[00:00:01] I'M GOING TO CALL THIS REGULAR COUNCIL MEETING, 2021- 19 TO ORDER THE INVOCATION WILL BE [CALL TO ORDER:] LED BY BILL BRATTON AND HE WILL ALSO LEAD US IN THE PLEDGE OF ALLEGIANCE. SO PLEASE RISE. TWO MONTHS AGO, WHEN I REQUESTED THE PRIVILEGE TO GIVE THE INVOCATION, I HAD NO IDEA THAT THERE WAS SUCH A LONG WAITING LIST, BUT HERE I AM NOW. THE PEOPLE WHO KNOW ME KNOW I'M NOT A STRONG RELIGIOUS PERSON. HOWEVER, I WANT TO BE JUDGED AND I WANT TO JUDGE PEOPLE ON THEIR DISPLAYED BEHAVIORS. SO WITH THAT BEING SAID, HERE IS A CODE I TRY TO LIVE EACH DAY BY. IF EACH DAY WITH COURAGE, RESPECT AND SINCERITY. DO WHAT NEEDS TO BE DONE AND DO THE RIGHT THING, EVEN IF NO ONE IS WATCHING. EVERY PERSON DESERVES A SECOND CHANCE. TREAT OTHERS WITH THE SAME RESPECT YOU WISH TO BE TREATED. NEVER STOP FIGHTING FOR WHAT YOU BELIEVE IN. TO BE FAIR, A TOUGH BE COURAGEOUS AND TRY NEVER TO BE PETTY. OK, LOW, OK, SLOW, UNLESS YOU'RE ON A THREE MINUTE TIMER AND DON'T SAY TOO MUCH. ALWAYS TREASURE THE VALUES OF LIBERTY AND FREEDOM. TO BE A TRUE FRIEND IS TO STAY TRUE TO YOUR WORD. ALWAYS HAVE A DREAM AND A GOAL AND A LOVE FOR PURSUING BOTH. THIS IS HOW I TRY TO LIVE MY LIFE. NOW, A LITTLE BIT OF HISTORY ABOUT THE PLEDGE OF ALLEGIANCE AND FOR WHAT IT MEANS TO ME. THE PLEDGE OF ALLEGIANCE WAS CHANGED BECAUSE OF A FEAR OF COMMUNISM INFILTRATING OUR GOVERNMENT. SO IN 1951, UNDER GOD WAS ADDED FOR ME, IT IS NOT HOW OR WHAT IS SAID, BUT MORE IMPORTANTLY, THE CONTEXT OR THE INTENT OF THE PLEDGE OF ALLEGIANCE. IT WAS IT GOES, I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA. AND TO THE REPUBLIC FOR WHICH IT STANDS. NATION OF GOD. I APPRECIATE YOU REPEATING THAT WITH ME AND THAT I WOULD HAVE SAID THE PLEDGE, WHICH BUT THAT'S OK. I WOULD LIKE ALL OF YOU FOR INDULGING ME. THAT WAS VERY SWEET AND NICE OF ALL OF YOU. THANK YOU VERY MUCH. REMEMBER, IT'S FOR THE REPUBLIC FOR WHICH IT STANDS. THANK YOU. THANK YOU, MR. CHIEF. MADAM LEFLER ROCKHOLE, MAYOR MEDINA, PRESENT DEPUTY MAYOR JOHNSON HERE, COUNCILMAN BAILEY. COUNCILMAN BAILEY, CAN YOU HEAR US HERE, COUNCILMAN FOSTER COUNCILMAN FELIX MS. SHERMAN HERE, MS. SMITH. YEAH. [ANNOUNCEMENTS:] DEPUTY MAYOR. YES, MAYOR, WE HAVE ONE VACANCY ON THE BUSINESS IMPROVEMENT DISTRICT BOARD REPRESENTS AT LARGE MEMBER WHO OWNS A COMMERCIAL PROPERTY OR OPERATES A BUSINESS WITHIN A DISTRICT. TWO VACANCIES ON THE COMMUNITY DEVELOPMENT ADVISORY BOARD REPRESENTS RESIDENTIAL HOMEBUILDER ACTIVELY ENGAGED IN HOMEBUILDING EMPLOYED WITHIN THE CITY FOR PROFIT PROVIDER OR NOT FOR PROFIT PROVIDER POSITIONS TO VACANCIES ON THE YOUTH ADVISORY BOARD REPRESENTS AT LARGE STUDENT MEMBER POSITIONS. ANYONE WISHING TO SERVE THESE BOARDS CAN APPLY ONLINE AT PALM BAY FLOOR TO TALK OR CONTACT THE CITY CLERK'S OFFICE AND THREE TWO ONE NINE FIVE TO THIRTY FOUR ONE FOR. THANK YOU, DEPUTY MAYOR, MADAM SHERMAN. [AGENDA REVISIONS:] THANK YOU, MAYOR. THE FOLLOWING AGENDA, REVISIONS ARE READY FOR ANNOUNCEMENT. NUMBER ONE, A REVISED LEGISLATIVE MEMORANDUM, AN AMENDED PURCHASE OFFER FROM SPACE COAST MARINAS HAVE BEEN PROVIDED FOR ITEM SIX UNDER CONSENT AGENDA. A REVISED LEGISLATIVE MEMORANDUM RELATING TO THE INFORMATION TECHNOLOGY DIRECTOR SALARY HAS BEEN PROVIDED FOR ITEM 18 UNDER CONSENT AGENDA. AND STAFF AS THE APPLICANT IS REQUESTING A CONTINUANCE OF ITEM THREE UNDER PUBLIC HEARINGS THROUGH THE SEPTEMBER 2ND COUNCIL MEETING IN ORDER TO REVISE THE TEXTUAL AMENDMENT OF THE BAYFRONT MIXED-USE DISTRICT BASED ON COUNCIL DISCUSSION DURING THE JULY [00:05:01] 1ST COUNCIL MEETING. THANK YOU, MAYOR. I NEED A MOTION FOR THAT SO MOVED WITH A RECEIPT FOR SEPTEMBER. DID YOU SAY YES, SEPTEMBER 2ND, OK, THE MOTION SHOULD REFLECT THAT. SO MOVED. SECOND, I GOT A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN FELIX ANY FURTHER DISCUSSION COUNCIL. AND I'M CALLING FOR A VOTE ALL IN FAVOR I AND OPPOSE. THIS IS UNANIMOUSLY. ADAM SMITH, NO, SIR. MARY. WELL, MARY, I WOULD LIKE TO MAKE IT A GENERAL REVISION AS WELL. MARY, I WOULD LIKE TO MAKE A MOTION TO WITHDRAW ALL ITS TWENTY TWENTY ONE. DASH FIFTY. MOTION TO WITHDRAW THE SECOND READING. I'LL SECOND THAT. SO LAST COUNCILMAN, I REALLY THOUGHT I WAS FINDING A COMPROMISE WITH THE MOTION I MADE BECAUSE AND I STILL TRULY BELIEVE WE NEED A FIVE PERSON COUNCIL TO OPERATE. THAT'S THAT'S REALLY WHAT I BELIEVE. BUT OUTPOLL I'VE RECEIVED. AND MAYOR, YOU KNOW, WHEN I WENT ON A LITTLE BREAK, BUT EVEN AFTER WHEN I GOT BACK TO A LOT OF PEOPLE, THEY STILL THEY BELIEVE WE CAN OPERATE AS A FOUR PERSON COUNCIL. AND WHAT I WILL SAY TO THAT IS THIS PAST TUESDAY IN THE BUDGET WORKSHOP FOR UP HERE, IT WAS JUST LIKE THIS FOUR UP HERE AGREED TO STAY STAND WITHIN THE THREE PERCENT CAP. SO. SO SO WITH THAT BEING SAID, WILL THERE BE CHALLENGES? YES, I I STILL BELIEVE THERE'LL BE CHALLENGES, BUT IT'S BEEN IT'S BEEN MADE CLEAR TO ME. SO WITH THAT BEING SAID, THAT'S WHY I MADE THE MOTION TO WITHDRAW THEIR. WELL, DEPUTY MAYOR JOHNSON, I'VE GOT TO ADMIRE YOUR POSITION TODAY IN YOUR TIME OF REFLECTION AND AND I WHOLEHEARTEDLY SUPPORT. EMOTION, I'M EXCITED ABOUT IT BECAUSE IT IS GIVEN THE RIGHT OF THE PEOPLE AND I'M I'M REALLY EXCITED ABOUT IT. YEAH, COUNCILMAN BAILEY, I HEAR YOU. WOULD YOU LIKE TO MAKE A COMMENT AT THIS TIME? COUNCILMAN BAILEY, CAN YOU HEAR ME? YES, THEY ARE. THANK YOU. I WANTED TO QUICKLY ADDRESS THE EMOTION, AS I HEARD IT WAS FOR A FULL WITHDRAWAL OF THE WHOLE ORDINANCE AS OPPOSED TO A WITHDRAWAL OF THE OF THE BACON I'M SORRY, THE INTERIM APPOINTMENTS PROVISION. MY RECOMMENDATION IS THAT WE NEED TO JUST REMOVE THAT PROVISION. THERE ARE OTHER OTHER SECTIONS OF THAT THAT ARE NOT RELATED TO THE PORTION OF APPOINTING SOMEBODY THAT SHOULD STILL PASS. AND NAMELY ONE OF THOSE IS THE TIMELINE ON WHICH THE ELECTION HAPPENS, BECAUSE AS COUNCIL RECEIVED INFORMATION TODAY, THERE IS ABOUT A 20 THOUSAND DOLLARS DIFFERENCE IF IT WERE TO BE HELD A LITTLE BIT LATER. AND SO WHILE IT'S NO LESS THAN 10 PERCENT OF THE OVERALL COSTS, IT SHOULD STILL BE DONE SO THAT WE CAN SAVE THOSE TAXPAYER DOLLARS. SO THE WITHDRAWAL WAS, FROM MY UNDERSTANDING, AND I'LL CHECK WITH OUR CITY ATTORNEY, BUT THE WITHDRAWAL WAS THE ENTIRE THE ENTIRE ORDINANCE THAT WAS PLACED. THIS WAS THE SECOND READING. IT'S WITHDRAWING THE ENTIRE ORDINANCE. SO I'M GOING TO YIELD TO OUR CITY ATTORNEY AT THIS POINT. YES, SIR. I TALKED WITH DEPUTY MAYOR AND THAT CERTAINLY WAS HIS INTENT. THERE ARE OTHER ITEMS THAT CERTAINLY NEED TO BE CLEANED UP AND CHANGED. AND AS I DISCUSSED WITH HIM, CERTAINLY I WILL BRING THOSE BACK SO THAT OUR ORDINANCES REFLECT THE CHANGES THAT ARE MADE IN THE CHARTER. BUT WAS THE INTENT OF THIS WOULD BE WITHDRAWN? IT WOULD STAY THE SAME AS IT IS NOW IN THE CHANGES THAT NEED TO BE MADE. [00:10:01] I WILL BE BRINGING BACK AT A LATER DATE. IS THAT CLEAR? COUNCILMAN BAILEY, I APOLOGIZE, MS. MS. CAN YOU REPEAT, LIKE THE LAST TWO SENTENCES YOU STATED THERE? THE LAST IDEA WE WOULD BE AUTISTS WOULD REMAIN THE SAME AS FAR AS THE FILLING OF A VACANCY. THERE WOULD BE NO CHANGES TO IT. THE CHANGES THAT WE LEGALLY NEED TO MAKE. I WILL BRING BACK AT A LATER DATE. SO THE INTENT WOULD BE TO WITHDRAW AND NOTHING IN THE ELECTION CODE CHAPTER WOULD CHANGE AT ALL. SO LET ME JUST REAL QUICK, MY MAIN POINT, I UNDERSTAND SOME OF THOSE THINGS CAN WAIT. IS THERE ANY TIME IN THIS ISSUE AS FAR AS CHANGING THE 90 TO 75 DAY PORTION OF THE WINDOW FOR HOLDING A SPECIAL ELECTION? THAT MEANS THAT UNTIL WE ACTUALLY MAKE THAT CHANGE, THE SUPERVISOR OF ELECTIONS IS NOT ABLE TO TELL US OR TO GIVE US A DATE, WHICH, YOU KNOW, OBVIOUSLY IN THIS CASE WOULD SAY NO, BASED ON THE ESTIMATE, ABOUT 20000 DOLLARS. THAT WOULD BE A POLICY DECISION FOR COUNCIL IF THEY WANT TO MAKE THAT CHANGE. THAT'S NOT THE CURRENT MOTION, THOUGH, MAYOR. OK, JUST ONE TOWN COUNCIL. THANK YOU. SO SO THE POINT IS THE ENTIRE ORDINANCE WOULD BE REMOVED, COUNCILWOMAN, BAILEY, AND THEN WE CAN WORK ON THE OTHER PORTION OF THAT. SO THAT'S HOW I UNDERSTAND IT. AND I THINK THE COUNCIL WAS GEARING TOWARDS THE GOAL IS TO HAVE THAT SPECIAL ELECTION FOR NOVEMBER 2ND. SO I DON'T WANT TO MUDDY THE WATERS HERE WHEN WHEN WHEN THE DEPUTY MAYOR JOHNSEN'S OR SOMETIME IN NOVEMBER IS NOT. IF YOU ALL DECIDE THAT YOU'RE NOT GOING TO MAKE ANY CHANGE, YOU'RE GOING TO LEAVE THE ORDINANCE AS IS. IT IS NOT LIKELY THAT THIS ELECTION WILL HAPPEN NOVEMBER 2ND. IT WILL PROBABLY HAPPEN SOME TIME, MAYBE IN DECEMBER, BUT IT IS HIGHLY UNLIKELY THAT IT WILL HAPPEN ON NOVEMBER 2ND. BECAUSE THE CURRENT TIME FRAME THAT'S IN THE ORDINANCE WILL MAKE IT STAND OUT, ESSENTIALLY A, B, BE THE SUPERVISOR ELECTION WOULD BE HAVING TO HAVE THE ELECTION THE WEEK AFTER THE ELECTION. THE CHANGE THAT COUNCILMAN BAILEY PROPOSED WOULD HAVE MOOT. SURE. IN THE PERIOD WHICH WOULD HAVE ALLOWED IT TO BE IN NOVEMBER. IS IT POSSIBLE WHAT YOU MENTIONED IS DOING THAT POLICY AS A POLICY TO COME BACK AND DO THAT? NO, THAT'S GOING TO THAT'S IN THE ORDINANCE THAT WOULD REQUIRE AN AUGUST CHANGE. IF YOU DO CHANGE NOTHING IN THE ORDINANCE, YOU LEAVE IT AS IT IS. THE SAME TIME FRAME WILL APPLY AND IT WILL BE AFTER ELECTION DAY. IT WILL YOU WILL STILL HAVE A SPECIAL ELECTION. IT'S JUST LIKELY THAT THE SUPERVISOR ELECTION WILL PROBABLY SET IT SOMETIME DECEMBER. IT COULD BE DECEMBER OR I THINK ITS LATEST JANUARY. BUT IT WOULD NOT BE IS HIGHLY UNLIKELY THAT WOULD MAKE IT FOR THE ELECTION, AT LEAST ON THE INFORMATION THAT WE RECEIVED, YOU MAY CARRY ON. THANK YOU, MAYOR, I APPRECIATE YOUR YOUR INDULGENCE, I YES, I THINK THE SIMPLER WAY OF APPROACHING THIS IS TO REMOVE THAT CHANGE, THE CONTROVERSIAL CHANGE OF THE INTERIM APPOINTEE, REMOVE THAT PROVISION AND ALLOW THE REST TO CARRY FORWARD. THAT'S WHAT I WOULD SUPPORT TONIGHT, BECAUSE THAT WOULD ALLOW THE TIMING OF ALL THIS TO WORK OUT. SO IF IS THAT POSSIBLE TO DO, MADAM ATTORNEY? CERTAINLY POSSIBLE. LET ME LOOK AND SEE IF THAT'S GOING TO BE A NEW FIRST READING. GIVE ME A SECOND. IN THE MEANTIME, WHAT WE'RE TALKING ABOUT BETWEEN. NO, SIR, YOU CAN DO IT. WE CAN. YOU WOULD MAKE THAT CHANGE. SO THE ONLY CHANGE THAT YOU WOULD HAVE IN THE FEELING OF VACANCES. A 50 50 MAYOR, PERMANENT VACANCY CHANGES THE TIME FRAME, THAT'S THE ONLY THING IN THE 50 50 SO THAT WITHSTAND THE CHANGE AND FIFTY FIFTY FIVE, YOU WOULD MAKE THE CHANGE IN [00:15:04] SUBSECTION TWO, WHICH CHANGES THE TIME FRAME, BUT YOU WOULD NOT ADD IN THE ADDITIONAL SUBSECTION A. YOU WOULD MAKE THE CHANGE IN SUBSECTION TWO, BUT NOT ACTUALLY ADD IN ANY ADDITIONAL LANGUAGE. IN OTHER WORDS, NO APPOINTMENT, BUT A SPECIAL ELECTION WITHIN 90 OR 75, 90 DAYS, IS THAT IS THAT CORRECT? IN FIVE DAYS OR MORE THAN ONE HUNDRED AND EIGHTY. LOOKS LIKE IT HAS THE ONLY CHANGE WOULD BE IN SUBSECTION TWO, WHICH WILL MEET SEVENTY FIVE. YOU WOULD NOT ADD THE EIGHT. OK, SO AS WELL AS THE LANGUAGE AS FAR AS APPOINTING. SO TO BE CLEAR, MA'AM, AND I WANT TO TRY AND BE CLEAR WITH THIS, IT WOULD ELIMINATE US HAVING THE AUTHORITY TO APPOINT A COUNCIL PERSON AND IT WOULD REQUIRE US TO HAVE THE SPECIAL ELECTION IN 90 OR 75 TO 90 DAYS. IS THAT ACCURATE? NO, SIR. THE SPECIAL ELECTION SHALL BE SCHEDULED TO HELL NO SOONER THAN YOU WOULD CHANGE 90 TO 75 DAYS. THAT'S THE ONLY CHANGE YOU WOULD MAKE AND YOU WOULD ADD NO ADDITIONAL LANGUAGE. AND AS IT CURRENTLY STATES, IT IS MORE THAN A YEAR. SO YOU WOULDN'T HAVE THE AUTHORITY TO APPOINT THE ALL YOU WOULD CHANGE IN THAT SECTION IS THE TIME FRAME. WE WOULD STILL HAVE THE AUTHORITY TO APPOINT NO, THAT'S ADDITIONAL LANGUAGE THAT YOU ALL WOULD BE ADDING SO THAT THE ORDINANCE WOULD REMAIN THE SAME. THE ONLY THING YOU WOULD BE CHANGING IS 90 TO 75. THAT'S THE ONLY THING YOU WOULD CHANGE IN THE VACANCY SECTION FROM 90 TO 75. THERE WOULD BE NO ADDITIONAL LANGUAGE ADDED. THAT'S THE ONLY CHANGE FROM 90 TO 75. MAYOR? YES, SIR. DEPUTY MAYOR. I WAS JUST GOING TO MINIMIZE MOTION TO REFLECT WHAT THE CITY ATTORNEY SAID. OK, SO I JUST WANT TO WRAP MY HEAD AROUND THIS OR I JUST WANT TO WRAP MY HEAD AROUND THIS. IN OTHER WORDS, WE DON'T HAVE THE AUTHORITY TO APPOINT SOMEONE. UNLESS IT'S UNDER THE YEAR, IS THAT ACCURATE? RIGHT, WHICH IS WHAT ACTUALLY EXISTS RIGHT NOW. RIGHT. SO THAT'S THE ONLY CHANGE YOU'RE MAKING IS THE TIME FRAME. YOU'RE NOT TAKING ANYTHING ELSE. APPARENTLY IT IF THERE'S MORE THAN A YEAR YOU CAN APPOINT, THAT'S NOT CHANGING. THE ONLY THING THAT CHANGES IS A TIMEFRAME FROM 1975. OK, THANK YOU, MA'AM. I REALLY APPRECIATE THAT. I THINK THE VALUE OF US GIVING OURSELVES THE AUTHORITY TO PUT SOMEONE UP HERE IS IT WAS MY CONCERN. BUT CARRY ON. YOU'RE AMENDING YOUR EMOTIONS. I JUST MADE MY MOTION REFLECT WITH THE CITY ATTORNEY SAID, OH, NO, IF WE'RE GOING TO ACTUALLY GO FORWARD WITH THIS ORDINANCE, IN THAT CASE, I WOULD ASK INSTEAD OF ME COMING BACK TO CHANGE THIS ORDINANCE NOW, OK, YOU'D BE CONSISTENT WITH LAW. WE TAKE ALL OF MY OTHER CHANGES, INCLUDING MAKING SURE THAT PEOPLE KNOW THAT OUR CHARTER SAYS THAT WE DO HAVE SPECIAL ELECTIONS AND ALL WE DO IS MODIFY THE R AS FAR AS FILLING VACANCIES TO OMIT SECTION A IN THE. VACCINE FIFTY POINT FIFTY FIVE. SO YOU WOULD PASS IT AS IS, EXCEPT YOU WOULD DELETE. SUBSECTION TWO, A AND A IS THE PART THAT SAYS THE COUNCIL BY MAJORITY VOTE WITH THE REMAINING MEMBERS SHALL CHOOSE A SUCCESSOR TO SERVE UNTIL A NEWLY ELECTED COUNCIL MEMBER IS QUALIFIED. THAT IS THE LANGUAGE YOU WOULD DELETE. OK, BUT EVERYTHING ELSE YOU WOULD PASS IS. YES, AND ALTHOUGH BEING YOU ALL ARE NOT WITHDRAWN BECAUSE YOU'RE WITHDRAWN, IT CERTAINLY WOULD BE SOMETHING THAT IS PROCEDURAL, WHAT YOU WOULD DO AT THE BEGINNING. BUT IF YOU'RE ACTUALLY GOING TO REVISE ITS MOTION, YOU'RE GOING HAVE TO DO IT IN THE PUBLIC HEARING. WHAT I HAVE TO BRING TO ANY PUBLIC HEARINGS, AGENDA REVISIONS. YEAH. YEAH, YOU'RE GOT TO HAVE PUBLIC COMMENT. I MEAN, ESSENTIALLY, YOU WERE GOING TO CHANGE YOUR MOTION ONCE YOU HAVE PUBLIC COMMENT, BUT YOU'RE NOT GOING BE ABLE TO VOTE ON IT UNTIL YOU HAVE OPEN IT UP TO THE PUBLIC. YOU HAVE PUBLIC COMMENTS AND YOU CAN BRING IT BACK AND YOU ALL CAN CHANGE THE ACTUAL TEXT. YOU APPROVE IT SUBJECT TO THE ELIMINATION OF SECTION SUBSECTION TWO, A SECTION FIFTY POINT FIFTY FIVE. BUT YOU'RE GOING TO HAVE TO HAVE A PUBLIC HEARING FIRST. A SECOND. [00:20:20] AND CITY ATTORNEY, YOU SAID YOU WOULD COME BACK WITH THE WITH THE REVISIONS IN THE FUTURE. IF YOU ALL RIGHT? YES. OK, THEN I'LL MOVE AS SUCH WITH MY ORIGINAL MOTION. WITHDRAWING IT COMPLETELY. YEAH. BUT, YOU KNOW, COUNCILMAN BAILEY, JUST JUST TO BE CLEAR, JUST TO BE CLEAR, REMOVING IT, WITHDRAWING IT. WOULD BE WE WOULD STILL WORK AS A FOUR MAN TEAM. FOR PERHAPS AN ADDITIONAL TWO REGULAR COUNCIL MEETINGS, ARE THAT TO TWO TO THREE, SO WE WOULD STILL HAVE OUR SPECIAL ELECTION AND MAYBE WE COULD LATER ON HONE IN ON THE 75 TO 90 DAY RULE. I JUST WANTED TO MAKE THAT CLEAR. GO AHEAD, COUNCILMAN. BAILEY. YES. AND I MISUNDERSTOOD. UNDERSTOOD. WE'RE GOING BACK TO A FULL WITHDRAWAL, IS THAT CORRECT? YES. OK, NOW AND THEN MAKE THAT CLEAR TO COUNCIL AND TO THE DEPUTY MAYOR, BECAUSE I THINK THE DEPUTY MAYOR WAS GOING DOWN THE PATH, WHICH I AGREE WITH, WHICH IS TO SAY WE'RE GOING TO TAKE CARE OF THE EMPLOYMENT ISSUE AND NO LONGER HAVE THAT WHILE STILL MAKING THE ADJUSTMENT TO THE TIMELINE AND SUCH A WAY THAT WE CAN SAVE EXTRA MONEY ON THE SPECIAL ELECTION THAT'S PENDING. THAT WILL BE COMING IF WE DO NOT DO THAT TONIGHT, AS THIS JUST SAID. AND CHANGING THAT PROVISION IN THE FUTURE WILL LIKELY MEAN THAT THERE WILL BE NO CHANGE AND THAT THERE WILL. SORRY, EXCUSE ME. THAT MEANS THEY WILL LIKELY NOT BE NOVEMBER 2ND, THAT THE SUPERVISOR ELECTION WILL BE ABLE TO HOLD THE ELECTION BECAUSE WE ARE GOING TO HAVE TO WAIT ANOTHER MEETING, THE COUNCIL, YOU GUYS WILL HAVE TO WAIT UNTIL ANOTHER MEETING TO PASS THAT WHICH IS GOING TO MAKE IT TOO TIGHT OF A TIMELINE AT THAT POINT. SO IT'S JUST ONE OF THOSE NUANCES THAT I THINK COULD SAVE SOME MONEY NOW. AND ALL WE'RE DOING IS REMOVING THAT ONE PROVISION, THAT ONE THAT IS CAUSING ALL THE CONTROVERSY. WE'RE GOING TO THROW THAT ONE OUT AND JUST DO THOSE BASIC THINGS. AND WHAT WE'RE SAYING IS WHAT WE'RE SAYING IS IT WOULD ADD TWO ADDITIONAL COUNCIL, REGULAR COUNCIL MEETINGS WITH A FOUR MAN TEAM ON THE DAIS AND STILL EXPECT A SPECIAL ELECTION. AND THEN YOU COULD GO BACK AND AND DO THAT ALL OVER AGAIN. BUT THE POINT BEING IS A COMPLETE WITHDRAWAL WOULD ELIMINATE US HAVING TO TO LABOR THIS OUT. AND AND WE UNDERSTAND THAT THIS WILL INCREASE THE TIMELINE, BUT IT'LL STILL HAVE FORM FOR MEN UP ON THIS DAIS UNTIL THERE'S A SPECIAL ELECTION. AND THAT THAT'S THE BOTTOM LINE OF THE WITHDRAWAL. SIR. YEAH, AND THEY ARE THAT THE SAME WITH REMOVING THAT PROVISION THAT GIVES YOU THE SAME THING? IT WOULD BE A FOUR MAN COUNCIL, A FOUR PERSON COUNCIL UNTIL A SPECIAL ELECTION CAN BE HELD. OH, BOTH BOTH ACHIEVE THAT SAME GOAL, UNLESS I MISREAD SOMETHING THAT THE CITY ATTORNEY SAID. NOW, I'M JUST CLARIFYING POLICIES, YOU KNOW, PROCEDURALLY, EVERY COUNCIL MEMBER SHOULD GET AN OPPORTUNITY TO SPEAK BEFORE WE GO BACK AND FORTH WITH THE SAME COUNCIL MEMBER IS I YOU KNOW, I KNOW I HAVE YOUR SUPPORT ON THIS, BUT I WANT TO HEAR FROM THE OTHER COUNCIL MEMBERS AS WELL BEFORE WE HAVE A VOTE. SO I APPRECIATE THAT. THANK YOU. COUNCILMAN BAILEY. WE'RE GOING TO MOVE ON TO COUNCILMAN. FELIX. THANK YOU SO MUCH, MAYOR, I APPRECIATE THE OPPORTUNITY TO SPEAK. I'M A BIT CONFUSED. AS TO TO WHAT'S TAKING PLACE, I UNDERSTAND, DEPUTY MAYOR, IS WHY HE WANTS TO ACHIEVE. I GET IT NOW. IT'S BEEN 30 MINUTES. WE'RE GOING BACK AND FORTH. CANNOT REALLY CLARIFY WHICH DIRECTION WE WANT TO TAKE. THAT'S A CONFUSING PART. SO AS IT STANDS NOW. WE ARE WE INTEND TO MOVE FORWARD, POTENTIALLY LOSING THE NOVEMBER 2ND SPECIAL ELECTIONS [00:25:02] OPPORTUNITY, SHOULD WE WITHDRAW, WITHDRAW THE THE THE THE AGENDA ITEM COMPLETELY TONIGHT. WE WILL WE WOULD MISS THAT OPPORTUNITY, WHICH TO COUNCILMAN BAILEY POINT THAT REDUCED THE COST BY 30, I BELIEVE, 30 OR 20 OR 30 THOUSAND OUT. BUT ASIDE FROM THAT. IF THAT'S THE DIRECTION COUNCIL WANTS. ACTUALLY, I BELIEVE THE VOTE I MEAN, PROBABLY WILL BE WILL BE THERE TONIGHT, BUT I WILL REMAIN, I BELIEVE, PUTTING MOVING FORWARD. WITH A FOUR COUNCIL MEMBER PUTTING THE CITY IN A BAD, VERY BAD POSITION, I SAID THAT BECAUSE. I HAVE BEEN SPEAKING WITH WHAT A FEW PEOPLE HAVE THAT NOT LOOKING TO INVEST IN OUR CITY DEVELOPERS. THAT'S NOT A GOOD IDEA. NONE OF THEM WOULD AGREE THIS IS A GOOD IDEA. THERE'S A REASON WHY THE A FIVE MEMBER COUNCIL, RATHER, IT'S THREE MONTHS OR FOUR MONTHS. I THINK COUNCIL SHOULD ALWAYS REMAIN FIVE PEOPLE AND THAT THAT'S WHERE I STILL STAND. IF I MAY WANT TO TAKE THE OPPORTUNITY TO SAY A FEW THINGS. NOVEMBER TWENTY THIRD I TOOK OFF TO SERVE, CERTAINLY DIDN'T HAVE TO DO THIS, I'VE BEEN VERY BLESSED MANY WAYS, MANY, MANY WAYS. OF OUR HEART FOR SERVICE, I LOVE TO SERVE AND I HAVE BEEN ALL MY LIFE AS A TEENAGER. ALL MY ADULT LIFE, I'VE BEEN SERVING. DO YOU SEE THE RHETORIC'S THE NARRATIVE THAT'S BEEN SPREADING THROUGH SOCIAL MEDIA, YOU KNOW, LOCAL COMMUNITY, IT'S IT'S DISHEARTENING. I'M VERY SAD, AND I THINK PALM BAY IS MUCH BETTER THAN THAT, REGARDLESS OF THE DECISION THAT'S BEING MADE TONIGHT, I TRULY BELIEVE PEOPLE THAT TOOK OFF TO SERVE YOU. I'M TALKING FOR MYSELF AND I HONESTLY BELIEVE FOR THE REST OF COUNCIL AS WELL. THESE OLD MEN OF INTEGRITY THAT SERVE, GOD WILLING TO SERVE, NOT SERVE THE COUNTRY, MANY OF THEM. I'VE BEEN SERVING THIS COMMUNITY FOR OVER 15 YEARS FAITHFULLY. AGAIN, YOU KNOW, I'VE NO MOTIVE. I'VE NO OTHER REASON BUT TO SERVE HONEST WITH INTEGRITY. IT WILL MAKE ME SAD SOME OF THE THINGS THAT'S BEEN SPREADING ON SOCIAL MEDIA. THE NAMES HAVE BEEN CALLED THE AND IT'S A LOT OF IT. THE SAD REALITY IS A LOT OF IT IS IS DUE TO MISINFORMATION. PEOPLE WERE NOT INFORMED, PEOPLE THAT SIT IN THAT VERY SEAT. THE LAST MEETING WE HAD I'VE SEEN PEOPLE AFTER WE VOTE, PEOPLE ARE STILL LOOKING LIKE VERY CONFUSED. PEOPLE WERE NOT INFORMED OR NOR SEEK TO OR CLARITY. AND I HAVE MEMBERS IN THIS, YOU KNOW, CURRENTLY SITTING IN HERE THAT PERSONALLY CALL ME. WE HAD A CONVERSATION AND THEN THEIR REACTION IS LIKE, OH, MY GOD, I DIDN'T QUITE SEE IT LIKE THAT AND UNDERSTAND IT THIS WAY. BUT BUT AGAIN, REGARDLESS WHAT TAKE PLACE TONIGHT, I WANT TO LET YOU KNOW THIS MAN IN MY FAITH, MY VALUES, I TOOK OFF TO SERVE YOU AND I WILL CONTINUE TO DO IT WITH INTEGRITY FOR THE REST OF MY I'M NOT LOOKING FOR A LOT OF IT IS POLITICALLY MOTIVATED. THAT'S WHAT TOOK PLACE LAST MEETING. AND I FEEL IT'S BEEN CONTINUED HERE TONIGHT. BUT REGARDLESS, NO POLITICAL. I'M NOT LOOKING FOR NO POLITICAL CAREER. AND NO, TO GET ANYTHING OUT OF THIS, BUT TO SERVE YOU A LOW LEVEL OF RESPECT WOULD BE GREAT, WOULD BE GREATLY APPRECIATED. TREAT VOWED TO SERVE YOU WITH A LITTLE BIT OF RESPECT WHILE THE REST OF MY TIME HERE. THANK YOU. THANK YOU. COUNCILMAN. FELIX. COUNCILMAN. FOSTER. THANK YOU, MAYOR. I HEARD THE DISCUSSION BACK AND FORTH. I LISTENED VERY WELL WITH COUNCILMAN BAILEY WAS SAYING ABOUT SAVING 20000. LAST WEEK, WE HAD A BUDGET WORKSHOP AND I ASKED THE QUESTION, WAS THIS BUDGET? WE BUDGET FOR A SPECIAL ELECTION. IT. HE DIDN'T BUDGET FOR A SPECIAL ELECTION. THAT'S THE ANSWER I GOT. NOW, WE AND I HAVE A TWO HUNDRED AND FIFTY THREE THOUSAND DOLLAR BILL. AND BY MOVING IT TO NOVEMBER, IF THE SUPERVISED ELECTION, WE DON'T HAVE CONTROL OF ELECTION DATES, PALM BAY DOESN'T THAT'S NOT IN OUR WHEELHOUSE AS IN THE SUPERVISOR [00:30:03] ELECTION. THAT'S OUR DUTIES LAWYER SCOTT. AND SHE HAS A DIFFERENT DYNAMIC TO GET THIS DONE, AND IT COSTS MONEY. AND. THAT'S ONE REASON I MADE THE MOTION TO JUST HAVE AN APPOINTMENT. THAT'S ONE OF THE REASONS. THE SECOND REASON WAS. THERE'S OTHER CITIES, THAT'S WHAT THEY DO, THEY APPOINT A COUNCIL, APPOINT SOMEONE TO SERVE WHEN A VACANCY OCCURRED. THE STATE AND THE STATE ATTORNEY GENERAL GIVES COUNSEL THE AUTHORITY TO APPOINT. A GOVERNOR, AS TOOK IT UPON HIMSELF TO APPOINT AT THE COUNTY LEVEL. STATE GOVERNOR, GOOD POINT, YOUR COUNTY COMMISSIONER, IF JOHN, TOBI'S OR CHRISTINE HAD ZONKER VACATE, HE COULD MAKE AN APPOINTMENT WITHOUT NO SPECIAL ELECTION. OK, SO. APPOINTING SOMEONE IS IT'S NOT UNUSUAL, IT'S JUST DONE ACROSS THIS COUNTRY. I UNDERSTAND PEOPLE WANT TO VOTE FOR THE PERSON THAT SITS IN THIS SEAT, I GET THAT IT'S GOING TO COST US A LOT OF MONEY, MONEY THAT WE DIDN'T BUDGET FOR. WE DIDN'T BUDGET FOR THIS MONEY. SO. THE TO CALL ME NAMES OF BEING UN-AMERICAN OR THUG OR WHATEVER, YOU REALLY DON'T KNOW WHAT YOU'RE TALKING ABOUT, YOU DON'T KNOW WHO I AM BECAUSE I 100 PERCENT SUPPORT PEOPLE, CIVIL RIGHTS, VOTING RIGHTS AND THINGS OF THAT NATURE WHEN IT COMES TO MAKING A A DECISION, A STEWARD OF YOUR TAXPAYER. I NEED TO BE SMART ABOUT IT. I NEED TO THINK ABOUT THIS. A SPECIAL ELECTION IS GOING TO APPOINT SOMEONE FOR 10 MONTHS THE MOST, AND THEN YOU'RE GOING TO HAVE TO COME BACK IN NOVEMBER 22 TO VOTE AGAIN. OK. I'M NOT RUNNING. I HAVE NO DOG IN THE FIGHT. OH, MY THING IS, IF WE GO TO A MAYOR, IF WE'RE GOING TO CHANGE THE ORDINANCE, I MEAN. DO AWAY, NOT VOTE ON THIS SECOND READING. WE NEED TO GO BACK TO THE ORIGINAL ORDINANCE THAT WAS PASSED IN 2012. THAT IS A POINT IF IT'S LESS THAN A YEAR, WE'LL HAVE A SPECIAL ELECTION, IT WAS MORE. AND THAT'S WHERE I STAND AT IT, BECAUSE I COMPROMISE AND VOTED FOR THE THE FIRST READING. AT THIS POINT, I DON'T SEE ME COMPROMISING IF WE KEEP IF WE GO BACK TO THE ORIGINAL ORDINANCE BACK IN 2012. I WOULD SUPPORT THAT. OTHER THAN THAT, I CAN'T SUPPORT ANYTHING ELSE. THANK YOU. NOW, I SECONDED THERE'S A FEW THINGS I'D LIKE TO SHARE IN THAT. I SECOND THE MOTION TO COMPLETELY WITHDRAW. AND I THINK YOU HIT THE NAIL RIGHT ON THE HEAD. COUNCILMAN FOSTER. BECAUSE WHEN WE ALL WHEN WE ALL TOOK EVERYONE ON THIS DIES, WHEN WE ALL STOOD OUT THERE AND WE RAISED OUR HAND, WE TOOK OUR OATH TO PROTECT AND DEFEND NOT ONLY THE CONSTITUTION OF OF OF THE UNITED STATES, THE STATE, BUT ALSO THE ORDINANCE THAT EXISTS TODAY. THAT ORDINANCE THAT EXISTS TODAY IS EXACTLY WHAT YOU'RE SAYING, IF IT'S OVER A YEAR. AND WE HAVE A SPECIAL ELECTION IF IT'S. UNDER A YEAR, THEN WE HAVE THE AUTHORITY TO APPOINT WHAT OCCURRED IS THERE'S A. A COMMUNICATION WHERE WE WANTED TO GIVE OURSELVES THE AUTHORITY TO APPOINT WHEN THAT'S NOT WHAT WE RAISED OUR HAND, SO THAT IS WHAT I MEANT AND THAT'S WHAT I'LL CONTINUE TO SAY, IS IT'S NOT RIGHT FOR US TO GIVE OURSELVES THE AUTHORITY TO DO SOMETHING OTHER THAN WHAT WE RAISED OUR RIGHT HAND FOR. SO THAT BEING SAID. THE WITHDRAWAL OF THAT IS EXACTLY WHAT YOU'RE REFERRING TO, COUNCILMAN FOSTER IS GOING BACK TO THAT ORDINANCE THAT CURRENTLY EXISTS, COUNCILMAN FELIX AIR. WITH ALL DUE RESPECT, I JUST WANT TO MAKE MAKE MAKE MENTION SOMETHING YOU SAID AS TO US GIVING US OURSELVES THE AUTHORITY. YEAH. TO MAKE CHANGES TO THE ORDINANCE. THAT THAT'S INCORRECT. LET ME SAY SAY WHY. WHEN WHEN AN ITEM LEAVES THE CHARTER TO CHARTER, WE CANNOT CHANGE, WE RAISE OUR HAND TO TO FOLLOW THE CHARTER IN RESPECT ALONGSIDE THE CONSTITUTION. [00:35:03] WELL, THE ORDINANCE COUNCIL AT ANY GIVEN TIME CAN PULL AN ORDINANCE AND MAKE CHANGES TO IT. SO WITH THAT SAID. THIS THIS IS WE WE ALL WE ARE OPERATING WITHIN ALL OF AUTHORITY, MAKING AMENDMENTS TO THAT ORDINANCE NOW WE WE MAY AGREE NOT TO MOVE FORWARD TO MAKE THAT CHANGE IF MY MAJORITY OF COUNCIL DECIDES NOT TO. BUT FOR YOU TO SAY IT LIKE THAT, IT'S NOT QUITE QUITE RIGHT. WE THAT'S WITHIN OUR RIGHT AS A BODY TO CHANGE ANY AT ANY GIVEN TIME, CHANGE AN ORDINANCE CHARTER. WE CANNOT DO IT HAS TO GO TO THE VOTERS. THEY VOTE ON IT, WHICH THAT'S WHAT TOOK PLACE IN 2012. THEY MOVED IT FROM THE CHARTER TO THE CODE OF ORDINANCE ORDINANCE. AT ANY GIVEN TIME, ANY ORDINANCE, IT'S WITHIN OUR AUTHORITY TO MAKE CHANGES. YEAH. AND I JUST WANTED TO CLARIFY AND AND I WOULD AGREE WITH YOU ON THAT, THAT WE WE DO HAVE THAT AUTHORITY TO CHANGE THE ORDINANCE. COUNCILMAN, FELIX AT THE SAME TIME, IF WE HAD THAT ABILITY TO CHANGE THE ORDINANCE AND IT DOESN'T AFFECT THIS COUNCIL, BUT IT AFFECTS A NEXT COUNCIL. BUT WHAT WE'RE DOING, IN MY OPINION, IS WE'RE CHANGING THE ORDINANCE, CHANGING THE GAME BECAUSE OF THE SITUATION SO THAT THAT'S WHERE I'M COMING FROM WITH THAT. BUT YOU'RE ABSOLUTELY RIGHT. WITHIN AS A BODY, WE'RE WITHIN OUR RIGHT TO CHANGE ORDINANCES. IT'S JUST THAT THE TIMING'S NOT RIGHT. NOW, IF THE MOTION WOULD HAVE BEEN TO BRING THIS FORWARD IN THE FUTURE, THEN THAT'S A DIFFERENT STORY. AND I WHOLEHEARTEDLY AGREE IF IT DOESN'T AFFECT US AT THIS GIVEN TIME. SO I JUST WANTED TO CLARIFY MY STANCE AS WELL. COUNCILMAN FOSTER. WITH ALL DUE RESPECT, MAYOR. I'M NOT TRYING TO GET IN A DEBATE ARGUMENT WITH YOU, I DISAGREE WITH YOU WHEN YOU SAID THE REASON WHY I SAID I GO BACK TO THE ORIGINAL OR. BECAUSE AND THE REASON I WANTED TO CHANGE IS BECAUSE OF TWO THINGS. WE ARE IN LINE WITH OTHER CITIES, I SAID THAT I KEEP REPEATING MYSELF AND IT WILL COST THE TAXPAYER MONEY. YOU'RE RIGHT, THE TIMING IS NOT RIGHT, BUT SOMETIMES YOU GOT TO DO THINGS TO MAKE MAKE THE BEST DECISION WHAT YOU HAVE. AND AND BEING THAT WE'RE TALKING ABOUT A ELECTION THAT'S GOING TO HAPPEN ANYWAY. GENERAL, THE 2022 ELECTION IS GOING TO HAPPEN ANYWAY, AND AND AS OF TODAY, NO ONE. AS APPLIED TO FILL JEFF BAILEY SEAT IN A GENERAL ELECTION IN 2022, NOT ONE PERSON DIMMIT THEIR NAME TO RUN FOR JEFF BAILEY SEAT. OK, SO PLEASE. AND IF ALL YOU'VE GOT TO DO IS LOOK ON THE CITY WEBSITE, NOT ONE PERSON PUT THEIR NAME TO RUN FOR JEFF BAILEY SEAT, INCLUDING JEFF BAILEY. AND IT'S BEEN LIKE THAT EVERY SINCE THE BEGINNING OF THE YEAR. I'M NOT SAYING THAT'S EXCUSE NOT TO HAVE A SPECIAL ELECTION, NOT TO HAVE A SPECIAL ELECTION. WE'RE NOT IN LINE WITH OTHER CITIES AND IT'S GOING TO COST THE TAXPAYERS A PALM BAY. THE MOST EXPENSIVE ELECTION IN PALM BAY HISTORY. TWO HUNDRED AND FIFTY THREE THOUSAND IS MORE THAN ALL THESE SALARIES COMBINED OF THE CITY COUNCIL TOGETHER. OK, AND THEN WE'RE GOING TO TURN AROUND AND PAY FOR THE GENERAL ELECTION AND THE PRIMARY. AND TWO HUNDRED AND FIFTY THREE THOUSAND DOLLARS OR TWO HUNDRED AND THIRTY THOUSAND DOESN'T MATTER. NOVEMBER 2ND OR DECEMBER 15TH. WE COULD DO A LOT, WE COULD BUY FIVE POLICE CARS, WE COULD HIRE STAFF, WE CAN DO A LOT OF THINGS WITH THAT MONEY. SO TO PUT SOMEBODY ON A COUNCIL WITH 10, 10 MONTHS. AND THE DECISION THAT WE MAKE UP HERE IS NOT PARTIZAN. NO PARTIZAN DECISION. MAYBE A DIFFERENT OPINION, SO. ONCE AGAIN, I WILL SUPPORT THE ORIGINAL MOTION. I'M COMPROMISING AGAIN, MY MOTION WAS JUST A POINT THERE, BUT I WILL APPOINT I WILL GO BACK AND SUPPORT, WITHDRAW THIS MOTION. THE DEPUTY MAYOR WANTS TO WITHDRAW. I WILL VOTE FOR IT, BUT. BUT NO CHANGES TO THE ORIGINAL ORDINANCE THAT WAS PASSED IN 2012. [00:40:02] WELL, I JUST WANTED TO AND I KNOW THAT WE'RE STILL ON THE AGENDA REVISIONS, WE HAVEN'T EVEN GONE INTO CONSENT, DEPUTY MAYOR JOHNSON, BUT I WILL SAY. THERE'S THERE'S THERE'S A LOT OF DISCUSSION ON PROCEDURES HERE AND AND YOUR WILLINGNESS TO WITHDRAW IS I SENSE IT IN MY HEART THAT THE INTENT IS TO CONTINUE ON, WAS WHAT WAS IN PLACE BEFORE THIS NEW ORDINANCE THAT WE'RE DISCUSSING FOR THE SECOND READING. AND THAT THAT'S HOW I RECEIVE WHAT YOU'RE SAYING. WHAT I WILL SAY IS THAT. WHEN WE DID HAVE OUR BUDGET WORKSHOP, WE DID WORK TOGETHER AND WE DID ACKNOWLEDGE THAT ALTHOUGH WE WE CAN'T FORESEE WE'RE GOING TO ONE OF US IS GOING TO RESIGN. WE CAN'T FORESEE ONE OF US IS GOING TO GET SICK ON THE DYAS. RIGHT. SO, OF COURSE, YOU CAN'T BUDGET THAT. BUT I WANT TO I WANT TO REMIND COUNCIL THAT IN OPTION ONE, WE WE DO HAVE SOME FINANCES THERE THAT WE COULD USE TOWARDS THAT ELEC TOWARDS THE SPECIAL ELECTION. AND THAT'S WHAT THEY'VE HAVE BROUGHT TO US AT THE BUDGET BUDGET HEARING. SO I WANTED TO SHARE THAT. I KNOW THAT THERE'S A MOTION TO WITHDRAW AND AND THERE'S A SECOND. AND SO SINCE WE'RE STILL ON THERE AND ONE WANTED THE. WELL, HAD YOU MADE THE ORIGINAL YES, AND I'M STILL I'M STILL STANDING TO IT, I'M STILL STANDING WITH MY WITHDRAWAL, BUT I HEAR THE REST OF COUNCILMAN THAT'S WHERE WE'VE WE'VE DONE IT BEFORE ON OTHER ITEMS THAT WE WERE A LITTLE CONFUSED ON OR WANTED SOME MORE INPUT. WE COUNCILMAN FOSTER. I'M FINE WITH DOING A WORKSHOP. I THINK RIGHT NOW WE NEED TO WITHDRAW IT. BUT IN THE FUTURE, WHETHER IT'S A MONTH, TWO MONTHS OR AFTER THE SPECIAL ELECTION, WHENEVER, BEFORE OR AFTER, I'M FINE TO DO A WORKSHOP TO LOOK AT, YOU KNOW, WHAT YOU'RE SAYING IN REGARDS TO BEFORE 2012 OR IF WE NEED TO PUT IT UP BACK ON THE CHARTER REVIEW IN 2020 TO. I'M FINE. I'M FINE WITH THAT AS WELL, SO I DO WANT TO MAKE THAT CLEAR. YES, COUNCILMAN FOSTER. THANK YOU, MAYOR. I JUST WANT TO ADDRESS THE DEPUTY MAYOR. I DON'T LIKE I WANT TO END THIS CONTROVERSY. I THINK WE NEED TO BRING IT TO THE CHARTER REVIEW AND LET THE VOTERS DECIDE. OUR VACANCY ONCE TO OCCUR BECAUSE WE COULD WORKSHOP IT AND THEN WE'D BE BACK HERE AGAIN. THEY THEY DECIDED IN 2012 TO MAKE AN ORDINANCE, MAYBE THEY WANT TO CHANGE IT. I DON'T KNOW. BUT IT SHOULD BE IN THE CHARTER REVIEW AND BRING IT TO THE VOTE OF. COUNCILMAN BAILEY, ANY CLOSING REMARKS BEFORE WE TAKE A VOTE ON THE WITHDRAWAL? ON. FOR YOU ON. YES, THANKS. THANK YOU. THANK YOU, MAYOR. AS I WANTED TO SAY THAT, IT SOUNDS LIKE MAYBE THIS THIS VOTE FOR THE FULL WITHDRAWAL IS TEETERING A LITTLE BIT. I WILL SUPPORT IT. I WILL SUPPORT THE FULL WITHDRAWAL. I WILL JUST REITERATE THAT WHAT COUNCILMAN FELIX STATED EARLIER IS WHAT SUMMED UP WHAT I WAS SAYING, WHICH IS LOSING THE OPPORTUNITY TO CHANGE THAT ONE PROVISION AS FAR AS THE DATE WHICH COULD SAVE US SOME OF THE SPECIAL ELECTION COSTS. SO I STILL THINK THAT'S IMPORTANT. BUT IF ALL ELSE FAILS, I'D RATHER SUPPORT A FULL WITHDRAWAL THAN MOVING FORWARD THE WAY IT IS. UNDERSTOOD. SO WE HAVE A MOTION AND WE HAVE A SECOND, ANY ADDITIONAL DISCUSSION? DONE ALL IN FAVOR OF WITHDRAWAL WILL SIGNIFY BY SAYING, I, I. MAY I HAVE A ROLL CALL, PLEASE? DEPUTY MAYOR JOHNSON, I COUNCILMAN BAILEY, I COUNCILMAN FOSTER COUNCILMAN FELIX. NOW, MAYOR MEDINA I. MOTION PASSES THE ONE. WITHDRAW. WE'RE MOVING ON TO DEPUTY MAYOR OF. [CONSENT AGENDA:] [00:45:04] ITEMS FOUR, SIX, 15, 18 AND 19, SIX, FOUR, SIX, EIGHT, FOUR, SIX, 15, 18 AND 19. FIFTEEN, FOUR, SIX, 15, 18, 18 AND 19. OK, COUNSEL, ANYONE ELSE WISH TO WITHDRAW ANY AGENDA ITEMS? I MAKE A MOTION TO APPROVE THE CONSENT IN GENERAL WITH THE REMOVAL OF ITEMS FOR SIX, 15, 18 AND 19. I HAVE A MOTION BY DEPUTY MAYOR JOHNSON SINGING ABOUT COUNCILMAN FOSTER ALL IN FAVOR. I ONLY OPPOSE THERE. YES. YES, COUNCILMAN. I APOLOGIZE FOR THE DELAY RESPONSE THERE. MAYOR, I WANT TO MAKE SURE WHAT THE MARINA PROPERTY POOL. OH, YES, WE'RE ALREADY YEAH, YEAH, THAT WAS ITEM SIX, YES, IT WAS POPE, THANK YOU. ALL IN FAVOR. I ANY POPE PASSES UNANIMOUSLY. WE'RE AN ITEM FOR AN ECARDS. OR. OR CONSENT OR. WE THINK I HAVE IS THE NEXT ITEM, WHICH IS ITEM NUMBER SIX. OK. ALL RIGHT. SO ITEM FOR MR., BILL BURTON. [4. Contract: Master agreement and hourly rate schedule, architect and engineering design services, Building E, City Hall Complex – RFQ 34-0-2021 – Utilities, Building, and Parks and Facilities Departments (Silling Architects); and approval of Task Order 01-2021 against the Master Agreement ($543,750).] GILBERTON, 586 OCEAN SPRAY STREET SOUTHWEST. WHEN I WAS GOING THROUGH THIS BUILDING. E FORMAT ORIGINAL, I KEPT HEARING TWO MILLION DOLLARS, IT WAS UNTIL A BUDGET WORKSHOP THAT I REALIZED THAT THE ACTUAL COST OF THIS BUILDING WAS TEN MILLION DOLLARS. AND SO THAT'S WHEN I KNOW BECAUSE I'VE BEEN TRYING TO PAY ATTENTION FOR A LONG TIME. THAT WAS THE FIRST I HEARD OF UNTIL A BUDGET WORKSHOP. BUT IT IS THE FACT THAT IT'S TEN MILLION DOLLARS. ALL RIGHT. BUT THAT BEING SAID, WE NEED TO LET YOU KNOW THAT I ACTUALLY DO READ THE PACKET AGENDAS AND ENTER YOUR SYNOPSIS OF THE. ORDER. YOU HAVE DOWN IN THEIR BUILDING B INSTEAD OF BUILDING E, AND I DIDN'T WANT TO CALL IT OUT BECAUSE OF A TYPO ERROR, BUT IT'S THE SIMPLE FACT THAT I WANTED YOU TO KNOW THAT I REALLY DO READ ALL OF YOUR AGENDAS. RIGHT. AND I THINK THAT WAS ON PAGE 29. SO IT'S BUILDING E, NOT BUILDING B THAT WE'RE REQUESTING TEN MILLION DOLLARS TO SPEND MONEY ON. THANK YOU. AND SHERMAN. APOLOGIES FOR THE TYPO, MAYOR. I MEAN, MOTION COUNCILMAN. I'LL MAKE A MOTION TO APPROVE THE CONTRACT FOR BUILDING E IN THE TOTAL OF FIVE HUNDRED FORTY THREE THOUSAND SEVEN HUNDRED FIFTY DOLLARS. AND A MOTION BY DEPUTY MAYOR OF JOHNSON SECOND, I GOT A SECOND BY COUNCILMAN FELIX. ANY FURTHER DISCUSSION COUNCIL? HEARING NONE. ALL IN FAVOR, I. COUNCILWOMAN BAILEY IS STILL ON. ELSOM, BAILEY, CAN YOU HEAR ME? IT'S BARELY I WASN'T SURE IF YOU RECOGNIZE ME. I THOUGHT I OK, COPY THAT PASSES UNANIMOUSLY. BEFORE WE WE MOVE FORWARD, DEPUTY MAYOR JOHNSON, I JUST WANTED TO LET THE PUBLIC KNOW THAT THE ORDINANCE THAT WE WERE GOING TO DISCUSS. WAS WITHDRAWN BY THIS COUNCIL. JUST WANTED TO LET EVERYONE KNOW, SO THANK YOU. ITEM SIX, A BILL ABOUT. [6. Resolution 2021-38, conveying City and CRA-owned surplus real estate located at 4220 Dixie Highway NE, 2932 and 2920 Pospisil Avenue NE to buyer Space Coast Marinas, LLC.] MAYOR, IF I MAY, YES, MA'AM. RESOLUTION TWENTY TWENTY ONE, DASH THIRTY EIGHT, A RESOLUTION OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, SELLING AND CONVEYING PROPERTY AS RECORDED IN OUR BOOK, THIRTY FIVE TWENTY NINE THOUSAND SIXTY SEVEN OR BOOK SIXTY FOUR. SIXTY NINE AS WELL. 74 AND OR BOOK 63 67. PAGE TWENTY EIGHT 14. ARE THE PUBLIC RECORDS OF EVERY COUNTY, FLORIDA PROVIDING FOR AN EFFECTIVE DATE? [00:50:01] IF YOU MADE. BUT. LOBATON 586 OCEAN SPRAY STREET SOUTHWEST REASON I PULLED THIS ONE FROM CONSENT AGENDA WAS NO PLACE IN THE AGENDA PACKET DID IT ACTUALLY HAVE THE COST OF WHAT WE'RE GETTING READY TO SPEND. AND SO I JUST THOUGHT THAT BECAUSE IT WAS UNDER CONSENT, I THOUGHT THE PUBLIC SHOULD KNOW WHAT THE ACTUAL COST WAS. BUT BECAUSE OF THE BC3 LAST VOTE, WHICH WAS JUST A FEW MINUTES PRIOR, I NOW KNOW THAT IT WAS A ONE POINT SEVEN MILLION OR WAS AT ONE POINT EIGHT MILLION, ONE POINT SEVEN ONE POINT SEVEN MILLION, WHICH IS LESS THAN WHAT THE PROPERTY APPRAISED VALUE OF TWO POINT THREE MILLION WAS. SO I JUST WANT TO LET THE CITIZENS REALIZE REALIZE THAT BECAUSE NONE OF THOSE FIGURES WERE IN THE PACKAGE. THANK YOU. YOU. WELL. ALSO, I NEED EMOTIONAL. MOTION MOTION APPROVED THE ADOPTION OF THE RESOLUTION CONVEYANCE SITTING IN CIA ON SURPLUS REAL ESTATE LOCATED AT 40 TO 20 DIXIE HIGHWAY NE TWENTY NINE, THIRTY TWO AND TWENTY NINE, TWENTY PAPASSO AVENUE, NORTHEAST TO OUR SPACE COAST. MARÍAS, LLC, AUTHORIZED TO THE CITY TO VACATE APPROXIMATELY ELEVEN THOUSAND ONE HUNDRED NINETY SEVEN SQUARE FEET OF RIGHT AWAY ALONG MAPLEWOOD DRIVE FROM TURKEY CREEK NORTH TO A POPULAR AVENUE NORTHEAST AND AUTHORIZED CITY MANAGER TO EXECUTE THE CLOSING DOCUMENTS WITH THE PRICE TAG OF ONE POINT SEVEN MILLION. OK, GOT A MOTION BY DEPUTY MAYOR JOHNSON SECONDED BY. COUNCILMAN FOSTER ANY DISCUSSION? YES, I'M TRYING TO GIVE YOU A DELAY ON COUNCILMAN BAILEY, THANK YOU. BE RIGHT THERE. YES, SIR. YOU RECOGNIZED. THANK YOU, SIR. I, I JUST I WAS ABLE TO LISTEN TO THE SCIARRA PORTION, WHICH HAPPENED IMMEDIATELY PRIOR TO THE MEETING TONIGHT. WHENEVER I LISTEN TO THE DISCUSSION THERE, I I HEARD DISCREPENCIES THAT I BELIEVE SHOULD BE STRAIGHTENED OUT AND THAT THERE WAS COUNSEL WAS UNDER THE IMPRESSION THAT SOME OF THE MITIGATING FACTORS THAT WERE CLAIMED TO BE DISCOVERED DURING THE DUE DILIGENCE PERIOD WERE ACTUALLY ACKNOWLEDGED. AND WE'RE GIVEN TO PROVIDE IT TO THE DEVELOPER PRIOR TO THEIR LETTER OF INTENT TO THE CITY OF PALM BAY, NAMELY, THAT IS THE CURRENT LEASE THAT THE CITY HAS ON THAT PROPERTY WITH THE BRIGHT LINE PROJECT. NOW, NEVER MIND THE FACT THAT I HAD ISSUES WITH US DOING THAT, LISA FLIGHTLINE AND I HAD THIS RIGHT HERE, JUST HAPPENED TO BE A NO RESULTING ISSUE WHERE WE'RE REDUCING TWO HUNDRED THOUSAND DOLLARS BECAUSE OF THAT CONTRACT BEING REPORTED AT LEAST TO BE INTERFERING WITH THE BUYER OF THIS MARINA. HOWEVER, GIVEN THE FACT THAT THE BUYER OF THE MARINA, THE DEVELOPER, KNEW ABOUT THIS LEASE AND WAS GIVEN AN E-MAIL, ACCORDING TO STAFF ON. MAY ONCE I CAN HEAR MAYOR, I'M. MAY 29. THAT WAS BY WRITTEN ATTACHMENT AND THAT WAS PROVIDED TO ME BY STAFF AND ALSO THERE WERE DISCUSSIONS OF IT EVEN EARLIER THAN THAT, WHICH IS WAY BEFORE COUNCIL EVER. KNOW, WE MOVED. WE GOT TO THIS POINT. AND SO I JUST DON'T THINK THAT THERE'S A LEGITIMATE REASON TO REDUCE OUR PRICE. WHEN WE HAD SOMEBODY ELSE AT THE TABLE THAT WAS VERY SPLIT, COUNCIL WAS VERY SPLIT, SPLIT BETWEEN TWO GOOD PROJECTS. THE OTHER ONE HAS THE CASH. I THINK THAT WE SHOULD HOLD THIS DEVELOPER TO THE TUNE OF THEIR FEET TO THE FIRE, AS I HEARD DISCUSSED DURING THE LAST MEETING, MR. FELIX IS CORRECT. YES, FAIR PRICE ONE POINT NINE IS BELOW MOST ALL RECOMMENDATIONS RECEIVED FOR AS OUR BROKER AND OUR APPRAISAL, I THINK WE COULD GET IN. IT'S WORTH EVEN MORE THAN THAT. BUT AT THIS POINT, WE MADE A DEAL. WE HAD ONE POINT NINE. AND MY OTHER UNDERSTANDING IS THAT THIS PROJECT IS NOT GOING TO WALK. PROJECT IS NOT GOING TO WALK AT ONE POINT NINE. AND AND IF IT DOES, WE HAVE ANOTHER PROJECT OUT THERE THAT WE COULD BE EXPLORED. SO I WOULD NOT GO BELOW THAT ONE POINT NINE. THAT IS ESSENTIALLY A 200000 DOLLAR GIVEAWAY TO THE DEVELOPER WHEN THE DEVELOPER HAS ALREADY SELF ADMITTED THAT HE HAS OVERPAID ON SURROUNDING PARCELS. I THINK ONE OF THEM WAS 150000 DOLLARS. WHY WOULD WE ALREADY TAKING A SHORT. YOU KNOW, TAKING A PRICE SHORT OF MAYBE WHAT THE VALUE IS, TAKE IT EVEN LOWER WHEN AT THIS POINT THAT WOULD BE A CONCERN FOR ME. SO THERE'S NO WAY I COULD SUPPORT THIS WITH THE ONE POINT SEVEN. [00:55:04] I THINK WE NEED TO REVISE IT STRAIGHT TO WHAT STAFF RECOMMENDED PASSED, WHICH DEATH RECOMMENDED MOTION WAS, AND IGNORE THE ONE POINT SEVEN COUNTEROFFER. THANK YOU, COUNCILMAN BAILEY, DEPUTY MAYOR JOHNSON. YEAH, YOU WANT TO ADDRESS SOME OF THOSE? YES, I HAVE CONCERNS, MAYOR. IS THERE TRUTH TO WHAT COUNCILMAN BAILEY SAYING IN REGARDS TO THE DEVELOPER KNOWING OR. THE DEVELOPER WAS THE SORRY, THE BUYER, THE BUYER WAS UNAWARE OF THE RIGHT LINE HSR LEASE AGREEMENT ON MAY 29TH. THE BRIGHT LINE HSR LEASE AGREEMENT WAS EXECUTED ON APRIL 2ND. TWENTY TWENTY ONE. UM. HE PUT IN A CAR ANALOGY WITH THE CITY, I BELIEVE, IN MARCH LATE, MID TO LATE MARCH 20, 21. SO WHEN HE PUT IN THE LOAY. WE HAD OUR FINAL MEET HOUR MEETING, INITIAL MEETING WITH THE BUYER AND ALL OF THE DEVELOPMENT TEAM ON APRIL 1ST. THAT WAS WHEN FRANK WATANABE BROUGHT UP THE FACT THAT THE RIGHT OF WAY WOULD BE UNDER CONTRACT WITH BRIGHT LINE. ON APRIL 2ND WAS WHEN IT WAS EXECUTED, IT WASN'T PART OF THE LEASE AGREEMENT EXECUTION, BUT I OBTAINED A COPY ON MAY 29TH AND PROVIDED THAT TO FIRE VICTIMS. ALONG WITH THE SOIL SAMPLES THAT THAT HE MENTIONED AND HE ALSO STATED THAT JONATHAN FROM AVALON COULDN'T EVEN BUILD ON THAT BASED ON THE SOIL SAMPLE, IS THERE ANY ACCURACY TO THAT? WELL, I CAN'T SPEAK TO WHETHER ADLEN COULD OR COULD NOT BECAUSE I I'M NOT AN ENGINEER, BUT WE AS THE CITY WOULD NOT HAVE KNOWN ABOUT THE SOIL SAMPLES BECAUSE WE DID NOT CONDUCT ANY SOIL SAMPLES THAT WAS CONDUCTED BY THE BUYER DURING HIS DUE DILIGENCE PERIOD. ALL RIGHT, ANY FURTHER DISCUSSION, COUNCILMAN, FELIX, IF I MAY GET THANK YOU. THANK YOU, COUNCILMAN BAILEY, I WAS TRYING TO REALLY STEP IN. I KNOW YOU WEREN'T HERE, BUT TRULY, I MEAN BY ANY MEANS, THIS PROJECT IS A GREAT PROJECT. TWO HUNDRED THOUSAND DOLLARS. IS IT A HUGE DIFFERENCE? MAYBE NOT. BUT AGAIN, MY MY POINT BEING IS I THINK THIS IS A GREAT DEAL AT ONE POINT NINE FOR THE FOR THE BUYER. THAT'S WHY I STAND FAST ON ON KEEPING THAT THAT ONE POINT NINE AND COUNCILMAN BAILEY. BUT I'M NOT GOING TO EVEN GO INTO THE FACT THAT WHETHER THE DEVELOPER KNEW OR NOT. BUT THE SIMPLE FACT THAT. THIS IS PRIME PROPERTY, WE DON'T HAVE MANY OF THEM IN PALM BAY PARTICULARLY, YEAH, WE CAN LOOKED AT THE BAYFRONT AS A WHOLE, BUT THIS PARTICULAR PROPERTY IS A GREAT PROPERTY. THE BUYER SPOKE TO THE FACT THAT IT SAT IN THE MARKET FOR 10 YEARS. OF COURSE. I MEAN, LOOKED AT THE LAST 10 YEARS, I MEAN, OH OH REAL ESTATE MARKET JUST RECENTLY PICKED UP. AND I DON'T THINK THE CITY WAS DID A GREAT ENOUGH JOB PUSHING OR WHATEVER WE HAD AS AGENT AT THE TIME, WHAT I BELIEVE AT ONE POINT NINE. THIS IS STILL A GREAT PRICE. GOING BACK AGAIN TO THE TO THE APPRAISAL VALUE. WE'RE TALKING ABOUT A NEARLY ONE SIX FIVE SIX THOUSAND SIX HUNDRED THOUSAND DOLLARS DIFFERENCE. I MEAN, SO. FOR THE SIMPLE FACT THAT ALONE, THAT'S THAT'S WHERE I STAND AND I'M GLAD COUNCILMAN BAILEY YOU YOU STEPPED IN AND IN WILL THE ECHO THE FACT THAT, YOU KNOW, I THINK WE SHOULD STAY IN MY BELIEF AND I EVEN WENT BACK, TRY TO NEGOTIATE IN THE BUYER HALFWAY. BUT, OF COURSE, YOU KNOW, OBVIOUSLY THE MAJORITY OF THE BOARD FELT DIFFERENTLY. SO THIS IS AN OPPORTUNITY FOR THIS COUNCIL. WE HAVE AN ELECTION TO PAY FOR, I DON'T MEAN TO, BUT THIS IS THIS IS IT RIGHT THERE. I MEAN, THIS IS IT RIGHT THERE. BUT ANYWAY, I JUST WANTED TO THROW THAT IN, BUT I THINK COUNCIL SHOULD REALLY RECONSIDER THAT DECISION BY THE BCR BOARD. THANK YOU. COUNCILMAN FOSTER POLICE. THANK YOU, MAYOR. NOW TO SOUL. HE WOULD HAVE KNOWN THAT IF YOU DID HIS DUE DILIGENCE. THAT'S NOT THE CITY FAULT. [01:00:02] THAT'S NOT THE DEVELOPER FOR BUT. I WANT TO SEE THIS PROJECT BE SUCCESSFUL. I SAT THERE FOR OVER 10 YEARS. I MEAN, YOU HAVE A BUYER. YOU HAVE A BUYER NOW, WE HAVE A GOOD BUYER WHO'S DEDICATED, HAS BEEN IN WAS DOING GREAT THINGS IN MELBOURNE, COULD DO GREAT THINGS IN PALM BAY THAT COULD CREATE 300 JOBS. THE RETURN ON OUR INVESTMENT. IT'S GOING TO BE. A LOT FO. A LOT, FOLL, IF THE DEVELOPER BE SUCCESSFUL IN THIS AND IT'S GOING TO COST HIM MORE THAN HE THOUGHT, I KNEW THIS WHEN I KIND OF KNEW IT WHEN WE BOUGHT IT AND HE MADE THE OFFER AT ONE POINT NINE, I THOUGHT HE WAS GOING TO SPEND MORE MONEY AND WHAT HE WAS PLANNING. WELL, HERE WE ARE. HE'S SPENDING TWO HUNDRED FIFTY THREE THOUSAND ON ELECTION AND WE COULD ALSO SPEND TWO HUNDRED THOUSAND TO CREATE JOBS AND PALM BAY HAVE A GREAT PLACE TO LIVE ENTERTAINMENT TO PUT PALM BAY ON A MAP IN THAT ARENA. 253 THOUSANDS. NOT A LOT OF MONEY TO SPEND ON ELECTION. TWO HUNDRED THOUSAND DOLLARS IS NOT A LOT IN MY EYES TO BRING ECONOMIC IMPACT TO THE BAYFRONT AREA. AND THAT'S WHERE WE NEED TO DO ONCE WE BUILD UP, ONCE THIS PROJECT GETS OFF THE GROUND, IT'S GOING TO BE A DOMINO EFFECT OR PROJECTS IS GOING TO COME. SO I THINK WE SHOULD HONOR WHAT WE DID, THE MEMBERS OF THIS COUNCIL, WHAT WE DID IN THE SCIARRA MEETING JUST A FEW MINUTES AGO, I THINK WE NEED TO STICK WITH THE PLAN AND PASS THIS ORDINANCE. THANK YOU, COUNCILMAN FOSTER AND I'LL PUBLICLY SAY WHAT I SAID AT THE BOKHARA, THE INITIATIVE THAT WAS SHOWN BY THIS BUYER IN BUILDING A COLLABORATION AND RELATIONSHIP WITH THE NEIGHBORS AND RALLYING THE NEIGHBORS TO SUPPORT THAT PROJECT SPEAKS VOLUMES ON HOW THAT PROJECT'S GOING TO MOVE FORWARD. I SUPPORTED THAT PROJECT AS A MEMBER OF THE BC3 AND I SUPPORT IT STILL TODAY. RIGHT NOW, I'VE GOT A MOTION BY DEPUTY MAYOR JOHNSON AND SECONDED BY COUNCILMAN FELIX. GO AHEAD, COUNCILMAN BAILEY. YES, MA'AM, REAL QUICK, THE MAIN POINT WAS THAT HE DID HE WAS AWARE OF THE FLIGHTLINE LIST, WHICH IS A PRIMARY CONCERN, THE SOIL SAMPLES. I DON'T THINK THAT THAT'S ANYTHING UNUSUAL. STAFF TOLD ME THE SAME THING. AND AS FAR AS THAT, THEY STATION ADVOCATING FOR, I THINK IT WAS FOR STORMWATER OR FOR UTILITIES. THAT'S A KNOWN ANY DEVELOPER WORTH THEIR SALT KNOWS THAT THIS DEVELOPER IS VERY SAVVY. HE PURCHASED PROPERTIES IN THE MIDDLE OF HIS LETTER OF INTENT AT ABOVE MARKET PRICE IN ORDER TO UNDERCUT HIS COMPETITORS AND KNOWING HE HAS A STRONG POSITION. I GIVE HIM CREDIT FOR BEING A VERY SAVVY BUSINESSMAN. BUT I AM NOT, REGARDLESS OF HOW GREAT OF A BUSINESSMAN HE IS, HOW GREAT HE IS AS FAR REACHING OUT TO THE NEIGHBORS AND SO FORTH. I DON'T CARE IF IT'S MY BEST FRIEND OR MY ENEMY. WHAT I HEAR IS THAT THE CITY AND TAXPAYERS GET THE MARKET PRICE AND WE DON'T ESSENTIALLY TRANSFER TWO HUNDRED THOUSAND DOLLARS FROM THE PUBLIC TO THE PRIVATE. AND THAT'S THAT'S THAT'S THE BOTTOM LINE THERE, ESPECIALLY GIVEN THAT THESE THINGS THAT WERE FOUND IN DISCOVERY WERE REALLY NEGLIGIBLE IN THE BIG PICTURE COMPARED TO OTHER PROJECTS. THANK YOU, MAYOR. THANK YOU. I'VE GOT A MOTION BY DEPUTY MAYOR JOHNSON SINGING ABOUT COUNCILMAN FELIX ALL IN FAVOR AND ANY OPPOSE NAY NAY. SO PASSES THREE TO TWO WITH FELIX AND BAILEY VOTING NAY. IF YOU MAKE ABOUT. [15. Consideration of aerial firefighting support Memorandum of Understanding with the Brevard County Sheriff’s Office.] WE'RE ON ITEM 15. I NORMALLY TALK ILL OF THE CITY ON HOW THEY SPEND THEIR MONEY AND THEIR FINANCIAL ADVISEMENT THAT THEY SOMETIMES FACE, BUT THIS TIME I'M GOING THE OPPOSITE. THIS WAS A VERY GOOD DEAL THAT THEY WORKED OUT WITH THE SHERIFF'S OFFICE. THE FACT THAT YOU CAN GET A FIREFIGHTING CAPABILITY IN IN A CHOPPER IN THE AIR FOR JUST THE PRICE OF THE FUEL FOR THAT APPARATUS, THAT MEANS YOU DIDN'T HAVE TO BUY IT AND YOU DON'T HAVE TO MAINTAIN IT. YOU JUST GET TO PUT OUT FIRES AT THE COST OF FUEL. THIS IS ONE TIME WHERE THIS WAS A REAL GOOD DEAL. AND I'M PROUD WHOEVER CAME UP WITH THAT ONE. THANK YOU. ANY OTHER SPEAKERS? AND IN MOTION COUNCILMAN MOTION TO APPROVE ENTERING INTO AGREEMENT FOR AERIAL [01:05:03] FIREFIGHTING SUPPORT WITH BREVARD COUNTY SHERIFF'S OFFICE GOT A MOTION BY DEPUTY MAYOR JOHNSON SECONDED BY COUNCILMAN FOSTER. ANY ADDITIONAL DISCUSSION? COUNCILMAN BAILEY SELON, YES, SIR, I'D HAVE NOTICED I HAVE NO DEBATE, OK, ALL IN FAVOR, I ONLY OPPOSE US UNANIMOUSLY. ITEM 18, BOBETTE. [18. Consideration of an increase in the annual salary for the Information Technology Director.] LOBATÓN, 586 OCEAN SPRAY STREET SOUTHWEST. I'M SITTING KIND OF CLOSE TO THE INDIVIDUAL I'M GOING TO MAKE THE STATEMENT ABOUT SO AND A LITTLE BIT FURTHER. OK. WHEN YOU HAVE A DIRECTOR IS GETTING EIGHTY FIVE THOUSAND DOLLARS A YEAR COMPARED TO OTHER DIRECTORS WITHIN THE SAME CITY, THEY GET ONE HUNDRED AND FIVE THOUSAND DOLLARS A YEAR FROM THEIR BASE SALARY. I THINK THAT'S. YES, REPRESENTATION BASED ON POSITIONAL AUTHORITY AND PAY. BUT BILL BATIN BEING THE FOOL THAT HE IS, I HAVE A SOLUTION TO THIS. SO INSTEAD OF RAISING ONE INDIVIDUAL'S SALARY UP TO ONE HUNDRED AND FIVE THOUSAND, WHY DON'T WE DROP ALL THE OTHER DIRECTORS DOWN TO EIGHTY FIVE THOUSAND DOLLARS A YEAR? AND THAT'LL MAKE UP ENOUGH DIFFERENCE TO PAY FOR ONE DIRECTOR? IT WAS JUST AN IDEA. I KNOW THAT WAY EVERYBODY'S STILL EQUAL. EVERYBODY IS STILL BEING TREATED THE SAME. AND NOBODY WAS SLIGHTED EXCEPT FOR EVERYBODY THAT GOT A PAY CUT. ALL RIGHT. THANK YOU VERY MUCH. SO THERE WELL. ALSO, I NEED A MOTION MOTION TO AUTHORIZE AN INCREASE IN SALARY FOR THE I.T. DIRECTOR. I GOT A MOTION BY DEPUTY MAYOR JOHNSON SECONDED BY COUNCILMAN FELIX. ANY DISCUSSION COUNCILMAN BAILEY. THANK YOU, MAYOR, I APPRECIATE YOU ALLOW ME TO SPEAK ON THIS. THIS IS A VERY TOUGH ONE FOR ME. I THINK SOME ADJUSTMENT MIGHT BE WARRANTED. AND I APPRECIATE THE VALUE THAT MR. ROBERTSON HAS BROUGHT TO HIS POSITION AS ITS DIRECTOR THIS LAST I GUESS IT'S GOING TO ABOUT A YEAR AND A HALF, TWO YEARS NOW. BUT I KNOW THAT HE IS DOING A GOOD JOB. BUT HE STARTED AT A CERTAIN PLACE. WE HAVE BASED SALARIES FOR A REASON. AND I THINK A MORE MODEST AND THIS IS CONSISTENT WITH MY PREVIOUS STATEMENT WHEN IT COMES TO SALARIES OF THIS NATURE, I THINK A MORE MODEST ADJUSTMENT WOULD BE APPROPRIATE. AND SO I CAN'T SUPPORT IT AS IT IS. BUT BUT I DO APPRECIATE HIS SERVICE AND IS NOT A REFLECTION OF ANY WAY OF MS. ROBS AND APPRECIATES THE VALUE HE BRINGS. I CAN ECHO YOUR COMMENTS WHEN IT COMES TO APPRECIATING MR. ROBINSON'S VALUE FOR WHAT WHERE HE'S BOUGHT THE IT DEPARTMENT HERE TODAY, SPECIFICALLY WITH ALL THE CHALLENGES THAT HE'S FACED. SO I SUPPORT THIS MOTION ALL IN FAVOR OF ANY OPPOSE. NOW, AS IS FOUR TO ONE. ITEM 19, LOBATON. [19. Consideration of appropriation of funds from the Undesignated Fund Balance for the replacement of Shelter number 3 at Castaways Point Park ($29,069).] BILL 586 OCEAN SPRAY STREET SOUTHWEST. TWENTY NINE THOUSAND DOLLARS OR. DOES NOT SOUND LIKE A LARGE CHUNK OF MONEY, BUT I HAD A COUPLE OF QUESTIONS REGARDING IT. THE FIRST QUESTION WAS, IS THIS COMING OUT OF PARKS AND RECREATION FUND OUT OF THEIR UNFUNDED BALANCE OR IS IT COMING OUT OF THE GENERAL FUND UNFUNDED BALANCE BECAUSE PARKS AND RECREATION ALREADY CARRIES A BUDGET OF THREE MILLION DOLLARS A YEAR? YES, I WOULDN'T BE AWARE OF THAT. AND I WAS LOOKING AT WHAT THE BREAKDOWN WAS OF WHAT THAT WAS GOING TO BE, 11000 DOLLARS FOR THE BUILDING ITSELF. WHEN WE LOOK DOWN, IT SAYS LABOR WILL BE ALL IN HOUSE. AND I SEE BUILDING PERMIT FEES, ALMOST A THOUSAND DOLLARS. WELL, THAT'S TO THE CITY. SO WE SHOULDN'T HAVE OUR OWN BUILDING FEES WITHIN OURSELF. I WOULDN'T THINK IT'S TAKEN OUT OF MY RIGHT POCKET, PUT IN MY LEFT POCKET. ALL RIGHT. THE NEXT AND THE NEXT ONE WAS PHIL. DIRT'S THE SOIL. THREE HUNDRED DOLLARS FOR THE DIRT. I'M WATCHING THE CITY MOVE DIRT LEFT AND RIGHT WITHIN THEIR OWN OWN PROPERTY, UNLESS IT WAS JUST FOR THE TRUCKING COST. BUT I BUY A LOAD OF DIRT FOR 100 OF FILLED FILTER FOR ONE HUNDRED AND SIXTY DOLLARS. SO I DON'T KNOW WHY THAT ONE WAS THREE HUNDRED DOLLARS TO THE CITY. CONCRETE AND REBAR. THE BUILDING PAD WAS ALREADY THERE. SO WHY ARE WE BUILDING A NEW BUILDING, A NEW CONCRETE PAD OF THREE OF SIX THOUSAND DOLLARS TO PUT IT IN? IN A SHORT SUMMARY, THIS ONE LITTLE BUILDING THAT'S AT THE PARK WHERE YOU'RE OVERSPENDING [01:10:05] ON WHAT THE VALUE IS. I COULD SEE THE PRICE OF THE BUILDING, THE PAVILION COST OF ELEVEN THOUSAND DOLLARS, BUT I CANNOT SEE THE COST OF TWENTY NINE THOUSAND DOLLARS. WHAT WAS IT, TWENTY NINE THOUSAND SIXTY NINE? THAT SEEMED LIKE A LOT TO ME FOR A SHED GOING UP. THAT WAS GOING TO BE SOMETHING WE PURCHASED FOR ELEVEN THOUSAND DOLLARS. THANK YOU VERY MUCH. I'M SHERMAN. THANK YOU, MAYOR. SO TO ANSWER A COUPLE OF THE QUESTIONS, THIS IS COMING, RECOMMENDED TO BE FUNDED FROM GENERAL FUND UNDESIGNATED FUND BALANCE, IT IS PART OF A GENERAL FUND, WHICH IS WHERE THE PARKS AND FACILITIES DEPARTMENT IS ALSO BUDGETED OUT OF. THE QUESTION REGARDING BUILDING FEES, BECAUSE THE BUILDING DEPARTMENT HAS A SEPARATE ENTERPRISE FUNDS AND WE HAVE TO FOLLOW STATE STATUTES, BUILDING FUNDS SEPARATE FROM GENERAL FUNDS. SO WE DO HAVE TO MAKE THOSE PAYMENTS APPROPRIATELY BETWEEN THE FUNDS. UNFORTUNATELY, I'M NOT AN EXPERT ON THE SPECIFIC NEED FOR THE CONCRETE AND REBAR AND OTHER DETAILS, BUT THIS WAS PROVIDED BY OUR PARKS AND FACILITIES DIRECTOR GREG MINOR. AND I HAVE CONFIDENCE IN HIS ESTIMATION ON THOSE THINGS. HE'S UNABLE TO BE WITH US TONIGHT DUE TO A MEDICAL SITUATION, SO. THANK YOU, MA'AM. ALSO, WHAT IS YOUR PLEASURE? LISTEN TO APPROVE THE REPLACEMENT OF TOWER NUMBER THREE CASTAWAYS POINT PART GOT A MOTION BY DEPUTY MAYOR JOHNSON SECONDED BY COUNCILMAN FOSTER COUNCILMAN BAILEY. I WANT TO GIVE YOU THE FIRST OPTION IF YOU'RE GOING TO SPEAK. THANK YOU, MAYOR. THIS IS ANOTHER ONE THAT MAY IN TIME BE WARRANTED. BUT I THINK THERE ARE OTHER PROJECTS THAT COULD BE CONSIDERED WITH SOME OF THESE DOLLARS AND CERTAINLY OTHER THINGS, SUCH AS WE HAVE OUTSTANDING PUBLIC SAFETY AND OTHER CONCERNS, GIVEN THE FACT THAT THERE ARE ALREADY STRUCTURES THERE. TO ME, I THINK A MAY BE WISE OF TABLING THAT TABLING BY PUTTING THIS ONE ON THE SHELF, THIS PROJECT ON THE SHELF, AND THEY COME BACK OUT THROUGH THE CITY IN THE FUTURE. AND THEN THAT WAY THE UN DOESN'T HAVE FUN. BALLOTS CAN BE USED FOR HIGHER ORDER. ITEMS FROM THE CITY. I'LL BE THERE. THANK YOU, DEPUTY MAYOR JOHNSON. WHAT ARE YOUR THOUGHTS ON THAT? MY MY QUESTION I WAS LOOKING AT IT BECAUSE I WOULD LIKE TO HEAR FROM MR. MINER, AND I UNDERSTAND. I KNOW. SO THAT'S MY THING. I'LL ALWAYS BE LOOKING TO JUST PUT IT ON THE SHELF, BUT POSSIBLY TABLE IN IT UNTIL HE'S CONTINUING, UNTIL HE'S AVAILABLE, WHETHER THAT'S SOME A MONTH OR SO. BUT HIS FEEDBACK WOULD BE GREATLY APPRECIATED. I BELIEVE I WOULD SUPPORT THAT. OK. ALL RIGHT. OK, WE'VE GOT TO BE OK. HELLO, SIR, HOW ARE YOU? GOOD, SIR, HOW ARE YOU? ANDREW ORNDORFF, A PROJECT MANAGER AND FACILITIES. I THOUGHT YOU GUYS MIGHT HAVE A QUESTION, SIR. RIGHT NOW, ANDREW. SO JUST REAL QUICKLY, ONE OF THE QUESTIONS FOR ANDREW WAS RELATED TO THE PURPOSE OF THE CONCRETE AND REBAR, THERE'S A SIX THOUSAND DOLLAR ITEM THERE AND THE COMMENT WAS MADE BY A MEMBER OF THE PUBLIC THAT THERE, I GUESS, BELIEVE THERE'S AN EXISTING PAD THERE, IF YOU CAN SPEAK TO THAT, ANDREW. RIGHT. SO THE EXISTING PAVILION HAD A CERTAIN FOOTPRINT. AND ALSO UNDERNEATH THE FOOTPRINT, YOU'VE GOT THE FOUNDATIONS THAT ALL THE ISLANDS ARE ATTACHED TO. SO WHEN WE GO INTO A NEW NEW PAVILION, IT'S NOT GOING TO HAVE THE SAME FOOTPRINT. AND IF WE WERE TO. WITH ALL THE ENGINEERING BEHIND IT AND EVERYTHING THAT YOU HAVE TO POOR FOOTER FOR EVERYTHING, WE'RE GOING TO CUT UP PROBABLY 75 PERCENT OF THE CONCRETE. AND SO AT THAT POINT, IT'S ACTUALLY MORE COST EFFECTIVE TO COMPLETELY REMOVE EVERYTHING THAT WE HAVE THERE. AND IT'LL IT'LL BE MORE COST EFFECTIVE FOR GUYS TO POUR ME FOOTERS. NEW FOUNDATIONS FOR THE FOR THE DESIGN, COME ON, CAN YOU SPEAK LOUDER INTO THE MIND BECAUSE WE HAVE SOMEONE THAT'S REMOTE RIGHT NOW. SORRY, ARE YOU COPYING THIS? ARE YOU READING WHAT OUR STAFF ARE SAYING? AND BY THE WAY, WOULD YOU STATE YOUR NAME AGAIN, SIR? ANDREW ORNDORFF. ANDREW WARNED OFF COUNCILMAN BAILEY. DID YOU READ WHAT? THE SHOP. YEAH. YEAH. HE'S SPEAKING TO THE REASON FOR WHY THERE NEEDS TO BE A NEW PAD. IS THAT CORRECT? AM I HEARING SOME OF IT? THE COST NOW, COUNCILMAN, BAILEY IS BREAKING DOWN THE COST FOR EACH EACH ITEM IN REGARDS TO THE REPLACEMENT. OK, THANK YOU. MARIO. SO ANY QUESTIONS, COUNCILMAN BAILEY. [01:15:01] NO, SIR, I DON'T HAVE ANY QUESTIONS ABOUT THAT PORTION JUST ON. YOU DON'T HAVE ANY QUESTIONS REGARDING WHERE IT LINES UP WITH CAPITAL IMPROVEMENT. I'M SORRY, SAY AGAIN, MAYOR, APOLOGIZING REGARDING THE CAPITAL IMPROVEMENT ISSUE THAT YOU RAISED. SO COUNCILMAN BAILEY, WHAT HE'S ASKING IS IF YOU HAVE ANY QUESTIONS REGARDING THE TIMING OF THE CAPITAL IMPROVEMENT AND WHERE LINES UP ON THE LIST. OH, NO, I DON'T HAVE ANY. I THINK IT'D BE BEST FOR ME FOR FOR THE COUNCIL IN THE FUTURE TO WORK THAT OUT OR IF YOU WANT TO WORK OUT TONIGHT. BUT I DON'T HAVE ANYTHING SPECIFIC ON THAT. SO I'VE GOT A MOTION AND I GOT A SECOND. ANY FURTHER DISCUSSION? ALL IN FAVOR OF ANY OPPOSE. NOW, THIS IS FOUR TO ONE, WE'RE ON THE PROCLAMATION'S, AND I'D LIKE TO, IF YOU WOULD ALL INDULGE ME. OR JUST A FIVE MINUTE RECESS. THANK YOU. I'M GOING TO CALL THIS MEETING BACK TO ORDER. WE ARE ON PROCLAMATION'S IS COUNCILMAN BAILEY ON THE LINE I WANTED TO TRY TO GATHER ETA [PROCLAMATION: (Part 1 of 2)] FOR. SO GOOD EVENING, I'D LIKE TO CALL UP MARCI KING, IS MARCY KING WITH US. AND MORSI, COME ON UP. SO I'LL READ THIS PROCLAMATION. COUNCILMAN BAILEY, CAN YOU READ ME? COUNCILMAN BAILEY, I'VE BEEN INFORMED THAT YOU PERHAPS WON'T MAKE IT IN TIME FOR THIS COUNCIL MEETING. IS THAT ACCURATE? COUNCILMAN BAILEY AGAIN, WE'VE KNOWN EACH OTHER FOR FOUR YEARS, I'D SAY AT LEAST YOUR WHOLE TENURE ON COUNCIL, YOU KNOW, WE'VE HAD A LOT OF GREAT CONVERSATION OVER THE YEARS AND SPENT SOME TIME TOGETHER AGAIN. ALWAYS PAY CLOSE ATTENTION ONCE YOU START SPEAKING. I KNOW THERE'S ALWAYS AN OPPORTUNITY TO TO POTENTIALLY LEARN SOMETHING, ESPECIALLY AS A NEW MEMBER OF THIS BODY AND. LET'S JUST SAY, MAN, YOU'LL BE MISSED AND I NEVER YOU KNOW, YOUR FAMILY AS WELL, GHAURI THE KIDS, YOU KNOW, WE IF I RECALL COREY ACTUALLY, IF I MAY SAY IT PUBLICLY, ONE OF MY CAMPAIGN SIGN, COREY, WAS YOUR WIFE'S IDEA FOR THAT OUT FOREVER. YOU KNOW, THANKFUL. AND, YOU KNOW, MY LAST NAME IS FELIX. SHE SAID IT WOULD BE GREAT TO PUT FIX IT FELIX. SO WHICH WAS GREAT. AND I TOOK IT IN WHEN IT WAS REALLY THIS. THOSE ARE SOME OF THE LITTLE THINGS THAT WE MAY NOT PUT MUCH IMPORTANCE ON. BUT BUT THEY ARE THEY THEY ADD A LOT OF MEANING TO ME AND HER. AND I EXCHANGED TEXT QUITE A BIT IN AND THAT'S GOT IT RIGHT. BUT AGAIN, THANK YOU SO MUCH FOR YOUR SERVICE, SIR. YOU YOU WILL CERTAINLY YOU AND YOUR FAMILY WILL CERTAINLY BE MISSED. THANK YOU. COUNCILMAN FOSTER. COUNCILMAN BAILEY JUST GOING TO BE SHORT, I WISH YOU GODSPEED IN YOUR NEW ENDEAVOR IN LIFE, ALTHOUGH MAYBE YOU DISAGREE A LOT. WE DID HAD WONDERFUL CONVERSATIONS AFTER HOURS. WELL, HOURS. AND I APPRECIATE YOUR THOUGHTS AND. I DID VOTE FOR YOU, MR. BAILEY IN YOUR LAST ELECTION, ALTHOUGH I DISAGREE WITH YOU ON A LOT OF THINGS, BUT I DID VOTE FOR YOU OVER IRONBAR AND I AM PART OF. SO I WISH YOU THE BEST IN YOUR FUTURE. TAKE CARE OF YOURSELF AND YOUR FAMILY. DEPUTY MAYOR JOHNSON, I'M SORRY, THAT WAS FUNNY. OH, COUNCILMAN BAILEY, MAN. YEAH, WE DON'T WE'VE HAD SOME TIME TOGETHER. [01:25:04] YEAH. UH. LIKE I SAID BEFORE, WHEN YOU FIRST WHEN YOU FIRST TOLD US, I TOLD YOU, YOU KNOW, IT SAYS A LOT FOR YOU TO, YOU KNOW, HAVE TO STEP STEP AWAY FROM THIS BECAUSE YOU GOT TO MAKE SURE YOU TAKE CARE OF YOUR FAMILY. YOU'RE YOU KNOW, IT'S GOT FAMILY AND THEN OCCUPATION. AND YOU SAY YOU PRAYED ABOUT IT MULTIPLE TIMES. SO THAT WAS THAT WAS YOU LEANING ON GOD AND YOU'RE LOOKING TO TAKE CARE OF YOUR FAMILY AND PROVIDE FOR THEM. SO THAT IN ITSELF SPEAKS VOLUMES. SO FOR THAT, YOU KNOW, I COMMEND YOU AS WELL, SIR. I KNOW YOU DRIVE IN AND I TEND CAN BE DANGEROUS AT TIMES. SO PLEASE, I'LL BE CAREFUL AND I'M SURE I'LL SEE YOU BEFORE YOU LEAVE, REGARDLESS WHETHER IT'S TONIGHT OR ANOTHER DAY. I'LL MAKE SURE WE SAY OUR FAREWELLS BEFORE YOU MOVE. SO APPRECIATE YOU, BAILEY. COUNCILMAN BAILEY. THIS STILL ON. IT'S. OH, COPY THAT. WELL, THERE WAS YEAH, THERE WAS THERE WAS SOME HEARTFELT WORDS THAT WERE PRODUCED BY OUR DEPUTY MAYOR JOHNSON. SO PLEASE, PLEASE GO BACK TO THE TO THE VIDEO AND SEE THAT. I CAN TELL YOU THAT I REMEMBER WHEN WE FIRST MET, IT WAS THAT VALKYRIE AIRPORT. AND AT THAT TIME, OF COURSE, THERE WAS A CONGRESSIONAL STAFFER. BUT YOU SHARED WITH ME IT WAS BEFORE YOU ACTUALLY RAN FOR OFFICE AND YOU SHARED WITH ME YOUR INTENTIONS TO RUN FOR OFFICE IN AND HOW YOU TWO WERE A CONGRESSIONAL STAFFER BACK IN THE DAYS WHEN YOU WERE A LITTLE YOUNGER AND YOU HAD SOME INFLUENCE WITH CONGRESS. SO I REMEMBER THAT CONVERSATION. AND AND I WILL SHARE THIS. YOU HAVE BOUGHT A UNIQUE DYNAMIC TO THIS COUNCIL, WHETHER IT'S YOUR SCIENTIFIC APPROACH TO THINGS, WHETHER IT'S JUST YOU BEING A MATHEMATICIAN, I THINK IT'S A DYNAMIC THAT YOU CARRY SO WELL AND IT'S YOU BEING YOU. AND IT IS ACTUALLY A GIFT THAT GOD'S PLACED ON YOU. AND SO I COMMEND YOU FOR BEING BOLD WITH YOUR YOUR GIFTS OF GOD. I BELIEVE THAT WHEREVER YOU GO, YOU'LL BE SUCCESSFUL. BUT I, I ALSO ECHO THE SENTIMENTS OF MY COLLEAGUE, OUR DEPUTY MAYOR, THAT SAYS YOU SOLD EACH AND EVERY ONE OF US WITH YOUR COMMENTS. I'M PUTTING MY FAMILY FIRST. AND THAT THAT TOOK INITIATIVE AND THAT TOOK DETERMINATION. AND THAT TOOK A BOLDNESS FOR YOU TO SAY, I'M LISTENING TO GOD HIMSELF. I AM TO MOVE. SO I HONOR YOU TODAY, SIR, AND THANK YOU FOR YOUR SERVICE TO OUR CITY ALL THESE YEARS. DEPUTY MAYOR JOHNSON COMMON CARDS. [PUBLIC COMMENTS/RESPONSES:] ROBERT, I MESS THIS UP EVERY TIME, STICE OH, ALL RIGHT. YOU'RE WELCOME, SIR. GOOD EVENING, EVERYBODY. I HAVE NOT BEEN ABLE TO ATTEND THESE MEETINGS FOR THE LAST FEW MONTHS, I'VE BEEN PRETTY BUSY MYSELF AND AND SOME MEDICAL ISSUES I'M WORKING THROUGH. HOWEVER, I WOULD LIKE TO SEE IF THERE'S AN UPDATE. WE INITIALLY TALKED ABOUT BAYSIDE LAKES BOULEVARD, WHERE IT GOES INTO A 90 DEGREE TURN. AND THE CHIEF HAD TALKED ABOUT ONE OF THE TOP THREE MOST DANGEROUS INTERSECTIONS THAT WE HAVE. IF YOU RECALL THAT WE HAD THREE DEATHS IN THREE YEARS. WE'VE HAD PROPERTY DAMAGE. WE HAVE PEOPLE KNOCKING DOWN TELEPHONE POLES, LIGHT POLES, ET CETERA. SO JUST TO KIND OF SUMMARIZE, WE TALK TO, FIRST OF ALL, FRANK WATANABE. I MET HIM OUT THERE WITH HIS RADAR GUN AND THE AVERAGE SPEED ON THAT AREA IS 50 MILES AN HOUR. WE TALKED ABOUT ON WALTIN REDUCING THE TRAFFIC LIGHT TO MAKE THE TRAFFIC LIGHT TURN RED QUICKER TO MINIMIZE THE HIGH SPEED ON THE STRAIGHTAWAY COMING FROM THE NORTH TO THE SOUTH AROUND THAT TURN. WE ALSO TALKED ABOUT AND LET ME BACK UP, I WAS ABLE TO WITNESS SIGNAGE THAT WENT UP THERE FOR ABOUT TWO WEEKS SAYING THAT WE'RE GOING TO DO THAT. AND THEN TRAFFIC ENGINEERS GOT INVOLVED. WE COULDN'T DO WHAT WE SAID WE WERE GOING TO DO. WE'RE BACK AND FORTH AND I'D LIKE TO KNOW WHAT HAS BEEN DONE TO SLOW TRAFFIC DOWN IN THAT [01:30:03] PARTICULAR AREA THAT SEEMS TO HAVE GONE OFF THE TRACKS. THE OTHER THING WE TALKED ABOUT IS TO GET PEOPLE TO SLOW DOWN HERE IN FLORIDA WAS ENFORCEMENT. I HAVE NEVER SEEN OR SOME OF THE NAMES I HAVE IN SOMERFIELD. I'VE SEEN A TICKET WRITTEN. SO WE HAVE ONE OF THE MOST DANGEROUS INTERSECTIONS HERE. AND HELP ME GET UP TO SPEED. WHAT HAS BEEN DONE AND WHERE DO WE GO FROM HERE? AND THEN WHAT WHAT CAN I DO AS PRESIDENT SOMERFIELD WAY TO HELP SUPPORT THIS INITIATIVE. SO I LOOK FORWARD TO ANY COMMENTS. MAYOR. THANK YOU, MADAM SHERMAN, I'D LIKE TO I KNOW THAT THE LAST TIME ROBERT SPOKE, WE WERE ADAMANT ABOUT TRYING TO GRAB HOLD OF THAT SITUATION AND THE SEVERITY OF LOSING ANOTHER LIFE. WE DID SPEAK ABOUT THAT. SO CAN YOU GIVE US A BRIEF UPDATE? UNFORTUNATELY, I AM GOING TO HAVE TO GET BACK TO YOU ON THAT MR.. STICE IS CORRECT. THERE WAS DEFINITELY CONVERSATION GOING ON BETWEEN PUBLIC WORKS AND THE POLICE DEPARTMENT. IT'S BEEN A COUPLE OF MONTHS, SO I DON'T ACTUALLY RECALL WHERE THEY WERE. THEY ENDED UP I KNOW CHIEF HAS MENTIONED DOING ENFORCEMENT OUT THERE, BUT I WILL GET AN UPDATE AND BRING THAT BACK FOR YOU ALL. WE'LL BRING THAT NEXT COUNCILMAN, IF YOU LIKE, BUT ALSO GET IN TOUCH WITH YOU BEFORE THEN, SO YOU KNOW WHAT'S GOING ON. YEAH, PERHAPS SENDING AN EMAIL IF YOU HAVE HIS INFORMATION AND THEN LOOP COUNCILMAN. AT THE SAME TIME, YOU'VE BEEN DEALING WITH MR. WATANABE, ANOTHER STAFF MEMBER. SO I'M NOT SURE WE HAVE YOUR CONTACT. I SPOKE TO ANOTHER DEPARTMENT. WHAT'S STILL WITH US? WE'LL GET IT IN MY CURRENT CONTACT INFORMATION WHEN I GIVE IT A GO. AND SO YOU DON'T HAVE TO READ INTO THE RECORD. I MAY HAVE. THANK YOU. MR., DAVID MORSE. IT EVEN BORED DAVID MORRIS, TWO NINE SIX THREE WILKINSON AVENUE SE, I TAKE THE TIME TO SPEAK TO THIS CITY ABOUT THE MONEY THAT WE'RE SPENDING ON THE ROADS, OK, THE ROADS WHERE I LIVED, I LIVE. NORTH OF KOGAN, EAST OF SAN FILIPPO WAS THE BABCOCK, I THINK IT'S 22 OR 23, WHATEVER THAT AREA IS, WHAT THAT UNIT NUMBER IS. THEY CAME THROUGH, YOU KNOW, TORE THE ROADS UP. BUT THIS WHATEVER THEY DID, DOWNGRADED IT FLAT, PAVED OVER IT, WHATEVER, A GARENA STREET BEHIND ME THAT CONNECTS THIS TO THE NEXT NEIGHBORHOOD, A FEEDER STREET LITTLE ONE WAS SPLIT ALL OVER THE PLACE. AND WHEN I BROUGHT THIS TO BAILEY'S ATTENTION, JEFF BAILEY HIS ATTENTION. THEY CAME OUT AND THE COMPANY THAT PUT THAT DOWN SEALED ALL THOSE CRACKS UP. WELL, I GOT A BIG DOG. I WALKED HER LIKE A MILE AND A HALF A DAY, TWICE A DAY. AND I SAW THESE ROADS ARE IN BAD REPAIR. OK, BRAND NEW ROADS AND THEY GOT GRASS GROW AND THROW THEM ON THE SIDES. EVERY PLACE WHERE NEW CONSTRUCTION IS GOING IN, THE ENDS OF THESE ROADS ARE BEING SNAPPED OFF. AT THE CORNER OF MY STREET, WILKENSON AND TOWNSING UAW SEE THERE'S A FALLOT PURCHASE, ONE BIG HOME GOING UP ON THIS. THAT WHOLE FRONTAGE OF THAT THAT ROAD'S DESTROYED. OK, I MEAN, AND IT'S FOR MULTIPLE REASONS, YEAH, HEAVY EQUIPMENT GOING ON AND OFF THE ROAD WITHOUT PUTTING SOMETHING ON TOP OF A DIRT CUSHION TO HELP SAVE THAT ROAD WOULD BE ONE THING TO HELP. THERE'S NO STORM WATER DRAINAGE IN MY NEIGHBORHOOD BEFORE THEY PUT THESE ROADS DOWN. THEY DIDN'T. PUT THE PIPES UNDER THE GROUND. NOW, EVERY TIME IT RAINS, I ASKED COUNCIL TO COME OUT, WE GET A GOOD RAIN, COME OUT THE TOWER AND KOGAN. I WENT THROUGH THERE THE OTHER DAY, 17 INCH TIRES AND A PICKUP TRUCK, AND THE WATER WAS UP TO THE TIRES. THERE'S NO THERE'S NO DRAINAGE THERE, THE WATER JUST PULLS INTO MY STREET THE SAME WAY WE CAN FISH THERE. OK, IT'S RIDICULOUS, AND WE PAY ALL THIS MONEY FOR STORMWATER, WE PAY ALL THIS MONEY FOR ROADS AND WATER IS WHAT'S GOING TO DO THESE ROADS. AND IF YOU WALK IN THAT AREA OR DRIVE SLOW IN THAT AREA, THERE ARE SPLITS. SIDE TO SIDE ACROSS THAT ROAD. ALL OVER THE PLACE AND WATER'S GOING TO PERMEATE IT, IT'S GOING TO UNDO THE BEDDING AND WE'RE GOING TO BE BACK WHERE WE WERE BEFORE THESE ROADS ARE PUT DOWN IN FIVE YEARS OR LESS. AND I JUST WANT TO MAKE SURE WE'RE ON TOP OF THIS, NOBODY SEEMS TO BE WATCHING [01:35:03] ANYTHING. I APPRECIATE THAT. THANK YOU, MADAM SHERMAN. HOW ARE WE ADDRESSING THIS? I'M GOING TO THANK YOU. I WROTE DOWN ALL THE STREETS YOU MENTIONED TO US, AND I'LL ASK JOHN TO GET YOUR CONTACT INFORMATION AS WELL. THERE'S A COUPLE OF DIFFERENT CONTRACTED AREAS WHERE WE ARE IN ACTIVE PURSUIT OF RESOLUTION WITH THE VENDORS. I'M NOT SURE IF YOURS WAS A MICRO SURFACING AREA. DO YOU KNOW OFFHAND WHAT TYPE OF TREATMENT? THEY RIPPED ALL THE ROAD UP. THEY TORE IT DOWN. THEY PUT THIS MIX IN AND IT HARDENED AFTER THEY ROLLED IT OUT. AND THEN THEY PUT LIKE THIS MUCH A BLACK TOP ON TOP OF IT. SO I THINK IT'S FULL. THAT ROAD SOUNDS LIKE, OK, THAT WHOLE AREA WAS SITTING ON GDC ROAD. SO NOW SOMEBODY FROM THE CITY COME OUT MARKED OUT AREAS THAT HAD MARKS IN IT AND THEY CAME OUT AND SAW CUT SOME. PLACES TO FIX, WELL, JUST TO THE NORTH OF ME, THEY MARKED OUT A SPOT, THE CITY SHOWED UP OR NOT THE CITY, BUT THE COMPANY THAT PUT THE ROAD DOWN SHOWED UP. SO CUT THE ROAD THROUGH SOME HOT PATCH DOWN THERE. THEY ROLLED IT. THEY PUT THE TRUCK ROLLER BACK UP ON A TRUCK PULLED AWAY. BROKE THAT WHOLE SIDE OF THE ROAD. OK, THERE'S ABOUT AN EIGHT FOOT SECTION OF IT, THAT'S THE CORNER SNAPPED OFF THE ROAD BECAUSE. THEY SOMETHING TOO HEAVY WENT OFF ROAD AND THEY GOT TO COME BACK OUT AND FIX THAT NOW AND OH YEAH, WE'LL GET WE'LL GET YOUR CONTACT INFO AND WE WANT TO KNOW ALL THE STREETS THAT YOU'RE TALKING ABOUT AND WE'LL MAKE SURE WE DO AN EXTRA INSPECTION OUT THERE. IF THERE ARE PROBLEMS WITH THAT, WE WILL FIX THEM. AND I JUST WANT TO TAKE THIS OPPORTUNITY TO THANK YOU FOR YOUR DILIGENCE. I REALLY APPRECIATE THAT, SIR. THANK YOU. THAT'S PASTOR KENNETH. ALL ABOUT JUDY WOODRUFF. ONE FIVE FOUR ANGELO ROAD, SE PALM BAY, KENNETH DELGADO. GOD BLESS YOU ALL, SO GOOD TO BE HERE. JUST WANTED TO READ JUST A LITTLE THOUGHT FROM JAMES CHAPTER THREE, SPEAKING ABOUT THE TONGUE AND HOW EVIL IT CAN BE. IT'S RESTLESS. IT COULD BE FULL OF POISON. BUT THEN IT SAYS WITH IT, WE BLESSED THE LORD, OUR GOD AND FATHER. AND WITH IT WE CURSE PEOPLE WHO ARE MADE IN THE LIKENESS OF GOD FROM THE SAME MOUTH, PROCEDES BLESSING, CURSING MY BROTHERS. THESE THINGS OUGHT NOT TO BE SO. IT'S A SHAME THAT PEOPLE WILL CALL US NAMES. A FACT THAT I'M RIGHT UP HERE ON THE PODIUM PROBABLY WILL CAUSE PEOPLE TO SPEAK BAD ABOUT ME TOO. AS PASTOR, I'VE BEEN THE BRUNT OF MANY FALSE ACCUSATIONS AND FACE STATEMENTS. AND SO ON OUR SIDE, I WOULD SAY YOU ARE MADE IN THE IMAGE OF GOD. YOU ARE GOD'S CHILDREN. AND AND SO WE DO BLESS YOU AND WE THANK GOD FOR YOU ALL. WE DO PRAY FOR YOU. AND IT OUGHT NOT BE SO, BUT WE'RE IN A WORLD IN WHICH THEY CAN SET NOT BE B-R AND THINGS. WE WISH WE SHOULD BE, ARE NOT, AND BUT I KNOW WE'RE ALL STRIVING TO MAKE THIS A BETTER PLACE, AND I JUST WANT TO THANK GOD FOR ALL OF YOU AND BLESS YOU AS CHILDREN OF GOD. WOULD HE BE FOLLOWED BY A FIELD, FRANCO? BUT AGAIN. WOODY WOODRUM, THAT'S WOODY WOODROW WOODRUM. THAWRA FRENKEL. ALL BY A MAN WHO ROSE FIVE FREE. GOOD EVENING, MR. MAYOR. CITY COUNCIL AND CITY STAFF JUST LET YOU KNOW I'M ITALIAN AND MY 30 SECONDS HERE WOULD PROBABLY BE TWO HOURS IF NOT FOR THIS. SO MY NAME IS FILTHY FRANCO. I LIVE A FIVE SEVEN ZERO TRUMANS STREET SOUTHWEST AND I AM THE CURRENT CHAIR OF THE RECREATION ADVISORY BOARD. VACANCIES ON BOARDS AND COMMITTEES NEED TO BE ADDRESSED IN A MORE PROACTIVE MANNER. MR. FOSTER. THAT WAS WRITTEN BEFORE I FOUND OUT YOUR APPOINTMENT, BUT IT GOES TO MORE THAN JUST THAT. WE HAVE THE THE BRIBE HAS GONE THREE MEETINGS IN A ROW, SHORT ONE MEMBER, AND EVERY ONE HAS MISSED A MEETING IN THE LAST THREE MEETINGS WE'VE BEEN WORKING WITH FOR FIVE AT THE MOST. THE VACANCY HAS CAUSED US NOT TO HAVE A QUORUM AT THIS LAST MEETING WHERE GUESTS WERE IN ATTENDANCE TO ADDRESS THE BOARD. I FELT VERY BAD FOR THE GUESTS WHO SHOWED UP. [01:40:01] THIS VACANCY IS NOW FILLED BY MR. FOSTER. I CHANGED AFTER I FOUND OUT. I WOULD LIKE TO PROPOSE AN IDEA TO BE CONSIDERED TO ALLEVIATE THIS CURRENT PROBLEM AND IN THE FUTURE. HERE'S MY IDEA AND I'LL GIVE YOU A COPY OF THIS WHEN I'M DONE. IF A COUNCIL MEMBER CANNOT FIND A REPLACEMENT FOR WHATEVER BOARD WITHIN 30 DAYS OF THE RESIGNATION OR DISMISSAL, THE CIRCUIT CITY CLERK WOULD GO BACK TO THE LAST ADD LARGE GROUP OF NOMINEES AND CONTACT THE HIGHEST RANKING NOMINEE WHO WAS NOT SELECTED FOR THE AT LARGE POSITION. IF THAT PERSON DOESN'T TAKE IT, THEN YOU GO IN DESCENDING ORDER OF THE PEOPLE IN THERE. FOR INSTANCE, WHEN I WAS. APPLYING FOR A JOB, THERE WERE SEVEN OF US. I WAS EITHER FIRST OR SECOND, ALONG WITH MR. GARVER. OK, THE SECOND IDEA IS IF MR. FOSTER GOING TO PICK ON YOU, IF YOU COULDN'T FIND SOMEBODY WITHIN 30 DAYS, YOU WOULD EXTEND AN INVITATION TO ONE OF THE OTHER MEMBERS, SAY, LISTEN, DO YOU HAVE SOMEBODY THAT CAN FILL THE VACANCY? OK, THE OTHER THING IS WE MUST DO A BETTER JOB IN ADVERTISING THESE POSITIONS. CAN YOU DO A GREAT JOB? EVERY MEETING? BUT IT WAS THIRTY SEVEN SECONDS. THIRTY SEVEN SECONDS TONIGHT WHEN YOU WENT THROUGH ALL THE OPEN BOARDS. NOW THERE IS A FEW PEOPLE HERE, BUT NOBODY KNOWS HOW TO REALLY DO THEM, SO THERE HAS TO BE A BETTER WAY. WE ALSO MUST GET BOARDS TO START HAVING MEETINGS. OK, THERE'S 12 BOARDS ARE DIRECTLY IMPACT CITY AND I'LL JUST GIVE AN EXAMPLE. THE BUILDING AND CONSTRUCTION HAS NOT HAD A MEETING IN OVER THREE YEARS, OK? THE YOUTH ADVISORY BOARD HAS NOT HAD A MEETING SINCE OCTOBER OF LAST YEAR. THIS IS YOU KNOW, IF PEOPLE CAN'T DEDICATE THEMSELVES NOW SUZANNE, I'LL TELL YOU, I'M CUCKOO FOR COCOA PUFFS WITH THINGS. BUT AS PART OF THE TIME THAT YOU'RE GOING TO TALK TO THESE PEOPLE, INTERVIEW THEM, TELL THEM WHAT THE JOB IS DONE, MAKE SURE THEY CAN MAKE THE MEETINGS. THANK YOU. THANK YOU. DID YOU WANT TO. DID YOU WANT TO PASS THAT ON TO US SO WE COULD. COUNCILMAN FOSTER YOU WANTED TO ADDRESS? YEAH, JUST PASS THAT, GIVE THAT TO US. WE'LL GET A COPY OF THAT. THANK YOU, MR. FRANCO. COUNCILMAN FOSTER. YES, MR. DE FRANCO. I DID RECEIVE EMAIL AND I KNEW ABOUT THAT VACANCY AND. IT'S A DIRECT APPOINTMENT, I'M GOING TO MAKE APPOINTMENT TONIGHT FOR THAT THAT SEAT, BUT I WAS TRYING TO FIND THE RIGHT PERSON. I TRIED TO PUT THE RIGHT PERSON TO BENEFIT SOMEONE WHO WANTS TO DEDICATE THEIR TIME. AND SOMETIMES IT'S VERY HARD. IT'S DIFFICULT. I DON'T WANT TO JUST PUT SOMEBODY JUST THE SAKE OF NAMING SOMEONE AND THEY DON'T DO A GOOD JOB. I APPRECIATE YOUR SERVICE TO THE RECREATION ADVISORY BOARD. THAT'S ONE OF THE FIRST BOARDS THAT I SERVED ON IN THE CITY. AND MY HEART IS DEAR TO THAT BOARD. SO I APOLOGIZE. IF I WAS LITTLE DELAY, I HAD PEOPLE IN MIND, BUT THEY BACKED OUT AT THE LAST SECOND. I GOT AN INDIVIDUAL GOING TO SERVE, SO I'M GOING TO STAY ON TOP OF IT. SO THANK YOU FOR YOUR SERVICE, SIR. THANK YOU, COUNCILMAN FOSTER ANY OTHER SPEAKERS? THOSE FRED ROSEN FREED. ALL RIGHT, MY NAME IS AMANDA ROSEN, FREED, 513 AUSTRALIAN AVENUE, NW, NEW TO TOWN. AND I HEARD TONIGHT THAT SCHOOL STARTS ON TUESDAY AND WE LIVE AUSTRALIAN TO AMERICANA, I, I HOME SCHOOL. BUT WE GO TO A CO-OP AND IN THE MORNING MY HUSBAND WILL CALL AND GENTLY COMPLAIN ABOUT THERE'S NO TURN SIGNAL AT MOUNTAIN ROAD TO GO LEFT OFF AMERICANA TOWARDS PALM BAY ROAD. AND SO ESPECIALLY WHEN SCHOOL STARTS. AND THERE'S CHRISTA MCAULIFFE, I THINK IS THE SCHOOL. HE LITERALLY WILL SIT THERE FOR TEN MINUTES BECAUSE TRAFFIC. THERE'S NO TURN LANE, THERE'S NO TURN LIGHT, THERE'S NO ARROW, THERE'S NO NOTHING. SO IT'S JUST TRAFFIC GOING THIS WAY, BUT NOTHING. THERE'S IT'S COMPLETELY BACKED-UP, SO I WOULD LIKE TO PROPOSE THERE BECOME A TURN SIGNAL, LIKE THE, YOU KNOW, THE ARROW, THE ARROW AT MINTERN AND AMERICANA AS YOU'RE TURNING NORTH TO PALM BAY ROAD, IT'S EXTREMELY DANGEROUS. THEY DID PUT IN CROSSWALK SIGNS FOR THOSE KIDS. I MEAN, THANKFULLY, THERE'S COPS THERE WHEN I'M COMING BACK FROM MY SCHOOL. AND IT'S JUST IT'S A NIGHTMARE OF A TRAFFIC SITUATION. [01:45:02] SO A TURN SIGNAL ERA WOULD BE PERFECT. THANK YOU. AND KIM ISRAELSEN FRIEDE. MADAM, MADAM SHERMAN. YES, SIR. I WILL HAVE PUBLIC WORKS REACH OUT TO BREVARD COUNTY. THAT PORTION OF MINTERN IS BREVARD COUNTY JURISDICTION. BUT WE WILL HAVE. AN OLD. THANK YOU. WE'RE AT THE PORTION OF PUBLIC HEARINGS AND ITEM NUMBER ONE, MADAM SMITH. [PUBLIC HEARINGS:] IS TWENTY TWENTY ONE, THAT'S FORTY NINE, AN ORDINANCE, THE CITY OF PALM BAY, BURAK COUNTY, FLORIDA, AMENDING THE CODE OF ORDINANCES, TITLE FIVE LEGISLATIVE AFTER 61, SUSPENSION AND OR REMOVAL OF CITY BOARD MEMBER BY INCLUDING PROVISIONS FOR ATTENDANCE BY BOARD MEMBERS PROVIDING FOR THE REPEAL ORDINANCES OR PARTS OF ORDINANCES AND CONFLICT HERE WITH VYING FOR INCLUSION IN THE CITY OF PALM BAY CODE OF ORDINANCES, WRITING FOR SEVERABILITY COSTS, PROVIDING FOR AN EFFECTIVE DATE. THANK YOU, MISS SMITH, I WOULD LIKE TO OPEN UP THE PUBLIC HEARING AND MRS. LEFLER, WOULD YOU LIKE TO PRESENT THIS REQUEST? YES, THIS IS JUST THE SECOND AND FINAL READING OF THE ORDINANCE, WHICH IMPLEMENTS PROVISIONS THAT BOARD MEMBERS MUST ATTEND. AT LEAST 50 PERCENT OF EACH MEETING IN ORDER TO BE COUNTED IS PRESENT. COPY THAT. ALSO, ANY QUESTIONS OF STAFF? THIS IS A VERY GOOD CONSIDERATION. BUT TO THAT DAY, WE CURRENTLY HAVE A NUMBER OF I BELIEVE WE DO I YOU MAY REMIND ME WHAT IT IS A NUMBER OF MEETING A BOARD MEMBER WAS WITHIN A CALENDAR YEAR TO MS. TO BE ABLE TO, YOU KNOW, REMOVE THEM FROM THE BOARD, FROM THE FROM THE BOARD. IT MAY IT MAY ACTUALLY DETERMINE THE BYLAWS MAY DETERMINE EACH BOARD, BUT IT'S TYPICALLY THREE CONCURRENT MEETINGS OR TYPICALLY FIVE WITHIN A YEAR PERIOD A YEAR, AND THREE CONCURRENT WITH THAT, OF COURSE, IS DEPENDING ON EACH BOARD'S BYLAWS. THE QUESTION IS, DO WE KNOW HOW ACCURATE THAT IS OR IS IT BEING FOLLOWED OR INDIVIDUAL BOARD OF REASON WHY? I'M SAYING THAT JUST RECENTLY, TO YOUR POINT, SIR, I'M VERY AWARE OF THE SITUATION WITH THE PARK AND RECREATION ADVISORY BOARD. AND NEEDLESS TO SAY, THAT THAT'S A BOARD F SERVE AS PROBABLY THE ONE OF THE LONGEST MEMBER SERVICE SERVING MEMBER ON THAT BOARD. I BY STANDARD CHARTERED, FOR A LONG TIME, I HAD FOUR MORE OF YOUR MEMBER. I HAD A VERY WE HAD THAT CONVERSATION THIS PAST WEEK. SO WE THIS IS CERTAINLY SOMETHING THAT WE NEED TO ADDRESS. AND I THINK IT'S IMPORTANT, HOWEVER, COUNSEL CAN CAN HELP AND SUPPORT. I THINK IT'S EXTREMELY IMPORTANT TO MAKE SURE WE HAVE WE HAVE THOSE BOARDS FOR ALL VERY GOOD REASON AND THEY HAVE THEIR USE. MANY OF THESE BOARDS COUNCIL DO COUNT ON THEIR HELP AND THEIR INPUT AS WE MAKE A ON THE ON THE DAY. SO WE ALL MAKE SURE THEY ARE FUNCTIONING TO PAT MYSELF ON THE BACK MAYOR. BUT CERTAINLY I MEAN, I THINK WE NEED TO BE WITH A CONSCIENCE EFFORT INTO HELPING STAFFING THOSE BOARDS, ESPECIALLY WHEN IT COMES TO OUR DIRECT APPOINTMENT, EVEN NOT, YOU KNOW, ENCOURAGE PEOPLE AT LARGE TO APPLY AND FIND A WAY TO BETTER ADVERTISE. AND THOSE ARE GREAT, GREAT IDEAS. BY THE WAY, THANK YOU SO MUCH. YOU KNOW, THE LAST FOUR MEMBERS. TO ADULTS AND TO YOU ON THE ON THE, YOU KNOW, YOUTH ADVISORY BOARD, THEY WERE MY DIRECT ONE OR THE OTHER, YOU KNOW, KIND OF COME ON WHEN WE NEED YOUR HELP. SO, YOU KNOW, IN FOUR OUT OF SEVEN MEMBERS. SO, YOU KNOW, THREE MORE SLOTS TO FILL, BUT BUT IF WE TRULY PUT THE EFFORT IN, I THINK WE CAN CERTAINLY HELP OUR STAFF AND HELP, YOU KNOW, THOSE BOARDS AND GET THEM NOT ONLY STAFFED AND OR SO. YEAH, BUT WE DO NEED TO ADDRESS MAY HAVE SOME SOMETHING TO DO WITH THE CHAIRS. THE CHAIRS OF THOSE BOARDS TO REALLY MAKE SURE THAT IF THERE'S PEOPLE THAT THAT'S NOT SHOWING UP OR WE WANT MAKE SURE WE FOLLOW AND MONITOR THOSE MR. GET THEM REPLACED AND I'M ALL FOR IT AND JUST GET THEM REPLACED. LET'S GET PEOPLE THAT ARE WILLING TO SERVE. I THINK THOSE IDEAS ARE GREAT. SO COUNCIL MS. [01:50:02] MS. LAFLEUR. WE SHOULD DEFINITELY TAKE A CONSIDERATION SO WE CAN IMPLEMENT THOSE IDEAS. THANK YOU, COUNCILMAN FELIX I DID. AS MS. LEFT FOR HOW WE CAN MOVE FORWARD, SO YOU MENTIONED THAT THIS WILL BE COMING BACK TO THE BOARD, THIS WOULD SEND US SOME INFORMATION ON HOW TO IMPLEMENT SOME OF THESE IDEAS. SO OUTSTANDING SUGGESTED COUNCILMAN FOSTER. DEPUTY MAYOR JOHNSON, I WAS JUST GOING TO MAKE A MOTION. I'LL TAKE I'LL TAKE A MOTION. I'LL MAKE A MOTION TO APPROVE OR IT'S TWENTY TWENTY ONE DASH. FORTY NINE. FINAL READING. I CAN HAVE A MOTION. MY DEPUTY MAYOR JOHNSON SECONDED BY COUNCILMAN FOSTER. ANY ADDITIONAL DISCUSSION? ALL IN FAVOR OF ANY OPPOSE, I PASSES UNANIMOUSLY, WE'RE ON TO UNFINISHED BUSINESS [UNFINISHED AND OLD BUSINESS:] AND I'M YIELDING TO DEPUTY MAYOR JOHNSON. THANK YOU, MAYOR. I MAKE A MOTION TO APPROVE DENNIS AMATO TO THAT LARGE STUDENT MEMBER POSITION FOR THE YOUTH ADVISORY BOARD. SHAGGIN. COUNCILWOMAN FOSTER YOU WANT TO YIELD TO A SECOND, OK, ON A MOTION BY DEPUTY MAYOR JOHNSON SINGING IT BY COUNCILMAN BAILEY. ANY FURTHER DISCUSSION? HEARING NONE ALL IN FAVOR, I MEAN, HE ALWAYS PASSES UNANIMOUSLY, WE'RE ON COMMITTEE AND [COUNCIL REPORTS:] COUNCIL REPORTS, COUNCILMAN, FELIX. THANK YOU, MAYOR. IT IS NINE O'CLOCK, THAT IS A GREAT THING. I TRULY HAD MY SLEEPING BAG IN THE CAR AND THAT'S TRULY I THINK IT'S GREAT HAVING, YOU KNOW, FOR SERVANT. WE ALL GOT OUR DIFFERENT IDEAS AND ALWAYS VIEW THINGS AND BUT IT'S GREAT THAT WE CAN COME TOGETHER AND MAKE DECISION TRULY THE BEST INTERESTS OF OUR CITY. I'M PRETTY SURE I'M A CITIZEN. OH, PLEASE. AND WE'LL GET TO GO HOME BEFORE MIDNIGHT TONIGHT. THANK YOU, MAYOR. THANK YOU. COUNCILMAN FELIX. COUNCILMAN FOSTER. I'M GOING TO BE POINTING FILLMORE TO THE RECREATION ADVISORY BOARD. THAT'S THE DIRECTOR. THAT'S ALL I HAVE. THANK YOU. COUNCILMAN FOSTER. COUNCILMAN BAILEY YOUR COMMENTS FOR YOUR LAST COUNCIL MEETING ON THE REPORTS. MAYOR, IF I MAY, CAN WE MOVE MINE TO THE VERY END? I THINK I MIGHT BE ABLE TO SNEAK IN AT THE END IF WE DO THAT AFTER THE KDAY. ABSOLUTELY, COUNCILMAN, BAILEY THAT THAT WOULD BE GREAT TO SEE YOU, DEPUTY MAYOR JOHNSON. NO REPORTS, SO ON THE MS. REPORTS, I JUST WANTED TO SAY I WAS AT THE TDC MEETING A WEEK AGO AND WE'VE GOT A GREAT REPORT WHEN IT COMES TO THOSE FINANCES. SO THEY WERE BUDGETING ON A 12 TO 14 MILLION DOLLAR BUDGET BECAUSE OF COVID. NOW THEY'RE ANTICIPATING MORE THAN 15 MILLION. AND THAT IS TAKEN INTO CONSIDERATION ALSO THAT OUR CRUISING INDUSTRY IS ABOUT TO COME IN. AND IT JUST STARTED FOR THIS MONTH. SO THOSE THINGS ARE VERY POSITIVE. AND I'M EXCITED ABOUT THOSE TOURIST DEVELOPMENT DOLLARS COMING IN. OF COURSE, WE ARE BENEFICIARIES OR I CAN GROUND AND I'M LOOKING TO GET DETAILS ON HOW WE'RE MOVING FORWARD WITH THAT COUNCIL BECAUSE WE WANT TO MAKE SURE THAT WE CAN ACTUALLY MAXIMIZE THOSE DOLLARS. AND THEN ONCE WE BUILD UP THAT CREDIBILITY RIGHT, WE'LL BE ABLE TO BE IN A GOOD POSITION FOR ADDITIONAL FUNDING IS HOW I BELIEVE. NOW, PART OF YOU, MANY OF YOU KNOW ME FROM BEFORE I SAT ON THIS. DYAS AND YOU KNOW HOW PASSIONATE I AM ABOUT BRINGING TOURISTS INTO OUR COMMUNITY, BRINGING OUR BUSINESSES INTO OUR COMMUNITY. AND PART OF THAT IS MY PASSION FOR BOXING AND PROFESSIONAL BOXING. WE HAVEN'T HAD PROFESSIONAL BOXING HERE FOR QUITE SOME TIME, BUT THE AMOUNT OF MONEY THAT THAT CAN GENERATE, WE'RE MARKETING THE CITY OF PALM BAY SO MANY LATIN AMERICAN COUNTRIES. [01:55:05] THIS IS WHAT I'M PASSIONATE ABOUT. I REMEMBER THERE WAS A GENTLEMAN FROM COLOMBIA THAT WAS WATCHING TELEMUNDO DEPORTES BOXING. AND I'LL SAY THAT AGAIN, TELEMUNDO, THEY PUT THIS BOXING AND HE KNEW A FRIEND OF SOMEONE THAT LIVED IN PALM BAY AND SAY, I SAW PALM BAY ON THE MAP ON TV IN TELEMUNDO, MEANING THE LATIN AMERICAN COMMUNITY OF BOXING IS BIG FOR LATIN AMERICANS AND ALL OF THE UNITED STATES. BUT JUST WANTED TO GIVE THAT FREEDOM OF THOUGHT TO THE TOURIST DEVELOPMENT COUNCIL AND HOW WE COULD MAXIMIZE THOSE THOSE DOLLARS TO TO BRING PALM BAY INTO THE GLOBAL MARKETING STRATEGY. YES, SIR. AND THAT ALSO GOES COUNCILMAN FOSTER WITH YOUR SISTER CITY INITIATIVE. AND THAT THAT'S WHAT THIS IS ALL ABOUT. SO, YES, SIR, I THINK ME YOU'RE ON THE SAME PAGE WITH THAT, SIR. BUT WHEN YOU GO BACK AGAIN, CAN YOU YOU KNOW, WE DID THAT BIKE TRAIL. YES, SIR. DID YOU TRY TO GET THEM TO PROMOTE THAT TO THE TOURIST DEVELOPMENT? SO I'M GLAD YOU PEOPLE HERE. THAT'S A GREAT POINT. THEY'RE STRATEGICALLY MARKETING EVERY SECTION OF THE SPACE COAST, SO THEY'LL THEY'LL SHOW KAYAKING AND THOSE THINGS IN PALM BAY. SO SPACE COAST AT PALM BAY AND THOSE ADVERTISING DOLLARS, I DON'T KNOW IF YOU'VE SEEN IT, BUT THEY'RE ON TV TODAY. SO IT HAS IDENTIFIED FOUR YEARS. THERE'S ALWAYS BEEN THIS SEPARATION OF THE NORTH AND AND SO ON, SO THAT WHAT THEY'VE DONE IS THEY'VE IDENTIFIED THAT DISPARITY AND THEY'RE ACTUALLY TARGETING COCOA BEACH, CITY OF PALM BAY, MELBOURNE AND TITUSVILLE ALL THROUGHOUT. IT'S PART OF THE SPACE COAST SEE MARKETING SCHEME. BUT YES, THAT'S AN EXCELLENT POINT. COUNCILMAN FOSTER. THANK YOU. THAT'S IT. COUNCILMAN BAILEY ARE YOU NEAR BECAUSE WE'RE ON. WE'RE UP TO YOU NOW. HE ACTUALLY JUST EMAILED, SAID HE'S OFF THE PHONE BUT WILL BE HERE IN JUST A MOMENT. PRAISE THE LORD. ANY, ANY. ANY, ANY. WE CAN DO NEW BUSINESS, THIS AFFECTS I TURNED UP ON ME. DID YOU SIGN UP FOR COMMENT? WE WERE KEEPING A RUNNING LIST FOR THE ELECTIONS, IS THAT THE ITEM? YEAH, THAT WAS WITHDRAWN. WE WITHDREW THAT ITEM. WE WILL YEAH, THERE'LL BE AN OPPORTUNITY FOR YOU TO SPEAK, THERE'LL BE ANOTHER PUBLIC COMMENT AT THE END OF THE MEETING, CLOSER TO THE END OF THE MEETING. YES, SIR. YOU STILL HAVE AN OPPORTUNITY TO SPEAK. SO WE'LL GO TO NEW BUSINESS ITEM ONE. [NEW BUSINESS:] THANK YOU, MAYOR. SO WE'RE GLAD TO BRING TO YOU THE. CULMINATION OF MULTIPLE MONTHS OF STAFF WORKING VERY CLOSELY WITH THE CITY ATTORNEY'S OFFICE AND THE EMERALD LAKE OR EMERALD INVESTMENT HOLDINGS LLC TO BRING FORTH THE VERY FIRST MASTER SETTLEMENT AGREEMENT OR IMROTH LAKES DEVELOPMENT, WHICH, AS WE KNOW, IS A VERY LARGE, SIGNIFICANT DEVELOPMENT IN THE SOUTH PART OF THE CITY, THE VICINITY OF THE NEW ST. JOHN TERESE PARKWAY IN THE NEW 95 INTERCHANGE UNDER THE APPLICANT IS HERE AND I SUSPECT HE WANTS TO SAY A FEW WORDS. BUT JUST TO QUICKLY TEE THIS UP, IT IS A 20 YEAR DEVELOPMENT AGREEMENT BECAUSE IT'S THE SIZE OF THE PROJECT IS SUCH THAT WE EXPECT THIS TO BE A LONG KIND OF LONG TERM PROJECT IN MULTIPLE PHASES. THE AGREEMENT PROVIDES A LOT OF DEVELOPMENT STANDARDS AND OBLIGATIONS RELATING TO INFRASTRUCTURE AND PUBLIC IMPROVEMENTS TO INCLUDE ROADS, TRANSPORTATION, STORMWATER AND UTILITIES, AS WELL AS PUBLIC FACILITIES SUCH AS PARKS AND PUBLIC SAFETY. BUT YOU'LL FIND IN THE AGREEMENT, BECAUSE IT IS THE M. OVERARCHING AGREEMENT, THE VAST MAJORITY OF THOSE ITEMS GO OUT OF THE WAY TO REFERENCE WHICH THE ORDINANCES WILL APPLY TO THOSE SPECIFIC SCENARIOS AS THEY COME IN THE FUTURE. AND THERE ARE DEFINITELY SOME COMMITMENTS THAT ARE LISTED OUT THERE FROM THE DEVELOPER. BUT I WOULD IF COUNCIL INDULGE ME, ALLOW THE DEVELOPER ACTUALLY TO COME UP AND SPEAK, BECAUSE I KNOW THIS IS A BIG DAY FOR MR. PAUL PELUSI AS WELL. SO ABSOLUTELY. MR. PELUSI, PLEASE STEP FORWARD. THANK YOU ALL, PELUSI REPRESENTING EMERALD INVESTMENT HOLDINGS ADDRESS 24 02 VICTORY GARDENS LANE IN TAMPA, FLORIDA. THANKS FOR LETTING US PRESENT TONIGHT AND THANKS SO MUCH TO THE CITY STAFF FOR ALL THE [02:00:03] EFFORT THAT'S BEEN PUT FORTH OVER QUITE A LONG PERIOD OF TIME. I THOUGHT IT WAS IRONIC. WE DISTILLED ALL THE THINGS THAT WE ARE FOCUSING ON FOR THE FUTURE AND TO A 15 PAGE DEVELOPMENT AGREEMENT, WHICH HAPPENS TO BE THE SAME NUMBER OF YEARS THAT WE'VE BEEN WORKING AT THIS. IT WAS 15 YEARS AGO IN JANUARY THAT WE SPENT OUR FIRST INVESTMENT IN PALM BAY TOWARDS THE EFFORTS OF GETTING THE INTERCHANGE APPROVED. SO IT'S BEEN A LONG TIME COMING AND WE'RE EXCITED ABOUT THE FUTURE. ALMOST DONE, WE HOPE, BE IN FRONT OF YOU WITHIN THE NEXT 30 DAYS WITH OUR UTILITY AGREEMENT TO FINISH UP OUR STATE PERMITS AND AND GET MOVING AND BREAKING GROUND. SO TO DO THAT, WE NEED YOUR SUPPORT AND ASK FOR YOUR SUPPORT ON THE DEVELOPMENT AGREEMENT THAT'S IN FRONT OF YOU TODAY. AND THAT CERTAINLY HAPPY TO ANSWER ANY QUESTIONS OR ADDRESS ANY COMMENT. THANK YOU, COUNSEL. ANY QUESTIONS? THANK YOU, MISS FALU, THANK YOU. MR. BOBETTE. GILBERTON, 586 OCEAN SPRAY STREET SOUTHWEST. EMERALD LAKES IS A MAJESTIC DEVELOPMENT. THEY WOULD HAVE THEM HAVE MUCH MORE SUPPORT FOR ME IF THERE WAS NOT SUCH A STRONG TIE TO THE ST. JOHN'S HERITAGE PARKWAY SOUTH AND THE DETRIMENT THAT ENDED UP COSTING THE CITY DEVELOPMENT IS DOING GREAT. I'M WISHING THEM THE BEST OF LUCK. BUT THOSE WHO KNOW ME KNOW THAT THE ENTIRE DEVELOPMENT AREA HAS ALWAYS BEEN A SORE SPOT WITH ME. THAT BEING SAID, EMERALD LAKES IS A DOMESTIC. MAJESTIC. MASS PRODUCTION IS GOING TO BE GREAT IF IT EVER COMES TO LIGHT. I HAVE TWO ITEMS WITH THAT TO ADDRESS, ITEM NUMBER ONE. THAT BEING SAID, S. FIFTEEN POINT ONE SIX, I THINK IT'S ON PAGE THREE, 68. THERE IS NO ASSURANCE THAT THE THAT THE DEVELOPMENT WILL ACTUALLY COME COME TO FRUITION OR COMPLETION, AND IF YOU DON'T THINK THAT'S POSSIBLE, THAT THEY'RE NOT POSSIBLE TO FAIL, I WANT YOU TO TAKE A LOOK AT THE FACT THAT GDC, THE COMPOUND, A MAJOR DEVELOPMENT THAT FAILED BAYSIDE LAKES AS MAJOR DEVELOPMENTS INSIDE THAT DEVELOPMENT AREA. IT IS NOTHING BUT PAVED ROADS. AND STILL SIX VAGG SITS VACANT ROADS PUT IN WITH NO MORE DEVELOPMENT. IN FACT, SOME OF THE SAME NAMES ON THOSE CONTRACTS ARE STILL BEING BROUGHT UP IN CONTRACTS IN THE CITY OF PALM BAY. TO THIS DAY, I HOPE THIS IS NOT THE FATE OF EMERALD CITY. I MEAN, EMERALD LAKES. THAT'S HOW LONG I'VE BEEN PLAYING WITH THIS. IT'S EVEN GONE THROUGH TO NAME CHANGE. AND I'VE BEEN DOING THIS WITH MR. POLO'S ITEM NUMBER TWO ON THEIR CONSERVATION LAND. AND THE TRAILS ARE THESE CONSERVATION LANDS AND TRAILS ARE GOING TO BE OPEN TO THE PUBLIC OR IS IT RESTRICTED TO THE RESIDENTS OF THE CD? ONLY BECAUSE THERE'S A LOT OF LAND MASS AND THERE WAS A LOT OF LAND TRANSFER IN ORDER TO ACCOMPLISH THAT FOR ACCOMPLISHMENT THAT I DON'T THINK THE CITIZEN SHOULD BE DEPRIVED OF. SO IT IS EITHER OPEN TO THE PUBLIC OR NOT. THANK YOU VERY MUCH. AND I DO WISH EMERALD LIKES THE BEST IN THIS. THANK YOU. THANK YOU. MASTER CHIEF. M. SHERMAN, IF I CAN CLARIFY WITH MR BATTEN, I MS. THE REFERENCE IN THE FIRST POINT WHICH SECTION? WELL, AS FAR AS THE DIVORCE AGREEMENT, I BELIEVE THE EXCEPTION THEY ARE SAYING YOUR POINT NOW IS AND THEY SAID THERE ARE THERE IS A SECTION IN THE DEVELOPMENT AGREEMENT AS FAR AS COMPLIANCE AND THERE ARE. WHICH IS. PARAGRAPH 11 IN THE DEVELOPER AGREEMENT, AND THERE IS ALSO PARAGRAPH 18 THAT ADDRESSES NONPERFORMANCE. AND THE OPEN TO THE PUBLIC. I WOULD ACTUALLY ASK THE DEVELOPER TO SPEAK TO THAT. THANKS FOR WELL WISHES, BILL, APPRECIATE IT. AND YES, THE ALL THE PRESERVATION AREA WITH THE NUMBER OF LAKES IS GOING TO BE ROUGHLY 700 ACRES WILL BE OPEN TO THE GENERAL PUBLIC. WE LOOK FORWARD TO THEM COMING OUT AND ENJOYING WHAT WE'RE CREATING, IN PARTICULAR THE LAGOON, RIGHT? YES, THAT'S RIGHT. [02:05:03] THANK YOU. THANK YOU. THANK YOU. COUNCILMAN, I NEED A MOTION. MOTION TO APPROVE THE EMRAH LAKE'S MASSIVE DEVELOPMENT AGREEMENT AND AUTHORIZE MAYOR MEDINA TO EXECUTE THE AGREEMENT. MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN FELIX. ANY FURTHER DISCUSSION, GENTLEMEN? NONE. ALL IN FAVOR OF PASSES, UNANIMOUS OR PASSES FOUR TO ONE OR FOUR TO ZERO. OR ZERO, WE'RE AT AT THIS POINT, WE'VE GOT ADMINISTRATIVE COME ON IN, COUNCILMAN, BAILEY. SO WE'RE ON THE ADMINISTRATIVE AND I KNOW YOU'VE BEEN ON THE ROAD ALL THIS TIME, MAYBE YOU MIGHT WANT TO DRINK SOME WATER. SIR, WE'RE WE'RE ON ADMINISTRATIVE, MADAM SHERMAN ANY ANY REPORTS? NOTHING FURTHER. MAYOR, THANK YOU. ADAM SMITH. NO, SIR. SO I WANTED TO TAKE THIS OPPORTUNITY TO. [PROCLAMATION: (Part 2 of 2)] THE PROVIDER, WE HAVE A PLAQUE FOR YOU AND WE WE WANTED TO SURPRISE YOU THERE IN PROCLAMATION'S, BUT YOU HAD TO GET CAUGHT UP IN TRAFFIC. BUT ANYWAY, YOU KNOW, YOU'VE HEARD MY COMMENTS, OUR HEARTFELT COMMENTS ON YOUR DEDICATED SERVICE TO THE CITY OF PALM BAY. AND ON BEHALF OF THE ONE HUNDRED TWENTY THOUSAND RESIDENTS, I COMMEND YOU FOR YOUR SERVICE. AND I THANK YOU. AND I WISH YOU GODSPEED. I'M GRATEFUL FOR WHAT YOU'VE DONE. AS A CITIZEN, AS A PALM BAY FOR OVER THIRTY THREE YEARS, I'M GRATEFUL FOR YOUR SACRIFICE. I'M GRATEFUL TO LEARN ON YOU SACRIFICING ANYTHING ELSE. PAM. WE CAN ALL LEARN FROM THAT. I WANTED TO ALSO JOIN ME IN CONGRATULATING COUNCILMAN BAILEY IN HIS IN HIS FUTURE ENDEAVORS. THAT'S EXTENDED TO JEFFREY ALAN BAILEY, YOU KNOW, I WOULD CALL. IN APPRECIATION AND RECOGNITION OF YOUR OUTSTANDING PUBLIC SERVICE TO THE COMMUNITY AS AN ELECTED OFFICIAL CITY COUNCIL. WE CAN BET YOU NEVER SEEN A COUNCIL MEMBER LEAVE ON THIS. THANK YOU, MR.. WELL, YOU DON'T A COUPLE OF MONTHS FOR. WELL, ARE YOU WANT TO GIVE IT UP ON THE DICE? JUST ONE MORE TIME, I GET TO TALK FROM THEIR. OH, THANK YOU, MAYOR, THANK YOU FOR THE SPIRIT OF BRINGING THE COUNCIL AND THE REST OF COUNCILMAN. THANK YOU ALL AS WELL FOR YOUR REFLECTIONS. AND I LOOK FORWARD TO NOW, HOPEFULLY NOW THAT I WON'T BE VOTING ON ANYTHING WITH YOU. IF YOU GUYS WANT TO TALK, YOU CAN ALWAYS TALK BY PHONE. AND WE CAN NOW TALK ABOUT SOME OF THE THINGS AND THINGS GOING FORWARD. BUT I JUST I JUST KNOW THAT, YOU KNOW, I'VE SEEN COUNCILMAN, FELIX KIND OF STEPPING UP ON SOME THINGS. AND OBVIOUSLY THE DEPUTY MAYOR HAS STEPPED UP AND RISEN TO HIS POSITION. WHAT'S GOING ON? AND I KNOW EVERYBODY, EVERYBODY HERE IS GROWING. AND I THINK THAT'S A GREAT THING TO KEEP IN MIND, THAT WE HAVE TO KEEP OUR OUR EYES ON THE BALL, ON BIG CONTRACTS, ON BIG DEVELOPMENTS, THINGS OF THAT NATURE. [02:10:04] THANKFULLY, WE HAVE PEOPLE LIKE MR. BATTAN THAT ARE WATCHING, AND I THINK THERE'S OTHER FOLKS THAT KEEP GETTING INVOLVED. SO RANDALL'S OUT HERE TONIGHT IS GOOD TO SEE. I DIDN'T HEAR YOU FROM THE PODIUM, BUT GOOD TO SEE YOU. AND I KNOW THOSE OTHER FOLKS, TOO. IT'S BEEN A REAL HONOR AND PRIVILEGE TO SIT IN THE SEAT. AND YOU'RE RIGHT, MAYORS, SOMETIMES IT'S HARD TO DO THIS JOB AND IT DOESN'T MATTER WHO YOU ARE, WHETHER WE DISAGREE, AGREE, SOMETIMES IT'S HARD TO DO IT WITHOUT IT TAKES SOME SACRIFICE AWAY FROM THE FAMILY. SO IS IT'S HARD IS TO WALK AWAY FROM HERE. YOU KNOW, IT'S SOMETHING THAT NEEDED TO BE DONE, I THINK, FOR MY FAMILY. AND WE'RE SO EXCITED. YOU KNOW, A MONTH AGO WHENEVER I ANNOUNCED THIS, THAT WAS PROBABLY THE HARDEST THING. I LIKE THAT I DID NOT WANT TO COME IN. I JUST DIDN'T WANT TO SHOW MY FACE. I WANT TO LEAVE BECAUSE I WAS JUST SO SAD ABOUT LEAVING. I CAN TELL, YOU KNOW, GOD BLESSES. HE'S BEEN BLESSING US. IT SEEMS LIKE THINGS JUST KEEP FALLING INTO PLACE ALONG THE PATH. AND SO WE'RE JUST GOING TO KEEP TAKING STEPS FORWARD. AND IT SEEMS LIKE IT'S THE RIGHT DIRECTION. AND I CAN TELL YOU THAT NOW THE FAMILY'S SUPER HAPPY AND EXCITED OR WHERE WE'RE MOVING TO IN ALABAMA, BEING CLOSE TO MY MY MOTHER AND GRANDMA AND THE KIDS ALL GOING TO GRANDMA'S FARM AND PLAYING WITH THE SHE PLAYING WITH THE DOGS AND OTHER THINGS LIKE THAT. SO IT'S IT'S IMPORTANT. AND IT WAS SOMETHING THAT AND THAT WAS PART OF THE LIFESTYLE THAT WE WANTED. AND WE'RE VERY EXCITED THAT I THINK MY IN-LAWS WHO ARE HERE IN PALM BAY ARE ALSO LOOKING TO TRANSITION WITH US AND THEY'RE GOING TO BE IN THE PROCESS BEHIND US AND TO HAVE EVEN MORE OF OUR FAMILY TOGETHER. THOSE WERE THOSE WHAT, YOU KNOW, THE COVID REALLY BROUGHT ABOUT. I THINK EVERYBODY IS LOOKING AT THINGS DIFFERENTLY. AND THESE THINGS BECAME VERY APPARENT TO US AND IT WAS HARD TO OBTAIN THAT UNLESS MR. AND GIVE ME A GREAT DEAL ON HIS HIS PIECE OF PROPERTY. I CAN'T FIND IT HERE. OK, IT HAS TO BE A GREAT DEAL SO I CAN AFFORD IT. BUT BUT THAT BEING SAID, YOU KNOW, EVERYTHING IS GOING WELL. AND SO NOW WE'RE VERY EXCITED. NOW I'M OVER THAT HUMP EXCITED. I THOUGHT I WAS GOING TO YOU KNOW, THOSE WOULD BE A LITTLE BIT HARD TO BE HERE TONIGHT. THINGS NO SAY A FEW PARTING WORDS TO TO EVERYBODY. BUT I JUST REALLY APPRECIATE EVERYBODY. I AM GOING TO BE HOPEFULLY SPREADING AROUND SOME SOME LAST MINUTE NOTES AND GOODBYES IN THE MORNING AND PROBABLY OVER THE NEXT COUPLE OF DAYS UP UNTIL THE 10TH, WHERE I PUT MY RESIGNATION BECAUSE I WANT TO MAKE SURE I HAD TIME TO KIND OF SAY THOSE THINGS AND LET PEOPLE KNOW, EXPRESS HOW I FEEL, BECAUSE I THINK THAT'S ONE OF THE THINGS THAT I WAS SO LOOKING TO BE WATCHED ON, LOOKING FOR THINGS THAT I FORGOT TO RECOGNIZE, THOSE PEOPLE THAT WORK HERE. AND AND ALTHOUGH SOMETIMES I DID AND SOME THERE CERTAIN PEOPLE HAD WE HAD DIFFERENT RELATIONSHIPS, OBVIOUSLY WOULD DEPEND ON WHO THE PERSON IS. BUT IN THE END, I WAS LIKE I THAT'S ONE OF THE THINGS I WISH I COULD HAVE DONE MORE. AND I WANT TO KIND OF LEAVE A LITTLE BIT OF A BANG AS FAR AS THAT GOES AND LEAD SOME PEOPLE SOME SOME NOTES. AND WHAT MY WHAT MY HEART NOW, AS YOU SAY, IS WHAT'S WHAT'S ON MY HEART. I JUST PRAY FOR THE CITY THAT GOD WILL BLESS. PALM BAY I'M LOOKING FORWARD TO COMING BACK. I'M LOOKING FORWARD TO COMING BACK TO EMERALD LAKES TO TO VACATION THERE. AND NOW HOPEFULLY YOU GUYS GET THAT DONE QUICKLY SO I CAN COME QUICKLY AND DO THAT. AND I'M SURE THE KIDS WILL LOVE IT. AND SO THAT'S THAT'S WHAT I'M LOOKING FORWARD TO IN THE FUTURE. AND STILL BEING PART OF THIS TOWN, WE'RE STILL GOING TO HAVE FAMILY HERE. AND I'M SURE WE'RE STILL GOING TO BE COMING BACK AND VISITING AND HOPEFULLY SEEING SOME OF YOUR STOPPING BY AND SEEING SOME OF YOUR FACES ALONG THE WAY. BUT PLEASE DO I'D LOVE TO HAVE A CONVERSATION WITH ANY OF YOU GUYS. AND I KNOW AND JUST SO YOU KNOW, I REALLY DO LOVE ALL YOU GUYS. I'VE NEVER HAD ANY WILL WITH ANYBODY UP HERE. NO WIN OR LOSE ON AN ISSUE DEBATING BACK AND FORTH IF I CAN GET PASSIONATE AND HARDHEADED ON ISSUES. BUT I REALLY DO CARE ABOUT ALL OF YOU IN THE CITY, THE STAFF AND THE PEOPLE THAT LIVE HERE. STILL STANDING COUNCILMAN BILLION. I HEARD YOU MENTION SHEEP AND ALL OF THAT, BUT YOU DIDN'T MENTION CHICKENS, AND I KNOW YOU FAVOR CHICKENS. WELL, I THINK WELL SEE THAT'S SEE, THAT'S THE BEAUTY OF HAVING FAMILY TOGETHER IS THAT WEEK. THAT'S SOMETHING WE CAN IMPLEMENT AND WE CAN TRADE OFF DUTIES THAT WAY BECAUSE WE'RE NOT IN THE SAME SAME PLACE. WE CAN TRADE OFF DUTIES AND TRADE OUR STUFF. SO AND BY THE WAY, SHE'S GOT A BEAUTIFUL LITTLE PUPPY. OK, SO LET ME TELL A STORY REAL QUICK. MY MOM GOT MY MOM. SHE NEED A SHEEPDOG. SO SHE PICKED UP A SHEEP DOG. SHE WAS TOLD BY THE FRIENDS IN THE CHURCH WHO GAVE HER TO THE DOG THAT NOW SHE JUST LET THEM IN THE PASTURE AND DON'T PET THEM. DON'T JUST LET THEM INTEGRATE WITH THE SHEEP. I'M LIKE, OK. I MEAN, IT SOUNDS A LITTLE HARSH, BUT A LITTLE BIT DIFFICULT. BUT I WAS LIKE, OK, THAT'S WHAT SHE'S GOING TO DO. MY MOM NOW, SHE'S JUST HOW SHE IS. I EXPECT HER TO DO IT. OF COURSE, SHE GOT THE PUPPY. NOW SHE'S FEEDING THE PUP EVERY DAY. SHE SAID, I CAN'T GO OUT THERE AND FEED THE PUPPY THAT PETTING IT. AND THEN, OF COURSE, NOW THE KIDS ARE OUT THERE AND THE KIDS ARE RUNNING AROUND PLAYING WITH THEM LIKE IT'S OVER. SHEPHERDS, SHEPHERDS, DOMESTICATED. AT THIS POINT, IT'S ALL OVER FROM HERE. SO I'M FEELING WELL. WE'RE REALLY FOND OF YOU, SIR, AND WE REALLY WISH YOU THE BEST. GODSPEED. THAT'S EVIDENT IN YOUR LIFE. THANK YOU. THANKS FOR BEING A GOOD INFLUENCE ON EACH AND EVERY MEMBER ON COUNCILMAN. SO WE'RE UP TO PUBLIC COMMENTS AGAIN, MAYOR. [02:15:01] YES, I APOLOGIZE, I GOT SO EXCITED TO SEE COUNCILMAN BAILEY THAT I FORGOT I DID ACTUALLY [ADMINISTRATIVE AND LEGAL REPORTS:] NEED TO MAKE AN ANNOUNCEMENT. COPY THAT, MA'AM. WHAT WOULD WE'RE GOING BACK TO YOUR REPORT. YES, SIR. THANK YOU. HONORABLE MAYOR AND MEMBERS OF CITY COUNCIL. I NEED TO SEEK YOUR ADVICE CONCERNING THE FOLLOWING LITIGATION MATTERS PURSUANT TO SECTION TWO EIGHTY SIX POINT ZERO ONE ONE, SUBSECTION EIGHT OR STATUTES. DAVID MATTHEW VS. CITY OF PALM BAY CASE NUMBER ZERO FIVE WHEN HE C A ZERO FOUR SIX FIVE THREE SEVEN AND BRINDA BURGO PALONE VS. CITY OF PALM BAY CASE NUMBER ZERO FIVE TWENTY TWENTY ONE C A ZERO THREE THREE SIX SIX FIVE HAVE COORDINATED A TIME WHEN COUNCILMAN IS AVAILABLE TUESDAY, AUGUST 17TH. TWENTY TWENTY ONE AT 6:00 P.M.. THE MEETING SHOULD TAKE APPROXIMATELY ONE HOUR. ATTENDEES WILL BE MAYOR AND CITY COUNCIL CITY MANAGER SUZANNE SHERMAN, ASSISTANT CITY ATTORNEY RODNEY EDWARDS AND CITY ATTORNEY PATRICIA SMITH. THANK YOU. THANK YOU, MA'AM. WE'RE ON PUBLIC COMMENTS. [PUBLIC COMMENTS/RESPONSES:] I HAVE NO CARS, BUT THE GENTLEMAN WHO WANTED TO FILL OUT A CARD AFTER SIR. YOU COULD JUST FILL OUT A CARD OR YOUR OK, PERFECT. OK, AFTER FOLLOWING MR. BILL, FOLLOWED BY PAST THE KINDERGARTEN, FOLLOWED BY FIELD OF FRANCO. ALL OF OUR RENTAL, CHESKY. HELLO, MY NAME IS GARY CHANEY, BEING A CITIZEN AND PALM BAY FOR 20 YEARS HOLIDAY SPEYSIDE LIKES. THE ELECTION'S BEEN REALLY DIFFICULT FOR ME IN THE PAST YEAR, NOVEMBER 2ND. I HAD HERE NOVEMBER THE 4TH. I DIDN'T. IT'S BEEN VERY DIFFICULT, BUT IT'S BEEN A BLESSING. YOU KNOW, I'VE SEEN THINGS IN THIS COUNTRY THAT I DIDN'T KNOW EXISTED. CORRUPTION, AND NOW IT'S OUT IN THE OPEN, AND RECENTLY THERE'S A REPORT FROM SETH CASHEL ABOUT HE DID THE AUDIT FOR ARIZONA, WHICH EVERYBODY'S WATCHING RIGHT NOW, AND IT'S A STATISTICAL. ANALYSIS OF VOTER ROLLS, REGISTRATIONS, AND, YOU KNOW, THESE VOTES MATCH UP. AND HE FOUND IN FLORIDA. YOU KNOW, BROWARD, PALM BEACH PROBLEMS, BROWARD OR BOVARD WAS ON THE LIST AS ONE OF THE BIGGEST ISSUES IN HIS REPORT. AND IT SHOCKED ME. YOU KNOW, THIS IS WHERE I'VE LIVED FOR 20 YEARS AND HE'S SAYING THE VOTER REGISTRATIONS, REPUBLICANS GET SO MANY DEMOCRATS, IT DOESN'T ADD UP. AND SO THERE'S A GRASSROOTS MOVEMENT STARTING NOW ON TELEGRAM, AND I'D LIKE TO. NAME THAT. IT'S. OR THE FIRST IT ON TELEGRAM. AND IT'S A BUNCH OF CITIZENS GETTING TOGETHER TO START FIGURING OUT GRASSROOTS START UP IN THE STATE OF FLORIDA AND AND GET TO THE BOTTOM OF THIS FRAUD THAT MAY HAVE HAPPENED. AND IT'S ALL, YOU KNOW, ON THE BOOTS ON THE GROUND, CITIZENS GETTING INVOLVED. AND I JUST WANTED TO MAKE A STATEMENT ON THE RECORD FOR THAT. I WAS JUST REALLY SURPRISED THAT THE COUNTY I LIVE IN FOR 20 YEARS WAS NOT GOOD. THANKS. HAVE YOU REACHED OUT TO THE SUPERVISOR OF ELECTIONS? HAVE YOU REACHED OUT TO THE SUPERVISOR OF. FIRST, EARTHIER. HERBET. Q IS TO GO BACK AND FOLLOW, I PASSED THE KINDERGARTEN. MILVERTON 586 OCEAN SPRAY STREET SOUTHWEST. THE RIGHT TO VOTE IS SOMETHING. WITHOUT THAT, WE ARE NO LONGER THE UNITED STATES OF AMERICA. WE'RE SOME OTHER COUNTRY, AND I'M NOT I'M NOT ABOUT TO GIVE UP MY RIGHT TO VOTE, EVEN IF IT'S FOR A SHORT PERIOD OF TIME. BUT WITH THAT BEING SAID, WHEN I HEAR COUNCIL MEMBERS TALKING ABOUT WHAT THE COST OF A SPECIAL ELECTION IS GOING TO BE ON OR NICKEL AND DIMING THAT, I KNOW IT'S A LOT OF MONEY BECAUSE, YOU KNOW, I WATCH IT CLOSELY. BUT FOR SOMETHING SO IMPORTANT, IT'S NOT A TANGIBLE ITEM YOU CAN HOLD IN YOUR HAND, IT'S [02:20:04] NOT SOMETHING YOU CAN WALK ON AND PAVE AND MAU MAU WITH A MORE. BUT THAT RIGHT TO VOTE FOR YOUR ELECTED OFFICIALS IS MORE IMPORTANT THAN ANY TANGIBLE ITEM THAT DETERIORATES IN 10 YEARS. AND YOU BUILD A NEW ONE, LIKE HAVE A LITTLE SHED THAT WE'RE JUST GETTING READY TO BUILD FOR THIRTY NINE THOUSAND DOLLARS IF DETERIORATE. THAT'S NOT WHAT THE RIGHT TO VOTE IS. SO WHEN I HEAR PEOPLE SAYING, WELL, WE DON'T KNOW ABOUT THE COST, SO I'M GOING TO SAVE YOU TWO HUNDRED THOUSAND DOLLARS, BILL. WELL, WE WASTED TWO HUNDRED AND TWO HUNDRED THOUSAND DOLLARS FOR A DEVELOPER TONIGHT THAT WOULD HAVE PAID FOR THE ELECTION. IN SPECIAL ASSESSMENTS THAT WERE GIVEN TO THAT, PEOPLE DON'T HAVE TO PAY, THAT COMES OFF THE BACK, THE TAXPAYERS FOR STORMWATER ASSESSMENT, THAT WAS TWO HUNDRED AND SEVENTY THOUSAND DOLLARS THAT YOU ASKED THE TAXPAYERS TO PAY. SO NOBODY ELSE DID. BUT YOU'RE GOING TO SAVE ME THE MONEY ON A VOTE. NO, THANK YOU, I'D RATHER PAY THE MONEY, GET THE RIGHT TO VOTE, DON'T TAKE MY RIGHT AWAY TO VOTE. OK. NEXT ITEM ON A SECOND ITEM WAS WHEN YOU'RE TALKING ABOUT THE TOURIST ATTRACTIONS COMING INTO PALM BAY AND IT FOR THE ADVERTISING FOR THAT. ONE MORE TIME, I'LL BRING THIS UP, THE CITY OF PALM BAY HAS THE LARGEST LAND MASS OF ALL THE CITIES IN CENTRAL FLORIDA, YET WE DON'T HAVE A SINGLE HORSE TRAIL. IN THIS CITY, WE HAVE TO GO TO OTHER CITIES TO RIDE YOUR HORSES. WE HAVE BIKE TRAILS THAT GO FOR 50, 60 MILES, AND THEY EVEN CROSS WHAT TRAILS THAT GO IN TO OTHER TO OTHER CITIES. WE DON'T HAVE ANY OF THAT IN THE CITY OF PALM BAY. I JUST WANT TO BRING THAT UP ONE MORE TIME BECAUSE I KNOW A LOT OF HORSE PEOPLE IN HERE AND THEY'D LOVE TO BE ABLE TO RIDE THEIR HORSE IN THEIR HOMETOWN. THANK YOU VERY MUCH. AND I DO KNOW WHAT THE JOB IS UP THERE BECAUSE I DID PUT MY NAME IN FOR IT. LUCKILY, I DON'T HAVE TO DO IT. THANK YOU VERY MUCH. THANK YOU. THAT'S THE KINDERGARTEN FOLLOWED BY FELDA FRANCO KINDERGARTEN, ONE FOR ANGELA ROAD, SOUTH, EAST AND BAILEY, CONGRATULATIONS. WE REALLY APPRECIATE YOU. CORETTA SCOTT KING'S STRUGGLE IS A NEVER ENDING PROCESS. FREEDOM IS NEVER REALLY WON. YOU EARN IT AND WIN IT IN EVERY GENERATION. COUNCILMAN JOHNSON. THANK YOU FOR FIGHTING FOR FREEDOM. I THANK YOU THAT WE DID NOT CANCEL VOTER. WE DID NOT HAVE VOTER SUPPRESSION OR CANCEL CULTURE BECAUSE YOU HEARD ONE HUNDRED PEOPLE LAST MEETING SAY DO NOT CHANGE IT. I'M THANKFUL THAT YOU LISTENED TO THE TWO HUNDRED THAT WERE OUTSIDE AND DID NOT CAUSE VOTER SUPPRESSION WHEN THEY SAID DON'T CHANGE THE ORDINANCE. I WANT TO THANK YOU BECAUSE YOU LISTEN TO THE ALMOST 100 PERCENT OF THE PEOPLE WHO CALLED YOU AND EMAILED YOU AND SAID, DON'T CHANGE WHAT THE PEOPLE ASKED FOR. I THANK YOU FOR LISTENING, LISTENING AND HEARING, BECAUSE IN 2012, WHEN 63 PERCENT VOTED TO MAKE IT AN ORDINANCE, THEY SAID THE ORDINANCE THAT WE WANT WAS A YEAR FEEL FREE, MORE THAN A YEAR IT'S OURS. YOU DIDN'T SUPPRESS THE VOTERS OF 63 PERCENT WHO VOTED FOR THAT ORDINANCE AS IS NOT CHANGED. I THANK YOU BECAUSE I'M THIRTY SEVEN WHO VOTED AGAINST MAKING IT AN ORDINANCE STILL SAID DON'T CHANGE IT AND THEREFORE YOU STOPPED VOTER SUPPRESSION. I WANT TO THANK YOU, MR. COUNCILMAN JOHNSON, BECAUSE INDEED IT WAS SAID THAT WE NEEDED MORE BRAINS TO MAKE DECISIONS FOR FINANCES. AND RIGHT HERE WE HAVE BRAYNE, BILL BATTEN. WE DON'T NEED ANY MORE BRAINS AND PLUS WE HAVE THE CENTRAL GURUS IN OUR CITY. THANK YOU FOR LISTENING. I WANT TO THANK YOU BECAUSE IT WAS SUGGESTED A TWO TWO DEADLOCK WOULD HAPPEN. WHAT WOULD STOP BUSINESS TODAY IF WE WERE TO TAKE MR. BAILEY OUT, EVERYTHING WOULD HAVE PASSED ANYWAY. IT WAS A FIGMENT FOR ME. IT WAS MIRRORS AND A LOT OF SMOKE, BUT NOTHING REALLY THAT WOULD BE TRUE. MATTER OF FACT, THAT SAME DAY, OTHER THAN TAXES, OTHER THAN TAXES, EVERYTHING WOULD HAVE PASSED. IT WAS SAID THAT WE SHOULD LOOK AT THE HIGHER LEVEL. YOU SAID THAT. AND I THANK GOD THAT YOU DID LISTEN TO THE HIGHER LEVEL. LET ME TELL YOU WHAT. THE HIGHER LEVEL, IN MY VIEW, IS, NUMBER ONE, THE HIGHER LEVEL OF A GOOD NAME OF PALM BAY. IT SAYS IT'S BETTER TO HAVE A GOOD NAME, THEN BE THEN RATHER HAVE GREAT RICHES, MONEY CANNOT BUY A GOOD NAME. THE HIGHER LEVEL OF ALL THINGS MAY BE LAWFUL, BUT ALL THINGS ARE NOT PROFITABLE. IT WOULD NOT HAVE BEEN PROFITABLE TO DO THAT. [02:25:02] HOW ABOUT THE HIGHER LEVEL OF AVOIDING ALL APPEARANCE OF EVIL? THESE ARE INTANGIBLE REALITIES THAT THERE'S NO PRICE THAT YOU CAN PAY FOR. I THANK YOU FOR LISTENING AND FOR CHANGING YOUR POSITION. I WANT TO HONOR YOU SPECIFICALLY TODAY FOR YOUR DECISION TO ELIMINATE THAT ORDINANCE. GOD BLESS YOU AND THANK YOU, COUNCILMAN. I THINK YOU MAY RESPOND TO THAT. COUNCILMAN BAILEY. YEAH. AND I'LL JOIN YOU IN THAT. I APPRECIATE THAT. NO, COUNCIL MEMBER DID YOU HERE THE PUBLIC WHAT I'VE HEARD FROM THE PUBLIC WAS UNANIMOUS AGAINST THAT. IT'S JUST I THINK IT'S BAD TIMING. BUT AND I THINK THE I THINK THE CREDIT THAT PASTOR DELGADO JUST GAVE TO THE DEPUTY MAYOR IS APPROPRIATE. BUT I ALSO THINK THAT SOMETHING THAT KIND OF IN THE MIDST OF EVERYTHING THAT GOT OVERLOOKED IS THE CREDIT I THINK IS THOUGH, DUE TO COUNCILMAN FELIX ON THIS ISSUE, BECAUSE WITHOUT COUNCILMAN FELIX SUPPORT AT THE FIRST READING, IT WOULD HAVE BEEN A FULL OUT APPOINTMENT FOR THE WHOLE TIME WITH NO ELECTION. SO I THINK THAT THAT WAS HIGHLY OVERLOOKED. THAT WAS A VERY CRUCIAL MOMENT IN ALL THIS. AND MATTER OF FACT, YOU WOULD NOT HAD TODAY'S WITHDRAWAL OF THE SECOND READING WITHOUT THAT HAPPENING FIRST. I DON'T BELIEVE SO. I JUST WANT TO THANK COUNCILMAN FELIX. I KNOW A LOT OF FOLKS WHO CAME OUT WERE MY SUPPORTERS TOO, AND I WANT TO COMMUNICATE TO THEM THAT AND THOSE ARE STILL LISTENING THAT THAT THAT MOMENT HAPPENED. WHERE WERE MR.? FELIX WAS A CRUCIAL VOTE ON THIS PARTICULAR ISSUE THAT DOESN'T TAKE AWAY FROM THE ARGUMENTS OF THOSE WHO FEEL OTHERWISE AND VOTED OTHERWISE. BUT I JUST WANNA MAKE SURE I RECOGNIZE YOU AND I APPRECIATE IT. THE FRANCOPHILIA CONCLUDED BY RENTAL HOUSING AFFORDABILITY. FRANCO FIVE SEVEN ZERO TRUMANS STREET SOUTHWEST. JUST GET BACK TO THE BOARDS AND COMMITTEES. I COULDN'T FIT THIS INTO MY FIRST THREE MINUTES. IT'S GOING TO BE VERY SIMPLE. WE HAVE 18 BOARDS OR COMMITTEES IN THE CITY, 12 OF WHICH DIRECTLY IMPACT WHAT'S GOING ON IN THE CITY. I'LL GIVE YOU ONE THAT DOESN'T THE POLICE AND FIREMEN'S PENSION FUND COMMITTEE. THAT'S NOT SOMETHING THAT I'M SURE IT IMPACTS US, BUT THAT'S ALL I'M TALKING ABOUT IS LIKE THE RECREATION BOARD. THERE'S A SECTION IN AIR FOR REPORT, YOU ALL GIVE YOUR REPORTS FOR YOUR SEPARATE THINGS. MY THOUGHT IS THERE'S ONE THAT I FEEL ARE THE MOST IMPORTANT. BREAK THEM UP, THE GROUPS ARE TWO, TWO GROUPS OF SIX. THE FIRST MEETING OF THE MONTH GROUP GOES. THEY GET THREE MINUTES OR FIVE MINUTES, WHATEVER YOU WISH. IF YOU WANT FIVE ONLY, TAKE A HALF HOUR. TELL THEM WHAT'S GOING ON, OK? IF THE CHAIRMAN OF THE BOARD CAN'T DO IT, IN MY CASE, I HAVE FRATER TROYES. TELL ME WHAT'S GOING ON. PEOPLE EMAIL ME WHAT'S GOING ON WITH THE PLAYGROUND'S. THEY'VE BEEN CLOSED FOR THREE MONTHS. IF PEOPLE WATCH THIS AND NOT ALL, YOU KNOW, TODAY, FRIDAY, SUNDAY, IF THE PERSON CAME UP AND SAID, I WANT TO GIVE YOU AN UPDATE ON THE PLAYGROUND, THIS IS WHAT WE'RE LOOKING TO DO, GIVE THEM FIVE MINUTES. IT'S GOING TO GO OUT TO ALL THE PEOPLE. THERE'S NOT EVEN SIGNS THAT I BROUGHT THIS UP WITH FRED AND SUZANNE AND A FEW OTHER PEOPLE THAT SAY, HEY, LISTEN. THE CITIES APPROVED THE MONEY FOR THE PLAYGROUNDS, WE ANTICIPATE HAVING A FINAL DATE OF WHATEVER, NOVEMBER 1ST AND BY DECEMBER 1ST, A PLAYGROUND SHOULD BE IN IN PLACE FOR YOUR ENJOYMENT. THEY DID GO AROUND TO THE LOCAL PEOPLE AND PUT LITTLE HANGERS ON THE DOOR AND ASK THEM, BUT THEY ONLY WENT AROUND TO LIKE 100 PEOPLE, OK? WHEN MY GRANDKIDS LIVED HERE, I WAS IN SOUTHEAST. I WANT TO BUILD MADDEN PARK. IT WAS LIKE A TEN MINUTE RIDE FROM WHERE I LIVED. SO YOU DIDN'T TALK TO THOSE PEOPLE AND THOSE PEOPLE WERE PART OF THE GROUP. SO IF EACH OF THE 12 ADULTS FOLLOW THIS UP WITH AN EMAIL TO EVERYBODY. ONCE A MONTH GAVE A FIVE MINUTE. UPDATE ON WHAT THEIR COMMITTEE IS DOING OR THEIR BOARDS ARE DOING OR WHATEVER IT MIGHT BE LIKE WE HAD LAST WEEK, THE LADY THAT TALKED ABOUT THE CITIZENS BUDGET ADVISORY COMMITTEE, I LEARNED STUFF FROM HER THAT I PROBABLY WOULDN'T HAVE KNOWN IF SHE DIDN'T COME UP AND GIVE A REPORT. SO MY SUGGESTION IS TWO GROUPS OF SIX, FIVE MINUTES EACH ONCE A MONTH, AND PEOPLE CAN WATCH IT THREE OR FOUR TIMES ON TV. COME HERE OR WATCH IT LIVE. THAT'S IT. THANK YOU. THANK YOU. RANDAL CHAYEFSKY. GOOD EVENING, COUNCIL RANDALL SHAMSKY THREE FOUR EIGHT BRAKHAGE STREET NE. I JUST LIKE TO LEAD WITH A LITTLE BIT OF GRATITUDE. [02:30:01] I FIRMLY BELIEVE THAT WHEN YOU LEAD YOUR LIFE WITH GRATITUDE, WHEN YOU LIVE WITH LIGHT, AND WHEN YOU LEAD IT WITH LOVE, YOU CAN'T GO WRONG. AND I HAVE GRATITUDE TO THIS COUNCIL AS A WHOLE. BUT I DO HAVE TO SPECIFICALLY TALK TO YOU. DEPUTY MAYOR JOHNSON, THANK YOU, SIR, FOR SEEING THE LIGHT. THANK YOU, SIR, FOR SEEING THE LOVE OF THE CITIZENS OF THIS CITY FOR THEIR RIGHTS. AND THANK YOU FOR WHAT YOU DID TO BRING IT UP. BUT WHEN YOU BROUGHT IT UP, IT HAD TO BE ACTED UPON BY THE REST OF THE COUNCIL AND THANK YOU, COUNCIL, FOR HAVING A SPIRITED DEBATE, TALKING ABOUT THE ISSUE AND FOR WITHDRAWING THE ISSUE AS SUCH. AND I KNOW YOU GUYS WILL WORK OUT THE SEMANTICS OF THE CHANGES THAT DO NEED TO TAKE DO THAT. NO PROBLEM. BUT THANK YOU FOR WHAT YOU DID. THANK YOU FOR WHAT YOU DID THE FIRST TIME THAT I EVER GOT UP ON THIS THIS PODIUM AND SPOKE TO YOU GUYS. I POSED THE QUESTION TO YOU AND THE QUESTION WAS THE TITLE OF DR. MARTIN LUTHER KING'S LAST NOVEL THAT HE WAS ABLE TO WRITE BEFORE HE WAS ASSASSINATED IN 1967. AND THE TITLE OF THAT NOVEL IS WHERE DO WE GO FROM HERE? SUBTITLE CHAOS OR COMMUNITY. AND IF YOU LOOK IN THE RECENT WEEK, THE CHAOS THAT'S GONE ON IN BREVARD COUNTY FROM PEOPLE NOT FEELING HURT WHEN YOU LOOK AT THE SCHOOL BOARD MEETING THAT OCCURRED LAST WEEK BECAUSE YOU YOU ALL KNOW WHAT WAS GOING ON THERE AND HOW PEOPLE FELT UNHEARD AND HOW PEOPLE FELT BY THAT BODY, I WAS WORRIED THAT I WAS COMING TO CHAOS TODAY. I THINK EVERYBODY ELSE WAS WORRIED. THE CITY DID A GREAT JOB OF SETTING UP INFRASTRUCTURE, HAVING EXTRA OFFICERS, HAVING EVERYTHING ON HAND. BUT LO AND BEHOLD, THE COUNCIL AS A WHOLE CHOSE COMMUNITY. I'VE SEEN THAT IN THE PAST. I'VE SEEN THAT FROM OUR POLICE CHIEF CHOOSING COMMUNITY WHEN IT COMES TO THESE SOCIAL JUSTICE ISSUES THAT WE HEAR. I'VE SEEN OUR MAYOR SPEAK TO CHOOSING COMMUNITY AND OTHER ISSUES. AND TONIGHT I HEARD THE COUNCIL CHOOSE COMMUNITY. AND I'M SO PROUD TO BE HERE IN THE CITY OF PALM BAY. AND I WANT TO ELABORATE ON SOMETHING THAT MR. BAILEY SAID ABOUT SETTING UP HIS HIS INNER CIRCLE, IF YOU WILL, UP IN ALABAMA. AND GOOD FOR YOU, COUNCILMAN BAILEY. GOOD FOR YOU FOR DOING THAT. AND I SHARE WITH YOU GUYS THAT THAT'S EXACTLY WHAT I AM DOING. RANDALL OLSZEWSKI CHOSE TO DO THAT BECAUSE OF COVID, BECAUSE I EVALUATED MY LIFE. AND THREE YEARS AGO WHEN I MADE THE DECISION TO TAKE MY FAMILY AWAY FROM THIS GREAT CITY, IT WAS THE HARDEST THING THAT I DID. BUT I WAS FORTUNATE ENOUGH TO BE ABLE TO COME BACK. AND SINCE I'VE BEEN BACK, NOT ONLY DO I JOIN MY GRANDPARENTS WHO HAVE BEEN HERE FOR THE TWENTY FIVE YEARS OF THEIR RETIREMENT, AND THEY'RE STILL TICKIN AT THEIR UPPER 80S, I'VE NOW BEEN ABLE TO MOVE MY PARENTS BACK FROM THE STATE OF WASHINGTON JUST THIS PAST JANUARY. I'M WORKING HARD ON MY SISTER. I GOT THE WHOLE THING GOING ON AND THIS IS MY PLACE. THIS IS MY CIRCLE. SO I APPRECIATE IT. I ONLY HAVE 30 SECONDS LEFT, SO I'M GOING TO MAKE MY COMPLAINTS BRIEF. REPUBLIC REPUBLIC AND THEN THE RECREATION ADVISORY BOARD SITUATION. I APPLIED FOR RECREATION ADVISORY AT LARGE POSITION TO THIS COUNCIL. I EXPLAINED IN THAT IN THAT APPLICATION THE PASSION THAT I HAVE FOR RECREATION AND THE YOUTH. AND I WANTED TO CONTRIBUTE TO THAT, TO TO HEAR THAT THAT THAT ADVISORY BOARD IS HAVING SO MUCH TROUBLE, WHETHER IT'S WITH QUORUM OR ATTENDEES OR BOARD MEMBERS. AND SOMEONE LIKE ME HAS ALREADY EXPLAINED TO YOU AS A WHOLE THAT I WANT TO HELP SCOTT. IT'S OFF-PUTTING FOR ME, BUT MR. SHERMAN, PLEASE TALK TO ME ABOUT REPUBLIK. THANK YOU. THANK YOU. IS THERE ANYONE ELSE THAT WISHES TO ADDRESS THIS COUNCIL AND SPEAK? SO, YOU KNOW, THIS MEETING CAN ADDRESS AND REAL QUICK, WHENEVER I SAID I SAID BIG CONTRACTS REPUBLIC. JUST KEEP THAT MIND. REPUBLIC IS THE LARGEST CONTRACT IN THE HISTORY OF PALM BAY, THE LARGEST SINGLE CONTRACT IN HISTORY PALM BAY BY FAR. SO KEEPING A CLOSE EYE ON THAT. I KNOW I WAS HAVING MANY INTENSE MEETINGS WITH WITH OUR STAFF ABOUT IT, BUT HOPEFULLY YOU GUYS, SOMEBODY KIND OF TAKES UP THAT AND SAYS, WHAT ARE THEY DOING OVER THERE? BECAUSE WE EXPERIENCED WASTE MANAGEMENT. I THINK THAT IF WE HAD NIPPED IN THE BUD EARLY WITH THE LAST CONTRACT, THINGS PALM BAY WOULD HAVE FELT A LITTLE BIT DIFFERENTLY. AND THAT'S WHAT I WAS ATTEMPTING TO DO WITH MS., SHERMAN AND OTHERS. AND HOPEFULLY YOU GUYS CARE THAT THEY DON'T. IS THERE ANYONE ELSE THAT WISHES TO SPEAK STEP FORWARD? THEY GINNANE. THEY CAN WAIT 13 ONE SEABURY STREET SOUTHWEST. I WILL NOT TAKE MY THREE MINUTES BECAUSE I JUST WANT TO SAY. COUNCILMAN BAILEY FIGHTING TO SAVE THE CITY OF PALM BAY MONEY TO THE LAST SECOND OF YOUR LAST MEETING. THANK YOU FOR YOUR SERVICE TO THE CITY. THANK YOU ALL TO. THIS MEETING IS ADJOURNED. * This transcript was compiled from uncorrected Closed Captioning.
