AND WHEREAS A LIFEGUARD BLEW THE LONG WHISTLE SIGNAL, WHICH ALERTED EVERYONE THAT AN EMERGENCY WAS IN PROGRESS IN THE POOL.
DOVE INTO THE POOL TO PUT A TUBE UNDERNEATH THE VICTIM GUIDED HIM TO THE EDGE OF THE POOL, WHERE ANOTHER LIFEGUARD PLACED A BACKBOARD UNDER HIM AND REMOVE THE VICTIM FROM THE POOL.
EMERGENCY RESPONDERS RESPONDERS WERE ALERTED.
WANT YOU TO TAKE A MOMENT AND NOTICE HOW EVERYONE PLAYED A ROLE? IT WAS A TEAMWORK APPROACH, WHEREAS THE LIFEGUARDS, TRAINED PERSONNEL AND EMERGENCY RESPONDERS TAKING IMMEDIATE ACTION AND THE EFFECTIVE USE OF THE LIFESAVING TECHNIQUES RESULTED IN SAVING THE LIFE OF THE SWIMMER.

WE WERE OUT HERE IN JANUARY WITH THE ENTIRE TEAM FROM ARNOLD PALMER, TRAINING TRAINING WITH FIRE RESCUE SPEND, AN AFTERNOON GOING THROUGH SIMULATIONS AND WHATNOT.
AND THIS IS GREAT THAT WE SEE SOME OF THE WORK THAT WE PUT IN THERE.
THIS IS REALLY NEAR AND DEAR TO ME.
I WAS A LIFEGUARD, I WAS A SWIM TEAM MEMBER.
I ACTUALLY AM IN MEDICINE BECAUSE OF THAT.
SO YOU HAD TO BE AN EMT TO DRIVE THE BOAT AND BE ON THE TRUCK AS THE L.A.
COUNTY LIFEGUARD. SO THAT'S HOW I GOT STARTED.
WE REALLY RECOGNIZE THAT THEY TOOK WHAT THEY WERE TRAINED TO DO AND TOOK SOMEONE.
AND WHEN WE RECEIVED THE SHOT, WE DIDN'T KNOW IF THIS WAS A CARDIAC OR DROWN A TRAUMA WHATNOT. BUT EVERYBODY DID THE RIGHT THING.

AND WHEREAS LIGHTS ON AFTER SCHOOL, THE NATIONAL CELEBRATION OF AFTER SCHOOL PROGRAMS BEING HELD THIS YEAR ON OCTOBER 28TH PROMOTES THE IMPORTANCE OF QUALITY AFTER SCHOOL PROGRAMS IN THE LIVES OF OUR CHILDREN AND THE LIVES OF OUR FAMILIES AND IN OUR COMMUNITIES. THERE IS A SAFETY, HEALTH AND ENVIRONMENTAL CONCERN, AND THE OWNER MAY VOLUNTARILY SATISFY THE LIEN AT ANY TIME, TYPICALLY SATISFIED IF ATTEMPTING TO SELL LIENS ARE RECORDED FOR A PERIOD OF 10 YEARS AND MAY BE RERECORDED FOR ANOTHER PERIOD OF 10 YEARS NOT TO EXCEED A TOTAL OF 20.
HOMESTEAD PROTECTION IS PROVIDED TO ANYONE WHO HAS A LEGAL OR EQUITABLE TITLE.

WE ARE GETTING CALLS WEEKLY ON IT AND UNFORTUNATELY OUR HANDS HAVE BEEN TIED.
SO THIS IS A PROCESS THAT THE CITY ATTORNEY'S OFFICE HAS LOOKED INTO AND IS NOW PROCEEDING. WHEN STRUCTURES ARE DEEMED UNFIT FOR OCCUPANCY, UNSAFE OR UNSECURED, A DEMOLITION AND CLEARANCE PROGRAM WOULD ALLOW THE CITY TO ADDRESS THESE PROPERTIES.
AND THIS IS A PROGRAM THAT NANCY IS GOING TO SPEAK ON BEHALF OF FROM THE COMMUNITY ECONOMIC DEVELOPMENT.
THE CERTAIN FUNDING SOURCES THAT WE HAVE PROPOSED WOULD BE TO FOR CODE COMPLIANCE DIVISION MAINTAINS THE NUISANCE VIOLATION FUND FOR WHICH REVENUES ARE DERIVED FROM FINES AND LEADS ON PROPERTIES.
FUNDS CAN BE USED FOR THE PURPOSE OF PAYING CONTRACTORS FOR SERVICES ON NUISANCE PROPERTIES. THERE ARE ALSO CIRCUMSTANCES WHERE CODE WORKS AND COORDINATES WITH PUBLIC WORKS DEPARTMENT FOR USE OF EQUIPMENT AND STAFF TO MINIMIZE COST OF AN OUTSIDE VENDOR, I.E. TRASH DEBRIS REMOVAL AND IN TURN, THE RECYCLABLE MATERIAL GENERATES MONEY BACK INTO THE GENERAL FUND.
HERE IS ANOTHER SCENARIO OF A NON HOMESTEAD PROPERTY THAT HAS TALL GRASS AND WEEDS.
THESE ARE VERY COMMON IN PALM BAY, AND THE PROPERTY OWNER AGAIN FAILS TO BRING THE PROPERTY INTO COMPLIANCE.
A SUPERIOR LIEN, SUCH AS A MORTGAGE, WILL PREVENT LIEN FORECLOSURE.
THE CITY, IN TURN, HIRES A CONTRACTOR TO MOW THE PROPERTY THAT BRINGS IT BACK INTO COMPLIANCE. ALEENA IS PLACED BACK ON THE PROPERTY, AND THE TIMELINE FROM THE INITIAL DATE OF COMPLAINT TO THE DATE WHICH A CONTRACTOR MOWS THE PROPERTY IS APPROXIMATELY THREE TO SIX MONTHS, DEPENDING ON IF WE GET COMPLIANCE FROM THE OWNER, AND IF NOT, WE TURN OVER TO THE CONTRACTOR. THE LEAN AMOUNT IS NOT LESS THAN THE AMOUNT TO ABATE OR BRING THE PROPERTY INTO COMPLIANCE.
IN SCENARIO THREE, WE HAVE, AGAIN, ANOTHER HOMESTEAD PROPERTY, THIS ONE HAPPENS TO BE A BURNT STRUCTURE THAT IS DEEMED UNINHABITABLE.
PROPERTY OWNER AGAIN FAILS TO BRING THE PROPERTY INTO COMPLIANCE.

STAFF IS PROPOSING TO BRING FORTH GUIDELINES AND FOR THE DEMOLITION AND CLEARANCE PROGRAM IN A PREVIOUS JURISDICTION I WORKED IN, WE HAD SIMILAR PROGRAM AND DEMOLISHED ABOUT APPROXIMATELY ONE HUNDRED AND TWENTY STRUCTURES.
THEY COULD BE RESIDENTIAL OR COMMERCIAL.
THEY HAVE TO BE NON HOMESTEADED VACANT FOR AT LEAST THREE MONTHS.
WE USE COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS.
CURRENTLY, THE CITY OF PALM BAY HAS $200000 ALLOCATED FOR A DEMOLITION PROGRAM, SO WE COULD USE THOSE FUNDS ONCE WE, IF COUNCIL'S DESIRE IS TO BRING FORTH THIS PROGRAM ONCE THOSE GUIDELINES ARE APPROVED.
WE WOULD BE ABLE TO START INITIATING DEMOLITION.
SO ONE OF THE, OF COURSE, WITH THE COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS, THEY'RE FEDERAL FUNDS AND ONE ONE OF THE REQUIREMENTS IS THAT THE UNIT ACTUALLY BE VACANT FOR AT LEAST THREE MONTHS.
AND THE REASON FOR BEING THAT IS THAT THERE IS A UNIFORM RELOCATION ACT AND THE UIA WOULD KICK IN. SO BUT NOT TO WORRY BECAUSE THE TIME FRAME WANTS THE BUILDING OFFICIAL POSTS IT, THERE IS A REQUIREMENT TO GIVE THE PROPERTY OWNER NOTICE.
THEY CAN EITHER APPEAL TO THE CODE BOARD OR THEY CAN FIX THE PROPERTY.
AND SO IF THEY DO NEITHER, THEN THE BUILDING OFFICIAL CAN DEEM IT READY FOR DEMOLITION.
SO JUST WANTED TO PROVIDE YOU SOME OF THE SCENARIOS FOR UNINHABITABLE STRUCTURES.
I WON'T READ ALL OF THEM, BUT BASICALLY THAT IF IT'S CAUGHT ON FIRE, IT WAS PARTIALLY CONSTRUCTED, IT'S LEFT ABANDONED.
ALSO, THE THE BUILDING COULD BE USED FOR DRUGS AND NUISANCES, AND SO IT COULD BE POSTED BY THE BUILDING OFFICIAL IF IT WAS UNOCCUPIED.
I MEAN, IF IT WAS UNSAFE, IT WAS OPEN.
SO AND THEN VACANT, UNGUARDED AND OPEN AT DOORS, WINDOWS AND MUST HAVE THREE OF THOSE CRITERIAS. SO THAT WOULD HELP IF THERE IS ILLEGAL ACTIVITY GOING ON IN THE STRUCTURE THAT WOULD ALLOW THE BUILDING OFFICIAL TO DEMOLISH.
SO AS I MENTIONED THE PROPERTIES, WOULD IT BE IDENTIFIED BY CODE COMPLIANCE POLICE DEPARTMENT OR THE BUILDING DEPARTMENT, AND THEY MUST BE UNINHABITABLE BY CHAPTER SIX, DASH EIGHT FIVE AND CHAPTER NINETY SEVEN POINT FIFTEEN.
AND THEY WILL BE CONDEMNED BY THE BILL IN THE OFFICIAL CHAPTER SIX DASH EIGHT OH FIVE DEFINES THE UNSAFE STRUCTURES THAT THE BUILDING OFFICIAL WOULD DEEM IT ELIGIBLE FOR DEMOLITION. SO AS I MENTIONED EARLIER, OF COURSE, THE PROPERTY OWNER MAY APPEAL TO THE BUILDING OFFICIAL, HE WILL GIVE IT TO THE BUILDING OFFICIAL, WHICH WILL TURN IT OVER TO CODE. ENFORCEMENT AND CODE ENFORCEMENT HAS SEVERAL OPTIONS TO DEEM TO GO FORWARD WITH THE DEMOLITION. THEY CAN GIVE AN EXTENSION OF TIME, OR THEY CAN JUST ALLOW THEM TO FIX IT UP.
SO UPON COMPLETION OF THE DEMOLITION, THERE'LL BE A LIEN PLACED ON THE PROPERTY THAT WILL BE FOR THE COSTS.
WE WOULD HIRE AN OUTSIDE CONTRACTOR TO DEMOLISH THE PROPERTY, AND THAT LIEN WILL BE PLACED ON THE PROPERTY CERTIFIED BY THE BUILDING OFFICIAL.
AND THEN WITH AFTER 90 DAYS, THE CITY COULD FORECLOSE ON THE PROPERTY IF THEY WISH TO.
SO IF AT COUNCIL'S DIRECTION, YOU WOULD LIKE STAFF TO BRING FORTH AN AGENDA ITEM OUTLINING THAT SPECIFIC DEMOLITION AND CLEARANCE PROGRAM POLICIES AND PROCEDURES, WE WOULD CERTAINLY DO THAT.

TAKE YOUR SEAT AND THEN BE TOLD THAT YOUR COMMENTS ARE RIDICULOUS AND NOT HAVE A CHANCE TO SAY ANYTHING BACK TO THAT, WHICH I DON'T BELIEVE IS APPROPRIATE.
SO I BELIEVE WE SHOULD REMEMBER THE PUBLIC RESPONSE ASPECT TO THESE SEGMENTS AND RECOGNIZE THE IMPORTANCE TO THAT.
