MAYOR COUNCIL MEMBERS.

DIRECTORS OF DIFFERENT DEPARTMENTS, OUR HEARTFELT THANKS.

FOR WHAT YOU EMPOWERED US AND PARTNER WITH TO DO.

THIS WAS WITHOUT.

COMPARISON. THE BEST CHRISTMAS EXTRAVAGANZA THAT WE'VE EVER HAD.

CHURCHES COMING TOGETHER, BUSINESSMEN COMING TOGETHER, VOLUNTEERS MAKING EVERYTHING FLOW FLAWLESSLY, BUT IT COULD NOT HAVE BEEN DONE WITHOUT THE SUPPORT AND THE HELP OF THE CITY

[00:05:02]

OF PALM BAY. WE HERE STAND THANKING YOU FOR WHAT YOU HAVE DONE AND HOW YOU EMPOWERED US TO, TO TOUCH THE HEARTS AND BRING JOY TO THE CITIZENS OF THE PALM BAY.

FROM WHAT I UNDERSTAND, ACCORDING TO YOUR REPORTS, THE FEEDBACK I GOT.

THEY SAID MAYBE OVER 15000 PEOPLE CAME.

I DON'T KNOW HOW ACCURATE THAT IS.

I CAN SAY IT WAS THE LARGEST CROWD THAT WE'VE EVER SEEN, AND MORE AND MORE PEOPLE ARE HELPING. MORE AND MORE PEOPLE ARE CONTRIBUTING.

MORE AND MORE PEOPLE ARE SAYING THE CITY OF PALM BAY IS A PLACE WHERE THE FAMILY CAN GROW AND YOU ALL WERE PARTNERS.

AND SO YOU ALL TOUCHED THE LIVES OF THE PEOPLE THAT CAME TO THE CHRISTMAS EXTRAVAGANZA.

AND AND SO WE HERE STAND.

THIS IS JUST A SMALL GROUP, BUT EVERY CHURCH THAT WAS A PART OF IT SAY THANK YOU.

THANK YOU FOR WHAT YOU'RE DOING.

THANK YOU FOR LEADING.

THANK YOU FOR HELPING.

THANK YOU FOR MAKING A DIFFERENCE IN PEOPLE'S LIVES.

PEOPLE LEFT HAPPY.

AMEN. AND SO WE DO HAVE A SMALL WAY OF AN EXPRESSION BECAUSE EVERYTHING THAT WE DID WAS F R W E FREE.

AND AND WE ALWAYS HAD THIS STATEMENT THAT THERE'S ALWAYS MORE AND THERE IS MORE.

AND SO IN THIS MORE, WE ARE IN OUR EFFORT TO TO REALIZE THAT WE WE ARE PARTNERING WITH YOU IN THE CITY OF PALM BAY ALSO AND THAT WE SUPPORT YOU.

WE BROUGHT GIFTS.

WE WOULD CALL IT THE THREE KINGS GIFTS AT THIS POINT BECAUSE CHRISTMAS IS OVER.

SO IT'S THE THREE KINGS AND WE WOULD LIKE TO THANK.

BY CALLING UP THE REPRESENTATIVE OF THE PALM BAY PARKS AND RECREATION, THE PALM BAY FIRE AND RESCUE AND THE PALM BAY POLICE DEPARTMENT, WOULD YOU COME UP? WOULD YOU BE SO KIND? WOULD YOU ALL GIVE THEM A HAND CLAP TOO, BECAUSE THEY'RE DOING A FANTASTIC JOB? I GUESS. AMEN.

WE COME BEARING GIFTS THIS YEAR AGAIN, AND AND I HOPE THAT THIS IS JUST THE BEGINNING OF MORE BECAUSE THERE'S ALWAYS MORE AT THE CHRISTMAS EXTRAVAGANZA.

AND SO WE WE COME DESIRING TO GIVE EACH DEPARTMENT A THOUSAND DOLLARS TO SAY THANK YOU FOR MAKING IT SAFE.

THANK YOU FOR HELPING THOSE WHO BUY HEAT EXHAUSTION NEEDED YOUR SUPPORT.

THANK YOU FOR OPENING UP AND HAVING YOUR PEOPLE.

JUST. MAKE EVERYTHING RUN SO SMOOTHLY AND THANK YOU AGAIN ON THE DAIS FOR FOR MAKING IT MAKING IT POSSIBLE, AND SO IF I MAY.

SITE. SORRY, THIS.

WOULD YOU ALL COME OVER? HERE'S.

EVERY MAYOR, WE'RE ON PUBLIC PUBLIC COMMENTS.

[PUBLIC COMMENTS/RESPONSES]

AS MAYOR, WE HAVE MR. BILL BRATTON FIRST. MR. CHIEF. ABOUT IN 586 OCEAN SPRAY STREET, SOUTHWEST.

REPEATEDLY, I'VE ASKED.

THE COUNCIL, WHERE IS THE RURAL RESIDENTIAL LAND SUPPOSED TO BE IN THE CITY OF PALM BAY?

[00:10:02]

AND AS OF YET, I HAVE YET TO RECEIVE ANY ANSWERS.

SO THAT LEADS ME TO QUESTION, IS PALM BAY, IS IT LEANING TOWARDS THE CURRENT ADMINISTRATION'S PLAN OF THE $5 BILLION GRANT PROGRAM FOR EXCLUSIONARY ZONING AND INFRASTRUCTURE PLAN TO REDUCE LOT SIZES AND ALLOW APARTMENTS IN SMALL RESIDENTIAL ZONING? THERE ARE ONLY QUESTIONS, POSSIBLY ALREADY.

I'M WRONG, BUT I DOUBT IT.

SO JUST FOR BATTON SAKE, LET'S FOLLOW THE MONEY.

THIS IS A CASE OF A GRANT $5 BILLION.

FROM FEDERAL GOVERNMENT, POTENTIALLY.

ALL RIGHT. AND SO EITHER YOU PLAY BALL TO QUALIFY FOR THESE GRANTS OR YOU'RE ON YOUR OWN IF YOU REFUSE, THAT MEANS YOU DON'T RECEIVE THE FEDERAL FUNDING.

THIS TACTIC IS ALL PART OF THE GREAT RESET.

I DON'T KNOW WHERE YOUR MIND SETS ARE OR HOW YOU'RE PLANNING PROCESS IS, BUT MY PERCEPTION IS MY REALITY.

I HAVE TO QUESTION WHAT I SEE HAPPENING.

WHAT USED TO BE FIVE PERCENT OF THE LAND IN THE CITY OF PALM BAY IS NOW DOWN TO ONE PERCENT OF RURAL RESIDENTIAL, AND IT'S FOLLOWING THAT ENTIRE PLAN OF MAKING THOSE WHO HAVE NOT HAVE AND CONDENSING THE POPULATION INTO TIGHTER GROUPS.

BLESS YOU. I DON'T KNOW IF IT'S A REALITY OR NOT, BUT IT'S MY PERCEPTION.

SO TO ME, IT DOES MAKE IT A REALITY.

THANK YOU. THANK YOU.

I'LL. GARY.

IT'S GOOD NIGHT TO THE COUNCIL, MR. MAYOR. CITY MANAGER IS ALFRED ÉGARD FROM 60 TO 80 MAIN STREET ARTIST PALM BAY.

I MUST COME IN THE OLD CHURCH FOR THAT GREAT EVENT THAT THEY PUT ON.

AND I THINK IT'S REALLY, REALLY A GREAT OUTCOME.

YOU KNOW, IN THE END OF THE DAY, IT WAS SO NICE.

I HEARD A LOT OF PEOPLE TALKING GOOD THING ABOUT IT, AND WE MUST REALLY APPRECIATE THE GIFTS AND THE EFFORT THAT THEY PUT TOGETHER.

AND I WILL ALWAYS TRY TO CONTRIBUTE AND DONATE TO THAT PROJECT BECAUSE I THINK IT'S REALLY NEEDED IN THE COMMUNITY.

THE SECOND THING IS THE F.B.L.

IF BNL CAME LAST MEETING AND THEY WERE MAKING THAT COMMENT ABOUT AN UPGRADE, I TRY MY BEST TO MAKE SOME CALLS AND I DIDN'T GET MUCH RESPOND.

BUT MY MAIN CONCERN IS THOSE ARE THE CITIZENS OF PALM BAY WILL BE FACING ANY KIND AND EXPENSE ON THIS UPGRADE.

I WOULDN'T, I WOULD, YOU KNOW, WOULD REALLY LIKE THE CITY TO CHECK INTO THAT, YOU KNOW, BECAUSE WE WOULDN'T WANT THESE EXPENSES TO GO TOWARDS OUR CITIZENS.

THE FINAL IS IS BEEN BENEFITING FROM THIS UPGRADE BECAUSE, YOU KNOW, IT COSTS THEM A LOT OF MONEY EVERY YEAR TO MAINTAIN THE POWER LINE AND STUFF.

SO IF THEY DO THIS UP, UPGRADE THEIR BENEFIT TOTALLY FROM IT.

SO I WOULD LIKE THE COUNCIL TO CHECK INTO THAT, THE CITY MANAGER TO CHECK IN, TO MAKE SURE THE CITIZENS OF THIS CITY IS NOT FACING WITH A COST.

THANK YOU. GOOD NIGHT. THANK YOU.

M. SHERMAN, YOU WANTED.

I REMEMBER THE PRESENTATION, BUT I DON'T WANT TO BE MISQUOTED, DO YOU? DID YOU WANT TO ANSWER A FEW OF THOSE QUESTIONS? CERTAINLY. I BELIEVE IN THE IN TERMS OF THE FPL WORK THAT THEY'RE GOING TO DO IN THE CITY. THE WAY THEY EXPLAINED IT AT THE MEETING WAS THAT THAT IS NOT A DIRECT COST TO THOSE RESIDENTIAL PROPERTIES IN THAT AREA.

NOW, CERTAINLY, IT'S PART OF THEIR OVERALL, YOU KNOW, CAPITAL INVESTMENTS THEY'RE DOING STATEWIDE, AND THAT ALL GETS FACTORED INTO THE RATE THAT WE ALL PAY.

BUT THERE'S NOT A DIRECT COST TO THOSE RESIDENTS OR THAT'S HAPPENING IN FRONT OF THEIR HOMES. UM, REGARDING THE RURAL RESIDENTIAL QUESTION, I KNOW THAT THAT IS AN ITEM, AND WE CAN CERTAINLY GET INTO MORE DETAILS IN THE FUTURE, IF YOU LIKE, BUT THAT IS AN ITEM THAT'S DEFINITELY UNDER REVIEW AS PART OF OUR COMPREHENSIVE PLAN PROCESS.

WHAT WE HAVE TODAY AND WHAT WE COULD HAVE TOMORROW IS ALL GOING TO BE PART OF WHAT WE LOOK AT. THE THANK YOU, MA'AM.

MAYOR, IF I MAY. GO AHEAD.

COUNCILMAN FELIX. THANK YOU.

I THINK IT'S IMPORTANT THAT MS. SHERMAN, WE MAY HAVE TO FOLLOW UP WITH F.B.L.

THAT'S COMPLETELY UNDERSTOOD THAT THE.

IMPROVEMENT. IT'S A PART OF THE CAPITAL IMPROVEMENT PROJECT, BUT I THINK IT'S IMPORTANT

[00:15:02]

THAT TO SHARE WITH THE CITIZEN AND THE QUESTION WAS ASK AND I BROUGHT THAT UP TO THE CENTER. IT REALLY COULDN'T GIVE US AN ANSWER.

I THINK IT WOULD BE GOOD FOR THE CITIZEN TO KNOW, OBVIOUSLY WAS A CONCERN OF MINE.

YOU HAVE OTHERS IN THE IN THE AUDIENCE THAT.

QUESTIONING THE FACT THAT WHO'S GOING TO PICK UP THE TAB, RATHER WE PAY IT OVER TIME, RATHER WE PAY IT THE SOMEBODY WILL PICK UP THE TAB.

BUT I THINK IT WILL BE CLEAR IT WOULD BE HELPFUL TO MAYBE BRING F.B.L BACK.

RATHER, THEY GIVE US SOME SORT OF IDEA AN IDEA.

WHAT WOULD IT BE? WHAT WOULD IT MEANS TO EVERY SINGLE USER IN THE CITY OF PALM BAY? I THINK IT'S IMPORTANT, SO I'D SAY WE CAN GET CONSENT FROM COUNCIL TO DO A FOLLOW UP TO GET A CLEAR UNDERSTANDING.

WHAT WOULD THAT MEANS OVER TIME FOR THE CITIZENS OF PALM BAY? AND I APPRECIATE THAT COUNCILMAN FELIX.

I THINK THEY'RE REGULATED BY THE PUBLIC SERVICE COMMISSION, WHICH IS THE STATE AGENCY.

BUT CERTAINLY, WE COULD DEFINITELY HAVE STAFF COME BACK OR STAFF REACH OUT TO FPL AND SAY, HEY, WE NEED TO GET INTO THE NUTS AND BOLTS, RIGHT? BUT THEY DID MENTION THEIR HARDENING THE STRUCTURE.

BUT YEAH, I THINK WE HAVE CONSENSUS ON THE DICE.

IF YOU COULD REACH OUT TO MR. BART PATRONS SINCE, YEAH, I CERTAINLY DO THAT.

YEAH. AND JUST TO FURTHER CLARIFY, JUST IN CASE I DIDN'T STATE IT CLEARLY.

SO THIS IS ONE OF MANY CAPITAL PROJECTS THAT THEY HAVE INCLUDED IN THIS YEAR'S BUDGET, YOU KNOW, AND THEY HAVE THEY KIND OF DO A MULTI-YEAR PLAN LIKE WE DO FOR OUR BUDGETING.

SO IT'S ALL KIND OF WRAPPED UP IN THERE.

THEY HAVE REVENUES THAT THEY PLAN ON.

THEY HAVE EXPENDITURES BOTH, YOU KNOW, PERSONNEL OPERATING AND CAPITAL.

AND THIS IS ONE OF THE CAPITAL PROJECTS.

SO I CAN CERTAINLY HAVE THEM SEND US THEIR BUDGET DETAILS AND DOCUMENTS LIKE THAT THAT THEY'VE SUBMITTED TO THE PUBLIC SERVICE COMMISSION, WHERE THEY REQUESTED CERTAIN RATES TO BE SAID SO. THAT ARE YOU SATISFIED WITH THAT? FELIX, OK? DEPUTY MAYOR JOHNSON PETER FILIBERTO.

MR. MAYOR COUNCILMAN, THANK YOU.

PETE FILIBERTO. TWO, TWO, SIX THREE SPRING CREEK CIRCLE.

SO I WAS OUT AND ABOUT IN PALM BAY.

THE OTHER DAY I RAN INTO A RESIDENT WHO HAPPENED TO OWN SEVEN RENTAL PROPERTIES AROUND OUR CITY AND ONE OF THOSE RENTAL PROPERTIES, A RENTER PARKED HIS VEHICLE ON THE ON THE GRASS. THE RENTER ASSUMED FINES, AMASSED FINES FIFTY DOLLARS A DAY FOR HOWEVER LONG THE DURATION OF THE RENT TO RENTER WAS.

THEREFORE, THERE'S NOW AN EIGHT KAYLENE $8000 LEAD ON THIS OWNER'S PROPERTY DUE TO THE RENTER. I SUPPORT CODE ENFORCEMENT, I SUPPORT WHAT THEY DO, BUT I FEEL LIKE $8000 IS A LITTLE EGREGIOUS. I PAID $3000 IN TAXES THIS YEAR.

SO WITH $3000.

TIME SEVEN RENTAL PROPERTIES, THAT'S TWENTY ONE GRAND COME TO COME INTO THE CITY OF PALM BAY. THIS INVESTOR AND HIS RESIDENT PAYS FOR.

SO MY QUESTION TO COUNCIL AND TO THE CITY MANAGER WITH MORE RESIDENTS AND EVEN INVESTORS OPTING TO RENT THEIR PROPERTIES OUT, NOTIFICATION NOTIFYING THE PROPER OWNER OF THE HOME OR THE BUSINESS MAY BECOME MORE PROBLEMATIC.

DO PALM BAY HOMEOWNERS OR COMMERCIAL OWNERS HAVE THE OPTION TO NOTIFY THE CITY THAT THEIR PROPERTY IS BEING RENTED? SO THAT WAY, WE CAN FORWARD THE CITY BUSINESS TO THAT PROPER PERSON.

THANK YOU ALL. THANK YOU, MR. FILIBERTO, MADAM SHERMAN.

DID YOU WANT TO ADDRESS SOME OF THOSE ISSUES? YES. THANK YOU, MAYOR. MR. FILIBERTO DID SEND AN EMAIL EARLIER IN THE WEEK, SO WE HAVE BEEN LOOKING AT THAT PARTICULAR ISSUE.

SO I APPRECIATE IT. SO ESSENTIALLY, WHAT HAPPENED IN THIS CASE, AS WE'VE DUG INTO IT IS THE WHERE WE PULL OUR DATA ON WHO OWNS A PROPERTY IS FROM THE PROPERTY APPRAISERS WEBSITE AND THAT PARTICULAR PARCEL, THE ADDRESS OF THE PARCEL AND THE MAILING ADDRESS.

FOR THE PARCEL, WE'RE BOTH THE SAME.

WHEN THE PROPERTY OWNER CHOSE TO RENT OUT HIS PROPERTY, HE DIDN'T PUT A DIFFERENT MAILING ADDRESS. SO ALL THE MAIL FOR THAT PROPERTY FOR THE OWNER KEPT GOING TO THAT LOCATION WHERE THE TENANTS WERE AND THE TENANTS OBVIOUSLY WERE IGNORING, I GUESS, THE INFORMATION.

SO OUR STAFF HAS ALREADY REACHED OUT TO THE OWNER AND HE'S, I BELIEVE, ON THE SCHEDULE FOR SPECIAL MAGISTRATE CONSIDERATION RELATED TO THE THE FEES AND FINES THAT WERE BUILT UP OVER TIME. BUT CERTAINLY OUR ONLY SOURCE OF ACCURATE DATA THAT WE'RE ABLE TO PULL FROM FOR OWNERSHIP AND FOR ADDRESSING IS FROM THE PROPERTY APPRAISERS WEBSITE.

SO I WOULD ENCOURAGE ANYBODY WHO IS RENTING THEIR PROPERTY.

MAKE SURE YOU UPDATE YOUR MAILING ADDRESS FOR YOUR PROPERTY WITH THEM BECAUSE THAT IS THE PLACE THAT A LOT OF A LOT OF CITIES AND OTHER UTILITIES WILL PULL DATA FROM.

IS THERE ANY WAY WE COULD PASS THAT INFORMATION OUT TO FOLKS THAT INTEND TO, YOU KNOW, THAT ARE PURCHASING BECAUSE WE DON'T KNOW HOW TO DIFFERENTIATE, WHO'S INVESTING AND WHO'S STAYING RIGHT? SO I DON'T KNOW WHAT EXTRA COSTS THAT WOULD BE, BUT IT IS JUST GOES A

[00:20:03]

LITTLE DEEPER IN OUR DUE DILIGENCE, I WOULD IMAGINE.

DEPUTY MAYOR JOHNSON PASTOR KEN DELGADO.

KENDALL GOT ONE FIVE FOR ANGELA ROAD, SOUTHEAST PALM BAY, FLORIDA, A THOUGHT AND ISAIAH CHAPTER FIFTY SIX IN VERSE 10.

GOD SAYS HE DECLARES THE END FROM THE BEGINNING AND FROM THE ANCIENT TIMES.

THAT ARE NOT YET DONE, SAYING MY COUNSEL WILL STAND, IN OTHER WORDS, HE THROWS OUT A VISION OF WHAT IT'S GOING TO LOOK LIKE AT THE END, AND THEN HE MAKES SURE IT HAPPENS.

INTERESTINGLY, A HARVARD BUSINESS STUDY SPEAKING ON ZONDER VINCE ZONDER EVANS WAS THE LEAST PROFITABLE PART OF THAT CONGLOMERATE.

AND THEY PUT A NEW PERSON IN THERE AND EVERYBODY WAS BICKERING.

ONE DEPARTMENT WAS BICKERING AGAINST ANOTHER DEPARTMENT, AND THIS ISN'T RIGHT AND THAT ISN'T RIGHT. AND AREN'T WE GOOD AT KNOWING EVERYTHING THAT'S JUST NOT RUNNING RIGHT? AND SO THEY'RE GOING BACK AND FORTH, AND HERE COMES THIS GUY.

AND THEY WERE ASKING, OK, WHAT ARE YOU GOING TO DO ABOUT IT? AND HE DIDN'T ADDRESS ONE OF THE PROBLEMS OF ALL THE COMPLAINTS THAT THEY HAD DIDN'T ADDRESS ONE. WHAT HE DID IS HE LISTED 10 THINGS.

HE DECLARED THE END OF WHAT HE WANTED TO SEE ON SUNDERLAND'S PUBLISHING COMPANY, RATHER THAN BICKERING ON ALL THAT WAS WRONG.

THEY DECIDED TO BE CREATIVE IN FINDING OUT WHAT THEY CAN DO TO GET TO THE PLACE WHERE EVERYTHING WAS RIGHT.

NOT DEALING WITH THE FIRES BECAUSE YOU PUT ON ONE FIRE, ANOTHER FIRE POPS UP, BUT HE GAVE THE VISION OF WHAT THEY WANTED AT THE END.

THEY STARTED CHANGING THEIR ATTITUDE ON WHAT WAS WRONG INTO WHAT CAN WE DO TO REACH THAT, WHICH WAS DECLARED FROM THE END, FROM THE BEGINNING.

AND NOT ONLY DID THEY MEET THEIR GOALS, THEY SURPASSED THEIR GOALS AND BECAME ONE OF THE MOST PROFITABLE AREAS OF THAT CONGLOMERATE.

WITH THAT, I'M SAYING THIS, GOD SAYS IN PHILIPPIANS CHAPTER ONE, THE GOOD WORK THAT I HAVE BEGUN IN YOU.

I AM, WELL, ABLE TO COMPLETE IT.

IN OTHER WORDS, GOD HAS A VISION FOR EACH PERSON, AND IT'S A GOOD VISION, A VISION FOR GOOD AND NOT EVIL, FOR BLESSING AND FOR PROSPERING.

AND GOD SETS THE STANDARD AND SAYS, I BELIEVE I CAN.

WHAT I'VE BEGUN IN EACH PERSON, I CAN BRING IT TO PASS.

AND IF WE STOP LOOKING AT EVERYTHING, THAT'S WRONG, BUT START LOOKING AT WHAT GOD IS SAYING, THIS IS RIGHT AND START PUSHING AND CREATIVELY IN WHAT GOD WANTS IN, EACH PERSON WILL FIND OUT THAT WE WILL ACHIEVE FAR MORE MORE.

OH, I'M SORRY, THE MORE MORE THAN YOU CAN EVER THINK BECAUSE GOD HAS GIVEN US PERMISSION TO BE MORE THAN WHO WE ARE.

THANK YOU FOR YOUR TIME.

IT WAS A HARVARD BUSINESS CASE STUDY THOUGHT.

THANK YOU. NATHAN WHITE.

NATHAN WHITE, 13 01 SEABREEZE STREET, SOUTHWEST.

I'LL BE BRIEF. I SIMPLY WANTED TO ASK COUNCIL AND STAFF WHEREVER THE ANSWER MAY COME FROM. A NEWS STORY BROKE WITHIN THE LAST WEEK OF A PORT ST.

LUCIE CONTRACTOR BY THE NAME OF BRIAN.

MORAL OR MORAL CURRENTLY BEING? FACED WITH THREE COUNTS, I BELIEVE IT IS OF FRAUD DEFRAUDING THE CITY OF PORT ST.

LUCIE FROM WHAT I UNDERSTAND.

MR. MORAL.

OR AT LEAST ONE OF HIS COMPANIES, ONE OF THE ONES I BELIEVE INVOLVED IN THE PORT ST.

LUCIE FRAUD CHARGES.

CALL THE NAME.

SECURE POINT, I THINK IT WAS.

EITHER WAY, ONE OF THIS GENTLEMAN'S COMPANIES, I BELIEVE, HAS DONE WORK FOR OR WITH THE CITY OF PALM BAY.

SO I WAS WONDERING IF THERE WAS IF I'M RIGHT ABOUT THAT AND ALSO IF THERE IS ANY PLAN OR IF THERE COULD BE A PLAN TO REVIEW THE INVOICES AND SUCH WITH REGARDS TO THOSE PROJECTS TO ASSURE THAT THE CITY OF PALM BAY DID NOT SUFFER ANY DEFRAUDING FROM AN INDIVIDUAL OR THAT OR THAT COMPANY? THANK YOU. THANK YOU, MADAM SHERMAN.

BASED ON YOUR KNOWLEDGE, OR IS THIS SOMETHING THAT WE'VE DONE BUSINESS WITH SECURE POINT, I BELIEVE THAT'S THE NAME HE USED.

[00:25:01]

UM, MY I GUESS MY RESPONSE THAT WOULD BE WE BECAME AWARE OF THAT ISSUE QUITE SOME TIME BACK AND WE DID OUR OWN INVESTIGATION AND.

FOUND THAT EVERYTHING WAS IN ORDER ON OUR END.

WE HAD A THOROUGH REVIEW OF THAT WITH THE CITY ATTORNEY'S OFFICE AND THE PROCUREMENT DEPARTMENT, AND WE CAN CERTAINLY GO THROUGH THAT AT ANOTHER TIME, IF YOU WOULD LIKE TO.

IT PERHAPS IT WOULD BE GOOD INFORMATION TO GIVE TO THE PUBLIC.

MEANING IF THERE WAS ANYTHING THAT WAS FOUND ATTORNEY, WOULD YOU LIKE TO WEIGH IN ON THAT? CERTAINLY, IF THERE IS SOMETHING THAT WE WE WERE TO HAVE FOUND OR IF THERE IS SOMETHING FOUND IN WHICH WE BELIEVE THAT THERE'S CRIMINAL ACTIVITY, I THINK THE FIRST RESPONSE WOULD CERTAINLY BE TO FORWARD IT ON TO THE APPROPRIATE PERSONS TO THE INVESTIGATION BEFORE WE WOULD ACTUALLY RELEASE IT TO THE PUBLIC.

BUT TO MY KNOWLEDGE, THERE HAS NOT BEEN ANYTHING AMISS THAT HAS BEEN FOUND.

SO WHAT I'M HEARING IS WE'VE DONE OUR DUE DILIGENCE.

AND AND NOTHING HAS BEEN FOUND.

TO MY KNOWLEDGE. I'M JUST GOING TO DEPUTY MAYOR JIM.

YEAH, I KNOW YOU WERE ON THE DAIS.

YEAH, I'M JUST GOING TO SAY IT SO SO PALM BAY POLICE DEPARTMENT ARRESTED HIM, BUT WE ARRESTED HIM ON BEHALF OF ST.

LUCIE COUNTY FOR A FELONY WARRANT.

SO THE ARREST THAT PALM BAY DID WAS ON BEHALF OF ST.

LUCIE COUNTY FOR THE FOR THE CHARGES THAT HAPPENED DOWN THERE.

SO THAT'S THAT'S WHAT HAPPENED.

WAS SLASHED HERE TWENTY TWENTY ONE.

I'M RIGHT. YEAH.

OK. OK, I BELIEVE CHIEF NODDED HIS HEAD YES, IDEALLY THIS ANSWERS YOUR QUESTION MR. WHITE MS. NOT JUST CONTINUE TO FOLLOW UP WITH US AND WE'LL WE'LL HAVE STAFF LOOK INTO IT.

THANK YOU, DEPUTY MAYOR JOHNSON.

ALL THE PUBLIC SPEAKERS, SO WE'RE ON PUBLIC HEARINGS, ITEM NUMBER ONE, MS. SMITH. WE'RE TWENTY TWENTY ONE DEATHS, SEVENTY FIVE.

[PUBLIC HEARINGS]

AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE CODE OF ORDINANCES TITLE 17 LAND DEVELOPMENT CODE, CHAPTER ONE EIGHTY THREE COMPREHENSIVE PLANNING REGULATIONS SECTION ONE EIGHTY THREE POINT ZERO ONE COMPREHENSIVE PLAN SUBSECTION D.

ADOPTION OF FUTURE LAND USE MAP AMENDING FUTURE LAND USE MAP PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES AND CONFLICT HERE WITH.

PROVIDING FOR AN EFFECTIVE DATE.

THANK YOU, MA'AM, I'M GOING TO OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO STEP FORWARD. GOOD EVENING, COUNCIL ANNA SAUNDERS WITH BSE CONSULTANTS THREE TWELVE SOUTH HARBOR CITY BOULEVARD, MELBOURNE, FLORIDA THREE TWO NINE ZERO ONE.

I JUST WANT TO TAKE THIS OPPORTUNITY TO SAY THANK YOU.

WE'RE EXCITED TO BE AT THIS PHASE IN THE APPROVAL PROCESS.

I WOULD SAY EXCITED THAT D.O.

HAS COME BACK WITH A FAVORABLE RECOMMENDATION.

YOU GUYS HAVE SEEN THE STAFF REPORT.

WE'RE JUST EXCITED TO GET STARTED.

AND IF YOU'VE GOT ANY QUESTIONS, PLEASE LET ME KNOW.

I'LL BE HAPPY TO ANSWER THEM. DO YOU HAVE ANY QUESTIONS OF THE.

HOW MUCH? MADAM SHERMAN, ANY COMMENTS YOU WANT TO ADD? I THINK FOR THE MAYOR, THANK YOU.

THE ONLY ONE IN THE AUDIENCE THAT WISHES TO SPEAK FOR AGAINST THIS ITEM.

OK. BUT GREG MS., MASTER CHIEF.

WE'RE. BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.

WHEN I WAS GOING THROUGH THE PACKET, I NOTICED THAT THE LEVEL OF SERVICE ON PACE ROAD, IT'S GOING TO GOING TO BE EXCEEDED.

SO THERE WE GO WITH ONE MORE TIME, WE'RE PLANNING MASSIVE GROWTH WITHOUT HAVING THE INFRASTRUCTURE SET UP TO MAINTAIN IT.

BUT WHEN I'M LOOKING AT THE PACKAGE, IT SAYS, BUT AT SOME POINT WE ARE GOING TO EXPAND THE ROAD OR MAKE.

AND IT DIDN'T SAY WHO THE WE ARE FOR THIS DEVELOPMENT EXPANSION COMING IN.

WAS IT THE TAXPAYERS OF PALM BAY? WAS IT GOING TO BE THE DEVELOPER? AND THE OTHER THING I DIDN'T LIKE ABOUT IT IS THE FACT THAT IT SAYS WE'RE APPROVING THE GROWTH, BUT WE'RE SAYING AT SOME POINT WE WILL MAKE THE CORRECTIONS.

I'M JUST TRYING TO SEE IF THE COUNCIL OR STAFF CAN LET ME KNOW WHEN IS THAT CORRECTION GOING TO BE TAKEN? THAT BEING SAID, ON THE OTHER SIDE OF THAT COIN, THOUGH, I'M WATCHING THIS DEVELOPMENT COME IN, THEY'RE DOING EVERYTHING THEY CAN, BUT WHEN I SEE THAT THERE'S SOME GROWTH THAT'S NOT READY PLAN, THE EXPANSION IS NOT PLANNED FOR YET.

THAT'S WHERE I'M CALLING IT UP.

AND I'M MUCH AS I LIKE WHAT THEY'RE DOING, I HAVE TO CALL IT OUT.

THANK YOU. THANK YOU, NATHAN WHITE.

[00:30:08]

EVEN WHITE, 13, ON SEABREEZE STREET, SOUTHWEST, APOLOGIZED FOR THE DRAMATICALLY LARGE STACK OF PAPER THE ONLINE AGENDA WAS NOT FUNCTIONING WEBSITE, SO PRINT IT OUT.

AS MR BATTEN MENTIONED, THE.

PUBLIC WORKS DEPARTMENT ANALYSIS DOES STATE THAT THE GENERATED TRIPS WOULD EXCEED THE ROADWAY CAPACITY, CAUSING A DEFICIENT LEVEL OF SERVICE.

I'M NOT SURE THAT IT.

I'M NOT SURE HOW WE COULD EXACTLY.

JUSTIFY MOVING FORWARD WITHOUT AT LEAST A PLAN FOR HOW TO DEAL WITH THAT OTHER THAN JUST THE IDEA THAT WE SHOULD AT SOME POINT.

THE OTHER THING IS THE TRAFFIC STATEMENT HERE FROM PALM VISTA MEDLEY AT EVERLANE'S BSE FILE. ALL RIGHT.

LET'S HEAR THE MIXED THE MIX OF UNIT TYPES FOR THIS PHASE IS PROJECTED AS FOUR HUNDRED AND FIFTY SIX SINGLE FAMILY.

TWO HUNDRED AND THIRTY FOUR FOR UNIT TO SIX UNIT TOWNHOMES AND ONE HUNDRED AND FIFTY PAIRED VILLAS.

NOW THEY PUT IN PARENTHESES HERE, THE FORD UNIT TO SIX UNIT ASPECT OF THE TOWNHOMES, THERE'S NO SUCH. ADDITIONAL DESCRIPTOR FOR THE PAIRED VILLA, SO I'M NOT SURE ABOUT THAT, BUT THE TOTAL OF 840 UNITS THAT IT PUTS AT THE BOTTOM, IT SEEMS A BIT MISLEADING.

IT'S USED FOR THE REST OF THE MAP AS WELL OR THE REST OF THE STATISTICS AS WELL.

BUT THAT TOTAL COUNTS ALL 234 OF THOSE TOWNHOMES AS ONE UNIT WHEN IT STATES THAT ALL OF THEM WILL BE FOUR TO SIX UNITS.

SO THESE NUMBERS SHOULD BE CLOSER TO THE 1500 OR 1300 RANGE INSTEAD OF 840.

AND THAT MATH WOULD GREATLY AFFECT THE TRIPS THAT ARE USED TO TALK ABOUT THE TRAFFIC STATEMENT, AMONG OTHER ELEMENTS OF THIS PROPOSAL.

I DON'T HAVE ENOUGH TIME TO GO IN DEPTH ABOUT THE OTHER REASONS THAT I THINK THIS PROJECT SHOULD BE SLOWED DOWN A LITTLE BIT TO OBSERVE THE IMPLICATIONS FOR THE CITY.

I JUST KNOW THAT I WOULD, BUT YES, I WOULD LIKE SOME CLARIFICATION AND SOME SOME LIGHT SHED ON THIS UNIT MATH, AS I SAY, IT DOES APPEAR TO BE MISLEADING AND WOULD SKEW ALL OF THESE TRAFFIC REPORT FINDINGS.

THANK YOU. ANYONE ELSE WISH TO SPEAK FOR OR AGAINST THIS ITEM? I'M GOING TO ASK THE APPLICANT TO STEP FORWARD AND.

PERHAPS PROVIDE SOME SOME ANSWERS.

HAPPY TO. IN THE EARLIER PUBLIC HEARINGS TO SPEAK DIRECTLY TO THE TRAFFIC REPORT THAT WAS FOUND IN THE DETAILED BY PUBLIC WORKS, THERE WERE SOME TYPOGRAPHICAL ERRORS THAT I HAD POINTED OUT IN THE EARLIER.

LIKE I SAID EARLIER PUBLIC HEARINGS, STAFF HAD WRITTEN DOWN SOMETHING LIKE TWO THOUSAND ONE HUNDRED. I FORGOT.

LET ME LET ME PULL THE PAGE UP.

TWENTY NINE HUNDRED AND FIVE UNITS, THERE'S REALLY ONLY 840 UNITS PROPOSED IN THIS PARTICULAR PORTION OF THE DEVELOPMENT.

SO WHEN YOU REVISE AND CORRECT THAT MATH, WE ARE IN FACT NOT TRIPPING THE THRESHOLD BY, YOU KNOW, WE'RE A THIRD OF THAT TOTAL OVERALL NUMBER.

WITH RESPECT TO MR. WHITE'S COMMENT ABOUT THE TOTAL NUMBER OF UNITS, IT IS IN FACT 840 UNITS.

THERE ARE 50.

MY EYES ARE A LITTLE BIT BAD HERE, BUT THERE ARE 15 FOUR UNIT TOWNHOUSES WHICH EQUATE TO 60 UNITS.

THERE ARE 20.

I THINK IT IS TWENTY SIX, MAYBE TWENTY SIX SIX UNIT BUILDINGS IN ONE HUNDRED AND SEVENTY FOUR TOTAL THERE.

THE PAIRED VILLAS AS A TOTAL OF TWO.

THERE ARE SEVENTY FIVE VILLA BUILDINGS THAT EQUALS ONE HUNDRED AND FIFTY UNITS.

WHEN YOU ADD ALL OF THOSE UP, IT DOES EQUATE TO THE 840 UNITS.

THAT CONCEPT PLAN IS INCLUDED IN ALL THE APPLICATIONS THAT WAS SUBMITTED TO STAFF.

IT SHOULD ALSO BE IN YOUR STAFF REPORT AND THE MATH IS WHAT IT IS.

IT'S EIGHT HUNDRED AND FORTY UNITS TOTAL, SO THERE WAS NO BAIT AND SWITCH.

WE DIDN'T COUNT. ONE FOUR UNIT BUILDING IS ONE UNIT.

IT DOES COUNT AS FOUR.

WE ACTUALLY TOTAL THEM TWO SEPARATE WAYS.

SO YOU GOT A NUMBER OF BUILDINGS AND YOU GOT TOTAL NUMBER OF UNITS AS WELL.

YOU'RE WELCOME. ME, ANY ADDITIONAL QUESTIONS? STAFF HAVE ANY COMMENTS.

SO FOR THIS DEVELOPMENT AND ALL OF THE OTHER SURROUNDING, WELL, THIS IS THE LAND USE ITEM, BUT IN THE IN THE FUTURE ITEMS AS THEY COME FORWARD, YOU'LL GET MORE DETAILS FOR THE DEVELOPMENT RELATED TO IMPROVEMENTS THAT DEVELOPERS HAVE TO MAKE, YOU KNOW, TURN LANES, TRAFFIC SIGNALS, WHATEVER IT MIGHT BE.

AS WELL AS THERE'S ALWAYS THE CALCULATION OF TRAFFIC, TRAFFIC IMPACT, FEES, PROPORTIONATE FAIR SHARE AND THE FUNDING THAT GOES THE CITY TO MAKE FUTURE.

[00:35:05]

THAT'S REGARDING THE WE STATEMENT BY MASTER CHIEF.

CORRECT. THANK YOU, MA'AM.

IS THERE ANYONE ELSE THAT WISHES TO SPEAK FOR OR AGAINST THIS ITEM? IT COUNCILMAN I'M GOING TO CLOSE THE PUBLIC HEARING AND ASK FOR EMOTION.

MOST IMPROVED ONE IS TWENTY TWENTY ONE DASH, SEVENTY FIVE SECOND ON A GOT A MOTION BY DEPUTY MAYOR JOHNSON SINGING BY COUNCILMAN FELIX ANY ADDITIONAL DISCUSSION, GENTLEMEN? SEEING, NONE ALL IN FAVOR, I PASSED UNANIMOUSLY.

ANYONE IN THE AUDIENCE WISH TO SPEAK FOR OR AGAINST THIS ITEM? MASTER CHIEF. SILVERTON 586 OCEAN SPRAY STREET, SOUTHWEST, THIS IS GOING TO BE A QUICK AND EASY QUESTION, AND WE HAVE THE NEW MAGISTRATE APPOINTED.

[00:45:02]

IS THERE GOING TO BE DIRECT LINK FOR AN INDIVIDUAL TO ASK THAT INDIVIDUAL A QUESTION PRIOR TO HAVING TO GO IN BEFORE THEY HAVE TO FACE A FINE? IS IT GOING TO BE LIKE AN OPEN COMMUNICATION CAPABILITIES WITH CITIZENS LIKE MYSELF? WE DON'T END UP WITH THE MASSIVE FINES LIKE WE WERE FACING WHEN WE THOUGHT WE COULD HAVE CHALLENGED IT. THANK YOU.

THANK YOU, MR. CHIEF.

RESIDENTS WILL CERTAINLY BE ABLE TO HAVE CONTACT WITH STAFF, BUT THE SPECIAL MAGISTRATE, NO DIFFERENT THAN A JUDGE, WON'T BE ABLE TO HAVE ANY EX PARTE COMMUNICATION WITH ANY OF THE RESIDENTS PRIOR TO THE ACTUAL PUBLIC HEARING.

THANK YOU, MADAM SMITH.

ANYONE ELSE IN THE AUDIENCE WISH TO SPEAK FOR OR AGAINST ASYLUM? I WAVED. GO AHEAD AND MS. IF YOU'RE STANDING UP. I FIGURE FROM 60 TO 80 MAIN STREET AND ARTIST PALM BAY, I GOT ONE QUESTION.

I'M ON A COURT ENFORCEMENT BOARD MYSELF AND I AM REALLY CONCERNED TO FIND OUT THE ANSWER.

WHY ARE WE CHANGING THIS FROM THE REGULAR COURT ENFORCEMENT BOARD TO THE MAGISTRATE? AND THE QUESTION IS MAINLY IF IT'S AN OPEN, IT'S AN OPEN CASE OR EVERYTHING GOING TO BE, YOU KNOW, KIND OF, YOU KNOW, NOT TRANSPARENT, YOU KNOW, TRYING TO LOCKED OFF UNTIL YOU WHEN YOU SEE WHEN YOU GET THE APPOINTMENT TO GO TO THE MAGISTRATE, EVERYTHING COMES OUT OR SOMETHING THAT YOU CAN FOLLOW AND COMPLY AND ALL THAT, YOU KNOW, THE SYSTEM IS GOING TO REALLY WORK. THANK YOU.

THANK YOU. TYPICALLY, I CAN I CAN RESPOND, BUT STAFF, ARE YOU ABLE TO RESPOND TO THE QUESTION OF OF HOW IT'LL WORK? THE PROCESS ISN'T GOING TO BE ANY DIFFERENT THAN IT REALLY WAS WITH THE CODE ENFORCEMENT BOARD, INSTEAD OF HAVING THE BOARD, YOU KNOW, MAKE THE DECISION.

IT'LL JUST HAVE THE ONE PERSON, WHICH IS A SPECIAL MAGISTRATE, THEY'LL STILL BE THE SAME REQUIREMENTS AS FAR AS NOTICE.

SAME DUE PROCESS.

SAME ABILITY.

PRESENT EVIDENCE.

AND IT ALL STILL BE PUBLIC.

IT'S JUST YOU ARE LITERALLY JUST TAKING THE BOARD AND REPLACING IT WITH ONE PERSON WHO IN THIS CASE WILL BE AN ATTORNEY.

THANK YOU, MA'AM. ANYONE ELSE WISH TO COME AND SPEAK? AND PETE FILIBERTO, TWO THREE, SPRING CREEK CIRCLE.

JUST A QUESTION ABOUT THE SPECIAL MAGISTRATE.

USUALLY WHEN SOMEONE IS ISSUED A TRAFFIC CITATION OR WHAT HAVE YOU, THEY'LL GO TO FIGHT THE TRAFFIC CITATION AND THEY'LL BE TAKEN BEFORE A SPECIAL MAGISTRATE.

THERE'S ALSO THE OPTION TO TAKE IT BEFORE A JUDGE.

THAT SAME TRAFFIC CITATION IS THAT OPTION HERE ON THE TABLE FOR ALSO A CODE ENFORCEMENT.

THANK YOU. THANK YOU.

AT NO. CERTAINLY, ANYTHING WILL BE BEFORE THE SPECIAL MAGISTRATE, ANY APPEAL WILL BE BEFORE THE.

A COURT, BUT THE ACTUAL CASEY HEARING OF THE UNDERLYING MATTER WILL BE THE JURISDICTION WILL BE FOR THE SPECIAL MAGISTRATE.

HIGH PASSES UNANIMOUSLY.

MS. TERESE CONGRATULATIONS.

ITEM NUMBER 11.

THANK YOU, MAYOR. I THINK THIS IS MINE.

SO THIS IS A CONSIDERATION OF A SUBSTANTIAL AMENDMENT TO PROGRAM YOUR TWENTY TWENTY TWENTY ONE ANNUAL ACTION PLAN.

AS YOU ALL KNOW, WE RECENTLY COMPLETED THE OR WE'RE COMPLETING THE DEMOLITION OF THE OLD FIRE STATION ONE ON PALM BAY ROAD.

THE FUNDING THAT WAS ALLOCATED FOR THAT FROM THE CDBG PROGRAM.

SHOULD I HAVE? DIDN'T MEAN TO INTERRUPT.

I'M SORRY. I HAVE JUST SAID.

WHEN I OPEN UP THE PUBLIC HEARING.

SO JUST IN CASE PROCEDURALLY, I JUST SAID I'M GOING TO OPEN UP THE PUBLIC HEARING.

CARRY ON, MADAM SHERMAN.

I DON'T KNOW. I'M ON AUTOPILOT, SO I MIGHT HAVE MISSED IT.

SO, SO ESSENTIALLY WE HAD SAVINGS FROM THE DEMOLITION.

IT WAS BUDGETED FOR ABOUT THREE HUNDRED FORTY FIVE THOUSAND DOLLARS BECAUSE THERE ARE A LOT OF UNKNOWN VARIABLES, IT ENDED UP COSTING A LITTLE OVER $88000.

SO THIS REQUEST IS TO MAKE SOME CHANGES TO OUR OUR PLAN SO THAT WE COULD REALLOCATE THE FUNDING FOR TWO PURPOSES.

ONE WOULD BE TO SET ASIDE FUNDING TOWARD THE PURCHASE OF A FUTURE QUINTE, A FIRE APPARATUS FOR THE NEW FIRE STATION AT THAT LOCATION, AS WELL AS TO REPLACE SOME PARK BENCHES AT LIBERIA PARK AND HAPPY TO ANSWER ANY QUESTIONS YOU MIGHT HAVE.

THANK YOU. COUNSEL, DO YOU HAVE ANY QUESTIONS, ANY ADDITIONAL QUESTIONS?

[00:55:02]

THERE ANYONE IN THE AUDIENCE THAT WISHES TO SPEAK FOR AGAINST THE SIDE OF MASTER CHIEF.

GILBERT IN 586 OCEAN SPRAY STREET, SOUTHWEST, JUST A COUPLE OF QUESTIONS WITH THIS ONE.

ONE HOW COULD WE BE OFF BY A QUARTER OF A MILLION DOLLARS IN OUR ORIGINAL ESTIMATES BECAUSE WE HAD TO GO TO THE GDG AND ASK FOR THAT FUNDS TO BEGIN WITH? HOW COULD WE BE OFF BY A QUARTER OF A MILLION DOLLARS ON SOMETHING THAT WAS QUITE SIGNIFICANT, I THOUGHT.

ITEM NUMBER TWO WAS LOCATION AND COST OF THE NEW FIRE STATION.

NUMBER SEVEN, IF IT'S GOING TO BE IN THE SAME LOCATION AS THAT, THAT'S A MIGHTY SMALL PLOT FOR WHAT WE'RE LOOKING AT FOR THE NEW FIRE STATION.

AND IS IT GOING TO BE WHAT NUMBER IS IT GOING TO BE CALLED? SO WITHOUT QUESTION, WITHOUT QUESTION, I'M SAYING, COULD THIS FUNDS BE USED? WE ALREADY HAVE A HARDENING STATION WEATHER STATION FOR FOUL WEATHER FOR STATION NUMBER SIX. THEY'RE LIVING IN A TRAILER RIGHT NOW.

WE HAVE THIS FUN SETUP.

WE'VE ALREADY WE'VE ALREADY GOT IT FROM GVC GRANT FUND.

COULD WE USE THAT FOR HARDENING OF FIRE STATION NUMBER SIX INSTEAD OF HAVING THE SOUTHWEST FIRE STATION? THEY'RE NOT THERE WHEN THERE'S AN EMERGENCY, THEY HAVE TO LEAVE THE AREA, THEY'RE LITERALLY IN A TRAILER.

SO THAT WAS, YOU KNOW.

I'M JUST NOW, IF IT'S POSSIBLE OR NOT, I WANT TO PROTECT THE FIREFIGHTER THAT'S CLOSEST TO ME, I KNOW THAT'S SELFISH, BUT THAT'S WHAT I PREFER INSTEAD OF PLANNING FOR A FIRE STATION THAT'S ALREADY GOT THREE IN THE AREA.

BUT WHO KNOWS, I COULD BE WRONG IN MY THOUGHT PROCESS.

AND THE LAST ONE WAS WHEN I WAS TRYING TO FIND LOCATIONS.

I WENT TO THE CITY'S WEBSITE FOR THE HOME PAGE.

I WAS TRYING TO BRING UP A.

CLICK IN TO FIND THE ACTUAL LOCATIONS OF YOUR FIRE STATIONS.

WELL, ON THE HOMEPAGE, IT DOESN'T TELL YOU THE THE LOCATION OF YOUR FIRE STATIONS.

I THOUGHT, WELL, THAT'S PRETTY BAD BECAUSE BATTENS ONLY LIVED HERE FOR A FEW DAYS AND HE DOESN'T KNOW WHERE THEY'RE LOCATED.

SO I WENT TO THE WEBSITE.

LET'S SEE IF WE CAN FIND IT SO I CAN FIND OUT WHERE IS THE CLOSEST STATION IS.

I CAN TELL YOU WHERE THE CLOSEST FIRE HYDRANT IS, BUT I CAN'T TELL YOU WHERE THE CLOSEST FIRE STATION IS.

AND SOMETIMES THAT'S YOUR QUICKEST RESPONSE TO GET EMERGENCY IF YOU NEED IT.

IF YOU DON'T KNOW HOW TO GET THERE AND YOU KNOW IT COULD BE A PROBLEM.

SO OUR GIS MAPPING FOR THIS, FOR THE FIRE STATION, THERE'S SOMETHING MISSING IN THAT SITE. THAT BEING SAID, I UNDERSTAND WE MIGHT NOT BE ABLE TO GET HARDENING OF FIRE STATION NUMBER SIX, BUT I WOULD PREFER IT.

THANK YOU. I BE THERE, THANK YOU, MR. CHIEF, MADAM SHERMAN, THANK YOU.

WE WILL LOOK AT THE WEBSITE ISSUES ALL WORK SORT OF BACKWARDS.

STATION SIX IS OWNED BY BREVARD COUNTY.

WE HAVE A SITE NOT TOO FAR DOWN THE ROAD ON DEGROOT THAT WE'RE LOOKING TO BUILD A PERMANENT STRUCTURE IN THE SHORT TERM, HOPEFULLY.

SO WE'RE WORKING ON THE FUNDING PLAN FOR THAT AS WE AS WE SPEAK FOR THAT STATION SIX.

THE NEW FIRE STATION WILL BE ON THE OLD SITE ON PALM BAY ROAD.

IT WILL BE CALLED FIRE STATION NUMBER SEVEN.

MY UNDERSTANDING AND NANCY FUND IS OUR COMMUNITY ECONOMIC DEVELOPMENT DIRECTOR, IF YOU HAVE ANYTHING ELSE TO ADD, JUST WAVE.

BUT MY UNDERSTANDING AS TO WHY THE ESTIMATES WERE SO MUCH HIGHER IS WE WEREN'T SURE HOW MUCH REMEDIATION WE WOULD NEED TO DO AT THE SITE BECAUSE THERE HAD BEEN I MEAN, THE SITE HAD BEEN USED FOR LOTS OF DIFFERENT THINGS OVER YEARS AND YEARS AND YEARS.

THERE WAS CONCERNS ABOUT SOIL CONTAMINATION AND REMOVAL COSTS AND WHAT WAS IN THE OLD BUILDINGS. AND SO THAT WAS ALL SORT OF PREPARING FOR POTENTIAL MAXIMUM WORST CASE SCENARIO, AND IT DIDN'T TURN OUT TO BE AS MESSY AS IT COULD HAVE BEEN.

I GUESS SO. ANYONE ELSE THAT WISHES TO SPEAK FOR OR AGAINST ASYLUM, PLEASE STEP FORWARD.

IN DELGADO, ONE, FIVE FOUR, ANGELA ROAD, SOUTHEAST PALM BAY, FLORIDA, IS THIS IS THIS WHERE THEY'RE DESTROYING THE OLD ONE AND THEY'RE PUTTING A NEW ONE? WOULD THEY WOULD IT BE POSSIBLE EVEN TO CONSIDER THERE'S A INTERSECTION RIGHT THERE? YOU ALREADY GOT PULLS UP FOR LIGHTS, BUT YOU GOT VISTA OAKS.

YOU HAVE A CHURCH.

I THINK IT'S CALLED THE HOUSE PALM BAY.

I THINK I GO THERE AND AND WITH WITH THE THE THRIFTY PRODUCE THAT'S THERE, THERE'S JUST SO MUCH TRAFFIC AND I SEE PEOPLE BYPASSING HAVING TO DO A U-TURN AND GOING THROUGH WHAT'S SUPPOSED TO BE ONLY A RIGHT HAND TURN.

AND THEN AS THEY DO A U-TURN, VERY DANGEROUS BECAUSE PALM BAY ROAD OBVIOUSLY IS ONE OF THE MOST TRAFFICKED ROADS POSSIBLE.

MAYBE WE CAN READJUST THAT SO THAT THERE ACTUALLY BE A FOUR WAY LIGHTS, NOT JUST FROM THE FIRE DEPARTMENT, BUT COMING OUT FROM VISTA OAKS JUST FOR CONSIDERATION.

REFINE. THANK YOU.

MADAM SHERMAN, THANK YOU, MAYOR.

WE ALREADY HAVE THAT AS AN ITEM WE'RE REVIEWING, SO WE'LL TAKE A LOOK AT THAT.

THANK YOU, MA'AM. IS THERE ANYONE ELSE THAT WISHES TO SPEAK FOR OR AGAINST THIS ITEM?

[01:00:03]

HEY, CNN, I'M CLOSING THE PUBLIC HEARING AND ASK HIM FOR A A MOTION MOTION TO APPROVE A SUBSTANTIAL AMENDMENT TO THE FISCAL YEAR 2020 DASH TWENTY TWENTY ONE CDBG ANNUAL ACTION PLAN TO REALLOCATE TWO HUNDRED AND FIFTY SIX THOUSAND SEVEN HUNDRED AND FORTY DOLLARS FROM DEMOLITION OF OLD FIRE STATION ONE FOR THE ACQUISITION OF THE FIRE APPARATUS FOR FUTURE FIRE STATION SEVEN AND TO REALLOCATE THREE THOUSAND FOR NEW BENCHES THAT LIBERIA PARK. [Additional Item]

IT WAS JUST APPROVED.

SO CONGRATULATIONS. YOU ALL JUST WANT TO MAKE SURE YOU'RE ALL KNOW.

SO, SO JUST BECAUSE WE JUST PASSED IT, WOULD YOU LIKE TO SHARE A FEW WORDS? PERHAPS WE SHOULD HAVE. WE SHOULD HAVE DONE THAT BEFORE WHERE YOU GOT ME EMOTIONAL.

OH GOODNESS.

I'M DON FUTCH, THE CO-FOUNDER, AND MICHAEL GENE, KIDS BASKETBALL FOUNDATION.

OUR SON, MICHAEL, WAS A STUDENT AT BAYSIDE HIGH SCHOOL.

HE UNFORTUNATELY PASSED AWAY IN A CAR ACCIDENT ABOUT A MONTH SHY OF HIS 20TH BIRTHDAY, SO WE STARTED THE FOUNDATION TO HELP FAMILIES IN BROWARD COUNTY.

OVER THE PAST 11 YEARS, WE HAVE ALLOCATED APPROXIMATELY $50000 A YEAR INTO THE COMMUNITY.

WE DON'T KEEP ANYTHING. IT'S ONE HUNDRED PERCENT GIVE BACK AND WE SPONSOR ALL OF THE PADDLE LEAGUES IN THE AREA, AS WELL AS THE BASKETBALL WRECKS.

WE'VE HELPED SCHOLARSHIPS AT BAYSIDE HIGH SCHOOL FOR KIDS THAT PLAY BASKETBALL THERE WITH COACH DANNY MILLER. AND, YOU KNOW, WE WANT TO GET A MENTORING PROJECT GOING AS WELL.

AND LIBERTY PARK IS WHERE MICHAEL PLAYED EVERY DAY AS WELL AS THAT'S WHERE HIS MEMORIAL SERVICE WAS. SO IT WAS IMPORTANT FOR US TO TO DO THIS IN HONOR OF MICHAEL AND TO BE ABLE

[01:05:01]

TO CONTINUE TO GIVE FORTH TO THE COMMUNITY.

SO WE VERY MUCH APPRECIATE THE APPROVAL AND WE LOOK FORWARD TO CONTINUING PARTNERSHIP WITH YOU GUYS. SO THANK YOU.

THANK YOU FOR EVERYTHING YOU DO, MA'AM.

AND THIS IS PART OF MICHAEL'S LEGACY THAT WILL CONTINUE TO LIVE ON.

AND THANK YOU FOR INVESTING IN OUR COMMUNITY AND INVESTING IN LIFE COUNSEL.

ANY WORDS? FOSTER, I COULDN'T SAY NO BETTER THAN WHAT THE MAYOR JUST SAID, THANK YOU FOR.

CONTINUE HIS LEGACY AND THE FOUNDATION.

I REALLY APPRECIATE WHAT YOU DO TO THE COMMUNITY.

IT MEANS A LOT TO ME AND, YOU KNOW, TO SHOW MICHAEL IS STILL ALIVE AND THAT BASKETBALL COURT IS GOING TO BE NAMED AFTER HIM.

SO I APPRECIATE WHAT YOU'RE DOING.

CONTINUE, PLEASE CONTINUE TO FIND WAYS.

THANK YOU, MAYOR, THANK YOU SO MUCH FOR WHAT YOU DO.

THE GERMANS ALREADY SAID, I THINK IT'S IMPORTANT TO PUT VALUE THAT SPEAKS VOLUME WHEN A GROUP DECIDED TO DO SUCH A THING AND TO MAKE SURE THAT HIS LEGACY LIVE FOREVER.

GET. DEPUTY MAYOR JOHNSON, EVERYBODY HIT IT ON THE HEAD.

I APPRECIATE YOU, MA'AM, I APPRECIATE EVERYBODY HERE.

COACH MILLER, I SEE YOU IN THE BACK.

BAYSIDE HIGH HEAD BASKETBALL COACH.

I APPRECIATE YOU SUPPORTING THIS FAMILY, SO THAT'S WHAT IT'S ABOUT.

THAT'S WHAT IT'S ABOUT AS A COMMUNITY.

PASTOR DELGADO, YOU KNOW, THIS IS THE HOUSE RIGHT NOW, SO I'M JUST BEING REAL.

SO I APPRECIATE YOU ALL.

STAY BLESSED. THANK YOU.

BLESS YOU, MA'AM, THANK YOU SO MUCH, THANK YOU, GUYS.

WE'LL GO TO ITEM NUMBER 10 MR.

[10. Consideration of designating certain City-owned real estate generally located at 1201 Sunswept Road NE as surplus and listing for sale to the public. ]

BILL BATTEN. BILL BATTEN 586.

OCEAN SPRAY STREET.

IN TWO THOUSAND FIVE, THE CITY BOUGHT THIS PROPERTY FOR ONE HUNDRED AND EIGHTEEN THOUSAND DOLLARS IN A LAND BUY WASN'T JUST THE ONE LOT.

I UNDERSTAND IT WAS IN A TOTAL LAND BUY, BUT SO THEN THAT LEADS TO THE QUESTION WHY DID THE CITY BUY THIS PARTICULAR LOT? WHY EVEN SPEND THE MONEY TO BEGIN WITH? ITEM NUMBER TWO.

IF THE CITY SELLS THIS PARCEL, IS THAT IT GOING TO BE AT A LOSS FROM WHAT WE PAID FOR IT WHEN WE PURCHASED IT FOR THIS LOT? AND WHY IS IT NON BUILDABLE? I KNOW SEVERAL PEOPLE COULD PUT A GARAGE ON IT, A SHED ON IT, A SWIMMING POOL WITHOUT HAVING TO ASK FOR EXTENSIONS ON THE PROPERTY, ET CETERA, ALL KINDS OF THINGS COULD STILL BE BUILT ON THAT PROPERTY.

I KNOW SEVERAL INDIVIDUALS RIGHT NOW THAT ARE PAYING $40000 FOR AN INDIVIDUAL LOT FOR SO THEY CAN HAVE DOUBLE WHAT'S THEY'RE PAYING FORTY THOUSAND FOR EACH ONE, JUST SO THEY HAVE A LITTLE BIT MORE LAND.

THAT'S EXACTLY WHAT THIS IS GOING TO BE, BUT YOU'RE ONLY GOING TO SELL IT FOR $25000.

THAT'S LESS THAN THE AVERAGE LOT IN THE PALM BAY.

SO THAT BEING SAID, AND TO THE QUESTIONS, WHY DID WE BUY IT TO BEGIN WITH? AND IF THE CITY SELLS US, IS IT GOING TO BE AT A LOSS? AND WHY IS IT CONSIDERED NON BUILDABLE IF IT'S ONLY BECAUSE OF THE SIZE? BECAUSE YOU COULD PUT OUT BUILDINGS, SWIMMING POOLS, ET CETERA, ON THAT PROPERTY? THANK YOU VERY MUCH.

THANK YOU. AND SHERMAN, ASK NANCY BUNTER, COMMUNITY ECONOMIC DEVELOPMENT DIRECTOR, TO COME UP AND ADDRESS SOME OF THOSE QUESTIONS.

YOU, MA'AM. AND SYMBOLIC MEANING, ECONOMIC DEVELOPMENT DIRECTOR, THIS LOT IS ACTUALLY THE ADJOINING PROPERTY OWNERS WHO ARE INTERESTED IN IT.

THEY SAID THERE'S A LOT OF TRAFFIC THAT GOES THERE, LIKE THEY LIKE TO FISH OFF OF THE THE WATER. AND SO THEY ARE ACTUALLY INTERESTED IN PURCHASING THE LOT TO THEY WOULD FENCE IT IN AND AND THEN USE IT FOR THEM THEMSELVES SO IT CAN BE AVAILABLE TO EITHER ONE OF THOSE TWO PARCEL OWNERS THAT ARE ADJACENT TO IT.

IT'S NOT VALUED. THE PROPERTY APPRAISER HAS IT VALUED AT TWENTY FIVE THOUSAND.

BUT ONCE OUR BROKER DOES THE CMA, IT MAY BE ACTUALLY VALUED MORE SO IT COULD BE BUILDABLE IF THERE WAS VARIANCES.

IF YOU'VE SEEN THE MAP, IT HAS A LITTLE BIT OF IT'S ON THE CUL DE SAC, SO IT JUST DOESN'T MEET ALL OF THE REQUIREMENTS.

BUT IT WOULD.

IT COULD BE BILLABLE, BUT WITH VARIANCES IT WOULD BE KIND OF TIGHT.

SO BUT THERE IS SOME INTEREST IN IT, AND SO WE'RE LOOKING TO SURPLUS FOR THAT REASON.

WE DIDN'T HAVE ANY USE FOR IT.

ANY QUESTIONS FROM STAFF? OH, NANCY, THANK YOU.

I BELIEVE THAT COMMUNITY AS WELL, THESE DID RESTRICT IT.

[01:10:02]

HE DID NOT. TERMS OF SIZE OF HOUSES YOU CAN PUT, YOU CAN BUILD, THERE'S A MINIMUM SIZE.

I'M NOT SURE ABOUT HER.

THAT'S FINE, BUT I JUST WANTED TO MAKE A POINT, I BELIEVE IT IS, SO IT MAKES COMPLETE SENSE EITHER, OR ESPECIALLY IF THEY EXPRESS INTEREST, CERTAINLY NEEDS TO TRY TO GET AS MUCH AS YOU POSSIBLY CAN.

BUT IT TRULY MAKES SENSE TO US TO ESPECIALLY, YOU KNOW, AGAIN, IF THEY EXPRESS INTEREST ALREADY, SO WE DON'T HAVE ANY USE FOR IT.

SO. ANY ADDITIONAL QUESTIONS? THANK YOU, MA'AM. THE COUNCIL.

AN IMPROVED CITY-OWNED. THE REAL ESTATE GENERALLY LOCATED 12:01 SUNSET SWEPT ROAD NORTHEAST TO BE DESIGNATED AS SURPLUS AND LISTED WITH THE CITY'S REAL ESTATE BROKER, A MOTION BY DEPUTY MAYOR JOHNSON BY COUNCILMAN FELIX.

ALL IN FAVOR, I PASSES UNANIMOUSLY.

ITEM NUMBER 11 THE BATON.

[11. Consideration of a SHIP Program funding request for Volunteers of America’s Space Coast Commons Apartments special needs low-income housing development ($100,000). ]

NO BATON, 586 OCEAN SPRAY STREET, SOUTHWEST.

I'M USUALLY NOT IN SUPPORT IN THE CITY, UTILIZING ITS FUN TO US TO ASSIST A DEVELOPER, HOWEVER. THIS WILL HELP THE GROUP GREATLY WITH THE CITY'S LOW INCOME HOUSING PROBLEM THAT WE'RE CURRENTLY FACING.

THIS IS A I LOOK AT THIS AS A GOOD THING, EVEN THOUGH IS COMING OUT OF OUT OF OUR FUNDS.

IT'S IT'S A GOOD THING.

BUT THAT LEADS ME TO A COUPLE OF QUESTIONS WHEN I SEE 33 AND A THIRD PERCENT OF THE CITY'S CITYWIDE MEDIAN INCOME.

WHAT DOES THAT MEAN THAT THEY'RE ACTUALLY GOING TO BE PAYING FOR RENT? THAT'S WHAT IT'S GOING TO BE SAID AT ITS 33 PERCENT.

I DIDN'T KNOW WHAT THE CITY'S MEDIAN INCOME WAS.

THAT COULD STILL BE $2000 A MONTH.

OR A ONE BEDROOM OR A TWO BEDROOM APARTMENT, SO IT DOESN'T SAY WHAT WHAT THEY'RE GOING TO BE RENTING IT OUT, SO THAT DOES NOT PUT IT IN FOR THE LOW INCOME INDIVIDUALS.

IT'S GOING TO MAKE IT AVAILABLE TO SOMEBODY WHO DOES COME INTO THAT, WHO'S RIGHT ON THE BORDERLINE, IT'S GOING TO MAKE IT AVAILABLE FOR THEM.

I WAS WONDERING IF THERE IS ANY WAY YOU COULD DO GO BACK AND CHECK IT THE STANDARDS.

I KNOW THIS ONCE GOVERNED BY REGULATION, I UNDERSTAND THAT WHERE IT COULD BE, THE 33 PERCENT OF WHAT WE CONSIDER THE LOW INCOME INDIVIDUALS, NOT THE MEDIAN OF THE OF THE CITY OF PALM BAY, BECAUSE THE MEDIAN OF CITY PALM BAY IS RELATIVELY HIGH IN COMPARISON TO THE LOW INCOME RESIDENTS OF PALM BAY.

IN ONE MORE TIME, IT COULD.

IT COULD PUT PEOPLE OUT THAT WE SAY, OH, LOOK, WE'RE OPENING IT UP TO THEM.

THEY AREN'T GOING TO QUALIFY OR THEY ARE GOING TO BE ABLE TO AFFORD IT.

SO, LIKE I SAY, IT IS A GOOD THING.

I DON'T LIKE CITI HAVING TO SPEND ITS MONEY, BUT I DON'T SEE ANY ANY OTHER BUILDERS THAT ARE COMING IN AND WILLING TO RENT OUT A SITUATION LIKE THIS.

THANK YOU VERY MUCH. THANK YOU, MR. CHIEF MADAM SHERMAN.

I'D LIKE TO HAVE OUR COMMUNITY ECONOMIC DEVELOPMENT DIRECTOR COME UP AGAIN AND PROVIDE SOME CLARITY AND A LITTLE BETTER EXPLANATION ON THAT FOR US.

EVENING, AS MR BATTEN HAD MENTIONED, IT IS THEY ARE PLANNING ON GOING THROUGH THE FLORIDA HOUSING FINANCE CORPORATION SALE FUNDS, AND SO THERE ARE REQUIREMENTS.

SO ONE OF THE REQUIREMENTS IS THAT NO MORE THAN 30 PERCENT OF THEIR INCOME CAN GO TOWARDS THE RENT. AND THEN THERE'S THERE'S INCOME RESTRICTIONS.

SO THERE'S FOR 80 PERCENT OF THE UNITS MUST BE AT 50 PERCENT AMI AND THEN 20 PERCENT HAVE TO BE AT 33 PERCENT.

SO YOU ARE LOOKING AT PERSONS THAT ARE MAKING $10000 FIFTEEN THOUSAND DOLLARS, DEPENDING ON WHERE THEY FALL IN THAT CARIBBEAN IS FROM VOLUNTEERS OF AMERICA.

AND SHE'S ALSO HERE AS WELL AS MAYBE IF SHE WANTED TO GIVE YOU A SHORT PRESENTATION AND SPEAK ON IT AS WELL.

IF YOU'RE INTERESTED, IF COUNSEL WOULD LIKE, YES, AND SHE PLEASE STEP FORWARD.

REALLY APPRECIATE YOU BEING HERE, MA'AM.

THE NAME IS KARA BEARD, AND I'M A RESIDENT IN PALM BAY.

THREE SIXTY THREE YEAR STREET SOUTHEAST.

AND THIS WILL BE A 30 UNIT COMPLEX SERVING LOW TO EXTREMELY LOW INCOMES, AND IT WILL BE FOR PEOPLE WITH SPECIAL NEEDS AS WELL AS THERE'S A REQUIREMENT OF 20 PERCENT SERVING HOUSEHOLDS THAT ARE CONSIDERED HOMELESS.

WE HAVE BEEN BLESSED TO BE IN PARTNERSHIP WITH THE BREVARD HOMELESS.

I'M SORRY, THE HBC, THE HOUSING AUTHORITY OF BREVARD, WHICH HAS GRACIOUSLY COMMITTED TO

[01:15:01]

PROJECT BASED VOUCHER EVERY SINGLE UNIT IN THIS COMPLEX.

THAT MEANS THAT WE WILL BE ABLE TO SERVE PEOPLE WITH ZERO INCOME AND AGAIN IT WILL BE 30 PERCENT OF THEIR INCOME. SO WE'LL WELL EXCEED OUR MINIMUM REQUIREMENTS OF THE ELOY UNITS THAT WILL BE REQUIRED BY FLORIDA HOUSING.

Q, MA'AM, NO PROBLEM, ANY OTHER QUESTIONS, ANY QUESTIONS, COUNCILMAN COUNCILMAN FOSTER.

YES, SIR. UM, MY ONLY CONCERN WAS THE YOU HAVE A LOT OF ONE BEDROOM UNITS.

AND NOT TOO MANY TWO BEDROOMS OR THREE BEDROOMS. CAN YOU SPEAK TO THAT? ABSOLUTELY, SIR.

THE. AND WHEN WE WENT TO DO THE ALLOCATING, HOW MANY THE UNIT ALLOCATIONS, WE REACHED OUT TO THE BREVARD HOMELESS COALITION AND MET WITH THEIR HOUSING NAVIGATOR, WHO DOES EXTENSIVE RESEARCH ON A WEEKLY MONTHLY BASIS ABOUT WHAT IS IN MOST NEED.

AND THEY SAID ONE BEDROOMS ARE IN DESPERATE NEED.

WE ALSO REACHED OUT TO THE HOUSING AUTHORITY AND SAID AGAIN, WHAT ARE YOU SEEING? WHERE IS THE NEED? AND AGAIN, RENOWNED ONE BEDROOMS? AND WHEN YOU'RE SERVING SPECIAL NEEDS AND LOW INCOME, A LOT OF TIMES THOSE ARE PEOPLE THAT JUST NEED A ONE BEDROOM.

AND I ALSO WANT TO MENTION THAT THESE ARE NOT JUST AFFORDABLE HOUSING UNITS.

VOA PRIDES THEMSELVES IN PROVIDING SUPPORT SERVICES THAT ARE CLIENT DRIVEN, CLIENT CENTERED. SO THIS WON'T BE JUST AFFORDABLE HOUSING.

IT WILL COME WITH SUPPORTS AND IT'S A PERMANENT, SUPPORTIVE HOUSING DEVELOPMENT.

SO AND WE ARE VERY HAPPY TO BE IN PARTNERSHIP WITH PALM BAY.

AND AGAIN, I'M A RESIDENT HERE AND THIS HAS BEEN A PASSION PROJECT FOR ME PERSONALLY.

SO I HAVE JUST A FEW QUESTIONS.

YES, SIR. THANK YOU FOR THAT ANSWER.

I MADE IT MORE CLEAR TO ME ALSO.

WELL, THEY'RE GOING TO BE SOCIAL SERVICE ON SITE.

YES, SIR. AND WHAT ABOUT MY CONCERN IS LIKE SINGLE MOMS, WE HAVE KIDS.

WHAT CAN THEY LIVE THERE FOR MORE THAN A YEAR OR SO? THEY GET ON THEIR FEET? YES, IT'S A PERMANENT, SUPPORTIVE HOUSING DEVELOPMENT.

VOLUNTEERS OF AMERICA DOES WORK TOWARDS HELPING PEOPLE GET ON THEIR FEET, LIKE YOU SAID, AND OUR ULTIMATE GOAL IS TO HELP THEM MOVE TO SOMETHING DIFFERENT, TO SOMETHING BIGGER, BETTER. AND THAT'S WHERE I GET SUPER EXCITED TALKING ABOUT OUR PARTNERSHIP WITH HOUSING AUTHORITY, RIVERSIDE COUNTY IS ONE OF THE LUCKIEST COUNTIES TO HAVE HBC.

I TRAVEL THROUGHOUT FLORIDA AND DEAL WITH HOUSING AUTHORITIES THROUGHOUT FLORIDA.

THEY HAVE AN AMAZING PROGRAM THAT IS NOT AT EVERY HOUSING AUTHORITY, WHICH IS A HOMEOWNERSHIP PROGRAM.

AND BECAUSE THESE PROJECT BASED VOUCHERS WILL BE THERE.

OUR CLIENTELE WILL HAVE THE OPPORTUNITY TO ENROLL IN THEIR SELF-SUFFICIENCY CLASS, WHICH HELPS THEM MOVE TOWARDS BETTER INCOME HOMEOWNERSHIP.

THEY CAN WORK TOWARDS DEPOSITS FOR THOSE HOMEOWNER OPPORTUNITIES.

SO IT REALLY IS AN AMAZING OPPORTUNITY FOR PEOPLE TO GET ON THEIR FEET AND MOVE ON TO SOMETHING BETTER AS WELL.

SO THIS ONE HUNDRED THOUSAND OF THE SHIP MONEY HOW THAT HELPED THIS PROJECT? WELL, IT IS PART OF WHEN YOU GO THROUGH THE FUNDING PROCESS.

I'M NOT A GRANT WRITER, SO I'LL DO MY BEST TO ANSWER THIS.

PART OF THE SCORING IS GETTING LOCAL CONTRIBUTIONS AND IT HAS TO BE THREE PERCENT OF WHAT YOU'RE REQUESTING. AND SO OUR REQUEST WILL BE, I BELIEVE, FIVE MILLION.

I DON'T HAVE THE PRO FORMA IN FRONT OF ME.

SO THREE PERCENT MATCHING FUNDS WOULD BE ONE HUNDRED AND FIFTY.

SO THIS HUNDRED WILL GO TOWARDS THAT AND WE ALREADY ARE IN COMMUNICATION WITH THE COUNTY AS WELL AND EXPECT TO RECEIVE MORE SUPPORT FROM THEM AS WELL.

THIS IS GOING TO HELP POSSIBLY GET FUNDING FROM THE STATE.

YES, ABSOLUTELY. WE'LL HELP OUR APPLICATION BE A STRONGER APPLICATION.

THANK YOU. THANK YOU.

ANY ADDITIONAL QUESTIONS? COUNCILMAN FELIX SWAGIT THANK YOU, MAYOR.

LET ME FIRST COMPLIMENT THE THE ORGANIZATION.

OBVIOUSLY THE WORK YOU GUYS ARE DOING AND SO ON, AND ESPECIALLY FOCUS ON THIS SECTOR OF OUR COMMUNITY TO SERVICE THEM.

MY ONLY QUESTION IS, IS THERE MORE COMING? IS THERE A PLAN FOR MORE, I SHOULD SAY? WELL, WE WOULD LOVE TO CONTINUE TO DO MORE.

AND I CAN JUST SAY THAT I'M VERY IMPRESSED WITH THE STAFF HERE.

THEY HAVE BEEN AMAZING TO WORK WITH.

ANY TIME WE'VE NEEDED ANYTHING HAD A QUESTION.

THEY'RE RIGHT THERE.

SO THANK YOU SO MUCH TO EVERYBODY WHO HAS HELPED US GET TO THIS POINT.

SO I WILL ASK PALM BAY RESIDENT ALWAYS WORK TOWARDS BRINGING ADDITIONAL DEVELOPMENTS IN TO HERE. AND I'M ALSO A PART OF THE AFFORDABLE HOUSING COMMITTEE FOR THE HOMELESS

[01:20:01]

COALITION, AND I KNOW THAT WE ARE PUTTING TOGETHER INFORMATION TO HOPEFULLY PRESENT TO WHOEVER ABOUT HOW TO BRING MORE AFFORDABLE HOUSING DEVELOPMENT INTO PALM BAY.

AND THERE ARE A LOT OF WAYS THAT I THINK THAT WE AS A CITY CAN DO SOME THINGS THAT WILL BRING MORE AFFORDABLE HOUSING.

BUT THERE ARE SOME FUTURE RFAS THAT I WOULD BE INTERESTED TO SEE IF THEY COULD COME TO PALM BAY AND POSSIBLY MAYBE BE A PART OF THIS, LIKE A PHASE TWO OR SOMETHING.

SO. YES, I FOR FOR THE FOR THE CITIZEN THAT MAY BE WATCHING THAT DON'T QUITE UNDERSTAND.

THIS IS CERTAINLY AN ORGANIZATION THAT SEE A PROBLEM.

IT'S A TRUE PROBLEM, IT'S A CHALLENGE AND NOBODY REALLY HAVE THE, YOU KNOW, THE PERFECT ANSWER. SO IT'S GREAT WHEN WE SEE ORGANIZATIONS SUCH AS YOUR ORGANIZATION MAKING STRIVE, MAKING THE EFFORT. SO I IN MY, YOU KNOW, PERSONALLY, I'M ON BOARD.

I'D LOVE TO SEE A LOT MORE COME IN.

AND ALSO, IF YOU CAN PARTNER WITH OTHERS AND THEN TRY TO DRAG THEM ALONG BECAUSE YOU GUYS HAVE THE EXPERIENCE.

CERTAINLY, THAT'S SOMETHING I KNOW THERE ISN'T ENOUGH DEVELOPERS THAT ARE WILLING OR WANTING TO BRING THIS KIND OF, YOU KNOW, THIS KIND OF HOUSING, YOU KNOW, A COMMUNITY.

BUT I TRULY APPLAUD ORGANIZATION TO.

I APPRECIATE THAT IT IS VERY DIFFICULT BEING A NONPROFIT DEVELOPER, WHICH IS WHAT WE ARE.

VOLUNTEERS OF AMERICA DOESN'T DEVELOP TO MAKE MONEY.

WE RECOGNIZE THAT OUR CLIENTELE, THAT WE SEEK TO SERVE, THAT THE ONLY WAY THEY CAN BECOME STABLE IS WITH PERMANENT HOUSING AND STABLE HOUSING.

YOU CANNOT EXPECT SOMEBODY TO BE MENTALLY STABLE IF THEY DON'T HAVE STABLE HOUSING, YOU CANNOT EXPECT SOMEBODY TO WORK ON SOBRIETY OR ANY OF THOSE THINGS WITHOUT A STABLE PLACE TO DO THAT. SO THE ONLY REASON THAT WE GOT INTO DEVELOPMENT WAS TO MAKE THOSE HOMES FOR THE PEOPLE THAT NEED THEM.

AND THE REASON I'M PASSIONATE ABOUT THIS JOB IS I USED TO LIVE IN AN AFFORDABLE HOUSING PLACE THAT WASN'T VERY NICE WITH MY SINGLE CHILDREN, AND I FEEL HONORED AND BLESSED TO BE A PART OF A COMPANY THAT BUILDS BEAUTIFUL PLACES THAT ARE SAFE AND GORGEOUS AND A PLACE THAT SOMEBODY CAN TRULY CALL HOME AND BE PROUD TO LIVE THERE.

SO. THANK YOU.

THANK YOU. I WANT TO TAKE THIS OPPORTUNITY TO PERSONALLY THANK YOU FOR EVERYTHING VOLUNTEERS OF AMERICA DOES FOR OUR VETERAN COMMUNITY THAT HAS NOT BEEN MENTIONED HERE, BUT I'M WELL-INFORMED TO KNOW AND RECOGNIZE, FROM MENTAL HEALTH TO SHELTERING THOSE THAT HAVE FOUGHT THE FIGHT FOR US, THAT DOWN THE UNIFORM THAT HAVE GONE ABROAD AND HAVE SCARS THAT ARE UNSEEN VOLUNTEERS OF AMERICA HAS HELD THEIR HAND.

SO I WANT TO TAKE THIS OPPORTUNITY TO THANK YOU FOR THAT.

THANK YOU. THAT'S ONE OF THE OTHER REASONS I HAVE A VERY BIG SOFT PART OUR HEART FOR PEOPLE WHO HAVE SERVED OUR COUNTRY AND BELIEVE THAT THEY DESERVE, ABSOLUTELY DESERVE TO HAVE A SAFE PLACE TO LIVE.

SO THANK YOU FOR THAT.

THANK YOU. ALSO ENTERTAIN A MOTION MOTION TO APPROVE THE FUNDING REQUEST FOR VOLUNTEERS OF AMERICA FOR MONETARY SUPPORT FROM THE CITY OF PALM BAY AND THE AMOUNT OF $100000 FROM SHIP PROGRAM FUNDS IN THE FORM OF A GRANT FOR ITS AFFORDABLE HOUSING PROJECT FOR THE SPACE COAST COMMERCE APARTMENTS SPECIAL NEEDS LOW INCOME HOUSING DEVELOPMENT.

SECOND, I GOT A.

MOTION BY DEPUTY MAYOR JOHNSON SEEING BY COUNCILMAN FOSTER.

ALL IN FAVOR, ALL PASSES UNANIMOUSLY.

ITEM NUMBER 12 JOE BARTON.

[12. Consideration of utilizing Undesignated Storm Water Fund Balance for funding of commercial site plan engineering review on-call services.]

ROBERTON 586 OCEAN SPRAY STREET, SOUTHWEST.

I THOUGHT THE STORMWATER FUND WAS UNDER A SPECIAL ASSESSMENT CHARGE, I THOUGHT THAT'S WHAT WE WERE FUNDING IT WITH.

AND AS SUCH, IT HAD TO BE SPENT ON THE ORIGINAL PROJECT IT COULDN'T HAVE FUNDS FROM FROM SPECIAL ASSESSMENT COULD NOT BE SHIFTED AROUND.

THAT WAS MY PERCEPTION.

I COULD BE WRONG. THE CITY CURRENTLY STILL HAS PROBLEMS WITH THE STORM WATER WITHIN THE CITY OF PALM BAY STILL HAVE STANDING WATER.

WE STILL HAVE DITCHES THAT DON'T FLOW AND WE STILL HAVE PIPES THAT ARE COLLAPSED, RIGHT? SO THAT'S ALL PART OF STORM WATER.

SO. IF ANYBODY DOES NEED TO BE CORRECTED BEFORE.

BEFORE WE START LOOKING AT HOW WE'RE GOING TO START OFFSETTING OFFICE BILLS, THAT'S HOW I'M LOOKING AT THIS.

IF ANYBODY COULD EXPLAIN HOW WE COULD USE SPECIAL ASSESSMENT FUNDS FOR WORKING IN THE OFFICE ON THIS, THEN PLEASE LET ME KNOW.

THANK YOU. THANK YOU, MADAM SHERMAN.

THANK YOU, MAYOR. SO CURRENTLY, THE STORMWATER FUND IS FUNDED THROUGH A STORMWATER FEE.

IT'S NOT AN ASSESSMENT ANY LONGER.

IT'S I FORGET EXACTLY WHAT YEAR WE WENT AWAY FROM THE ASSESSMENT, BUT IT'S A FEE ON THE UTILITY BILL. SO THE FUNDING COMES IN.

IT'S WE ACTUALLY DO A CALCULATION EVERY YEAR TO SEE WHAT THE THE NEEDS ARE, WHAT WE CAN COMPLETE IN TERMS OF CAPITAL PROJECTS, WHAT THE PERSONNEL COSTS ARE, ET CETERA.

[01:25:04]

AND THAT'S WHAT GOES INTO OUR RECOMMENDATION EACH YEAR FOR WHAT FEE WE WOULD SET.

SO REGARDING THE ACTUAL USE OF THESE FUNDS, WE ACTUALLY PAY ENGINEERS CURRENTLY OUT OF THE STORMWATER FUND BECAUSE THEIR TASKS INVOLVE THINGS RELATED TO STORMWATER.

ONE OF THOSE THINGS IS TO REVIEW SITE PLANS AND THE STORMWATER COMPONENTS OF THOSE SITE PLANS. SO THIS REALLY IS JUST A REQUEST TO ADD ADDITIONAL CAPACITY BY HAVING A.

WE HOPE IT'S A SHORT TERM SOLUTION TO HAVE AN OUTSIDE ENGINEER ASSIST US WITH SOME OF THESE SMALLER PLAN REVIEWS FOR SMALLER COMMERCIAL SITES UNDER THREE ACRES AND THEN ALSO MINOR SUBDIVISIONS.

THANK YOU, MA'AM. ANY ADDITIONAL QUESTIONS? YOU KNOW, NO LESS FOR A MOTION.

A MOTION APPROVED THE TRANSFER OF FUNDS FROM UNDESIGNATED STORMWATER FUND BALANCE FROM THE COMMERCIAL SITE PLAN ENGINEERING REVIEW ON CALL SERVICES AT A MOTION BY DEPUTY MAYOR JOHNSON SEEING BY COUNCILMAN FELIX.

FURTHER, THE DISCUSSION ALL IN FAVOR HIGH PASSES UNANIMOUSLY.

ITEM NUMBER ONE IN NEW BUSINESS.

[NEW BUSINESS]

MS. SHERMAN, THANK YOU, MAYOR.

THIS IS A CONSIDERATION OF A PURCHASE OFFER THAT WE RECEIVE FOR A PROPERTY AT FOURTEEN SPORTSMAN LANE NORTHEAST.

THE PROPERTY WAS APPROVED AS A A SURPLUS PROPERTY BY THE BY THE COUNCIL PREVIOUSLY AND WE LISTED IT FOR SALE BACK IN MID-NOVEMBER OF LAST YEAR AT A LIST PRICE BASED ON CMA.

THAT WAS ABOUT IT WAS FIVE HUNDRED AND NINETY FIVE THOUSAND DOLLARS.

SINCE THAT TIME IN NOVEMBER, WE HAVE RECEIVED JUST A ONE OFFER, BUT WANTED TO BRING THAT TO YOU FOR CONSIDERATION.

THAT OFFER IS FOR FOUR HUNDRED AND FIFTY THOUSAND DOLLARS, WHICH IS LESS THAN THE LIST PRICE, AND I'M HAPPY TO ANSWER ANY QUESTIONS YOU MIGHT HAVE ON THAT.

I DO HAVE QUESTIONS, BUT I SAW.

COUNCILWOMAN FELIX, WHO HAS TAKEN AN AVID INTEREST IN REAL ESTATE.

PLEASE GO AHEAD. SO NO CARRY ON.

YEAH, ABSOLUTELY. OUT OF CURIOSITY, MS. SHERMAN, HOW MANY OFFERS DID DID WE RECEIVE? TO MY KNOWLEDGE, IS JUST THE ONE STILL STAFF IS CONFIRMING YES.

AND THE PROPERTY WAS WAS LISTED WHEN ON NOVEMBER 16TH, I THINK NOVEMBER 16TH.

SO MY QUESTION IS, IS MORE ON THE LEGAL SIDE OF.

NUMBER ONE, I DON'T THINK WE SHOULD ENTERTAIN.

I THINK THE VALUE, ACCORDING TO OUR NOTES, IS FIVE HUNDRED NINETY FIVE THOUSAND.

THAT'S THAT'S SUBSTANTIALLY LOWER, RIGHT? THAT'S THE FIRST THING, BUT I DON'T KNOW IF WE HAVE AN OPPORTUNITY TO FIGURE OUT BECAUSE IT SAYS THEY DON'T WANT TO DO A WEDDING VENUE.

RIGHT. SO I DON'T KNOW IF WHAT SQUARE FOOTAGE THEY'RE TALKING ABOUT.

AND DO WE BECAUSE ONE OF THE BIGGEST THINGS I'M CONCERNED WITH IS WE WE SAY YAY TO FOUR FIFTY AND THEN THEY TURN AROUND AND FLIP IT FOR FIVE NINETY FIVE, RIGHT? ALL IN ONE SWOOP. SO THAT'S AN AREA OF CONCERN.

BUT WHAT I WAS THINKING IS KIND OF LIKE A PUBLIC PRIVATE PARTNERSHIP.

I'M NOT EVEN SURE THAT CAN HAPPEN, BUT CERTAINLY WE COULD KIND OF LIKE TO CREATE A VENUE FOR US RIGHT WITHIN THE CITY LIMITS OF PALM BAY.

SO I WAS JUST THINKING OUT LOUD ABOUT THAT AND WANTED TO SEE IF THAT THAT'S SOMETHING THAT WE COULD EVEN PURSUE.

I GUESS THE QUESTION WOULD BE TO YOU, MADAM, MADAM ATTORNEY.

IS THAT SOMETHING THAT? IN COUNTER-OFFER OR WHAT IS THAT LIKE WAY OUT OF LINE ON ON A WISH LIST THAT I HAVE? WELL. CERTAINLY, IF IT'S SOMETHING THAT COUNSEL WANTED US TO EXPLORE, CERTAINLY I'VE NOT HAD ANY CONVERSATIONS WITH THE PROSPECTIVE PURCHASER AS FAR AS WHAT THAT PERSON'S PLANS IS, THAT PERSON WOULD BE.

SO I COULDN'T SPEAK TO THAT.

BUT CERTAINLY IF COUNSEL WANTED ENOUGH STAFF TO REACH OUT AND TO SEE HOW THAT, YOU KNOW, IF THAT PERSON WOULD BE INTERESTED IN TRY TO FIGURE OUT ON WHAT TERMS. CERTAINLY, THAT COULD BE SOMETHING THAT COULD BE EXPLORED.

BUT AT THIS POINT, WITHOUT SPEAKING TO THEM, I CAN'T SAY IT CAN HAPPEN.

BUT AT THE SAME POINT, I CERTAINLY CAN'T TELL YOU AT THIS TIME THAT IT'S SOMETHING THAT'S OUT OF THE REALM OF POSSIBILITY.

I JUST WOULD HAVE TO HAVE ADDITIONAL TIME TO BE ABLE TO EXPLORE WITH THIS PURCHASER OR ANY OTHER PURCHASER. AS FAR AS WHAT THEIR PLANS ARE AND HOW.

PARTNER WITH THE CITY MAY OR MAY NOT BE WHAT THEY'RE LOOKING FOR, AND IT MAY NOT BE THAT WE'RE REALLY A STRICT, YOU KNOW.

REPEAT, IT MAY BE SOMETHING LESSER THAN THAT THERE ARE MULTIPLE DIFFERENT POSSIBILITIES

[01:30:05]

WHERE YOU COULD HAVE WERE DEPENDENT UPON THIS PERSON'S INTEREST.

CERTAINLY, WE COULD EVEN HAVE A SITUATION WHERE IF YOU THINK ABOUT DISNEY, WHERE THEY HAVE, YOU KNOW, THE PAST WHERE YOU KNOW, THEY HAVE CERTAIN BLACKOUT DATES, WHERE THEY THEY'RE DOING THEIR BUSINESS, BUT OTHER TIMES THEY'RE MORE RECEPTIVE.

I MEAN, THERE ARE DIFFERENT.

WHEREAS, YOU KNOW, HEY, OTHER TIMES WHERE THERE MAY BE PRIORITIES FOR CITY EVENTS OR MAYBE EVEN EVENTS WHERE PEOPLE IN PALM BAY, I DON'T KNOW BECAUSE I DON'T KNOW THIS PERSON'S BUSINESS MODEL AND HOW WHAT WE ARE DOING MAY OR MAY NOT FIT INTO IT.

BUT IT IS SOMETHING IF COUNSEL IS INTERESTED IN IT, WE COULD EXPLORE.

I'M TRACKING YOU. THANK YOU, MA'AM.

IT IS AN OPTION FROM WHAT I HEAR.

I DON'T KNOW, MADAM SHERMAN, DID YOU SPEAK TO THE ACTUAL APPLICANT OR THE GENTLEMAN THAT IS WANTING TO? I HAVE NOT, BUT NANCY IS GOING TO COME UP AND SHARE WHAT SHE CAN SHARE, I'M SURE.

OK. MS. SHERMAN, WHILE NANCY IS COMING UP, CAN WE BRING THE GROWTH MANAGEMENT AS WELL? OF A COUPLE OF QUESTIONS IN REGARDS OF DEVELOPMENT IN A PIECE OF PROPERTY.

IF I ACTUALLY TALKED TO OUR COMMERCIAL BROKER, SO HE'S LOOKING AT A SMALLER VENUE, OF COURSE, DURING HIS DUE DILIGENCE PERIOD, HE'S GOING TO NEED TO TALK WITH GROWTH MANAGEMENT TO SEE THE SIZE OF THE OF THE BUILDING AND THE PARKING.

IT'S ONLY AN ACRE.

SO IT REALLY DEPENDS ON, YOU KNOW, STORMWATER.

AND IF THERE'S ANY, I'M NOT SURE IF THERE'S ANY WETLANDS ON THE PROPERTY, BUT HOW MUCH PARKING HE WOULD NEED. CERTAINLY WITH A VENUE LIKE A WEDDING, HE IS GOING TO NEED SOME ROOM FOR PARKING.

SO HE WOULD DO THAT MORE LIKE MORE THAN LIKELY DURING HIS DUE DILIGENCE PERIOD.

THANK YOU, MA'AM. WELL, COUNCILMAN FELIX, ANY ADDITIONAL QUESTIONS FROM AD FOR NANCY ALSO. HI, HOW ARE YOU? I'M DOING WELL. HOW ARE YOU? GOOD, GOOD. WELCOME.

WELCOME TO OUR TO THE TEAM.

GLAD TO BE HERE. WE HAVEN'T FORMALLY MET, BUT THANK YOU SO MUCH IN TERMS OF THE CURRENT CODE. I KNOW IT'S SEE IT'S COMMUNITY COMMERCIAL.

CORRECT. I BELIEVE SO.

IT'S COMMUNITY COMMERCIAL.

SO. WHAT IS ALLOWED I KNOW A SMALL WEDDING VENUE MAY BE ALLOWED.

I HAVE NOT STUDIED THE CODE AND I DON'T HAVE IT MEMORIZED YET, I GUESS THAT'S WHAT I'M TRYING TO SAY. SO I WOULD HAVE TO GET BACK TO YOU ON WHAT WOULD BE ALLOWED.

AS FAR AS A WEDDING VENUE.

I KNOW THAT THERE ARE SOME AREAS THAT WEDDING VENUES ARE ALLOWED, BUT COMMUNITY COMMERCIAL. I'M NOT 100 PERCENT SURE THE PARKING WOULD BE CALCULATED BASED ON CAPACITY, RIGHT? THAT'S CORRECT. IS THAT CORRECT? YEAH, THAT'S FOR THE MOST PART.

I WANTED TO MAKE SURE IT'S IT'S IT'S A VERY SMALL.

I MEAN, FOR THAT, WHAT THEY WANT TO DO, IT'S A VERY SMALL PROPERTY.

A HUNDRED AND FIFTY THOUSAND DOLLARS, IT'S NOT NECESSARILY ABOUT OFF.

MY OPINION. THAT'S JUST MY PERSONAL OPINION ON THAT PROPERTY.

I'M ONE OF THE QUESTION I ASK AS WELL IS WAS IT WE DIDN'T DO A PROPER APPRAISAL APPRAISAL ON THAT PROPERTY. IT JUST WE ONLY SIR, WE ONLY DO APPRAISALS IF ARE FIVE ACRES OR LARGER.

YES, SIR. THAT'S RIGHT. IT WAS A WHAT IS IT, A MARKET ANALYSIS? YOU JUST DO THE COMPARABLE MARKET ANALYSIS IF IT'S UNDER THE FIVE ACRES PER HOUR POLICY.

YOU KNOW, THE ONLY CONCERN I HAVE IS THAT WE DON'T WE DON'T ACTUALLY SEE ANY COMPARABLE MARKET ANALYSIS SHOW COMPARABLE AS WELL.

I KNOW WE HAVE AN APPRAISER IN THE AUDIENCE, BUT I KNOW IT'S IT DIDN'T SHOW ANYTHING.

JUST SAY COMPARABLE PROPERTY ON PALM BAY ROAD IS IS EVALUATED BY RATED AT OVER 500.

THE OTHER THING IS, I DON'T THINK IT'S A BAD DEAL FOR THE CITY.

A QUICK HISTORY OF THAT PIECE OF PROPERTY.

THE CITY HAVE THIS PIECE OF PROPERTY.

IT'S RECORDED.

1990 TO JULY OF 1990, 1992, FOSTER ZERO.

ADDED FOR ZERO DOLLAR.

WAS LISTED ONE ONE APPLICANT EXPRESS INTEREST, IF IT WAS THAT HARD OF A DEAL, I BELIEVE WE WOULD HAVE MORE. IT'S A GREAT SPOT.

IT'S IT'S IT'S PRIME.

I WOULD, I WOULD SAY THAT, BUT CONSIDERING THE SIZE OF THE PROPERTY.

IN MY HUMBLE OPINION, IT'S.

SO IT'S A GOOD OFFER, AND CURRENTLY THE ON THE PROPERTY APPRAISAL SITE, IT'S EVALUATED AT

[01:35:01]

190 ONE SIX.

SO I KNOW THIS IS NOT, BUT THAT'S WHAT'S CURRENTLY EVALUATED.

JUST, OH, HISTORY FOR MY COLLEAGUES JUST TO.

WHERE WE ARE AT. I THINK IT'S NECESSARILY ABOUT OFF.

THANK YOU, COUNCILMAN FOSTER.

YEAH. I MEAN, COUNCILMAN FELIX KIND OF ANSWER ALL MY QUESTION, WE DON'T HAVE APPRAISAL DONE ON THIS BECAUSE OUR POLICIES AND PROCEDURES, BUT WE ONLY HAVE ONE OFFER.

AND I'VE BEEN TO THAT PROPERTY, I KNOW EXACTLY WHAT IS AT, AND I WALKED, I ACTUALLY WALKED ON THE PROPERTY AND IT'S A NICE LOCATION, BUT I DON'T KNOW WHAT YOU PUT THERE.

I HAVE NO LUCK. WHAT WOULD YOU PUT THERE? I MAY. YOU KNOW.

I WOULD LIKE TO. SEE APPRAISAL OF IT, BUT WHAT WOULD YOU PUT THERE AND RELAXING, YOU KNOW, FIVE HUNDRED AND NINETY FIVE THOUSAND? I DON'T KNOW. YOU KNOW.

WHAT WOULD BE THE PROPER BUSINESS, BUT THAT'S NOT MY CONCERN, AND MY CONCERN IS.

ARE WE GETTING. YOU KNOW, A BANG FOR OUR BUCK WITH THIS PROPERTY, I THINK WE ARE.

I DON'T SEE NOBODY ELSE COMING BY AND OFFERING ANY, ANY ANY BETTER OFFER THAN THAT.

I JUST I CAN'T SEE ANYBODY OFFERING.

A BETTER OFFER, AND I LIKE THE PROPERTY, BUT I WOULDN'T OFFER FIVE NINETY FIVE FOR, YOU KNOW, I WOULDN'T EVEN GO WHAT WE WHAT HE'S OFFERING.

BUT YOU KNOW, I I THINK WE SHOULD TAKE THE OFFER AND.

SELL IT, OK? DEPUTY MAYOR JOHNSON, WE'VE GOT SHERMAN MS. SHERMAN HAD ONE MORE COMMENT FIRST.

YEAH, I'M SORRY. I JUST WANTED TO ADD TO MAKE SURE EVERYONE UNDERSTOOD BECAUSE THERE WAS A REFERENCE TO HOW YOU KNOW HOW THE PROPERTY WAS ACTUALLY PRICED FOR THE LISTING.

AND SO I'LL JUST READ PART OF WHAT THE THE BROKER PUT DOWN.

BUT ESSENTIALLY WHAT THEY DID TO PREPARE THIS IS IT WAS A BROKER OPINION OF WHAT THE PRICE SHOULD BE AND WHAT THEY HAD TO LOOK AT IN THE AREA WAS THERE WERE NO COMPARABLE PROPERTY SALES THAT THEY COULD USE, YOU KNOW, LIKE SOMETIMES FOR SINGLE FAMILY HOME PROPERTIES. THERE WERE NO COMPARABLE PROPERTIES THAT COULD BE FOUND SINCE THEY WENT BACK TO NOVEMBER OF 2020 TO LOOK, AND THEY DIDN'T HAVE ANYTHING TO COMPARE TO.

SO THEY REALLY THEY LOOKED AT THE VALUE OF THE PROPERTY, WHAT COULD BE DEVELOPED, AS THEY ALSO HAD SEEN SOME PROPERTIES OF THE SAME SIZE ON PALM BAY ROAD IN THE BABCOCK AREA THAT WERE LISTED FOR AROUND FIVE HUNDRED AND NINETY EIGHT THOUSAND.

SO THEY USE THAT AS KIND OF A COMPARABLE.

BUT THAT IS ALL THAT WENT INTO THE DEVELOPMENT OF THE PRICE FROM THE BROKER'S PROFESSIONAL OPINION.

SO. MA'AM.

NATHAN WHITE.

NATHAN WHITE, 13 01 SEABREEZE STREET, SOUTHWEST.

UM, I'D LIKE TO JUST READ.

THE GENERAL SUMMARY FROM THE BROKER WITH REGARDS TO THIS PROPERTY, THIS SITE IS LESS THAN 1000 YARDS FROM THE HIGHEST TRAFFIC COUNT IN ALL OF BREVARD COUNTY, I-95 AND PALM BAY ROAD. THIS AREA HAS SEEN THE MOST AGGRESSIVE AND ACTIVE GROWTH ANYWHERE IN BREVARD COUNTY FOR THE LAST FIVE TO 10 YEARS.

NO COMPARABLE PROPERTY SALES CAN BE FOUND FOR THIS PROPERTY SINCE NOVEMBER 1ST, 2020.

PROPERTIES CURRENTLY THE SAME SIZE ON PALM BAY ROAD NEAR BABCOCK ARE LISTED FOR FIVE HUNDRED AND NINETY EIGHT THOUSAND DOLLARS.

SO COMPARABLE PROPERTIES FARTHER AWAY FROM THIS, THIS INTERSECTION, SO TO SPEAK, WHICH HAS THE HIGHEST TRAFFIC COUNT IN THE ENTIRE COUNTY, ARE GOING FOR MORE THAN WE PUT THIS FOR SALE FOR.

AND WE'RE CONSIDERING ACCEPTING AN OFFER THAT'S 25 PERCENT LOWER THAN THE REQUESTED PRICE. BECAUSE IT'S BEEN ON THE MARKET FOR ALL OF.

TWO MONTHS. AND I CAN'T SEE THE LOGIC IN THAT.

BUT. I'M NOT A REAL ESTATE AGENT.

BUT AFTER READING HIS SUMMARY, WELL, NOT ACTUALLY A SUMMER, READ HIS WHOLE REPORT, BUT I AFTER READING THE BROKER'S REPORT HERE, I STAND IN AGREEMENT WITH THE BROKER.

I DO NOT THINK THE CITY SHOULD LET THIS PROPERTY GO FOR SEVENTY FIVE PERCENT OF THEIR RECOMMENDED ASKING PRICE, WHICH IS ALREADY LOWER THAN COMPARABLE PROPERTIES IN LESS PRIME LOCATIONS. THANK YOU.

THANK YOU. HAPPY, MARY JOHNSON.

I'M I'M NOT IN FAVOR OF SETTLING FOR THIS PRICE.

WE'VE HAD SO MANY PROPERTIES COME BEFORE US THAT WE SHOT IT RIGHT BACK.

[01:40:05]

AND IT WAS A SMALLER AMOUNT.

WE'RE TALKING ABOUT 20000 DIFFERENCE OR TWENTY FIVE THOUSAND IN DIFFERENCE HERE.

WE'RE LOOKING AT 140000 IN DIFFERENCE AND WE'RE TALKING ABOUT SETTLING FOR THIS.

SO I'M NOT COMFORTABLE WITH THAT.

AND JUST MY OPINION, I DON'T SEE A WEDDING VENUE BEING A GOOD LOCATION FOR THIS.

YOU KNOW, RIGHT HERE.

BUT THE MAIN THING IS THE PRICE FOR ME, IT'S BEEN ON THE MARKET TWO MONTHS.

I SAY WE KICK IT BACK OUT, LET IT LET IT RIDE FOR A FEW MORE MONTHS OR HALF A YEAR, MAYBE EVEN A YEAR. YOU SEE HOW THE MARKET'S GOING RIGHT NOW.

OF COURSE, IT'S GOING TO COME BACK DOWN, BUT I DON'T SEE US.

I WOULD ENCOURAGE COUNSEL NOT TO SETTLE ON THIS PRICE.

WE HAVEN'T SETTLED OVER THE PAST YEAR AND THREE MONTHS.

WE HAVEN'T SETTLED ON ANY PRICE SO FAR.

SO WHY SHOULD WE SETTLE HERE? SO THAT'S ALL. THANK YOU, DEPUTY MAYOR JOHNSON.

ARE THERE ANY ADDITIONAL SPEAKER CARDS THAT THAT WAS THE ONLY ONE? I CONCUR WITH YOU. I THINK IT'S A LITTLE SLOW, AS I MENTIONED.

WE HAVE ONE SPOKE.

YOU SPOKE AS THE CHIEF, YOU SPOKE ON THIS SIDE MORE, RIGHT? NO, THIS.

OH, AS YOU WERE THEN SET FOR MASSACHUSETTS.

PLEASE, YES. POINT OF ORDER, STEP FORWARD.

BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.

MOST OF THE ITEMS THAT I HAD ON MY LIST HAS BEEN HIT AND TALKED ABOUT, WHICH IS A GOOD THING, AND THAT MEANS THERE WERE LIKE MINES ARE SEEING IT THE SAME WAY, WHICH I APPRECIATE. BUT AS I LOOK AT THIS, IT'S ONLY BEEN LISTED SINCE NOVEMBER 16TH.

LONG SHORT TERM ON THE ACTUAL MARKET, THE APPRAISED VALUE, LIKE YOU SAY, FIVE HUNDRED AND NINETY FIVE DOLLARS THE OFFER FOR 50.

SO THAT'S SHORTCHANGING THE CITY OF HUNDRED FORTY FIVE THOUSAND DOLLARS.

AND THAT FUNDS, I AGREE, WOULD BE NICE GOING TO THE ROAD MAINTENANCE FUND.

BUT I'D RATHER HAVE ONE HUNDRED AND FORTY FIVE THOUSAND DOLLARS MORE GO INTO THE ROAD MAINTENANCE FUND BECAUSE WE DON'T HAVE RIGHT NOW.

THAT WOULD BE A USABLE THING, RIGHT? I'D LIKE TO SEE A REASONABLE COUNTER OFFER, IF POSSIBLE.

TALK TO THE INDIVIDUALS THERE.

CONSIDER IT RIGHT.

ONE THING I DON'T WANT TO SEE IS THE LAND SALE.

JUST SO THE BUYER.

IT WAS BROUGHT UP JUST SO THE BUYER COULD TURN AROUND TOMORROW AND FLIP IT FOR A BIG PROFIT. I BOUGHT IT. I TOLD YOU, THIS IS WHAT I WANT TO DO, BUT I'M JUST GOING TO FLIP IT BECAUSE THE VALUE IS GREATER THAN WHAT I PURCHASED IT FOR, AND WE ALL LOOK AROUND WITH YOLK ALL OVER OUR FACE.

ALL RIGHT. SO MY QUESTION WOULD BE THE INDIVIDUAL IS TRYING TO DO THIS IF THE INDIVIDUAL SAYING THAT'S WHAT THEY WANT TO BUY A BOARD.

DO THEY EVEN MEET THE CURRENT BUILDING CODE FOR THE CITY OF PALM BAY FOR THIS SIZE OF DEVELOPMENT? WHAT WOULD IT BE? OR IS IT JUST GOING TO BE A LAND SALE FLIP? SO MY QUESTION IS WHERE IS THE GUARANTEE OF THE PROJECT BUILD? IF WE'RE GOING TO DO IT TO GET OUR MONEY, SEE A SEE A GUARANTEE WITH IT.

RICK, THANK YOU VERY MUCH.

THANK YOU, MS. CHIEF.

ANY ADDITIONAL SPEAKER CARDS? OK, SO COUNCILWOMAN OR DEPUTY MAYOR JOHNSON, I'M IN AGREEMENT.

I THINK THAT'S. AND HELLO, WHEN YOU'RE RIGHT, WE'VE DEBATED LESS THAN $20000, IF I REMEMBER CORRECTLY OR SOMEWHERE NEAR THEREABOUTS.

AND SO I THINK, YOU KNOW, BASED ON OUR DISCUSSION, I THINK WE'RE LIKE AT A, YOU KNOW, TWO TWO. IS THERE IS THERE A COUNTEROFFER WE WOULD WANT TO CONSIDER TO PROVIDE FOR STAFF? OH, YEAH, I THINK THE.

A OPPOSING OPPOSING MEMBERS OF THIS COUNCIL SHOULD THROW A NUMBER OUT.

YOU COMFORTABLE WITH DEPUTY MAYOR JOHNSON.

I ALREADY SHARED MY HEART.

I WOULD WANT, I WOULD WANT, YOU KNOW, THE ONLY THING I WANT, I WANT TO SAY THIS DEPUTY MAYOR TO SAY, WE, YOU KNOW, SEND EVERYTHING BACK.

THEY NOT ALL THE PARCELS ARE NOT THE SAME.

WHAT I'VE BEEN PRESENTED TO BEFORE THE COUNCIL, IT'S NOT THE SAME.

THIS IS A UNIQUE SITUATION WHERE.

I CAN'T I HOPE I'M WRONG.

WE'RE NOT GOING TO GET NEAR WHAT WE ASKING.

THAT'S JUST MY MY OWN EXPERIENCE BASED ON ON FACT.

BUT AGAIN, I'LL YIELD TO WHATEVER COUNCILWOMAN I DO.

I DON'T BELIEVE I THINK IT'S A DECENT DEAL FOR COUNCIL, BUT IF WE WANT TO COUNTER AND I'LL SUPPORT WHATEVER COUNCIL WANT TO DO, BUT I CAN TELL YOU IT'S I THINK IT'S IT'S A LITTLE OVER. WE DON'T HAVE A FAIR COMPARISON.

WE WE CAUSE A FAIR COMPARISON.

IT'S NOT JUST WHAT A PROPERTY IS LISTED FOR, IT'S WHAT WAS SOLD.

SO WHAT, WHAT WAS SOLD? AND AGAIN, I'M BEING CAREFUL.

[01:45:02]

I HAVE A PROFESSIONAL SITTING IN THE IN THE AUDIENCE.

IT'S WHAT WAS SOLD, A NUMBER OF PROPERTY THAT COMPARABLE THAT WAS SOLD IN THE LAST WITHIN A CERTAIN RADIUS.

THREE SOLD THREE CURRENTLY ON THE MARKET.

THAT'S ALL. YOU GET A GOOD VALUATION.

BUT THERE IS NO SUCH BASE.

I THINK JUST A NUMBER OF THE ALL REALTOR THROW OUT THERE.

BUT AGAIN, YOU KNOW, JUST I THINK WE SHOULD COUNTER.

GO AHEAD AND I'LL SUPPORT WHATEVER COUNCILWOMAN.

ALL RIGHT. HOLD ON.

COUNCILMAN FOSTER. I REALLY DON'T KNOW ABOUT A COUNTER, BUT.

WE'RE TALKING ABOUT A PROPERTY I KNOW PEOPLE SAY, WELL, HE COULD FLIP IT.

HE COULD. WE COULD SELL IT FOR FIVE POINT NINETY FIVE AND HE COULD STILL TURN AROUND AND FLIP IT. WE DON'T HAVE NO PRAISE VALUE OF IT, IT'S A COMMERCIAL PROPERTY.

WE HAVE AN OPPORTUNITY TO GET COMMERCIAL ON THAT PROPERTY AND GET IT ON THE TAX ROLLS.

I JUST DON'T SEE.

IT'S A UNIQUE PROPERTY WHERE IT'S BETWEEN THE HARLEY DAVIDSON, THE HYATT HOTEL AND A CHURCH, AND IT'S THE LAND.

AND IT'S GOT A BILLBOARD SIGN UP THERE BECAUSE I LOOKED AT THE PROPERTY, I WANTED TO BUY IT MYSELF, BUT THE CITY WOULD HAVE SAID, WE SELL IT FOR FIVE NINETY FIVE.

I WAS LIKE, NO, I'M NOT BUYING THAT.

I DON'T HAVE FIVE, NINETY FIVE.

SO I WOULDN'T. BUT YOU KNOW, I COULDN'T BUY IT ANYWAY.

BUT EVEN IF I HAVE FIVE 95, WHAT WOULD YOU PUT ON THAT PROPERTY? AND I DON'T SEE I DON'T SEE I DON'T SEE A FIT BETWEEN HARLEY DAVIDSON AND BASS PRO AND THE HYATT. WHAT WOULD BE IN IN A CHURCH? THAT THAT PROPERTY HAD VERY LITTLE PARKING.

WHATEVER THEY BUILD IS GOING TO BE VERY LITTLE PART.

AND THEN YOU'VE GOT TO DO A STORM WATER ON THAT, SO.

I REALLY, YOU KNOW, MAYBE HE WILL FLIP IT, BUT WE'RE GOING TO GET OUR MONEY.

IT DIDN'T COST THE CITY TO COUNCILMAN FELIX, THEY DIDN'T COST THE CITY VERY LITTLE MONEY TO ACQUIRE THAT PROPERTY AND FOUR HUNDRED AND NINETY FIVE THOUSAND GOING TO OUR ROAD FUND. AND PLUS WE HAVE A COMMERCIAL AND WE HAVE TAXES.

WE COULD SIT AROUND AND THE PERSON COULD WALK AWAY AND WE'RE WAITING FOR ONE YEAR, TWO YEARS. WE DON'T KNOW WHAT THE REAL ESTATE MARKET IS GOING TO DO, THE COMMERCIAL MARKET IS GOING TO DO. AND I DON'T HAVE A CRYSTAL BALL.

IT MIGHT BE GREAT. IT MIGHT SINK.

WITH INFLATION, I DON'T KNOW.

OUR INTEREST RATE GOING UP.

THAT'S WHY, YOU KNOW, SOMETIMES WHEN WE HAVE A UNIQUE PROPERTY, THAT'S A COMMERCIAL, MAYBE WE NEED TO DO A APPRAISAL ON IT, SEE WHAT'S THE TRUE VALUE? PROPERTY ON BANGKOK IS BABCOCK IS UNIQUE COMPARED TO BASS PRODRIVE.

I DON'T SEE TOO MANY CARS, I WAS OVER THERE TODAY, I DON'T SEE TOO MANY CARS DRIVING OUT BASS PRO DRIVE BECAUSE THAT'S WHAT SPORTSMEN LANE.

HEY. BECAUSE THAT'S WHAT THAT'S HOW YOU GET TO THE PROPERTY BARS PROS DRIVE TO SPORTSMAN LANE. I DON'T SEE TOO MANY CARS GOING GOING THROUGH THERE.

SO HOW ARE YOU GOING TO ATTRACT BUSINESS? WHEN I TRACK IT FROM EITHER HEIGHT OR THE BASS PRO, SO.

I THINK WE GOT A GOOD OFFER, SO I DON'T KNOW.

I'M NOT FOR COUNTER, I CAN DO IT YOU.

MARY JOHNSON MS. SUZANNE FELIX WHAT IS ALLOWED ON THAT PROPERTY? FIRST, THOUGH, BASED ON THE CURRENT ZONING, IT'S COMMUNITY COMMERCIAL, SOME OF THE THINGS ARE LISTED AS PRINCIPAL USES AND STRUCTURES.

I'LL JUST READ THROUGH SOME OF THEM SO YOU CAN PUT RETAIL STORES, SALES AND DISPLAY ROOMS, PERSONAL SERVICE ESTABLISHMENTS LIKE BEAUTY AND BARBER LAUNDRY, DRY CLEANING, PROFESSIONAL OFFICES, STUDIOS CLINICS, GENERAL OFFICES, GOVERNMENT OFFICES, BUSINESS SCHOOLS, SIMILAR USES, SCHOOLS, LIBRARIES, CHURCHES, OTHER USES, DAYCARE CENTERS.

YOU CAN HAVE RESTAURANTS, PUBLIC UTILITY EQUIPMENT AND FACILITIES, BANKS AND FINANCIAL INSTITUTIONS, BUSINESS SERVICE ESTABLISHMENTS THERE CAN BE CLUBS, LODGES AND FRATERNAL ORGANIZATIONS. FUNERAL HOMES ALSO HOTELS, MOTELS AND GUEST COTTAGES.

HOSPITALS AND NURSING HOMES, PLANT NURSERIES AND GREENHOUSES.

AND A VARIETY OF OTHER THINGS, LET ME SEE IF THERE'S ANYTHING ELSE HERE TO SHARE.

VETERINARY CLINICS.

NEW AND USED AUTOMOBILES.

MAJOR RECREATIONAL EQUIPMENT AND MOBILE HOME SALES AND RENTALS OUTSIDE AREAS WHERE MERCHANDISE IS DISPLAYED.

I'M SORRY, I'M GETTING INTO SOME OF THE CRITERIA.

SO THAT'S KIND OF THE HIGH LEVEL OVERVIEW OF SOME OF THE THINGS THAT ARE IN.

THE PRINCIPAL USES.

THANK YOU. SO IS THERE ANY MENTION OF A WEDDING VENUE? UH, THERE IS. LET ME SEE.

DO YOU KNOW WHERE THE SECTION IS THAT?

[01:50:04]

YOU'RE ASKING, DO I KNOW WHERE IT IS AND.

THEY WOULD HAVE TO REZONE IT.

YES, I'M GETTING A NOD BACK THERE.

OK, SO THAT'S CURRENT ZONING.

OK. ALL RIGHT. THAT'S WHAT I WAS GETTING AT.

OK. AS OF NOW, I'M FINE WITH I'LL MAKE THE MOTION.

WE'LL SEE HOW IT GOES. I MAKE A MOTION TO AUTHORIZE THE CITY MANAGER TO PROVIDE, TO NEGOTIATE AND PROVIDE A COUNTEROFFER TO THE APPLICANT.

A SECOND THAT. THE REASON WHY I DIDN'T GIVE AN AMOUNT BECAUSE GIVING AN AMOUNT ON THE DICE PUTS YOU ALREADY, YOU'RE BACK AGAINST THE WALL, SO I'D RATHER JUST LET THEM NEGOTIATE AND DO WHAT THEY HAVE TO DO AND THEN SEE IT FROM THERE IF IT COMES BACK AT A HIGHER RATE AND THEY WOULD GO WITH IT, OK? IF NOT, THEN WE GO AS SUCH.

BUT I THINK THIS IS THE MOST APPROPRIATE WAY TO MOVE FORWARD AS A CITY SIR AND DEPUTY MAYOR JOHNSON. THIS WILL COME BACK.

WHATEVER OFFER SHE HAS NEGOTIATED, THEY'LL COME BACK.

WE'LL COME BACK TO COUNCIL.

THERE'S A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY MAYOR MEDINA.

ANY ADDITIONAL DISCUSSION? ALL RIGHT, EMMA. ADDITIONAL DISCUSSION, YOU GIVE ME A SECOND.

THE TEAM OVER HERE WAS TALKING ABOUT THE SPECIAL CONDITIONAL CONDITIONAL USES THAT ARE ALLOWED IN THIS PARTICULAR DISTRICT.

I DIDN'T WANT TO, YOU KNOW, NOT GIVE THAT TO YOU IF WE NEED TO SHARE SOMETHING ADDITIONAL.

OH, BUT THAT'S. PALM BAY.

BUT THEY WEREN'T FOR THAT.

I THINK THE END RESULT IS THE CONDITIONAL USE FOR WEDDING VENUE APPARENTLY IS ONLY FOR FIVE ACRE PARCELS FROM WHAT WHAT WE'RE LOOKING AT.

OK, SO THAT WOULDN'T EVEN APPLY FOR THIS SCENARIO.

SO I'M SORRY TO INTERRUPT, BUT JUST WANT TO MAKE SURE THERE MAY BE SOME ISSUES WITH THAT KIND OF USE, YOU'RE SAYING.

ALL RIGHT. SO WHAT I'M HEARING IS THAT THEY WOULD HAVE TO DEFINITELY GO TO REZONING.

WELL, THEY MIGHT NOT EVEN BE ABLE TO LAND USED IN ZONING, YOU'RE SAYING.

WHAT THEN ON? IT'S NOT THE FIVE ACRES IS NOT REAL RESIDENTIAL.

AND I CERTAINLY DON'T WANT TO PUT ALEX ON THE SPOT, SO IT CERTAINLY THIS IS IT MAY BE AN ISSUE AS FAR AS THAT PARTICULAR USE AND UNLESS THERE.

I GUESS IT'S HOW THEY PLAN.

MAYBE THEY'RE JUST GOING TO HAVE LIKE A COMMUNITY CENTER TYPE OF BUILDING AND THEY'RE GOING TO USE IT FOR WEDDINGS OR WHATEVER.

BUT AS FAR AS WHAT WE HAVE AS FAR AS WEDDING VENUE, WE CONTEMPLATE SOMETHING MUCH LARGER.

I'VE GOT TO ADD HERE, IF WE COULD.

YES, AS I MENTIONED, THAT'S WHERE DURING HIS DUE DILIGENCE HE WOULD HAVE TO WORK WITH GROWTH MANAGEMENT TO SEE EXACTLY WHAT HE WANTED TO DO IF IT WAS A COMPLETELY OPEN VENUE, WEATHER AND THEN THE PARKING, THE STORM WATER, ALL OF THAT.

IT IS VERY SMALL, SO IT PROBABLY WILL NOT FIT THERE, BUT IT'S SOMETHING THAT HE WOULD NEED TO LOOK AT AND THAT POTENTIALLY COULD HE REZONE IT.

AND IF HE REZONING IT AND CHANGE THE FUTURE LAND USE, WHAT WOULD THAT BE SO THAT HE WOULD DETERMINE THAT DURING HIS DUE DILIGENCE PERIOD BEFORE WE WOULD COME BACK WITH A RESOLUTION TO ACTUALLY PURCHASE IT? THANK YOU, MA'AM. THANK YOU.

I BELIEVE COUNCILMAN FELIX WANTED TO WEIGH IN.

I MEAN, THE MY MY QUESTION WAS ANSWERED.

A WEDDING VENUE DOES DEFINE AS WHAT? BECAUSE IT'S A BUILDING, A BUILDING CAN BE USED.

I MEAN, AS LONG AS YOU HAVE A RECEPTION HALL, SOMEWHAT, IT CAN BE USED AS PLEASE.

THE REALITY OF THE MATTER IS, YOU KNOW, THE PLATE.

THE IDEA IS GREAT, BUT I DON'T THINK THE THE BUYER WOULD SOON REALIZE WHAT WHAT HE HAD IN MIND WOULD NOT BE A GOOD FIT.

SO ESSENTIALLY, I MEAN, WE CAN WE CAN SIT ON THIS PIECE OF PROPERTY EXCEPT IF THEY CAN PURCHASE THEIR.

PROPERTY BEHIND THEM OR.

MY VIEW IS SO MUCH YOU CAN DO WITH THIS PIECE OF PROPERTY AND WHAT WE THINK, WE THINK WE HAVE A PIECE OF GOLD. IT'S A GREAT LOCATION.

BUT, YOU KNOW, BECAUSE OF THE SIZE.

IT'S NOT, YOU KNOW, IT'S NOT THAT.

AND THAT'S WHERE THE BROKER HAD SOME ISSUES WITH THE CMA BECAUSE A LOT OF WHAT WAS SOLD WAS ACTUALLY ON BABCOCK, NOT BACK AND THE SIZE.

[01:55:01]

SO I KNOW IN TALKING WITH HIM HE HAD A DIFFICULT TIME TRYING TO COME UP WITH A NUMBER BECAUSE OF THE THERE WERE NORMALLY LARGER PARCELS AND THEY WERE ON THE MAIN ROAD.

SO THAT'S WHERE I HAD THE DIFFICULTY WITH THIS PARCEL.

EVEN IF YOU LOOKED AT THE CURRENT PROPERTY, WE GOT THE HOTELS.

EACH OF THE HOTELS ARE BUILT ON, WHAT, THREE ACRES.

SO AND THEY GO UP.

SO IT'S REALLY THERE'S SO MUCH YOU CAN DO.

AND IF YOU LOOKED AT THE PRICE, THE HISTORY ON THE PRICE OF THAT PIECE OF PROPERTY NEXT DOOR, IT'S NOT.

YEAH. SO BUT BUT ANYWAY, YEAH, I YIELD TO THE TO THE WISH OF THE COUNCIL THAT SENT IT BACK AND TALKED TO THE BUYER.

ADDITIONAL DISCUSSION, GENTLEMEN.

YEAH, I JUST WANTED TO SAY, AND I THINK.

UM, NANCY, YOU HIT IT RIGHT ON HER, NO.

BABCOCK IS DIFFERENT FROM SPORTSMAN LANE.

AND GREAT LOCATION, SMALL PROPERTY.

AND, YOU KNOW, WE GOT AN OFFER OF FOUR HUNDRED WHAT NINETY FIVE HUNDRED FIFTY THOUSAND DOLLARS FOR A SMALL ACRE OF LAND THAT IS LANDLOCKED BETWEEN.

WELL, HARLEY DAVIDSON, YOU ARE CORRECT AND THE CHURCH AND THEN IN FRONT OF IT, GOT THE HOTEL. AND IT'S VERY LITTLE.

I DON'T SEE HOW THEY COULD DO PARKING THERE WITH A STORMWATER.

OK. SO I THINK IT'S A GREAT DEAL.

WHAT THEY OFFER.

WE COULD GO AND NEGOTIATE AND THEY COULD WALK AWAY FROM IT.

WE JUST LOST $450000 AND WE'RE GOING TO WAIT TWO THREE FOUR FIVE SIX SEVEN EIGHT NINE 10.

I CAN KEEP COUNTING HOW MANY YEARS THAT PROPERTY IS GOING TO SIT THERE LIKE THAT.

SO. I'M NOT IN FAVOR.

WE ARE NOT IN FAVOR OF GOING BACK IN ACTION FOR OFA, TAKE IT AND TAKE THE MONEY AND RUN AND PUT IT IN OUR BOND.

SO THAT'S WHERE I'M AT.

THANK YOU. I GOT A MOTION BY DEPUTY MAYOR JOHNSON TO HAVE OUR CITY CITY MANAGER NEGOTIATE A DIFFERENT PRICE, NOT NOT RESTRICTING HER, AND I HAVE A SECOND BY THE MAYOR.

ANY ADDITIONAL DISCUSSION IN NONE, ALL IN FAVOR.

I. ALL THE POLLS.

WHAT WAS YOUR VOTE? THEY SO PASSES THREE TO ONE, PASSES THREE TO ONE FOSTER NAY.

WE ARE ON ITEM NUMBER TWO.

YES, MAYOR, PURSUANT TO DISCUSSION AT THE LAST MEETING, I HAVE PREPARED TWO AMENDMENTS TO THE COUNCIL'S POLICIES AND PROCEDURES.

THE FIRST ONE BEING TO INCLUDE LANGUAGE THAT REFLECTS A START TIME OF SIX P.M.

FOR THE REGULAR MEETINGS AND IN THE LEGISLATIVE MEMORANDUM.

I APOLOGIZE. I DID NOT INCLUDE THE EFFECTIVE DATE FOR THAT CHANGE, WHICH WOULD BE APRIL 1ST DUE TO ADVERTISING THAT HAS ALREADY OCCURRED.

AND ITEM NUMBER TWO IS TO INCREASE THE NUMBER OF BOARDS ON WHICH INDIVIDUALS MAY SERVE FROM TWO TO THREE BOARDS.

HEY, LET'S TAKE THAT ONE ITEM AT A TIME, DO WE HAVE SPEAKER CARDS? PETER FILIBERTO JOHNSON.

HOLD THEM OUT AS YOU.

PALM BAY IP, FILIBERTO, 226 THREE SPRING CREEK CIRCLE.

I'M SORRY TO JUMP BACK TONIGHT TO NEW BUSINESS NO.

ONE COUNCILMAN FOSTER I DID HEAR YOU SAY THAT THE SALE OF THE THIS PROPERTY HERE WOULD GO TO THE ROAD, BUT I JUST WANTED TO CONFIRM WAS THAT AN ERROR OR WOULD IT GO TO THE RMF? ROAD MAINTENANCE. SO WHEN YOU GO TO THE ROAD BOARD AND GO TO ROAD MAINTENANCE.

OK. ALL RIGHT. SORRY, MY.

MY APOLOGIES. I WANT TO CLARIFY THAT.

ALL RIGHT. CONSIDERATION FIRST, I WOULDN'T SAY FOR ITEM NUMBER TWO.

NOW WE'RE TALKING ABOUT THE START TIME FOR REGULAR MEETINGS AND TO INCREASE THE NUMBER OF BOARDS. I DID WANT TO MENTION THAT THIS ITEM IS STACKED FOR THE NUMBER OF BOARDS AND ALSO FOR WHAT TIME TWO MEANS YOU CAN START.

SO STARTING OFF WITH A MEETING TIME.

DID YOU EVER ASK YOURSELF WHY THIS STARTS AT SEVEN? I HAVE SOMEBODY WHO HAS SERVED WITH YOU ALL IN PRIOR.

SOMEONE WHO WORKED NINE TO FIVE CAME HOME, HAD DINNER WITH HIS FAMILY FROM 5:30 TO 6:30 AND IT CAME TO THIS DIOCESE.

7:00 P.M.. SO AGAIN, WORK NINE TO FIVE, CAME HOME FOR OUR DINNER TO SPEND TIME WITH HIS FAMILY AND THEN CAME TO SERVE HIS COMMUNITY AT SEVEN P.M..

IT'S BEEN SEVEN PM FOUR YEARS.

SO I HAVE TO I HAVE TO ASK MYSELF HERE.

WHY DO YOU WANT TO CHANGE IT? EITHER MY INITIAL THING IS TO DO NOT HAVE A JOB OR OUTSIDE COUNSEL, OF COURSE, OR DO NOT HAVE A FAMILY. SO THAT'S THAT'S MY CONCERN THERE FOR THE NUMBER OF BOARDS OF WHICH

[02:00:01]

INDIVIDUALS MAY SERVE.

I HAVE NO OBJECTION TO IT GOING FROM TWO TO THREE.

I FEEL THAT PERHAPS WE CAN DIG A LITTLE BIT DEEPER IN THE WELL TO THE RESIDENTS OF PALM BAY AND MAYBE SOME NOTICE NOTICES OR WHAT HAVE YOU.

BUT I APPRECIATE COUNCIL AND THANK YOU FOR HAVING ME HERE TONIGHT.

THANK YOU. ANY ADDITIONAL.

THE ONLY CARD. OK, SO ITEM NUMBER ONE, LET'S WE'RE GOING TO SPLIT THIS UP TO MAKE IT.

ANY FURTHER DISCUSSION YOU WANT TO ASK BECAUSE FOR A A MOTION? OK, I'LL MAKE A MOTION FIRST, I MAKE A MOTION TO APPROVE THE TO REVISE THE PORTION WHERE IT SAYS THE TIME WILL BE DETERMINED BY COUNSEL TO THE HOUR OF SIX P.M..

SECOND, A MOTION BY DEPUTY MAYOR JOHNSON, SECOND BY COUNCILMAN FELIX, AND I'LL SPEAK REAL QUICK. I LOOK AT IT FROM A DIFFERENT STANDPOINT.

YOU KNOW, I UNDERSTAND WHERE MR. FILIBERTO IS COMING FROM, WHERE HAVING DINNER WITH YOUR FAMILY.

BUT I LOOK AT IT ON THE OTHER SIDE, WHERE YOU CAN KISS YOUR FAMILY GOODNIGHT.

WELL, YOU KNOW, AFTER THE COUNCIL MEETING AND GO SEE THEM BEFORE THEY GO TO SLEEP, SO I LOOK AT IT ON THE OTHER STANDPOINT, YOU KNOW, GETTING FAMILIES, YOU KNOW, IN AND OUT.

YOU SAW IT HERE.

WE HAD SEVERAL DIFFERENT PEOPLE FROM THE MICHAEL GENE FOUNDATION AND OTHER OR, YOU KNOW, PEOPLE THAT GOT TO GET BACK TO THEIR FAMILIES AT A REASONABLE HOUR SO THEY CAN GO TO WORK BACK IN THE MORNING, FIVE A.M., EIGHT A.M.

NINE A.M. SO I JUST SAW IT AS A DIFFERENT WAY OF BEING EFFICIENT.

YES, IT'S BEEN THAT WAY FOR A WHILE, BUT IT'S NEVER, YOU KNOW, POLICY WISE.

7:00 P.M. WAS NEVER SET.

YOU KNOW, I'M LOOKING TO SET 6:00 P.M..

ANY ADDITIONAL DISCUSSION, COUNCILMAN? UM. YEAH, I WANT TO SAY SOMETHING THERE.

ALSO, THANK YOU FOR CORRECTING ME, MR. FILIBERTO. I MEANT THE ROAD MAINTENANCE.

THE COUNTY STARTS AT 10:00 10 A.M..

HAVE THEY COUNCIL MEETING AT 10:00? AND THEN WHEN THEY HAVE IN THE EVENING, I BELIEVE IT'S AT 6:00.

IN OTHER COUNCILMAN STARTS BEFORE.

SEVEN P.M.. SO.

UH, WE HAVE A STAFF.

THEY'VE BEEN HERE SINCE.

EIGHT, THIRTY NINE O'CLOCK IN THE MORNING.

AND THEY HAVE FAMILY, TOO, THAT THEY WANT TO GO HOME TO.

AND THEY HAVE, YOU KNOW, AND COOKED DINNER AND HAVE DINNER AND ENJOY THEIR EVENING.

THEY PUT IN A HARD STAY AT WORK, BUT THEY SACRIFICED.

WE HAVE PEOPLE THAT.

WE HAVE CHANGED THE ORDER IN OUR AGENDA TO TRY TO SPEED UP OUR COUNCILMAN.

AT THIS POINT, YOU KNOW, OUR COUNCIL MEETING IS.

I KEEP SAYING THIS, I'M GOING TO KEEP SAYING IT.

UM, YOU CAN WATCH THE SUPER BOWL AND THE SUPER BOWL WILL BE OVER WITH BEFORE WE FINISH A COUNCILMAN. SUPERBOWL IS LONGER THAN OUR COUNCILMAN.

OK. THIS IS CRAZY, AND I'VE BEEN TO OTHER CITY COUNCILS, AND THEY'RE VERY EFFICIENT AND THEY'RE VERY FAST ON GETTING THE BUSINESS OF THE CITY DONE AND.

AND THIS AND I'VE BEEN IN THAT FOR THIS, DICE THE DICE PRIOR TO US COMING ON BOARD.

THEY TOOK. I'VE BEEN THERE, THE COUNCILMAN, THE PRIOR COUNSEL BEFORE TWENTY TWENTY TWENTY. THEY TOOK I'VE BEEN IN A COUNCIL MEETING TO ONE O'CLOCK IN THE MORNING A COUPLE OF TIMES. LET'S SEE, MR..

SHE SAID, YEAH, I'VE BEEN THERE THE PRIOR COUNCILMAN.

THIS IS LUDICROUS.

WE CAN'T CONDUCT BUSINESS THIS WAY.

WE'VE GOT TO BE EFFICIENT.

WE NEED TO START ON TIME.

WE NEED TO START EARLY.

UM. AND WE HAVE TO ALL SACRIFICE THAT'S WHAT WE IN PUBLIC SERVICE, IF YOU'RE NOT IN PUBLIC SERVICE AND YOU DON'T, YOU'RE NOT WILLING TO SACRIFICE, THEN YOU NEED TO GET OUT OF PUBLIC SERVICE IF YOU'RE GOING TO HAVE TO SACRIFICE.

AND THESE GUYS, OUR STAFF.

IT'S SITTING AROUND A WHOLE HOUR BEFORE WE EVEN.

TWO HOURS BEFORE WE START COUNCIL MEETING.

SO I JUST FEEL THAT WE GOT TO WE GOT TO DO BETTER, I THINK WE CAN DO BETTER.

I THINK WE COULD BE MORE EFFICIENT.

I THINK WE COULD GET OUT OF HERE AT A DECENT TIME AND NOT AT 11.

NOT AT 12, AND I TRY TO.

I TRY NOT TO SAY MUCH BECAUSE I WANT TO GET OUT OF HERE AT A DECENT TIME, BUT SOMETIMES I GOT TO SPEAK ON ITEMS AND I WANT TO GET MY POINT ACROSS OR MAKE MY POINT HEARD TO THE PUBLIC. NOT SO MUCH OF MY COLLEAGUE TO PALM BAY WHAT MY MIND IS THINKING.

[02:05:02]

I THINK WE NEED TO HAVE EFFICIENT COUNSEL.

WE NEED TO DO IT EFFICIENTLY AT A DECENT TIME.

START AT SIX AND GET OUT AT A DECENT TIME AND DON'T ALLOW OUR STAFF TO BE HERE TO MIDNIGHT 11 30.

DRIVING HOME AT 11:30 AT NIGHT AND THEN GOT TO GET UP AND BUY HERE AT EIGHT OR NINE O'CLOCK. AND THESE ARE AND THESE THESE LADIES AND GENTLEMEN, MAKE DECISIONS ON WHAT HOW THE BUSINESS IS BEING DONE IN PALM BAY.

AND THEY NEED TO BE ATTENDED AND THEY NEED TO BE ALERT.

SO I'M ALL FOR CHANGING IT TO SIX O'CLOCK.

YEAH, I HAVE TO MAKE A SACRIFICE TO EVEN GET HERE AT SIX O'CLOCK BECAUSE I HAVE BUSINESS THAT I HAVE TO. I HAD TO STOP WHAT I WAS DOING TODAY JUST TO MAKE HERE ON TIME AND.

IT AFFECTED MY INCOME.

SO I HAD TO MAKE SACRIFICES TO BE HERE.

AND IT WAS INCOME.

BUT MY BUSINESS, I HAD TO STOP.

WHAT I WAS DOING JUST TO GET HERE ON TIME.

SO WE'RE ALL GOING TO MAKE SACRIFICES AT SIX O'CLOCK IS NOT TOO MUCH TO ASK.

THANK YOU, MARY. I GOT EXCUSE ME, I HAVE A MOTION BY DEPUTY MAYOR OF JOHNSON SEEING, MIKE COUNCILMAN, FELIX ANY ADDITIONAL DISCUSSION? SEEING NONE. MAY I JUST WANT TO SAY ONE THING I TEND TO YIELD TO THE MAJORITY RULE IT IN COUNCILMAN FOSTER.

YOU MENTION IT AND THEN DEPUTY MAYOR AS WELL.

WHEN WE LOOKED AT THE OVERALL IN TERMS OF STAFF, YOU KNOW, BEING HERE, YOU KNOW, 15 HOURS, TWICE A MONTH, SOMETIMES MORE.

I THINK IT'S ONLY FAIR IF WE CAN CUT IT DOWN.

I KNOW AN HOUR MAY NOT MAKE THAT MUCH OF A DIFFERENCE, BUT FOR THOSE THAT PUT 15 HOURS, I USED TO HAVE A JOB WHERE I USED TO PUT 15 HOUR DAYS, SO IT'S REALLY NOT FUN.

SO LIKE I SAID, I BELIEVE I YIELD TO THE TO THE, YOU KNOW, RULE OF THE MAJORITY.

IT SOUNDS LIKE THE MAJORITY IS ON BOARD.

I CAN REALLY HONESTLY GO EITHER WAY, BUT I YIELD TO TO ALL OF THE MAJORITY.

I'LL SUPPORT THE SIX. THANK YOU.

ANY ADDITIONAL DISCUSSION SEEING NONE.

I'VE GOT A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN FELIX, ALL IN FAVOR.

I NE MEDINA AND DANNY.

ITEM NUMBER TWO OF THAT ITEM WE AND JUST TO POLICE THIS A BIT.

DEPUTY MAYOR JOHNSON, WE RECEIVED THE SPEAKER CARD AFTER THE MOTION WAS MADE OR THE TIME CHANGE. SO NOW WE'RE STILL ON THE SAME ITEM, BUT THERE'S NO MOTION ON ON THE BOARD DISCUSSION THAT WE'RE HAVING.

SO CARRY ON SIR NATHAN WHITE.

ALL RIGHT, WELL, ANYONE WISH TO SPEAK.

WELL, NO COMMENT.

NO COMMON CARDS. ALL RIGHT.

I'LL ENTERTAIN A MOTION MAKE A MOTION TO INCREASE THE SLOT FOR MEMBERSHIP FOR COMMITTEES FROM TWO TO THREE. THEY GOT A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN FOSTER TO INCREASE THE MAXIMUM BOARD CIVILIANS ARE ALLOWED TO SERVE FROM TWO TO THREE.

ALL IN FAVOR.

I PASSED HIS UNANIMOUSLY.

I'D LIKE TO TAKE A BREAK IF IF YOU GUYS DON'T MIND.

BEFORE WE GET INTO COUNCIL REPORTS, THANK YOU.

JUST FIVE MINUTES.

SESSION AND WE'RE ON COMMITTEE AND COUNCIL REPORTS, SO I'LL START WITH COUNCILMAN FELIX

[COMMITTEE AND COUNCIL REPORTS]

ON MY LEFT. THANK YOU, MAYOR.

I WILL MAKE THIS SHORT.

JUST WANT TO SPEAK MORE ADDRESS THE THE RESIDENTS WHO MAY BE LISTENING RIGHT NOW.

WE'VE HAVE A CHALLENGE.

PEOPLE SERVING, IN FACT.

WELL, THE LAST THING WE DISCUSSED IS THE FACT THAT WE'RE OFFERING PEOPLE OPPORTUNITY TO SERVE THOSE THAT WANT BEEN SERVING, AND WE TRULY APPRECIATE THAT IF YOU EVER SERVE AND THEN CONTINUE SERVING, WE APPRECIATE YOUR SERVICE.

WE OPEN THE OPPORTUNITY FOR PEOPLE TO SERVE ON MORE BOARD.

BUT FOR THOSE OF YOU THAT HAVE INTEREST.

WANT TO SERVE AS QUITE, THERE'S ALWAYS OPPORTUNITY TO SERVE ON DIFFERENT BOARDS.

RIGHT NOW, WE HAVE QUITE A FEW VACANCIES.

LAST THE LAST MEETING, THIS LIST WAS QUITE SMALL.

[02:10:05]

IT SEEMS TO BE GROWING UNDER THE OPPOSITE DIRECTION.

SO I WOULD SURELY ENCOURAGE YOU.

2022 NEW YEAR'S RESOLUTION WILL THEY CONSIDER SERVING YOUR CITY? THANK YOU SO MUCH. THANK YOU.

COUNCILMAN FELIX COUNCILMAN FOSTER.

THANK YOU, MAYOR. YOU KNOW, COUNCILMAN FELIX TALKED ABOUT SERVICE.

THIS PAST MONDAY, WE CELEBRATE DR.

MARTIN LUTHER KING HOLIDAY.

AND THAT HOLIDAY IS MORE THAN JUST CIVIL RIGHTS VOTING OR.

YOU KNOW, IT'S ABOUT SERVICE THAT HOLIDAY IS ABOUT GOING OUT AND DOING SOMETHING FOR THE LEAST OF THESE.

OF, YOU KNOW, SERVING FOOD OR SERVING YOUR COMMUNITY AND.

AND THIS WAS MY ORIGINALLY MY MY REPORT, BUT I WANTED TO MENTION THAT AND WE NEED PEOPLE TO COME IN AND VOLUNTEER AND SERVE PALM BAY AND GIVE YOUR INPUT, YOUR VOICE, YOUR THOUGHTS, YOUR IDEALS MATTERS.

AND I ENCOURAGE PEOPLE NOT ONLY TO VOLUNTEER AND SERVE ON A BOARD OR SERVE IN THEIR COMMUNITY, BUT ALSO APPLY FOR JOBS IN PALM BAY.

IF YOU QUALIFY.

YOU GOT VACANCIES, YOU SHOULD APPLY.

I TRY TO POST A LOT OF THAT STUFF ON LINKEDIN.

NO, I AND I I CREATED A LINKEDIN TO CONNECT WITH OTHER CITY WORKERS THROUGH OUT OF OUR COUNTY AND THROUGHOUT THE STATE OF FLORIDA.

AND THAT'S WHAT MY LINKEDIN IS ABOUT.

TO TRY TO ATTRACT THE BEST PEOPLE TO BE INTERESTED IN WORKING FOR PALM BAY.

OK. AND AND BEFORE I RAN FOR COUNCIL, I SERVED ON BOARDS.

AND I DID COMMUNITY SERVICE THROUGHOUT THE COUNTY, AND I AND WHEN I'M OFF COUNSEL, I'M GOING TO STILL DO COMMUNITY SERVICE WITH MY CHURCH AND OTHER COMMUNITY ORGANIZATIONS, SO I REALLY ENCOURAGE THAT.

MY SECOND REPORT IS I'M GOING TO BRING I'M GOING TO BE BRINGING FORTH A RESOLUTION ON A RIDE-ALONG PROGRAM.

WE HAVE SOME ISSUES WHERE EVERYBODY NEEDS TO SIGN A WAIVER, SO I'M WORKING WITH THE CITY ATTORNEY TO COME UP WITH THE LANGUAGE IN THE CITY MANAGERS THAT COME UP WITH LANGUAGE FOR A RESOLUTION. UP TO THAT, RIGHT, A LOT RIGHT ALONG PROGRAM, WHETHER WITH THE POLICE FIRE PARKS, IT DOESN'T MATTER.

EVERYONE SHOULD NOT BE EXEMPT FROM SIGNING THE WAIVER AND ADHERING TO THE PROGRAM RIGHT NOW IN THE CITY COUNCIL ARE EXEMPT FROM THAT.

OK. MS. SUZANNE, CITY MANAGER, DO YOU HAVE ANYTHING? WHAT WE DISCUSS AS FAR AS THE POLICY? THE ONLY OTHER THING WE'RE LOOKING AT IS CREATING A ACROSS THE BOARD ADMINISTRATIVE CODE INTERNALLY TO GUIDE STAFF AND GIVE DIRECTION FOR CONSISTENCY AND HANDLING THAT.

YEAH. SO A RESOLUTION WILL WILL COME FORWARD.

NEXT COUNCIL MEETING.

I JUST WANT TO MAKE MY COLLEAGUES AWARE OF THAT.

THANK YOU, MAYOR. THANK YOU, DEPUTY MAYOR JOHNSON.

JUST ONE THING COUNCILMAN FOSTER.

YOU HIT IT RIGHT ON THE HEAD IN REGARDS TO JOB POSTINGS AND EVERYTHING, AND YOU THREW UP THE ALLEY OOP FOR ME. SO I'M ABOUT TO SLAM DUNK.

HERE WE GO. SO I'VE BEEN IN CONTACT WITH MS. RACHEL RUTLEDGE, WHO'S IN CHARGE OF THE CAREER AND TECHNICAL EDUCATION PROGRAM FOR BOVARD PUBLIC SCHOOLS, AND THEY HAVE FORTY EIGHT.

FORTY NINE. THEY HAVE A LOT OF PROGRAMS ALL THROUGHOUT BOVARD COUNTY, AND SEVERAL OF THEM COVER SOME OF THE JOBS WE HAVE AND SOME OF THE JOB OPENINGS WE HAVE HERE IN THE CITY OF PALM BAY. SO WHAT I'M LOOKING TO DO, WE'RE TALKING TO THEM TO CREATE AN INTERNSHIP PROGRAM WHERE A LOT OF THOSE KIDS WHO ARE, YOU KNOW, THEY'RE THERE READY TO HIT THE GROUND RUNNING. THEY CAN COME AND INTERN WITH THE CITY OF PALM BAY AND HOPEFULLY HAVE FULL EMPLOYMENT WITH THE CITY OF PALM BAY.

THEY'RE ACTUALLY THEY ALREADY HAVE, YOU KNOW, THE PIRATES TO POLICE PROGRAM.

AND AT PALM BAY HIGH, NOW THEY'RE GOING TO HAVE A FIREFIGHTERS PROGRAM.

WE'RE GOING TO NEED ADDITIONAL FIREFIGHTERS.

SO I THOUGHT THAT WAS A PERFECT SEGUE WAY UP IN TITUSVILLE, THEY HAVE, YOU KNOW, FOUR DISPATCHERS. THEY HAVE A PROGRAM UP THERE.

SO MAYBE WE CAN GET SOME OF THOSE KIDS FROM TITUSVILLE TO MOVE DOWN TO PALM BAY AND SUPPORT OUR POLICE DEPARTMENT, SUPPORT OUR CITY.

SO I'M ENCOURAGED BY THIS IS GOING GREAT.

I'M ALSO REACHING OUT TO EASTERN FLORIDA STATE COLLEGE CAREER SOURCE FIT.

I'M REACHING OUT TO EVERYBODY BECAUSE WE HAVE 27 JOB OPENINGS AND WE'RE GOING TO PROBABLY HAVE MORE OF THE WAY WE'RE EXPANDING AS A CITY.

SO, YOU KNOW, WHY NOT, YOU KNOW, YOU KNOW, DRAWING THE BEST WITHIN OUR CITY AND WITHIN OUR COMMUNITY WHEN WE HAVE THE CHANCE.

SO THAT'S THE ONLY THING I HAVE TO REPORT, MAYOR.

[02:15:04]

BUT JUST IN CASE YOU FORGET, I'M GONNA BRING UP SPACE COAST LEAGUE AT CITY, SPEAK ON IT.

THERE YOU GO. WELL, I'M A I'M A PAST THAT, MIKE.

I REALLY APPRECIATE ALL YOUR EFFORTS TOWARDS THIS MAN BECAUSE OUR CHILDREN ARE OUR FUTURE AND CULTIVATING THOSE RELATIONSHIPS AND GUIDING THEM.

THAT IS CRITICAL NOT ONLY TO OUR COMMUNITY, BUT TO OUR NATION, RIGHT? SO DON'T FORGET TO AFFORD THE OPPORTUNITY TO BECOME A UNITED STATES MARINE WHILE YOU'RE AT THAT BROTHER. JUST WANTED TO THROW THAT OUT THERE.

LISTEN, I JUST WANTED TO SHARE.

FIRST OF ALL, THANK YOU FOR ALLOWING ME TO SERVE AS AS MAYOR OF THE GREATEST CITY ON THE FACE OF THE EARTH. I HADN'T SAID THAT TODAY, SO I HAVE TO GET THAT OUT.

I HAVE TO CONTINUE TO SPEAK THAT GENTLEMAN.

I'M EXCITED TO TELL YOU ABOUT OUR MAYOR'S BALL AND I'LL GO AHEAD AND PASS THAT DOWN.

AND OUR MAYOR'S BALL IS IS COMING SHORTLY AND IT'LL BE MARCH 20.

SIX. 26, I BELIEVE, OR 20.

MARCH TWENTY SIX.

AND SO THE WHOLE PURPOSE OF THIS BALL IS TO TO GATHER FUNDS OR SACRIFICE PARK.

YOU'VE PROBABLY HEARD THAT BEFORE.

BUT LET ME JUST SHARE A LITTLE BIT OF MY HEART.

WE LOST TO TWO LAW ENFORCEMENT OFFICIALS IN APRIL OF NINETEEN EIGHTY SEVEN, AND THESE GENTLEMEN WERE.

ARMED WITH REVOLVERS, AND THEY FACED AN ENEMY THAT HAD AUTOMATIC WEAPONS.

WE'VE GROWN SINCE THEN, AND SO I WANTED TO TO GATHER FUNDS TO MAKE SACRIFICE PARK SOMETHING THAT HONORS THEIR SACRIFICE.

I BELIEVE THAT THE BLOOD THAT THEY SACRIFICED IS THE FOUNDATION OF THIS GREAT CITY THAT WE CALL PALM BAY. IT IS BUILDING A TRIBUTE TO THEM, AND I HOPE YOU'LL JOIN ME IN IT NOT ONLY AT THE BALL, BUT HELPING ME GATHER OTHERS TO TO PARTNER WITH US SO WE CAN GATHER THE FUNDS AND MAKE THAT SACRIFICE PART SOMETHING THAT WE CAN ALL BE PROUD OF AS A GROWING CITY, AS A GROWING METROPOLIS.

AS MOST OF YOU KNOW THAT THESE MEN AND WOMEN THAT DOWN THE UNIFORM DAY IN AND DAY OUT, THEY SACRIFICED SO MUCH.

THESE TWO LAW ENFORCEMENT OFFICIALS, THEY LOST THEIR LIVES.

THEY REPRESENT PALM BAY, AND I TRULY BELIEVE THAT THEY ARE THE FOUNDATION OF THIS GREAT CITY. WHAT THEY WHAT THEY SACRIFICED.

SO GENTLEMEN, THAT'S ALL FOR MY REPORT.

I HOPE YOU JOIN ME AND LET'S GET ALL THESE BUSINESS PARTNERS TOGETHER TO JOIN US IN AND MAKE THE SACRIFICE PART SOMETHING THAT WE CAN ALL BE PROUD OF AS BEING ONE HUNDRED AND TWENTY THOUSAND STRONG AND THE GREATEST CITY ON THE FACE OF THIS EARTH.

SO THAT IS MY REPORT.

I'M GOING TO YIELD TO MADAM SHERMAN, AND SHE MAY BE ABLE TO SPEAK A LITTLE BIT ABOUT THE THE SPACE COAST LEAGUE OF CITIES.

THANK YOU. THANK YOU, SIR. YES.

SO FIRST ON MY LIST IS A BIG SHOUT OUT TO A LOT OF GREAT PEOPLE THAT HELPED TO PUT TOGETHER THE SPACE COAST LEAGUE OF CITIES EVENT ANNUALLY.

IT IS AN EVENT THAT FOR THOSE WHO DON'T KNOW, THE CITIES ALL AROUND BREVARD COUNTY HOST THE SPACE COAST LEAGUE OF CITIES.

IT'S A GROUP OF IT'S COMPRISED OF LOCAL ELECTED OFFICIALS AND STAFF MEMBERS, AND WE MEET AND LEARN ABOUT DIFFERENT TOPICS AND NETWORK.

AND IN JANUARY, WE HAD THE OPPORTUNITY LIKE WE DO ANNUALLY TO HOST.

THIS WAS THE FIRST TIME THAT WE'RE AWARE OF THAT.

WE ACTUALLY DID IT AT A CITY FACILITY, AT LEAST IN RECENT YEARS, AND WE HOSTED IT AT THE SENIOR CENTER AND THE SENIOR CENTER, IF YOU DON'T KNOW, UNDERWENT A LOT OF RENOVATIONS.

AND SO OUR TEAM WORKED REALLY HARD TO JAZZ IT UP, I GUESS IS A GOOD WAY TO SAY IT.

AND SO I GIVE A LOT OF KUDOS TO JUDY DENNIS.

YES. IN THE CLERK'S OFFICE AND THE TEAM THERE, BECAUSE THEY PUT A LOT OF EFFORT INTO MAKING IT REALLY A GREAT VENUE FOR THE EVENT.

AND WE HAD LOTS OF STAFF MEMBERS FROM CITY ATTORNEY'S OFFICE, OBVIOUSLY CLERK'S OFFICE AND OUR ENTIRE TEAM WELL REPRESENTED AND IT WAS A GREAT EVENT AND I JUST APPRECIATE EVERYONE WHO PITCHED IN TO MAKE IT SUCCESSFUL.

UM, THAT'S NUMBER ONE, THE SECOND THING I WANT TO MENTION, JUST FOR THOSE WHO DON'T KNOW IS JANUARY 29TH, WHICH IS SATURDAY.

NEXT WEEK IS THE CITY'S MULTICULTURAL FESTIVAL.

SO IF YOU DON'T KNOW ABOUT IT, THIS IS GOING TO BE OUT AT FRED POPPI REGIONAL PARK.

NINETEEN FIFTY ONE MALABAR ROAD.

IT IS FROM 10 A.M.

TO EIGHT P.M.

WE'RE GOING TO HAVE OVER 18 FOOD TRUCKS, ONE HUNDRED AND TEN PLUS VENDORS, BANDS WITH LIVE MUSIC, CULTURAL DISPLAYS.

IT'S GOING TO BE A LOT OF FUN AND IT'S FREE.

SO I ENCOURAGE EVERYBODY TO COME OUT AND JOIN US.

LOT OF FOOD TRUCKS, I HEARD.

THAT'S WHAT I HEARD, TOO. SO DEFINITELY WORTH A VISIT.

SO COME OUT AND, YOU KNOW, TELL YOUR FRIENDS AND FAMILY AND GET PEOPLE FROM OUT OF TOWN TO COME. OUR GOAL IS TO MAKE THIS A GREAT CELEBRATION OF THE DIVERSITY OF PALM BAY AND TO

[02:20:02]

MAKE THIS AN ANNUAL EVENT TOO, WHICH WOULD BE KIND OF COOL.

LAST THING IS SOMETHING I'D REQUEST SOME CONSENSUS FROM COUNCIL ON, AND THAT IS RELATED TO THE DATE THAT WE WILL HOLD OUR 4TH OF JULY EVENT THIS YEAR.

SO THE TEAM HAS BEEN ABLE TO CONFIRM THAT EASTERN FLORIDA STATE COLLEGE WILL ALLOW US TO HOST THE EVENT THERE, WHICH IS GREAT.

THE QUESTION WE HAVE FOR YOU IS FOURTH OF JULY FALLS ON A MONDAY THIS THIS YEAR, AND OUR PREFERENCE WOULD ACTUALLY BE TO HOST THE EVENT ON A SATURDAY BECAUSE YOU CAN MAKE IT A BIGGER EVENT. YOU KNOW, IT'S IT'S MORE OF THE BIG WEEKEND TYPE ACTIVITY, BUT IT REALLY IS COUNCILS KIND OF DISCRETION AS TO WHETHER YOU'D WANT TO SEE IT ON A SATURDAY OR IF YOU WANT IT TO BE ON THAT MONDAY NIGHT.

WOULD IT BE JULY 2ND, THEN, IS WHAT WE'RE TALKING ABOUT, RIGHT? SATURDAY, JULY 2ND, CORRECT? YEAH. YEAH, I'M GOOD WITH THAT.

I DON'T KNOW HOW THERE'S THE COUNCIL.

DEPUTY MAYOR JOHNSON, WHAT ARE YOUR THOUGHTS? FINE EITHER WAY. OK, THANK YOU.

APPRECIATE THE CENSUS, DO IT FOR SATURDAY, WE COULD DO IT FOR SATURDAY.

ALL RIGHT, GREAT. I APPRECIATE IT.

WAS THAT ALL, MA'AM? THAT'S ALL FOR ME.

THANK YOU. SO NOW WE'RE ON OUR CITY ATTORNEY, ADAM SMITH.

[ADMINISTRATIVE AND LEGAL REPORTS]

NOTHING FURTHER. SO NOW DO WE HAVE ANY SPEAKER CARDS? THE ONLY ONE IN THE AUDIENCE THAT WISHES TO SPEAK.

[PUBLIC COMMENTS/RESPONSES]

THE PUBLIC WE ARE ON PUBLIC COMMENT.

THAT'S THE CHIEF. YOUR BATON, 586 OCEAN SPRAY STREET, SOUTHWEST, I HAVE A COUPLE OF ITEMS. WHEN WE WERE, WE WERE TALKING ABOUT THE.

RENNER THAT GOT THE FINE FROM CODE ENFORCEMENT, AND THE RENNER DIDN'T GET IT, BUT THE HOMEOWNER GOT IT FOR RENTING IT.

MY QUESTION IS THEN THAT THAT PROBABLY MEANS THAT INDIVIDUAL THAT OWNED THAT HOUSE WAS PROBABLY CLAIMING HOMESTEAD EXEMPTION, WHICH MEANS THEY WERE PROBABLY STEALING MONEY FROM THE CITY OF PALM BAY SO THEY COULD RENT THEIR HOUSE AND MAKE MONEY THAT NOW WE'RE SAYING, WELL, YOU SHOULDN'T HAVE TO PAY BECAUSE YOU WERE SKIRTING THE LEGAL SIDE OF IT, I CAN'T SAY THAT'S FOR SURE.

BUT IF IT'S THE SAME OWNER WITH THE SAME ADDRESS, THAT PROBABLY MEANS THAT THEY'RE APPLYING FOR HOMESTEAD EXEMPTION.

JUST SOMETHING TO THINK ABOUT ITEM NUMBER TWO WITH THE GET THEIR NAME CORRECT HERE, BUDDY. VOLUNTEERS OF AMERICA'S SPACE COAST COMMONS APARTMENTS.

WE'VE JUST VOTED FOR $3 MILLION.

WELL, YOU VOTED FOR $3 MILLION OF THE CARES ACT TO GO TO THIS PARTICULAR IDENTITY.

THIS IS WHERE WE MIGHT.

I DON'T KNOW HOW YOU WANT TO DO IT.

I'M JUST TRYING TO KEEP THAT KEEP THAT THOUGHT REVENUE OPEN SOMEHOW TO HELP THEM BECAUSE THIS IS THE FIRST ORGANIZATION IT'S ACTUALLY COME IN AND INVEST IN.

THEY'RE INVESTING $6 MILLION INTO WORKING TOWARDS OUR TOPIC THAT WE HAVEN'T BEEN ABLE TO SOLVE OURSELVES.

THEY'RE INVESTING $6 MILLION INTO IT.

WE MIGHT BE ABLE TO UNDER THAT CARES ACT THAT YOU VOTED FOR $3 MILLION TO ASSIST THEM SOMEHOW. ITEM NUMBER.

THREE, EXCUSE ME, I'M TRYING TO RUSH IS YOU VOTED FOR YOURSELVES TO START YOUR MEETINGS AT SIX O'CLOCK? I, BILL BATTIN AND SEVERAL OTHER INDIVIDUALS IN HERE ATTEND A LOT OF THE OTHER PUBLIC MEETINGS, NOT JUST THIS ONE WE HAVE TURNED ON AND THEY START AT SEVEN O'CLOCK AT NIGHT.

SO THE SAME STAFF IS HERE.

BUT NOW, INSTEAD OF A YOUTH SITTING UP THERE SAVING AN HOUR ON IT, BOARDS ARE HAVING TO START THEIRS AT SEVEN O'CLOCK.

SO MAYBE WE MIGHT WANT TO CONSIDER STARTING BOARDS AT SIX O'CLOCK.

ALSO, IT'S JUST FOOD FOR THOUGHT.

I PROMISE YOU, I'LL STILL BE ATTENDING THESE MEETINGS BECAUSE THAT'S THE WAY I AM.

I ON THE LAST ONE IS DON'T FORGET WE HAVE A SPECIAL ELECTION COMING UP IN MARCH.

YOU'RE IN MUCH TALK, MUCH TALK ABOUT IT, BUT IT'S AN IMPORTANT THING.

SO THE PEOPLE THAT ARE TRYING TO BE ACTIVELY INVOLVED IN THE CITY OF PALM BAY, THAT IS THE NUMBER ONE RESPONSIBILITY OF THE VOTING INDIVIDUAL YOU HAVE SEE ALL ON MARCH AND MARCH. THANK YOU.

THANK YOU. IS THERE ANYONE ELSE THAT WISHES TO SPEAK? SO MADAME SHERMAN NOW IS VOLUNTEERS OF AMERICA, PART OF THE WELL, WHILE ALFIE COMES UP PART OF, YOU KNOW, THAT INVITATION OF WHAT WE VOTED ON TO PARTNER.

WERE THEY ON OUR LIST? WELL, WE'RE STILL WORKING ON THE RFI, RFI FOR THE ARPA FUNDING THAT WE DISCUSSED, SO THAT WILL COME TO YOU AT THE NEXT COUNCIL MEETING.

WE HAVE A FINAL DRAFT.

WE'RE IN THE HOMESTRETCH ON THAT.

I DON'T KNOW ENOUGH ABOUT VOA, BUT FROM WHAT I HEARD TONIGHT, IT SOUNDS LIKE THEY COULD BE ONE OF THE NONPROFITS THAT COULD APPLY, BUT WE ARE GOING TO SEND IT OUT TO ALL THE NONPROFITS I'LL BE AWARE OF.

ALL RIGHT. SO THAT WE KNOW EVERYBODY CAN APPLY.

WHO'S INTERESTED? SO IT'D BE GREAT THAT I THINK MR. CHIEF HAS A GOOD SUGGESTION.

THEY THERE THEY ARE ALREADY WELL INVESTED INTO THE COMMUNITY.

SO DEPUTY MAYOR JOHNSON, YOU HAD SOME.

YES. WELL, I'LL SAY IT.

[02:25:01]

SO THEY THEY HAVE NO EXEMPTIONS THAT THAT HOUSE.

THE HOUSE WITH THE LENS, WE LOOK WITH THE CODE LENS AT.

NO, THEY HAD NONE.

THEY HAD NONE. AND THEN WITH WITH THE BOARDS, I LOOKED IT UP AS WELL BECAUSE THAT WAS A CONCERN OF MINE TOO.

TO SOME OF THE BOARD STARTED SIX.

SOME OF THE BOARDS STARTED SIX 30, SOME START AT SEVEN.

SO THERE'S A LOT OF INCONSISTENCY ACROSS THE BOARD.

SO I'M WITH YOU ON THAT.

SO THAT'S ALL ALL ALFIE GALLERY.

ANYONE ELSE? IT'S GOING TO BE A GOOD NIGHT AGAIN.

GOOD NIGHT, MR. MAYOR. IT'S NOT I DON'T THINK IT'S A PROBLEM OR AN ISSUE.

WE'RE PROPERTY FOR SALE IS BEING NEGOTIATED.

IT'S A PRINCIPLE OF SELLING PROPERTY TO HAVE A COUNTEROFFER AND NEGOTIATE BECAUSE MOST OF THE TIME WHEN YOU PUT THE PRICE UP, YOU KNOW, THE PEOPLE WILL ALWAYS SAY, WELL, I'M GOING TO PAY TEN THOUSAND LESS OR 50000 LESS.

SO IT'S NOT A PROBLEM TO NEGOTIATE AND COUNTEROFFER.

I THINK THAT'S A BUSINESS PRINCIPLE.

WE ARE A PROPERTY IS CONCERNED, SO DON'T FEEL BAD OF SENDING THIS ONE OUT FOR A NEGOTIATION. I THINK THAT'S A GOOD IDEA.

YOU KNOW, PROPERTY IS EXPENSIVE.

IT GOT REGULAR LOTS A QUARTER OF AN ACRE SELLING FOR $60000 OUT HERE WITH SEWER AND ON CITY WATER. YEAH, SIX TO SEVENTY THOUSAND DOLLARS.

YEAH. OH, I KNOW ONLY THEY BUILD IT.

YOU KNOW, I'M IN THE CONSTRUCTION ALL.

THEY BUILD IT JUST BY 11 LOTS DON'T HERE IN PALM BAY WITH SEWER AND CITY WATER.

SIXTY FIVE THOUSAND DOLLARS A LOT.

SO YOU KNOW, THAT'S WHAT I MEAN, YOU KNOW, SO THINGS HAPPENING LIKE THAT.

SO PLEASE NEGOTIATE WHEN WHEN PRICES COMES IN DOESN'T HURT ON THE ON THE TIME FOR THE MEETING. WELL, I AM VERY DISAPPOINTED IN IT BECAUSE I DON'T THINK THEY'RE GOING TO MAKE IT THAT SOME OF THE MEETING I'M A I'M A WORKER, I WORK PRETTY HARD A LOT OF HOURS AND MOST OF THE TIME I'D BE RUSHING TO GET TO THE MEETING FOR SEVEN.

BUT THAT'S OK.

I'LL TRY TO RESCHEDULE MY, YOU KNOW, BASIC SCHEDULE.

AND I'M. MS. SAID THE VOTERS NEED TO COME OUT.

WE HAVE THIS ELECTION ON ON THE 8TH OF MARCH AND PLEASE COME OUT AND VOTE BECAUSE THAT'S THE MAIN THING WITH THE ELECTION AND AT LEAST YOU GET THE CHANCE TO VOICE YOUR VOTE.

THANK YOU. GOOD NIGHT. THANK YOU.

ANYONE ELSE WISH TO SPEAK? SEEING NONE. THIS MEETING IS ADJOURNED.

SIR.
