[AGENDA REVISIONS]
YES, THANK YOU, MAYOR, I HAVE THREE AGENDA REVISIONS.REVISION NUMBER ONE IS THE REQUEST TO REMOVE ITEM NUMBER 12 FROM THE AGENDA.
THE NEXT ITEM IS CONSIDERATION OF IN ADDITION TO NEW BUSINESS, THIS WILL BE A NEW BUSINESS ITEM NUMBER FOR CONSIDERATION OF SUBMITTING A GRANT APPLICATION THROUGH THE NATIONAL POLICE DOG FOUNDATION OR A POLICE VEHICLE, CANINE HEAT ALARM KIT.
AND THE THIRD IS AT THE REQUEST OF COUNCIL MEMBER BAILEY CONSIDERATION OF HONORING REVEREND RICHARD SPELMAN, WHICH HAS BEEN ADDED AS ITEM FIVE FOR NEW BUSINESS.
[CONSENT AGENDA]
EVERY MAYOR OR ANY PUBLIC COMMENT CARDS FOR ITEM AGENDA ITEM NUMBER 14, PULL FROM THE CONSENT.MAYOR, I CLARIFY THE ITEM THAT I MENTIONED, ITEM 12, I MAY HAVE USED THE WORD REMOVE, I MEANT TO WITHDRAW, FULLY REMOVE IT FROM THE AGENDA, SO NOT PULL IT OFF OF THE AGENDA.
I JUST WANT TO BE CLEAR WHO ACTUALLY REMOVED.
THANK YOU. CONSENT NUMBER TWO WAS GOING TO BE A CLARIFICATION ON THAT ONE DISCOURSE.
NUMBER TWO, THERE WAS A TYPO AND ERROR IN THE, UH, ONE OF THE ATTACHMENTS, SO WE CAN CERTAINLY PULL THAT AND READ THAT OUT FOR THE RECORD.
LIKE. SO WHEN IS PULLING NUMBER TWO? TWO AND 14. I'M MAKING A MOTION I MAKE A MOTION TO APPROVE THE CONSENT AGENDA WITH THE REMOVAL OF ITEMS. NUMBER TWO AND NUMBER 14 AND WITH THE FULL REMOVAL OF ITEM NUMBER 12 FROM THE AGENDA COMPLETELY AND INCLUDING ADDING ITEM NUMBER FOUR UNDER NEW BUSINESS AND ADDING ITEM FIVE ON NEW BUSINESS. SECOND, WE'VE GOT A MOTION FROM DEPUTY MAYOR JOHNSON SECONDED BY COUNCILMAN BAILEY.
ANY DISCUSSION? HEARING NONE, I'M CALLING IT ALL IN FAVOR, I ANY OPPOSE PASSES UNANIMOUSLY. ITEM NUMBER TWO, OR AS YOU WERE, MADAM SMITH, RESOLUTION 2021, DEC.
16, A RESOLUTION, THE CITY OF HOLLAMBY, BREVARD COUNTY, FLORIDA, OMITTING RESOLUTION 2021, DASH FORTY NINE, AMENDED BY RESOLUTION 2021 ZERO FIVE, ADOPTED THE CLASSIFICATION AND PAY PLANS, THE POSITION CONTROL PLAN FOR EMPLOYEES OF THE CITY OF PALM BAY FOR FISCAL YEAR TWENTY TWENTY OR 2021.
RESCINDING RESOLUTIONS OR PARTS OF RESOLUTIONS CONFLICT HERE WITH PROVIDING FOR AN EFFECTIVE DATE RESOLUTION.
2021 TEXT SEVENTEEN RESOLUTION OF THE CITY OF PALM BAY COUNTY, FLORIDA, MEANING
[00:10:06]
RESOLUTION TWENTY TWENTY DASH FIFTY AS AMENDED BY RESOLUTION 2021, DASH ZERO SIX.ADOPTING THE FIVE YEAR CAPITAL IMPROVEMENTS PROGRAM FOR THE FISCAL YEAR.
TWENTY TWENTY THREE 2021 THROUGH TWENTY TWENTY FOUR THROUGH TWENTY TWENTY FIVE FOR THE CITY OF PALM BAY, FLORIDA, PRECEDING RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT YEAR WITH PROVIDING FOR AN EFFECTIVE DATE.
AND NUMBER TWO, COUNCIL MEMBER.
I'LL PASS IT TO MS. SHERMAN FIRST, SECOND. THANK YOU, SIR.
I'D LIKE JULIA MOSCONE, OUR CHIEF PROCUREMENT OFFICER, TO COME UP.
WE DID DISCOVER COUNCIL MEMBER LEE POINTED OUT AN ERROR IN ONE OF OUR SPREADSHEETS WILL ALLOW MS. MOSCONE TO EXPLAIN THAT A LITTLE BIT AND CLARIFY THAT FOR COUNCIL.
GOOD EVENING, JULIA MOSCONE, CHIEF PROCUREMENT OFFICER COUNCIL.
I APOLOGIZE, THERE IS A TYPOGRAPHICAL ERROR ON THE ATTACHMENT TO THIS AGENDA ITEM BE SCORING IN RANKING FORM.
IF YOU TURN TO THE FIRST PAGE, WHICH HAS A SUMMARY OF ALL THE TOTALS, THE POINTS WERE COST WAS WORTH UP TO THIRTY FIVE.
BUT THE CALCULATION WAS THAT WAS PROVIDED IN YOUR PACKAGE WAS BASED ON TWENTY FIVE.
SO THE CORRECTION WOULD BE AMILA POOLS RECEIVED THIRTY FIVE POINTS, NOT TWENTY FIVE.
CLOSE CONSTRUCTION RECEIVED THIRTY THREE POINT FIVE, TWO POINTS, NOT TWENTY THREE POINT NINE. FOR THE NEW TOTALS WOULD BE AMILA POOLS AS THE HIGHEST RANKED AND RECOMMENDED FIRM HAS EIGHTY EIGHT POINTS IN CLOSED CONSTRUCTION HAS SEVENTY ONE POINT FIVE TWO POINTS.
AND I DIDN'T I DIDN'T HAVE ANY MORE QUESTIONS, BUT IT WAS ONE OF QUESTIONS I DID ASK JUST FOR THE COUNCIL'S KNOWLEDGE IS ONE OF THE THINGS I WAS CURIOUS ABOUT WAS WE HAD A BUDGET SET FORTH FOR FOR THE SLIDE.
WE HAVE WENT OVER THAT BUDGET OF WHAT WE EXPECTED IN THE COST.
MY UNDERSTANDING IS WE WERE ELIMINATING ANOTHER PART OF THE PROJECT THAT THE COVERING CRACKED IN ORDER TO MAKE UP.
FOR THAT, WE'RE LOSING PART OF IT.
AND ONE OF MY QUESTIONS, WHICH YOU FEEL FREE TO ANSWER MORE NOW, FOUR COUNTS OF YOUR WISH WAS NOW WHAT DID WE LOOK AT, SAY, ONCE WE REALIZED THAT THE COST WAS GOING TO BE MUCH HIGHER, THAT WE LOOK AT A LOWER COST SLIDE OPTION SO THAT WE COULD DO ALL THE PROJECT WITHIN THE BUDGETS THAT WE HAD.
THERE IS NOT AN OPPORTUNITY AT THIS MOMENT IN TIME TO REVISE THE PROPOSALS AS SUBMITTED, IT JUST SIMPLY WOULDN'T BE FAIR.
THE INITIAL PROPOSAL WAS THE REQUEST TO REPLACE REPLACE LIKE WITH LIKE.
SO I'M GOING TO INFORMALLY DESCRIBE IT AS TWO TWISTS, OK, DUMPING OUT INTO THE POOL AND BOTH PROPOSALS THAT WE RECEIVED REPLACE THAT.
IN SPEAKING WITH THE HIGHEST RANKED FIRM, THEY TWO FACTORS I BELIEVE AFFECTED THE PRICE.
ONE. THERE IS A SHARP RISE IN COST OF MATERIALS.
EVEN THE MANUFACTURER HAS SAID THAT THE COST OF PLASTIC, THE COST OF FUEL HAS SIGNIFICANTLY IMPACTED THE RAW MATERIAL PRICING RELATED TO THIS.
I BELIEVE THE INITIAL BUDGETARY QUOTE WAS SEPTEMBER, OCTOBER IN THAT TIME FRAME.
THE OTHER THING IS I ACTUALLY BELIEVE THAT IN SOME WAYS WE ARE POTENTIALLY SAVING MONEY BECAUSE THIS PROPOSAL REUSES THE EXISTING FOOTINGS, BECAUSE THE SLIDE THAT IS BEING PROPOSED IS FROM THE EXACT SAME MANUFACTURER FROM WHEN THE POOL WAS ORIGINALLY CONSTRUCTED BY BREVARD COUNTY IN TWO THOUSAND AND THREE, I BELIEVE.
SO THEY'RE GOING TO, OF COURSE, CORE SAMPLE AND DO THEIR DUE DILIGENCE OF ENGINEERING INSPECTIONS. BUT THE INTENT IS TO REUSE THE EXISTING FOOTINGS.
MOTIONAL WAR PROPOSAL TO OFFER MILLAR'S PAUL'S LLC THAT CAN.
A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN FOSTER, ANY FURTHER DISCUSSION IN MAYOR I WILL JUST HIGHLIGHT IT'S INTERESTING, SLIGHTLY TANGENT.
WE'VE BEEN HAVING CONVERSATIONS.
I'VE BEEN IN WITH THEM WITH MAYOR SHERMAN SINCE THE BEGINNING OF THE YEAR.
I THINK I MISSED ONE OF THOSE THE BIG MEETINGS WITH THE REPUBLIC.
AND PART OF THAT HAS BEEN THE RECYCLING OF OUR TRASH BINS FROM WASTE MANAGEMENT.
WHAT'S BEEN INTERESTING IS TO LEARN THAT ESSENTIALLY IN THE FIRST ROUND WE ALMOST BROKE EVEN AND GOT NOTHING FROM THAT AT THE COST OF MATERIALS FOR PLASTIC IS GOING UP.
SEEMS TO ME THAT THE COST OR THE VALUE OF RECYCLED PLASTIC SHOULD BE GOING UP ALONG WITH IT. SO I JUST WANT TO POINT THAT I JUST KIND OF JUST POPPED IN MY HEAD AND TO THAT THAT SHOULD BE PAID ATTENTION TO.
BUT SHORT OF SAYING THAT, I JUST WISH THAT WE WOULD HAVE FOUND A WAY OF DOING ALL OF IT IN ONE IN ONE SWOOP.
I'M STILL ON THE FENCE OF IT EITHER WAY, BUT I MEAN, I'LL SUPPORT IT TONIGHT, LOL.
NO, I THINK COUNCIL'S GOING TO SUPPORT A ROLE FOR FORWARD, BUT IT WOULD HAVE BEEN MY
[00:15:04]
INTENT TO REDUCE THE SCOPE OF IT OR MAYBE REVISIT THE SCOPE OF IT.BUT GIVEN THE FACT THAT PRICES ARE GOING UP, I DON'T KNOW IF THIS IS THE RIGHT TIME TO DO THAT. SO I'LL SUPPORT IT.
I APPRECIATE THE BREAKDOWN, ANY FURTHER DISCUSSION.
ALL IN FAVOR, I ONLY OPPOSE PASSES UNANIMOUSLY.
MOVING ON TO ITEM 14, MR. BILL BURTON. WOOLVERTON 586 OCEAN SPRAY STREET SOUTHWEST.
OR A LAWFUL SOCIETY OR WHAT WE CALL RULE OF LAW.
WITH THAT MINDSET, WE RELY ON A THIN BLUE LINE.
WITHOUT THAT THIN BLUE LINE, WE WILL BE A SOCIETY OF LAWLESS LAWLESSNESS AND WE WILL TURN INTO A SOCIETY OF ANARCHY.
SO, YOU KNOW ME, I SOMETIMES SPEAK OUT OF HOW MONEY IS SPENT.
WE CANNOT KEEP LAW ENFORCEMENT THAT WE HAVE.
THEY'RE GOING TO DIFFERENT LOCATIONS AND THEN TRYING TO FIND MEMBERS OF SOCIETY THAT WANT TO BE IN LAW ENFORCEMENT NOW IS TURNING EVEN HARDER AND HARDER.
SO I PERSONALLY HAVE, EVEN THOUGH I'VE HAD TO CROSS THAT THIN BLUE LINE ONCE OR TWICE AND THEY LET ME KNOW ABOUT IT, I'M NOT GOING TO HOLD THAT AGAINST THEM.
BUT I DO REALIZE ULTIMATELY WHAT THE LAW ENFORCEMENT DOES NOW, THAT'S PROTECTION OF US AS A SOCIETY. SO I THINK THIS IS GOING TO BE MONEY WELL SPENT.
AND IF WE CAN KEEP THOSE RECRUITS IN THE CITY OF PALM BAY BECAUSE THEY HAVE AN OPPORTUNITY TO GO OTHER PLACES AND WE DON'T GET ENOUGH TO MAINTAIN OUR FORCE, WE'RE GOING TO SUFFER. SO I THINK THIS IS GOING TO BE MONEY WELL SPENT.
MAKE A MOTION AND CELEBRATION OF PREPARATION OF GENERAL FUND AND DESIGNATED FUND BALANCE FOR EXPENDITURES TO COVER THE JULY POLICE ACADEMY COSTS FOR SPONSORSHIP AND CONCERT BY RECRUITS ABOUT THIRTY FIVE THOUSAND ONE HUNDRED AND FIFTY DOLLARS PER SECOND.
I'VE GOT A I'VE GOT A MOTION BY COUNCIL MEMBER BAILEY AND I BELIEVE I HEARD WITH THE COUNCILMAN FORCER FELIX.
AS YOU WERE, I HAVE A MOTION BY COUNCIL MEMBER BAILEY IN A SECOND BY COUNCILMAN FELIX.
ANY FURTHER DISCUSSION, GENTLEMEN? AND SEEING NONE.
ALL IN FAVOR, I OPPOSE PASSES UNANIMOUSLY.
WE'RE ON THE POINT OF PRESENTATIONS AND OUR CHIEF OF POLICE.
[PRESENTATIONS]
WE'LL BE PROVIDING AN UPDATE REGARDING PANHELLENIC.THE EVENING AGAIN, MR. MAYOR, COUNCIL, THANK YOU FOR ALLOWING ME TO COME UP HERE AND GIVE YOU A BRIEF UPDATE, BUT BEFORE I START, JUST A COUPLE OF THINGS THAT ARE IMPORTANT FOR ME TO MENTION, AND I WOULD BE REMISS IF I DIDN'T SEIZE THIS OPPORTUNITY TO BRING IT TO LIGHT. LAST FRIDAY, WE LOST FORMER POLICE CHIEF OF THIS CITY, BOB ROSSMAN OF CROSSMAN SERVED US FROM NINETEEN EIGHTY EIGHT TO NINETEEN NINETY FOUR.
HE WAS AN EXEMPLARY LEADER IN OUR ORGANIZATION.
HE MADE HIS MARK AND HIS CONTRIBUTIONS NOT ONLY TO OUR AGENCY, BUT TO OUR CITY AND AS A 19 YEAR OLD YOUNG MAN WITH VERY LITTLE TO OFFER.
HE WAS THE ONE WHO TOOK A GAMBLE AND A CHANCE AND HIRING WAS TRULY.
AND SO I AM FOREVER GRATEFUL FOR HIM AND HIS FAMILY, FOR HIS CONTRIBUTIONS IN PUBLIC SAFETY. SO I WANTED TO MAKE SURE THAT THE PUBLIC KNEW THAT NO.
NUMBER TWO, THIS IS NATIONAL TELECOMMUNICATING WEEK.
WE DON'T WANT TO TAKE A MOMENT TO THANK MY TELECOMMUNICATIONS, OUR DISPATCHERS, FOR THE WONDERFUL WORK THEY DO FOR THIS COMMUNITY DAY IN AND DAY OUT AS FIRST RESPONDERS.
AS YOU KNOW, I'VE STOOD HERE BEFORE YOU AND TOLD YOU HOW I SEE THEM AS FIRST RESPONDERS AND THE FIRST LINE OF CONTACT WITH OUR CITIZENS AND THE GREAT WORK AND DEDICATION THAT THEY SHOW AND SHOWCASE TO THIS COMMUNITY EVERY DAY AND EVERY NIGHT.
THEIR LEADER, MEGAN SALANDER, IS AN EXEMPLARY MANAGER WHOM I'M GRATEFUL FOR HER LEADERSHIP, AND I WANT TO CONGRATULATE THEM AND THANK THEM FOR THEIR DEDICATION.
THANK YOU. AND I CAN'T IGNORE MR. BATTENS COMMENTS, AND I THANK YOU, SIR, FOR THOSE WORDS.
ALL RIGHT, SO TONIGHT I'M HERE TO GIVE YOU AN UPDATE ON THE PANHANDLING ISSUE THAT IS A SURGING ISSUE NOT ONLY IN OUR CITY, BUT THROUGHOUT THIS COUNTRY, CERTAINLY IN OUR NEIGHBORING COMMUNITIES. THIS IS AN ISSUE THAT EACH MUNICIPALITY STARTING TO CONTEND
[00:20:03]
WITH. I HAVE PERSONALLY SPOKEN TO CHIEF GILLISPIE, CHIEF WILEY, AND WE BOTH SHARE A COMMON CONCERNS. THIS IS AN ISSUE THAT REQUIRES VERY CAREFUL BALANCE AND A CAUTIOUS APPROACH, BECAUSE ALTHOUGH WE'RE DEALING WITH A PUBLIC SAFETY ISSUE, WE'RE ALSO DEALING WITH A HUMANITARIAN ISSUE IN THAT WE'RE DEALING WITH A SECTOR OF OUR POPULATION THAT IS OFTEN CALLED HOMELESSNESS.NOW, I WILL ALSO POINT OUT THAT HOMELESSNESS DOESN'T ALWAYS EQUATE TO PANHANDLING.
THAT'S IMPORTANT FOR ME TO KNOW, BECAUSE WHAT WE HAVE FOUND OUT THROUGH OUR CONTACTS IS THAT WE ALSO HAVE FOLKS WHO ARE HOUSED OR ACTIVELY INVOLVED IN THE BUSINESS OF PANHANDLING. SO I WANT TO MAKE SURE THAT THAT THAT WE DON'T MAKE THE THE CONNECTION THAT PANHANDLING IS ALWAYS A HOMELESSNESS ISSUE, BUT IT OFTENTIMES HAS A NEXUS.
SO I'D BE REMISS IF I DON'T MENTION THAT.
HAVING SAID THAT, I'M GOING TO GIVE YOU KIND OF A SNAPSHOT UPDATE ON WHAT OUR HOMELESSNESS SITUATION STANDS CURRENTLY AND THEN TRANSITION ON TO WHAT PANHANDLING LOOKS LIKE TODAY. SO OUR ESTIMATED POPULATION OF OUR HOMELESS SITS ROUGHLY AROUND ONE HUNDRED FOLKS. THAT IS A CONSISTENT NUMBER THAT WE'VE HAD NOW FOR SEVERAL MONTHS.
BUT THAT IS ALSO A ROUGH ESTIMATE BECAUSE THE HOMELESS POPULATION TENDS TO BE VERY TRANSIENT AND OFTENTIMES, PARTICULARLY THOSE THAT ARE ENCAMPED, THEY MOVE THEIR CAMPS FOR MANY REASONS, SAFETY BEING ONE OF THEM.
SO IT'S DIFFICULT FOR US TO ALWAYS HAVE A PRECISE COUNT BASED ON OUR CONTACTS AND OUR COMMUNICATION WITH OUR PARTNERS.
OUR BEST ESTIMATE TODAY SITS NEAR ONE HUNDRED.
SOMETIME IN MAY OF TWENTY TWENTY, WE ESTABLISH A CALL FOR SERVICE, IN FACT, IT WAS MR. TOM REDMAN WHO HAD SOME DISCUSSION WITH US AND WE AGREED THAT WE NEEDED TO ESTABLISH A CALL FOR SERVICE THAT CAPTURED THE PANHANDLING ACTIVITIES IN OUR CITY.
AND WE DID SO. BEFORE I GO INTO WHAT THE RESULTS OF THAT IS, OUR CONTINUED EFFORTS WITH OUR PARTNERS IS ONGOING.
WE RECENTLY HAD YET ANOTHER MEETING WITH ALL OUR PROVIDERS, OUR SERVICE PROVIDERS.
ONE OF THEM SITS IN OUR AUDIENCE TONIGHT.
AND LET ME JUST GO OVER TO SOME OF THOSE FOLKS ARE BECAUSE THEY ARE ACTIVELY INVOLVED IN THIS COMMUNITY IN GIVING BACK AND PROVIDING SERVICES TO THOSE THAT ARE ACUTELY HOMELESS.
ON THE LEFT HAND COLUMN, YOU SEE OUR FAITH BASED ORGANIZATIONS, LOCAL CHRISTIAN CHURCH, CENTERPOINT, CHURCH, TRUTH REVEALED MINISTRIES AND IF I MAY POINT OUT TRUTH REVEALED AS OFFERED TO ONCE AGAIN BE THE COLD NIGHT SHELTER IN OUR CITY THAT IS IMPORTANT FOR OUR HOMELESS POPULATION TO HAVE A PLACE TO GO THOSE NIGHTS THAT ARE BELOW 40 DEGREES.
AND OUR LADY OF GRACE CONTINUES TO BE A PROVIDER ON THE RIGHT.
ASIDE FROM THE HOMELESS COALITION, WHICH REMAINS ACTIVE, YOU HAVE HUMANITY VILLAGE, COMMUNITY OF HOPE, DAILY BREAD FOR SURE.
THE SOUTH OF OUR SHARING CENTER, VOLUNTEERS OF AMERICA AND STREETSIDE SHOWERS, ALL ARE ACTIVE IN OUR COMMUNITY RENDERING SERVICES.
OK, NOW LET'S GET BACK TO THE ISSUE OF PANHANDLING, BECAUSE NOW WE HAVE SEEN AN UPTAKE AND CALLS FOR SERVICE, CALLS FOR SERVICE, THAT PREDOMINANTLY, AS IT TURNS OUT, ARE COMING FROM OUR CITIZENS, BOTH A MIXTURE OF MOTORISTS AND PROPERTY OWNERS, PARTICULARLY BUSINESS OWNERS. WHAT WE DISCOVERED IS THAT WE DO HAVE AN ORDINANCE IN THE BOOKS AND WE'VE KNOWN THIS ORDINANCE HAS BEEN IN THE BOOKS FOR SOME TIME.
THE CONSTITUTIONALITY OF THIS ORDINANCE IS WHAT IS IN QUESTION.
WE FEEL LIKE THE CONSULTATION WITH THE CITY ATTORNEY THAT THIS CITY ORDINANCE IN OUR BOOKS IS DEFENSIBLE AND ALSO ENFORCEABLE.
BUT IT IS HOW WE ENFORCE IT, WHERE WE WILL MAKE OUR MARK, FOR EXAMPLE.
IN SUMMARY, THIS ORDINANCE ALLOWS US TO REMOVE FOLKS THAT ARE AT OUR INTERSECTIONS.
AND IF THEY FAIL TO ABIDE BY THAT, BY THAT LAW, WE CAN ENFORCE THE LAW AND ULTIMATELY MAKE AN ARREST FOR A MISDEMEANOR.
THAT HAS ALWAYS, AS YOU KNOW, NOT BEEN A DESIRE OF US TO ARREST A WAY OUT OF AN ISSUE THAT HAS TO DO WITH THE HOMELESS, WE SEEK FOR OTHER WAYS TO ACHIEVE COMPLIANCE.
WE'VE COME BEFORE YOU AND TALKED ABOUT THE TRESPASSING ISSUE THAT HAS BECOME A HOT ISSUE OF DEBATE AND TOPIC AND.
THE AMOUNT OF WORK THAT GOES INTO ANY ONE TRESPASS WARNING THAT WE SADLY SOMETIMES HAVE TO ISSUE, WELL, SIMILARLY IN PARALLEL.
THE PANHANDLING ISSUE NEEDS TO BE ADDRESSED THE SAME, SO THE ORDINANCE SITS IN OUR BOOKS.
AND ACCORDING TO OUR CITY ATTORNEY, WHICH I RELY ON A GREAT DEAL.
SHE IS CONFIDENT THAT IT IS DEFENDABLE.
LET ME GIVE YOU AN OVERVIEW OF OUR PANHANDLING SITUATION IN OUR CITY.
AND AGAIN, THE CITY OF MELBOURNE IS GOING THROUGH THE SAME ISSUE, THE CITY OF WEST MELBOURNE IS GOING TO BE THE SAME ISSUE IN BOTH SURROUNDING COMMUNITIES ARE SEEKING FOR WAYS TO ADDRESS IT.
[00:25:01]
WE SAID AT SIXTY SIXTY EIGHT CAR SERVICE SINCE MAY OF TWENTY TWENTY.SURPRISINGLY, HOW DO THOSE FIFTY SEVEN OF THOSE WERE ACTUALLY GENERATED BY MOTORISTS OR PEOPLE? ONLY A HANDFUL OR 11 WERE ACTUALLY GENERATED BY OUR POLICE OFFICERS WHO INITIATED A CONTACT WITH SOMEONE PANHANDLING.
IT BREAKS THAT OUT FURTHER, YOU CAN SEE TWENTY THREE INCIDENTS WHERE FOLKS THAT WERE HARASSING INDIVIDUALS.
SO WE'RE FOCUSING ON A COUPLE OF THINGS.
WE'RE FOCUSING ON AGGRESSIVE PANHANDLING, AGGRESSIVE PANHANDLING.
WE DEFINE AS THAT TYPE OF PANHANDLING THAT LEAVES THE PERSON IN FEAR OF THEIR SAFETY BASED ON THE PANHANDLERS BEHAVIOR AND OVERALL DEMEANOR.
AND, OF COURSE, ANYTHING THAT INTERFERES WITH OUR FLOW OF TRAFFIC THAT CAN CAUSE YET ANOTHER SET OF ISSUES REGARDING TRAFFIC ACCIDENTS.
AND AS YOU KNOW, TRAFFIC RELATED ISSUES CONTINUE TO BE OUR NUMBER ONE CONCERN IN OUR CITY. IT GOES DOWN THE LIST, THREE OF THOSE INCIDENTS WERE FOLKS WALKING INTO THE STREET.
FIFTY SEVEN INCIDENTS WERE GENERATED FROM CITIZEN COMPLAINTS, EITHER BUSINESS OWNERS OR EMPLOYEES OF BUSINESSES.
THIRTY FOUR WERE GENERATED AT MAJOR INTERSECTIONS.
IN FACT, THAT IS THE NUMBER ONE THING THAT WE'RE TRYING TO ADDRESS.
WE HAVE TO ADDRESS THIS ISSUE INCREMENTALLY.
AND I'LL GO INTO THAT IN THE NEXT FEW MINUTES, BECAUSE, AS YOU CAN IMAGINE, ONCE WE ADDRESS THE INTERSECTIONS, THE NATURAL LAW OF DISPLACEMENT WILL OCCUR AND WE'LL HAVE TO BE PREPARED TO ADDRESS THAT.
AND THAT WILL REQUIRE YOUR LEADERSHIP.
WHEN HE ONE OF THOSE ARE STANDALONE BUSINESSES SUCH AS GAS STATIONS AND WAL-MART AND 11:00 AT SHOPPING CENTER.
THIS BREAKS IT DOWN. THIS IS A VISUAL THAT GOES BACK TO FROM MAY TO DECEMBER OF TWENTY, TWENTY FORTY TWO CUSTOMER SERVICE.
2021 TWENTY SEVEN CUSTOMER SERVICE YEAR TO DATE.
SO CURRENTLY, THE VIOLATIONS AT INTERSECTIONS, WE HAVE TO FOLLOW THE ESTABLISHED PROTOCOLS, SO THE CITIZEN.
OR EVEN AN OFFICER OBSERVES A PERSON PANHANDLING AT AN INTERSECTION AS OUR MAIN FOCUS, WE'RE GOING TO RESPOND. WE'RE GOING TO EDUCATE THE INDIVIDUAL WHO INCIDENTALLY, WE'VE BEEN IN AN EDUCATIONAL BLITZ FOR A WEEK AND A HALF NOW.
OUR GOAL IS TO GET THE WORD OUT IS AS MUCH AS POSSIBLE OF OUR INTENTION TO NOW START LOOKING AT THE ENFORCEMENT OF THE ORDINANCE, IF NEED BE.
BUT WE'RE TRYING TO GAIN COMPLIANCE FROM OUR HOMELESS POPULATION.
AND THE GOOD NEWS IS THAT WE HAVE.
SO WE WILL FIRST EDUCATE, PERHAPS EVEN GIVE A COPY OF THE ORDINANCE TO THOSE THAT WE COME IN CONTACT WITH. WE WILL ENTER INTO OUR DATABASE THE RESULTS OF THAT CONTACT, BECAUSE IT THEN BECOMES SEARCHABLE, SO IF I COME ACROSS THE SAME INDIVIDUAL YET AGAIN, WE CAN QUERY OUR DATABASE AND SEE WHAT, IF ANYTHING, HAS BEEN DONE WITH THIS INDIVIDUAL THUS FAR.
AND THEN TAKE ACTION FROM THERE ON A SECOND TIME, IF WE HAVE TO SPEAK TO AN INDIVIDUAL.
WE WILL NOW WARN THEM OF WHAT WILL HAPPEN IF WE SEE IT AGAIN AND THEN THE THIRD TIME WE ALLOW OUR OFFICERS TO EXERCISE THEIR DISCRETION.
WHAT THAT MEANS, AS YOU KNOW HOW I FEEL ABOUT THIS QUESTION, REMAINS TO BE SEEN.
THE OFFICER HAS THE ABILITY TO OFFER COPIOUS OR HE CAN DO A NOTICE TO APPEAR AND OR A PHYSICAL CUSTODY ARREST.
I'M HOPING THAT THROUGH OUR EDUCATIONAL EFFORTS AND PREVENTION THAT WE CAN GET COMPLIANCE BEFORE ENFORCEMENT.
VIOLATIONS ON PRIVATE PROPERTY.
NOW LET'S TALK ABOUT THE RULE OF DISPLACEMENT, ANY TIME YOU ADDRESS AN ISSUE IN ONE AREA, IT TENDS TO DISPLACE THE PROBLEM ELSEWHERE.
WE EXPECT THAT THIS SITUATION WILL HAPPEN HERE AS WELL.
ULTIMATELY, THOSE THAT ARE PANHANDLING, PARTICULARLY THOSE THAT ARE IN NEED, WILL GO ELSEWHERE TO TRY TO GET MONEY TO MEET THEIR NEED, WHICH BRINGS IN OUR COALITION AND OUR PARTNERS, BECAUSE WE'RE ALSO HOPING THAT AS WE ADDRESS THE PANHANDLING, THAT THERE WILL BE AN INCREASE IN THOSE SERVICES THAT THE FOLKS ACTUALLY ACCEPT.
OFTENTIMES, WE HAVE AN ISSUE THAT THOSE ARE PANHANDLING.
IT BECOMES SO CUSTOMARY FOR THEM TO TO MAKE QUASI LIVING THAT THEY DON'T TAKE FULL ADVANTAGE OF THE MANY RESOURCES THAT ARE AVAILABLE IN OUR COMMUNITY.
WE'RE HOPING THAT IN AND SO ENFORCING AND SO MAKING SURE THERE'S COMPLIANCE WITH OUR ORDINANCE THAT THAT THEY ACTUALLY TAKE ADVANTAGE OF THE SERVICES RENDERED BECAUSE IT MAY LEAD TO A PATH TO HOUSING.
VIOLATIONS OF PRIVATE PROPERTY IS WHAT WE EXPECT TO SEE NEXT AS THEY COME OFF THE INTERSECTIONS, IT WILL LIKELY BE A RISE IN THEM GOING TO OUR COMMERCIAL CORRIDORS, OUR PLAZAS. WE, AS YOU KNOW, DON'T HAVE A DEDICATED CONCENTRATE DOWNTOWN, BUT WE HAVE A SEVERAL COMMERCIAL CORRIDORS SPREAD OUT THROUGHOUT OUR CITY.
WE ANTICIPATE THAT WE WILL SEE FOOT TRAFFIC PANHANDLING ON THAT PRIVATE PROPERTY.
HOW WE HANDLE THAT IS WE CAN GET A LITTLE A LITTLE DICEY BECAUSE WE CURRENTLY REPRESENT
[00:30:03]
THE RIGHTS OF A PROPERTY OWNER UPON REQUEST.NOW, WHEN WE ISSUE A TRESPASS WARNING TO SOMEBODY AT A AT A SHOPPING PLAZA, IT IS TECHNICALLY FOR THAT ONE BUSINESS AND THE CURTILAGE THEREOF.
WHAT ABOUT THE REST OF IT? OTHER COMMUNITIES HAVE LEGISLATION IN PLACE THAT MAKES AN ASSUMPTION THAT THE CITY REPRESENTS THE INTERESTS OF PROPERTY OWNERS AND BUSINESSES UNLESS OTHERWISE STATED BY THE PROPERTY OWNER AS LEGISLATION THAT WE CONTINUE TO LOOK AT.
WE WILL CONTINUE TO HAVE DIALOG.
WE WILL ACCEPT YOUR LEADERSHIP BECAUSE WE NEED SOME GUIDANCE ON WHERE DO WE GO ONCE WE SEE THAT DISPLACEMENT.
CURRENTLY, OUR ONLY FORM TO TO COPE WITH THAT LEGALLY IS TO TRESPASS WARNING AND AS WE KNOW NOW, THE ISSUE OF TRESPASSING IS A HOT TOPIC, RIGHT? I DON'T WANT TO TRESPASS OUR WAY OUT OF THIS OUT OF THIS PROBLEM.
I WOULD RATHER THERE BE CONTINUED COORDINATION OF SERVICES SO THAT WE CAN DECREASE PANHANDLING RATHER THAN INCREASE TRESPASSING VIOLATIONS AND SUBSEQUENT ARREST THAT WILL ONLY STOCK OUR JAILS WITH MINOR VIOLATIONS WHILE REALLY ACCOMPLISHING VERY LITTLE.
SO WHAT REALLY NEEDS TO HAPPEN HERE IS A SYSTEM WHERE WE HAVE INCREASED SERVICES WHILE DECREASING PANHANDLING.
AND THAT'S WHAT WE ADVOCATE HERE.
SO AS OF APRIL 8TH, OUR COMMUNITY RESOURCE OFFICERS HAVE BEEN ACTIVELY BLITZING OUR STREETS, EDUCATING OUR FOLKS, WE SO FAR HAVE COMPLAINTS, VERBAL COMPLAINTS.
I'VE SEEN VERY LITTLE IN TERMS OF PANHANDLING IN OUR INTERSECTIONS OVER THE PAST WEEK, WEEK AND A HALF. BUT I STILL SEE IT IN NEIGHBORING AGENCIES.
AND AS MUCH AS I LIKE TO SAY THAT THERE'S A COORDINATED EFFORT, EACH RESPECTIVE MUNICIPALITY MAY SEE THIS ISSUE A LITTLE DIFFERENTLY.
IN FACT, THE CITY OF MELBOURNE IS HOLDING A SPECIAL COUNCIL MEETING COMING UP SHORTLY ABOUT THIS ISSUE. SO THAT IS OUR OUR SNAPSHOT.
THAT IS OUR. UPDATE REGARDING PANHANDLING.
WE THINK THAT WE ARE TRENDING IN THE RIGHT DIRECTION BECAUSE WE WANT TO BE ABLE TO FIND THAT THAT BALANCE BETWEEN THE HUMANITY AND THAT OF PUBLIC SERVICE, PUBLIC SAFETY.
BUT WE STILL NEED TO HAVE FURTHER DIALOG AND DISCUSSION.
WHAT HAPPENS WHEN THE PROBLEM CONCENTRATES IN OUR COMMERCIAL CORRIDORS? SO THE EXPECTED CONSEQUENCES, AS I ALREADY MENTIONED, THE DECREASE IN PANHANDLING AT INTERSECTIONS, WHICH WAS OUR PRIMARY CONCERN GOING INTO THIS PROJECT.
NUMBER TWO, AS I AS I TOLD YOU, ALL THE DISPLACEMENT OF THE PANHANDLING AMONG THE COMMERCIAL QUARTERS WILL BE A CHALLENGE.
AND WE HOPE THAT AN ANTICIPATED CONSEQUENCE IS THAT THERE IS AN UPTICK IN THE ACCEPTANCE OF SERVICES SO THAT WE CAN DEAL WITH THIS IN ITS TOTALITY, NOT JUST THE ONE ASPECT THAT IS PANHANDLING. THAT THAT IS THE UPDATE AND I'M OPEN TO COMMENTS, QUESTIONS OR SUGGESTIONS. SURE. REPRESENTATIVE JOHNSON, THANK YOU, MAYOR, AND THANK YOU, CHIEF, AND THE REST OF PALM BAY P.D., I APPRECIATE EVERYTHING YOU'RE DOING.
AND I PERSONALLY HAVE NOTICED I DRIVE PARMLY ROAD EVERY DAY TO GO TO WORK.
AND I'VE PERSONALLY NOTICED A DIFFERENCE IN THE PAST WEEK AND A HALF PAST TWO WEEKS OF INDIVIDUALS ON THE MEDIAN.
AND THIS THAT WAS MY MAIN CONCERN WITH PANHANDLING, THE SAFETY FOR BOTH THEM AND OTHERS, BECAUSE WE KNOW PEOPLE ARE TEXTING AND DRIVING.
AND IF SOMEBODY JUST HITS THAT CURVE, THEN WE HAVE A DIFFERENT ISSUE ON OUR HAND.
ON TOP OF THAT. AND YOU LOOK AT WE WERE TALKING ABOUT OTHER MUNICIPALITIES AND OTHER INDIVIDUALS LOOKING AT, YOU KNOW, JUST PUTTING A BAND-AID OVER IT, LOCKING PEOPLE UP, DOING A FINE OR SOMETHING.
BUT I LOVE WHAT YOU'RE SAYING. WE'RE TRYING TO BE MORE PROACTIVE AND BEING MORE PROACTIVE. I KNOW BOVARD HOMELESS COALITION HAS A NEW EXECUTIVE DIRECTOR.
HAVE THEY REACHED OUT HER NAME, MA'AM? OK, WE'VE MET WE WE RECENTLY HAD A MEETING.
WE HAD ALL OUR PARTNERSHIP AND WE TABLED THIS VERY DISCUSSION AND WE WERE ALL IN AGREEMENT ABOUT WHAT OUR END GOAL IS HERE.
AND AS I STATED, IT IS TO TREAT IT AS AN OVERVIEW, AS AS AN OVERALL PERSPECTIVE ON HOW WE COPE WITH OUR HOMELESSNESS POPULATION, OF WHICH PANHANDLING IS AN ELEMENT OF.
AND AND I'LL CHECK I'LL JUMP IN ON TO THE NEXT MEETING, BECAUSE ANOTHER GOOD SOURCE TO USE THIS CAREER SOURCE IS THAT'S THAT'S THEIR JOB THERE TO HELP PEOPLE GET CAREER STARTED. AND SO I WOULD APPRECIATE YOU.
EVERYTHING YOU'RE DOING. I'M JUMPING ON THE NEXT MEETING, SEE IF CAREER SOURCE ARE INTERESTED IN WORKING TOGETHER AND TRY TO USE SOLUTIONS FOR ALL THESE INDIVIDUALS.
ENFORCE THE. THANK YOU, MAYOR.
CHIEF, HAVE YOU, UM, IS THIS ORDERED ORDINANCE LOOKED AT CHARITY GROUPS THAT.
[00:35:05]
AND IN THIS SECTION ASKS HIM FOR MONEY, MAYBE GIRLS CALL FIREFIGHTERS OR IF CHURCH GROUPS THAT YOU SEE IT IN HIS SECTION DOING CHRISTMAS TIME, THINGS LIKE THAT.THANK YOU. SO THAT THAT IS ACTUALLY A GREAT POINT THAT I FORGOT TO MENTION.
HERE'S A CAVEAT ABOUT OUR AUDIENCE, OUR AUDIENCE, IN ORDER FOR IT TO BE EFFECTIVE AND DEFENSIBLE, NEEDS TO BE.
ENFORCED CONSISTENTLY NEEDS TO BE APPROACHED CONSISTENTLY, MEANING ANY AND ALL GROUPS THAT ARE INTERSECTIONS ARE NOT THERE.
WE SEE THAT IN OUR POLITICAL PROCESS THAT ALLOWS FOR SOLICITATION, BUT NOT OUT AT INTERSECTIONS, ANYTHING THAT CAN CREATE A DISTRACTION TO THE MOTORISTS OR GOD FORBID, ANYBODY WALKING INTO TRAFFIC IS WHAT WE'RE TRYING TO AVOID.
COUNCIL MEMBER. I'M JUST CURIOUS.
HOW MANY REACTIONS THAT WE HAVE THAT'S INVOLVED THEM OR KNOW, EVEN IF IT'S JUST A CURSORY VIEW OF NO WORK, NO OF VERBALLY AMONG YOUR STAFF? HOW MANY ACTIONS HAVE BEEN CAUSED BY WHERE THERE WAS SOMEBODY THAT FENDER BENDER OR SOMETHING LIKE THAT? AND BAILEY, I CONGRATULATE YOU'RE ASKING ME SOMETHING I DON'T HAVE A CLEAR ANSWER ON. AGAIN, THAT'S A PIECE OF DATA THAT I THINK I CAN GET.
I THINK I CAN GET. BUT I WILL TELL YOU I'LL TELL YOU THAT IF WE HAD HAD AN ACCIDENT AS A RESULT OF A PANHANDLER, CHANCES ARE THAT WOULD HAVE REACHED MY LEVEL OF NOTIFICATION BECAUSE OF THE COMPLEXITY OF THE ISSUE.
I, HOWEVER, WOULD BE PRETTY CONFIDENT IN SAYING THE VERY MINIMUM WITH ANY.
YEAH, YEAH. I APPRECIATE THAT.
AND BY THE WAY, I DID SEE OUR OFFICERS STOPPED AT MALABAR AND BABCOCK LOOKED LIKE THEY'RE DOING SOME EDUCATION THAT SUPPOSEDLY IT'S A I JUST GET NERVOUS WHEN THEY'RE IN THAT THE SMALL MEDIANS THERE.
BUT THANKFULLY, IT DOESN'T SOUND LIKE WE'VE HAD ANY OF THOSE.
AND I AGREE. I THINK THAT PROBABLY WOULD HAVE PROBABLY NEVER HEARD ABOUT IT AT THIS POINT. BUT I JUST WONDER IF THERE'S BEEN, AGAIN, MAYBE NOT NOT A PERSONAL INJURY ISSUE OR LOSS OF LIFE, BUT IT'S A PROPERTY ISSUE, LIKE SOMEBODY GET IN A FENDER BENDER BECAUSE THEY'RE TRYING TO AVOID, YOU KNOW, SOMEBODY STEPPING IN FRONT OF THEM.
I MEAN, WHEN YOU LOOK AT THE ISSUE IN MELBOURNE.
MIDDLE OF THE NIGHT, I OFTEN HAVE BIKES CROSSING.
NO, NO, NOT AT THE PROPER INTERSECTION.
AND, YOU KNOW, YOU TAKE YOUR EYE OFF ONE SECOND.
NEXT THING YOU KNOW, YOU'VE GOT AN INJURY.
AND OF COURSE, THERE'S ALWAYS BEEN STORIES OF SOME INTENTIONAL ONES, OF THOSE, ESPECIALLY ON RIGHT HAND, TURN TO STUFF THAT WHENEVER YOU'RE SLOWING DOWN, THEY DON'T WANT TO GET KILLED. BUT, YOU KNOW, BUT THEY'RE LOOKING FOR SETUPS.
AND SO THOSE ARE CONCERNS THAT WOULD BE GOOD FOR US TO MITIGATE.
THAT IS ACTUALLY ANOTHER GOOD POINT, BECAUSE IN OUR DISCUSSION WITH OUR CITY ATTORNEY, THERE IS SOME DIALOG ABOUT IF WE ARE TO HAVE FURTHER LEGISLATION IN TERMS OF PANHANDLING IN GENERAL, WE CAN RESTRICT THE TIMES THAT WE ALLOW THAT BECAUSE OF THAT VERY CONCERN AND THE FACT THAT WE BELIEVE THAT ANYBODY THAT APPROACHES ANYBODY AFTER A CERTAIN TIME IS PROBABLY GOING TO GENERATE A NEGATIVE ENCOUNTER AND THAT CAN LEAD TO SOME DISASTER.
ULTIMATELY, FELIX. HERE SHE I JUST LIKE TO SAY THANK YOU FOR THE UPDATE.
I THINK ANY TIME WE APPROACH AN ISSUE IN THE SENSE WHERE WE'RE BEING PROACTIVE AND WE'RE CONSIDERING PREVENTION INSTEAD OF THE CURE, I THINK IT'S ALWAYS A GOOD MOVING IN THE RIGHT DIRECTION. SO, YOU KNOW, THANK YOU FOR APPROACHING IT IN SUCH MANNER.
AND HOPEFULLY WE CAN IMPROVE FROM THERE, SIR.
THANK YOU. CHIEF, MY COMMENTS ARE FIRST OF ALL, I WANT TO THANK YOU FOR YOUR PRESENTATION, WELL THOUGHT OUT OUR PRESENTATION AND GIVEN US A HUGE SPECTRUM AND DIFFERENCE OF HOW WE CONSIDER THE PANHANDLING ISSUE.
ONE OF THE ISSUES THAT I TEND TO AGREE WITH IS LOOKING AT THAT TYPE OF LEGISLATIVE EFFORT TO WORK ON BEHALF OF THE PROPERTY OWNERS.
I, FOR ONE, FEEL THAT THAT COULD EVEN HELP OUT PERHAPS EVEN OUR OUR CODE ISSUES AT TIMES THAT WE HAVE SQUATTERS.
I DO WANT TO ECHO WHAT COUNCIL HAS ALREADY PREVIOUSLY SAID.
I HAVE NOTICEABLY SEEN AND HANDLERS OFF THE MEDIUM ON PALM BAY ROAD AND MALABAR ROAD, WHICH I FREQUENT AROUND ALL THE TIME AS WELL, AND IT'S A VISUAL.
AND AS YOU KNOW, THERE HAVE BEEN SEVERAL, SEVERAL INSTANCES WHERE I THINK ONE LED TO AN ARREST, HOLLYWOOD, HOLLYWOOD PRIMARY RESIDENCE.
[00:40:01]
SO I'M ALL FOR PROTECTING LIFE.AND I BELIEVE EVEN THOUGH THEY'RE IN VIOLATION, IT'S ALIVE BECAUSE THEY THEY'RE ENDANGERING THEMSELVES AND ENDANGERING OTHERS.
SO I WOULD, FOR ONE, LOOK AT THAT LEGISLATIVE PIECE THAT YOU'RE YOU'RE REFERRING TO TO EQUIPPED US IN THE FUTURE.
THERE ARE OTHER COMMENTS AND AND QUITE FRANKLY, THE CITY OF MELBOURNE HAS EVEN SHARED THEIR ADAMANT.
PROCESS, THEY ARE GOING TO BE VISITING THIS IN A WORKSHOP, BUT THEY THEY WERE CONCERNED ABOUT INDIVIDUALS THAT ARE DOING THIS FOR A LIVING.
SO THOSE ARE THOSE ARE ISSUES THAT THEY'RE LOOKING AT.
AND IN THAT, YOU KNOW, I WANT TO FIGURE OUT HOW WHAT DO YOU SUGGEST? I MEAN, SOME PEOPLE, THAT'S HOW THEY GO TO WORK.
IT SOUNDS WEIRD FOR ME TO SAY THAT, BUT THEY ACTUALLY DO THAT AS A PROFESSION.
I THINK, LIKE I SAID EARLIER, THE ISSUE OF PANHANDLING HAS BEEN DEEMED BY THE SUPREME COURT AS PROTECTED FIRST AMENDMENT CONSTITUTIONAL RIGHT OF.
BUT THAT STILL DOESN'T MEAN THAT IN TERMS OF PUBLIC SAFETY THAT IT'S A FREE FALL.
WE REQUIRE REGULATION FOR ALL OF OUR BUSINESSES.
IF YOU ARE SO CHOOSING TO EXERCISE YOUR FIRST AMENDMENT RIGHT AND GO INTO THE BUSINESS OF PANHANDLING, I BELIEVE WE CAN THEN AS A CITY ENTITY, REGULATE WHAT IS BEST IN THE BEST INTEREST OF PUBLIC SAFETY, GIVEN THOSE PARAMETERS.
SO I AGREE WITH YOU WHOLEHEARTEDLY.
THAT'S WHY I WANTED TO MAKE IT KNOWN EARLY ON THAT THAT HOMELESSNESS DOESN'T ALWAYS NECESSARILY EQUATE TO PANHANDLING, BUT THERE IS A NEXUS, RIGHT? THANK YOU, CHIEF. ANY OTHER QUESTIONS FROM THE CHIEF? YEAH, YEAH, IT WAS HIM AND BAILEY MARRIAGE REAL QUICK.
I WAS JUST THINKING, AS SHERMAN MENTIONED, THAT I KNOW WE'VE HAD SOME CONVERSATIONS AS FOLKS WHO DO MAKE A HABIT OF THIS, WORKING FOR OTHERS AND SO FORTH.
WHAT TYPE OF RAQUE ARE THEY BRINGING IN? AND I THINK SHE MENTIONED THAT YOU GUYS HAD.
NO, BUT I WAS CURIOUS WHAT THAT WAS.
WHAT KIND OF WHAT, SIR? WHAT ARE THEY BRINGING IN WHEN THEY SAY THEY'RE OUT THERE? YOU KNOW, IT VARIES. AND A LOT OF THIS IS JUST WORD OF MOUTH AND WHAT THEY SELF REPORT.
BUT IT HAS BEEN BROUGHT TO MY ATTENTION THAT WE HAVE, FOR EXAMPLE, ONE PERSON.
OH, AND I'LL SAY THIS, WHO SADLY AND UNFORTUNATELY USES THE BUSINESS OF PANHANDLING ALONG WITH THEIR CHILD OR GRANDCHILD IS ONE OF THE TWO WHICH IS TROUBLING TO ME.
AND AND THAT PERSON HAS BEEN OFFERED COUNTLESS TIMES EVERY RESOURCE AVAILABLE IN THIS COMMUNITY, NOT ONLY BY US, BUT BY OUR PROVIDERS.
AND THAT PERSON HAS PUSHED US AWAY EVERY SINGLE TIME WHILE TELLING, MAKING IT KNOWN THAT THAT PERSON IS MAKING UPWARDS OF 500 DOLLARS A DAY.
LASTLY, I WANT TO THANK ALISSA BERMUDAS FOR ACTUALLY MAKING THIS PRESENTATION FOR ME.
IF YOU KNEW, IT'S NOT EASY TO MAKE A PRESENTATION FOR ME BECAUSE I CHANGE IT AT THE VERY LAST SECOND. SO I WANT TO THANK HER AND CERTAINLY THANK THE LEADERSHIP OF OUR COMMAND STAFF FOR ALL THEIR EFFORTS AND HANDLING JUST THIS ONE ISSUE ALONE.
THANK YOU, THANK YOU, THANK YOU, LISA.
WE'RE AT THE POINT ON THE AGENDA WHERE PUBLIC COMMENTS, DEPUTY MAYOR JOHNSON PASSED A
[PUBLIC COMMENTS/RESPONSES]
KINDERGARTEN. MAYOR COUNCILMAN KENDEL GOT A ONE FIVE FOUR ANGELIL ROAD SOUTH EAST PALM BAY, FLORIDA, AT THIS BEAUTIFUL CITY AND SO THANKFUL TO BE HERE TONIGHT.TODAY IN HONOR OF RICHARD SPELMAN.
WANT TO HONOR HIM FOR HIS LOVE TOWARDS THE CITY, TOWARDS THE COUNCIL MEMBER MEMBERS AND TOWARDS PEOPLE. AND SO IN HONOR OF HIM, I THINK I WILL GO AHEAD AND READ A SCRIPTURE.
I WANT TO WELCOME EACH AND EVERY ONE OF YOU TO THE MINISTRY.
AS I RECALL, YOU MINISTERS IN SOME COUNTRIES, THEY CALL IT A MINISTRY OF DEFENSE, THE MINISTER OF EDUCATION, SOMETIMES THE LAW, THE HOUSE OF LORDS, REPRESENTING AUTHORITY.
AND SO IN ROMANS CHAPTER 13 VERSE FOR THOSE IN AUTHORITY ARE GOD'S SERVANTS FOR THE GOOD OF SOCIETY. AND SO I JUST WANT TO SAY, FIRST OF ALL, THAT YOU ARE IN THE MINISTRY NOW, IN SOME SENSE YOU ARE PASTORING ONE HUNDRED AND TWENTY TWO THOUSAND PEOPLE.
AND SO WITH THAT, OBVIOUSLY, THERE'S A GREAT RESPONSIBILITY.
AND SO I WANT YOU TO KNOW THAT WE AS A CHURCH PRAY FOR YOU.
AND WE DO PRAY THAT THE WISDOM OF GOD, WHICH THE INVOCATION WAS AMAZING, BUT THAT THE WISDOM OF GOD WOULD REST ON EACH AND EVERY ONE OF YOU, BECAUSE I KNOW THAT YOU ARE HERE
[00:45:06]
FOR THE GOOD OF THE PEOPLE.I KNOW THAT YOU'RE HERE TRYING TO MAKE THE BEST DECISION POSSIBLE.
AND I'D JUST LIKE TO SAY THAT THE BEST DECISION POSSIBLE IS ALWAYS WHEN WE ACKNOWLEDGE FIRST GOD AND SAY GOD, GIVE US WISDOM IN JAMES CHAPTER ONE, IT SAYS VERY SPECIFICALLY, IT SAYS, IF YOU LACK WISDOM, ASK AND GOD WILL GIVE IT LIBERALLY AND WE WILL NOT WITHHOLD THAT WISDOM. SO TODAY, I JUST WANT TO BLESS YOU, LET YOU KNOW THAT YOU ARE THOUGHT OF, YOU ARE PRAYED FOR, YOU ARE LOVED.
WE ARE THANKFUL FOR YOU AS THE LEADERS OF THIS COMMUNITY AND AS A CHURCH AND IN HONOR OF RICHARD SPILMAN. GOD BLESS YOU.
I WANT YOU TO KNOW THAT JESUS LOVES YOU.
GOD LOVES YOU. AND WE LOVE YOU, TOO.
THANK YOU, SIR. THANK YOU, PASTOR KEN.
THE ADDITION OF. PASTA, CAN I JUST WANTED TO HIGHLIGHT.
REVEREND SPELLMAN WOULD HAVE PROBABLY GONE ON JUST A LITTLE FURTHER IN HIS HONOR.
I WANTED TO MAKE SURE I SHARE THAT BECAUSE WE LOVE YOU.
THANK YOU SO MUCH. WE'RE ON THE POINT OF PUBLIC HEARINGS AND.
[PUBLIC HEARINGS]
WE'LL GO TO ITEM NUMBER ONE.THAT'S MS. SMITH, ORDINANCE 2021, DASH 19, AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, PERMITTING THE FISCAL YEAR 2021 BUDGET BY APPROPRIATING ALLOCATING FUNDS IDENTIFIED IN EXHIBIT A CONSISTING OF FIVE PAGES AND INCORPORATE IT IN ITS ENTIRETY HERE IN RECOGNIZING THAT SUCH APPROPRIATIONS MUST BE MADE PURSUANT TO THE CODE OF ORDINANCES.
THE CITY OF ALBANY CHAPTER THIRTY FIVE.
ADOPTING, RATIFYING, CONFIRMING AND VALIDATING ALLOCATIONS PROVIDING FOR AN EFFECTIVE DATE. LIKE TO OPEN UP THE PUBLIC HEARING AND DEFER TO MADAM CHAIRMAN.
THANK YOU, MAYOR. THIS IS FINAL READING FOR OUR SECOND QUARTERLY BUDGET AMENDMENT.
AND I'M HAPPY TO ANSWER ANY QUESTIONS YOU MAY HAVE.
QUESTION IS ANYONE IN THE AUDIENCE THAT WISHES TO SPEAK FOR OR AGAINST THIS ITEM? NONE, I'M CLOSING THE PUBLIC HEARING AND ASK FOR A MOTION MOTION TO PUT FORWARD ITS 20, 21, DASH 19 FINAL READING ON A MOTION BY DEPUTY MAYOR JOHNSON, SINGING IT BY COUNCILMAN FELIX. ANY FURTHER DISCUSSION? ALL IN FAVOR AND HE OPPOSE PASSES UNANIMOUSLY, ITEM NUMBER TWO.
ADAM SMITH. IT IS TWENTY, TWENTY ONE DASH TWENTY, AN ORDINANCE OF THE CITY OF PALM BAY OF OUR COUNTY, FLORIDA, MAINTAINING THE CODE OF ORDINANCES, TITLE FIVE, LEGISLATIVE CHAPTER 52 OR SUBCHAPTER SUSTAINABILITY BOARD, MODIFY THE NAME OF THE BOARD AND REVISING QUORUM REQUIREMENTS, PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT.
HERE WITH VOTING FOR INCLUSION, THE CITY OF PALM BEACH CODE OF ORDINANCES PROVIDING FOR A SEVERABILITY CLAUSE PROVIDING FOR AN EFFECTIVE DATE.
AND OPEN UP THE PUBLIC HEARING AT THIS TIME.
THANK YOU, MAYOR. THIS IS AN ITEM THAT IS ALSO FINAL READING.
IT IS A COUPLE OF MINOR CHANGES TO THE SUSTAINABILITY BOARD CHAPTER OF OUR ORDINANCE.
AND I'M HAPPY TO ANSWER ANY QUESTIONS.
IS THERE ANYONE IN THE AUDIENCE THAT WISHES TO SPEAK ON THIS SIDE OF OR AGAINST THIS IDEA? THE FORWARD MAN.
MY NAME IS SUSAN CONNOLLY AND I'M A MEMBER OF THE PALM BAY SUSTAINABILITY BOARD, AND THIS IS CRITICAL TO THE SUCCESS OF THE BOARD BECAUSE IT HAS STRUGGLED FOR OVER A YEAR.
WITH NOT BEING ABLE TO REACH QUORUM AND THIS WILL REDUCE THE NUMBER WE NEED FROM QUORUM FROM FIVE TO FOUR, WE HAVE REALLY STRONG PARTICIPANTS RIGHT NOW ON THE BOARD.
I'M ONE OF THEM. AND THE ACTION PLAN IS IN PROCESS.
AND WITH THE QUORUM, WE'RE WE'RE DOUBLING UP ON THE NUMBER OF MEETINGS PER MONTH SO WE CAN CATCH UP AND GET A PLAN PRESENTED TO COUNCIL.
ALSO, THE NAME HAS BEEN MODIFIED TO BECOME AN ADVISORY BOARD, SO I THINK THAT IS VERY CRITICAL TO WHAT OUR PURPOSES.
THANK YOU. THANK YOU, MA'AM, AND THANK YOU FOR YOUR DEDICATED SERVICE TO THE CITIZENS OF PALM BAY. REALLY APPRECIATE THAT, MA'AM.
IS THERE ANYONE ELSE IN THE AUDIENCE THAT WISHES TO SPEAK FOR OR AGAINST THIS ITEM?
[00:50:02]
IN NONE, I'M CLOSING THE PUBLIC HEARING AND ASK FOR EMOTION, EMOTION, APPROVAL, AND IT'S TWENTY, TWENTY ONE DASH, TWENTY FINAL READING SAYING I'VE GOT A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN FELIX.ANY FURTHER DISCUSSION, GENTLEMEN? BEN, BILLY CONNOLLY, IF YOU COULD HELP ME RECRUIT MR. BATTON, I'D BE HAPPY TO POINT HIM TO THAT BOARD.
ALL RIGHT. HE HAS A VERY GOOD BACKGROUND AND HE WOULD BE THE TYPE OF PERSON I LIKE ON THEIR. ANY FURTHER DISCUSSION COUNCIL? THE PHENOMENA CALLED THE QUESTION, WE HAVE A MOTION.
BY DEPUTY MAYOR JOHNSON, SINGING IT BY COUNCILMAN FELIX, ALL IN FAVOR BY ANY OPPOSE PASSES UNANIMOUSLY, ITEM NUMBER THREE.
WITNESS OR IS 2021, THAT'S TWENTY ONE ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, MEANING THE CODE OF ORDINANCES, TITLE NINE, YOU KNOW, REGULATIONS, CHAPTER NINE THREE, REAL PROPERTY.
THIS SUBCHAPTER UNSIGHTLY AND UNSANITARY CONDITIONS BY INCLUDING ADDITIONAL PROVISIONS RELATING TO UNIMPROVED REAL PROPERTY, PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE WITH PROVIDING FOR INCLUSION, THE CITY OF PALM BEACH CODE OF ORDINANCES PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING FOR AN EFFECTIVE DATE.
WHEN I OPEN UP THE PUBLIC HEARING AT THIS TIME.
THIS IS ALSO A FINAL READING, THIS ITEM IN PARTICULAR IS GOING TO BE HELPFUL TO REDUCING THE COST TO VACANT LOT OWNERS WHEN THEY GET A COMPLAINT FROM A NEIGHBOR ABOUT OVERGROWTH, PAIN. WITH THIS CHANGE, IF IT'S APPROVED TONIGHT, THEY WILL NO LONGER HAVE TO DO ALL FOUR SIDES IN TERMS OF THE CUTBACK.
IT WILL JUST BE HARD TO CUT BACK THE SIDE OF THE COMPLAINANTS OR REDUCE THE FINANCIAL BURDEN ON THE ON THE RESIDENT AS WELL AS THE CITY FOR TAKING CARE OF THAT.
SO HAPPY TO ANSWER ANY QUESTIONS.
ANY QUESTIONS, COUNSEL? SEAMAN FELIX. I JUST WANT TO SAY TO MISS SHERMAN THAT THAT I'M GLAD THIS IS BEING LOOKED AT, I'M NOT SURE HOW THAT CAME ABOUT, BUT THIS IS I THINK THIS IS IMPORTANT BECAUSE I THINK THAT'S VERY ORDINANCE CAUSE A LOT OF PROPERTY OWNER TO LIQUIDATE THEIR PROPERTY BECAUSE THEY'VE BEEN FINED SO MANY TIMES OVER OVER TIME.
YOU KNOW, ESPECIALLY FOLKS THAT LIVES OUTSIDE OF THE STATES OR.
NOT AT ALL, NOT LOCAL, LOCALLY OWNED PROPERTY OWNER.
AND THEN, YOU KNOW, AND YOU HAVE NEIGHBORS AS WELL THAT USE THAT AS AN OPPORTUNITY.
MAYBE THEY WANT TO OWN THAT PROPERTY.
I'M GOING TO USE THAT ORDINANCE AGAINST MY MY NEXT DOOR NEIGHBOR.
HOPEFULLY THEY'LL BE DISCOURAGED TO THE POINT THEY CAN AT SOME POINT ON THEIR PROPERTY.
SO I'M GLAD THAT IS BEING LOOKED AT AND, YOU KNOW, TAKING MAKING THE RIGHT DECISION IN PROTECTING THOSE FOLKS AND, YOU KNOW, YOU KNOW, PROPERTY RIGHTS AS WELL AND THEIR PROPERTY RIGHTS TO MAKE TO MAKE SURE TO DO WHAT'S RIGHT BY THEM.
THANK YOU. ANY FURTHER DISCUSSION COUNCIL? OR ANY FURTHER QUESTIONS, I SHOULD SAY? ONLY ONE IN THE PUBLIC THAT WISHES TO SPEAK FOR OR AGAINST THIS ITEM MR. GAGNON. OR SENIOR CHIEF.
GILBERTON, FIVE EIGHTY SIX OCEAN SPRAY STREET, SOUTHWEST, I AGREE WITH YOU, IT'S GOING TO MAKE IT A LOT NICER FOR THE RESIDENTS ARE LIVING THERE AND THEY'RE BEING INFRINGED UPON BY THEIR NEIGHBORS WHO SOMETIMES DON'T EVEN REALIZE HOW THEY'RE INFRINGING UPON THEM.
BUT I HAD ONE CONCERN WITH THIS, AND I READ THE ORDINANCE MULTIPLE TIMES.
AND I DIDN'T SEE ANYTHING IN THERE ON THE MATURE TREES, SOME OF THE TREES THAT HAVE BEEN GROWING THERE FOR A LONG PERIOD OF TIME STARTED OUT JUST AS A SCRUB OAK HAVE NOW TURNED INTO BEAUTIFUL OAKS, EIGHT, EIGHT, 10 INCHES IN DIAMETER, WHICH WE CONSIDER NICE FOLIAGE.
WELL, I DIDN'T SEE ANYTHING IN THERE IN THE ORDINANCE THAT SAID, COULD YOU KEEP INSTEAD OF JUST COMING IN WITH THE BIG MACHINE, IT CLEARS EVERYTHING DOWN FOR 15 FEET IN.
IS THERE ANYTHING TO SAVE ON TO THE MATURE NICE KEEPERS, OK? I DIDN'T SEE ANYTHING, BUT MAYBE IT'S IN THERE, BUT I DIDN'T SEE IT.
BUT I'D HATE TO SEE ALL THE GOOD TREES BECAUSE WE NEED THEM FOR OUR HABITAT OF SOCIETY.
THANK YOU. ANYONE ELSE THAT WISHES TO SPEAK FOR OR AGAINST THIS ITEM? MADAM CHAIRMAN, WOULD YOU ADDRESS THE OAK TREE? THANK YOU, MAYOR. I'M NOT PARTICULARLY FAMILIAR WITH THE ANSWER TO THE QUESTION.
I'LL SEE IF GROWTH MANAGEMENT DIRECTOR LARRY BRADLEY HAS ANYTHING HE CAN SHARE.
[00:55:06]
NOT IT'LL BE A RESEARCH ITEM FOR US, BUT.GOOD EVENING, MAYOR AND COUNCIL, THIS ONLY DEALS WITH THE MOWING, WE DON'T DO TREE REMOVAL AS PART OF THIS ORDINANCE.
IT'S ONLY THAT WHAT WE CALL NUISANCE VEG, THE STUFF THAT'S LOW TO THE GROUND, STUFF THAT USUALLY A FIRE HAZARD.
I MEAN, THIS CAME OUT OF CONCERN OF FIRES AND SUCH NEAR IMPROVE PROPERTY.
SO WE DO NOT REMOVE TREES UNDER THIS ORDINANCE.
IF A TREE IS DEAD, THAT'S A DIFFERENT ISSUE.
THEN WE GO IN AND WE'LL DEAL WITH DEAD TREE.
BUT THAT'S A DIFFERENT CONTRACTOR BECAUSE THIS IS ALL DONE BY CONTRACTORS.
WE HAVE ONE CONTRACTOR THAT JUST DOES THE MOWING.
WE HAVE ANOTHER CONTRACTOR WE USE FAIRLY AND FREQUENTLY FOR REMOVAL OF DEAD TREES.
BUT IF IT'S A IF IT'S A LIVE TREE, WE'RE NOT ENFORCING IT UNDER THIS ORDINANCE.
ANYONE ELSE WISHES TO SPEAK FOR OR AGAINST ASYLUM? CNN, I'M GOING TO CLOSE THE PUBLIC HEARING.
AND AS FOR A MOTION MOTION IMPROVEMENT, 20 TWENTY DASH 21, FINALLY.
GOT A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN BAILEY.
ANY FURTHER DISCUSSION COUNCIL? CNN, I'M GOING TO CALL THE QUESTION ALL IN FAVOR, AND HE OPPOSES PASSES UNANIMOUSLY.
ITEM NUMBER FOUR, MS. SMITH. OR IS TWENTY, TWENTY ONE, THAT'S TWENTY FOR AN AUDIENCE OF THE CITY OF PALM BAY OF OUR COUNTY, FLORIDA, VACATE AND ABANDON A PORTION OF THE REAR 20 FOOT PUBLIC UTILITY AND DRAINAGE EASEMENT WITHIN LAW EIGHT, NINE, 12 MALABAR UNIT TWENTY TWO, ACCORDING TO THE PLOT THEREOF, AS RECORDED IN FLATBOAT, 16 17 OF THE PUBLIC RECORDS OF BAVARO COUNTY, FLORIDA, AND LEGALLY DESCRIBED HEREIN PROVIDING FOR AN EFFECTIVE DATE.
THANK YOU, MISS SMITH. I'M GOING TO OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO STEP FORWARD AND PRESENT HIS CASE.
NO, PETE AND MAGGIE, MARCH NINE.
FORTY EIGHT TURQUOISE WE'RE QUESTION ARE VARIANCE TO THE 20 FOOT EASEMENT OF TEN FEET IN ORDER TO SIMPLY PUT IN A POOL IN THE BACKYARD, I'LL BE HAPPY TO ANSWER ANY QUESTIONS OR CONCERNS. THE BEST OF MY ABILITY.
SO MANY QUESTIONS FROM OUR APPLICANT.
JUST FOR THE RECORD, STAFF TO SUPPORT THE REQUEST.
THANK YOU. THANK YOU. IS THERE ANYONE IN THE AUDIENCE THAT WISHES TO SPEAK FOR OR AGAINST THIS ITEM? CNN, I'M CLOSING THE PUBLIC HEARING AND ASKING FOR COUNSEL FOR EMOTION, EMOTION, APPROVAL, AND IT'S TWENTY, TWENTY ONE DASH TWENTY FOUR FIRST READING SECOND AT A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN.
BILLY. ANY FURTHER DISCUSSION? SO, YOU KNOW, I'M CALLING TO QUESTION ALL IN FAVOR, I OPPOSE THIS IS UNANIMOUSLY WE'RE GOING TO FINISH AND OLD BUSINESS DEPUTY MAYOR JOHNSON.
[UNFINISHED AND OLD BUSINESS]
YES, MAYOR, I MAKE A MOTION TO APPROVE MARIO PEÑAFIEL TO THE YOUTH ADVISORY BOARD, ADULT MEMBER POSITION SECOND.GOT A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN BAILEY.
ANY FURTHER DISCUSSION? NONE. ALL IN FAVOR, ANY OPPOSE PASSES UNANIMOUSLY, WE'RE ON COMMITTEE AND COUNCIL REPORT.
[COMMITTEE AND COUNCIL REPORTS]
AND FELIX. I'D LIKE TO START WITH.WITH AN APPOINTMENT, MISS SUSAN NORLING, I SAY RIGHT TO THE CITIZENS BUDGET ADVISORY BOARD, I BELIEVE YOU'LL DO AN EXCELLENT JOB.
AND AGAIN, ONCE AGAIN, THE MAYOR MENTIONED IT EARLIER.
THANKS FOR WILLINGLY WANTS TO SERVE OUR COMMUNITY.
SECONDLY, IF I MAY, THIS PICTURE, THOUGH, GREAT.
IT'S ALWAYS IT'S ALWAYS A GREAT THING THAT I DON'T KNOW HOW MANY OF YOU GUYS I GET TO SEE THIS. IT'S ALWAYS GOOD TO HAVE GREAT PUBLICITY.
I WOULD ENCOURAGE EVERY SINGLE MEMBER OF OUR COMMUNITY, THE BUSINESS COMMUNITY, AS WELL AS THESE PAPERS ALL OVER THE PLACE.
MOST BUSINESSES, THEY ARE DELIVERED FOR FREE.
PALM BAY'S UP AND IT'S UP ON THE UP AND UP.
WE GOT A LOT OF GREAT THINGS GOING, ESPECIALLY FOR BUSINESSES.
I'M HONORED GUESTS IN THE HOUSE COMING FROM MIAMI.
[01:00:02]
I WOULD CERTAINLY SAY THAT IS OPEN FOR BUSINESS IF YOU KNOW PEOPLE THAT ARE WILLING TO INVEST. WE ALL WELCOME WE WELCOME YOU.AND WE WE WE WILL ACTUALLY OPEN FOR BUSINESS.
I JUST WANTED TO HIGHLIGHT THIS.
THEY DID THAT AS JUSTICE AND PICK ONE UP AND COME HERE.
ELSOM ENFORCER. THANK YOU, MAYOR.
UM, I HAVE A COUPLE OF THINGS TO TRY TO BE REAL BRIEF.
FIRST OF ALL, THE DAY WE NAMED.
ROBERTO CLEMENTE, OR IT'S COMPLEX AND THE BASEBALL FIELD, I WANT TO THANK STAFF FOR SHOWING UP AND SUPPORTING THAT.
BECOME PART OF HISTORY WITH MAJOR LEAGUE BASEBALL AND HONORING THREE BASEBALL PLAYERS.
AND GOOD THING IS GOING TO COME OUT THAT I'M WORKING VERY HARD WITH MAJOR LEAGUE BASEBALL. THEY'RE GOING TO ISSUE A PROCLAMATION FOR US.
BUT INFELD'S. AND WE GOT YOUTH BASEBALL PLAYED THE GAME TONIGHT THERE, SO IT WAS A GREAT EVENT AND THERE WAS A HISTORY MAKING EVENT FOR PALM BAY.
SECOND, I WANT TO TALK ABOUT IS I WANT TO GET THE COUNCIL CONSENSUS ON PARKING.
PARKING SPOTS JUST OUTSIDE THE CHAMBERS RIGHT NEXT TO THE SIGN THAT SAYS COUNCIL CHAMBERS, WHAT I'VE ENVISIONED, HAVING THEM FIVE SPOTS NEXT TO THE HANDICAPPED SPOT DESIGNATE WHERE COUNCIL MEMBERS ARE DOING, UM.
COUNCIL MEETING. OH, WE HAVE A FULL HOUSE WHEN WE GET BACK TO NORMAL AFTER THIS PANDEMIC.
MORE PEOPLE WOULD BE COMING AND WE HAVE A PLACE TO PARK.
SO I JUST WANT TO HEAR WHAT MY OTHER COLLEAGUE THINKS THAT.
OUR DEPUTY MAYOR JOHNSON, I'M OPEN TO IT, ME PERSONALLY, I LIKE TO MOVE AROUND SO NOBODY KNOWS WHERE I'M PARKING OR, YOU KNOW, GO AND CATCH ME SLIPPING, BUT YEAH, I'M I'M OPEN TO IT. BUT, YEAH, I PERSONALLY LIKE TO, YOU KNOW, PARK ALL OVER.
COUNCIL MEMBER BAILEY, YEAH, I MEAN, FOR MY EXPERIENCE UP HERE, YOU KNOW, I JUST DON'T FIND IT NECESSARY. I DON'T THINK WE HAVE DESIGNATED SPOT FOR OUR OFFICERS AT THIS TIME.
WE DO HAVE SPECIAL SPOTS, OBVIOUSLY, FOR HANDICAP AND FOR THE VETERANS.
I THINK THOSE ARE TWO GOOD THINGS.
SO, I MEAN, I JUST DON'T THINK IT'D BE NECESSARY.
AND IT'S ALSO JUST PUTTING A LABEL ON YOUR VEHICLE.
L7, FELIX. ALL RIGHT, THANK YOU.
IT'S A GREAT IDEA IN A SENSE, WHERE, YOU KNOW, IN THE EVENT WE HAVE PACKED HOUSES AND THERE'S SOME SOME MEETINGS WHERE IF YOU DON'T SHOW UP ON TIME OR EARLY, YOU MAY NOT FIND A PARKING SPACE, YOU MAY HAVE TO TO PARK OVER IN THE LIBRARY OR FURTHER AWAY FROM THAT CHAMBER. I CAN SEE IN THAT SENSE THE NEED FOR IT, BUT I WOULD BE OK WITH, YOU KNOW, WHICHEVER DIRECTION THAT COUNCIL DECIDE TO GO.
THANK YOU, I AS FOR ME, I THINK IT'S A GOOD IDEA, HOWEVER, YOU KNOW, MOST OF YOU KNOW THAT I. I SERVED IN THE MARINE CORPS AND ONE OF THE TRAININGS THAT THESE TAXPAYER DOLLARS INVESTED IN ME WAS MAKING ME A HARD TARGET, SO I KIND OF YIELD TOWARDS WHAT DEPUTY MAYOR JOHNSON STATED AND COUNCILMAN BAILEY.
BUT I THINK IN CONSIDERATION OF A FULL HOUSE AS DEPUTY OR AS COUNCILMAN FELIX AND COUNCILMAN FOSTER STATED, PERHAPS WE COULD VISIT THAT LATER ON.
BUT FOR ME, I RATHER JUST REMAIN COVERT AT THIS TIME, OK? LIKE I SAID, IF WE REVISIT IT LATER ON, I DON'T HAVE A PROBLEM WITH THAT.
BUT, YOU KNOW, IT COULD BE DESIGNATED.
BUT, YOU KNOW, NOBODY'S FORCING YOU TO PARK AT THE DESIGNATED SPOT, SO.
THAT'S JUST MY CONCERN. LET ME MOVE ON TO THE NEXT ONE.
YES, SIR, BUT I'M WILLING TO WAIT ON IT.
I WOULD LIKE TO LOOK PALM BAY HAS NO SISTER CITIES, AND I WOULD LIKE FOR US TO CONSIDER LOOKING INTO. REACHING OUT TO SISTER CITIES, I GOT A COUPLE IN MIND, ONE IN SAN JUAN,
[01:05:10]
PUERTO RICO. UM.KINGSTON, JAMAICA, AND PORT AU PRINCE, HAITI.
I WOULD LIKE FOR THEM TO START THERE AND ADD OTHER SISTER CITIES SO THE CITY COULD BE A A ECONOMIC DRIVER AND.
EDUCATION AND BRINGING PEOPLE INTO THE CITY AND ALSO PEOPLE WHO LIVE HERE ARE FROM THEM CITIES ALL USED TO LIVE IN THEM CITIES.
I HAVE FAMILY THAT COULD EDUCATE PEOPLE ABOUT PALM BAY AND ALSO ABOUT THEM CITIES OUTSIDE LAWTER. AND WE COULD HAVE JUST THE CITIES IN FLORIDA, TOO, SO I JUST NAMED A FEW THAT I'M INTERESTED IN AND I WOULD LIKE THE COUNCIL TO CONSIDER THAT.
I'M GO WITH THAT PRETTY MANY CHANCES GO DOWN THERE, HALSMAN BAILEY.
I THOUGHT WE HAD ONE AND MAYBE THREE NOW I WOULD KNOW, BUT I THOUGHT WE HAD ONE IN BRAZIL, IF I RECALL CORRECTLY.
BUT I DON'T KNOW HOW ACCURATE THAT WAS FROM WHEN I FIRST GOT ON OVER SIX YEARS AGO.
I'M ACTUALLY DOING SOME RESEARCH AND LOOKING IT UP, BUT I DO VAGUELY REMEMBER SOMETHING ABOUT SISTER CITIES. COUNCILMAN FELIX MAYOR SHOULD NOT THAT'S JUST ALMOST NATURAL FOR ME.
I WOULD CERTAINLY SUPPORT THAT.
THANK YOU, COUNCILMAN FOSTER, TO BRINGING THAT UP.
AND THAT'S THAT'S SOMETHING I DEFINITELY HAVE BEEN THINKING ABOUT IT.
JUST THE APPROACH. HOW HOW DO WE DEFINE THAT IN TERMS OF WHERE BOTH THE RELATIONSHIP, WHERE BOTH CITIES CAN BENEFIT FROM, IN TERMS OF, YOU KNOW, CULTURAL, CULTURALLY, YOU KNOW, SPORTS, IT'S A GREAT COMMONALITY THAT MOST CITY AROUND THE WORLD CAN SHARE.
SPORTS IS A GOOD BIG PLATFORM, DANCE MUSIC, YOU KNOW, YOU NAME IT FOOD.
YOU KNOW, I LIKE TO EAT AND I ENJOY INTERNATIONAL FOOD.
SO I THINK IT COULD BE A GREAT A GREAT THING.
AND NOT ONLY LIMITED TO TO A CITY, I'M SURE IT A MANY OF LOCAL ORGANIZATION, YOUTH ORGANIZATION MOSTLY WOULD BE REALLY WELCOME THAT THAT THAT THAT WOULD BE SOMETHING THAT THE YOUTH ADVISORY BOARD I WOULD DEFINITELY LOVE TO SEE THEM ENGAGE IN THAT.
WHAT WOULD THAT MEANS TO THEM.
AND I THINK IT'S GOING TO BE IT'S GOING TO HAVE TO BE A COLLABORATIVE EFFORT AND BETWEEN STAFF AND EVEN ORGANIZATIONS, NON FOR PROFIT, THAT THAT WORK, WOULD YOU MOSTLY SEE HOW WE CAN, YOU KNOW, EXCHANGE IDEAS AND HOW WE CAN MAKE THAT WORKS? BUT I THINK IT'S A IT'S A SUPER, SUPER IDEA I WOULD DEFINITELY BE IN FAVOR OF.
THANK YOU, COUNCIL MEMBER FELIX, AS FOR ME, I BELIEVE THAT THERE WAS A PROGRAM, I THINK THAT IS GOING TO RESEARCH THAT, BUT IF NOT WITH THE CITY, I KIND OF REMEMBER, OF COURSE, YOU KNOW, I'VE BEEN HERE THIRTY THREE YEARS, BUT I KIND OF REMEMBER THE CHAMBER OF COMMERCE ALSO HAD SUCH A PROGRAM WITH SISTER CITIES THROUGHOUT THE WORLD.
SO, YEAH, I'M I'M ALL FOR I LOVE THE WAY YOU SAID YOUR ASPECT OF FOOD.
YOU LOVE FOOD, COUNCILMAN FELIX.
THAT'S WHY I CHUCKLED, BECAUSE I THINK THAT'S WHAT BRINGS PEOPLE TOGETHER IS WHEN WE ALL SIT AT THE TABLE. SO KUDOS TO YOU, COUNCILMAN FOSTER.
I WOULD I'D BE REALLY INTERESTED IN SEEING HOW THAT MANIFEST.
THANK YOU. OH, SO I GAVE YOUR BLESSING TO GO FORWARD WITH IT.
OK. YES, I THINK TERESA IS GOING TO EVEN RESEARCH SOME SOMETHING LIKE THAT.
SO I THINK WE WOULD BE GOOD EITHER WAY.
MR. REESE, YOU WANT TO WEIGH IN? YES, I DID FIND IT LOOKS LIKE WE STARTED A PROCESS BACK IN TWENTY THIRTEEN THERE.
I, I JUST SEE SOMETHING IN HERE WITH THE CITY OF MELBOURNE AND BRAZIL, BUT IT DOESN'T LOOK LIKE THE CITY EVER IMPLEMENTED ANYTHING.
SO I THINK YOU HAVE CONSENSUS HERE FOR US TO TO NAVIGATE THOSE TOP THREE CITIES THAT YOU MENTIONED AND THEN SEE HOW THAT GROWS FROM HERE.
OK, THANK. THANK YOU, COUNCILMAN BAILEY.
IF I MAY MAY MAY ADD, I DON'T KNOW WHAT'S IN THAT RESOLUTION, BUT I DO REMEMBER WHEN THE TALKING POINTS JUST FOR CONSIDERATIONS WHERE WE DO CHOOSE IT.
I THINK WE WERE LOOKING AT I CAME HERE, IS IT BOMBARDIER OR AND I CAME HERE WITH RARE AND RARE. I THINK THAT WAS PART OF US TRYING TO RECRUIT SOME INDUSTRY, LARGE INDUSTRY TO THE CITY. AND AND WHILE THE BREAKING BREAD AND THE NOW LOOKING AT OTHER CULTURES AND THAT
[01:10:03]
TYPE OF THING AND NOW SHARING FOODS IS A GOOD THING.AND I DON'T HAVE A PROBLEM WITH THAT.
I DO THINK THAT FIND A PLACE WHERE WE CAN BUILD RELATIONSHIPS TO BRING INDUSTRY HERE WOULD BE A GREAT PRIORITY.
I'D SECOND THAT I AGREE WITH POPPY THAT.
SO I THINK THERE'S THERE'S THE CONSENSUS IS THERE.
SO LET'S MOVE FORWARD IF WE CAN.
MADAM CHAIRMAN, I THINK THIS IS A WONDERFUL IDEA THAT WAS BROUGHT FORTH AND HOW WE INCREASE OUR. CAPACITY HERE WITHIN THE CITY IS IN PARTICULAR, WE'RE REACHING OUT TO BUSINESSES. THANK YOU.
THANK YOU, COUNCIL MEMBER FORCES, ARE YOU DONE WITH YOUR REPORT, SIR? YES, SIR. ALL RIGHT, COUNCILMAN BAILEY.
I'LL START OFF BY I WANT TO POINT CALEB BOOTHROYD TO THE YOUTH ADVISORY BOARD, HE'S A FORMER STUDENT OF MINE AND SON OF A FRIEND WHO ALSO SERVES ON MANY BOARDS FOR THE CITY.
SO LOOKING FORWARD TO HAVING HIM THERE AND SEE WHAT IDEAS HE CAN BRING TO THE BOARD.
THE SECOND THING THAT I WANTED TO TOUCH ON IS, YOU KNOW, I HAVEN'T REALLY GIVEN A FULL OVERVIEW OF IT, BUT I THINK IT'S BEEN LIKE THE LAST FIVE FRIDAYS I'VE BEEN HAVE I'VE HAD THE PRIVILEGE OF GOING OUT WITH OUR PUBLIC WORKS DIRECTOR AND CITY ENGINEER FRANK WATANABE AND OUR OUR LEAD INSPECTORS, JEREMY AND JOHN, OUT IN THE FIELD, AS WELL AS MEETING UP WITH SOME OF THE DIFFERENT CONTRACTORS WHO ARE IMPLEMENTING THE ROBOT PROGRAM.
NOW, I'VE HAD OTHER VISITS IN THE PAST, TOO, BUT IT'S BEEN A LITTLE BIT MORE INTENSE.
AND I'M LOOKING FORWARD TO GOING OUT TOMORROW AS WELL TO LOOK AT SOME OF THE OLD PIPES.
WE LOOKED AT A PIPE LAST WEEK AS WELL.
WE'VE REVIEWED THE FDR PROCESS.
WE'VE LOOKED AT THE THIN LEFT LAST WEEK.
AND I THINK I APPRECIATE MAYOR SHERMAN AND OUR STAFF PUTTING OUT SOME OF THE PICTURES I TOLD FRANK LAST WEEK. I SAID WE SHOULD HAVE BEEN TAKING PICTURES OF THIS THE WHOLE TIME.
AND HE SAID HE DID HAVE SOME JUST SO WE CAN KEEP COMMUNICATING.
AND THAT'S ONE THING THAT WAS ENCOURAGING TO TALK TO FRANK ABOUT AND TO MS. SHERMAN. BUT KEEP COMMUNICATE TO THE COMMUNITY WHERE THESE CONTRACTORS ARE AND WHAT TYPE OF WORK THEY'RE DOING AND GIVE THEM SOME VISUALS SO THEY UNDERSTAND THAT THAT IS PROGRESSING. IT'S NOT JUST IN THE BACKGROUND.
SO IT'S BEEN THAT'S REALLY BEEN A PRIVILEGE TO BE ABLE TO SEE ALL THE DIFFERENT TYPES OF STEPS, REALLY UNDERSTAND WHAT IT'S LOOKING LIKE OUT THERE IN THE FIELD.
AND NOW EVEN NOW, ONE OF THE THINGS ONE OF THE WEEKS WHEN THE VISITS WE REALLY FOCUSED ON I WAS WANT TO MAKE SURE I UNDERSTOOD THE INSPECTION PROCESS.
AND NOW RIGHT HERE, THIS IS ACTUALLY A PIECE OF PEGO, ONE OF OUR WORST READS AND MOST COMPLAINED ABOUT STREETS.
THIS RIGHT HERE WAS FROM THE MATERIALS USED FOR THE BASE OF THE FDR PROCESS.
THEY'RE MADE A PILL AND SHOWED ME HOW THEY MADE THE PILLS AND TESTED AND SO FORTH.
SO IT'S KIND OF LIKE A NO, THAT'S A LITTLE SOUVENIR AND PIECE OF THE PROGRAM.
THEY MAKE THOSE AND THEY SEND THEM OFF TO A LAB TO GIVE THEM STRESS.
NOW, TO GIVE THEM TESTINO, MAKE SURE IF THEY CAN HOLD UP TO THE WEIGHTS AND PRESSURES.
SO ANYHOW, THAT IT'S BEEN VERY INFORMATIVE.
I LOOK FORWARD TO CONTINUING TO BE OUT THERE WITH THEM.
AND AS WE LET FOLKS KNOW THAT WE ARE PROGRESSING AND THAT SAME VEIN, I HAVE ALSO NOW IN MY DISCUSSIONS NOW, ONE OF THE THINGS THAT I ASKED FOR WAS WHEN I WAS LOOKING FOR WAS NOW WHENEVER SOMEBODY SAYS SOMETHING TO ME, THEN I HEAR FROM OUR STAFF AND I HAVE THEIR EXPERTIZE, I HAVE THEIR EXPERIENCE TO LEAN ON WHERE HOW CAN I VERIFY IT? I'M NOT A PROFESSIONAL ENGINEER.
I'M NOT A EXPERT IN THE FIELD.
MY FATHER BUILT ROADS AND THINGS OF THIS NATURE.
BUT, YOU KNOW, UNFORTUNATELY, I DON'T I DON'T HAVE ALL OF HIS KNOWLEDGE AND HE'S NOT AROUND ANYMORE FOR ME TO TO KIND OF GLEAN FROM.
AND SO I WAS LOOKING FOR STANDARDS.
I KIND OF LIKE HOW BUILDING OFFICIALS HAVE A BUILDING CODE AND I CAN GO AND SEE EXPLICITLY I CAN READ IT MYSELF.
I CAN I CAN INTERPRET OR LIKE A TRAFFIC ENGINEER HAS A MANUAL.
AND SO THERE IS THERE ARE SOME CONCERNS.
I LEARNED THE PROCESS MORE AND HOW WE'RE USING A LAB AND WE'RE DOING CERTAIN TESTS BEFOREHAND AND GET RECOMMENDATIONS.
BUT ONE OF THE THINGS I THINK WOULD BE IMPORTANT TO DO IS TO HAVE A PROCESS NOW WHERE ABOUT A THIRD OF THE WAY THROUGH THE ROBOT PROGRAM AT THIS POINT APPROXIMATELY, AND I THINK WOULD BE A GOOD TIME TO KIND OF HAVE A SET OF EYES GO BACK AND LOOK AT WHAT WE'VE DESIGNED AND LAID OUT KNOW JUST JUST TO MAKE SURE FOR VERIFICATION PURPOSES TO HAVE A THIRD PARTY LOOK AT THAT.
AND THEN FOR THE FUTURE DESIGNS TO HAVE OUR CONSULTANTS THAT WE ARE WE ALREADY HAVE SOME ENGINEERING CONSULTANTS ON STAFF ARE ON OUR CONSULTING LIST THAT WE'VE ALREADY CONTRACTED WITH JUST TO HAVE THEM DO SOME SPOT CHECKS AND THESE PROCESSES JUST TO MAKE SURE BECAUSE I'M OUT THERE AND IT LOOKS GOOD TO ME AND I REALLY HAVE A LOT OF FAITH IN THE FOLKS THAT I'VE BEEN OUT THERE WITH. BUT I THINK IT BE ALSO HELP WAS ALWAYS HELPFUL TO HAVE A THIRD PARTY, HAVE A SECOND WITNESS.
AND SO THAT'S WHAT I'M LOOKING FOR.
AND I'M HOPING THAT NOW COUNTY COUNCIL SUPPORT MS. AND SUPPORT, WE CAN WE CAN REALLY CONTINUE TO WORK ON THAT AND MAKE SURE WE DO THIS RIGHT, BECAUSE WE'RE DOING A WHOLE WE'RE DOING VERY LARGE SET OF PROJECTS IN A VERY IN A RELATIVELY SHORT AMOUNT OF TIME.
AND THAT'S GOING TO BE UP TO EIGHT YEARS TOTAL.
IT'S A FIVE YEAR, FIVE PHASE PROGRAM, BUT IT'S IT'S A LOT OF WORK, 150 MILLION DOLLARS
[01:15:04]
WORTH. AND, YOU KNOW, IT'S NOT SOMETHING WE CAN WE CAN SCREW UP.AND SO I HAVE FAITH AND WE WERE MOVING, BUT I WANT TO MAKE SURE WE DO IT WELL.
AND AND I WILL I JUST WILL NOTE ONE THING.
I DON'T WANT TO BELABOR IT. HE WENT LOOKING FOR CONSENSUS OR.
YEAH, WELL, I MEAN, I'M MAKING IT KNOWN.
I MEAN, CERTAINLY IF YOU GUYS WANT TO PIPE IN.
ABSOLUTELY. I'LL STOP AND LET YOU GO BEFORE YOU GO FURTHER.
I'M. ANYONE WANT TO WEIGH IN? HE'S TRYING TO GET CONSENSUS, DEPUTY MAYOR JOHNSON, YOU WANT TO WEIGH IN AND COUNCILMAN FOLSOM, I'M ON THE SAME PAGE.
YEAH, WE WANT TO MAKE SURE IT'S DONE RIGHT.
SO AND I'VE ALREADY HAD TALKS WITH STAFF AS WELL.
BUT I WANT TO MAKE SURE THAT BOTH THE CITY ATTORNEY'S OFFICE AND CITY MANAGER'S OFFICE ARE WORKING TOGETHER ON IT.
SO, YEAH, I'LL BE THAT COUNCILMAN FOSTER AND THEN I AGREE WITH COUNCILMAN BARELY.
OK, SO HERE'S NOT ONLY ARE WE ALL IN AGREEMENT, MADAM CHAIRMAN, BUT IT'S EVEN DOUBLE CHECKING THOSE SPECS, MAKING SURE THOSE SPECS ARE AT A LEVEL WHERE WE DON'T HAVE TO GO BACK, AS YOU AND I DISCUSSED PREVIOUSLY, OVER A CERTAIN ISSUE.
BUT. DO YOU HAVE ENOUGH FROM THIS COUNCIL? ABSOLUTELY, AND I'VE SPOKEN TO, I THINK SEVERAL OF YOU INDIVIDUALLY ALREADY.
THAT IS SOMETHING WE'RE ALREADY WORKING ON BEHIND THE SCENES.
AND WE'LL BE BRINGING THAT FORTH.
AND WE'RE GOING TO START OUT WITH SOME WORK THAT WILL BE DONE WITHIN THE BUDGETARY THRESHOLDS. BUT IF WE NEED ADDITIONAL FUNDING, WE'LL COME TO COUNSEL FOR THAT JUST TO MAKE SURE WE'VE GOT THOSE DOUBLE CHECKS IN PLACE AND THE OUTSIDE VERIFICATION OF WHAT WE'RE DOING, THAT'S VERY IMPORTANT TO US AS WELL.
I APPRECIATE THAT. MAYOR IS JUST MORE I MEAN, I KNOW I KNOW MS. SHERMAN'S TRYING TO MAKE PROGRESS ON IT.
AND I JUST WANT TO BRING LIGHT THAT WE'RE WORKING ON THESE THINGS.
AND NO ONE ADDITIONAL THING IS THAT THAT THAT KIND OF RELATES TO ALL THIS.
AND WE'RE GOING TO GO SEE PIPES THIS WEEKEND.
NO. ONE OF ONE OF THE ONE OF THE THINGS THAT I KIND OF FELT LIKE WAS THERE WAS A LOT OF DISCUSSION WHEN WE WERE DISCUSSING THIS.
THIS NEXT PHASE IS TECHNICALLY IT'S YEAR THREE PHASE.
BUT WE ALSO MADE MODIFICATIONS FOR PHASE TWO, INCLUDING MOVING UP A UNIT.
FORTY NINE IS THAT THERE'S A LOT OF WORK OUT THERE STILL TO DO.
MY UNDERSTANDING IS THAT THE VERY FIRST UNITS THAT WE FINISHED THAT WE THAT WE COMPLETE AS FAR AS ROBAN WAS UNITS 31 32 AND THOSE DRAINAGE ISSUES, THE STORMARE PROJECTS, GETTING EVERYTHING STRAIGHT NOW AS FAR AS THE SWELLS AND SO FORTH, TO GET THE RIGHT FLOW JUST WRAPPED UP RECENTLY. AND THAT WAS THAT, THAT'S BEEN SOME TIME SINCE WE STARTED THIS.
AND SO WHAT I'M SEEING IS THAT WE NEED TO TRY TO ACCELERATE THOSE BECAUSE I'M OUT IN THE FIELD. I MEAN, I'M OUT THERE CONSTANTLY, NOT JUST WHENEVER I'M WITH STAFF, BUT I'VE BEEN DRIVING AROUND AND INSPECTING WHEN THERE'S COMPLAINTS FROM RESIDENTS AND RESIDENTS THAT HAVE BEEN BROUGHT A LOT OF THINGS TO MY ATTENTION.
AND WE SEE BRAND NEW PIPES NOW.
THEY'RE THEY'VE GOT SEDIMENT HALFWAY UP THEM.
AND WE KNOW AND STAFF KNOWS THEY'RE TRYING TO CATCH UP TO GET IN THERE TO DIG OUT THE SWELLS. SO WE DON'T HAVE THAT PROBLEM.
BUT IT'S ABOUT CATCHING UP ON IT.
THAT WAS ONE OF MY ISSUES. LIKE FORTY NINE IS THAT THAT STAFF, SOME OF THOSE STAFF MEMBERS ARE NOW BE OUT SOMEWHERE ELSE.
BUT THERE'S VERY FEW PEOPLE AND WE'RE JUST FURTHER BEHIND.
I THINK WE NEED TO THE COUNCILS RECOGNIZES WE NEED TO CATCH UP ON THAT.
AND NOW WE'VE MADE OUR DECISION ON ON PHASE THREE AND I'M FINE WITH THAT.
THE ISSUE THAT I WANT TO EMPHASIZE THAT HOPEFULLY WHEN WE GET TO THIS WORKSHOP OR WHATEVER DISCUSSIONS WE HAVE FOR THE RECOVERY DOLLARS, THAT IF WE CAN PRIORITIZE THAT AND USE THAT FOR THE STROHMEYER PROJECT SO THAT WE HAVE COMPLETE PROJECTS AS WE COMPLETE THESE ROADS, THAT WOULD BE A GREAT BENEFIT, I THINK, FOR CITIZENS.
SO WE DON'T SEE THESE TYPE OF ISSUES, DRAINAGE ISSUES.
SO THAT'S ALL I HAVE TO SAY ON THAT ONE.
THE. THE LAST THING AND I'LL SAVE IT FOR.
THERE'S SOME THERE'S SOME THOUGHTS I HAVE, BUT THEY CAN RELATE TO THE DEPUTY MAYOR JOHNSON'S NEW BUSINESS, NUMBER TWO.
SO WHAT I'LL DO IS I'LL WAIT TILL THAT TIME WITH MAYOR IF YOU GUYS ARE OK WITH IT.
LOOKING AT OTHER IDEAS, WE HAVE TO MAKE SURE WE CAN INSURE TO SHORE UP OUR WHISTLEBLOWER PROCESS. I THINK THAT WOULD BE APPROPRIATE COUNCIL MEMBER OTHER THAN A REPORT.
SO THANK YOU FOR THAT, DEPUTY MAYOR JOHNSON.
OK, SO LET ME START WITH THAT THEN, BECAUSE OTHER THAN NEW BUSINESS NUMBER TWO, I'M LOOKING AT THE WHOLE THE AUDIT REPORT.
I THINK IT'S IMPORTANT THAT WE WE POSSIBLY AND NOW I'M LOOKING FOR A CONSENSUS ON THIS.
THIS IS SEPARATE FROM THE REVISION OR REQUEST FOR A REVISION OF THE WHISTLEBLOWER ORDINANCE, BUT LOOKING AT TO CREATE AN ORDINANCE TO CODIFY THE PROCESS FOR INVESTIGATIONS, FOR ANONYMOUS COMPLAINTS.
SO I'M LOOKING MORE FOR CONSENSUS ON THAT.
[01:20:02]
SO THAT'S TWO THAT'S TWO DIFFERENT ORDINANCES.SO I DON'T WANT TO MAKE THEY GO TOGETHER, BUT IT'S TWO SEPARATE ORDINANCES.
SO THIS IS A SEPARATE ORDINANCE I'M LOOKING TO WORK WITH STAFF ON, AND I'M JUST LOOKING FOR A CONSENSUS ON THAT.
ALSO, NELSON BAILEY, I'LL START WITH YOU, NELSON AND FELIX.
NELSON ENFORCER. OK, SO YOU HAVE CONSENSUS, THEY DO GO TOGETHER, BUT I LIKE I LOVE YOUR APPROACH, YOU PIECEMEAL THINGS.
THAT'S HOW YOU TAKE AN ELEPHANT, RIGHT? ONE BITE AT A TIME.
SO CARRY ON, SIR. THE OTHER THAN THAT, I HOPE HE'S STILL AWAKE.
I WAS TELLING HIS MOM TO TRY TO KEEP HIM UP AS LONG AS POSSIBLE.
BUT THIS MONTH IS AUTISM AWARENESS AND ACCEPTANCE MONTH, AND I WANT TO GIVE LITTLE ANTHONY A SHOUT OUT.
HE'S DOING GREAT AT PUZZLE BOX ACADEMY.
SO I JUST WANTED TO LOOK AT THE CAMERA, GIVE HIM A PERSONAL SHOUT OUT.
ALL RIGHT. OH, SO THEN THAT IS IT, MAN.
I'M GOOD. SO WHERE TO GO, ANTHONY? WHERE TO GO? ANTHONY, CONGRATULATIONS.
SO I'M GOING TO START OFF WITH OUR FIRST RESPONDERS.
I WANT TO KNOW WHO THOSE TWO ARE, FIREFIGHTERS, WE WE REQUIRE SO MUCH OF ALL FIRST RESPONDERS. HOWEVER, THIS COUNCIL HAS WANTED TO PROVIDE THE COVID VACCINE TO THOSE NUMBERS THAT SO CHOOSE TO TAKE THE VACCINE.
AND ON A MOMENT'S NOTICE, THEY DEVISED AN OPPORTUNITY, A PLAN TO TAKE IN THE CALLS REGISTER. AND AND WE'RE DOING IT AGAIN TOMORROW MORNING.
SO MY HAT'S OFF TO THE OUTSTANDING TEAM THAT WE HAVE HERE IN PALM BAY.
I'M REALLY PROUD, REALLY PROUD OF ALL YOUR EFFORTS.
I'M REALLY PROUD OF THE FACT THAT YOU TRULY CARE FOR THIS COMMUNITY, THAT YOU PUT YOUR LIFE ON THE LINE AND IT DOESN'T MATTER.
WHATEVER WE ASK OF YOU, YOU'RE OUT THERE SAYING ICER AND YOU MOVE THE NEEDLE.
THANK YOU FOR ALL THAT YOU DO.
AND THEN I WANTED TO SHARE I WANTED TO ECHO A LITTLE BIT ABOUT MS., MS., JONI GIANCOLA BROWN. YOU KNOW, SOMETHING THAT THAT'S NEAR AND DEAR TO MY HEART IS IS.
HONORING THOSE THAT TRULY SACRIFICE OF THEIR TIME AND IMPROVING OUR CITY, I JUST WANT TO SHARE WITH YOU THAT TODAY, RIGHT NOW.
JONI GIANCOLA BROWN IS IN OUR AUDIENCE WORKING AND SHE'S CELEBRATING HER BIRTHDAY, NOT GOING TO SAY WHICH. NO, BUT HAPPY BIRTHDAY, JONI AND BROWN REALLY LOVE YOU.
AND I'M GOING TO ADD ANOTHER ROOM.
MA'AM, I'M GOING TO ASK YOU TO COME STEP OVER BECAUSE.
BECAUSE I WANT TO I WANT TO HONOR YOU.
YOU ARE OUR NEW DEPUTY CITY MANAGER AND YOU HAVE DONE AN OUTSTANDING JOB.
AND AS MOST OF YOU KNOW, SOMETHING THAT'S NEAR AND DEAR TO MY HEART IS THE EAGLE, THE EAGLE GLOBE AND ANCHOR.
IT IS A CHALLENGE COIN THAT I HAVE DEVISED FOR EMPLOYEES AND CITIZENS THAT DO OUTSTANDING WORK IN OUR COMMUNITY AND IT'S ON THE BACK OF IT.
WE'VE GOT HONOR AND INTEGRITY.
AND I'M GOING TO GO DOWNSTAIRS, MA'AM, AND OR DOWN BELOW, AND I'M GOING TO COIN YOU JUST LIKE WE WOULD DO IN THE MARINE CORPS.
REGULATIONS AND HAPPY BIRTHDAY.
SO NOW WE'RE UP TO NEW BUSINESS AND WE'LL GO WITH NEW BUSINESS NUMBER ONE, MS.
[NEW BUSINESS]
SMITH, RESOLUTION 2021, DASH EIGHTEEN.A RESOLUTION IN THE CITY OF PALM BAY OF OUR COUNTY, FLORIDA, REQUESTING THE UNITED STATES SECRETARY OF THE INTERIOR ROBERTO CLEMENTE, PLACE OF DEATH.
AND LUISA SUPPORTED PUERTO RICO IN THE NATIONAL REGISTER OF HISTORICAL PLACES, PROVIDING FOR AN EFFECTIVE DATE. COUNCILMAN FOSTER, I'M GOING TO DEFER TO YOU.
THANK YOU, MAYOR. BEFORE I SPEAK, WE HAVE SOME GUESTS, VERY IMPORTANT GUESTS IN THE AUDIENCE. AND I WOULD LIKE TO CALL THEM UP TO SPEAK ON THIS ITEM.
I DO IT RIGHT. YEAH, OK, I TRY TO ROLL THE RS.
I JUST WANT YOU TO KNOW THIS DEPUTY MARY JOHNSON DID ROLLED HIS EYES.
I WAS PRACTICING THAT IN MY HEAD.
OK, LET ME SAY SOMETHING BEFORE YOU SPEAK.
[01:25:04]
THESE TWO INDIVIDUALS ARE THE SONS OF ROBERTO CLEMENTE WALKER, AND IF YOU DON'T KNOW, ROBERTO CLEMENTE WAS AN OUTSTANDING BASEBALL PLAYER, HUMANITARIAN.HE'S IN THE HALL OF FAME AND I'LL BE TALKING MORE ABOUT THAT.
BUT I'LL LET HIS TWO SONS TRAVEL GREAT DISTANCES TO BE HERE.
THANK YOU, ROBERTO CLEMENTE, JUNIOR ELLIOT, THE SON OF ROBERTO CLEMENTE.
THANK YOU, COUNCILOR JOHNSON AND JOHNSON, AND THANK YOUR CITY COUNCIL.
WELL, WE'RE VERY HONORED THAT YOU HAVE ALSO AGREED TO JOIN OUR DIFFERENT CITIES TO A POINT, LISA, PUERTO RICO, WHERE OUR FATHER LOVED TO TO GO AND LIVING AND PICK UP CERTAIN THINGS AND DRIFTWOOD TO MAKE LAMPS AND DO THINGS AROUND THE HOUSE.
AND HE SOME TIMELY DEATH WAS RIGHT THERE.
AND THAT SIDE OF THE ISLAND WHERE HE REALLY ENJOYED, YOU KNOW, BEING HIMSELF, IF YOU WILL. BUT AT LEAST ROBERTO AND OUR GOOD FRIEND AND BROTHER, PRESIDENT OF THE FOUNDATION, HAVE REALLY DONE A FANTASTIC JOB IN BRINGING CITIES LIKE YOURS TO JOIN THE FORCES TO BECOME JUST A REALITY.
WELL, GOOD EVENING. CERTAINLY THE FACT THAT OUR FATHER LOST HIS LIFE IN THAT MISSION OF MERCY, RIGHT. AND THE FACT THAT HIS BODY WAS NEVER RECOVERED, THERE IS NOT A PLACE ANYWHERE OFFICIALLY WHERE YOU CAN GO AND PAY YOUR YOUR RESPECTS.
SO THIS IS WHAT THIS PLACE WILL BECOME, THAT MAUSOLEUM, THE PLACE WHERE ANYONE WHO'S A FAN, ANYONE WHO HAS READ ABOUT HIM, HAS BEEN INSPIRED BY HIS LIFE.
WELL, NOW CAN GO AND ACTUALLY.
SEND THEIR RESPECTS IN THAT AREA THAT'S EVER SINCE THE ACCIDENT, THAT IS A PLACE THAT THE FAMILY HAS BEEN GOING EVERY SINGLE THIRTY FIRST OF DECEMBER.
AND AT THE BEGINNING, I REMEMBER THERE WERE MANY, MANY PEOPLE THAT WERE LOOKING TO SEE IF IT WOULD APPEAR THEN, YOU KNOW, WITH THE YEARS THAT WERE LESS AND LESS AND LESS TO SHOW.
AND IT WAS JUST LIKE THE OFFICIAL LIKE FAMILY PRIVATE PLACE TO PAY OUR RESPECTS.
NOW WE'RE OPENING IT TO THE WORLD, TO THE FANS THAT WOULD LIKE TO COME.
SO IT'S IT'S VERY IMPORTANT FOR US THAT THIS BE CONSIDERED AND SUPPORTED SO WE CAN FINALLY HAVE THAT PLACE TO SHARE.
ALSO NOW WITH EVERYONE WHO ADMIRES MY FATHER'S LEGACY.
YOU HAVE A QUESTION TO THE COMMITTEE, ELSOM ENFORCEMENT.
WHAT DID THIS SITE MEANS TO THE PEOPLE IN PUERTO RICO? MANY PEOPLE DON'T KNOW EXACTLY WHERE IT IS.
THEY FEEL THAT IT'S IN IN THE VICINITY IN THE AREA, BUT THEY'RE NOT 100 PERCENT SURE SPECIFICALLY WHERE IT IS.
SO THERE IS A MARKER THAT WAS DONE AND IT'S BEEN UNDER THE CUSTODY OF THE GOVERNOR'S MANSION IN PUERTO RICO.
AND THAT IS GOING TO BE PLACED IN THAT AREA.
THAT WILL BE THE FIRST THING THAT IT WILL HAPPEN.
WE ARE LOOKING TO HAVE THE PAST RECIPIENTS OF THE ROBERTO CLEMENTE AWARD TO BE WHO HAVE NEVER BEEN REUNITED TO BE THE FIRST TO BE AT THE PLACING OF THIS MARKER.
SO THEY'RE THE ONES WHO ACTUALLY FIRST AND THEIR RESPECTS.
AND THEN FROM THAT POINT ON, WE ENVISION THAT, YOU KNOW, I HAD A CONVERSATION WITH THE MAYOR OF LOAIZA TO LET HER KNOW THAT, YOU KNOW, THERE'S GOING TO BE LOGISTICS AND WE'LL HAVE TO TAKE PLACE BECAUSE THERE WILL BE A LOT OF WE FORESEE A LOT OF DONATIONS, A LOT OF PEOPLE PLACING.
YES, I MEAN, THERE WILL BE PROBABLY SPORTING EQUIPMENT, YOU KNOW, THAT THERE WOULD BE FLOWERS THAT WOULD BE.
WE FORESEE THAT HAPPENING, AND I BELIEVE, WELL, THE PEOPLE OF PUERTO RICO, OBVIOUSLY THEY THEY THEY HAVE OUR FATHER LIKE HIS HIGHEST EXAMPLE OF WHAT A TRUE PUERTO RICAN IS.
AND THE GENERATIONS CONTINUE TO READ ABOUT HIM IN THE ELEMENTARY SCHOOL.
THERE'S A CHAPTER TO SPEAKS ABOUT ROBERTO CLEMENTE, HIS LIFE.
[01:30:01]
SO WE WANT TO KEEP THAT AND NOT ONLY HIS, BUT NOW ALSO OUR MOTHERS, WHO RECENTLY AS IN NOVEMBER OF NINETEEN.BOTH OF THEM, THEIR LEGACIES, IT'S AMAZING, THIS IS WHY WE DO WHAT WE CONTINUE TO DO TO HONOR BOTH OF THEM. SO IT IS REALLY IMPORTANT FOR US AND IT MEANS A LOT THAT THIS RESOLUTION PASSED AND HE SUPPORTED.
AND. ANY QUESTIONS? COUNCIL MEMBER, YOU KNOW, THANK YOU, MAYOR, AND THANK YOU, GENTLEMEN, FOR BEING HERE AND THE REST OF YOUR FRIENDS AND FAMILY, I APOLOGIZE FOR NOT BEING AT THE DEDICATION.
EARLIER, I GOT CAUGHT UP WITH TRYING TO PREPARE FOR THIS MEETING.
YOU GUYS WERE HERE. HE WAS SO I CAME HERE LIKE RIGHT AT SEVEN O'CLOCK.
BUT ONE QUESTION I DID HAVE AND TRYING TO LOOK IT UP BECAUSE I KNOW MY BASEBALL TIME KIND OF STOPPED WHEN JOHN SMOLTZ RETIRED, ALTHOUGH THERE'S A BRIEF TIME.
I WAS A PRETTY BIG BRAVES FAN BY.
NOW, IN LOOKING UP THE STORY AND GETTING INTEREST IN IT, IS THIS SITE GOING TO IT'S GOING TO BE ACTUALLY ON THE BEACH? IS THAT THE LOCATION? YES, IT IS ACTUALLY A MILE AND A HALF FROM WHERE THE PLANE TOOK OFF.
AND IT'S ACTUALLY RIGHT THERE IN FRONT OF THE BEACH.
AND IT'S ACTUALLY ONE PLACE THAT I BELIEVE THAT FOR THE FIRST TIME, PEOPLE WILL HAVE TO PAY THEIR RESPECTS AFTER FORTY NINE YEARS THIS YEAR TO BE ABLE TO HAVE SOMEWHERE THAT THEY CAN GO, LIKE JFK MEMORIAL.
NEVER BEEN ANYWHERE THAT WE CAN ACTUALLY RECOGNIZE OUR FATHER.
ALL RIGHT, THANK YOU, GUYS. I THINK, JONATHAN.
I MEAN, FELIX, YOU WANTED TO WEIGH IN.
THE ONLY THING I WOULD SAY A WHOLE DIFFERENT IN SUPPORT OF THIS, MUCH MORE TO ADD TO THAT IS I MEAN, WHAT ELSE I'VE BEEN IS SUPPORTING THIS.
THANK YOU. I WANTED TO ADD THERE IS THERE IS A BIG, BIG ROCK LIKE IN THE MIDDLE OF THE OCEAN. THAT OBVIOUSLY SURROUNDED BY WATER THAT WE'RE LOOKING INTO EVENTUALLY ALSO INCLUDING A STATUE OF OUR FATHER OR WHERE IT CANNOT BE VANDALIZED BECAUSE IT COULD BE YOU CANNOT GET TO IT AND THAT WILL BE SOMETHING THAT WILL BE THE LAST THING AS YOU LEAVE ODORICO, AS YOU TAKE OFF IT OVER FLIES.
ALL WE WOULD ALL FLY THAT AREA.
SO THAT'S PART OF WHAT WE'RE LOOKING EVENTUALLY TO TO EXPAND IT INTO.
THANK YOU SO MUCH. ARE YOU AND ARE YOU READY? ALL RIGHT. THANK YOU SO MUCH.
THOMAS. GOOD EVENING AND TOM BRASWELL, I'M THE PRESIDENT OF THE RURAL COMMUNITY FOUNDATION, FIRST OF ALL, I WANT TO THANK THE MAYOR AND THE MEMBERS OF THE CITY COUNCIL AND EVERYONE FOR THEIR PARTICIPATION AND PRESENCE THIS EVENING.
EARLIER AT THE COMPLEX DEDICATION, THIS SITE, AS WE MENTIONED, IS IS A SITE THAT IS PREVIOUSLY HARD TO GET TO, BUT KIND OF AS A THREE PRONGED PROCESS.
PREVIOUSLY, WHEN I WORKED WITH MAJOR LEAGUE BASEBALL, WE WANTED TO PUT A MARKER THERE SO THAT PEOPLE KNEW WHERE IT WAS.
AGAIN, AS LUIS AND ROBERTO MENTIONED, WE WOULD GO THERE ON NEW YEAR'S EVE AND PAY TRIBUTE. BUT IT'S NOT A PLACE THAT IS A SITE THAT YOU WOULD KNOW WHERE TO GO TO.
SO THE MARKER HAS WE SAID IT WAS COMMISSION, IT WAS DEDICATED, UNVEILED.
IT SITS IN THE GOVERNOR'S MANSION IN PUERTO RICO, BUT IT'S BEEN HIT BY SOME BAD WEATHER.
ALSO, THERE WERE TIDAL WAVES AND THE TWO HURRICANES.
SO IT SITS THERE. OUR GOAL IS TO GET THAT MARKETPLACE THERE.
THE SECOND PART OF THIS ALSO, AS MENTIONED, WE'RE COMING UP ON, BELIEVE IT OR NOT, 50 YEARS OF THIS TRAGIC AND UNTIMELY PASSING.
SO AS WE COME UP NEXT YEAR, WE WOULD LIKE TO GET THE MARKER THERE, BUT ALSO HISTORIC MARKER ONE THAT'S GOING TO BE KIND OF VERY MUCH PERMANENT.
THE ONE THAT WE COMMISSIONED IS A BEAUTIFUL MARKER WITH A COLOR PICTURE AND THE WHOLE HISTORY OF ROBERTO AND ALSO WHAT HAPPENED TO HIM.
BUT WE WANT TO PUT THIS AGAIN, ONE OF THOSE KIND OF HISTORIC SITE MARKERS THERE.
AND WE APPRECIATE HAVING THE CITY OF PALM BAY AND THEIR NAME TO THE UNITED STATES CONGRESS WHO PASSED THIS RESOLUTION.
EIGHTY FIVE TO ONE WITH TREMENDOUS SUPPORT, BIPARTISAN SUPPORT.
WE'VE GOT CITIES OF PITTSBURGH, HARTFORD, CONNECTICUT, NEW YORK CITY, THE STATE LEGISLATURE IN NEW JERSEY.
SO WE ARE SO GRATEFUL THAT YOU ARE CONSIDERING AND HOPEFULLY WE'LL BE ADDING YOUR NAME TO THAT LIST. AND THEN AT LEAST MENTIONED THERE ARE OTHER THINGS AFTER THE MARKER, AFTER THE PLACEMENT. WE DO WANT TO HAVE POSSIBLY A NICE LITTLE MEMORIAL PARK WHERE PEOPLE CAN COME AND PAY RESPECTS BECAUSE ROBERTO WAS A GREAT HUMANITARIAN.
THERE WERE ALSO FOUR OTHER PEOPLE ON THE PLANE AND WE PROBABLY WOULD PUT MAYBE FIVE TREES
[01:35:05]
THERE. SO WE WOULD ALSO PEOPLE CAN ALSO COME THE FAMILIES OF THOSE VICTIMS AS WELL CAN COME AND PAY TRIBUTE. BUT AGAIN, PEOPLE CAN COME AND REFLECT.AND AS I SAY, WE GO ALL OVER THE WORLD, ALL OVER THE COUNTRY.
AND EVERYWHERE YOU GO, THERE ARE ROBERTO CLEMENTE FANS.
AND AGAIN, THIS WILL BE ANOTHER AREA WHERE THEY CAN COME AND PAY TRIBUTE TO THE GREAT PERSON HE WAS. AND ALSO, WE WANT TO WE WANT TO INSPIRE PEOPLE TO DO THE GOOD WORKS THAT ROBERTO DID, BUT HAS BEEN VISITING TODAY AT HERITAGE HIGH SCHOOL.
WE WANT TO ALSO INSPIRE CHILDREN TO LEARN THE STORY OF ROBERTO CLEMENTE, AS WELL AS BEING ABLE TO THEN DO GOOD WORKS, DO GOOD DEEDS, BECOME GOOD CITIZENS, BECOME GOOD MEMBERS OF THEIR COMMUNITY, AND THERE IS NO GREATER ROLE MODEL.
THEN FOR THAT THEN ROBERTO CLEMENTE.
SO WE APPRECIATE YOUR CONSIDERATION AND WE THANK YOU VERY MUCH.
MY NAME IS SAMANTHA BETTMANN, AND I'M HERE TONIGHT.
AS A REPRESENTATIVE OF THE ORGANIZATIONS THAT MY FATHER, SAMUEL CASSIANO LOPEZ, WAS THE FOUNDER OF UNITED THIRD BRIDGE INC.
UTB AND THE FLORIDA PUERTO RICAN HISPANIC CHAMBER OF COMMERCE INC., AS YOU ALREADY KNOW, MY FATHER, SAMUEL CASSIANO LOPEZ, PASSED AWAY IN JANUARY OF 2021.
HE WAS A FIERCE ADVOCATE FOR CIVIL RIGHTS, RECOGNIZING THE PUERTO RICANS AND THE PEOPLE OF COLOR THAT HAVE MADE CONTRIBUTIONS TO THIS GREAT COUNTRY.
YOU WORKED HARD TO GET PEOPLE TO KNOW WHO ROBERTO CLEMENTE WALKER WAS AND WHAT A GREAT HUMANITARIAN HE WAS.
AND TONIGHT WE ARE HERE TO SUPPORT THE RESOLUTION 20, 21, 18, REQUESTING THAT THE UNITED STATES SECRETARY OF THE INTERIOR TO ADD ROBERTO CLEMENTE WALKER'S PLACE OF DEATH IN LOAIZA, PUERTO RICO, THE NATIONAL REGISTRY OF HISTORICAL PLACES, AS A MARKER.
THANK YOU AND MAY GOD BLESS YOU ALL.
YOU CAN FEEL IT, OR AS YOU WERE COUNCIL MEMBER I.
UM. HOW CAN YOU GO AFTER THE SONS SAID WHAT THEY SAID? I JUST WANTED TO ASK MY COLLEAGUES ON THE DYS TO SUPPORT THIS.
WE COULD REACH OUT TO SO MANY PEOPLE BY SUPPORTING ESPECIALLY THE PUERTO RICAN COMMUNITY HERE IN PALM BAY AND ALSO BEING PART OF HISTORY AND JOINED OTHER CITIES ACROSS THE COUNTRY, THE U.S.
DEPARTMENT OF INTERIOR, TO DO THE RIGHT THING AND NOT WAIT 50 MORE YEARS TO PUT A HISTORICAL MARKER THERE.
LET'S MAKE HISTORY PALM BAY TONIGHT.
LET'S SUPPORT THIS AND PASS THIS RESOLUTION.
SO. THE FIRST THING I'D LIKE TO SAY, COUNCILMAN FORCER, IS THANK YOU.
THE SECOND THING I'D LIKE TO SHARE IS I WOULD BE REMISS IF I WOULDN'T HAVE ROBLETO AND LEWIS COME BACK TO THE PODIUM FOR ONE SECOND.
COMING OUT REPRESENTING YOUR FATHER AND HIS LEGACY.
YOUR MOM IS WELL. YOUR MOTHER WAS A STAUNCH SUPPORTER OF YOUR FATHER, ALWAYS SPEAKING HIGHLY OF ALL HIS ACTION ON THE FEELING OF AND WHAT YOU'RE DOING IS LIFTING UP YOUR FAMILY. I'D LIKE YOU TO TAKE A MOMENT, ROBLETO, IF YOU WOULD.
TO SHARE THE STORY ABOUT THE PRESIDENT.
THAT YOU SHARED WITH US EARLIER TODAY, BECAUSE I THINK IT'S WORTH HEARING AGAIN, BECAUSE IT JUST ENCAPSULATES THE LIFE OF SO MANY OTHERS AND HOW YOUR FATHER TOUCHED THE LIVES, INSPIRED THEM TO GREATER HEIGHTS.
YOU KNOW, WE HAVE BEEN VERY FORTUNATE BECAUSE OF OUR FATHER'S LEGACY TO MEET SO MANY PEOPLE. AND THAT INCLUDES PRESIDENT SINCE JIMMY CARTER AND EVERY PRESS, EVERY PRESIDENT EVER SINCE. AND, YOU KNOW, FROM, YOU KNOW, GEORGE W.
BUSH HANGING OUT ON HIS FARM AND WHEN HE WAS AN OWNER OF THE RANGERS.
BUT MOST IMPORTANTLY, BECAUSE OF TODAY AND SPEAKING ABOUT, YOU KNOW, JACKIE ROBINSON AND
[01:40:05]
OF COURSE, WE ALL KNOW THE STORY.BUT PERSONALLY, I NEVER MET JACKIE.
I MET I HAD THE PRIVILEGE OF MEETING HANK AARON AND HANGING OUT WITH HANK AND BEING A TRAVELING PARTNER IN 86.
WE HUNG OUT A LOT AND WE GOT TO KNOW US VERY WELL.
AND, YOU KNOW, YOU KNOW, GOING BACK AND TALKING ABOUT THE PRESIDENT, I MET BARACK OBAMA, LIKE I SAID, BILL CLINTON.
BUT BARACK OBAMA THE FIRST TIME MEETING HIM, THE FIRST THING HE SAID TO ME WAS, YOUNG MAN, WHY DIDN'T YOU KNOW? YOU SHOULD BE VERY PROUD BECAUSE YOUR NAME MOVES MOUNTAINS.
AND THAT WAS VERY POWERFUL TO ME.
AND ON A FUNNY NOTE WAS BILL CLINTON WERE TALKING AND HE COMES TO ME, HE GOES, YOU KNOW, ROBERTO, I WAS I WAS TALKING TO MY GOOD FRIEND HENRY AARON.
AND HE I ASKED HIM, HE GOES, WHO WAS THE BEST PLAYER YOU EVER SAW PLAY THE GAME? AND HE WAS 100 PERCENT SURE THAT HE WAS GOING TO SAY WILLIE MAYS.
AND THAT FOR ME ALWAYS, YOU KNOW, SHOWS HANK, YOU KNOW, ALWAYS QUIET, SUCH A GENTLEMAN, BUT ALWAYS KNOWING AND ALWAYS HAVING GOOD TASTE.
IT WAS WORTH HEARING YOU SAY THAT AGAIN, I WANT TO THANK YOU FOR CONTINUING THE LEGACY.
I ALSO WANT TO ENCOURAGE YOU TO LISTEN NOT ONLY I THINK THERE'S A CONSENSUS ON THIS COUNCIL TO SUPPORT THIS VENTURE, BUT AS YOU KNOW, THIS IS THE SECRETARY OF THE INTERIOR.
AND SO THE EFFORTS WITH WORKING WITH THE U.S.
HOUSE OF REPRESENTATIVES AND THE US SENATE, PERHAPS EVEN GATHERING SOME CONTACTS WITH THE RESIDENT COMMISSIONER OF PUERTO RICO, JENNIFER GONZALEZ.
THERE'S A STAFFER I KNOW THAT WORKS ON THESE TYPE OF ISSUES BY THE NAME OF GABRIEL BRAVO.
SO I UNDERSTAND THAT NOT ONLY IS THIS MAJOR IN THIS COUNCIL SUPPORTIVE OF ESTABLISHING THAT, BUT I'M WILLING TO ASSIST YOU EVEN FURTHER OUT THAN JUST VOTING ON THIS ON YOUR VENTURE IN PARTICULAR WITH THE DATE OF SUCH HIGH SIGNIFICANCE, THE FIFTIETH ANNIVERSARY OF THAT OF HIS DEMISE.
SO I UNDERSTAND THAT YOU'VE NOT ONLY GOT MY HEART, YOU'VE GOT MY EFFORTS AS WELL.
THANK YOU FOR YOUR SERVICE AND FOR ALL THE MILITARY AND SERVICE MEN.
WOULD YOU KINDLY SAY YOUR FATHER, ROBERTO CLEMENTE, SERVED IN WHAT BRANCH? BUT HE OUR FATHER WAS A MARINE.
THANK YOU. I REALLY APPRECIATE YOUR WORDS AND RECOGNIZING MOM'S EFFORTS AS WELL.
I ALWAYS SAY I'M VERY PROUD TO BE ROBERTO'S SON, BUT I FEEL EXTREMELY HONORED AND FORTUNATE TO BE THEIR SON AS WELL.
THANK YOU SO MUCH. SO CANCEL OUT AND ENTERTAIN A MOTION.
THE MOTION TO PASS RESOLUTION 20, 21, 18, REQUESTING THAT THE UNITED STATES SECRETARY OF INTERIOR TO DOCUMENT A PLACE OF DEATH AND LEWIS OF PUERTO RICO TO THE NATIONAL REGISTRY OF HISTORICAL PLACE.
MOTION BY COUNCILMAN FOSTER AND SECONDED BY COUNCILMAN FELIX.
ANY FURTHER DISCUSSION, GENTLEMEN? ALL IN FAVOR. ANY OPPOSE PASSES UNANIMOUSLY.
CONGRATULATIONS. NEXT ON THE AGENDA IS ITEM TWO.
I'M GOING TO DEFER TO DEPUTY MAYOR JOHNSON.
THANK YOU, MAYOR. SO THIS IS JUST WHEN AN ORDINANCE HAS BEEN PASSED AND IT'S BEEN WITHIN A YEAR, YOU HAVE TO COME BACK AND REQUEST FROM COUNCIL TO RECONSIDER TO MAKE ANY CHANGES OR AMENDMENTS. SO THIS ISN'T CHANGING THE ORDINANCE ITSELF RIGHT HERE.
THIS IS JUST REQUESTING COUNCIL TO MAKE A MOTION AND APPROVE ME TO WORK WITH STAFF.
AND I KNOW THAT COUNCILMAN BAILEY HAD SOME QUESTIONS REGARDING MS., SO.
I GUESS. YOU LIKE TO GO, DO YOU WANT ME TO I'LL GO NOW.
[01:45:07]
THANK YOU, MAYOR. THEY NEED TO BE MAYOR.NO STAFF HAVE BROUGHT US THE LANGUAGE WE HAD BEFORE.
I KNOW WE WERE TRYING TO SHOW GOOD FAITH EFFORT AND IMPROVING OUR PROCESSES TO SHOW THAT TO THE STATE FOR THE AUDIT REVIEW THAT WE HAD.
I THINK THAT REVISITING IT AND LOOKING FOR WAYS TO IMPROVE IT IS CERTAINLY SOMETHING THAT AN OPPORTUNITY THAT WE SHOULD KNOW THAT'S AVAILABLE TO US.
AND I HAVE NO PROBLEM TAKING THAT.
I DID WANT TO MAYBE ADD TO IT SOME AND THAT NOW I'VE ADVOCATED AND I STILL ADVOCATE THAT PERHAPS THERE SHOULD BE A CHARTER OFFICE FOR INSPECTOR GENERAL.
BUT ONE OTHER WAY OF LOOKING AT THAT.
NO, INSTEAD OF ANOTHER CHARTER OFFICE, WHICH MIGHT ENTAIL A HIGHER AMOUNT OF RESOURCES, A STARTUP IS LOOKING AT MAYBE HAVING SOMETHING UNDERNEATH THE PURVIEW OF THE CLERK'S OFFICE. MOST OF THESE THESE ISSUES WILL BE COMING THROUGH THE CITY MANAGER'S OFFICE.
WE NEED THE CITY ATTORNEY'S OFFICE TO BE THERE AS LEGAL ADVISEMENT.
SO WE DON'T NECESSARILY WANT TO THROW THEM INTO THE PROCESS.
AND I SEE YOU'RE ADDING KNOW, WHAT YOU'RE LOOKING TO DO IS SWITCH OUT THE CITY MANAGER FOR CLARK. AND I UNDERSTAND THE I UNDERSTAND WHY YOU'RE DOING THAT.
SO WE HAVE KIND OF OUTSIDE EYES.
AND I JUST WAS GOING TO SAY THAT MAYBE WE CAN TAKE IT EVEN STEP FURTHER IF WE WOULD HAVE SOME TYPE OF COMPLIANCE OFFICER, SOMEBODY WITH SOME TYPE OF CREDENTIALS, MAYBE FRAUD PREVENTION OR OR A FRAUD INVESTIGATOR.
I MEAN, WE CAN SAY WITH DIFFERENT WITH DIFFERENT TERMS. AND BUT I WOULD LIKE TO DO AND I'D CERTAINLY BE HAPPY IF THE DEPUTY MAYOR WOULD LIKE TO PICK THAT UP. IF YOU'RE IN AGREEMENT, DEPUTY MAYOR, AND INCLUDE THAT IN YOUR EFFORTS, I'D LIKE TO SEE IT. OR IF YOU WANT ME TO CONTINUE GOING DOWN THAT PATH, THAT'S FINE, TOO.
BUT I WOULD LIKE TO SEE THAT EFFORT TO BE AN ADDITION TO TO WHAT WE'RE DOING HERE.
SO WE HAVE THE ADDED LEVEL OF ACCOUNTABILITY.
SO, YOU KNOW, I'M GOING TO WEIGH IN ON THIS ONE, IF YOU DON'T MIND ME.
SO WHAT YOU'RE SAYING IS WHEN YOU SAY ARE YOU REFERRING TO A LAW ENFORCEMENT OFFICIAL WITH TYPE OF CREDENTIALS, THAT TYPE OF CREDENTIAL YOU'RE REFERRING TO? I THINK THAT WE WOULD WANT TO HAVE THE CLERK AND, YOU KNOW, PERHAPS ALL OF WHICH OUR OFFICERS CAN LOOK AT WHAT TYPE OF CREDENTIALS WE'RE LOOKING AT.
CERTIFICATIONS ARE OUT THERE. I DON'T KNOW IF SHE WOULD BE ABLE TO COST EFFECTIVELY GET SOMEBODY WHO'S CERTIFIED AS AN INSPECTOR GENERAL TO WORK UNDERNEATH THERE.
BUT THERE ARE I THINK THERE ARE OTHER LEVELS OF CREDENTIALS, AND I THINK WE SHOULD BE NOW, I GUESS I'M LOOKING FOR IS MAYBE THAT'S A STEP TOWARDS HAVING THAT EXTRA ACCOUNTABILITY. AND THAT WOULD STILL, IF WE'RE GOING TO HAVE HER ON THAT COMMITTEE, THEN SHE WOULD HAVE A PROFESSIONAL THERE AND THAT BE THEIR JOB.
AND THEN MAYBE EVEN THE FUTURE OF THAT POSITION, THAT PERSON, AFTER WE LOOK AT IT, THAT PERSON MIGHT EVEN BE ABLE TO SAY, INSTEAD OF HAVING A PERMANENT COMMITTEE OF THE H.R.
PROCUREMENT AND. IS IT FINANCE, BUT MAYBE, MAYBE NOT ALWAYS, MAYBE THERE ISN'T THE EXPERTIZE YOU ALWAYS NEED, MAYBE THAT COMPLIANCE OFFICERS SAY, OK, FOR THIS PARTICULAR ONE, I NEED AN ENGINEER AND SOME OTHER TYPE OF EXPERTIZE.
AND THEN IF IT'S FINANCIAL, THEY COULD GET THE FINANCIAL EXPERTIZE TO CONVENE THOSE BOARDS. I'M NOT LOOKING TO MAKE IT THAT EXPANSIVE.
I'M JUST KIND OF LOOKING AHEAD A STEP AHEAD.
BUT FOR THE TIME BEING, IF WE CHANGE THE AUDIT COMMITTEE THE WAY THAT THE MAYOR IS ASKING AND THEN THEY LOOK AT EXPLORING, ADDING A POSITION WITH THE CITY CLERK THAT WOULD BE AN ASSISTANT TO LOOKING AT THESE WHISTLEBLOWER AND OTHER TYPES OF COMPLAINTS FROM THE OUTSIDE, OUTSIDE AND INTERNAL.
I THINK THAT WOULD BE GREAT. AND ALSO, IN ADDITION TO WHAT HE SAID ABOUT, SAY, CODIFYING THE ANONYMOUS CLAIMS, YOU'RE SAYING THAT'S SEPARATE FROM THE WHISTLEBLOWERS CLAIMS. OK, SO I'LL LET YOU EXPAND UPON THAT.
BUT I JUST WANT TO MAKE SURE I TOOK THIS OPPORTUNITY TO SAY, OK, MAYBE I KNOW I'M NOT GOING TO GET TO THE END TODAY, BUT MAYBE IF I CAN JUST GET ONE STEP, CONSIDER CONSIDERED YOU'RE CREATING A POSITION IS WHAT YOU'RE SAYING, AND HAVING IT COME OUT OF THE CLASS OF.
THAT'S JUST WANTED TO BE CLEAR ON AND IT'D BE SOMETHING ALONG THE LINES OF LIKE WHAT CREDENTIALS OR SOMEONE THAT IS OVERSEEING A DIFFERENT TYPE OF AUDIT.
YEAH, SO THEY'RE THEY'RE GOING TO BE INVESTIGATED.
WHAT, YOU'RE YEP. OK, THANK YOU.
I APPRECIATE THE CLARIFICATION, DEPUTY MAYOR JOHNSON.
CONVOLUTE THE MOTION RIGHT HERE FOR REQUEST TO RECONSIDER, BUT I'M FINE WITH EXPLORING THAT UNDER THE CITY CITY CLERK'S OFFICE.
I KNOW SHE'S TYPING AWAY, BUT SHE PROBABLY HAS HER OWN OPINION.
SO I'LL SIT AND TALK WITH HER AFTER THIS.
SO WOULD IT WOULD IT HAVE TO BE AMENDED OR.
WELL, NO, THIS IS JUST A REQUEST TO RECONSIDER.
[01:50:01]
IS IT PERHAPS.MAYBE WHAT I SHOULD ASK IS IF COUNCIL'S OK WITH ME HAVING CONVERSATIONS WITH OUR OFFICERS, EXPLORE WHAT THAT POSITION WILL LOOK LIKE SO THAT WE CAN BRING IT BACK MAYBE TOWARDS THAT SAME MEETING SO WE CAN HAVE THAT GENERAL DISCUSSION.
I DON'T MIND BOTH COUNSEL WORKING ON THAT MS. SMITH, WOULD YOU LIKE TO WEIGH IN? IF WE'RE GOING TO.
I WHATEVER WHETHER AUDIT COMMITTEE, WHETHER IT'S A PERSON THAT'S REPORTING TO THE CLERK, ALL OF THAT BEING DRESSED IN THE SAME AUDIT AS IT MAY BE A LITTLE DIFFICULT FOR TWO COUNCIL MEMBERS TO WORK WITH A STAFF WITHOUT STAFF ACTUALLY MAKING MISTAKENLY POINTING AT SOMEBODY ELSE INSTEAD OF FILING SUNSHINE.
SO I WOULD REALLY PREFER TO WORK WITH ONE COUNCIL MEMBER WITH THE AUDIENCE.
SO YOUR INTENT IS PRETTY CLEAR HERE WHAT YOU'RE LOOKING TO CHANGE.
AND I THINK THAT I ASSUME THAT YOU'VE TALKED TO MS. SMITH ABOUT WHAT YOU WOULD LIKE.
SO YOU'RE CLEAR ON WHAT THE DEPUTY MAYOR IS ASKING RECONSIDERATION OF? YES, SIR. OK, THEN I'LL JUST TAKE IT.
WE'LL SEE IF WE TAKE A LOOK AT MAYBE TAKING A STEP FURTHER WITH THAT, WITHOUT PROFESSIONAL, THAT CAN HELP GUIDE IT.
AND YOU'RE SAYING THAT THAT PROFESSIONAL TITLE MIGHT BE COME UP IN THE ORDINANCE AND HOW WE GIVE THEM A RESPONSIBILITY.
ALL RIGHT. I LOVE THE TEAMWORK APPROACH TO THIS.
THANK YOU, DEPUTY MAYOR JOHNSON.
ARE THERE ANY SPEAKER CARDS? NO ONE WISHES TO SPEAK ON THIS.
SO I'LL ENTERTAIN A MOTION MOTION TO APPROVE RECONSIDERATION OF WHISTLE-BLOWER ORDINANCE AS REQUESTED. I GOT A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN BAILEY.
ANY FURTHER DISCUSSION ALL IN FAVOR, I OPPOSE PASSES UNANIMOUSLY, WE'RE ON NUMBER THREE, CONSIDERATION OF CERTAIN NUMBER THREE.
MADAM CHAIRMAN. THANK YOU, MAYOR.
THIS IS OUR FIRST LIST THAT WE'RE BRINGING TO YOU NOW THAT WE HAVE A RESIDENTIAL REAL ESTATE BROKER COMMITTED TO ASSIST US.
SO THERE ARE, I THINK, 11 PROPERTIES ON THIS LIST CONSIDERED SURPLUS.
THE MAJORITY OF THEM ARE SMALLER, LESS THAN AN ACRE, SINGLE FAMILY AND MULTIFAMILY TYPE LOTS. AND WE'RE HAPPY TO ANSWER ANY QUESTIONS YOU MIGHT HAVE.
GILBERTON, FIVE EIGHTY SIX OCEAN SPRAY STREET SOUTHWEST, I'VE ADDRESSED THE PURCHASING OF SELLING OF CITY LAND PREVIOUSLY AND I UNDERSTOOD WHY WE GOT TO THE POINT THAT WE WERE TRYING TO SELL OFF CITY EXCESS LAND BECAUSE IT WAS WE WERE USING IT AS A FUND GENERATOR OR PAVING OF ROADS.
NOW WE'VE SET UP A MECHANISM TO PAVE ROADS.
WE'VE ALSO SET UP MECHANISMS FOR GUIDING FOR THE ROAD MAINTENANCE.
AND NOW I'M GOING PAST THAT AND LOOKING MORE TOWARDS THE FUTURE AND WORKING SIMILAR TO THE SUSTAINABILITY SIDE OF IT IS WE'RE NOT GOING TO BE ABLE TO GENERATE MORE GREEN SPACE THAN WHAT WE HAVE NOW.
SO I'M NOT THAT I'M AGAINST THE SALE OF THIS.
I'M AGAINST THE SALE OF GREEN SPACE JUST TO MAKE AN EXTRA DOLLAR TO.
THAT'S KIND OF CONTRADICTORY, WHAT YOU SEE OUT OF BILL BATTON, BUT IF WE DON'T WIN, WE LOSE IT. THE CITY IS GOING TO SAY, WELL, NOW WE HAVE TO TAKE MORE OF OUR FUNDS TO BUY LAND IN ORDER TO MEET THE CRITERIA THAT WE'RE GOING TO EVENTUALLY REQUIRE FOR GREEN SPACE WITHIN THE CITY, BECAUSE MORE AND MORE OF THAT IS BEING GOVERNED UNDER SUSTAINABILITY THROUGHOUT THE NATION. THERE'S A GIVE AND TAKE AND WE HAVE A FUNDING SOURCE NOW FOR ROADS. WE DON'T NEED TO BE SELLING OFF AT THE HIGH RATE OF GREEN SPACE WITHIN THE CITY.
THANK YOU VERY MUCH. SUSAN CONNOLLY.
AND BEFORE I BEGIN, I JUST HAPPENED TO HAVE THE DRAFT OF THE 20 20 SUSTAINABILITY MILITARY ACTION PLAN THAT WE'RE WORKING ON.
GET DOWN THAT WAY, IT'S ON THE.
COUNCILMAN BAILEY HAS A POSITION AT LARGE THAT HE CAN APPOINT TO THE COMMITTEE, BUT I WANTED TO REFERENCE AN EARLIER REMARK HE MADE ABOUT REPUBLICAN RECYCLING AND THE COST OF PLASTICS AND THINGS, AND THAT IS BEING ADDRESSED IN OUR PLAN.
IN FACT, THE INNOVATIVE WASTE MANAGEMENT IS ONE OF MY FAVORITE CHAPTERS, SO.
I THINK ALSO IN THE HEART OF THAT PLAN IS THE SETTING ASIDE OF LANDS FOR PRESERVATION AND
[01:55:09]
SUSTAINABLE DEVELOPMENT.I THINK WHAT SETS US ASIDE IN PALM BAY IS THAT WE HAVE LAND TO SET ASIDE, THAT WE HAVE LAND ALMOST 60 PERCENT THAT IS UNDEVELOPED.
THIS FACT ALONE CARVES US OUT FROM ALL THE OTHER OTHER MUNICIPALITIES WHO DON'T HAVE THIS. THEY'RE STARTING FROM RETROFITTING AND TRYING TO RECREATE FROM SOMETHING THAT ALREADY HAS A STRUCTURE ON IT.
SO THIS LAND, EVEN THOUGH IT IS A SMALL, TINY PIECE OR CONSIDERED TO BE MAYBE NOT SO ESSENTIAL JUST SITTING THERE, THE COST THAT WE WOULD GET TODAY CANNOT EVEN BE COMPARED TO THE FUTURE VALUE THAT IT WILL HOLD ONCE WE.
LEARN WE DON'T EVEN KNOW WHAT THE FUTURE HOLDS, BUT THE LAND PRESERVING IT AND SETTING ASIDE AND STARTING WITH OUR SUSTAINABILITY PLAN.
SO MY ASK OF THE COUNCIL TONIGHT IS, WAIT, DON'T SELL IT RIGHT NOW.
WAIT, WAIT FOR OUR PLAN TO COME OUT AND WAIT FOR THE COMPREHENSIVE PLAN IN THE CITY HALL MEETINGS AND SOME OF THESE THINGS THAT ARE IN IN COMING RIGHT NOW WHERE CITIZENS WILL HAVE INPUT AND OTHERS LIKE ME CAN TELL YOU WHAT OUR IDEAS ARE AND WE CAN TOGETHER SEE THE FUTURE. RIGHT NOW WE CAN'T.
AND SELLING A PIECE OF PROPERTY FOR TAX VALUE.
THAT IS WHAT WE KNOW, BUT WHAT'S IMPORTANT IS WHAT WE DON'T KNOW WHAT IS TO COME.
AND SO I ASK YOU THAT YOU WAIT, LET US FINISH OUR PLAN, AND ANOTHER IDEA WOULD BE ASK US FOR ALTERNATIVE IDEAS.
LET US, INSTEAD OF SELLING IT FOR PROPERTY TAX, LET A GROUP OF US COME BACK TO YOU AND SAY, WELL, YOU KNOW WHAT? WE THINK WE COULD USE THIS LAND IN THIS WAY AND MAYBE WOULD BE MORE ECONOMICAL.
OH, I'M OUT OF TIME, BUT THANK YOU VERY MUCH.
WHEN ELSE, DEPUTY MAYOR JOHNSON? NATURALMOTION. MAKE A MOTION FOR ACCELERATION OF CERTAIN ON REAL ESTATE TO BE DESIGNATED SURPLUS LISTED FOR SALE TO THE PUBLIC.
SECOND, I'VE GOT A MOTION BY COUNCIL MEMBER BAILEY, SECONDED BY DEPUTY MAYOR JOHNSON.
ANY FURTHER DISCUSSION? JUST ONE QUICK THING SO YOU CAN SPEAK TO WHAT WE SPOKE ABOUT IN REGARDS TO WHAT WE'RE LOOKING AT. YES, SO THIS LIST IS JUST 11 PROPERTIES WE HAVE.
DOZENS AND DOZENS, IF NOT HUNDREDS OF PROPERTIES STILL ON OUR SURPLUS LIST.
UM, AND I ACTUALLY SPECIFICALLY WENT THROUGH THIS LIST WITH THE TEAM TO MAKE SURE THAT WE WERE ACTUALLY THINKING ALONG THE VERY SAME LINES AS WHAT THE RESIDENT SPOKE ABOUT.
WE ONLY BROUGHT YOU A LIST OF PROPERTIES THAT ARE THERE'S A HANDFUL OF SINGLE FAMILY LOTS THAT ARE ALREADY IN AREAS WHERE THERE'S SINGLE FAMILY DEVELOPMENT.
SO THERE'S NOT A SPECIFIC NEED THAT WE COULD SEE FOR FUTURE USE FOR THE CITY.
UM, THERE'S ONE THAT'S A SMALL IT'S LIKE A ONE ACRE COMMERCIAL AREA PARCEL THAT'S ON THERE AND THERE.
LIKE I SAID, THERE ARE A HANDFUL OF SOME SMALLER LOTS THAT WE ACTUALLY GOT FROM COUNTY THROUGH THE TAX PROCESS.
AND THOSE ARE MULTIFAMILY CURRENT FOR THE ZONING AND LAND USE.
BUT WE SPECIFICALLY EXCLUDED FROM THIS LIST ANY OF THE LARGER PARCELS.
AND BY THAT I MEAN PARCELS THAT WERE THREE, FOUR OR FIVE ACRES PLUS BECAUSE WE WANTED TO MAKE A VERY CAREFUL APPROACH TO LOOKING AT THE CITY LAYOUT.
ONE OF THE THINGS WE TALKED ABOUT IN HOW INTERNALLY AND WE WANTED TO PREPARE OURSELVES, HAVE A DEEPER CONVERSATION COUNCIL, BUT IT'S JUST LOOKING AT THE LAYOUT OF WHERE ALL OF OUR CURRENT PARKS ARE, WHERE PEOPLE CAN WALK TO GREEN SPACE.
CURRENTLY, NOT NECESSARILY SAYING THAT WE WOULD EVEN DEVELOP THESE PARKS IN THE FUTURE, BUT THE QUESTION CAME UP, SHOULD WE CONSIDER SAVING THESE BECAUSE THEY ARE GREEN SPACE FOR THIS EXISTING NEIGHBORHOOD AND NEIGHBORHOODS THAT ARE FAST DEVELOPING? SO A LOT OF THINGS TO LOOK AT AND THINGS THAT WE'RE GOING TO BE TALKING ABOUT AND CERTAINLY BRING BACK TO COUNCIL.
ELEVEN OF HUNDREDS OF PARCELS THAT THE CITY CURRENTLY OWNS.
AND THAT WAS SOMETHING IN LARGE PART, THE GDC, UM, BLACK FOREST, WHICH IS NOT NECESSARILY A BAD THING IF YOU THINK ABOUT THE LONG TERM DEVELOPMENT OF THE CITY.
ANY FURTHER DISCUSSION COUNCIL? MAYOR HALSMAN BAILEY, THEN COUNCILMAN FELIKS, PLEASE, MAY I JUST SAY BASIC TO MS. SHERMAN'S POINT? THAT'S THE REASON I MADE A MOTION THAT THIS IS VERY, VERY SMALL PORTION.
[02:00:03]
I'VE SEEN THE LIST BEFORE IN THE PAST.AND KEEP IN MIND THAT SOME OF THESE NEWER ONES THAT WE INHERITED, THAT THEY ALSO ALSO COME AT COST. SO WHENEVER THERE'S ISSUES ON THESE PROPERTIES, TAXPAYERS, WE HAVE TO WE HAVE TO REMEDY THEM.
AND SO THEREFORE THEIR LIABILITY AT TIMES WE SEE THAT WE SAW THE ISSUES THAT WE'RE HAVING OVER THERE IN THE HOLIDAY PARKS OR SUBDIVISION RIGHT NOW AND THE COST OF ITS INCURRED UPON US. THAT WAS A GIFT TO US FROM THE COUNTY.
SO ANYHOW, SO THAT'S WHY I HAVE NO PROBLEM MOVING FORWARD WITH THIS.
BUT I THINK STAFF AND MY TALKING WITH STAFF, THEY'VE BEEN PRETTY CONSERVATIVE ABOUT LOOKING TO SAVE A LOT OF THEM BECAUSE I WAS WONDERING WHY IT WAS SO SHORT.
BE HONEST WITH YOU, BUT I DON'T HAVE A PROBLEM WITH THIS.
THANK YOU, MAYOR. COUNCILMAN BAILEY JUST BASICALLY MENTIONED THE EXACT SAME THING I WAS ABOUT TO SAY. I ADDED THE ACREAGE CAME UP TO LESS THAN EIGHT, EIGHT, EIGHT ACRES.
SO IT'S VERY SIGNIFICANT IN THE SENSE WHERE AND I'M REALLY TRUSTING STAFF DUE DILIGENCE ON CHOOSING AND PICKING OUT THOSE THE SITES I WOULD BE IN SUPPORT OF AT.
THANK YOU, COUNCILMAN FELIX, I'M GOING TO CALL THE QUESTION ALL IN FAVOR, I TO OPPOSE PASSES UNANIMOUSLY.
THIS LAST ITEM OF NEW BUSINESS WAS A AN AGENDA REVISION.
WE HAVE AN OPPORTUNITY TO APPLY FOR A A WHAT'S CALLED A CANINE HEAT ALARM GRANT.
SO THIS IS THE SYSTEM THAT MONITORS THE OBVIOUSLY THE TEMPERATURE IN THE VEHICLES WHERE THE CANINE WOULD BE LOCATED.
IT IS A NO-MATCH GRANT AND WE'RE JUST LOOKING FOR THE OPPORTUNITY AND PERMISSION OF COUNCIL TO APPLY TO ADD THIS TO ONE OF OUR VEHICLES.
THANK YOU, ANY SPEAKER CALL ANYONE, WHICH IS.
WELL, I'LL ENTERTAIN A MOTION SO MOVES A NEW BUSINESS NUMBER FOR A SECOND AND A MOTION BY COUNCIL MEMBER ALI SECONDED BY DEPUTY MAYOR JOHNSON.
ANY FURTHER DISCUSSION, COUNSEL, IT'S GREAT, THE AINUN.
ALL IN FAVOR. ANY OPPOSED PASSES UNANIMOUSLY, ITEM NUMBER FIVE.
I'M GOING TO DEFER TO COUNCILMAN BAILEY.
AND I'LL SLOW ROLL THIS AND THE DEPUTY MAYOR GETS HE HAD TO GO FOR A SECOND HERE.
I KNOW THAT, YOU KNOW, I BELIEVE HE'S BEEN IN CONTACT WITH THE FAMILY OF MR. SPELLMAN. FOR THOSE IN THE AUDIENCE WHO DON'T ALREADY KNOW, HE DID PASS YESTERDAY MORNING. OBVIOUSLY, WE'RE GOING TO WE'RE GOING TO WE'RE GOING TO HAVE A LITTLE HOLE, I THINK, HERE IN THE CHAMBERS AND IN OUR HEARTS FOR FOR SOME TIME NOW WITHOUT HIM HERE.
BUT I THINK WE ALL KNOW THAT HE HE WENT TO WITH HIS FAITH AND HIS THE WAY THAT HE GLORIFIED HIS FAITH AND HIS ACTIONS AND JUST HIS WHOLE DEMEANOR.
WE KNOW HE'S IN A BETTER PLACE FOR THOSE WHO BELIEVE.
BUT WHAT I WANTED THE OPPORTUNITY TO DO IS I KNOW THAT THERE'S GOT TO BE PROBABLY EVERYBODY IS PRAY A LOT OF PEOPLE WHO ARE THINKING OF WAYS THAT WE CAN HONOR HIM.
AND I MY UNDERSTAND THAT THERE MIGHT BE THINGS ARE BEING PURSUED BY OTHER OTHER COUNCIL MEMBERS, AND THAT'S FINE.
I DON'T WISH TO DETRACT FROM THEM OR STOP THEM OR ANYTHING.
I WANT US ALL TO TO TO COLLABORATE FOR.
SO WHAT I WANTED TO DO IS THAT MY THOUGHTS, ONE OF THINGS I'VE SAID FOR FOR FOR A FEW YEARS NOW WAS REALLY SINCE HIS WIFE PASSED WAS THAT, YOU KNOW, WHEN WHEN THAT DAY DOES COME. THAT WE DO SOMETHING TO HONOR HIM WHEN THINGS WHEN MY THOUGHTS IS THAT WE WOULD NAME THIS THIS BUILDING AFTER HIM, I THINK THAT THAT WOULD BE A GREAT, GREAT HONOR.
AND THERE'S OTHER IDEAS THAT I HAVE.
BUT THE THING ABOUT IT IS THAT I DON'T WANT IT TO BE WHERE COUNCIL MEMBER BROAD IDEA AND THAT'S WHAT WE DID OR ANOTHER COUNCIL MEMBER WE JUST WENT TO ONE TRACK.
WHAT I WANT TO DO IS EXPLORE THE BEST WAY TO HONOR HIM AND DO IT COLLABORATIVELY, BECAUSE I THINK IF THERE'S ONE THING THAT WE CAN AGREE ON IS THAT WE ALL AGREE THE POSITIVE EFFECT OF WHAT MR. SPELMAN HAS HAD HERE IN THIS CHAMBER OVER THE YEARS.
AND ANY TIME THAT WE WE'RE GETTING OFF TRACK, HE ALWAYS REMIND US WHAT'S IMPORTANT AND WHO WE'RE HERE TO SERVE. AND, YOU KNOW, HE HE SERVED THE NATION IN THE NAVY AND RESERVES AFTERWARDS. AND, UM, HE SERVED AS A.
AND HE JUST HE WAS JUST A LIGHT OF SUNSHINE.
AND SO WHAT I'VE WRITTEN, I ADDED THIS AGENDA ITEM, WAS THAT WHAT I WANTED TO GET COUNSEL AND WHETHER IT NEEDS TO BE A MOTION OR CONSENSUS AND MEAN.
I'M NOT WORRIED ABOUT THE THE PROCESS AS MUCH AS THAT.
WHAT I WANT TO DO IS HAVE OUR CHARTER OFFICERS OR, YOU KNOW, MAYBE OUR CLERK OR CITY MANAGER LEAD IT UP AND HAVE LIKE A COMMISSION TO LOOK AT THE WAYS WE CAN HONOR REVEREND SPELLMAN AND EXPLORE ALL THE WAYS.
I MEAN, MAYBE IT'S STREET NAMING ANOTHER.
[02:05:02]
NO, I WAS TALKING. MY WIFE WAS IF WE HAD THIS PICTURE IN HERE WITH WITH A QUOTE FROM HIM, I THINK I THINK THERE'S A LOT OF GOOD AND I'M SURE THE COUNCIL MEMBERS HAVE GREAT IDEAS.SO IF WE CAN HAVE, LIKE, THAT KIND OF COMMISSION TO THEM, THEY CAN TALK TO US, THEY CAN TALK TO FORMER COUNCIL MEMBERS, THEY CAN TALK TO THE STAFF, PUBLIC FAMILY AND JUST COME BACK WHEN MAYBE A COUPLE OF REALLY GREAT IDEAS OF HOW WE CAN HONOR REVEREND SPELLMAN.
I THINK THAT WOULD BE A REALLY SPECIAL THING FOR US TO DO.
SO THAT'S WHY THAT'S WHY I ADDED TO THE AGENDA.
SO WE CAN ALL BE IN THIS TOGETHER AND HAVE EVERYBODY'S VOICES HEARD AND REALLY DO IT TOGETHER. THANK YOU, COUNCIL MEMBER.
I'D LIKE TO HEAR FROM COUNCIL DEPUTY MAYOR JOHNSON'S GOT HIS HAND UP JUST ALREADY FIRED UP. YEAH, I CAN HEAR YOU.
I CAN HEAR EVERYTHING COUNCIL MEMBER BAILEY.
SO BUT I APPRECIATE YOU ADDING THIS ON.
I WANTED TO ADD SOMETHING SIMILAR ON, BUT AS BILL BENNETT HEARD ME SAY, I WAS GOING TO ADD ANYTHING ON LAST MINUTE.
SO SO THAT'S THE ONLY REASON WHY.
BUT COUNCIL MEMBER, I APPRECIATE YOU DOING THIS ON.
AND YES, I'VE BEEN IN CONTACT WITH THE FAMILY AS WELL.
AND THEY WILL THEY WILL SUPPORT THIS.
AND I HAVEN'T TALKED TO THEM TODAY, BUT I KNOW THEY WOULD SUPPORT THIS.
YEAH, REMEMBER, SPILMAN WAS AMAZING, MAN.
YOU KNOW, MY TALKS ABOUT THE REVEREND FOUR, A MORE APPROPRIATE TIME, BUT I DO SUPPORT THIS WHOLEHEARTEDLY. SO SO SO MAYBE IF WE CAN CONVENE OUR CHARTER OFFICERS, THAT'S WHAT I WOULD ASK OUR OFFICERS AND THEY CAN WHOEVER THEY WANT TO ADD IN THAT PROCESS, TO LOOK AT THOSE WAYS, KNOW THE TECHNICALITIES AS TO HOW FAR AS OUR PROCESSES.
I CERTAINLY DON'T WANT TO HAMSTRING THE CHARTERED OFFICERS EITHER IN THAT EFFORT.
BUT OTHER OFFICERS OR WHOEVER THEY DESIGNATE MIGHT MIGHT MIGHT BE SOMETHING THAT WOULD BE BENEFICIAL, BECAUSE, AS YOU KNOW, EVERYONE'S SCHEDULES ARE PRETTY TIGHT.
SO BUT I THINK IT'S GREAT TO BRING THAT UP AS WE SEE THIS.
PATRICIA, HAD ANY OPINION ON IT OR YOU OK? THIS IS JOHN. SHE'S GOOD.
ANYONE ELSE WANT TO WEIGH IN? UH, FELIX, THANK YOU.
I WOULD DEFINITELY BE ON BOARD AS FAR AS YOU KNOW.
HONORING FINDING A WAY FORWARD, AS COUNCIL MEMBER BAILEY SAID, I WOULD SUPPORT WHATEVER COUNCIL. COUNCIL MEMBER FOSTER.
REVEREND SPELLMAN WAS A VERY SPECIAL PERSON, AND EVERY TIME I GOT TO MEET HIM IN PUBLIC IN A RESTAURANT, I MAKE SURE I ACKNOWLEDGE HIM AND AND LET HIM KNOW THAT.
HE'S HERE AND YOU SPEAK TO HIM, SO, YES, I THINK WE NEED TO HONOR HIM AND I AGREE WITH COUNCIL MEMBER. THANK YOU.
I JUST ALSO WANTED TO SHARE THAT WHATEVER IT IS, WE SHOULD HAVE A SCRIPTURE.
WITH HIS NAME SOMEWHERE ALONG THE LINE, BECAUSE THAT'S WHAT HE WAS ALL ABOUT, IT WAS ABOUT BRINGING FORTH THE SCRIPTURES TO LIFE, AND I JUST WANT TO SHARE THAT.
I KNOW WHERE HE IS AND I'M SEE HIM AGAIN IN CONFIDENCE, I CAN TELL YOU THAT.
AND IN MAY, THERE WAS A SECOND PART TO THIS, TOO, AS I THINK I MIGHT HAVE SENT IT TO EVERYBODY. I JUST SENT IT OUT TO REPLY TO WHAT ROSEMARY SENT OUT TO US YESTERDAY.
BUT NOW I DID TALK TO TO ROBERT, HIS SON, EARLIER, AND HE HAD JUST FINALIZED THE FUNERAL ARRANGEMENTS. IT'S GOING TO BE MONDAY AT THE CAPE CANAVERAL CEMETERY AT ONE 30 CAPE CANAVERAL NATIONAL CEMETERY.
NOW, HE WILL BE RECOGNIZED IN HIS SERVICE.
AND SO HE ASKED ME TO SPREAD THAT WORD.
SO OBVIOUSLY, I KNOW THERE'S A FEW PEOPLE IN THE AUDIENCE WHO MIGHT BE INTERESTED IN ATTENDING THAT. I KNOW THAT THEY WOULD LOVE TO HAVE YOU ALL.
THE THE OTHER SIDE OF THAT IS THAT THERE THERE'S NOT A VIEWING, BUT WE DID KNOW QUICKLY DISCUSSED THAT THEY WOULD LIKE TO AT SOME POINT HAVE A CELEBRATION OF LIFE.
AND WHAT I WOULD LIKE TO KNOW WHETHER THE CITY ORGANIZED SOMETHING.
WE'VE HAD THIS FOR OUR EMPLOYEES.
AND HE IS HE WAS CERTAINLY PART OF THE PALM BAY FAMILY IN THIS AUDIENCE.
BUT IF WE IF WE HAD SOMETHING, WHETHER IT'S AT ONE OF OUR PAVILIONS OR ONE OF OUR REC CENTERS OR HERE AT CITY HALL, BUT IT HELPED THEM ORGANIZE WITH THAT, WORK WITH THEM AS LONG AS THEY KNOW TO COOPERATE WITH THEM.
THAT IS WHAT MAKES SURE COUNCIL IS ON BOARD WITH THAT.
AND AND I TALKED TO ALL OF OUR CHARTER OFFICERS EARLIER TODAY TO GIVE THEM A HEADS UP THAT THAT'S ONE OF THE THINGS THAT I WANTED TO DISCUSS.
JUST HOPE THAT WE'RE OK WITH DOING THAT, BECAUSE THAT WOULD BE A GREAT TIME WHERE WE CAN KIND OF LOOK AT THOSE QUOTES I TALKED TO.
YOU CAN REMEMBER WHICH ONE OF YOU GUYS, WHICH IS ONE OF THE CHARTER OFFICERS I MENTIONED, TOO. BUT IF WE GOT, LIKE QUOTES OR SOME SNIPPETS OF SOME OF HIS PUBLIC COMMENTS, THAT THAT WOULD BE NICE TO TO PLAY THERE AT THAT TIME.
[02:10:01]
JUST HAVE SOME THAT MEMORY IN THAT IN THAT POSITIVE ENERGY, HE BROUGHT SO MANY.I THINK THAT THAT WOULD BE ANOTHER GREAT THING THAT THE CITY CAN DO TO SHOW APPRECIATION FOR HIS LIFE AND TO HIS FAMILY FOR ALL THAT HE DID BECAUSE HE CARED ABOUT ABOUT PALM NOW MORE THAN ANYBODY ELSE NOW CAN IMAGINE.
I LOVE THAT IDEA OF A CELEBRATION OF LIFE, I'VE I'VE BEEN KNOWN TO LEAD SEVERAL OF THOSE SERVICES AS A MINISTER MYSELF, SO I THINK THAT'S A GREAT IDEA.
I DON'T KNOW HOW YOU WOULD HANDLE THAT, MADAM CHAIRMAN, BUT UNDERSTAND THAT I'M AT THE DISPOSAL OF THIS COUNCIL AND STAFF IF YOU WANTED TO BESTOW THE BLESSING OF ME PARTICIPATING IN SOMETHING LIKE THAT.
BUT I LEAVE THAT UP TO YOU AND THE COUNCIL.
DO WE NEED. WE HAVE CONSENSUS WITH THIS, WE NEED THIS IN THE FORM OF A MOTION, MADAM OR AL-MANSOURI CONSENSUS IS FINE.
COUNCILMAN FELIX, I THINK YOU WANTED TO WEIGH IN ON SOMETHING.
AND I WOULD ADD I THINK IT'S A GREAT IDEA.
OK, WE'RE UP TO ADMINISTRATIVE AND LEGAL REPORTS.
[ADMINISTRATIVE AND LEGAL REPORTS]
MS. SHERMAN, NOTHING FURTHER, MAYOR, THANK YOU.MS. SMITH. YES, MAYOR, I RECENTLY CONTACTED COUNCIL LETTING YOU ALL KNOW THAT THE LOCAL GOVERNMENT ATTORNEYS AND THE ATTORNEY GENERAL HAVE COME TO SOME UNDERSTANDING AS FAR AS THE ALLOCATION OF THE SETTLEMENT PROCEEDS.
AND THERE IS A PROPOSED RESOLUTION THAT THE ATTORNEY GENERAL WILL LIKE THOSE THAT THOSE LOCAL GOVERNMENT ENTITIES THAT ARE IN AGREEMENT WITH TO PASS.
I HAVE SPOKEN WITH OUR LITIGATION TEAM, INCLUDING OUR LOCAL COUNSEL, MICHAEL KAHN.
AND SO WHAT WE'RE PLANNING TO DO, BECAUSE I DIDN'T WANT TO JUST BRING A RESOLUTION AND SAY COUNCIL. ASK THIS AND LET'S MOVE ON.
IS TO BRING THAT RESOLUTION FORTH AT EITHER THE MAY 6TH OR MAY 20TH, BUT HAVE MICHAEL KAHN WILL BE HERE AND A REPRESENTATIVE FROM THE LITIGATION TEAM TO EXPLAIN THE PROCESS OF. HOW WE GOT HERE, AS FAR AS THE LITIGATION ITSELF, THE SETTLEMENT PROCEEDS, THE ALLOCATION AGREEMENT, WHAT THEY ARE ENVISIONING, SO COUNSEL HAS THE OPPORTUNITY TO ASK ANY QUESTIONS. THE PUBLIC KNOWS WHAT'S GOING ON.
AND I THINK THAT'S A FAR MORE TRANSPARENT PROCESS.
WE HAVEN'T MADE DEFINITIVELY TELL ME WHICH DATE, BUT WE'RE LOOKING AT ONE OF THE DATES IN MAY. BUT I'M CERTAINLY NOT INTENDING TO BRING IT UNTIL I ACTUALLY HAVE SOMEONE HERE THAT CAN ANSWER THE QUESTIONS FOR COUNSEL IN THE PUBLIC.
THE OTHER ITEM WAS THE COMMERCIAL BROKER, WE HAD TALKED ABOUT THAT AT THE LAST MEETING AS FAR AS. ME FINDING WHAT INTERIM MEASURES THAT COULD BE THAT WE COULD DO WHILE WE ARE WAITING TO SOLICIT.
SO I DO HAVE A LISTING OF THOSE THINGS THAT WE CERTAINLY COUNCIL CAN THINK ABOUT AND WE MAY BE ABLE TO IF COUNCIL DECIDES TO DOWN IN THE FUTURE.
FORCE ONE OPTION, WHICH I DID SPEAK WITH CHRISTOPHER BROWN AND BILL DELLINGER, IS TO CONTINUE WITH OUR CURRENT A BROKER UNTIL WE ACTUALLY DO HAVE THE NEW BROKER, A COMMERCIAL BROKER SELECTED.
AND THEY HAVE AGREED THAT IF THAT IS COUNSEL'S WISH, THEY WOULD SERVE UNTIL WE HAVE A NEW ONE SELECTED AND THE AGENT, MR. BILL, WOULD BE AVAILABLE TO DO THAT.
ANOTHER OPTION, WHICH WE DISCUSSED AT THE MEETING, WOULD BE TO AWARD IT TO THE SECOND HIGHEST BIDDER. ANOTHER OPTION WOULD BE WHERE THE CITY WOULD SOLICIT ELSEWISE FOR INDIVIDUAL PROPERTIES.
WE COULD USE AUCTION SERVICES OR WE COULD JUST LEAVE THE NOT DO ANYTHING AND NOT ACTUALLY SOLICIT ANYTHING FOR THE PROPERTIES UNTIL WE HAD ANOTHER COMMERCIAL BROKER.
BUT THOSE ARE SOME OF THE VARIOUS OPTIONS THAT THE CITY TO PURSUE IN THE INTERIM.
THERE IS. OK, SO WE SPOKE ABOUT ME AND MRS.
[02:15:03]
SMITH SPOKE ABOUT THE OPIOID LITIGATION, SO THIS HAS BEEN A LONG TIME COMING.THIS ACTUALLY STARTED BEFORE I WAS YOUR OWN COUNSEL.
THIS IS RIGHT BEFORE I GOT ELECTED.
WHEN I REMEMBER WE WERE LOOKING AT AT FIRST THEY WERE LOOKING AT GOING WITH RECORD BOOKS ARE WITH ONE BOOK.
AND THEN THEY WENT WITH MICHAEL KAHN.
AND WE WERE ONE OF THE FIRST CITIES TO PURSUE THIS.
AND HE WAS SAYING THAT IS BIG, THAT WE WERE BECAUSE NOW THREE YEARS DOWN THE LINE, WE'RE GOING TO GET A PIECE OF THE PIE WHERE A LOT OF PEOPLE ARE TRYING TO JUMP ON LAST MINUTE AND THEY MIGHT NOT HAVE THAT OPPORTUNITY.
SO I THINK IT'S GREAT IF WE CAN GET SOMEBODY HERE.
I SPOKE TO MS. MR. KHAN HIMSELF, AND HE WAS SAYING THAT IT'S IMPORTANT THAT WE GET SOMEBODY HIGHER UP WITH A BETTER UNDERSTANDING OF IT SO THAT THEY CAN ANSWER THE QUESTIONS.
BECAUSE I KNOW EVEN THOUGH WE WERE PART OF THE PROCESS COUNCIL MEMBER, I KNOW WE'RE GOING TO HAVE QUESTIONS ONCE THEY COME BEFORE US, BUT.
YES, WHATEVER THE AMOUNT OF MONEY IS, I DEFINITELY WANT US TO LOOK AT, YOU KNOW, OUR FIRST RESPONDERS BECAUSE THEY'RE THE ONES THAT HAVE TO TAKE CARE OF THESE INDIVIDUALS THAT OVERDOSE OR ARE DEALING WITH A LOT OF THESE SITUATIONS.
SO I'M EXCITED FOR IT BECAUSE IT'S BEEN A LONG ROAD.
AND IN ABOUT HER SECOND REGARDING THE BROKER, YOU GOT TO YOU WANT TO WEIGH IN ON THAT? WHICH ARE WHICH OPTION YOU MIGHT PREFER.
OUR LEGAL COUNSEL FOR THAT ONE.
YEAH, OBVIOUSLY, ON THE LITIGATION, YOU STILL, MR. CARD, TO SHOW US THE MONEY, RIGHT? THAT'S THAT'S THE ONLY THAT'S THE ONLY QUESTION I'VE GOT.
OBVIOUSLY, IT SHOULD BE IN A FUND THAT THAT THAT TIES BACK TO WHERE THE COSTS ARE INCURRED. AND SO THAT OBVIOUSLY I THINK THAT'S THAT MAKES SENSE.
I WAS JUST GOING TO ASK TO THE MAYORS QUESTION, CAN YOU REPEAT THOSE OPTIONS AGAIN THAT YOU HAD FOR THE BROKERAGE? BECAUSE I THINK I MISSED OUT ON PART OF ONE OF IT.
YES, WE CAN CONTINUE ON WITH THE CURRENT BROKER WHO WOULD REMAIN REMAIN ON STAFF AS FAR AS WITH THE TEAM, WITH THE CONTRACT, UNTIL WE WERE ABLE TO REPLACE THEM.
WE COULD AWARD IT TO THE SECOND HIGHEST BIDDER.
WE COULD SEEK LETTERS OF INTEREST FOR INDIVIDUAL PROPERTIES.
WE COULD USE AUCTION SERVICES OR WE COULD DO NOTHING.
YOU HAVE ANY RECOMMENDATIONS OR JUST STAFF HAVE ANY RECOMMENDATIONS ON WHICH OF THOSE, BECAUSE I CAN'T I DON'T HAVE A CLEAR IDEA OF WHAT THE PRIORITIES WERE TRYING TO LIQUIDATE TO THIS PROCESS WOULD LOOK LIKE.
WELL, I'LL ASK STAFF TO COME UP IN.
HERE ARE SOME OF THEIR THOUGHTS. I'VE ASKED JULIETTE TO JOIN ME AS WELL.
WE DID HAVE A MEETING, WE MET WITH ERIC MESSENGER, PART OF THE CITY ATTORNEY TEAM, AND WE WENT OVER THE SEVERAL OPTIONS, SEVERAL OPTIONS THAT WE UNDERSTOOD BEING AVAILABLE FOR THESE PROPERTIES. THERE ARE CURRENTLY TWO PROPERTIES NOT UNDER CONTRACT THAT ARE COMMERCIAL, BOTH SMALL IN NATURE, ABOUT ONE ACRE IN SIZE.
AND THE OTHER THREE ARE THE PELICAN HARBOR MARINA PROPERTIES, THE THREE PROPERTIES CURRENTLY UNDER ALAOUI WITH BROKERS BROUGHT FORTH BY OUR AMAIA COMMERCIAL BROKER.
THOSE THEY THEY WILL STILL REPRESENT THOSE THOSE BUYERS.
THAT REMAINS ONLY THE TWO FOURTEEN HUNDRED SPORTSMAN LANE, WHICH COINCIDENTALLY WAS ON THE LIST TONIGHT, DIDN'T NEED TO BE.
IT WAS ALREADY BROUGHT FORTH WITH THE COMMERCIAL BROKERAGE CONTRACT.
THE OTHER IS FIFTEEN EIGHTY TWO.
WATER DRIVE IS A SMALL ONE ACRE PARCEL NEXT TO JUST SOUTH OF THE CHAMBER.
SO THE OPTIONS THAT WE SPOKE OF WERE AND CORRECT ME IF I'M WRONG, JULIA, I'M GOING OVER MY CHICKEN SCRATCH HERE, TEMPORARY AMENDMENT TO.
SECOND WAS THE USE IN THE SECOND ROUND FROM THE OTHER, THE THIRD OPTION WAS AUCTION.
THE FOURTH OPTION WAS A LETTER OF INTEREST OR AN EXPRESSION OF INTEREST.
WE RANKED THOSE WE CAME OUT WITH OPTION NUMBER ONE, BEING A TEMPORARY AMENDMENT.
OH, YOU'RE CORRECT. WE ACTUALLY TOOK THE FIRST OPTION OFF ALTOGETHER, OUR FIRST OPTION WAS GOING WITH THE SECOND RANKED FROM.
RIGHT, DRYER AND ASSOCIATES AND I HAVE ACTUALLY WORKED WITH MICHAEL DRYER AND SCOTT MARKETING IN THE PAST AND MY EMPLOYMENT WITH CITY OF COCOA AND OTHERWISE, AND THEY'RE GOOD. THEY'RE GOOD AT WHAT THEY DO.
SO I WOULDN'T HAVE ANY CONCERNS WITH THAT OR.
OK, SO WE'VE CONTACTED WE KNOW THAT THE CURRENT BROKER WOULD BE WILLING TO AMEND.
DO WE KNOW THAT THAT DRYER WOULD BE WILLING TO TAKE IT OVER? WE HAVE NOT SPOKEN TO MICHAEL DREYER.
WE WERE WAITING TO HAVE THIS COME UP BEFORE COUNSEL.
I WASN'T AWARE THIS WAS COMING UP TONIGHT.
SO I APOLOGIZE. I'M A LITTLE UNPREPARED.
[02:20:01]
I HAVE SOME CONCERNS WITH GOING CONTINUING WITH AMI.I HAVE EXPRESSED TO SUSANNE AND TO JULIET MY CONCERNS WITH THE PERFORMANCE BY OUR BROKER BILL DOWN TO IN FACT, WE HAVE PREPARED A VENDOR PERFORMANCE EVALUATION, WHICH WAS HE DIDN'T PERFORM UP TO OUR STANDARDS.
SO I DO HAVE SOME CONCERNS WITH GOING WITH THAT OPTION.
OPTION TO THIS QUESTION FOR JULIET, DID YOU NOT SAY LAST ON LAST MEETING THAT WE HAD SOME ISSUE WITH IT? POTENTIALLY SOME.
OH, MY MY CONCERN WITH GOING WITH DREYER AND ASSOCIATES IN ANY BROKER IS THE INTERM CONCEPT. WELL, I DON'T KNOW IF SOMEONE WOULD BE WILLING TO TAKE THIS ON.
AND THIS IS ANY FIRM OTHER THAN R.M.
KNOWING THAT MS. SMITH SPOKE TO THEM. ON A TEMPORARY BASIS UNTIL WE ISSUE A NEW SOLICITATION.
THAT'S MY CONCERN. I HAVE NOT APPROACHED THEM, MAYBE THEY WOULD LOVE THAT.
I WOULD ASK MS. SMITH, IS IT AN OPTION TO NOT MAKE THAT A TEMPORARY CHANGE, IS IT AN OPTION TO GO TO THEM FOR THE REMAINING DURATION OF THE ORIGINAL CONTRACT PERIOD? YES, THAT'S WHAT I THOUGHT AT THAT TIME.
I THOUGHT TO YOU, I'M LIKE, I DON'T I HAD AN ISSUE WITH GIVING IT TO SOMEONE WHO NEVER ACTUALLY SUBMITTED A PROPOSAL FOR IT.
BUT HAVING THE NUMBER TWO WAS NEVER AN OPTION THAT COULD HAVE BEEN HANDING IT TO EVEN INTO THE NUMBER TWO INSTEAD OF THE LISTING.
BUT IF WE WEREN'T GOING TO GO WITH THE NUMBER TWO, WE WEREN'T GOING TO CONTINUE ON WITH THE INITIAL.
I THOUGHT THAT IT NEEDED TO BE RE SOLICITED.
OK, SO I HAVE A QUESTION IN REFERENCE.
WE'RE TALKING ABOUT TWO PROPERTIES HERE, TWO COMMERCIAL PROPERTIES, ONE OF WHICH IS ON.
I BASS PRO SHOP, CORRECT, AND THAT ONE HAS SOME INTERESTS.
SO WITH THOSE TWO PROPERTIES, WOULD IT HINDER JUST US GOING SOLICITING THE ELSEWISE THIS COUNCIL? WHAT DO YOU MEAN BY SOLICITING OTHER WAYS, LIKE GETTING LETTERS OF INTENT, THAT THAT'S ONE OF THE.
WE WOULD NOT WANT TO OH, I'M SORRY.
SO YOU WERE THINKING LETTER OF INTEREST OR EXPRESSION OR EXPRESSION OF INTEREST AND I CAN LET JULIET SPEAK TO WHAT EXACTLY THAT MEANS.
IT'S SOMETHING SIMILAR TO AN RFP.
THESE PROPERTIES, THEY ARE LOCATED NEXT TO LARGER DEVELOPMENT PROJECTS OR COULD BE ASSEMBLED, FOR EXAMPLE, 50 NATY TO WATER DRIVE THE PROPERTIES, ALL BUT ONE ON THAT BLOCK ARE ALSO AVAILABLE FOR SALE WITH WITH ANOTHER BROKER.
AND THE CITY HAS BEEN APPROACHED IN THE PAST ABOUT SOMEBODY INTERESTED IN ASSEMBLING ALL OF THEM TO INCLUDE THE CITIES.
I WILL SAY THE REASON WHY WE WENT WITH OUR MAYOR IN THE FIRST PLACE WAS BECAUSE OF THE WATERFRONT MARINA PROPERTY AND THEIR EXPERTIZE.
IN DOING THAT, IF WE TAKE THE WATERFRONT PROPERTIES OUT OF THE PICTURE, ASSUMING THAT WE ARE GETTING THESE SALE CONTRACTS.
THAT LEAVES US WITH THESE TWO.
AND DION ASSOCIATES IS MORE THAN CAPABLE.
THAT WOULD BE THE NUMBER, THAT WOULD BE THE PREFERENCE, THE NUMBER ONE TEMPORARY.
ANY OTHER QUESTIONS, COUNSEL? AND ALSO. YOU MEAN I WOULD.
I WILL GO WITH A STAFF RECOMMENDATION AND TAKE UP THE OPTION OF WITHDRAWAL HERE AND MOVE FORWARD. THANK YOU.
I MEAN, YOU LOOK AT WHAT THIS IS JUST EXACTLY WHERE I WAS JUST ABOUT TO MENTION THAT AS WELL, I THINK TAKING ALL INTO CONSIDERATION, OPTION NUMBER TWO AND THE DEPUTY CITY MANAGER IS FAIRLY CONFIDENT THAT, YOU KNOW, THEY WOULD BE MORE THAN CAPABLE.
THE APPROACH, AS JULIETTE MENTIONED, IT'S NOT THE TEMPORARY ASPECT YOU'RE NOT COMFORTABLE WITH WHY, YOU KNOW, NOT PRESENT THEM AND THEN TO SEE HOW THEY ARE WILLING TO MOVE FORWARD AND HOPEFULLY CONSIDER, YOU KNOW, FROM THE PERMANENT.
WELL, ONE THING I'D LIKE TO NOTE IS THAT THIS CONTRACT IS SET UP WITH A ONE YEAR INITIAL PERIOD AND THEN RENEWALS WERE COMING UP OFF OF THE FIRST YEAR AND WE WOULD CONTINUE ON IN THE SAME VEIN SO THAT POTENTIALLY INSTEAD OF A SIX MONTH TEMPORARY PROCESS, WE WOULD ONLY BE TALKING ABOUT A ONE YEAR CONTRACT WITH THE CITY'S OPTION TO RENEW.
SO AFTER THE FIRST YEAR, IF IF STAFF AND COUNSEL FEEL LIKE IT'S IN THE CITY'S BETTER
[02:25:03]
INTEREST TO THEN RE SOLICIT, WE WILL STILL CERTAINLY HAVE THAT OPTION.BUT I FEEL LIKE A ONE YEAR TIME PERIOD IS MORE ENTICING CONTRACT.
AND THEY COULD SAY NO AND WE COULD BE COMING BACK TO YOU TO TALK ABOUT WHAT THE NEXT OPTION WAS. YES.
SO THAT WAS MY QUESTION, WHICH YOU'RE ABOUT TO ADDRESS THERE.
WHAT IS THE SO WHAT'S THE CURRENT DATE FOR THE TERM OF CONTRACT? APRIL 20TH, I BELIEVE.
BUT THEY HAVE ALREADY AND THEY'RE UNDER CONTRACT WITH US.
WE'VE ALREADY CONFIRMED NON RENEWAL WITH THEM.
IT WOULD CONTINUE ON WITH THE WATERFRONT PROPERTIES, AS WE MENTIONED PREVIOUSLY.
IF WE GO TO DRIER, AS SOON AS THEY ACCEPT THEY WOULD GET THROUGH FOR 20 AND THEN THE NEXT YEAR IS WHAT WE'RE WE'RE OVER OR TWENTY, TWENTY, TWENTY TWO AND THEN HAVE AN OPTION FOR AN ADDITIONAL YEAR. SO BY THE TIME WE DO THE PAPERWORK, IT WOULD BE SLIGHTLY LESS THAN A YEAR FOR THE INITIAL PERIOD.
MAYOR, I DON'T THINK THE LETTER OF THE LAW, I WOULD BE GOOD FOR THESE PROPERTIES, I HAVE NO PROBLEM WITH GOING WITH DREIER.
MY RECOMMENDATION IS THAT IS THAT WE ATTEMPT THAT DREIER DECLINES.
THEY MIGHT THEY MIGHT DECLINE THEN I HAD NO PROBLEM GOING BACK WITH OPTION ONE AND AND UNTIL NOW, AMENDING IT UNTIL WE CAN HAVE TIME TO SOLICIT.
AND I DON'T THINK THERE'S GOING TO BE ANY HARM NOW IF THEY DON'T FIND ANYTHING.
THEY DON'T FIND ANYTHING, NED.
I'M AMENDING IT, YOU KNOW, IT'S GOING AGAINST WHAT STAFF RECOMMENDS, THEY JUST DON'T, IF I HEARD CORRECTLY.
THEY THEY DIDN'T PERFORM TO THE.
OUR STANDARD, OUR CRITERIA, FROM WHAT I UNDERSTAND.
IS THAT IS THAT ACCURATE OR DID I MISS MISUNDERSTAND SOMETHING WAS MY BILL.
CAN YOU REPEAT WHAT YOU STATED? BECAUSE I UNDERSTOOD THAT YOU MEANT TO GO WITH RIGHT INTO YOUR DRYER.
I DON'T WANT TO GO BACK IF IF IF DRYER DECLINES AND THEN WE DIDN'T PURSUE THAT THAT WAY.
WE HAVE AN ACTIVE AGENT UNTIL WE HAVE THE RFP DONE WITH OUR ROOM.
YEAH. I MEAN, THE ONLY OTHER OPTION IS WE'RE NOT GOING TO SELL THE PROPERTY RIGHT NOW BECAUSE I DON'T THINK THAT I WOULD PROBABLY BE A GOOD MAN.
AND THAT'S CORRECT. AND I'LL STATE THAT THESE TWO PROPERTIES ARE ALREADY LISTED WITH ARMY AND THEY HAVEN'T BEEN SUCCESSFUL IN A YEAR TO BRING ANY BUYERS FORTH.
THEY'RE NOT CURRENTLY BECAUSE YOU TOOK THEM BACK.
BUT THERE IS RIGHT THAT WE RECENTLY CANCELED OUR SALES AT AN ADDENDUM FOR THOSE TWO PROPERTIES, BUT THEY WERE LISTED WITH ARMY.
THERE IS INTEREST FOR AT LEAST ONE.
I KNOW THERE WAS SOME COMMUNICATION ISSUES BETWEEN OUR ARMY AND WITH STAFF, BUT THERE IS INTEREST ON AT LEAST ONE.
AND THERE'S MORE THAN JUST JUST THAT COMPLAINT.
IN FACT, WE'VE HAD MULTIPLE CLIENTS, NOT JUST THAT ONE, BUT LET'S JUST WORK ON THAT NUMBER. LET'S WORK ON DRY AND THEN COME BACK IF THAT HAPPENS.
DID YOU NEED A MOTION TO THIS, MADAM SMITH, OR ARE WE GOOD WITH WITH JUST THE CONSENSUS? WELL, TO BRING THIS BACK OR HOW DO YOU WANT TO PROCEED? I THINK YOU'VE GIVEN DIRECTION BECAUSE RIGHT NOW THERE ISN'T REALLY ANY IT'S KIND OF WHAT WAS OUR OPTIONS? WE'VE KIND OF DATED.
THE MAIN OPTION IS TO SEE WITH THE SECOND, THEY STILL HAVE TO REACH OUT TO THE SECOND.
I THINK UNTIL WE CAN ACTUALLY KNOW THAT WE CAN ACTUALLY HAVE A PATH FORWARD TO WHATEVER THAT IS, I DON'T THINK THERE IS A NEED FOR MOTION.
I THINK THERE'S SOME DIRECTION.
THAT WAS THE SECOND ONE. AND IF NOT, THEN WE'LL BE BACK AND FORTH DRIER.
AND THAT'S HOW WE'LL PROCEED, BUT RIGHT NOW, I DON'T KNOW THAT THERE'S ANYTHING FOR COUNCIL MEMBER. I THINK WE'RE GOOD THERE.
WE'RE TAKING YOUR RECOMMENDATION.
DEPUTY MAYOR JOHNSON, DID HE SPEAK OF.
WELL, HEARING AND SEEING NONE, THIS MEETING IS ADJOURNED.
WELL, I THOUGHT IT WAS A. AND THERE'S NO CAMERAS, BUT THAT'S WHAT HE MEANT.
BUT. AS YOU WERE THEN, WE'RE OPEN, WE'RE NOT CLOSED, AS YOU WERE PUBLIC COMMENTS I JUST ASKED. I'M SORRY. I'M SORRY.
[PUBLIC COMMENTS/RESPONSES: Speakers are limited to 3 minutes.]
WHAT PROCEDURALLY DO I HAVE TO DO AT THIS POINT? YOU SAY WE'RE OPEN. WE'RE NOT WE'RE WE'RE NOT WE'RE NOT ADJOURNED.YOU'RE FINE. JUST FINE. YOU CAN CONTINUE TO SYRIA.
ANYONE IN THE AUDIENCE WISHES TO SPEAK.
MR. BARTON, PLEASE COME FORWARD.
ABBERTON FIVE EIGHTY SIX I APOLOGIES, BILL.
IT'S QUITE ALL RIGHT. I DIDN'T REALIZE WHEN YOU ASK IF THERE WAS ANY SHEETS.
WELL, WE WOULDN'T KNOW BECAUSE WE DON'T KNOW IN YOUR SHEETS UNTIL AFTER THE MEETING TO WHAT WAS HAPPENING EITHER WAY.
OK, LOBATÓN FIVE EIGHTY SIX, OCEAN SPRAY STREET, SOUTHWEST.
I HAVE TWO ITEMS ADDRESSED UNDER PUBLIC COMMENTS.
THE FIRST ONE WHEN YOU'RE DISCUSSING NEW BUSINESS NUMBER TWO AND LOOKING FOR AN IG OR AN
[02:30:04]
IG FOR THE CITY.I'M NOT QUITE SURE IF WE'RE GOING TO LOOK AT THAT AS A CHARTER EMPLOYER OR CHARTER STAFF MEMBER, THAT WOULD REQUIRE A CHARTER REVIEW COMMITMENT IN CITY CHARTER.
SO I JUST KEEP THAT IN MIND, IF THAT'S WHAT WE'RE LOOKING AT.
RIGHT. THE NEXT ITEM WAS ADDRESS AND RICHARD SPELLMAN.
AND I DO NOT HAVE THE SAME RELIGIOUS UNDERSTANDINGS AND HE KNEW THAT ABOUT ME, AND THAT'S OK BECAUSE WE STILL GOT ALONG VERY, VERY WELL.
BUT HE KNEW WHAT MY RELIGIOUS BELIEFS WERE AND I KNEW WHAT HIS WERE.
AND THAT'S WHAT WE STILL WERE, VERY GOOD FRIENDS TOGETHER.
AND HE ONCE ASKED ME, HE SAYS, BILL, WHEN YOU SHOW UP TO THESE MEETINGS, YOU ALWAYS HAVE SO MUCH UNDERSTANDING AND KNOWLEDGE OF WHAT'S INCLUDED IN THIS.
AND HE'S LOOKING AT JUST THE AGENDA PACK.
AND HE SAYS, WHERE DO YOU GET ALL THAT INFORMATION? SO RICHARD AND I, WE WOULD GO TO THE LIBRARY OVER HERE AND WE WOULD SIT DOWN AND I TAUGHT HIM HOW TO GET IN, HOW TO OPEN THE PACKAGE AND ACTUALLY GO AND READ EACH ONE OF THE LINE ITEMS. AND HE SAYS, AND WE'RE THERE FOR SEVERAL HOURS AT A TIME.
HE SAYS, BILL, HOW DO YOU DO THIS? AND I SAID, YOU KNOW, THE BIBLE.
AND I SAID, I KNOW MY GOVERNMENT.
AND THAT'S HOW WE DID IT. AND SO THERE'S A LITTLE BIT THERE'S A LITTLE BIT OF RICHARD SPELMAN IN ME, BUT I'M SORRY TO HEAR OF HIS PASSING.
ANYONE ELSE IN THE AUDIENCE, WHICH IS TO SPEAK? AND IN HEARING THEM, THIS MEETING IS ADJOURNED.
