SO IT GIVES ME GREAT JOY TO PRESENT THIS PROCLAMATION.

I KNOW THE HISTORY OF OF THIS, AND MOREOVER, I'LL JUST DWELL RIGHT INTO IT.

BUT I HAVE SO MUCH TO SAY THAT I DON'T WANT TO.

I JUST DON'T WANT TO DRAW THE ATTENTION TO WHAT I HAVE TO SAY RIGHT NOW.

WHAT I WANT TO DO IS DRAW THE ATTENTION ON A LEGACY OF A MAN THAT TOOK IT ON THE CHIN FOR EACH AND EVERY ONE OF US IN BREVARD COUNTY.

SO I'M GOING TO ASK THAT UTB MEMBERS, CARMEN AND HER TEAM, COME JOIN ME.

AS YOU WERE. SAMANTHA.

SAMANTHA, COME ON UP.

COME ON. IT IS HEREBY PROCLAIMED BY THE MAYOR OF THE CITY OF PALM BAY, THE GREATEST CITY ON THE FACE OF THE EARTH, BREVARD COUNTY, FLORIDA, THAT WHEREAS

[00:05:02]

NATIONAL HISPANIC HERITAGE MONTH IS AN OPPORTUNITY TO RECOGNIZE AND CELEBRATE THE MANY AMERICANS OF HISPANIC DESCENT WHO HAVE MADE OUTSTANDING ECONOMIC, EDUCATIONAL AND CULTURAL CONTRIBUTIONS NOT ONLY TO OUR CITY, BUT OUR STATE AND OUR NATION.

AND THAT EXCITING.

THE PARADE IS HOSTED BY UTB UNITED THIRD BRIDGE, INC.

EDUCATIONAL AND CULTURAL.

HE MOVED TO BREVARD COUNTY IN 1993 AND ESTABLISHED BREVARD COUNTY'S ANNUAL PUERTO RICAN DAY PARADE IN PALM BAY, FLORIDA, HOSTED BY UTB EDUCATION AND CONTROL FUND.

AS THE PUERTO RICAN TRADITION AND AS A GIFT TO ALL HISPANICS OF ALL HISPANIC DESCENT, WHICH HAS GROWN INTO THE LARGEST COUNTY CELEBRATION OF PUERTO RICAN HERITAGE. YOU KNOW, I REMEMBER THAT.

AND IT WAS BACK ON PORT MALABAR BOULEVARD BY VETERANS PARK IS HOW THAT ROUTE OF THE PARADE WAS WAY BACK IN THE DAY.

I WON'T I WON'T LIST MY AGE, THOUGH, SAMANTHA.

WHEREAS THIS YEAR'S NATIONAL HISPANIC HERITAGE MONTH THEME IS UNIDOS INCLUSIVITY FOR A STRONGER NATION.

I'M HONORED. THANK YOU.

I KNOW MY FATHER, SAMMY WILL SEE LOPEZ SMILING DOWN ON US AND IS VERY PROUD OF ALL THAT WE HAVE DONE, ESPECIALLY THIS YEAR DURING SPANISH HISPANIC HERITAGE MONTH LEADING UP TO THESE VERY SPECIAL HISTORICAL EVENTS.

ON BEHALF OF THE BOARD OF DIRECTORS OF UTB UNITED THIRD BRIDGE, INC.

THANK YOU AGAIN.

AND WE LOOK FORWARD TO SEEING ALL OF YOU THIS SATURDAY, OCTOBER 22ND, RIGHT HERE IN PALM BAY.

MAYOR, SAY IT.

WHAT IS PALM BAY? GREAT. GREAT.

GREAT CITY. FACE OF THE EARTH.

I LIKE WHEN YOU SAID. I LIKE WHEN YOU SAY IT RIGHT HERE.

OUR 25TH ANNUAL PUERTO RICAN DAY PARADE AND MULTICULTURAL FESTIVAL DEDICATED TO OUR FOUNDER, OUR FOUNDER.

AND MY FATHER, SAMMY WILL SEE.

LOPEZ. IT'S FREE TO THE PUBLIC.

THANK YOU AGAIN.

AND MAY GOD BLESS YOU ALL.

WHO ARE? THEY SAID, JUST WANT TO SAY THIS IS THE VERY FIRST TIME THE VERY FIRST TIME THIS PARADE TAKES PLACE WHERE SAM LOPEZ WAY WAS DEDICATED, THE ENTRANCE WAY INTO CITY HALL.

AND THE REASON JUST HAS A POINT OF HISTORY.

MAYOR ED GUY OR FORMER MAYOR ED GUY CAME TO THIS PODIUM AND SAID, YOU KNOW, SAM LOPEZ AND I WERE, YOU KNOW, AT ODDS IN MANY TIMES IN MANY CIRCUMSTANCES.

HOWEVER, HE DID TAKE IT ON THE CHIN FOR THIS COMMUNITY.

AND SINCE HE BEAT A PATH TO CITY HALL, I THINK IT'S FITTING FOR US TO NAME THAT PATH.

SAM LOPEZ WAY.

SO THAT IS SO, SO ENCOURAGING FOR ME AS I'VE SEEN THE HISTORY OF THIS EVOLVE, THE SACRIFICES THAT YOUR FATHER MADE FOR ALL HISPANICS, ALL MINORITIES WITHIN BREVARD COUNTY.

WHEN I SAY HE TOOK IT ON THE CHIN, HE TOOK IT ON THE CHIN FOR ALL OF US, AND WE WERE AT ODDS.

WE WERE ON OPPOSITE SIDES OF THE SPECTRUM, AS YOU KNOW.

I'VE SHARED THAT WITH YOU.

BUT I HONOR AND RESPECT HIS LEGACY.

I HONOR WHAT HE DID FOR ME AND MY FAMILY AND THOSE THAT ARE IN THIS COMMUNITY.

SO TODAY WE PROCLAIM THAT OCTOBER 22ND IS PUERTO RICAN DAY.

RIGHT. AND WE'RE GOING TO CELEBRATE WITH FOOD AND DANCING.

AND IT'S JUST GOING TO BE AN EXCITING TIME.

SO I WELCOME EACH AND EVERY ONE OF YOU TO COME OUT FORCE THROUGH A RELATIONSHIP BECAUSE WE'RE ALL AMERICANS.

WE'RE PUERTO RICAN AMERICANS.

HURRAH! SO COME ON OVER.

COME ON, LET'S TAKE A. COME ON.

COME ON. THIS. AND WHAT ARE YOU GOING? THANK YOU. THANK YOU SO MUCH.

THANK. SO TONIGHT.

I HOPE YOU ALL ARE.

NOW. THAT WAS EXCITING, WOULDN'T IT? YES, SIR. I DON'T KNOW. I FEEL LIKE PARTYING, GUYS.

LET'S START DANCING. RIGHT.

OKAY, SO A LITTLE BIT OF SALSA, WEPA.

SO WE HAVE A.

THANK YOU, MA'AM. THANK YOU FOR ALL YOU DO.

GOD BLESS YOU, YOU GUYS.

WHAT, BECOMING DEPUTY MAYOR?

[PUBLIC COMMENTS/RESPONSES]

WE'RE GOING TO START OFF WITH TIM BLAND, FOLLOWED BY BILL BRATTON.

SECONDS, SIR.

YES, SIR. CARRY ON.

I KNOW YOU'RE NOT THAT OLD.

YOU'RE ONLY LIKE, WHAT, 32? COME ON. PRAISE THE LORD.

COME ON. HE COULDN'T EXIST.

TIM BLAND, 1992, WIND BROOK DRIVE, PALM BAY.

TALK ABOUT WHAT I ALWAYS WANT TO TALK ABOUT.

AND THAT IS PALM BAY IS THE LARGEST CITY IN BREVARD COUNTY BY POPULATION AND LAND MASS.

PALM BAY IS ALSO THE 10TH LARGEST CITY IN THE STATE OF FLORIDA.

THE STATE OF FLORIDA ADVERTISES ITSELF AS THE GOLF CAPITAL OF THE WORLD, YET PALM BAY DOES NOT HAVE A GOLF COURSE.

[00:15:01]

THERE'S STILL REMNANTS OF A GOLF COURSE THERE THAT ARNOLD ARNOLD PALMER HIMSELF HELPED DESIGN.

HE'LL NEVER DESIGN ANOTHER GOLF COURSE AGAIN.

THE TEE BOXES ARE THERE, THE FAIRWAYS ARE THERE, THE BUNKERS ARE THERE, THE GREENS ARE THERE.

IT JUST NEEDS PROPER OWNERSHIP AND MAINTENANCE.

I CAN'T BELIEVE THAT THE CITY OF PALM BAY HAS NOT CONSIDERED GIVING THEIR 120,000 RESIDENTS, WHICH I MIGHT ADD, PROBABLY, YOU KNOW, IF 10% OF THEM PLAY GOLF, THAT'S 12,000.

IF 5% OF THEM PLAY GOLF, THAT'S 6000.

THAT'S A LOT OF ROUNDS OF GOLF.

THAT THING IS A GOLD MINE.

I JUST CAN'T BELIEVE THAT THE CITY IS NOT CONSIDERING PURCHASING THAT GOLF COURSE.

IT'S A BEAUTIFUL PIECE OF PROPERTY IN BAYSIDE LAKES.

IT'S GOT TONS AND TONS OF OPPORTUNITIES THERE.

I UNDERSTAND THAT MAYBE SOMEBODY IS INTERESTED IN PURCHASING IT, BUILDING A PUTT PUTT GOLF COURSE THERE, PUTTING SOME BATTING CAGES IN, MAKING IT REALLY A COMMUNITY CENTERED EVENT VENUE.

PLEASE, I ASK YOU.

AT LEAST CONSIDER IT.

BUT NO WAY DO WE WANT ANY REDEVELOPMENT OF 367 HOMES ON THAT PROPERTY.

ONE HOME PER FIVE ACRES OR A FARM.

I BEG YOU. I BEG YOU TO PLEASE CONSIDER IT.

UH, YOU KNOW, I'M A LITTLE TAKEN ABACK THAT MANY, IF NOT ALL, OF YOU AREN'T KIND OF EMBARRASSED THAT WE DON'T HAVE THIS KIND OF FACILITY IN THE CITY OF PALM BAY.

PLEASE, PLEASE CONSIDER IT.

THANK YOU. THANK YOU.

SO, BATON FOLLOWED BY ANTON.

SILVERTON 586 OCEAN SPRAY STREET SOUTH WEST AT REGULAR COUNCIL MEETING.

2022 26 UNDER RESOLUTION 2020 2242 THE CITY COUNCIL WAS CORRECT.

I INTERRUPTED THE COUNCIL MEETING UNDER A POINT OF ORDER, AND YOU WERE ABSOLUTELY CORRECT.

IT WAS THE PLAINTIFF'S REBUTTAL AT THAT TIME, AND I'M APOLOGIZING TO CITY COUNCIL AT THIS TIME FOR THE EXTRA 60 SECONDS I TOOK FOR INTERRUPTING OF THAT MEETING. I APOLOGIZE FOR THAT AT THIS TIME.

THANK YOU VERY MUCH.

I WAS WRONG.

IT'S FOLLOWED BY DAVID AVILA.

ANTON. ANTON.

GOOD EVENING, MR. MAYOR AND STAFF COUNCIL.

I JUST WANT TO MY HEADDRESS.

THIS 1681 WICHITA BOULEVARD, SOUTHEAST.

AND I WANT TO TELL YOU. THANK YOU.

SOMETHING WAS FINALLY DONE FOR THE SPEEDING ON WICHITA BOULEVARD.

I DON'T KNOW IF YOU WERE AWARE OF IT, BUT THEY CAME OUT AND SET UP AND TOOK SOME SPEED TRAFFIC AND THEY GAVE A COUPLE OF TICKETS.

AND ALSO WE GOT A MONITOR UP NOW, BUT A LIGHT.

AND IT HELPS A LOT.

A LOT. AND I WILL CONTINUE TO CUT THE GRASS ON THE OPPOSITE SIDE BECAUSE THE KIDS WILL NOT WALK ON THAT HIGH GRASS.

BUT I JUST WANT TO SAY THANK YOU AND I REALLY APPRECIATE IT ON MY BEHALF.

THANK YOU. YOU.

DAVID AVILA, FOLLOWED BY RENTAL CHAYEFSKY.

MY NAME IS DAVID AVILA. I USED TO RESIDE AT 941 RIVIERA DRIVE, PALM BAY, FLORIDA, UP UNTIL 2006 WHEN I CHOSE TO MOVE OUT OF PALM BAY.

SO SINCE THEN, I HAVE NOT HAD A SINGLE ARREST OR A TICKET.

BUT WHILE LIVING IN PALM BAY, FLORIDA, FOR A SHORT DURATION OF TIME THAT I DID, I WAS ARRESTED FOR THINGS LIKE.

MILDEW ON THE EXTERIOR WALLS OF A HOUSE THAT I DID NOT OWN.

I WENT TO TRIAL. I WAS ACQUITTED.

I WENT TO JAIL FOR MAJOR AUTO REPAIRS AND A RESIDENTIAL AREA WORKING ON MY CAR, MY DRIVEWAY NON RESTRICTED.

[00:20:05]

I WENT TO JAIL FOR AGGRAVATED ASSAULT ON A LAW ENFORCEMENT OFFICER, WHICH SIMPLY GOING AROUND HIM, WE'RE IN TRIAL.

HE WAS HE TESTIFIED THAT HE SAW HE SAW ME AND I DID SOMETHING AGGRESSIVE TOWARDS HIM OR THE HOMEOWNER CONTRADICTED THAT.

MY OWN TESTIMONY CONTRADICTED THAT BECAUSE I DID NOT EVEN KNOW IT WAS A COP.

THESE OFFICERS WERE OUT TO GET ME.

AND IT CAN BE PROVEN IN THEIR OWN NARRATIVE STATEMENTS WHERE THEY SAY THEY WENT AND THEY SOUGHT OUT THINGS TO ARREST ME FOR THESE OFFICERS WENT AND THEY HAD AN UNDERCOVER STING, KNOCKED ON MY DOOR, ASKED ME TO WORK ON THEIR CAR.

AND THEN WHEN I DID, THEY ARRESTED ME FOR RUNNING A BUSINESS WITHOUT A LICENSE.

I WENT TO TRIAL.

I WAS FOUND NOT GUILTY.

THIS GONE ON AND ON AND ON AND ON.

37 TIMES I WAS ARRESTED IN MY LIFE IN PALM BEACH, FLORIDA, BEFORE I MOVED IN PALM BAY, FLORIDA.

ZERO ARREST, ZERO TICKETS MOVED OUT OF PALM BAY, FLORIDA.

ZERO ARREST, ZERO TICKETS.

THERE'S WAY MORE TO IT THAN THAT.

THAT'S WHY I ASK THAT YOU GUYS HAVE THE PAPERWORK IN FRONT OF YOU TO WHERE YOU COULD SEE.

UNTIL THIS DAY, I HAVE NO JUSTICE.

THEY TURNED IT DOWN IN 2017 SAYING THAT THE VIDEOS WERE NOT SUFFICIENT.

WELL, I PRODUCED VIDEOS EVERY WAY I CAN THROUGHOUT THE INTERNET, THROUGHOUT THE 18 JUDICIAL CIRCUIT COURT CORRUPTION WEBSITE ON FACEBOOK, AS WELL AS MORE DOCUMENTS THAN YOU HAVE BEFORE YOU TODAY THAT SHOW THE POLICE NARRATIVES AND EVERYTHING THAT I HAVE THAT I'VE BEEN HANGING ON TO ALL THIS TIME BECAUSE I WANT JUSTICE.

TIRED OF WAITING. I WANT MY LIFE BACK.

I DON'T WANT TO HAVE THIS RECORD.

ONE, I WANT TO GO OUT AND NOT HAVE TO EXPLAIN WHAT HAPPENED IN PALM BAY, FLORIDA.

I DON'T WANT THAT NO MORE.

I WANT TO GONE. THANK YOU FOR HERE.

YOU. WE HAVE RENTALS FOLLOWED BY PHILLIP CORCORAN.

GOOD EVENING, COUNSEL. RANDAL OLSZEWSKI, 348 BROOK STREET, NORTHEAST.

I HOPE YOU ALL DOING WELL THIS EVENING.

FIRST THING I'D LIKE TO BRING UP IS I'D LIKE TO GIVE A PLUG, IF YOU WILL, FOR A LOCAL ORGANIZATION REFERRED TO AS PALM BAY LIVE.

PALM BAY LIVE IS GOING TO BE EDUCATING OUR COMMUNITY NEXT WEEK IN THE FORM OF CANDIDATE INTERVIEWS FOR THE SEAT FOR RACE.

BOTH CANDIDATES WILL HAVE THEIR OWN INTERVIEW AND A DEBATE SPONSORED BY PALM BAY LIVE.

PALM BAY LIVE IS ALSO GOING TO RUN A PANEL DISCUSSION ON THE CHARTER AMENDMENTS THAT WILL SHOW UP ON YOUR BALLOT.

SO ANYBODY LISTENING, MAKE SURE YOU FOLLOW IN PALM BAY LIVE NOW SO YOU GET ALL OF THE NOTIFICATIONS FOR WHEN THEY'RE GOING TO START NEXT WEEK AND GET YOURSELF EDUCATED.

DON'T GO TO THAT BALLOT BOX IN NOVEMBER WITHOUT UNDERSTANDING EVERY SINGLE ITEM ON THAT BALLOT.

AND YOU KNOW, JUST A LITTLE PIECE OF ADVICE.

DON'T JUST RUN THE PARTY TICKET EITHER.

YOU KNOW, IT'S NONPARTISAN RACES, SO YOU SHOULD REALLY CONSIDER WHO THE INDIVIDUALS ARE AND VOTE BASED UPON THE INDIVIDUAL.

THAT BEING SAID, I'D LIKE TO ENGAGE IN A LITTLE BIT OF A PRACTICE THAT I'VE BEEN DOING LATELY OF PLANTING SEEDS.

ANYBODY PAYS ATTENTION TO PLANNING AND ZONING MEETINGS, IT'S NOTICED I'VE BECOME A NATURAL JOHNNY APPLESEED, AS I MIGHT CALL MYSELF, AND I HOPE YOU ALL ARE PAYING ATTENTION TO THAT. AND YOU KNOW, I HAVE JUST TAKEN A HARD STANCE ON PUBLIC SAFETY IN CONCURRENCE WITH MY COUNSEL, AND I REFUSE TO BACK DOWN FROM IT.

AND I'LL CONTINUE TO PLANT SEEDS IN THAT VEIN.

BUT THERE'S OTHERS. SO TODAY I WANT TO PLAY IN A LITTLE SEED, AND FIRST I'M GOING TO TELL YOU A LITTLE STORY.

SO I WAS DRIVING NORTH ON BABCOCK, HEADING RIGHT TOWARDS MY ALMA MATER, THE BEST HIGH SCHOOL THAT SERVES OUR CITY, PALM BAY HIGH SCHOOL, HOME OF THE PIRATES, JUST SOUTH OF MY HIGH SCHOOL, RIGHT ABOUT THE MELBOURNE LINE, THERE IS A NEW TRAFFIC LIGHT FOR A NEW APARTMENT COMPLEX ON LAKE IN THE WOODS DRIVE AND SUN LAKE DRIVE, AND THAT TRAFFIC LIGHT IS HARDENED A HARD POLE.

NOW IF A HURRICANE HAPPENED AND THAT LIGHT WENT OUT, HEAVEN FORBID, DOES IT REALLY AFFECT THE COMMUNITY? NO. SO MY RETURN TRIP, AS I PASS THAT LIGHT AGAIN, I POINT OUT TO MY WIFE, LOOK, LOOK, HONEY, A NEW LIGHT.

WE GET TO BABCOCK AND PALM BAY ROAD, THE BUSIEST INTERSECTION IN BREVARD COUNTY, AND WE SEE THAT DANGLING LIGHTS AND LIGHT BREEZE.

NOTHING TO DO WITH A HURRICANE.

JUST BOUNCE IT ON CABLES.

NOW, LUCKILY, NONE OF THEM FELL DURING HURRICANE IAN, BUT I JUST WANT TO PLANT A SEED OF AN IDEA.

I KNOW IT'S PROBABLY THE COUNTY THAT NEEDS TO DO IT, BUT LISTEN, THE COUNTY MADE THAT DEVELOPER PUT A HARD LIGHT AT A RELATIVELY MOOT INTERSECTION JUST SO THAT THOSE FOLKS COULD MAKE A LEFT HAND TURN AND HEAD TOWARDS THAT RIDICULOUSLY BUSY INTERSECTION.

WHAT'S GOING TO HAPPEN WHEN A HURRICANE HAPPENS AND THAT INTERSECTION GOES OUT? AND THE CHIEF COULD PROBABLY TELL ME IF IT DID FOR SOME TIME DURING HURRICANE IAN.

WE NEED TO GET REPRESENTATION AT WHATEVER ENTITY WE DO WITH THE COUNTY.

WE NEED THAT INTERSECTION HARDENED FIRST AND WE NEED TO START THINKING ABOUT THE INTERSECTIONS WE ARE RESPONSIBLE FOR THROUGHOUT THE CITY AND HARDENING THEM.

WE CANNOT CONTINUE WITH SPAN TRAFFIC LIGHTS.

IT'S JUST NOT A SUSTAINABLE STRATEGY.

THE LAST THING AND YOU CAN CALL IT A SEA OF AN IDEA IF YOU WANT, IS THESE BEAUTIFUL CHAIRS BACK HERE.

NOW YOU GUYS ARE SITTING IN THE COMFY CHAIRS.

I GOT THE CHANCE TO TRY THOSE ON P AND Z.

THEY'RE GREAT LUMBAR SUPPORT AND EVERYTHING ELSE, BUT OUR CHAIRS ARE STILL IN BOXES.

SO IF YOU GUYS ARE LOOKING FOR VOLUNTEERS, I MEAN, I'M AN ABLE BODIED MALE.

I WILL BE HAPPY TO COME ON HERE.

I'LL COME ON A SATURDAY, SUNDAY, WHATEVER YOU NEED ME, I'LL PUT A COUPLE OF CHAIRS TOGETHER.

LET'S GET THEM TOGETHER.

THANK YOU. THANK YOU.

THANK YOU. PHILLIP COCHRAN, FOLLOWED BY PASTOR KEN DELGADO.

[00:25:05]

YOU KNOW, RANDALL, I DID SAY I DIDN'T FEEL COMFORTABLE GETTING OUR CHAIRS OPEN BEFORE THOSE, BUT THERE'S SOMETHING WRONG WITH THOSE RIGHT NOW.

SO I THINK WE'RE SHIPPING THEM BACK.

CAN YOU CAN YOU CONFIRM THAT, MADAM SHERMAN, OR WHAT? OR CONFIRM, MARY? YES. WE ARE SHIPPING THEM BACK AND WE WILL BE ORDERING REORDERING NEW ONES.

GOOD EVENING. CARRY ON.

GOOD EVENING. PHILLIP CORCORAN.

1878. WHEN? BROOK DRIVE. I DON'T KNOW IF YOU NOTICED, BUT LAST WEEK IT WAS REPORTED ON THE NATIONAL NEWS THAT PROPERTY VALUES WERE DROPPING IN PALM BAY AT THE THIRD LARGEST RATE IN THE COUNTRY BEHIND NEW YORK CITY AND LA AND SAN FRANCISCO AND ALL THE CITIES THAT HAVE REALLY BIG PROBLEMS. OUR OUR PROPERTY VALUES WERE BEHIND BOSTON AND ONE OTHER CITY I DON'T REMEMBER.

AND I NOTICED THAT AS A CORRELATION BETWEEN THAT AND NOT HAVING A GOLF COURSE ANYMORE, WE NEED TO HAVE RECREATIONAL ACTIVITIES IN GREEN SPACE FOR PEOPLE IN THE CITY. AND SO THIS THIS COULD BE IT IS A STRONG CORRELATION TIMING WISE.

AND IT WOULD BE ONE OF THE MAJOR REASONS.

I ALSO WANTED TO ASK A LITTLE BIT ABOUT THE UNIMPROVED PROPERTY THAT RODNEY EDWARDS IS WORKING THROUGH.

IT WAS APPROVED UNANIMOUSLY A FEW WEEKS AGO AT THE PLANNING AND ZONING MEETING.

I WAS WONDERING WHEN THAT'S COMING UP FOR A VOTE HERE IN THE CITY COUNCIL.

AND I DID SEND A EMAIL TO EACH AND EVERY ONE OF YOU ASKING FOR YOUR STANCE ON WHAT THAT'S GOING TO BE.

SO TAKE THIS AS A GENTLE REMINDER.

THANK YOU. Q.

PASTOR KINDERGARTEN, FOLLOWED BY PEPITO NIEVES JUNIOR KINDERGARTEN 154.

ANGELO ROAD, SOUTHEAST.

PALM BAY, FLORIDA.

ARNOLD PALMER.

WOW. ALMOST SOUNDS LIKE IT NEEDS TO BE LIKE A LANDMARK, LIKE A HERITAGE.

NEVER BEFORE RIGHT HERE.

IT COULD BE PRESERVED AS A LANDMARK AND MUST KEEP UP TO ITS STANDARD, BECAUSE THAT'S.

WOW. AMAZING, ISN'T IT? AMEN. BUT I'M NOT HERE FOR THAT ANYWAY.

BUT I'M READING FROM FIRST CORINTHIANS CHAPTER 13 AS A PASTOR.

THAT'S WHAT I DO. AND FIRST CORINTHIANS 312, IF ANYONE BUILDS EXCUSE ME, THERE IS NO ONE THAT CAN LAY ANY FOUNDATION OTHER THAN THE ONE ALREADY LAID, WHICH IS JESUS CHRIST.

THIS FOUNDATION IS USING POWER NOT FOR SELF GRANDEUR, BUT POWER TO SERVE.

LAYING DOWN YOUR LIFE, LOVING YOUR NEIGHBOR, GIVING A STINGING YOUR NEIGHBOR BETTER THAN YOURSELF.

WHAT A FOUNDATION TO BUILD A PALM BAY THAT WE'RE THINKING OF OTHER PEOPLE, NOT ABOUT OURSELVES.

IF ANYONE BUILDS ON THIS FOUNDATION USING GOLD, SILVER, COSTLY STONES, WOOD, HAY OR STRAW, THEIR WORK WILL BE SHOWN FOR WHAT IT IS BECAUSE THE DAY WILL BRING IT TO LIGHT.

IT WILL BE REVEALED WITH FIRE, AND THE FIRE WILL TEST THE QUALITY OF EACH PERSON'S WORK.

IF IF WHAT HAS BEEN BUILT, BEEN BUILT, SURVIVES, THE BUILDER WILL RECEIVE A REWARD.

IF IT IS BURNED UP, THE BUILDER WILL SUFFER LOSS AND YET WILL BE SAVED.

EVEN THOUGH ONLY A SWAN ESCAPING THROUGH THE FLAMES.

NOT TALKING ABOUT HELL OR ANYTHING LIKE THAT.

IT'S SAYING IN THIS LIFE THAT WE HAVE, WE HAVE OPPORTUNITIES TO BUILD ON WHAT JESUS CHRIST DID.

THINKING OF OUR NEIGHBORS, THINKING OF THE FUTURE, THINKING MORE THAN OURSELVES, USING OUR CAPACITY NOT TO GROW, TO TO MAKE OURSELVES SUCCESSFUL, BUT TO MAKE OTHER PEOPLE SUCCESSFUL.

WHEN WE DO THAT, WE ARE ACCUMULATING A RETIREMENT FUND.

GOLD, SILVER AND PRECIOUS STONES.

THE WOOD, HAY AND STUBBLE ARE THOSE THINGS THAT WE DID FOR OURSELVES.

NOW I KNOW IT'S JUST ME THAT I'M TALKING ABOUT THAT I ONLY DID.

I DID SOME THINGS FOR MYSELF.

THAT'S JUST ME. BUT.

BUT IF THERE HAPPENED TO BE OTHER PEOPLE THAT DID SOMETHING BUT THEY DID IT FOR THEIR OWN SELVES, THEY'RE NOT CONSIDERING OTHER PEOPLE.

ALL THIS IS SAYING IS, IS THAT THERE WILL BE A A LIKE A FLAME THAT WILL BURN THOSE THINGS UP SO THAT THE SUBSTANCE OF OUR LIVES WILL BE REVEALED AS TO WHAT IT IS. AND FROM THAT POINT, THIS IS THE REWARD THAT GOD GIVES US ACCORDING TO WHAT WE DID, BUILDING ON THE FOUNDATION OF SACRIFICE, OF LOVING OUR NEIGHBORS BETTER THAN OURSELVES.

AND SO JUST THE THOUGHT AS YOU DO WHAT YOU DO AND YOU DO SO NICELY AS WE DO WHAT WE DO IN OUR JOB PLACES AND OUR HOMES.

IT'S ABOUT THE OTHER PERSON USING OUR POSITION TO SERVE OTHER PEOPLE.

THANK YOU. GOD BLESS YOU ALL.

OH, THAT'S GOOD. THAT WAS GOOD.

PEPITO DAVIS JR.

AND JEREMY MEARS.

[00:30:06]

MY NAME IS PEPITO NIEVES JR.

LIVE AT 949, A LITTLE STREET NORTHEAST PALM BAY, FLORIDA.

I'M A LITTLE. I'M NOT REALLY A SPEAKER, BUT I'M GLAD THAT I CAME FOR THE FIRST ACKNOWLEDGMENT OF MY CULTURE, OUR CULTURE.

BUT I AM ALSO SADDENED BECAUSE I'VE BEEN TRYING SINCE I'VE MOVED TO PALM BAY PRIOR TO THIS, RARELY EVER GETTING IN TROUBLE. RARELY.

AND TO THIS DAY.

EXCUSE ME. I, OF COURSE, WAS YOUNG.

I MADE MISTAKES.

I LEARNED FROM MY MISTAKES, NEVER DOING THEM AGAIN.

BUT I AM STILL BEING JUDGED.

I'M STILL BEING PUT DOWN.

I'M CURRENTLY I'M 44 YEARS OLD AND I'M LIVING IN MY MOTHER'S HOUSE BECAUSE I CAN'T FIND A JOB BECAUSE OF MY PAST.

WHEN I WAS YOUNG, BEFORE I WAS TEENAGE, 18, 19, AND STILL THE PALM BAY POLICE DEPARTMENT ABUSING ME, YOU KNOW, AND I'M STILL LIKE I SAID, I'M NOT A SPEAKER, SO I'M VERY NERVOUS, BUT I JUST NEED TO KNOW WHAT I CAN DO.

I DON'T KNOW WHAT TO DO.

I'M VERY CAPABLE. I'M AN HVAC SERVICE TECHNICIAN.

I'VE ACTUALLY OPENED UP MY BUSINESS IN NOVEMBER OF LAST YEAR IS A-PLUS NIEVES HVAC SERVICES.

BUT I WAS TOLD YESTERDAY THAT I CAN'T EVEN TOUCH AN AIR CONDITIONING UNIT WITHOUT GETTING ARRESTED.

SO I'M REALLY I DON'T KNOW.

MY HANDS ARE IN THE AIR. I DON'T KNOW WHAT TO DO.

AND I JUST JUST BECAUSE OF THE RECORD THAT PALM BAY HAS PLACED, I'M NOT SAYING I'M PERFECT.

NO ONE IN THIS WORLD IS PERFECT, BUT I DON'T KNOW WHAT TO DO.

I'M JUST BEFORE YOU TO SEE WHAT WE CAN DO ABOUT THIS, BECAUSE I'M NOT THE ONLY ONE.

I'VE MET NUMEROUS ACQUAINTANCES THAT MAY POLICE DEPARTMENT AND CONTINUE TO GET ABUSED BY THE PALM BAY LA POLICE DEPARTMENT.

SO I'M JUST ASKING.

THIS WAS JUST BROUGHT TO ME LAST WEEK.

I DON'T I'M NOT EVEN PREPARED.

I DON'T KNOW ANYTHING, BUT JUST PRETTY MUCH JUST PUTTING IT OUT THERE AND SEEING WHAT CAN BE DONE.

THAT'S PRETTY MUCH IT. THANK YOU.

THANK YOU. THANK YOU.

GERRY MARES FOLLOWED BY KEVIN BOLUS.

HELLO. MY NAME IS JEREMY MEARS.

I'M THE DEVELOPMENT PARTNER WITH THE BROWNSTONE GROUP.

JUST A LITTLE BRIEF BACKGROUND.

TWO WEEKS AGO, I PRESENTED ON OCTOBER 6TH, I PRESENTED THE ELABORATE PALM BAY DEVELOPMENT APARTMENT DEVELOPMENT OVER THERE OFF MALABAR, AND WE HAD SOME DISCUSSIONS ABOUT THAT.

IT WAS THERE WAS NO OPPOSITION FROM THE NEIGHBORS.

THE VOTE WAS THREE TWO TO DENY THE PROJECT AND DENY THE AR 15 ZONING.

THAT WAS CASE NUMBER Z 40 42022.

AND THE REASON I'M HERE TODAY, I WANT TO TALK ABOUT THERE WAS SOME INFORMATION THAT I DID NOT PRESENT AT CITY COUNCIL.

I WANT TO TALK ABOUT THAT TODAY AT P AND Z WHEN I WAS THERE.

ONE OF THE MAJOR ITEMS THEY HAD WAS THE FACT THAT THEY WERE CONCERNED ABOUT FIRE SAFETY.

AND SO BEING THAT THEY WERE CONCERNED ABOUT FIRE SAFETY, I THOUGHT, I NEED TO DO SOMETHING ABOUT THAT.

AND WHAT I WANTED TO DO WAS MAKE A SUBSTANTIAL DONATION TO THE PALM BAY FIRE DEPARTMENT.

AND THE LAND SAID I WAS GOING TO MATCH MY REQUEST AND MY DONATION.

AND SO THIS CONTRIBUTION.

THESE ARE STANDARD SOMETIMES IN DEVELOPMENT WORLD AND SOMETHING THAT WE DO.

AND SO I ASKED MY CONSULTANT TO VISIT WITH STAFF, AND HE DID.

AND HE TALKED TO STAFF AND STAFF ASKED US NOT TO PRESENT THIS DONATION TO CITY COUNCIL.

AND SO WE DID NOT.

AND THIS THIS DONATION WAS SOMETHING WE DO AND HAVE DONE IN THE PAST.

THIS THIS AMOUNT WE WERE GOING TO OFFER WAS 200,000.

AND THIS $200,000 WAS GOING TO GO TOWARD THE FIRE DEPARTMENT AND SOMETHING THAT WE WERE VERY EXCITED AND WANT TO MAKE AND WE COULD NOT.

IN HINDSIGHT, I BELIEVE THAT THIS FINANCIAL DONATION MAY HAVE MADE A DIFFERENCE IN AN IMPACT ON THE DECISION THAT THE CITY COUNCIL MADE.

I BELIEVE MY FAILURE TO OFFER THIS DONATION WAS A MISTAKE AND SOMETHING THAT WOULD ALLOW THE CITY COUNCIL AND I THINK IT WOULD ALLOW THE CITY COUNCIL TO RECONSIDER THIS REZONING REQUEST. IN SUMMARY, I AM SEEKING A RECONSIDERATION OF THE DENIAL AS ALLOWED BY THE CITY'S POLICY AND PROCEDURES MANUAL.

CHAPTER SEVEN. PARAGRAPH 7.9.14.

MY OFFER OF THIS DONATION AND THAT OF THE CURRENT LANDOWNER IS STILL ON THE TABLE, AND I LIKE FOR THIS PROJECT TO BE RECONSIDERED.

SO IT'S SOMETHING I PROBABLY SHOULD HAVE DONE LAST TIME.

SO I WAS ASKED NOT TO.

WE'VE GOT TO GO THROUGH THE REST OF THE OK.

KEVIN BOLUS, FOLLOWED BY ROBERT STICE.

[00:35:12]

GOOD EVENING, COUNSEL. MY NAME IS KEVIN BOS.

I LIVE AT 1323 VAN BUREN AVENUE SOUTHEAST.

ONE OF THE THINGS THAT I'D LIKE TO ADDRESS IS NOT TO BASH THE POLICE DEPARTMENT, BUT AROUND HERE, EVERY LAST ONE OF US HAS WITNESSED PEOPLE COMING OFF OF DAYTONA SPEEDWAY A.K.A 95, AND I THINK THEY'RE STILL ON 95, DRIVING DOWN MALABAR ROAD, DRIVING DOWN PALM BAY ROAD AS IF THEY'RE STILL ON THAT SUPER FREEWAY.

NOW, I'VE BEEN BROUGHT TO MY ATTENTION THAT EVEN THOUGH PALM BAY POLICE ARE TICKETING THESE PEOPLE, THEY GO TO COURT.

THE COURTS DO NOT ISSUE POINTS TO PEOPLE'S LICENSES.

WHY? I'VE BEEN ALL UP AND DOWN THE EASTERN SEABOARD.

UNTIL WE START HITTING PEOPLE IN THE POCKETBOOK, UNTIL PEOPLE START FEARING THE LOSS OF THEIR LICENSE BECAUSE THEY CANNOT SLOW DOWN AND FOLLOW TRAFFIC LAWS, THEN THAT'S NOT GOING TO STOP.

MAYOR, YOU STATED IN YOUR OWN WORDS THIS IS THE GREATEST CITY ON THE FACE OF THIS PLANET.

BUT HOW MANY PEOPLE ARE WE LOSING EVERY WEEK TO TRAFFIC FATALITIES? HOW MANY KIDS ARE WE LOSING IN SCHOOL ZONES TO THE TRAFFIC FATALITIES? PEOPLE DO NOT KNOW HOW TO SLOW DOWN UNTIL YOU HIT THEM WHERE IT HURTS.

THEY WON'T LEARN THE LESSON.

A FINE, FINE.

I PAY THAT. I GO ON.

I LOSE 100 BUCKS.

I GET POINTS ON MY LICENSE, I LOSE MY LICENSE.

I CAN'T GO TO WORK.

I CAN'T, YOU KNOW, SUPPORT MY HOUSE TO SUPPORT MY FAMILY.

MAYBE I'LL THINK TWICE BEFORE I DO 75 MILES AN HOUR AND A 40 MILE AN HOUR ZONE.

WHY ARE WE CONTINUALLY ALLOWING PEOPLE TO DIE IN THIS CITY? BECAUSE WE CANNOT HIT THESE PEOPLE WHERE IT HURTS AND SLOW DOWN THE TRAFFIC.

EMERSON IT'S A SPEEDWAY.

I HAVE SEEN PALM BAY POLICE SITTING IN THE MEDIAN.

PEOPLE PLAY BY OFFICE ARE STILL SITTING THERE PALM BAY ROAD OFFICERS SITTING IN THE MEDIAN.

NOBODY SLOWS DOWN BECAUSE THEY KNOW THAT OFFICER IS NOT GOING TO PULL OUT AND PULL THEM OVER.

WE NEED TO START ENFORCING THE TRAFFIC LAWS AND WE NEED TO START HITTING PEOPLE WHERE IT HURTS.

UNTIL THEN, IT WON'T STOP.

THANK YOU FOR LOOKING INTO THIS.

THANK YOU. ROBERT STYLES, FOLLOWED BY NATHAN WHITE.

ROBERTS DAY 1796 WHEN BURT DRIVE SOUTHEAST.

REALLY ENCOURAGING TO HEAR WHAT THIS GENTLEMAN SAID, BUT I DON'T PLAY GOLF THAT OFTEN.

BUT THIS MORNING I WENT DOWN TO BUREAU, PLAYED GOLF.

MAN, THERE'S A LOT OF ELD GOING ON DOWN BY EMERALD LAKE.

EVERY ONE OF YOU GET TO DEVELOP AS AT 50% OF PALM BAY.

THE 50% OF PARLIAMENT NEEDS TO BE DEVELOPED.

WHAT DO YOU WANT THAT TO LOOK LIKE? OK HASN'T JOINED.

IT'S TAKEN OUT THE SPRINKLER HEADS, MOVED ALL THE LANDSCAPING EQUIPMENT AND GOLF BALLS, ETC..

AND SHE'S ONLY MOWING THE PERIMETER OF THAT AREA.

LIKE I SAID BEFORE, THIS IS THE CENTRAL PARK OF PALM BAY.

YOU HAVE 198 ACRES.

WHAT DO YOU WANT TO DO WITH IT? WHAT ARE YOU GOING TO DO WITH IT? WHAT'S BENEFICIAL TO THE CITY AND THE RESIDENTS WHO LIVE THERE AS WELL? WHAT'S THERE TO DO FROM A RECREATIONAL PERSPECTIVE? HOW ARE YOU GOING TO LOOK AT THAT AND MOVE FORWARD? AND PLEASE BE CONSIDERATE WITH REGARD TO WHAT YOU'VE GOT GOING AND WITH ALL THE WITH ALL THE NEW BUILD.

I, YOU KNOW, PLEASE, YOU HAVE TO HAVE THE INFRASTRUCTURE IN THERE.

HOW MANY FIRE DEPARTMENTS ARE WE LACKING? WE HAVE SIX. SEVEN. WE NEED TO BUILD.

HOW ABOUT PLEASE, EMT YOU KNOW, THE ZONING BOARD VOTING DOWN TO 4100 HOUSES, I THINK WAS DOWN IN HERITAGE, AND I'M PROUD OF THEM FOR DOING THAT. CAN YOU IMAGINE PUTTING BEING IN THE MIDDLE OF THAT? EVERYBODY HERE HAVE CHILDREN, GRANDCHILDREN.

IMAGINE BEING IN THE MIDDLE OF THAT.

THERE'S THREE PLACES IN AND OUT.

WHAT WOULD YOU DO IF YOU HAD A FIRE IN THE MIDDLE OF THAT? WE HAD A HURRICANE COME IN AND WE'RE THE NUMBER ONE LIGHTNING STATE IN THE COUNTRY.

YOU GET A FIRE IN THE MIDDLE OF THAT.

THE HOUSES ARE CLOSE TOGETHER.

THE WAY THEY'RE LINED UP AND YOU GET A FIRE IN THE OTHER SIDE OF TOWN OR AN EMERALD LAKE WHERE WE JUST PASSED THOSE TODAY, THESE HOUSES ARE RIGHT NEXT TO EACH OTHER.

IT JUST TAKES ONE ONE ASH.

SHUCKS. YOU KNOW, TO HAVE THIS HUGE PROBLEM AND IT'S ALL GOING TO FALL IN EVERY ONE OF YOUR LAPS.

[00:40:05]

SO THE CONSTRUCTION HAS GOT TO BE IN A SMART WAY.

YOU REALLY WANT TO GET AWAY? I THINK YOU DO. I'D LIKE TO HEAR IT FROM YOU GUYS, FROM A BEDROOM COMMUNITY.

BUT WHAT ARE YOU GOING TO DO WITH IT? HOW ARE YOU GOING TO KEEP US SAFE GOING FORWARD? AND WHAT ARE YOU GOING TO DO WITH THE 200 ACRES? IS THERE A WAY THAT WE CAN LOOK AT THAT ON THE SIDE? BECAUSE THE VALUE HAS GONE WAY DOWN ON THAT GOLF COURSE PROPERTY? IS IT WORTH 1.2 IS WORTH LESS THAN WHAT YOU PAID FOR IT? THE WAY IT LOOKS RIGHT NOW, IT IS.

BUT TO TIM'S POINT, AS A GOLF COURSE UNDER THAT AREA, OR IS THERE SOMETHING ELSE THAT'S UNDER THAT AREA? WHAT ARE YOU GOING TO DO WITH THE 50% OF HOMES AND DEVELOPMENT THAT YOU'RE GOING TO BE LEFT WITH? THANK YOU. Q NATHAN WHITE.

NATHAN WHITE, 1301 SEABREEZE STREET, SOUTHWEST.

I'LL KEEP IT BRIEF.

WE ARE DOING THE PRAY FOR THE CANDIDATES EVENT AGAIN.

WE WILL BE DOING IT NOVEMBER 5TH AT 630 AT CHURCH ON THE ROCK ON BABCOCK STREET.

AS I SAID BEFORE, AND IT STANDS AGAIN WITH THIS MEETING.

IT IS NOT. IT'S NOT A PRAYER MEETING ABOUT ISSUES.

IT'S NOT A PRAYER MEETING ABOUT PRAYING FOR SOMEONE TO WIN, SOMEONE TO LOSE.

IT'S FOR THOSE WHO HAVE STOOD UP AND ARE SERVING THE COMMUNITY AS AN ELECTED OFFICIAL OR WHO ARE ATTEMPTING TO DO SO AS A CANDIDATE.

WE HAVE INVITED EVERYONE.

LITERALLY EVERYONE, ACTUALLY VIA THE SUPERVISOR OF ELECTIONS OFFICE FOR CANDIDATES.

AT THE LAST MEETING, WE HAD ABOUT DOUBLE THE TURNOUT.

WE EXPECTED FOR A SHORT NOTICE KIND OF MEETING, AND WE DID ACTUALLY HAVE CANDIDATES COME IN FROM BOMBAY AND AS FAR NORTH AS I BELIEVE IT WAS COCOA.

AND WE RECEIVED WORD FROM MORE THIS TIME COMING.

WE HAD ALSO THE FULL SPREAD OF REPUBLICANS, DEMOCRATS AND NPA CANDIDATES THERE IN THE MIX.

AND IT WAS A VERY, VERY GOOD AND POWERFUL NIGHT OF PRAYER, LIFTING UP THE CANDIDATES AND THE ELECTED OFFICIALS AGAIN, PRAYING FOR HEALTH, SAFETY, SECURITY, PEACE, PRAYING FOR THEIR FAMILIES AND PROTECTION OVER THEM AND THEIR FAMILIES.

I'M SURE YOU UNDERSTAND BEING AN ELECTED OFFICIAL IS A STRENUOUS THING, AND IT CAN BE MORE OR LESS STRENUOUS DEPENDING ON A MYRIAD OF CIRCUMSTANCES.

SO I JUST WANTED TO MAKE SURE THAT YOU ALL WERE AWARE IN CASE YOU DIDN'T SEE THE EMAIL.

YOU ARE ALL INVITED.

WE'RE ALL PRAYED FOR AT THE LAST MEETING.

YOU WILL BE AGAIN AND I HOPE YOU ARE ABLE TO MAKE IT OUT AGAIN.

NOVEMBER 5TH AT 630 AT CHURCH ON THE ROCK ON BABCOCK STREET.

AND IS THERE AN APPROPRIATE PLACE? I COULD PUT DOWN A COUPLE OF THE INFORMATIONAL, LIKE THE TABLE OR THE SIDE OR TO YOU GUYS? YOU AND I HOPE TO SEE YOU THERE.

GOOD NIGHT. TO MADAM SHERMAN.

IF YOU WANT TO ADDRESS ANY OF THE.

THE PUBLIC COMMENTS REGARDING.

I'M HAPPY TO ANSWER ANY QUESTIONS COUNCIL MAY HAVE FOR ME.

SO. SO, MA'AM, THE FIRST THING I'D LIKE TO TRY AND ADDRESS AND I'M TRYING TO DO THIS IN IN ORDER, RIGHT.

THE THE ENFORCEMENT OF OF OUR TRAFFIC LAWS.

WE DO HAVE A TRAFFIC DIVISION NOW WITHIN THE CITY OF PALM BAY.

CORRECT. AND IT'S CORRECT.

SO SHOULD WE JUST I KNOW THAT A LOT OF THE SPEAK THE SPEAKER, WHAT HE BROUGHT UP WAS FOR THE LEGISLATURE TO PUT SOME MORE UMPH INTO THAT BITE.

PEOPLE GET TICKETS, BUT THEY STILL THEY STILL BEHAVE ERRATICALLY ON ON ON THE ROADWAYS.

SO PART OF THAT IS YOU CAN'T LEGISLATE THE HEART.

RIGHT. BUT MY MY QUESTION IS, WHAT HAVE WE DONE IN REGARDS TO ENFORCING OUR SPEEDS WITHIN THE CITY OF PALM BAY? CAN WE ASK? I'M NOT PREPARED TO GIVE A GRAND SPEECH ABOUT THAT TONIGHT.

I MEAN, WE'RE ACTIVELY OUT THERE PERFORMING TRAFFIC ENFORCEMENT ACTIVITIES.

WE'VE TALKED ABOUT THEM PLENTY OF TIMES HERE WHERE WE PUT THE, YOU KNOW, THE THE SPEED, THE FLASHING SPEED LIMIT SIGNS.

AND WE HAVE ALL KINDS OF UNITS OUT THERE EVERY DAY.

AND I THINK PART OF THE PROBLEM IS EXACTLY WHAT YOU SAID, MAYOR, THAT THERE'S SOMETHING WE WILL NEVER BE ABLE TO FULLY RESOLVE, BUT WE'RE WORKING ON IT.

ANY OF THE RESIDENTS WHO SPOKE, OUR DEPUTY CHIEF IS OVER IN THE CORNER AND HE'D BE HAPPY TO SPEAK WITH YOU IF YOU HAVE SOME SPECIFIC QUESTIONS ABOUT SPECIFIC AREAS.

WE CERTAINLY TAKE RESIDENTS CONCERNS SERIOUSLY WHEN WE GO OUT AND WE DO SPECIAL DETAILS AS WE NEED TO, AND SPECIFIC AREAS IN PARTICULAR TO SOME OF THE DOCUMENTS WE RECEIVED.

[00:45:09]

THESE THESE ITEMS WERE DONE IN 2001.

AND SO PERHAPS AN ATTORNEY IS IS APPROPRIATE.

I DON'T KNOW THIS THIS APPEARS TO BE LIKE COURT ISSUES, COURT DOCUMENTS THAT THIS GENTLEMAN DROPPED OFF.

YES, SIR, I WOULD I WOULD LEAVE THAT IN THE HANDS OF A LEGAL OR SOMETHING LIKE THAT.

OKAY. OKAY. THANK YOU, MA'AM.

AND THEN ALONG THE SAME VEIN WITH PEPITO, NIEVES IS WHAT HE SPOKE ON.

CONCERNED ABOUT HIM WORKING, AND HE'S SAYING HE'S BEING HARASSED BECAUSE HE CAN'T.

SO I'M INTERESTED TO SEE HOW THAT THAT'S MANIFESTING.

LIKEWISE, I WOULD HAVE OUR DEPUTY CHIEF REACH OUT TO MR. NIEVES. SO, MR. NIEVES AND MR. AVILA, IF YOU LIKE, YOU COULD SEEK THE COUNSEL OF OUR DEPUTY CHIEF HERE, AND MAYBE HE COULD GUIDE YOU INTO SOME COURT PROCESS.

AND THEN WANTED TO TALK A LITTLE BIT ABOUT THAT PROPERTY THAT ARNOLD PALMER DESIGNED.

AND I KNOW THAT THE CITY AT ONE POINT BACK IN THE DAY.

THEY THEY WERE MOVING FORWARD TO TRY AND PURCHASE THE GOLF COURSE AT ONE POINT.

WAS IT WAS IT THEY WERE LOOKING TO PURCHASE IT OR WAS IT THAT.

WELL, FRED WOULD KNOW. CAN I ASK FRED TO COME UP AND EXPLAIN THAT A LITTLE BIT? CERTAINLY. OKAY. THANK YOU.

I'M NOT SURE WHICH TIME YOU'RE SPEAKING OF.

WELL, THAT PROPERTY ORIGINALLY WAS CITY PROPERTY.

YES, SIR. THAT WAS THAT WAS PART OF THE SETTLEMENT WITH GDC.

AND THE CITY DID GO THROUGH A PROCESS WHERE WE DESIGNED A GOLF COURSE THAT WAS GOING TO BE A MUNICIPAL COURSE.

IT GOT BROUGHT IN FRONT OF THE COUNCIL, AND THE COUNCIL ON A32 VOTE, DECIDED NOT TO GET INTO THE GOLF COURSE BUSINESS, AND THAT PROPERTY WAS EVENTUALLY SOLD TO A DEVELOPER. AND WHEN WAS THAT, SIR? IT'D BE LIKE EARLY NINETIES.

WAS THERE SOMETHING AFTER THE 2000S THAT THAT WAS DISCUSSED AS WELL? WELL, THE THE PROPERTY WAS SOLD IN A FAMILY BUY OUT OF ATLANTIC CITY, BUILT THE GOLF COURSE AND THEN THEY SOLD IT TO BEN JEFFRIES.

AND THEN BEN JEFFRIES SOLD IT TO A CONGLOMERATE GROUP THAT SOLD IT TO THE LADY THAT HAS IT PRESENTLY.

PRIOR TO THAT, WE WERE GIVEN DIRECTION FROM COUNSEL TO SEEK.

OUT THE PURCHASE OF THAT PROPERTY AND IT WAS GOING TO BE TIED INTO THE EXPANSION OF THE SOUTH REGIONAL WATER.

TO HAVE THAT AS A PLACE FOR THE REUSE AND THEN THE CITY WOULD RUN IT THE GOLF COURSE AS A AS AN ENTERPRISE FUND.

SO THAT WAS TALKED ABOUT IN 2015, 2016.

SO THAT WAS THE MOST RECENT.

THAT'S WHAT I GUESS WHERE I WAS GOING.

YES, SIR, I WAS I WAS ACTUALLY IN NEGOTIATIONS WITH CHARLIE STAPLES.

THAT WAS THE OWNER AT THAT TIME.

SO WE WERE DISCUSSING TRYING TO OBTAIN THAT GOLF COURSE.

THAT'S CORRECT. IN 2015 AND ALL THE WAY UP TO PROBABLY ABOUT 18.

OKAY. AND THEN THE TALKS, THEY JUST FIZZLED OUT AND NEVER OCCURRED AGAIN PER DIRECTION FROM THE PREVIOUS CITY MANAGER.

THOSE THOSE NEGOTIATIONS CEASED.

YEAH, THAT'S WHAT I WAS REFERRING TO.

DEPUTY MAYOR. THAT WAS REALLY CURRENT ON MY YOU KNOW, I KNEW THOSE TALKS WERE GOING I REMEMBER IN THE NINETIES TOO.

BUT ALL OF THAT RUNS TOGETHER.

RIGHT WITH THE TIMELINE. BUT THANK YOU FOR FOR THAT HISTORY, BECAUSE 2015 IS JUST A FEW SHORT YEARS AGO.

I MEAN, FOR SOMEONE THAT'S LIVED AS LONG AS I HAVE.

RIGHT. IT SEEMS LIKE YESTERDAY FOR ME.

BUT THANK YOU FOR THAT HISTORY.

AND THAT'S WHY I WANTED TO TALK ABOUT GENTLEMEN, IS IS HOW DO WE HOW DO WE GET THIS GOLF COURSE? IS THAT SOMETHING THAT THIS COUNCIL WOULD WANT TO TRY TO EXPLORE? OR WHAT ARE YOUR THOUGHTS? ME PERSONALLY, I THINK WE HAVE BIGGER THINGS TO FOCUS ON, HENCE OUR POLICE AND FIRE.

I JUST I'M LOOKING AT THE NUMBERS OF THE PEOPLE WHO WERE ATTENDING THE GOLF COURSE.

AND YES, WE HAVE OVER 120,000, BUT I DON'T SEE THAT MANY PEOPLE WERE GOING THERE BEFORE.

SO I WANT SO WE CAN EXPLORE IT.

BUT I JUST I WANT I WANT THE LOCAL GOVERNMENT BE CAREFUL IN TRYING TO GET INTO THE BUSINESS REALM TOO MUCH.

[00:50:08]

I KNOW WE DO HAVE THE CAMPGROUNDS, BUT I THINK THAT'S PROBABLY AS FAR AS WE SHOULD EXTEND RIGHT NOW, BECAUSE WE'RE STILL TRYING TO GET THAT UP AND RUNNING.

SO WE'LL BE SPREADING OURSELVES EVEN MORE THIN.

SO FOR CONSIDERATION, YES, I JUST I DON'T WANT TO, YOU KNOW, TIE STAFF UP TOO MUCH WHEN WE HAVE A LOT MORE PRUDENT THINGS, SUCH AS TRAFFIC AND THINGS OF THAT NATURE THAT NEED TO BE TACKLED. SO I'M FOR CONSIDERATION, BUT I JUST DON'T WANT TO PUT TOO MUCH EFFORT TOWARDS IT, TAKING STAFF AWAY FROM MORE PRUDENT THINGS.

OKAY, I COPY YOU.

ANYONE ELSE WANT TO WEIGH IN? MARY, IF I MAY. COUNCILMAN FELIX.

THANK YOU. I FEEL.

TOTALLY DIFFERENT THAN DEPUTY MAYOR.

I THINK JUST AS IMPORTANT AS WE LOOK THAT HOLISTICALLY, WE LOOKED AT ALL THE NEEDS OF THE CITY, RIGHT? PUBLIC SAFETY IS CERTAINLY ON THE VERY TOP.

SO IS RECREATION, BECAUSE AS PEOPLE CONSIDERING AN AREA TO MOVE, ESPECIALLY FLORIDA, ARE WE TALKING ABOUT YOU GO UP NORTH AND YOU KNOW, SPEAKING OF OF NORTH MAYOR, IF YOU ALLOW ME ONE MORE SECOND, I JUST WANT TO ACKNOWLEDGE MY.

COLLEAGUE HERE, COUNCIL VICE VICE PRESIDENT OF RANDOLPH, MASSACHUSETTS.

SHE IS HERE WITH US AND VISITING.

I JUST WANT TO ACKNOWLEDGE.

WELL, NATASHA, IF YOU JUST WOULD SAY, YOU KNOW, NATASHA, SHE'S A COLLEAGUE OF FELLAINI AND SISTER, AND THANK YOU FOR VISITING THE GREATEST CITY ON THE FACE OF THE EARTH, BY THE WAY, NOT RANDOLPH, MASSACHUSETTS.

SO, YOU KNOW, BUT GETTING BACK TO WHAT I WAS SAYING IS THAT I THINK IT JUST AS IMPORTANT AS WE LOOKED AT RECREATION AS WELL IS JUST AS IMPORTANT FOR AS PEOPLE CONSIDERING SAFETY, JOBS AND RECREATION IS RIGHT ON TOP AS WELL.

SO DEFINITELY THAT'S A DISCUSSION WORTH HAVING CONSIDERING.

WELL, IF I MAY DISCLOSE AS WELL, I LIVE ON THE GOLF COURSE, SO THAT HAS NOTHING TO DO WITH IT, BUT I JUST WANT TO PUT THAT OUT THERE.

BUT BUT BY NO MEANS I THINK THIS SHOULD BE TAKEN INTO CONSIDERATION AS WELL AS I ALSO SHOULD CONSIDER IT.

THANK YOU, COUNCILMAN. ANY OTHER COUNCIL OR COUNCILMAN FOSTER? YEAH. I JUST WANT TO SAY SOMETHING.

I DO THINK WE NEED TO CONSIDER IT.

I THINK WE NEED TO HAVE A WORKSHOP AND.

THE RESIDENT. I DON'T LIVE IN BASS LAKES, BUT I HAVE FRIENDS AND FAMILY THAT LIVE WELL, FRIENDS AND FAMILY THAT LIVES IN BASS LAKES.

AND THEY TALK ABOUT THAT GOLF COURSE ALL THE TIME.

AND THE CITIZENS SHOWED UP IN THEIR RED SHIRTS FOR MANY WEEKS.

SO WE ARE HERE TO REPRESENT THE CITIZENS.

THAT'S THAT'S WHAT ONE OF OUR MAIN FUNCTIONS TO REPRESENT PALM BAY AND REPRESENT THE CITIZENS.

THE QUESTION IS, ARE THEY WILLING TO PAY FOR IT? THE BODY REPRESENTATION SHOWING UP SEEM LIKE THEY ARE MIGHT BE WRONG, BUT SEEM LIKE THEY ARE.

AND I'M NOT FOR DEVELOPING 300 HOUSES ON THEIR.

YOU KNOW, THAT DIDN'T COME UP.

BUT I'M TELLING YOU RIGHT NOW, THAT'S NOT MY MINDSET.

I SEE THAT'S EVEN MORE OF A HAZARD.

SO THE OWNER DON'T WANT TO LET IT GO AND MAKE IT AN EYESORE.

IT'S JUST LIKE IF YOU GO DOWN THE STREET AND WE SEE A PROPERTY OWNER DON'T TAKE CARE OF THEIR PROPERTY.

AND IT GETS ABANDONED.

YOU GET SPRAY PAINTED.

DRUG ADDICTS GOES IN AND OUT THE HOUSE WITH THE IS GOING TO DO WITH THAT.

WHAT'S THE CITY? IS THE CITY GOING TO HOLD THAT PROPERTY OWNER ACCOUNTABLE? I THINK ONE PROPERTY COMES IN MY MIND, THE ONE ON PALM BAY ROAD, THE OLD CRYSTAL PALACE.

OKAY, SO.

IS WE DON'T OWN THESE PROPERTIES, BUT WE DO HAVE A RESPONSIBILITY TO HOLD PEOPLE ACCOUNTABLE FOR WHAT THEY DO IN OUR CITY.

MAYOR SO I THINK WE SHOULD HAVE A WORKSHOP ON IT.

I THINK WE SHOULD SEE IF THE IDEA IS FEASIBLE.

THAT'S AND I DON'T KNOW WHICH WAY I WILL VOTE, BUT I THINK WE SHOULD HAVE A WORKSHOP ON IT, HAVE CITIZENS INPUT AND AND SEE WHERE WE GO FROM THERE. THANK YOU.

COUNCILMAN FOSTER.

COUNCILMAN FILIBERTO.

THANK YOU, MAYOR. SO I GUESS I'LL BE THE THIRD ONE HERE.

I THINK WE SHOULD TALK ABOUT IT.

YOU KNOW, WE'RE UP HERE FOR THE RESIDENTS.

THE RESIDENTS WANTS TO EXPLORE THE ISSUE.

I HAVE NO PROBLEM EXPLORING THE ISSUE OF PURCHASING OR WHATEVER WE'RE GOING TO DO WITH THE MAJOR'S GOLF COURSE.

[00:55:04]

SO, YES, I'M FOR TALKING ABOUT THE MAJOR'S GOLF COURSE AND THE SUBJECT AT HAND, WHETHER IT'S A WORKSHOP HERE OR ANYWHERE ELSE.

THANK YOU, MAYOR. THANK YOU, COUNCILMAN FILIBERTO.

MADAM SHERMAN.

SO I THINK COUNCIL WOULD LIKE TO CONSIDER THAT.

AND WE COULD. WE COULD DISCUSS IT FURTHER.

CERTAINLY NO ONE'S COMMITTED, BUT EVERYONE FEELS THAT THE DISCUSSION IS WARRANTED.

SO. THANK YOU, MA'AM.

UM. YOU WANTED TO SAY SOMETHING BEFORE I GOT INTO? YEAH, I'M JUST.

I. I RESPECT EVERYONE'S, YOU KNOW, VOICING THEIR OPINIONS AND EVERYTHING.

BUT, YOU KNOW, I'M FROM HERE, JUST LIKE MANY OF YOU, AND I'VE HAD NOTHING BUT GOOD DEALINGS AND GOOD RUN INS WITH PALM BAY POLICE DEPARTMENT EVEN BEFORE I WAS ON CITY COUNCIL.

EACH PERSON'S EXPERIENCE IS DIFFERENT, SO I UNDERSTAND THAT.

AND THERE ARE SOME THAT ARE MORE INTENSE OR MORE STRINGENT THAN OTHERS.

BUT I KNOW THIS STAFF RIGHT HERE, AND I KNOW YOU TWO GENTLEMEN.

Y'ALL CAN GO, I PROMISE YOU, YOU CAN GO TO DEPUTY CHIEF FISHER OR OUR CHIEF AJELLO, AND HE'LL MAKE SURE HE CAN GET ANY WRONG THAT WAS DONE.

HE'LL MAKE SURE HE CAN WRITE IT OR THEY WILL MAKE SURE THEY CAN WRITE IT.

SO PLEASE TAKE THEM UP ON THAT, SPEAKING WITH THEM, BECAUSE THESE ARE UPSTANDING GENTLEMEN AND WOMEN.

WORSE YET. THERE WE GO.

AND WOMEN.

SO. SO PLEASE TALK TO THEM.

I WOULD ENCOURAGE YOU I KNOW YOU KNOW, WHEN YOU HAVE A BAD RUN IN, SOMETIMES IT CAN LEAVE A BAD TASTE IN YOUR MOUTH WHERE YOU DON'T WANT TO.

BUT I WOULD ENCOURAGE YOU ALL TO JUST GIVE THEM A CHANCE AND TALK WITH THEM SO WE CAN WRITE THIS AND MOVE FORWARD SO YOU CAN FLOURISH AS A BUSINESS OWNER.

AND SIR, IF YOU WANT TO MOVE BACK TO PALM BAY, WE CAN HAVE YOU MOVE BACK HERE WITH NO ISSUE.

SO THAT'S THAT'S ALL I REALLY WANT TO SAY, MAYOR, RIGHT NOW.

AND THAT'S IT. I'M GOOD.

THANK YOU. OKAY. AND THAT CONCLUDES PUBLIC COMMENTS.

OH, I DIDN'T WANT TO.

MR. MYERS MENTIONED THE 200,000 AND THAT THAT WASN'T IN THE REPORT FOR HIS LAST COUNCIL MEETING. SO I JUST WANTED TO INQUIRE ABOUT THAT.

I WANTED TO ADDRESS THAT AS WELL.

YEAH, SO DO I.

SO, OKAY, CARRY ON.

SO EILEEN, ON FIRST.

DO YOU WANT TO GO BEFORE THE CITY ATTORNEY? IF YOU DON'T MIND. CARRY ON.

COUNCILMAN. DEPUTY MAYOR JOHNSON WANTS TO GO FIRST.

OKAY. ALL RIGHT, SO WE JUST HAD THE DISCUSSION ABOUT THE GOLF COURSE.

I MEAN, BASICALLY, STAFF WAS LOOKING INTO PURCHASING A GOLF COURSE, AND THEN STAFF HALTED THOSE NEGOTIATIONS.

I DON'T KNOW IF COUNCIL KNEW ABOUT THAT OR NOT.

SO NOW HERE'S ANOTHER EXAMPLE.

A DEVELOPER WENT TO STAFF WITH AN OFFER THAT THIS COUNCIL MAY HAVE CONSIDERED YET STAFF COMPLETELY DISREGARDED THIS ACT OF GOOD FAITH, A DONATION OF X AMOUNT OF DOLLARS TOWARDS A CRITICAL NEED IN OUR CITY.

THE APPLICANT IS DOING THIS NOT ONLY FOR THE SURFACE NEW RESIDENTS OF PALM BAY OR THOSE EXISTING RESIDENTS AROUND THE NORTHEAST AREA.

COLLECTIVELY, US OF COUNCIL HAVE HELD DEVELOPERS ACCOUNTABLE TO NINE PROJECTS BASED ON PUBLIC SAFETY, AND SAME WITH THE PLANNING AND ZONING BOARD.

NOW STAFF HAS MADE MADE THE DETERMINATION OF GOOD FAITH.

OFFER IS NOT WORTHY OF US TO HEAR OR CONSIDER.

AND I HONESTLY FEEL THIS TO BE UNACCEPTABLE.

AND I SPOKE TO THE CITY MANAGER ABOUT THIS.

WHEN I LEARNED ABOUT THIS. I WAS FURIOUS.

I REALLY WAS. SO GIVEN THAT THE FACTS WERE PRESENTED DURING AUDITS, NOT ALL THE FACTS WERE PRESENTED DURING ORDINANCE 2020 2112.

I'D LIKE TO MAKE A MOTION TO RECONSIDER ORDINANCE 2022 112 FOR THE NEXT AVAILABLE HEARING DATE.

GIVEN THAT WE WEREN'T PRESENTED ALL THE FACTS, SO WAS THAT WAS THAT OUR STAFF THAT.

YES, MA'AM, THAT'S CORRECT. THAT'S THE WAY I UNDERSTAND IT.

STAFF WAS PRESENTED AN OFFER FOR FOR AN X AMOUNT OF DOLLARS, A DONATION TOWARDS EITHER SOMETHING FIRE RELATED BECAUSE PLANNING AND ZONING BOARD HAD FIRE FIRE CONCERNS.

WE AS A COUNCIL HAVE PUBLIC SAFETY CONCERNS.

AND THEY SAW THOSE CONCERNS AND WERE WILLING TO GO ABOVE AND BEYOND TO HELP US WITH THOSE THOSE CRITICAL NEEDS AND STAFF DISREGARDED THEM.

SO THOSE FACTS WEREN'T PRESENTED.

AND THAT'S YOU KNOW, I DON'T KNOW COUNCILMAN FILIBERTO, AND WE'RE GOING TO GO TO THE CITY ATTORNEY, BUT FOR ME, IT WAS MORE OF THE BAIT AND SWITCH, RIGHT? BECAUSE IT WAS SOMETHING THAT WAS PRESENTED AND IT WAS A GREAT PROJECT.

AND THEN IT CAME BACK JUST A FEW SHORT MONTHS LATER AND IT WAS HIGHER DENSITY AND THE WHOLE NINE.

BUT I'M WILLING TO HEAR FROM THE CITY ATTORNEY, MA'AM.

YES, SIR. THANK YOU.

THERE ARE TWO SIGNIFICANT ISSUES ABOUT THIS PROPOSAL AS FAR AS THE 200,000 DONATION AND THE AND THAT DONATION HAVING AN EFFECT UPON COUNCIL'S DECISION REGARDING ZONING WHEN COUNCIL IS REZONING PROPERTY.

COUNCIL IS USING ITS POLICE POWERS AND THERE IS ACS GOING BACK TO THE FLORIDA SUPREME COURT TO THE FIFTIES THAT ACTUALLY

[01:00:06]

SPEAK ABOUT COUNCIL USING ITS POLICE POWERS AND AGREEMENTS.

YOU KNOW, WE'VE OFTEN TALKED ABOUT, IF YOU REMEMBER WHEN WE DID THE LAND USE WORKSHOP CONTRACT ZONING.

AND WHAT IS CONTRACT ZONING IS A SITUATION WHERE GOVERNMENT AGREES TO REZONE LAND IN EXCHANGE FOR CONSIDERATION GIVEN BY THE PROPERTY OWNER.

AND WHAT THE COURT HAS SAID, A LOCAL GOVERNMENT MAY NOT CONTRACT TO WEIGHT ITS POLICE POWERS.

YOU CAN'T DECIDE WHEN YOU DECIDE TO RESIGN.

YOU LOOK AT THE COMPREHENSIVE PLAN.

YOU LOOK AT THE SURROUNDING AREA.

YOU LOOK AT YOUR LAND DEVELOPMENT CODE.

YOU SHOULD NOT BE LOOKING AT WHETHER SOMEBODY'S GOING TO GIVE YOU MONEY.

THAT IS NOT APPROPRIATE CONSIDERATION.

THE OTHER ISSUE AS FAR AS THIS DONATION IS, WE MUST BE AWARE OF THE CHANGES TO THE IMPACT OF EU LAW, SPECIFICALLY ONE 63.31801 SUBSECTION FIVE.

NOTWITHSTANDING ANY CHARTER PROVISION, COMPREHENSIVE PLAN, POLICY, ORDINANCE, DEVELOPMENT ORDER, DEVELOPMENT PERMIT OR RESOLUTION, THE LOCAL GOVERNMENT OR SPECIAL DISTRICT MUST CREDIT AGAINST THE COLLECTION OF THE IMPACT FEE.

ANY CONTRIBUTION, WHETHER IDENTIFIED IN A PROPORTIONATE SHARE AGREEMENT OR OTHER FORM OF ITS ACTION RELATED TO PUBLIC FACILITIES OR INFRASTRUCTURE, INCLUDING LAND, DEDICATION, SITE PLANNING AND DESIGN OR CONSTRUCTION.

ANY CONTRIBUTION MUST BE APPLIED ON A DOLLAR FOR DOLLAR BASIS AT FAIR MARKET VALUE TO REDUCE ANY IMPACT FEE COLLECTED FOR THE GENERAL CATEGORY OR CLASS OF PUBLIC FACILITIES OR INFRASTRUCTURE FOR WHICH THE CONTRIBUTION WAS MADE.

SO HAD YOU TAKEN THIS, AGREED TO IT, HAD IT AS PART OF AN ORDINANCE, IT STILL SHALL.

THIS IS THE STATE STATUTE AND IT GOES INTO DEPTH HOW YOU CAN GO AROUND IT, WHATEVER REDUCES IMPACT FEE.

FIRST, YOU CAN'T PASTE YOUR DECISION ON IT.

AND IT'S NOT JUST FREE MONEY.

IT WOULD HAVE BEEN A CREDIT AT BEST AT HIS IMPACT FEE.

AND TO THE EXTENT THAT YOU WOULD DENY THIS WITHOUT KNOWING ABOUT THE CONTRIBUTION, IT SHOULD STILL BE DENIED.

BECAUSE IF YOU FOUND THAT IT WAS NOT CONSISTENT WITH THE COMPREHENSIVE PLAN, IT SHOULD NOT MAKE ANY DIFFERENCE THAT HE'S WILLING TO GIVE YOU MONEY.

ONE OF THE THINGS I KNOW IT'S BEEN A FEW YEARS SINCE MOST OF YOU CAME ON, BUT WHEN YOU CAME, A LOT OF YOU RAN.

YOU KNOW WHAT? WE'RE GOING TO CLEAN UP POMPEY'S IMAGE.

WE'RE GOING TO GET RID OF CORRUPTION.

MANY OF YOU MAY REMEMBER THE MAYOR HAD THE FBI COME HERE AND WE TALKED ABOUT THESE TYPE OF THINGS.

THIS IS NOT THE WAY TO GO.

WHAT YOU WANT TO DO IS MAKE DECISIONS BASED UPON YOUR COMPREHENSIVE PLAN, NOT BY DONATIONS IS NOT APPROPRIATE.

THIS IS NOT THE LOOK WE WANT.

THANK YOU, MA'AM. THANK YOU, MA'AM.

IF I JUST MAY SAY ONE THING.

OKAY. YEAH.

THANK YOU. THERE WAS NO NO BAD FAITH HERE ON MY END OR ON COUNSEL'S END.

WE'RE SETTING A TREND, AND THE DEVELOPERS ARE LISTENING TO THE TREND OF.

HEY. COUNCIL WANTS TO IMPROVE.

PUBLIC SAFETY. COUNCIL WANTS TO DO THIS.

THE COUNCIL WANTS TO DO THAT. WE DIDN'T ASK FOR 200,000.

WE DIDN'T TIE HIS HANDS.

HE VOLUNTARILY WENT TO STAFF AND SAID, HEY, I SEE THIS NEED.

I SEE COUNCIL TALK ABOUT THIS NEED.

HERE'S WHAT I CAN DO TO FILL THAT VOID.

SO I DON'T FEEL IT WAS ANYTHING EGREGIOUS.

MY MOTION IS I'M STILL GOING TO STAND WITH MY MOTION.

I UNDERSTAND THERE'S GOING TO BE A SECOND, BUT I DIDN'T SEE AS EGREGIOUS.

AND MADAM ATTORNEY, I HIGHLY RESPECT YOUR DECISION AND THANK YOU FOR SPEAKING, EXPANDING YOUR KNOWLEDGE ON THAT.

THANK. THEY ALSO ENFORCE THEM.

COUNCILMAN FILIBERTO, I SELECTED YOU.

BECAUSE I VOTED FOR IT.

IT WAS TURNED DOWN 3 TO 2 WITHOUT KNOWING THIS.

MONEY FOR THE FIRE STATION BECAUSE I DON'T.

I THOUGHT IT WAS A GOOD PROJECT AND I UNDERSTAND WHY HE DID IT.

I DIDN'T KNOW THAT 200,000 WAS OFFERED.

I REALLY DIDN'T. I VOTED FOR IT WITHOUT KNOWING THAT.

SO THAT'S WHY I'M TAKING YOUR MOTION, BECAUSE I STILL THINK IT'S A GOOD PROJECT.

WE VOTED LAST TIME WITH THE COTTAGES, RIGHT? WE VOTED. IT WAS A GOOD PROJECT THEN AND SHOULD STILL BE A GOOD PROJECT NOW.

AND THAT'S THE WAY I SEE IT.

THAT'S WHY I SECOND YOUR MOTION.

I THINK YOU SHOULD COME BACK AND THE COUNCIL TURN IT DOWN AGAIN.

I DON'T CARE ABOUT THE 200,000, AND I'M NOT VOTING.

I'M NOT SECONDED BECAUSE OF THE 200,000.

I'M SECONDING BECAUSE I BELIEVE IT'S A GOOD PROJECT.

THAT'S WHY I VOTED FOR IT LAST TIME.

I JUST WANT TO REITERATE WHAT THE CITY ATTORNEY SAID.

SHE SAID. THAT WOULD HAVE TO GO IN AS A CREDIT.

[01:05:06]

REGARDLESS. AND THAT WHAT WE'RE DOING IS IF WE AGREE TO THAT, WE'RE OPENING UP OURSELVES AND IT'S JUST A BAD TASTE.

SO I'M GOING I'M GOING WITH WHAT THE CITY ATTORNEY SAYS.

I UNDERSTAND I GOT A MOTION FOR RECONSIDERATION AND A SECOND.

BUT CITY CITY ATTORNEY.

YES. BEFORE YOU ALL CONSIDER, I DO WANT YOU ALL TO BE AWARE, TOO, WHEN YOU'RE SAYING RECONSIDERATION.

THERE IS AN ORDINANCE THAT TELLS THAT COUNCIL IS BOUND BY AS FAR AS WHEN YOU MAY RECONSIDER A CASE THAT HAS BEEN DENIED.

51.05. SUBSECTION B, THE CITY COUNCIL OR ANY BOARD MAY RECONSIDER THE SAME OR SIMILAR ISSUE WITHIN THE 12 MONTH PERIOD.

IF A MISTAKE, INADVERTENCE, SURPRISE OR EXCUSABLE NEGLECT HAS A RECURRED.

I DIDN'T HEAR ANY OF THOSE.

SO CERTAINLY IF THE COUNCIL IS LOOKING FORWARD TO MAKING THIS MOTION, YOU ALL NEED TO IDENTIFY WHAT THE MISTAKE, INADVERTENCE, SURPRISE OR EXCUSABLE NEGLECT AND THE FACT THAT YOU ALL DID NOT KNOW ABOUT SOMETHING THAT YOU CANNOT PROPERLY CONSIDER WHEN MAKING A REZONING DOES NOT FIT ANY OF THOSE.

SO JUST TO CLARIFY ON THAT POINT.

RIGHT, I BOUGHT SOMETHING FOR RECONSIDERATION AT ONE POINT AND IT HAD TO GO THROUGH A CONSENSUS.

RIGHT. AND THEN IT CAME BACK ON THE AGENDA TO TO RECONSIDER.

AND THEN WE WOULD HAVE RECONSIDERED IT HAD IT PASSED.

SO WE'RE AT A LINE, IS WHAT I'M HEARING.

SO DO WE.

I'M GOING TO I'M A BIT PERPLEXED BECAUSE I'VE GOT A MOTION THAT THAT REALLY ISN'T A WARRANTED MOTION, AND I GOT A SECOND WITH THAT.

SO I'M A BIT PERPLEXED ON MY MOVING FORWARD WITH THAT CITY ATTORNEY.

SO I'M I'M ASKING FOR GUIDANCE HERE.

TO. IS IT? CORRECT ME IF I'M WRONG. I THINK I THINK I FOLLOW WHAT YOU'RE SAYING THERE.

THERE SHOULDN'T BE EMOTION RIGHT NOW.

IT SHOULD BE A CONSENSUS FIRST.

IT SHOULD BE A CONSENSUS.

AND THEN IF IT WAS AND IF IT WAS CONSENSUS, THEN IT NEEDS TO BE SPECIFIED.

ON WHAT GROUNDS? THE MISTAKE OR NEGLECT OR WHATEVER THE CASE MAY BE.

TYPICALLY WHEN WE'VE HAD THIS, IT HASN'T OCCURRED OFTEN.

BUT IF A ATTORNEY OR AN APPLICANT WANT IT TO HAVE A REQUEST, THEY MADE IT OFFICIAL, THEY MADE A WRITTEN REQUEST.

THEY CITED THE GROUNDS AND, YOU KNOW, AND WHAT THEY FELT MET THOSE GROUNDS.

THAT STANDARD IS VERY SIMILAR TO A STANDARD FOR RECONSIDERATION THAT'S FOUND IN THE RULES OF CIVIL PROCEDURE REGARDING CASES THAT SEE IN THE COURT.

TYPICALLY GROWTH MANAGEMENT GETS THAT.

THEY PROVIDE IT TO ME.

I LOOK AT THOSE FACTUAL SITUATIONS AND LOOK AT CASE LAW BECAUSE THERE IS QUITE A BIT I'M MAKING A RENDER AN OPINION.

IT IS SET FOR A PUBLIC HEARING OR COUNSEL LOOKS AT WHAT THEY'VE MADE, LISTENS TO THE APPLICANT AND LISTENS TO.

AS FAR AS THE LEGAL OPINION ANYBODY WANTS TO GET PUBLIC COMMENT, COUNSEL THEN DETERMINES WHETHER THE FACTORS HAVE BEEN MADE.

THIS IS NOT HOW THIS TYPICALLY MOVES FORWARD, NOT FOR SOMETHING THAT WE'RE RECONSIDERING FOR A PUBLIC HEARING.

AND I HEAR YOU, MA'AM, BUT MY QUESTION STILL STANDS.

I'VE GOT A MOTION IN A SECOND, EVEN THOUGH THAT MOTION IS UNWARRANTED.

SO WHAT WHAT ACTION DO WE TAKE IF.

WE DON'T HAVE TO TAKE A VOTE ON A MOTION IN A SECOND.

THAT'S WHERE.

I THINK CERTAINLY I DON'T KNOW HOW THEY YOU HAVE A MOTION THAT DOESN'T ACTUALLY MEET ANY OF THESE GROUNDS.

I MEAN, THE EASIEST THING WOULD BE CERTAINLY IF THE TWO COUNCIL MEMBERS THAT WANT TO GO FORTH WOULD BE.

FOR THE OTHER THREE COUNCIL MEMBERS TO INSIST UPON THE APPLICATION OF OUR ORDINANCES AND GO FOR IT THAT WAY.

SO. SO WHAT I'M HEARING IS THE PROPER CHANNEL IS FOR THE APPLICANT TO SUBMIT TO GROWTH MANAGEMENT.

TO GO THROUGH THE ATTORNEY.

AND WE YOU KNOW, WE CONTINUE ON.

I'LL BE THAT. THAT'S WHAT I'M HERE.

COPY THAT. SO THAT'S SO BE IT.

SO BE IT. SO.

CERTAINLY YOU ALL CAN DENY IT BASED UPON THE FACT THAT THERE IS NO SHOWING OF ANY OF THE RELEVANT CHARACTER

[01:10:03]

CHARACTERISTICS. BUT AT NO POINT IN TIME CAN YOU GRANT IT, UNLESS YOU CAN GRANT IT BASED UPON A MISTAKE WHICH IS IN OUR ORDINANCE, INADVERTENT SURPRISE OR EXCUSABLE NEGLECT.

NONE OF WHAT THE APPLICANT SAYS MEET THOSE SO YOU CAN EITHER OUTRIGHT DENY IT OR YOU CAN DENY IT WITH THE ABILITY FOR HIM TO HAVE HIS ATTORNEY FOR THIS PROPERLY AND ACTUALLY ATTEMPT TO MEET ONE OF THE LEGALLY RECOGNIZABLE CATEGORIES.

THAT'S WITHIN OUR ORDINANCE, BUT AT NO FORTH SHOULD IT GO FORTH NOW, BECAUSE OTHERWISE YOU WON'T BE ADHERING TO YOUR OWN ORDINANCE.

COUNCILMAN. THANK YOU, MAYOR.

I MEAN, I THINK IT'S PRETTY CLEAR.

I MEAN, WE IT'S ALMOST I FELT LIKE WE SHOULDN'T BE HAVING THAT DISCUSSION TO BEGIN WITH.

IT'S A IT'S A I WOULDN'T SAY IT'S A WASTE OF TIME.

I THINK WE WANT TO HONOR AND RESPECT ALL COLLEAGUES OPINIONS AND THE WAY THEY FEEL ABOUT THINGS.

BUT IT TO ME, IT'S A IT'S REALLY.

IT'S A NO POINT TO TO MOVE FORWARD THE THE ATTORNEY.

WELL, SHE LAID LAID IT OUT WELL FOR US.

AND AND AT THIS POINT, MAYOR I SAY WE AND BY THE WAY, I DID SUPPORT THE PROJECT.

I BELIEVE IT WAS A GREAT PROJECT.

I WOULD VOTE FOR IT.

BUT CERTAINLY WE CAN UNDO WHAT WE WE THE THINGS THAT ARE ALREADY IN PLACE.

WE SETTING UP TERRIBLE PRECEDENTS.

EVERY SINGLE ONE OF US RUN FOR VERY THE VERY THINGS THAT WE DISCUSS RIGHT NOW.

I DIDN'T FEEL COMFORTABLE WITH THE MONEY INVOLVED.

I DIDN'T KNOW ABOUT THE MONEY.

I SUPPORTED THE PROJECT ON THE MERIT OF WHAT IT WHAT WAS PRESENTED, AND I WOULD VOTE FOR IT AGAIN SHOULD I HAVE TO.

BUT THERE'S A WAY IN WHICH WE SHOULD DO THINGS, DO BUSINESS.

SO, MAYOR, I WOULD SUGGEST THAT YOU CALL THE QUESTION AS FAR AS THE RECONSIDERATION AND WE GO FROM THERE.

COUNCILMAN FOSTER, IF YOU WOULDN'T MIND WITHDRAWING YOUR SECOND, I'LL WITHDRAW MY MOTION, AND ALL I'M GOING TO DO IS ASK FOR CONSENSUS.

IF WE CAN HEAR THEM AGAIN.

IF I GET THREE THUMBS UP, THEN WE HEAR IT AGAIN.

IF NOT, WE MOVE FORWARD.

COUNCILMAN FILIBERTO. I DON'T HAVE A PROBLEM DOING THAT.

I WITHDRAW MY SECOND AND I WITHDRAW MY MOTION.

I'M JUST GOING TO ASK FOR A CONSENSUS OF HEARING THIS PROJECT AGAIN BASED AT ALL.

THE ALL THE FACTS OF THE PROJECT WERE NOT STATED IN THE STAFF REPORT.

VERY FAR, IF WE WANT TO MENTION SORRY, WE WANT TO MENTION THAT NEGLIGENCE.

THAT'S FINE. I DON'T WANT TO GO THAT FAR WITH IT.

I'M SUPPORTING THE I'M GOING WITH THE RECOMMENDATION OF OUR CITY ATTORNEY.

I WOULDN'T SUPPORT A RECONSIDERATION ON THAT BASIS WITH THE MONEY BEING INVOLVED.

I'M NOT COMFORTABLE WITH IT. THANK YOU.

THANK YOU. SO I GOT A I GOT A THUMBS DOWN FROM COUNCILMAN FELIX.

I HAVE A THUMBS DOWN FROM MAYOR MEDINA.

AND I WOULD I WOULD JUST LIKE TO ENCOURAGE THE APPLICANT TO GO THROUGH GROWTH MANAGEMENT BECAUSE I'M REMEMBERING NOW THIS HAPPENED BEFORE WITH A PROJECT WHERE THE APPLICANT WENT TO LARRY BRADLEY, THE LATE LARRY BRADLEY, AND THERE WAS SIGNIFICANT CHANGES TO THE PROJECT AND THEN IT CAME BEFORE COUNCIL, BEFORE THE 12 MONTHS.

SO IT HAPPENS AND THIS HAPPENED SUCCESSFULLY.

SO I WOULD ENCOURAGE TO GO THAT ROUTE.

SO THAT'S WHY I'M AT MAYOR.

GOOD. ALL RIGHT. ALL RIGHT.

SO WE'RE NOW ON PUBLIC PUBLIC HEARINGS.

[PUBLIC HEARINGS]

ITEM NUMBER ONE.

TO OPEN UP THE PUBLIC HEARING ESTIMATE SHERMAN.

TO PRESENT THIS REQUEST.

THANK YOU, MARY. THIS IS ACTUALLY AN ADMINISTRATIVE CLEANUP ITEM RELATED TO A DEVELOPMENT AGREEMENT THAT CITY COUNCIL BACK IN 2020 HAD APPROVED WITH A COMPANY CALLED GRAPEFRUIT SCUBA LLC.

ESSENTIALLY, WHAT'S BEING BROUGHT BEFORE YOU IS AT THE TIME CITY COUNCIL APPROVED A LAND USE AND ZONING CHANGE AND THE REQUIREMENTS THAT WERE PART OF THOSE APPROVALS FOR THE DEVELOPMENT OF THE LAND WERE PUT INTO A DEVELOPMENT AGREEMENT.

THE ADMINISTRATIVE CLEANUP WE'RE DOING TONIGHT IS THE STEPS WERE NOT FOLLOWED WHEN THE DEVELOPMENT AGREEMENT WAS SIGNED, WHICH INCLUDED THE NEED TO HAVE PUBLIC NOTICE, ADVERTISING AND TWO PUBLIC HEARINGS.

SO THIS IS AN ADMINISTRATIVE CLEANUP ITEM AND WE CAN ANSWER ANY QUESTIONS YOU MAY HAVE.

ANY QUESTIONS? ANYONE IN THE AUDIENCE. WE DO HAVE LAURIN AND DEBORAH MCGEE.

MCGEE. 701 DALHART.

PULL THE MIC CLOSER TO.

SORRY, WE HAVE SINCE YOU MADE THE AGREEMENT.

WE HAVE THE WE'VE PURCHASED WE PURCHASED THE LAND FROM.

[01:15:02]

FROM GRAPEFRUITS CUBA.

AND WE GOT THE NOTICE ABOUT THIS MEETING.

AND WE WERE JUST A LITTLE CONFUSED BECAUSE I'M LIKE, WAIT A MINUTE, WE'VE GOT TO DEVELOP AS A HOBBY.

CAN YOU JUST SPEAK IN THE MIC, PLEASE? OKAY. WE GOT THE NOTICE ABOUT THE MEETING AND WE HAVE A CERTIFIED COPY THAT THIS WAS APPROVED.

AND SO WE WERE JUST A LITTLE CONFUSED.

WE'RE LIKE, DO WE GO OUT THERE? WHAT WILL WE DO? SO THAT'S WHY WE'RE HERE TONIGHT.

THE ONLY OTHER DON'T LOSE.

THAT'S THE ONLY COPY I HAVE ANYWAY.

THE ONLY COPY SHE HAS.

WE HAVE THIS PART OF THE AGENDA.

YEAH. YEAH, WE HAVE IT.

PART OF THE. AND THE OTHER ISSUE THAT WE'RE HAVING WITH WITH THE PROPERTY IS IT'S COMPLETELY FENCED.

IT WAS FENCED BY THE GENTLEMAN WE PURCHASED THE PROPERTY FROM.

IT'S FENCED, BUT THE FENCE IS FIVE FEET IN FROM ALL THE PROPERTY LINES.

AND ONE OF THE HOMEOWNERS ON THE NORTH SIDE OF OUR TO THE NORTH OF OUR PROPERTY HAS PUT UP A FENCE ALONG HIS PROPERTY LINES BACK TO OUR FENCE, WHICH IS REALLY 55 FEET ONTO OUR PROPERTY AND FILLED IT IN.

AND HE'S FILLED IT IN BECAUSE THE PROPERTY NATURALLY GOES DOWN BY THE PROPERTY LINES.

AND HE'S HE'S EXTENDED HIS BACKYARD UP TO OUR FENCE AND THEN FILLED THAT LAND.

SO HIS WATER IS DRAINING BASICALLY ON OUR LAND.

MY HUSBAND CALLED CODE ENFORCEMENT, AND CODE ENFORCEMENT TOLD HIM THAT THAT WAS A CIVIL ISSUE AND WE WOULD HAVE TO GET AN ATTORNEY.

AND I DON'T UNDERSTAND WHY THAT'S NOT A SOMETHING THAT WAS SOMETHING THAT THE CITY WOULD WOULD HELP.

HELP. BEFORE US TODAY, MA'AM, IS JUST WE'RE TRYING TO CLEAN UP THE POLICY THAT REGARDING THIS.

SO WE'LL JUST TAKE CARE OF THIS FIRST AND THEN COME BACK SOME TIME WITH YOU KNOW, THAT MAY BE A DIFFERENT VENUE FOR YOU TO.

ALL RIGHT. TO HANDLE THAT, WE DIDN'T KNOW QUITE HOW TO HANDLE IT.

SO THAT'S ALL WE'RE ASKING.

OKAY. SO, LIKE I SAID, THAT'S THE ONLY THING WE WE WERE JUST A LITTLE CONFUSED ON WHY THIS WAS EVEN AT A MEETING.

WELL, I'LL HAVE TO UNDERSTAND THAT.

I THINK SHE EXPLAINED IT, BUT.

SO I DON'T KNOW IF YOU WANTED TO HEAR IT AGAIN, BUT OUR CITY MANAGER EXPLAINED WHY THIS CAME BACK UP.

WE DIDN'T KNOW. WE DIDN'T KNOW.

SO THAT'S WHY WE THOUGHT WE'D BETTER WHEN WE FIRST GOT SOMETHING IN THE MAIL LAST WEEK, WE'RE LIKE, WE BETTER GET OUT THERE.

WELL, THANKS FOR COMING, OK.

THANK YOU. ANYONE WISH TO COME AND SPEAK FOR OR AGAINST THIS ITEM? STEP FORWARD, MASTER CHIEF.

BILL BATTEN 586 OCEAN SPRAY STREET SOUTHWEST.

WHEN I WAS GOING THROUGH THE AGENDA AND I WAS LOOKING AT THE ACTUAL AGREEMENT BETWEEN THE CITY, BETWEEN THE MR. YATES AND THE CITY OF PALM BAY.

I WAS THINKING BECAUSE I WAS ALL FOR THIS THING, YOU KNOW, 11 ACRES.

IT WAS GOING TO GO FROM RESIDENTIAL.

IT'S GOING TO BE BACK PUT BACK INTO RURAL RESIDENTIAL.

THAT'S EXACTLY WHAT EXACTLY THE TYPE OF THING THAT I WAS LOOKING FOR.

AND THEN TO FIND OUT THAT IT WASN'T EVEN MR. YATES A SIGNATURE THAT WE'RE EVEN LOOKING AT FOR THIS THING TO COME FORWARD AGAIN TO TO THE COUNCIL.

IT'S NOT EVEN THE SAME PROPERTY OWNER THAT SUBMITTED THE INITIAL AGREEMENT.

SO THAT GENERATES EVEN MORE CONCERN.

BUT WHEN I WAS LOOKING AT WHEN I WAS READING THE AGREEMENT, I NOTICE THAT A SAID IF THE LAND EVER SOLD, THERE WERE CERTAIN THINGS THAT HAD TO BE TAKEN WHEN THAT WITH THAT LAND SALE. AND HOW DOES THAT COME INTO PLAY ON THIS ONE? THIS ONE TURNED INTO ANOTHER BAG OF WORMS. BUT THE ONLY THING I'M HAPPY TO SEE ON THE WHOLE THING IS THAT AN INDIVIDUAL BOUGHT IT AND WANTED TO KEEP IT AS RURAL RESIDENTIAL.

I'M ALSO UPSET FOR THE FACT THAT NOW THAT I HEAR THE PERSON THAT DID THAT, THAT THEY'VE LOST FIVE MORE FEET OF THEIR PROPERTY, WHICH IN THEIR AGREEMENT THEY TOOK TEN FEET, THEY FROM THEIR PROPERTY LINE HAD TO BE CLEARED.

THEN THEY HAD TO PUT AN ADDITIONAL TEN FEET IN FROM THE PROPERTY FROM THAT.

SO THEY HAD 20 FEET OF PROPERTY BUFFER AROUND THEM.

SO THAT NOW PUTS THEM AT 25 FEET OF LOST PROPERTY ON 11 ACRES.

THAT'S THAT'S ALMOST TWO ACRES OF LAND THAT THEY'VE LOST.

AND THAT'S WHAT BOTHERS ME, ESPECIALLY ON SOMEBODY WHO'S TRYING TO GO RURAL, RESIDENTIAL, BECAUSE RURAL RESIDENTIAL, IF YOU'RE RUNNING LIVESTOCK, YOU NEED THAT LAND MASS JUST TO RUN YOUR STOCK.

IT'S A LITTLE BIT OF A CAN OF WORMS AND.

I JUST I'M NOT SURE WHERE YOU'RE GOING TO GO WITH THIS ONE, BECAUSE I LOOKED AT IT AS TWO DIFFERENT THINGS AND ONLY TO FIND OUT IT WASN'T EVEN THE SAME PERSON THAT ORIGINATED THE AGREEMENT WITH THE CITY.

I DON'T KNOW WHERE YOU'RE HEADED.

ANOTHER ONE FOR LEGAL.

LEGAL IS GOING TO GET A WORKOUT TONIGHT.

THANK YOU. I'LL BE THAT.

MADAM SHERMAN I GUESS THE ONLY COMMENT I HAVE IS THAT THERE'S A SECTION IN THE AGREEMENT THAT SAYS THAT THE AGREEMENT IS BINDING ON SUCCESSORS, SO ESSENTIALLY IT RUNS WITH THE LAND. SO THE AGREEMENT STILL STANDS WITH THE NEW OWNERS.

ANYONE ELSE WISH TO SPEAK FOR OR AGAINST THIS ITEM? NONE. I'M GOING TO CLOSE A PUBLIC HEARING AND ASK FOR A MOTION SO MOVED.

[01:20:01]

ITEM NUMBER FIVE.

ORDINANCE 2020 2-107, AN ORDINANCE OF THE CITY OF PALM BAY BREVARD COUNTY, FLORIDA OMITTING THE.

THE ZONING ORDINANCE OF THE CITY OF PALM BAY BY CHANGING THE ZONING OF PROPERTY FROM H.

C HIGHLY COMMERCIAL DISTRICT TO B AMU BAYFRONT MIXED USE DISTRICT, WHICH PROPERTY IS LOCATED WEST OF AND ADJACENT TO DIXIE HIGHWAY AND VICINITY NORTH OF MALABAR ROAD AND LEGALLY DESCRIBED HEREIN, PROVIDED FOR A CHANGE WITH THE ZONING MAP PROVIDING FOR AN EFFECTIVE DATE.

I WOULD OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO PRESENT THEIR CASE.

GOOD EVENING, MAYOR. MEMBERS OF THE CITY COUNCIL.

I DO HAVE A POWERPOINT JUST TO SHOW YOU THE PROJECT RENDERING.

AGAIN, WE WERE HERE TWO WEEKS AGO.

THIS IS THE OLD FIGHT PROJECT.

IT'S A MIXED USE PROJECT.

7000 SQUARE FEET, ABOUT 15% OR 20% OF IT IS COMMERCIAL.

IT'S SIX STORIES ON THE WEST AND FIVE STORIES ON THE EAST.

AND THIS IS A MIXED USE DEVELOPMENT.

OH, I APOLOGIZE.

I'M KIM ROSENKER. I'M HERE ON BEHALF OF THE APPLICANT WITH WOOD FIELD ACQUISITIONS LLC.

ALSO WITH ME IS ROSS ABRAMSON, THE PARTNER.

THIS IS THE PROJECT. AND AS THE ENGINEER OF RECORD, THEY'RE NOT ABLE TO BE HERE.

AND WE HAVE ALSO KIMLEY-HORN IS THE TRAFFIC ENGINEER, SO THERE'S NOTHING NEW TO PRESENT.

AGAIN, YOU MAY REMEMBER THIS.

THERE WAS A PEOPLE ARE VERY UPSET ABOUT THE WILDLIFE AND THE CANAL AND ON THE PROPERTY ALL THE AMENITIES WERE MOVED BACK INTO THE NORTH.

SO IT'S 100 FOOT AT LEAST BACK FROM THE WATER TO THE BUILDING, ALL THE AMENITIES OF PACE TO THE NORTH THERE.

AND THIS IS A MIXED USE PROJECT AND THE BAYFRONT MIXED USE, FUTURE LAND USE.

THIS IS COMPATIBLE AND CONSISTENT WITH THE GOALS AND OBJECTIVES OF THE COMPREHENSIVE PLAN AND YOUR LAND DEVELOPMENT REGULATIONS.

AND WE WOULD ASK THAT YOU APPROVE THIS REZONING TO BAYFRONT MIXED USE FROM HIGHWAY COMMERCIAL.

AND IF YOU HAVE QUESTIONS, WE'RE HERE TO ANSWER ANY OF THEM.

[01:30:01]

MA'AM, ANY QUESTIONS? COUNCIL MEMBER JUST COMMENT.

YES, SIR. MR. ZENKO, IF YOU WOULDN'T MIND, JUST AS A RECOMMENDATION, THIS COUNCIL DID PASS A LOW IMPACT DEVELOPMENT ORDINANCE.

IF YOU WOULDN'T MIND EXPLORING THAT ORDINANCE WITH STAFF DURING A DEVELOPMENT, I'D GREATLY APPRECIATE IT, CERTAINLY.

AND AS MY CLIENTS HERE TOO.

AND HE'LL DO THAT AS WELL.

THANK YOU ALL. NO FURTHER QUESTIONS AND NO FURTHER COMMENTS.

QUESTIONS. THANK YOU, MA'AM.

THANK YOU. I MEAN, BECAUSE EVERY MAN.

HE'LL SPEAK THE CARDS. I'M CLOSING THE PUBLIC HEARING, ASKING FOR EMOTION.

TO APPROVE ORDINANCE 2022 107.

SO I CAN. BOLSTERED BY COUNCILMAN FILIBERTO SINGING BY DEPUTY MAYOR JOHNSON.

ANY ADDITIONAL DISCUSSION, GENTLEMEN.

SO YOU'RE NOT ALL IN FAVOR OF ANY OPPOSE PASSES UNANIMOUSLY.

ITEM NUMBER SEVEN.

ADAM SMITH. OH, AS YOU WERE ITEM NUMBER SIX.

ALL RIGHT. ITEM NUMBER SIX OR ITS 2022, DASH 109.

AN ORDINANCE OF THE CITY OF PALM BAY.

BREVARD COUNTY, FLORIDA.

AMENDING THE ZONING OR AMENDING THE ZONING ORDINANCE OF THE CITY OF PALM BAY BY CHANGING THE ZONING OF PROPERTY FROM RC RESTRICTED COMMERCIAL DISTRICT TO RACE TO SINGLE FAMILY RESIDENTIAL DISTRICT, WHICH PROPERTY IS LOCATED EAST OF AND ADJACENT TO BROWNING AVENUE IN THE VICINITY NORTH OF MALABAR ROAD AND LEGALLY DESCRIBED HEREIN, PROVIDING FOR A CHANGE OF THE ZONING MAP, PROVIDING FOR AN EFFECTIVE DATE TO OPEN UP THE PUBLIC HEARING AS THE APPLICANT TO PRESENT THEIR CASE.

HELLO, MAYOR. COUNCIL.

HENRY MORIN HERE.

I FIRST OF ALL, I WANT TO BEGIN BY THANKING WHOEVER ON STAFF IS RESPONSIBLE FOR PUTTING THAT UP.

I DID NOT AT THE FIRST MEETING.

BUT NOW THAT THAT'S THERE, I THINK IT HELPS OUT.

NOW, THIS PARTICULAR LOT IS, OF COURSE, VACANT.

THERE ARE TWO LOTS SEPARATING IT FROM MALABAR ROAD.

THE ONE ON THE CORNER IS A LITTLE REAL ESTATE OFFICE.

ON THE OTHER SIDE IS THE BREWSTER'S THAT'S ON TWO LOTS DEEP.

AND BEHIND BREWSTER'S IS A SINGLE FAMILY RESIDENCE THAT HAS SOLD SEVERAL TIMES.

SO. UM.

BY REZONING THAT TO RESIDENTIAL, WE'LL BE ABLE TO HAVE A NEW HOUSE BEHIND ANOTHER HOUSE WITHOUT HAVING ANY NEGATIVE IMPACT ON BREWSTER'S AND NO NEGATIVE IMPACT ON THE BUSINESS.

THAT'S UP FRONT.

OKAY. ANY QUESTIONS? OKAY. THANK YOU.

AND SPEAKER CARDS.

OKAY. I'M CLOSING THE PUBLIC AND ASKING FOR A MOTION.

MOTION TO APPROVE ORDINANCE 2020 2-109 SECOND GOT A MOTION BY COUNCILMAN FILIBERTO, SECONDED BY DEPUTY MAYOR JOHNSON.

ANY ADDITIONAL DISCUSSION, GENTLEMEN? JUST WANTED TO SAY I VOTED NAY THE LAST TIME BECAUSE I APPRECIATE THE COMMERCIAL.

WANTED TO KEEP IT COMMERCIAL.

I'VE BEEN CONSISTENT ON THIS COUNCIL, SO I'M ALSO A NAY VOTE AGAIN.

SO I GOT A MOTION AND A SECOND.

ALL IN FAVOR.

ALL OPPOSE PASSES 3 TO 2.

WAS THAT YOU, COUNCILMAN FELIX, MEDINA AND FELIX NAME? ITEM NUMBER SEVEN.

OR IS 2020 2-1 11 AN ORDINANCE OF THE CITY OF PALM BAY BREVARD COUNTY, FLORIDA AMENDING THE ZONING ORDINANCE SO THE CITY OF PALM BAY, BY CHANGING THE ZONING OF PROPERTY FROM R.C.

RESTRICTED COMMERCIAL DISTRICT TO IRIS TO SINGLE FAMILY RESIDENTIAL DISTRICT, WHICH PROPERTY IS LOCATED BETWEEN AND ADJACENT TO DUVAL AND OUTER SEA AVENUES IN THE VICINITY NORTH OF MALABAR ROAD AND LEGALLY DESCRIBED HEREIN, PROVIDED FOR A CHANGE TO THE ZONING MAP PROVIDING FOR AN EFFECTIVE DATE.

THANK YOU, MA'AM. I'M GOING TO OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO PRESENT THEIR CASE.

UM, IN THIS CASE RIGHT HERE, YOU'LL SEE THAT THERE'S FOUR LOTS IN FRONT.

THEY'RE ALL HOUSES.

I DO WANT TO SAY, FROM MY EXPERIENCE OF 40 YEARS, THAT THE DEPTH OF THE TWO LOTS IS PRETTY MUCH SIMILAR TO THE DEPTH OF THE CHECKERS ON BABCOCK STREET, THE PIZZA HUT, ETC..

SO PULLING PULLING THESE TWO LOTS OUT.

[01:35:02]

WHAT THAT DOES, THAT RESTORES OUR RIGHTS TO USE THE PROPERTY.

IF. SOMEBODY WANTED TO CONVERT A HOUSE UP FRONT.

INTO THEIR OWN LITTLE OFFICE.

WE'RE STUCK BACK THERE.

NOBODY WOULD BUILD ANYTHING BACK THERE NOW.

PERHAPS IN A POINT IN TIME SOMEBODY CAN PUT THOSE FOUR LOTS TOGETHER AND WITH THAT KIND OF DEPTH, THEY CAN PUT A 8000 SQUARE FOOT BUILDING UP FRONT WITH ALMOST 40 PARKING SPACES.

THAT'S PRETTY DARN IMPRESSIVE.

BECAUSE I CAN TELL YOU THIS, IN THE LAST 15 YEARS, I COULDN'T I HAVEN'T BEEN ABLE TO DO IT, BUT MAYBE IN THE FUTURE.

SO I.

I URGE.

THE NEGATIVE VOTES TO RECONSIDER AND REALIZE THAT WHAT WE'LL HAVE LEFT IS 250 FOOT OF FRONTAGE BY 170 FOOT DEEP.

THERE WILL BE A 30 FOOT REAR SETBACK.

FOUR RETENTION.

A 30 FOOT FRONT SETBACK FOR BUILDING AND IN A ROW OF PARKING IS GOING TO RUN ABOUT 70 FEET.

THAT WILL LEAVE ROOM FOR A BUILDING OF APPROXIMATELY 45 TO 50 FOOT DEEP.

SO WHAT'S REALLY HAPPENING IS, IS WE ARE CREATING A SITE THAT'S NOT GOING TO BE AS EXPENSIVE AS MY SITE NEXT TO IT.

THAT IS THREE LOTS DEEP.

SO IT'S LIKE A MENU.

SO. SO I GOT TO SAY.

THANK YOU. ANY QUESTIONS? COUNSEL. IF I MAY ASK YOU THIS MORNING.

A QUICK QUESTION FOR YOU.

YES, SIR. YOU YOU KNOW WHAT MY POSITION IS AND I FELT THE SAME ABOUT THIS PROPERTY AS WELL.

WOULD YOU WOULD WE BE ABLE TO PUT A GAS STATION? GAS STATION? SHOULD WE APPROVE THAT? A GAS STATION? YES.

NO. A GAS STATION IS NOT ALLOWED IN OUR ZONING.

I'M JUST USING THAT AS AN EXAMPLE.

IN TERMS OF SIZE, SHOULD IT? I'M CONSIDERING EMERSON AND MALABAR ROAD.

SIMILAR CASES.

WE HAD TO FORGO THREE HOUSES IN ORDER FOR US TO.

WITHOUT THAT, WE WOULDN'T HAVE THE WAH WAH AND THE CUMBERLAND FARM ON AMAZON RIGHT NOW.

AND I'M LOOKING AT THE SAME SAME VIEWS, THE SAME THOUGHT.

THAT'S WHY MY POSITION IS STILL THE SAME IN TERMS OF I WOULD WANT TO SEE THERE'S A REASON WHY WE DID IT BACK THEN AND I WOULD WANT TO MAINTAIN IT THE SAME.

WELL, I WOULD LIKE TO RESPOND, COUNCILMAN, THAT I OWN THE CORNER OF ELDON.

THAT'S BIG ENOUGH FOR A GAS STATION.

I'VE CONTACTED.

YOU KNOW. BACK BEFORE WAH WAH CAME IN.

I CONTACTED WAH WAH FOR THAT CORNER.

I'VE HAD RACE TRACK, LOOK AT THAT CORNER, AND THEY TURNED IT DOWN BECAUSE YOU GOT TO CUMBERLAND FARMS AND THE WAH WAH.

ALSO, SURE.

GAS, YOU KNOW, GAS STATIONS, THEY WANT TO BE ON A SIGNALIZED CORNER.

SO WE'RE NOT REALLY I'M NOT REALLY.

ELIMINATING A SITE FOR GAS USE GAS STATION AS AN EXAMPLE.

BUT I'M THINKING ASIDE A NICE SIZED RESTAURANT OR ANY RESTAURANT.

AND SO I UNDERSTAND AN EXAMPLE.

LET'S TAKE A LOOK AT THE LOOK AT IT NOW.

IF YOU LOOK ALL THE WAY ON THE LEFT AT THE RED.

THERE'S THE FLOAT. THAT'S WHERE FLORIDA I ASSOCIATES IS.

OKAY, NOW I OWN THE SITE TO THE EAST OF THAT 290 FOOT OF FRONTAGE, 250 FOOT DEEP. I'VE HAD THAT SITE PLANNED OUT FOR FINANCIAL INSTITUTIONS, RESTAURANTS.

I'VE PRESENTED IT TO CHIPOTLE.

SO THERE, SIR, WE DO HAVE A LOCATION FOR A BIG RESTAURANT, FOR A SIT DOWN RESTAURANT, WHICH I THINK WE'VE ALL WANTED FOR YEARS.

AND I'M WORKING ON THAT NOW.

MATTER OF FACT, I JUST PLACED A RESTAURANT ON NEW HAVEN, AND I'M WORKING HARD TO PUT THEM ON ONE OF MY SITES ON MALABAR ROAD.

I MEAN, I'VE GOT A MENU.

IF YOU LOOK TO THE RIGHT OF THE TWO, YOU KNOW, THERE'S THAT LITTLE INSURANCE OFFICE RIGHT ON THE CORNER.

[01:40:07]

YOU MAY KNOW WHERE THAT'S AT, BUT I'VE GOT THE THREE LOTS BEHIND THERE.

SO THERE IT'S THREE LOTS.

YOU DO ABOUT FIVE PLUS OR -5000 SQUARE FEET AND HAVE PLENTY OF PARKING.

SO I THINK I'VE GOT A PRETTY GOOD I THINK I HAD A GOOD MENU CORNER ON A TRAFFIC LIGHT, ALMOST 300 FOOT OF FRONTAGE ACROSS FROM CITY HALL.

YOU KNOW, AND THE BUT AND OF COURSE, EVERYBODY'S PROBABLY BEEN TO THE ICE CREAM SHOP.

I GOT THAT AS A CORNER OVER THERE THAT I'VE PRESENTED TO COFFEE SHOPS AND I'VE PRESENTED TO FAST FOODS.

I MEAN, I'VE HAD THAT MENU AVAILABLE FOR OVER TEN YEARS, SO.

GRANTING THIS, WE'RE JUST CREATING A SMALLER SITE FOR SOMEBODY, YOU KNOW, IN THE FUTURE.

IT'S A WIN WIN SITUATION, ACTUALLY.

THANK YOU. DEPUTY MAYOR.

ANY SPEAKER CALLS SEEING KNOW I'M CLOSING THE PUBLIC HEARING ASKING FOR A MOTION.

MAYOR I'LL MAKE A MOTION TO APPROVE ORDINANCE 2022 AND 111.

SECOND MOTION BY COUNCILMAN FILIBERTO, SECONDED BY DEPUTY MAYOR JOHNSON.

ALL IN FAVOR, I.

ANY OPPOSE NAY PASSES 3 TO 2 MEDINA AND FELIX NAME ITEM NUMBER EIGHT ORDINANCE 2022 113 AN ORDINANCE OF THE CITY OF PALM BAY.

ASK THE APPLICANT TO PRESENT THEIR CASE.

GOOD EVENING. ANNA SAUNDERS WITH BSE CONSULTANTS.

I'M GOING TO CONTINUE THE LESS IS MORE TREND.

SO YOU GUYS HAVE HEARD ME COME UP HERE JUST TWO WEEKS AGO ON THE FINAL DEVELOPMENT PLAN FOR THIS PARTICULAR PROJECT.

I RESPECTFULLY REQUEST YOUR APPROVAL ON THIS.

IT'S THE SECOND HEARING.

IF YOU HAVE ANY QUESTIONS, I'D BE HAPPY TO ANSWER THOSE QUESTIONS.

IF I CAN ADD A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN FOSTER.

ANY ADDITIONAL DISCUSSION, GENTLEMEN? COUNCILMAN. DEPUTY MAYOR.

ALL IN FAVOR. ANY OPPOSE PASSES UNANIMOUSLY.

ITEM NUMBER OR.

THAT'S IT. WE'RE ON CONSENT.

DEPUTY MAYOR. YES, MA'AM.

[CONSENT AGENDA]

AND HE OPPOSED PASSES UNANIMOUSLY.

SO WE'RE NOW GOING ON TO ITEM FOUR.

DEPUTY MAYOR. RANDOLPH CHAYEFSKY.

[4. Consideration of City Council Flag Program nominee, Tom Gaume. (Councilman Foster)]

GILBERT. BILL BATTEN 586 OCEAN SPRAY STREET SOUTHWEST.

UNDER THE FLAG PROGRAM.

I'M NOT TRYING TO JUDGE WHO OR WHO GETS AND WHO DOES NOT.

WHAT I'M. A LITTLE BIT UPSET ABOUT IS THE FACT IN THE AGENDA THAT THE PERSONS DEED TO 14 IS MADE PUBLIC.

I'M WHEN I LOOK AT IT, I'M VERY PROUD OF WHAT HE'S ACCOMPLISHMENTS, WHAT'S THERE.

BUT THAT'S SOMETHING NOT EVERYBODY WOULD LIKE TO BE.

PUBLIC KNOWLEDGE.

GRANTED, HIS SOCIAL SECURITY NUMBER WAS TAKEN OUT AND THE AMOUNT OF MONEY THAT HE GOT WHEN HE RETIRED, WHEN HE STEPPED OUT OF SERVICE, THAT WAS ALSO BLACKENED OUT. BUT THE FACT THAT THE DEED TO 14 WAS MADE PUBLIC.

THERE'S SOME THINGS THAT I DON'T WANT PEOPLE KNOWING WHAT I WHAT I HAVE IN MY SKILLS, AND THAT'S GOING TO MAKE IT PUBLIC.

IF THAT WAS EVER ME, I WOULD SAY, NO, DON'T DON'T GIVE IT TO ME BECAUSE I DON'T WANT MY DUTY TO 14 BEING MADE PUBLIC.

[01:45:07]

THERE'S OTHER WAYS TO CONFIRM IF AN INDIVIDUAL IS.

RECEIVE ELIGIBLE TO RECEIVE WHAT YOU'RE TALKING ABOUT.

I. THAT'S SO HE DESERVES IT.

BUT I DON'T THINK OF MAKING PUBLIC A PERSON'S DUTY TO 14 SHOULD BE THE RIGHT PROCESS WHEN WE'RE TRYING TO RECOGNIZE SOMEBODY FOR THEIR ACCOMPLISHMENTS.

THAT'S IT. THANK YOU VERY MUCH.

YOU BRING UP A GREAT POINT, MASTER CHIEF.

AND I SHARED THAT WITH THE LAST ONE THAT I PUT UP THERE.

I WANTED TO USE HIS SILVER STAR WARRANT OR CITATION.

RIGHT. BUT THEY THEY STILL NEEDED THAT DEED.

2014. SO MAYBE WE COULD, AS COUNSEL, READDRESS THAT, MAYBE, YOU KNOW, BE SORT OF, YOU KNOW, GO THROUGH ANOTHER CERTIFICATION PROCESS OR VALIDATION PROCESS, MAYBE NOT DISCLOSE IT, MAYBE HAVE THE CITY MANAGER MAKE THAT DETERMINATION ONCE SHE MAKES THE VISUAL OF THE DEED TO 14 OR ANY OTHER WARRANT WARRANTED MATERIAL? BECAUSE ALSO, I WANT TO GO ON THE RECORD AS SAYING THERE'S SOME VETERANS THAT DON'T HAVE THE 14, THEY HAVE THE 256, BUT THEY STILL SERVED ANYWAY.

SO THAT THAT MAY BE SOMETHING THAT COUNCIL COULD CONSIDER AS WELL, BUT.

EXCELLENT POINT, MASTER CHIEF, AND I'M IN AGREEMENT WITH THAT.

WE'RE DOSTOEVSKY. THANK YOU, MR. MAYOR. COUNCIL. MY APOLOGIES.

OF NOTE THE SPEAKERS OUTSIDE AREN'T WORKING.

RANDAL OLSZEWSKI 348 BROOK STREET, NORTHEAST.

I KNEW THIS ITEM WOULD BE PULLED ANYWAY, SO I JUST KIND OF WANTED TO JUMP ON THE OPPORTUNITY TO COMMENT ON IT AND JUST WANTED TO SHINE LIGHT WHERE LIGHT DESERVES TO BE SHINED ON TWO FRONTS.

AND MY FIRST RECOGNITION WOULD ACTUALLY BE FOR COUNCILMAN FOSTER HIMSELF.

AND WITH THAT BEING SAID, COUNCILMAN FOSTER, IT'S NOT LOST UPON ME.

WHAT TYPE OF SYMBOLISM AN ACT OF YOU BRINGING MR. GRIMES NAME UP IS? IT'S A SYMBOLISM OF UNITY WITHIN WITHIN YOUR SERVICE AND RECOGNIZING A CITIZEN AND ANY DIFFERENCES THAT MAY OR MAY NOT EXIST ASIDE, YOU RECOGNIZE THAT INDIVIDUAL SERVICE.

AND I REALLY APPRECIATE THAT, SIR.

SO THANK YOU. THANK YOU FOR DOING WHAT YOU'RE DOING HERE ON THAT.

WHEN IT COMES TO MR. TOM. I JUST WANT TO OVERALL, YOU GUYS ARE ALL GIVE ME FUNNY LOOKS.

I'M TALKING ABOUT THE RIGHT ITEM, RIGHT? WHEN IT COMES TO MR. TOM GUM, I JUST WANT TO HIGHLIGHT THAT HE REALLY IS A TRUE SERVANT TO THE CITY OF PALM BAY.

I HAVE THE PLEASURE OF SERVING WITH HIM ON THE RECREATION ADVISORY BOARD.

I'M THE VICE CHAIR. HE'S THE CHAIR, AND THE MAN IS A WALKING ENCYCLOPEDIA WHEN IT COMES TO PALM BAY HISTORY.

EVERYBODY KNOWS ABOUT HIS CONSISTENT CIVIL ENGAGEMENT, AND I REALLY JUST COULDN'T SEE A BETTER, MORE WELL ROUNDED EXAMPLE OF SOMEBODY THAT I KNOW WILL TOTALLY APPRECIATE A FLAG FLOWN OVER HIS CITY HALL.

AND, MR. MAYOR, I JUST HAVE TO POINT OUT, YOU KNOW, YOU TALKED ABOUT BEATING A PATH TO CITY HALL.

I THINK MR. GORMAN'S BEAT A FEW PATHS TO CITY HALL HIMSELF.

SO I JUST I KNOW HE'LL BE HONORED WHEN THE DAY COMES.

AND I JUST REALLY APPRECIATE THAT YOU GUYS ARE BRINGING UP HIS NAME.

AND I HOPE THAT THAT THIS THING DOES GO THROUGH FOR HIM.

AND WHILE I DO HAVE A LITTLE BIT OF TIME, I WOULD LIKE TO EMPHASIZE MR. BANTON'S POINT. I THINK EVEN IF YOUR PROCEDURE REQUESTS THAT THE CLERK SEES THE FORM, PERHAPS WE DON'T PUBLISH THE FORM IN THE AGENDA PACKET BECAUSE WE DON'T NEED TO KNOW THAT MR. BARBERTON IS A TRAINED ASSASSIN.

THANK YOU. THANK YOU.

AND TOM GORMAN ALSO SERVES ON THE INFRASTRUCTURE INFRASTRUCTURE ADVISORY BOARD, AND HE IS THE CHAIR.

SO YOU'RE ABSOLUTELY RIGHT, SIR.

I NEED MOTION. OR LET ME MAKE THE MOTION AND MAKE A COMMENT.

MOTION TO FOR THE CITY COUNCIL FLAG PROGRAM TO NOMINATE THOMAS GUM TO FLY THE FLAG IN HIS HONOR.

SECOND, GOT A MOTION BY COUNCILMAN FOSTER, SECONDED BY COUNCILMAN FILIBERTO CARRION.

COUNCILMAN TOM GUNN WAS OPPONENTS IN THE LAST RACE I RAN AND IT WAS A VERY CONTENTIOUS RACE.

BUT THAT DIDN'T NEGATE THE FACT THAT HIS SERVICE.

I LOVE VETERANS.

AND I SAY THAT I SAID THAT BEFORE I RAN FOR OFFICE.

AND I CONTINUED TO SAY THAT I'M A VERY ADVOCATE OF LAW ENFORCEMENT AND VETERANS, AND I'M GOING TO CONTINUE TO ADVOCATE TILL THE DAY I DIE. AND ALTHOUGH ME AND TOM GUN DISAGREES A LOT, ONE DO ONE THING WE DO AGREE ON IS THE SERVICE TO OUR COUNTRY.

AND I RESPECT THEM FOR THAT.

AND I APPROACHED HIM.

HE DIDN'T ASK FOR THIS.

I APPROACHED HIM BECAUSE I COULDN'T THINK OF ANYBODY.

[01:50:06]

TO GIVE MY FIRST FLAG TO TO HIM.

SO I JUST WANT TO PUT THAT ON THE RECORD.

THANK YOU, COUNCILMAN FILIBERTO.

THANK YOU, MR. MAYOR. I JUST WANT TO SAY I FIGURED TOM GUAN WOULD PROBABLY GET A GET A FLAG HERE FROM OUR CITY BY ONE OF US.

I'M JUST VERY HAPPY AT YOU, COUNCILMAN FOSTER.

I REALLY AM. THANK YOU, SIR.

AT A MOTION BY COUNCILMAN FOSTER, SECONDED BY COUNCILMAN FILIBERTO.

ALL IN FAVOR, I.

PASSES UNANIMOUSLY.

ITEM NUMBER FIVE, RANDOLPH, FOLLOWED BY BILL BATTEN.

[5. Consideration of a Facility Use Agreement with Space Coast Light Festival Inc., for the Space Coast Light Festival at Fred Poppe Regional Park from November 18, 2022, thru January 1, 2023.]

THANK YOU, MR. MAYOR AND COUNCIL.

RANDALL OLSZEWSKI 348 BROOK STREET, NORTHEAST.

SO WHEN IT COMES TO THE SPACE COAST LIGHT FEST, RELOCATING ITSELF TO FRED POPPY REGIONAL PARK THIS YEAR AND THE INTENT IS TO SET FORTH FOR FUTURE YEARS.

I FEEL AS THOUGH A BRIGHTER LIGHT NEEDS TO BE SHINED ON THAT IDEA.

SO AS I ACTUALLY JUST MENTIONED IN MY PREVIOUS COMMENTS, I'M THE VICE CHAIR OF THE RECREATION ADVISORY BOARD, SO I WAS MADE AWARE OF THIS.

WE DON'T GET A LOT OF OF PUBLIC ATTENDANCE AT OUR MEETINGS.

OUR MEETINGS ARE NOT VIDEOTAPED.

THEY'RE AUDIO RECORDED.

I HAVE THE LOUDEST VOICE OF THE BUNCH, SO I KNOW I'M HEARD, BUT I DON'T KNOW HOW THE RECORDINGS QUITE COME THROUGH.

I DON'T KNOW IF THE CITIZENS OF PALM BAY FULLY COMPREHEND AND GRASP THAT THE SPACE COAST LIGHT FEST, TALKING ABOUT THE ONE THAT'S ALWAYS BEEN AT WICKHAM PARK, IS GOING TO COME TO OUR CITY.

I DON'T KNOW IF THE RESIDENTS BETWEEN MILTON AND THE ST JOHNS HERITAGE PARKWAY ON MALABAR ROAD ARE KEENLY AWARE THAT THE SPACE COAST LIGHT FEST WANTS TO RELOCATE TO OUR CITY.

I THINK THAT THEY DESERVE TO BE.

NOW I WILL MENTION AND THESE RECORDINGS, YOU CAN VIEW THEM THAT WHEN THIS WAS ORIGINALLY BROUGHT TO THE BOARD, IT WAS CONCEPTUAL AND AT THE POINT THAT A CONTRACT WAS DRAFTED, IT WAS PROMISED THAT THAT WOULD COME TO US AND WE WOULD KIND OF HOST A PUBLIC VENUE.

SO MY THOUGHT PROCESS WHEN I FIRST HEARD ABOUT THE CONCEPT IS IT WOULD COME TO FRUITION, THEN IT WOULD COME TO US.

WE COULD MAYBE, YOU KNOW, GET IT OUT INTO THE NEIGHBORHOOD, MAKE SURE THOSE FOLKS COULD COME TO OUR BOARD, VET ANY GRIEVANCES THEY MAY HAVE, ANY SUPPORT THEY MAY HAVE.

WE COULD ADJUST ON THAT, WHAT HAVE YOU, AND THEN IT CAN MAKE ITS WAY TO COUNCIL.

NOW, IF YOU COUNCIL APPROVE IT AS A CONSENT AGENDA ITEM, IF IT WASN'T POLLED, HOW WOULD THOSE FOLKS KNOW UNTIL THE EVENT STARTS AND ONCE THE EVENT STARTS, WE'RE ALREADY UNDER CONTRACT AND THE CONTRACT IS QUITE LIBERAL TO BOTH PARTIES.

AS FAR AS AN EXIT STRATEGY, I READ IT IN DETAIL, BUT I JUST DON'T KNOW IF ONE READING THROUGH A CONSENT AGENDA.

NOBODY'S SAYING ANYTHING.

DOES ALL THOSE FOLKS THE JUSTICE THAT THEY ALL DESERVE.

I'LL GO. I'LL GO TO SPACE COAST LIGHT FEST.

I'VE BEEN EVERY YEAR THAT I'VE BEEN A BREVARD COUNTY RESIDENT.

I'LL GO AGAIN. HOPEFULLY THEY HOST A5K, I'LL RUN THROUGH IT.

I'LL DO THE STROLL NIGHT, WHAT HAVE YOU.

BUT THOSE FOLKS DESERVE TO KNOW AND BE CONSULTED WITH AND UNDERSTAND THE IMPACT OF WHAT'S GOING TO OCCUR.

FURTHERMORE, AT THE RECREATION ADVISORY BOARD, I RECOMMENDED THAT IF WE ARE TO PASS THIS, I THINK IT SHOULD BE IN THE CONTRACT THAT THERE IS A NIGHT THAT IT IS COMPLETELY FREE TO PALM BAY RESIDENTS BECAUSE PALM BAY RESIDENTS, ESPECIALLY THOSE IN THAT AREA, ARE GOING TO BE THE ONES THAT DEAL WITH THE NOT SO FUN ASPECTS OF IT AS WELL AS THE FUN ASPECTS.

AND I THINK A SIMPLE REWARD, CONSIDERING WE'RE REALIZING 15% OF THE NET PROFIT WOULD BE TO GIVE BACK TO OUR COMMUNITY.

SOME OF THE FOLKS CAN'T AFFORD THESE PRICES THAT THEY'RE PUTTING, ESPECIALLY THESE WEEKEND ONES.

WE SHOULD HAVE A PRIME TIME NIGHT WHERE, IF YOU ARE A PALM BAY RESIDENT, AS YOUR LICENSE SAYS, YOU GET IN FREE.

THANK YOU. THANK YOU.

GO BACK. BILL BATTEN 586 OCEAN SPRAY STREET SOUTHWEST.

I'M APPRECIATIVE OF THE FACT THAT THEY WANT TO EXPAND ON THE LIGHT FESTIVAL.

MAKES SENSE.

I KIND OF AGREE THAT IN THE CITY OF PALM BAY, OR GIVEN SO MUCH OTHER STUFF AWAY THAT MAYBE SOMEBODY IS GOING TO BE BENEFITING, COULD BE WILLING TO GIVE A LITTLE BIT BACK TO THE RESIDENTS OF PALM BAY SINCE WE'RE SPONSORING SO MANY OTHER FREE FUNCTIONS THAT WE SHOULD MAYBE LET ONE SOMEBODY ELSE GIVE ONE NIGHT.

I AGREE WITH RANDALL ON THAT ONE.

ONE NIGHT, AT LEAST FREE FOR RESIDENTS OF PALM BAY.

IT'S NOT GOING TO IMPLEMENT.

NOT GOING TO IMPACT ON THAT MUCH, I WOULDN'T THINK.

BUT THE OTHER QUESTION THAT COMES UP WITH THIS ONE WAS BECAUSE OF THE FESTIVAL OF LIGHTS.

THAT'S ALSO GOING TO HAPPEN AT THE SAME TIME FOR THE ONE DAY OF THE CHRISTMAS EXTRAVAGANZA.

SO THEY'RE GOING TO BE HAVING TWO MASSIVE FUNCTIONS GOING ON IN THE SAME LOCATION.

I JUST CURIOUS HOW IT'S GOING TO IMPACT BECAUSE OF THE PEOPLE ARE TRYING TO GO TO FRED POPPI PARK FOR THE EXTRAVAGANZA.

[01:55:06]

THEY'RE ALSO GOING TO BE SAYING, WELL, MAYBE DO I SEE THE LIGHT FESTIVALS AT THE SAME TIME? AND SO SINCE THE EXTRAVAGANZA IS FREE, WHICH CARD DO YOU HAVE TO PAY OR WHICH CARD GETS IT IN? DOESN'T HAVE TO PAY WHEN THEY'RE DRIVING INTO THE FESTIVAL OF LIGHTS.

JUST CURIOSITY.

QUESTION YOU KNOW, ME BEING THE DOUBTING TOM THAT I AM, AND IF IT'S ON CITY PROPERTY, I DON'T THINK ANYTHING SHOULD BE FREE.

BUT THERE WE GO.

THANK YOU. AND YOU'RE ABSOLUTELY RIGHT.

THE FAMILY CHRISTMAS EXTRAVAGANZA IS THAT FAR DOUBLY.

I JUST WANT TO REITERATE THAT.

AND AND IF MADAME SHERMAN ALLOWS, MAYBE WE COULD HAVE, BECAUSE I KNOW THOSE TOPICS CAME UP REGARDING THE EXTRAVAGANZA.

SO IF WE COULD HAVE OK.

YEAH, WE'LL HAVE FRED POPPEA RECREATION DIRECTOR COME UP AND ADDRESS THE COMMENTS.

I'LL ADDRESS MR. BANTON'S QUESTION FIRST.

ON THE NIGHT OF THE EXTRAVAGANZA, THE EXTRAVAGANZA ENDS A GOOD 2 HOURS BEFORE THE LIGHT FEST PRESUMES SO.

JUST AS IN THE PAST, WHEN THE EXTRAVAGANZA IS OVER, PEOPLE WOULD EXIT AND THE LIGHT FEST WOULD NOT START TILL PROBABLY SIX 630.

SO I DON'T SEE A CONFLICT THERE.

AND THAT'S REALLY A LOGISTICAL QUESTION.

I MEAN, OBVIOUSLY IF YOU APPROVE THIS AND THE CONTRACT GETS SIGNED, WE'RE GOING TO HAVE A LOT OF MEETINGS BETWEEN STAFF AND THE PROMOTER TO TO IRON OUT ALL THOSE THINGS.

I WILL SAY THAT ONE OF THE OTHER THINGS THAT WAS BROUGHT UP WAS ABOUT TRAFFIC.

AND I THINK IN THE PACKET WE DID ADDRESS THAT THERE'S GOING TO BE A STAGING AREA AND ALSO THE FACT THAT THEY'RE GOING TO HAVE TWO OFF DUTY POLICE OFFICERS ON MALABAR ROAD TO HELP WITH THAT.

AND I THINK ONE OF THE NEGATIVES ON THAT FROM TRAFFIC PERSPECTIVE IS PEOPLE ARE THINKING ABOUT WHEN WE HAD THE REVERSE PARADE AND ON THAT PARTICULAR NIGHT THERE WERE 1300 CARS IN A LONG WAIT.

YOU GOT TO REMEMBER, THAT WAS ONLY ONE NIGHT, ONE EVENT.

THIS IS GOING TO BE SEVERAL NIGHTS FOR SEVERAL WEEKS.

SO I'M NOT ANTICIPATING WE'RE GOING TO HAVE THAT KIND OF TRAFFIC.

IF WE DO, THE STAGING AND THE ENTRY ROAD WILL ACCOMMODATE 600 CARS OR THEREABOUTS BEFORE WE HAVE ANY IMPACT ON MALABAR ROAD.

SO I THINK THAT ANSWERS ALL THE QUESTIONS.

SIR, ANY OTHER QUESTIONS? MORE MORE OF A STATEMENT.

IF THERE WAS GOING TO BE A PACKED NIGHT, IT WILL BE THE NIGHT THAT IT WILL BE FREE, CORRECT? IF I HAD TO GUESS.

YES, SIR. YEAH, THAT'S ALL RIGHT.

OKAY. BUT AGAIN, ANY COMMENTS THAT YOU HAVE, AS FOR IF YOU WANT US TO ADDRESS WHEN WE FINALIZE THIS, I MEAN, I THINK WHAT YOU HAVE, WHAT WE PRESENTED IS A DRAFT THAT WE WORKED ON.

THAT'S NOT A FINAL, BUT IT IS A COMMITMENT.

AND I DO WANT TO EMPHASIZE ONE THING, TOO, THAT, YOU KNOW, THE THE ENTIRE BURDEN IS PLACED ON THE PROMOTER AND HIS VOLUNTEERS, EVERYTHING ON THIS.

SO THIS WILL BE ABOUT TEN TIMES THE SIZE OF WHAT WE HAD PREVIOUSLY.

AND THE LABOR INVOLVED BY PARK STAFF OVER TWO YEAR PERIOD WAS ABOUT $25,000 IMPACT.

SO I WOULD THINK MR. BATTEN WOULD BE HAPPY WITH THAT, THAT WE'RE WE'VE REDUCED THE COST TO THE CITY BY BY THAT COST BEING BORNE BY BY THE PROMOTER AND HIS VOLUNTEERS.

AND THEY ALSO WILL BE WORKING WITH NON-PROFITS AS WELL AND PAYING THEM FOR THEIR VOLUNTEER TIME.

THANK YOU. COUNCILMAN FOSTER.

THANK YOU, MAYOR. HOW LONG THE SPACE COAST LIGHT PARADE.

HOW LONG THEY'VE BEEN AT WICKHAM PARK? CLOSE TO 20 YEARS, I BELIEVE.

BUT BUT THE ORGANIZATION THAT WAS RUNNING THAT IS NO LONGER DOING IT.

A NEW PERSON HAS PURCHASED THAT AND IS AND IS COMING TO TO PALM BAY.

OH, FOR 20 YEARS THEY'VE BEEN AT WICKHAM, I BELIEVE ABOUT 20 YEARS.

SO, SIR. 20 YEARS? YEAH.

AND AND YOU VIEW THIS AS A GOOD THING COMING TO PALM BAY? I THINK SO, YES, SIR, BECAUSE I THINK IT OPENS UP THE DOORS TO TO SOME OTHER OPPORTUNITIES FOR US AS WELL.

I CAN'T REALLY DISCUSS THOSE AT THIS TIME, BUT THE IDEA OF THIS AGREEMENT IS WE'RE GOING TO DO IT FOR ONE YEAR.

BUT BUT THE HOPE IS THAT IT'S GOING TO BE SUCCESSFUL AND AND VIEWED AS A SUCCESS BY BOTH THE CITY AND THE PROMOTER.

AND FROM THAT, WE WOULD WE WOULD BE TALKING ABOUT IT A LONG TERM AGREEMENT WHERE THEY WOULD BE HELPING US WITH SOME CAPITALIZATION OF PUTTING

[02:00:03]

THE PERMIT UNDERGROUND ELECTRIC IN.

AND THE THE BONUS OF THAT IS THAT IT WOULD ALLOW US TO HAVE THAT ELECTRIC FOR OTHER OTHER EVENTS THAT WE MAY WANT TO HAVE IN THE PARK.

DO YOU HAVE AN ECONOMIC IMPACT THIS WOULD BRING TOWARDS THE CITY? NOT NOT RIGHT OFF THE TOP OF MY HEAD.

BUT I CAN TELL YOU FROM WHEN I WAS AT AT THE COUNTY, IT'S IT'S IT'S PRETTY BIG.

I MEAN, IT'S VERY SIGNIFICANT AND IT'S RECOGNIZED BY THE TOURIST DEVELOPMENT COUNCIL AS WELL, BECAUSE IT DOES BRING PEOPLE FROM OUTSIDE THE COMMUNITY AS WELL.

THANK YOU, SIR.

IT'S A WORTHWHILE PROJECT.

ANY OTHER QUESTIONS? THANK YOU. THANK YOU, SIR.

THANK YOU. APPRECIATE IT.

YEAH, THAT, THAT.

AND I JUST FOR THE RECORD, THE FAMILY CHRISTMAS EXTRAVAGANT EXTRAVAGANZA REMAINS F R W E, BUT I'VE GOT.

I NEED A MOTION. SO MOVED A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY MAYOR MEDINA.

ANY FURTHER DISCUSSION.

DEPUTY MAYOR. ALL IN FAVOR.

PASSES UNANIMOUSLY.

ITEM NUMBER SIX.

DEPUTY MAYOR. MR.

[6. Consideration of utilizing Stormwater Utility Funds to open a project and provide a budget for the replacement of the failed culvert pipes under Bass Pro Drive ($172,000).]

BILL BRATTON. WELL, FIRST, BEFORE MR. BILL SUZANNE WANTED TO MAKE A CORRECTION.

THANK YOU. CARRY ON.

I DIDN'T CREATE IT. SEE, I COULD USE SOME LIGHTS THERE ON THE LIST.

I SEE, MADAM. I SEE MADAM JONES JUST SHAKING HER HEAD IN THE BACKGROUND THERE.

SO THE. THE ADJUSTMENT THE STAFF BROUGHT ME EARLIER THIS WEEK ON THIS ITEM IS THE ESTIMATED COST FOR THE REPAIR IS 172,000.

THE REQUEST INSTEAD IS TO INCREASE THAT REQUEST TO $220,000 OUT OF THE STORMWATER AND DESIGNATED FUND FUND BALANCE FOR THIS PROJECT BECAUSE THERE IS ANOTHER PIPE THAT IS ALSO EQUALLY AS OLD AS THE OTHERS APPARENTLY, BUT HAS NOT YET FAILED BUT IS VERY CLOSE TO THE ONE THAT FAILED THAT WE'RE GOING TO FIX.

SO WE'D LIKE TO HAVE ENOUGH FUNDING TO TAKE CARE OF EVERYTHING KIND OF IN ONE FELL SWOOP WHEN WE'RE OPENING UP THE ROAD.

SO THAT IS THE REQUEST TO ADJUST THE AMOUNT IN THE MEMO TO 220,000 AS THE FUNDING REQUEST FOR THE BUDGET.

BE THAT. ANY QUESTIONS? COUNCIL. IN OTHER WORDS, REPAIRING IT BEFORE IT FAILS.

AT THE SAME TIME, LIKE THE ONE THAT HAS ALREADY FAILED.

THAT HAS ALREADY FAILED.

OKAY. ANY SPEAKER CARDED UP TO ME.

MR. BILL BATTEN. BILL BATTEN 586 OCEAN SPRAY STREET SOUTH WEST.

I UNDERSTAND THE STORMWATER UTILITY FUND IS EXACTLY WHAT IT'S FOR AND WE HAVE A FAILED STORMWATER PIPE THAT FAILED.

IT HAS TO BE REPLACED.

I UNDERSTAND THAT 110%.

THE PART THAT FOR REWINDING MY HISTORY TAPES WAS THE FACT THAT.

WHEN WE WHEN WE WERE TIGHT ON FUNDS FOR ROAD PAVING AT THE TIME IT HAPPENED TO BE THAT BASS PRO WAS ONE OF THE ROADS THAT GOT PAVED. BECAUSE OF BUSINESS WAS COMING IN THERE AND ME THINKING, WE'RE LEARNING A LOT FROM MR. WATANABE NOW OF WHEN THE ROAD LOOKING AT THESE FAILED THE PIPES THAT LOOK LIKE THEY'RE GOING TO FAIL.

HE'S CORRECTING THEM BEFORE THEY PAVE THE ROAD.

AND, YOU KNOW, I'M JUST I'M JUST WANTING TO SAY, LET'S TRY TO SEE IF WE CAN TAKE A PAGE OUT OF HIS HISTORY BOOK AND SAY, LET'S SEE IF WE CAN FIX THESE BEFORE THEY FAIL INSTEAD OF AFTER WE'VE SPENT THE MONEY ON THE PAVING THAT WENT IN FIRST ON BASS PRO.

THANK YOU VERY MUCH.

THANK YOU. AND I DO UNDERSTAND THEY FAIL AND THAT'S THE PROCESS.

I ALSO LIKE THE FACT THAT THE PIPES THAT HE'S REPLACING THEM WITH ARE 100 YEAR PIPES, WHICH.

ALSO MAKES A LOT OF SENSE AND THEY'RE CHEAPER AND EASIER TO WORK WITH.

THANK YOU. SUPPORTING.

I NEED. I NEED EMOTION.

MOST OF THE PROOF THE BUDGET FOR PROJECT 23 SUE TO 12 WITH THE REVISED AMOUNT OF 20 220,000 FOR UNIT 60 PIPE REPLACEMENT, I CAN ADD A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN FELIX.

ANY FURTHER DISCUSSION, GENTLEMEN? ALL IN FAVOR. ANY OPPOSE PASSES UNANIMOUSLY.

WE ARE NOW ON ITEM NUMBER SEVEN.

[7. Acknowledgement of the October 2022 GO Road Bond Paving report update.]

COUNCILMAN FILIBERTO.

IS THERE AN EMERGENCY MANAGER FOR A ONE TIME? COME UP, PLEASE, SIR.

FRANCOIS TANABE, OUR CITY ENGINEER.

GOOD EVENING, FRANK WATANABE, CITY ENGINEER.

GOOD. GOOD TO SEE YOU. I JUST WANTED TO PROVIDE AN UPDATE HERE REGARDING IV NUMBER SEVEN.

PARDON? REGARDING THIS ITEM.

JUST TO HIGHLIGHT AGAIN WHERE WE ARE WITH THE ROAD PAVING.

WE'RE STILL IN UNIT 48, WHICH IS THE AREA OF NORTH AND SOUTH OF EMERSON.

[02:05:02]

WE FINISHED ALL THE STREETS NORTH OF EMERSON, SO NOW WE'RE ON THE SOUTHERN HALF.

CURRENTLY, NOW WE'RE FINISHING MAJORITY OF THE MILL AND PAVE, AND STARTING NEXT WEEK WE'LL START DOING THE FDR IN 48.

SO THE MOVE FORWARD, THE PLAN IS TO HAVE ALL THE FDR UNIT 48 AND THEN MOVE OVER TO EMERSON.

THIS SECTION OF THE EMERSON BETWEEN THE FRED LEE PARK AND PRETTY MUCH MALABAR.

THAT'S THE LAST PIECE OF EMERSON FOR THAT SEGMENT, WHICH WILL BE FDR, WHICH WE THAT RANGER WILL FOLLOW UP AND FINISH THAT WITHIN TWO WEEKS.

SOON AFTER THAT, THEN THEY'LL JUMP TO THE OTHER HALF OF EMERSON BETWEEN AMADOR AND JUPITER, WHICH IS A SECTION THAT ALSO HAS A SIGNAL.

THEY'RE GOING TO REDO THAT SECTION AS WELL.

IT'S THE MILL AND PAVE AND THEN INSTALL THE TURN SIGNALS.

I MEAN, THE TURN LANES AT THE SIGNAL AT GLEN COVE.

ALSO, RANGERS ON BOARD TO DO THAT.

WE'RE ALSO MOVING FORWARD WITH UNIT 30, IF YOU HAVEN'T BEEN OUT THERE YET.

UNIT 30 INCLUDES DEGROOT AND WE'VE BEEN WORKING ON DEGROOT AT NIGHT.

IN FACT, I'M GOING TO BE OUT THERE IN THE NEXT 30 MINUTES WHEN WE GET DONE HERE, BECAUSE THEY'VE BEEN THEY'VE BEEN DOING NIGHTTIME WORK TO BE SAFE.

THEY'VE GOT PRETTY MUCH EVERYTHING UP TO ALMOST TO THE HIGH SCHOOL.

AND SO THIS EVENING THEY'LL BE AT THE INTERSECTION OF BAYSIDE AND THEN CONTINUE ON.

THEY HOPE TO HAVE THEY'RE NOT GOING TO WORK FRIDAY AND SATURDAY BECAUSE OF THE TRAFFIC AND THEN THEY'RE GOING TO RESTART ON SUNDAY AND HOPE TO HAVE SUNDAY AND MONDAY ALL THE WAY UP TO JUPITER.

AND THEN THEY'RE GOING TO REVERSE IT AND GO THE REVERSE DIRECTION.

AND SO THEY SHOULD BE ALL DONE WITH THE GROUP BY THEN THE NEXT WEEK.

THE GOOD NEWS IS WE'RE ALSO GOING TO START DOING SOME OF THE FDR.

THE PIPES ARE DONE IN UNIT 30.

GREAT. AND SO WE'RE NOW WORKING WITH ADDING THE BILLINGS FINISHED UP THE EDGE RATING AND HOPEFULLY WITHIN THE NEXT COUPLE OF WEEKS START THE FDR AND UNIT 30.

BUT UNIT 30 IS VERY LARGE, IS OVER 30 MILES.

ALSO, IT'S GOING TO TAKE SOME TIME.

IT'S THE CONTRACT IS SIX MONTHS, SO WE STILL HAVE PLENTY OF TIME TO FINISH THE PROJECT.

BUT UNIT 30 IS MOVE ALONG.

AND THEN THE GOOD NEWS IS WE OPENED BIDS AND WE ORDERED A NEW ONE FOR CONNECT AND PORT MALABAR ROAD.

THIS WOULD BE PORT MALABAR FROM BABCOCK ALL THE WAY TO US ONE, AND WE'LL TAKE CARE OF THAT RAILROAD CROSSING THAT WE'RE ALL AWARE OF.

I'M STILL WORKING WITH FTA, I'M STILL WORKING WITH THE RAILROADS.

THERE'S A DIP IN THE ROAD.

THE WAY THEY INSTALL THE TRACK.

THE TRACK WAS SUPER ELEVATED, SO WHEN THEY RAISE THAT TRACK, THEY CREATED A DIP IN THE ROADWAY.

IT MEETS ALL THE FTA REQUIREMENTS, BUT THERE'S STILL A DIP IN THE ROADWAY.

AND SO I'M STILL WORKING WITH THAT TO SEE IF THEY'LL COME BACK.

THEY WORKED ON IT TWICE AND I WON'T SEE IF THEY'LL COME BACK AND WORK ON A THIRD TIME.

THE FINAL DRAW WOULD BE FOR US TO DO IT.

AND SO NOW WE HAVE A CONTRACT READY TO GO, BUT WE WAIT FOR THE CONTRACT TO BE TAKEN CARE OF AND THEN WE'LL MOVE FORWARD WITH THAT PROJECT.

THAT'S KIND OF IN A NUTSHELL WHERE WE SIT WITH THE CURRENT PROJECT.

THANK YOU, FRANK. AND I APPRECIATE YOU MENTIONING THAT.

THAT RAILROAD CROSSING AT PORT MALABAR, BECAUSE I TAKE THAT CROSSING REGULARLY AND I EVEN SEE I STILL SEE SOME SCRAPE MARKS ON THE GROUND THERE.

NOW WE'RE WORKING ON IT. YEAH, ON THE EASTBOUND LANE.

SO MY LAST QUESTION FOR YOU.

I KNOW I ASK THIS EVERY TIME OF DISCUSSING THE WARRANTY PERIOD, DO WE HAVE ANY OPEN DEFECTS OR ANY, ANY CONCERNS REGARDING THE ROAD, OUR ROADS MOST RECENTLY PAVED? ACTUALLY, NO. WE'VE BEEN CAUGHT UP.

THE NEXT SET OF GROUPS IS A VERY LARGE ONE.

JUNE IS 24 AND 25.

THOSE ARE MAJOR FEATURES.

AND SO OUR INSPECTORS AND MYSELF HAVE BEEN GOING OUT AND CHECKING THE STREETS.

WE FOUND A FEW PUNCH THIS ITEMS FROM NOTHING MAJOR.

WE HAD SOME ISSUES IN UNIT 24 BECAUSE OF THE MATERIAL.

SOME OF THE MATERIAL IS RATTLING EARLY ON, BUT THEY FIXED IT WHEN THEY WERE STILL HERE.

WE HAVEN'T SEEN IT YET, BUT WE HAVE CONCERNS WITH THAT RATTLING.

BUT BEYOND THAT, THE ROADS ARE IN PRETTY GOOD SHAPE AND WE ONLY FOUND A FEW PUNCH MINOR PUNCH ITEMS. SO FAR, NOTHING MAJOR.

THANK YOU, FRANK. MY LAST QUESTION.

I KNOW THIS IS REGARDING ROBOT, BUT I WANT TO BRING IT UP ANYWAY.

WAY REJUVENATION AND REJUVENATION PROJECTS.

COME UP HERE, SIR.

I'M SPEAKING WITH OUR PROCUREMENT.

WE'RE GOING TO BE GOING OUT WITH A PIGGYBACK.

WE HAVE BECAUSE WE SKIPPED ONE YEAR, WE ACTUALLY INCREASED SOME OF THE STREETS AND SO WE HAVE A SIGNIFICANT AMOUNT OF STREETS TO DO FOR THIS COMING YEAR, CLOSE TO 3 TO $4 MILLION.

AND SO HOPEFULLY WE'LL GET THAT WRAPPED UP.

MY GOAL IS TO GET IT OUT IN THE NEXT 30 DAYS AS A PIGGYBACK CONTRACT AND HOPEFULLY HAVE THAT STARTED SOMETIME IN JANUARY.

EXCELLENT. THANK YOU, FRANK. OKAY.

THANK YOU. IN MOTION.

A MOTION TO APPROVE ACKNOWLEDGMENT OF OCTOBER 2020 TO GO ROAD BOND PAVING REPORT UPDATE SECOND GOT A MOTION BY COUNCILMAN FILIBERTO SECONDED BY DEPUTY MAYOR JOHNSON. ANY ADDITIONAL DISCUSSION, GENTLEMEN? SO YOU'RE NOT ALL IN FAVOR.

AND HE OPPOSED PASSES UNANIMOUSLY.

ITEM NUMBER TEN.

MR. BILL BACK. BILL BATTEN 586 OCEAN SPRAY STREET SOUTHWEST.

[10. Acknowledgement of the City’s Co-Sponsorship Policy annual update.]

WHILE I WAS LOOKING AT THE AGENDA PACKET AND REVIEWING ON THIS ONE.

I'M NOT GOING TO GO INTO THE GOOD OR THE BAD OR MY OPINION, YOUR OPINION ON THIS.

BUT WHAT I WOULD LIKE TO LOOK AT IS THE FACT THAT SOMEHOW THE ORGANIZATIONS THAT WERE DOING CO-SPONSORSHIP WITH AT LEAST PARTICIPATE A LITTLE BIT INTO THE MANPOWER COST, AT LEAST, YOU KNOW, FACILITIES IS ONE THING.

[02:10:07]

EQUIPMENT IS SOMETHING ELSE.

BUT THE MAN HOURS THAT COMES 100% OUT OF THE TAXPAYER DOLLAR.

WE DON'T HAVE ENOUGH POLICE FORCE AS IT IS NOW YET.

WE HAVE TO HIRE OUR POLICE FORCE ON OVERTIME FOR THESE CO SPONSORSHIPS.

WE'RE ALREADY SHORTFALL.

AND SO BUT THAT WE'RE DOING THAT AND IT COMES OUT AND THEY STILL THESE INDIVIDUALS STILL HAVE TO BE PAID JUST BECAUSE THE CITY SAYS, WELL, WE'RE CO-SPONSORING YOU THOSE POLICE OFFICERS AND FIREFIGHTERS AND PUBLIC AND PARKS AND RECS INDIVIDUALS STILL HAVE TO BE PAID.

THAT COMES 100% OUT OF THE TAX DOLLAR POCKETBOOK.

SO I'M JUST SAYING, MAYBE CONSIDER IT.

IF YOU WANT A CO-SPONSOR, THAT'S FINE.

BUT AT LEAST ASK THE INDIVIDUALS THAT YOU'RE CO-SPONSORING WITH IF THEY'RE WILLING TO PITCH IN A LITTLE BIT TOWARDS THE MANPOWER THAT THEY'RE TAKEN OUT, BECAUSE THAT'S A RESOURCE THAT WE'RE ALREADY SHORT OF.

THANK YOU VERY MUCH.

THANK YOU. ANY OTHER SPEAKER ON THIS ONE GENTLEMAN, THIS THIS WAS PULLED AND I HAVE A FEW COMMENTS REGARDING THIS.

AND AND MY COMMENTS ARE GOING TO BE.

REGARDING THE FAMILY CHRISTMAS EXTRAVAGANZA.

NOW I HAVE FIRSTHAND KNOWLEDGE OF OF THAT BUDGET.

AND IT IT ALWAYS EXCEEDS $25,000.

NOT INCLUDING MAN HOURS.

NOT INCLUDING GIFTS THAT ARE ALSO PROVIDED FROM FROM OTHER NONPROFITS.

AND WHEN I LOOK AT THIS LIST.

OF PARTNERSHIP.

GENTLEMEN. ICE.

I SEE THIS FAMILY CHRISTMAS EXTRAVAGANZA AS A STAND ALONE, THE LARGEST CHRISTMAS PARTY ON THE SPACE COAST.

NOW, AS YOU KNOW, I.

I DON'T VOTE ON THIS ITEM AS A CO-SPONSORSHIP, RIGHT.

BECAUSE OF MY MY WORK AS A AS DIRECTOR OF MINISTRIES, WHICH IS A VOLUNTEER POSITION AS AN ORDAINED MINISTER. RIGHT.

SO MY AND I KNOW THAT I'M SURPRISED THAT WE STILL HAVEN'T DISCUSSED THAT CO-SPONSORSHIP HASN'T COME TO US YET.

AND THIS IS GOING TO BE DECEMBER 17TH.

BUT WHEN YOU LOOK AT THIS AND YOU SEE THIS STAND ALONE, MAYBE WE COULD COME INTO SOME TYPE OF DIFFERENT PARTNERSHIP.

WITH THIS ORGANIZATION, AS THEY HAVE REALLY OVER THE LAST IT'S GOING TO BE THE 14TH ANNUAL.

SO I WANTED I WANTED TO TAKE THE OPPORTUNITY TO SHARE MY THOUGHTS REGARDING THAT WITH EACH AND EVERY ONE OF YOU.

I THINK EVERY ONE OF US HAS SEEN THE FAMILY CHRISTMAS EXTRAVAGANZA IN ACTION.

I'M NOT SURE ABOUT COUNCILMAN FILIBERTO, WERE YOU THERE LAST YEAR, BROTHER? YES, SIR. IT WAS OK.

COPY THAT. THANK YOU.

BUT I JUST WANTED COUNSEL TO START LOOKING AT THAT BECAUSE YOU KNOW THE VALUE OF IT, AND IT'S CERTAINLY DIFFERENT BECAUSE EVERYTHING IS FREE.

THERE'S NO CHARGE FOR THIS.

EVERYTHING THAT THEY DO IS IN PRIZES AND ENTERTAINMENT IS FREE.

SO I JUST WANTED TO KEEP THAT.

WANTED TO MAKE THOSE COMMENTS TO EACH AND EVERY ONE OF YOU PUBLICLY.

SO I NEED A MOTION.

SO MOVE. IT'S LIKE AN EMOTION BY DEPUTY MAYOR JOHNSON.

SECONDED BY COUNCILMAN FELIX.

ANY ADDITIONAL DISCUSSION? ALL IN FAVOR? I. AND HE OPPOSED PASSES UNANIMOUSLY.

ITEM NUMBER 12.

IT'S THE BILL THAT. BILL BATTEN 586 OCEAN SPRAY STREET

[12. Consideration of travel and training for specified City employees (Police Department).]

SOUTHWEST. 100% AND MONEY BEING SPENT FOR THE POLICE DEPARTMENT ON THIS CASE BECAUSE THERE'S NOTHING MAKES ME FEEL SAFER THAN HAVING A WELL-TRAINED POLICE FORCE.

OTHER THAN A WELL TRAINED MILITARY PROVIDER.

THEY'RE NOT AFTER ME.

I'D LIKE TO KNOW ON THIS ONE, THOUGH, IT'S WHEN THEY GET BACK FROM THIS TRAINING.

LAST YEAR WE ACTUALLY HAD SOME PEOPLE THAT WERE PRESENTING AT THE SWAT TRAINING COURSE AND THEY CAME IN, I THINK SIXTH OR SOMETHING LIKE THAT, WHICH I THOUGHT WAS A PRETTY GOOD STANDING FOR THE FIRST TIME, THE CITY OF PALM BAY EVER PARTICIPATED.

BUT THEY SAID, WELL, NOW WE SEE HOW THEIR GAME IS PLAYED.

WE'RE HOPING TO DO BETTER THIS YEAR, AND I HOPE THAT'S THE CASE.

I'D LOVE TO SEE A FIRST PLACE RIBBON COME BACK FROM OUR SWAT TEAM, BUT AT LEAST LIKE TO KNOW HOW THEY RANKED WHEN THEY DO COME BACK FROM THE PARTICIPATION.

BECAUSE IT'S LIKE A FEATHER IN THE CAP AND A PAT ON THEIR BACK WHEN THEY GET RECOGNIZED.

[02:15:03]

THANK YOU. YOU KNOW, THANKS FOR HIGHLIGHTING THAT, MASTER CHIEF, BECAUSE.

THESE GENTLEMEN, THEY COMPETE WITH LARGE CITIES.

RIGHT. AND THE COMPETITION IS PRETTY STIFF.

AND WE HAVE AND THE CITY SHOULD BE VERY PROUD OF OF THE MEN AND WOMEN THAT SERVE US.

SO, MADAM SHERMAN, TO MR. CHIEF'S POINT, IS THAT SOMETHING THAT WE COULD ASK FOR AN UPDATE WHEN WE CERTAINLY CAN GET THE EVENTS IS EARLY IN NOVEMBER, SO PERHAPS AT THE SECOND MEETING IN NOVEMBER WILL HAVE NEWS TO SHARE AND NOT ONLY NEWS, BUT A BIG KUDOS TO TO EACH AND EVERY ONE OF THOSE PARTICIPANTS.

I THINK IT GOES A LONG WAY.

WE. I LIKE THAT TRAIN OF THOUGHT.

I NEED EMOTION. SO MOVE.

AN AMERICAN GOT A MOTION BY DEPUTY MAYOR JOHNSON, SECONDED BY COUNCILMAN FELIX ALL IN FAVOR, AND HE OPPOSED PASSES UNANIMOUSLY. WE ARE NOW ON COMMITTEE AND COUNCIL REPORTS, AND WE'LL START WITH MR.

[COMMITTEE AND COUNCIL REPORTS]

FILIBERTO. THANKS.

THANK YOU, MAYOR. SO I JUST WANT TO HAD A COUPLE QUESTIONS FOR THE CITY MANAGER REFERENCE GARBAGE PICKUP AFTER THE HURRICANE.

I'M HEARING CONFLICTING REPORTS.

REPUBLICAN SAYS THAT THEY'RE DONE PICKING UP AFTER THE HURRICANE.

YET IN MY AREA IN THE NORTHEAST, STILL HAS TREE DEBRIS AND SOME OTHER GARBAGE LAYING AROUND FROM THE HURRICANE.

SO DO YOU HAVE AN UPDATE FROM YOUR PUBLIC REGARDING THE HURRICANE CLEANUP? YES, SIR. TODAY'S UPDATE WILL LET ME BACK UP FIRST OF ALL.

SO ESSENTIALLY WHAT HAPPENED AFTER THE HURRICANE WAS BECAUSE THE DAMAGE WAS NOT AS SEVERE AS OTHER PLACES WERE PUBLIC, WAS ABLE TO TAKE THAT ON AS PART OF THEIR NORMAL PICKUP PROCESS.

WHAT THEY ENDED UP DOING WAS HAVING TO DIVERT SOME OF THEIR BULK WASTE TRUCKS TO HELP WITH THE YARD WASTE PICKUP, AND THEY HAVE BEEN WORKING EVER SINCE.

SO WE'RE ON WEEK THREE NOW, I BELIEVE.

AND ESSENTIALLY THEY ARE ABOUT TO COMPLETE, AS I UNDERSTAND IT, AT THE END OF THIS WEEK, THEY SHOULD HAVE COMPLETED THEIR FIRST SWEEP OF THE INITIAL YARD WASTE DEBRIS.

SO NEXT WEEK, THEY'RE GOING BACK TO NORMAL SCHEDULES.

SO NORMAL YARD WASTE PICKUP.

IT TOOK THEM SOME DAYS TO GET CAUGHT UP IN CERTAIN AREAS.

SO NEXT WEEK THEY'LL GO BACK TO NORMAL YARD WASTE, NORMAL BULK WASTE, NORMAL EVERYTHING.

SO YOU SHOULD SEE IT START TO LEVEL OUT.

I KNOW THERE ARE SOME THINGS THAT WEREN'T PICKED UP ON THE FIRST SWEEP.

THERE WERE THINGS THAT WENT OUT AFTER THE FIRST SWEEP AND THE PILES HAVE BEEN SITTING THERE SINCE THAT FIRST WEEK OR SO.

BUT YEAH, NEXT WEEK THEY'VE ASSURED ME THAT THEY WILL BE BACK TO NORMAL SERVICING OF THE AREAS.

IF YOU'RE AWARE OF ANY PARTICULAR SITUATIONS THAT YOU WANT US TO INVESTIGATE VERY SPECIFICALLY WITH MR. CONRAD, WE CAN CERTAINLY DO THAT AS WELL.

UH, THANK YOU, MISS SHERMAN. JUST SO FOR THE PEOPLE OUT THERE IN THE PUBLIC, IF THEY STILL HAVE HURRICANE DEBRIS IN THEIR IN THEIR YARD, YOU'RE SAYING BY THE END OF NEXT WEEK THAT SHOULD BE PICKED UP, CORRECT? WE SHOULD BE FINISHED WITH THE CATCHING UP OF THE ENTIRE CITY.

THANK YOU VERY MUCH. I ALSO WANTED TO ANNOUNCE THAT THEY'RE ALSO GOING TO BE PICKING UP PRESSURE TREATED WOOD AND TIRES HERE PRETTY SOON TO I DON'T KNOW IF YOU WANT TO MAKE THAT ANNOUNCEMENT, MISS SHERMAN. CERTAINLY STARTING THIS SATURDAY, WE HAVE A COUPLE OF LOCATIONS.

I HAVE TO PULL THAT UP REAL QUICK AND HAVE IT IN FRONT OF ME.

I THINK ONE LET ME CHECK REAL QUICK.

GET THAT FOR YOU. WE'RE DOING A SERIES OF SATS ON THAT.

OKAY. THE THE WHAT THEY'RE GOING TO BE DOING IS THEY WILL LET'S SEE.

SO STARTING SATURDAY, OCTOBER 22ND AND ENDING ON SATURDAY, NOVEMBER 12TH.

SO JUST THOSE SATURDAYS RESIDENTS CAN PUT THIS IS ACTUALLY NOT A SPECIAL DROP OFF.

IT'S A PICKUP AT YOUR HOUSE SO RESIDENTS CAN PUT TIRES AND PRESSURE TREATED WOOD TO THE CURB PRESSURE TREATED WOOD JUST SO EVERYONE KNOWS ARE EXEMPTED FROM THE CONTRACT.

SO THIS IS A SPECIAL ABOVE AND BEYOND TYPE OF SERVICE THEY'RE PROVIDING.

SO IF YOU PUT THAT CURBSIDE STARTING THIS SATURDAY, THEY'RE GOING TO BE PICKING UP TIRES, PRESSURE TREATED WOOD AT THE CURB, AT THE HOUSES.

THE TIRE LIMIT IS FOUR PER HOUSE, NO RIMS OR COMMERCIAL TIRES AND VEHICLE TIRES ONLY.

SO I BELIEVE THOSE ARE THE PRIMARY DETAILS OF THE EVENT.

THANK YOU VERY MUCH. MANY OF YOU MAY MENTION THE DATES.

AGAIN, IT'S STARTING THIS SATURDAY, OCTOBER 22ND, RUNNING THROUGH SATURDAY, NOVEMBER 12TH.

FILIBERTO. YES. THANK YOU.

THANK YOU VERY MUCH, MISS SHERMAN.

JUST ONE OF THE IT ENDED THIS WEEK.

SO AS WE GO, IT'S GOING TO GO TO A STATE REPRESENTATIVE, RANDY FEIN, WHO RECOGNIZED AN ACT OF DISCRIMINATION AND DECIDED TO DO SOMETHING ABOUT IT WITHOUT GOING INTO MUCH DETAIL.

A CANDIDATE IN A NEIGHBORING CITY WAS FOUND MAKING ANTI-SEMITIC REMARKS, AND REPRESENTATIVE FINE HAS CONDEMNED THAT BEHAVIOR AND HAS ASKED OTHERS TO DO SO AS WELL.

I KNOW WE ALL WE'RE ALL BEEN CANDIDATES AT ONE TIME AND STUFF DOES COME OUT.

[02:20:04]

AND I EVEN HAVE A FELLOW OPPONENT RIGHT HERE NEXT TO ME.

BUT WE NEVER BROUGHT UP RACE, CREED, RELIGION, COLOR OR ANY OF THAT.

AND THAT IS UNACCEPTABLE, INAPPROPRIATE.

AND I CONDEMN THAT AS WELL.

SO THAT'S NOT NOT FAIR GAME.

AND I APPRECIATE REPRESENTATIVE FINE FOR MAKING THE REMARKS THAT HE DID.

THANK YOU. THAT CONCLUDES MY REPORT, MR. MAYOR. THANK YOU.

COUNCILMAN FILIBERTO.

COUNCILMAN FELIX, YOUR MAYOR.

I HAVE A COUPLE OF ITEMS. NUMBER ONE IS THE TPO.

WE JUST FOR THE PUBLIC TO KNOW.

THREE OF THE FIVE MEMBER OF COUNCIL SITS ON THE TPO BOARD, WHICH IS A TRANSPORTATION PLANNING ORGANIZATION.

THIS IS THE ORGANIZATION THAT ULTIMATELY MAKE DECISION AS TO MAJOR PROJECT, MAJOR INFRASTRUCTURE PROJECT, INCLUDING ROADS AND SO ON IN THE COUNTY.

THE PALM BAY WAS RECOGNIZED FOR A GOOD TEAM PLAYER.

IN ESSENCE, WE HAVE A PROJECT WHICH, YOU KNOW, OUR INVOLVEMENT IN THE TPO CERTAINLY TAKE SOME OF OUR PROJECT FROM THE BOTTOM OF THE LIST OF 50.

THE TPO TYPICALLY KEPT A 30, I BELIEVE A 3030 PRIOR PRIORITY PROJECT ALL THROUGHOUT THE COUNTY.

SO WE WERE THE MID OF THE LIST TO THE TOP FOUR OR FIVE PROJECTS.

SO THE TWO MAJOR PROJECTS WE HAVE IS THE WIDENING OF MALABAR ROAD ALL THE WAY TO THE HERITAGE PARKWAY.

I BELIEVE IT'S NUMBER THREE ON THE LIST.

AND ALSO WE WERE RECOGNIZED THE FACT THAT WE SHOW A GOOD TEAM PLAYER BECAUSE WE'RE CONTRIBUTING TOWARDS WE PUT ESSENTIALLY WE PUT OUR MONEY WHERE OUR MOUTHS ARE, SO WE PUT $7 MILLION IN THE DESIGN PHASE OF THIS PROJECT.

SO WE WERE HIGHLY PRAISED FOR THAT.

FOR DOING THAT, I WANT TO MAKE SURE I RECOGNIZE MI SHERMAN STAFF RECOMMENDATIONS AND COUNCIL DID ACT ON IT.

SO THAT WILL CERTAINLY PUT US AHEAD OF THE GAME WANTING TO APPRAISE STAFF FOR THAT IN MY COLLEAGUES AS WELL.

AND ALSO I WANT TO RECOGNIZE WE WERE TALKING ABOUT CO-SPONSORSHIP EARLIER.

I THINK DOING SO IT GOES TO GOOD, GOOD, GOOD CAUSES AND GOING TO THE VIVA BREVARD EVENT THIS PAST SATURDAY WAS A GREAT EVENT.

I THOUGHT IT WAS GREAT AND FAMILY MEMBERS AND IT'S REALLY GIVING THEM A CHANCE TO COME OUT AND KEEP THEM IN PALM BAY HAVE A GOOD TIME, RECOGNIZES THOSE DIFFERENT CULTURES AND THOSE EVENTS AND TRULY YOU CAN'T PUT A PRICE TAG ON THAT.

THAT CONCLUDES MY REPORT, MAYOR.

THANK YOU. WELL, THANK YOU, SIR.

AND THANK YOU FOR MENTIONING THE BRAVADO OF IT.

MR.. COUNCILMAN FOSTER.

YEAH. MAYOR, I WOULD LIKE TO SPEAK IN ABOUT THE TPO.

THERE WAS A GOOD MEETING, AND I'D LIKE TO SHOW A SHORT VIDEO.

IT'S ABOUT 2 MINUTES.

AND THEN I GET INTO MY COMMENTS AND YOU SHOW THE VIDEO.

THIS IS TRANSPORTATION.

THIS YEAR WITH A FOCUS ON THE IMPACTS OF HURRICANES AND A WIN ON THE RESILIENCY OF OUR TRANSPORTATION SYSTEM.

OUR ROADWAYS AND CORRIDORS CONNECT AND CARRY VITAL INFRASTRUCTURE THAT MAKE US THE ECONOMICALLY POWERFUL SPACE FORCE THAT WE ARE.

SO WE'RE ROLLING OUT A ROAD.

SHUCKS, BUT WE'RE AGAINST DEVELOPING THE TOOLS, TACTICS THAT WILL MAKE THIS A SAFER AND MORE RESILIENT.

SPACE COAST SHOT BY HURRICANE FORCE WINDS HAVEN'T SUBTLETY AND THE IMPACTS ARE SERIOUS.

OVER 100 MILES OF COASTLINE AND ROADWAY ARE VULNERABLE TO STORM SURGE.

49 NAMED STORMS HAVE INFLUENCE IN THE LAST 20 YEARS, DOWN FROM TRAFFIC LIGHTS, POWER LINES AND FREE GREAT TRANSPORTATION TO A HALT. AND THE CONSTELLATION PROGRAMS THAT ARE THE LIFELINES TO OUR COMMUNITIES BEARING UTILITIES AND DRINKING WATER ARE DAMAGED BY HURRICANES, STORM SURGE AND WINDS.

SO THINK OF TRANSPORTATION RESILIENCE.

THAT'S JUST ONE MORE PIECE TO THE LARGER PUZZLE OF A THRIVING BUSINESS.

TO LEARN MORE ABOUT OUR ROAD TO RESILIENCY HERE WITH OUR TEAM, VISIT SPACE COAST TPMB DOT COM.

THIS SECOND VIDEO.

IT IS SUCH AN ORGANIZATION HERE THAT SOME NEWS YOU COULD USE ABOUT TRANSPORTATION RESILIENCY.

YOU MIGHT BE ASKING YOURSELF RIGHT NOW, WHAT DOES THAT MEAN? IT MEANS WHATEVER PLANS THE PLAN WORKS AND WILDFIRES MIGHT OUT.

WE ARE PLANNING FOR THAT SO THAT WE CAN ABSORB, RECOVER AND GET BETTER IN THE FACE OF A HURRICANE, COASTAL FLOODING OR A WILDFIRE, BECAUSE BOUNCING BACK IS, YOU KNOW, OLD SCHOOL BOUNCING FORWARDS REALLY WHERE IT'S AT SEA.

[02:25:04]

OUR ROADWAYS AND CORRIDORS CONNECT AND CARRY VITAL INFRASTRUCTURE THAT MAKE US THE ECONOMICALLY POWERFUL SPACE COAST THAT WE ARE.

BUT THERE ARE IMPACTS ON OUR SYSTEM AND WE DEFINE THEM AS SHOCKS AND STRESS.

SO WE'RE ROLLING OUT A ROAD MAP TO MITIGATE SHOCKS LIKE HURRICANES AND WILDFIRES AND STRESSORS LIKE SEA LEVEL RISE, AND DO ALL THE TOOLS AND TACTICS THAT WILL MAKE US A SAFER, MORE RESILIENT SPACE COAST.

THINKING OF TRANSPORTATION RESILIENCY AS JUST ONE MORE PIECE TO THE LARGER PUZZLE OF A THRIVING SPACE COAST.

TO LEARN MORE ABOUT OUR ROAD TO RESILIENCY HERE BEFORE JOINING, VISIT SPACE COAST TEAM AECOM.

OKAY, LET ME GET INTO WHY I SHOWED THAT VIDEO.

FIRE RESILIENCY.

I WANT THE COUNCIL TO LOOK AT.

A 1 TO 4 PAGE.

THIS PAGE RIGHT HERE. THIS SHOWS WHERE WE'RE VULNERABLE FOR FIRE IN THIS COUNTY AND THEY GIVE YOU A PERCENTAGE.

MALABAR CITY OF MALABAR.

74%. THIS IS A STUDY DONE BY EPL, FRANK GRANT VICARIOUS 69%.

THEN THE THIRD ONE IS PALM BAY.

38%. AND YOU LOOK AT THE MAP SHOWS A LOT IN THE SOUTH.

SOUTHEAST, IN THE SOUTHWEST AND IN THE COMPOUND.

YOU SEE THAT? WHAT I'M SHOWING.

SO. IT SHOWS HOW VULNERABLE WE ARE TO FIRES.

THIS IS A STUDY THAT THE TPO IS DOING, IT HAS DONE ALREADY, AND HOW SMOKE AND FIRE CAN IMPACT THE CITY.

YOU CAN FIND THIS ON A WEBSITE.

ON THIS GRAPH.

I'M HOLDING UP. SO I FOUND THAT VERY INTERESTING.

WHEN WE START MAKING DECISIONS HOW FIRE OR FIRE RESPONSE, IF YOU KNOW, NOTICE ME IN THE TOP OF THE WEST, MALABAR, WEST, MALABAR AND THE NORTHEAST SECTION, IT'S NOT IMPACT AT ALL.

THAT'S A VERY DEVELOP AREA.

SO ESPECIALLY IF YOU GO DOWN TO MALABAR ROAD TO THE END, YOU SEE YOU COULD SEE WHERE THE PINKISH WHERE IS VULNERABLE TO FIRE. SO THAT'S JUST ONE.

THE SECOND ONE. UM.

FLOODS. GO TO THE FLOOD BROCHURE.

YOU CAN HAVE THIS. BROUGHT THIS.

IT'S WHAT WE TALKED ABOUT AT THE.

KNOW. PALM BAY 42% VULNERABLE TO FLOODS.

GRANT VICTORY IS 40%.

COCOA, COCOA BEACH, 56%.

PALM BAY WAS 42%.

EIGHT SIX SHOULD GIVE YOU AN INDICATION AND YOU COULD SEE IT ON THIS MAP WHERE THE FLOOD AREAS.

BE. SO THE REASON WHY I BROUGHT THIS UP.

WE JUST WENT THROUGH A HURRICANE.

AND, YOU KNOW, THE PUBLIC ACTS ABOUT PUBLIC SAFETY.

AND THIS IS INFORMATION.

THIS IS NOT SOMETHING I'M PULLING OUT OF MY HEAD.

THIS HAS BEEN STUDIED.

THIS IS INFORMATION THAT THE TOOLS THAT TPO IS LOOKING AT TO HELP OUT WITH INFRASTRUCTURE AND ROADWAYS AND THINGS LIKE THAT.

BUT WHEN IT COMES TO THE SHORELINE AND SEA LEVEL AND STORM SURGE.

WE HAD ZERO. WE HAD ZERO.

WHEN IT COMES TO FIRE AND FLOODS.

NOT SO. NOT SO GOOD.

SO THIS IS WHAT'S CONCERNING ME.

IF I HAVE ANY QUESTIONS FOR MY COLLEAGUE, I KNOW COUNCILMAN FELIX WAS THERE AND WE TALKED HEAVY ABOUT THIS.

THIS IS A GREAT STUDY.

COUNCIL, THESE BROCHURES ARE FOR YOU.

YOU CAN TAKE AND LOOK AT IT AT YOUR LEISURE.

BUT THIS IS SOMETHING THAT IN 2023, TPO IS LOOKING GOING FORWARD AND ADDRESSING THESE ISSUES THAT AFFECTS BREVARD COUNTY.

SO I HAVE ANY COMMENTS OR QUESTIONS.

BUT I JUST WANT TO.

THAT'S JUST FOR. I GAVE THAT.

I BROUGHT THAT FOR INFORMATION ONLY MY SECOND COMMENT.

[02:30:10]

IS ABOUT VOTING.

AND. AND ONE OF THESE BROCHURES SAYS LIKE 42% OF THE PALM BAY RESIDENTS DON'T HAVE TRANSPORTATION.

LACK OF TRANSPORTATION.

ONE OUT OF 20 HOUSEHOLDS DO NOT HAVE A.

HAVE THEY HAVE A CAR? BOB IN BEAVER COUNTY, ONE OUT OF 20.

SO THE SPACE COAST.

AREA. TRANSPORTATION IS GIVEN FREE RIDES ON ELECTION DAY.

BUT WE DIDN'T VOTE BY MAIL.

AND YOU WANT SOME PEOPLE DON'T LIKE TO VOTE BY MAIL.

SOME PEOPLE LIKE TO SHOW UP.

I WAS LIKE THAT FOR MANY YEARS.

I DIDN'T LIKE SENDING IN MY MAIL BALLOTS.

I LIKE TO GO IN THERE AND PHYSICALLY DO IT.

LATELY. YOU KNOW, I'M GETTING OLD AND I'M TIRED, SO I JUST DO IT BY MAIL.

BUT I UNDERSTAND THAT SOME PEOPLE DON'T HAVE A VEHICLE TO GET TO THE POLLS.

AND THE SPACE COAST.

I DIDN'T KNOW. SPACE COAST AREA TRANSIT IS GIVEN FREE RIDES TO THE POLLS ON ELECTION DAY ONLY.

YOU COULD GO TO 3 TO 1 TRANSIT, TRANSIT.

I HAVE. THANK YOU.

DEPUTY MAYOR JOHNSON.

THANK YOU, MAYOR. A FEW THINGS.

MR. BRYANT. FIRST THING I WANTED TO HIGHLIGHT, THE CITY OF PALM BAY IS HAVING A JOB FAIR NEXT WEEK.

SO YES, IT'S NICE TO LIVE IN THE GREATEST CITY ON THE FACE OF THE EARTH.

BUT WHY STOP THERE WHEN YOU CAN WORK FOR THE GREATEST? HEY, YOU SEE WHAT I DID THERE? ALL RIGHT, THERE WE GO. THANK YOU, MAYOR.

SOMEBODY GOT ME. THAT'S GOOD.

ALL RIGHT, SO.

SO THIS WILL BE OCTOBER 26, 2022, FROM 10 A.M.

TO 1 P.M.. RIGHT HERE IN THE COUNCIL CHAMBERS, YOU HAVE HUMAN RESOURCES, PARKS AND FACILITIES, POLICE PROCUREMENT, PUBLIC WORKS, RECREATION, AND MAYBE SOME OF US.

SO IF THERE'S ANYBODY WHO'S INTERESTED IN DOING WORK OR WORKING FOR THE CITY, THIS IS A PERFECT OPPORTUNITY FOR THEM TO COME CHECK US OUT, SEE WHAT WE'RE ABOUT, AND FOR THEM TO BRING A COPY OF THEIR RESUME AND THEIR CONTACT INFORMATION.

SO THANK YOU, SIR.

AND THAT SEGWAYS TO THE NEXT ONE.

I'M GLAD THIS IS SOMETHING THE YOUTH ADVISORY BOARD WORKED ON IN PREVIOUS YEARS, AND WE'RE BRINGING IT BACK.

JUNIOR JUNIOR ACHIEVEMENT MONEY ONE ON ONE.

SO WHAT THIS IS THIS IS A WAY TO TEACH FINANCIAL STABILITY HOW TO APPLY FOR FAST STUDENT GRANTS AND LOANS, CREDIT SCORES, BUYING A CAR, RENTING AN APARTMENT, PAYING BILLS, INVESTING IN FUTURE STOCKS, HOME OWNERSHIP FOR ONE CASE, THINGS THAT A LOT OF US MAY OR MAY NOT HAVE BEEN TAUGHT IN OUR CHILDHOOD.

SO THIS IS FOR 14 TO 19 YEAR OLDS AND ALL YOU NEED TO DO TO RSVP IS DO THE EMAIL AT THE BOTTOM OR GIVE A CALL WITH THE STUDENT'S NAME, SCHOOL AND AGE, AND THEY CAN SIGN UP FOR THIS.

SO THERE'S LIMITED SPOTS FOR THIS, BUT THIS IS A PERFECT OPPORTUNITY TO HELP OUR YOUTH IN CREATING GENERATIONAL WEALTH.

SO THIS IS A BIG THING RIGHT HERE, AND I'M GLAD THAT WE WERE ABLE TO GET IT STARTED BACK BECAUSE THE LAST ONE WE HAD WAS DURING COVID AND IT HAD TO BE VIRTUAL AT THIS TIME.

SO I THINK THIS BEING IN-PERSON WILL BE MUCH MORE IMPACTFUL FOR OUR YOUTH.

THE OTHER THING I'M GOING TO HIGHLIGHT, HE SPOKE ABOUT VOTING, EARLY VOTING.

IT BEGINS OCTOBER 24TH, 2022, AND ENDS NOVEMBER 5TH, 2022.

SO MONDAY THROUGH FRIDAY, THE VOTING HOURS ARE 8 A.M.

TO 6:00 PM, SATURDAY AND SUNDAY 8 A.M.

TO 4:00 PM. THE TWO LOCATIONS IN PALM BAY ARE TONY ROSA COMMUNITY CENTER AND TED WHITLOCK COMMUNITY CENTER.

SO JUST JUST SO YOU KNOW, FOR EARLY VOTING FOUR.

SO IF YOU DO HAVE A VOTE BY MAIL AND YOU WANT TO TURN IT IN IN PERSON, YOU CAN DO IT AT THOSE TWO LOCATIONS OR YOU CAN DO YOUR VOTING IN PERSON AT THOSE TWO LOCATIONS AS WELL.

LASTLY, I WANT TO HIGHLIGHT A YOUNG MAN WHO I HAVE THE PLEASURE OF SERVING WITH.

HAPPY BIRTHDAY, COUNCILMAN DONNY FELIX.

HAPPY 50TH BIRTHDAY, COUNCILMAN DON.

I KNOW, I KNOW.

HE DOESN'T LOOK IT, BUT DECADES.

FIVE DECADES.

COUNCILMAN FELIX, I'M ON A HOLIDAY AND HONOR YOU, SIR.

YOU SPOKE ABOUT IT PREVIOUSLY.

YOU KNOW, AS AN IMMIGRANT WHO CAME FROM HAITI AT THE RIPE AGE OF 19.

NOT KNOWING ENGLISH. CORRECT.

NOT KNOWING ENGLISH AND COMING HERE AND MAKING THE AMERICAN DREAM.

[02:35:01]

YOU KNOW, IT WASN'T GIFT WRAPPED OR HAND IT TO YOU.

YOU WORKED FOR IT.

YOU EARNED IT. AND YOU RAISE THE FAMILY.

YOU HAVE AMAZING, BEAUTIFUL CHILDREN THAT ARE, YOU KNOW, THAT ARE CARRYING ON THE FELIX LEGACY.

SO, YOU KNOW, THAT'S SOMETHING TO SPEAK TO, SIR.

AND WE APPRECIATE YOU.

SO I JUST WANTED TO HIGHLIGHT THAT ON THE DAIS.

OTHER THAN THAT, MAYOR, THAT CONCLUDES MY REPORT.

SO THANK YOU. WELL, THAT WAS GOOD.

DEPUTY MAYOR. I GOT TO TELL YOU, MAN, THAT THAT.

YEAH, I DON'T KNOW IF YOU CAUGHT THAT.

YOU WANT TO REPEAT THAT THERE? I CAN'T SAY HE HAS IT.

YES. HOW MUCH? THE COUNCILMAN FELIX DONATE TO MY CAMPAIGN.

HE DID NOT DONATE TO MY CAMPAIGN.

NOT AT ALL. BUT I GOT YOU KNOW THAT.

YOU KNOW, THAT IS HONOR.

AND I APPRECIATE THAT.

I REALLY DO. AND TO HIGHLIGHT SOMEONE THAT CAME TO THIS COUNTRY NOT KNOWING ENGLISH AND AND ACCOMPLISHING ALL THAT HE'S ACCOMPLISHED, MAN, KUDOS IN JUST FIVE SHORT DECADES. AND, YOU KNOW, I'M IMPRESSED.

YOU DON'T EVEN LOOK CLOSE TO 50.

PRAISE GOD. GOD HAS BEEN GOOD TO YOU, MY FRIEND.

LISTEN, I'M.

I'M GOING TO START MY REPORTS.

JUST WANTED TO SHARE SOMETHING WITH THIS COUNCIL, BUT I NEED YOUR INDULGENCE.

RIGHT. I REALLY NEED TO GET A PICTURE ON IF THIS WOULD BE OKAY, THEN.

THEN I WOULD MOVE FORWARD.

IF NOT, THERE'S NO THERE'S NO OFFENSE.

THERE'S. THERE'S NO ANYTHING THAT I WOULD HARBOR ILLNESS TOWARDS ANYONE.

RIGHT. BUT I WAS INVITED TO A FUNCTION BY LEO.

DOES ANYONE KNOW WHAT NA LEO IS? OKAY, GOOD. I'LL BRIEF YOU ON THAT.

NOW, LEO IS THE AN INSTITUTE FOR NEWLY ELECTED LATINO OFFICIALS, BUT IT IS THE NATIONAL ASSOCIATION OF LATINO ELECTED AND APPOINTED OFFICIALS.

IT'S A NATIONAL EDUCATION FUND IS WHAT THEY DO.

SO THERE IS AN EVENT IN D.C.

NOVEMBER 16TH THROUGH THE 18TH.

THE PROBLEM LIES WHERE? NOVEMBER 17TH.

WE HAVE A MEETING.

Y'ALL TRACKING ME SO FAR? NOW, I WOULD NOT CONSIDER GOING UNLESS WE ARE ABLE TO MOVE OUR 17TH MEETING.

TO THE 20TH, I THINK ARE THE 21ST, WHICH IS A MONDAY.

IT IS THE WEEK OF THANKSGIVING.

NOW, IF THIS COUNCIL FEELS THAT WE WON'T.

MOVE THAT MEETING TO THAT TIME FRAME, I WOULDN'T EVEN CONSIDER GOING.

BUT IF YOU DO, THEN THIS WOULD COME BACK AS AN AGENDA ITEM.

WITH ALL THE DISCLOSURES FOR US TO VOTE, WHETHER YOU'RE MAYOR OR BE ABLE TO GO TO THIS NATIONAL ELECTED, THIS NILAYAM EVENT. SO MY QUESTION IS TWOFOLD, RIGHT? THE VERY FIRST IS AND BY THE WAY, IT'S IT'S THE COST IS VERY MINIMAL BECAUSE THEY OFFER SCHOLARSHIPS AND THE CONVENTION OR THE THE ACTIVITY WILL BE FOR NEWLY ELECTED OFFICIALS THAT WERE ELECTED IN 2020.

SO THEY DISCUSS BUDGETING, FISCAL RESPONSIBILITIES, POLICYMAKING, RELATIONSHIPS AND VALUES AND ETHICS.

AND SO THESE ARE THE TOPICS THESE ARE THE SUBJECTS FOR THIS EVENT.

AGAIN, TWOFOLD.

NUMBER ONE, WOULD YOU CONSIDER MOVING THE COUNCIL MEETING TO THE 20? WHAT IS THAT, MONDAY, MA'AM, AFTER THE 17TH? IS IT THE 20TH OF THE 21ST? THAT'S THE 21ST.

OKAY. MONDAY, THE 21ST.

THAT'S THE FIRST QUESTION OF MY IF THIS COUNCIL WOULD CONSIDER THAT.

THE SECOND PORTION TO THAT IS, IF SO, THEN WE COULD BRING THIS AS AN AGENDA ITEM TO OUR NEXT MEETING IN NOVEMBER.

BUT I WOULDN'T EVEN NEED TO BRING IT IN AS TRAVELING IF YOU GUYS DON'T CONSIDER THAT.

THEN HERE'S ANOTHER CURVEBALL FOR YOU.

EVEN IF I CAN'T MAKE IT, I THINK WE SHOULD PARTICIPATE IN THIS WITH THIS ORGANIZATION.

AND I THINK THAT THERE'S DUES JUST LIKE ANY OTHER ORGANIZATIONS THAT WE HAVE.

BUT LET ME LET ME ASK THE VERY FIRST QUESTION.

WOULD COUNCIL CONSIDER MOVING THE 17TH MEETING OF NOVEMBER TO MONDAY, THE 21ST? YES OR NO? WELL, I'VE GOT TWO THUMBS UP.

THAT AS LONG AS WOULD IT NOT.

OBVIOUSLY, YOU PROBABLY ALREADY DISCUSSED THAT WITH STAFF IN TERMS OF HOW THEY DO THEIR THINGS AND ANNOUNCEMENT AND SO ON.

[02:40:02]

I WOULD SUPPORT THAT.

IT'S INTERESTING YOU BROUGHT THAT UP BECAUSE HAVING AN EVENT IN DC AS WELL FROM THE 15 TO 17.

SO YOU SAID I BOOKED I BOOKED MY FLIGHT EARLY THOUGH.

I SHOULD BE.

I'M TAKING THE CHANCE OF MAKING IT BACK ON ON AT 3:00.

BUT THAT WOULD GIVE ME THE PEACE OF MIND KNOWING THAT I DON'T HAVE TO WORRY ABOUT IT STILL, ALTHOUGH I WENT FOR IT.

IT'S A DIFFERENT EVENT AS TO DO WITH IMMIGRATION FORM ON A NATIONAL LEVEL WITHIN THE EVANGELICAL CHURCHES AND SO ON.

COMMUNITY. BUT IT'S A NATIONAL IMMIGRATION FORUM THAT I'M GOING TO ON MY OWN, ON MY OWN EXPENSE.

BUT FROM THE 15 TO 17.

BUT YES, IF COUNCIL IS WILLING TO, I'M WILLING TO SUPPORT THAT THAT WAY.

I KNOW IN CASE OF DELAY, IT WON'T BE AN ISSUE.

I WOULD SUPPORT THAT. YEAH.

AND THIS THIS IS A UNIQUE OPPORTUNITY BECAUSE THEY SAY THEY HAVE SCHOLARSHIPS.

THE ONLY THE ONLY CAVEAT WITH THEM PURCHASING MY MY ROUND TRIP TICKET WOULD BE THAT I HAVE TO FLY WHEN THEY TELL ME I FLY AND AND IT WOULD DEFINITELY TAKE ME TO THE THE LATEST PART OF THAT EVENT ON THE 18TH SO I WOULDN'T BE ABLE TO JUST MAKE AN APPEARANCE AND FLY OUT.

BUT I THANK YOU FOR FOR SUPPORTING THAT.

AND THIS WOULD COME BACK AS AN AGENDA ITEM IF I HAVE CONSENSUS TO CONSIDER MOVING THE MEETING TO THE 21ST COUNCILMAN FILIBERTO THANK YOU, MAYOR.

WE JUST MOVED ONE MEETING LAST.

YEAH, SO I HAVE MY RESERVATIONS ON IT.

SIR, I'M GOING TO SUPPORT YOU HERE, BUT I DON'T KNOW IF I'M GOING TO SUPPORT ANY OTHER MOVES OF MEETINGS MOVING FORWARD.

BUT I GOT YOU HERE, SIR.

AND, YOU KNOW, HAVE FUN, DC AND REPRESENT US WELL, SIR.

THANK YOU, DEPUTY MAYOR.

COUNCILMAN FILIBERTO, I DON'T KNOW IF IT'S BECAUSE WE WENT TO BAYSIDE, BUT I'M THE SAME WAY BECAUSE I DIDN'T WANT TO.

I DIDN'T WANT TO MOVE THE LAST MEETING EITHER.

BUT I'LL SUPPORT THIS.

BUT I KNOW FOR MYSELF, I WOULD.

YOU KNOW, I WOULD MAKE ACCOMMODATIONS, WHETHER IT'S VIRTUALLY OR WHATEVER, TO MAKE SURE I DIDN'T, YOU KNOW, CHANGE IT UP ON THE AUDIENCE OR CHANGE IT UP ON THE STAFF OR ANYTHING.

SO BUT TO THAT POINT, ALL THIS IS GOING TO BE EDUCATIONAL.

YOU'LL BE ABLE TO BRING INFORMATION BACK FOR US, FOR US TO, YOU KNOW, AND TIE INTO THE CITY OF PALM BAY.

SO I'M WITH YOU, FILIBERTO COUNCILMAN FILIBERTO FOR THIS.

YES, BUT GOING FORWARD, I'M NOT LOOKING TO CHANGE ANYTHING ELSE.

AND I WOULDN'T.

AND TRUST ME WHEN I TELL YOU I WOULDN'T WANT TO ATTEND IF IF I DIDN'T HAVE THAT TYPE OF SUPPORT, IF WE COULD MOVE IT.

BUT THIS IS THE APPARENTLY THIS IS LIKE THE LAST TIME THEY DID THIS WAS I DON'T KNOW WHEN, BUT THEY HAVEN'T DONE IT SINCE SINCE COVID.

SO IS THERE ANYTHING ELSE YOU MAY NEED? TERESE. NOTHING I CAN THINK OF.

OKAY SO SO THAT THAT IS THAT THAT CONCLUDES MY MY REPORTS I APPRECIATE.

YES, SIR. COUNCILMAN ALSO.

I JUST WANT TO BRING UP ONE THING I FORGOT TO BRING UP DURING MY REPORTS.

I'M GOING TO BE LOOKING AT OUR ADVISORY BOARDS AND THEN COME UP WITH A RECOMMENDATION TO ELIMINATE SOME OR KEEP SOME.

I JUST WANT TO LET COUNSEL KNOW THAT I'M GOING TO BE WORKING WITH STAFF ON THAT AND BRING IT AS AN AGENDA ITEM SO WE COULD DISCUSS IT.

THANK YOU. THANKS FOR INCLUDING THAT.

SO NOW WE'RE ON ADMINISTRATIVE AND LEGAL REPORTS, MADAM SHERMAN.

[ADMINISTRATIVE AND LEGAL REPORTS]

THANK YOU, MIRA. I JUST HAVE TWO THINGS REGARDING SCHEDULING.

THE FIRST IS YOU ALL RECEIVED AN EMAIL EARLIER THIS WEEK.

WE'VE BEEN TRYING TO LOCK DOWN THE DATE FOR THE LOCAL PREFERENCE WORKSHOP.

UM, WE'VE LOOKED AT THOSE DATES.

THE BEST ONE FOR STAFF IS GOING TO BE NOVEMBER THE FIRST.

SO I JUST WANT TO SEE IF IT'S POSSIBLE THE COUNCIL IS AVAILABLE TO HAVE THAT WORKSHOP.

TUESDAY, NOVEMBER THE FIRST.

AREN'T WE IN KISSIMMEE? OH, NO. THAT'S DECEMBER 1ST AS YOU ARE.

I'M GOOD. I'M GOOD.

I'M GOOD. I'M GOOD.

NOVEMBER 1ST.

6:00. 630.

WHAT TIME? WE WOULD NORMALLY DO 6:00.

SORRY. I WANT TO GET THAT.

30 MINUTES. THANK YOU.

MY OTHER ITEM IS, UM, I, I'VE RECEIVED SOME FEEDBACK THAT SOME WE HAVE THE STRATEGIC PLANNING SESSIONS THAT ARE COMING UP NOVEMBER 14TH AND 15TH.

WE'VE STRUCTURED IT CURRENTLY IS.

IT'S TWO HALF DAYS.

IT'S THE AFTERNOON OF THE 14TH AND THE HALF DAY, THE MORNING OF THE 15TH.

I JUST WANT TO GET COUNSEL'S DIRECTION.

IF THERE'S A PREFERENCE TO MOVE THAT ALL TO ONE DAY.

I'VE BEEN HEARING THAT AS A PREFERENCE BECAUSE THE IMPACTS TO WORK SCHEDULES AND THINGS.

SO JUST WANTED TO THROW THAT OUT THERE TO SEE IF YOU WANT US TO PIVOT FROM WHERE WE'RE AT.

HALF DAY IS BETTER FOR ME, BUT I'LL LISTEN.

[02:45:02]

THEIR WHOLE DAY. I DON'T KNOW IF COUNCIL.

BUT. I'M.

I'M SPORTING FULL DAY, YOU KNOW.

I'M A BIG FAN OF EVERY ONCE AND ONCE AND ONE AND DONE.

ONE AND DONE. YEAH.

I MEAN, I'M TRAVELING THAT DAY ANYWAY ON THAT TUESDAY.

BUT HE. TEAM WORK OR ME? SO DECIDED. THAT'S THE DIRECTION.

AVAILABLE IN THE MORNING FOR THE HALF SESSION IN THE MORNING OR NOT AT ALL.

THE 14TH IS THE BEST FOR YOU.

FILIBERTO. THANK YOU, MAYOR.

I PREFER TO KNOCK IT ALL OUT IN ONE DAY TOO, BUT I STILL AM FLEXIBLE.

BUT GIVEN THAT COUNCILMAN, I WANT COUNCILMAN FELIX HERE FOR IT.

SO I THINK WE SHOULD DO IT ALL.

NOVEMBER 14TH IS A MONDAY.

YES, SIR. NOVEMBER 14TH.

ALL DAY. DEPUTY MAYOR JOHNSON.

WE'RE YOU KNOW, WE'LL HAVE A LONG BREAK.

WE'RE GOING TO WE'LL HAVE WE'LL HAVE SOME BREAKS.

AND I THINK I THINK THEY'LL PROVIDE LUNCH.

NO, IT'S NOT THAT. I'LL FIGURE IT OUT.

Y'ALL KNOW MY LINE OF WORK.

SO, YEAH, THAT'S I'LL HAVE PROBLEMS WITH YOU.

BUT, YEAH, I'LL HAVE TO ADJUST SOME THINGS, BUT I'LL MAKE IT WORK.

ALL RIGHT? YEAH, WE. WE WOULD WANT COUNCILMAN FELIX THERE.

SO I'LL. I'LL HAVE TO TAKE A VACATION DAY, BROTHER.

SO. BUT.

ALL RIGHT. SO WE'LL GO NOVEMBER 14TH AND DEPUTY MAYOR JOHNSON WILL BE THERE WITH A SAD FACE.

MADAM SMITH. AND IS THAT THE SECTION? THANK YOU. YES, MADAM SMITH.

I THINK. FURTHER, SIR. PUBLIC COMMENTS.

MISS FLORIDA. HOBART.

[PUBLIC COMMENTS/RESPONSES]

GOOD EVENING. MY NAME IS FLORIDA HOLBERT.

ADDRESS 2322.

PLANTA RICH COURT SOUTHEAST PALM BAY 32909.

I JUST HAVE A QUICK QUESTION CONCERNING THE REPUBLIC WASTE PICKUP.

I WAS APPROACHED BY ONE OF MY NEIGHBORS THAT JUST MOVED IN AND THEY PUT THEIR BOXES OUT THAT THEY'VE BROKEN DOWN AND THEY WERE CONCERNED THAT THEY HAD NOT BEEN PICKED UP. SO I TOLD THEM, I SAID, WELL, WITH THE STORM AND ALL OF THIS STUFF THAT'S HAPPENED THERE, PROBABLY JUST A LITTLE BIT BEHIND, BUT PUT THEM OUT AGAIN.

BUT HE'S CONCERNED ABOUT HOW LONG IS IT GOING TO TAKE FOR THEM TO PICK IT UP.

SO DO I NEED TO TELL THEM TO CALL AND AND I'LL SCHEDULE AND LET THEM KNOW THAT THEY HAVE STUFF OUT THERE THAT NEEDS TO BE PICKED UP BECAUSE HE'S HE'S JUST REALLY CONCERNED.

HE WAS SORT OF DISTRAUGHT OVER THAT.

AND I JUST WANT TO TRY AND PUT HIS HEART AT EASE.

I SHOULD BE EASIER BECAUSE EVERY SITUATION IS DIFFERENT.

IF I CAN JUST GET YOUR CONTACT INFORMATION AND I'LL HAVE OUR OUR REPUBLIC REPRESENTATIVE CALL YOU BECAUSE YOU HAVE UNLESS YOU WANT TO GIVE US THE NUMBER FOR NOT ON THE RECORD, BUT FOR THE NUMBER FOR YOUR NEIGHBOR, WE CAN DO THAT TO.

WELL, I DON'T HAVE HIS PHONE NUMBER, BUT WE CAN PUBLIC REPUBLIC HAS MY PHONE NUMBER ALREADY AND BUT IT'S ON THAT CARD RIGHT THERE IT TO ME.

SO THAT WOULD BE GOOD.

AND I CAN JUST LET HIM KNOW THAT HE CAN PUT IT BACK OUT THERE.

I DON'T KNOW HOW I GOT TO BE THE NEIGHBORHOOD.

PERSON. BUT ANYWAY, THANK YOU.

THAT'S LEADERSHIP, MA'AM.

THANK YOU. THANK YOU, MA'AM.

ALL RIGHT. THANK YOU FOR WHAT YOU DO.

MASTER CHIEF. REMEMBER NO GOOD DEED GOES UNPUNISHED.

BILL BOUGHTON 586 OCEAN SPRAY STREET SOUTHWEST.

I HAVE THREE ITEMS TO BRING UP ON PUBLIC COMMENTARY.

FIRST ONE IS BRAVO ZULU FOR THE PUBLIC HEARINGS, WHICH WOULD GO ON THE PUBLIC HEARINGS AND YOU HAVE THEM UP ON THE BOARD.

NOW. IT MAKES A LOT EASIER FOR PEOPLE TO SEE THE MAPS AND STUFF, AND I SAW THAT OTHER PEOPLE RECOGNIZED IT, TOO.

THE CITY MANAGER, GOOD JOB ON THAT.

PLUS THE FACT THAT AT THE TOP OF THE PHOTO, IT SAYS WHICH PUBLIC HEARING IT WAS THAT ALSO HELPED HELP THE AUDIENCE FOLLOW ALONG.

GOOD JOB. I APPRECIATED IT.

THE SECOND ONE, WHICH I DIDN'T KNOW ABOUT, WAS THE TIRES AND PRESSURE TREATED WOULD PICK UP FROM REPUBLIC.

ARE YOU SUPPOSED TO CALL AND SCHEDULE IT? BECAUSE I HAVE QUITE A BIT OF LUMBER THAT I'VE GOT GETTING READY TO LOAD IT IN MY TRUCK AND TAKE IT TO KOKO.

BUT IF THEY'RE GOING TO PICK IT UP AT THAT TIME, DO I HAVE TO CALL INSTEAD OF CARRYING IT OUT OR NO.

THEY ACTUALLY HAVE SET UP THOSE THOSE FOR SATURDAY'S.

THEY HAVE SPECIFIC AREAS OF THE CITY.

THEY'LL BE SERVICING THE THE MAPS OF THOSE AREAS.

WE'RE ON FACEBOOK AND ON OUR WEBSITE AND WE CAN EMAIL THAT DIRECTLY TO YOU.

MR. BATTEN. I'LL GO AHEAD AND LOOK IT UP THEN.

I DIDN'T KNOW. ALL RIGHT.

AND THEN THE SECOND THE THIRD ITEM WAS THE DATES OF REGULAR COUNCIL MEETINGS WITH THE CHANGING THAT WE'RE DOING.

OF ALL THE CHANGING ON THEM, HOW DOES THAT IMPACT ON THE ADVERTISEMENTS FOR THE THINGS THAT WE PUT ALREADY PUT OUT WHERE WE'VE WE'VE PUT ADVERTISEMENTS OUT FOR PUBLIC REGULAR SCHEDULE MEETINGS FOR OUR P AND ZS FOR FOR THE FOLLOW UPS OF THOSE FOR THOSE COUNCIL MEETINGS.

SO IT HAS THOSE DATES ON THEM AND THEY'RE PUT OUT A DATE A MONTH IN ADVANCE OR SOMETIMES TWO MONTHS IN ADVANCE.

SO I JUST CURIOUS HOW THAT'S GOING TO START IMPACTING IF IT'S GOING TO MAKE YOU SAY, WELL, WE MISSED THIS DATE, SO NOW WE MISSED THIS APPOINTMENT, SO NOW WE HAVE ANOTHER.

AND WHAT DO WE WANT TO CALL A PEBBLE THAT ROLLS INTO A BIG BOULDER IF WE'RE NOT CAREFUL? THANK YOU. THANK YOU.

ROBERT STICE.

I ALSO HAVE THREE QUESTIONS.

THIS IS THE FIRST I'VE HEARD ABOUT REPUBLIC.

WHEN THE STORM WAS COMING IN, I GOT TWO TEXT MESSAGES SAYING THAT THERE WAS GOING TO BE A DELAY AND THEN AND THEN GOT ANOTHER TEXT.

AND I KNOW SPENDING SOME TIME IN AN INDUSTRY THAT THEY CAN SEND OUT TEXTS TO ALL OF THEIR CUSTOMERS QUITE EASILY.

HOW DO WE COMMUNICATE WITH FOLKS, SINCE THIS IS THE FIRST I'VE HEARD OF THAT, CAN THEY GET A TEXT OUT TO EVERYBODY, ALL THEIR CUSTOMERS? BECAUSE I'VE GOT THEM TWICE BEFORE.

WITH THAT I HAVE A.

I HAVE A QUESTION. I HAVE A RESIDENT IN MY NEIGHBORHOOD WHO INSURANCE COMPANY.

SHE HAD DAMAGE OVER THREE YEARS AGO FROM FROM I DON'T KNOW WHAT IT WAS.

ONE OF THE STORMS THAT CAME THROUGH AND HER INSURANCE COMPANY FILED FOR BANKRUPTCY.

AND IT'S BEEN THREE YEARS AND SHE DOESN'T KNOW WHAT TO DO.

THE STATE OF FLORIDA OR THE CITY CAN GIVE ME ANY KIND OF CONTACT INFORMATION BECAUSE I THOUGHT FLORIDA HAD SOME FUNDS AVAILABLE THAT WHEN A COMPANY, AN INSURANCE COMPANY DECLARED BANKRUPTCY, THAT THEY'RE STILL ABLE TO HELP THIS LADY, BECAUSE I DON'T WANT TO GO AFTER IT FROM AN HMO PERSPECTIVE, SO I CAN USE SOME HELP ON THAT.

FINALLY, WHEN I DO MEALS ON WHEELS AND A GENTLEMAN NAMED STUART ROBERTS, WHO'S OFF OF FRAZIER IN THAT AREA, HE'S TELLING ME THE ROAD HAS BEEN HE'S BEEN EATING, PAVING FOR OVER 20 YEARS.

AND I THOUGHT WE WERE GOING TO GET THAT DONE IN MID TO LATE OCTOBER.

CAN WE GET A HEADS UP ON THAT? SO ANY INFORMATION WOULD BE HELPFUL.

THANK YOU. WHEN ELSE WISH TO COME AND SPEAK TO TERESA.

MS.. TERESA OK.

I DON'T KNOW IF YOU GUYS REMEMBER ME, BUT BACK WHEN THEY WERE TRYING TO REZONE BEHIND MY PROPERTY OFF LADNER, I JUST WANTED TO INVITE YOU ALL TO COME DOWN AND SEE THE FLOODWATER BEHIND MY HOUSE BECAUSE IAN BROUGHT A LOT OF WATER, NEVER CAME INTO MY HOUSE OR ANYTHING LIKE THAT.

IT'S STANDING THERE AND I JUST WANTED YOU GUYS TO COME AND SEE IT.

BUT I APPRECIATE YOU GUYS NOT LET THOSE APARTMENTS GO IN BACK THERE.

YOU GUYS DID US. THANK YOU.

THANK YOU, MA'AM. OH, I DIDN'T SAY.

I'M TERESA KECK.

372 BUTLER AVENUE, NORTHEAST.

THANK YOU, GUYS. THANK YOU, MA'AM.

SURE. AND JARED CROWELL, 1071 SON SWEAT ROAD NORTHEAST, JUST RECENTLY BOUGHT THE HOUSE A MONTH AGO.

I'M JUST WANTING TO GET AN UPDATE ON THE GRANT MONEY THAT THE CITY OF PALM BAY HAS ACCEPTED FROM THE COUNTY TO CONVERT.

SEPTIC SYSTEMS ALONG THE LAGOON TO CITY SEWER THAT'S IN THE TURKEY CREEK AREA, BUT NOT IN THE HIGHLAND SHORES.

I DON'T KNOW. THERE'S PROBABLY 50 HOUSES ALONG MY MY STREET THAT ARE IN THE HIGH RISK ZONE, SO.

JUST WANT TO GET AN UPDATE ON THAT.

AND I'M SORRY. AND UNFORTUNATELY, CRYSTAL, OUR UTILITY DIRECTOR, HAS JUST LEFT, SO I'D HAVE TO GET YOUR CONTACT INFO, WHICH I BELIEVE WE MAY ALREADY HAVE.

AND WE WILL FOLLOW UP WITH YOU ON AN UPDATE, BECAUSE I DON'T HAVE THAT TONIGHT.

I'M SORRY. SO I CAN ADD JUST A LITTLE BIT TO IT, BECAUSE I KNOW WE WERE GETTING WE GOT FUNDING FOR 320 SOME ODD HOUSES IN THE TURKEY CREEK AREA, ROUGHLY.

THE THING WAS GETTING THE SEPTIC TO SEWER CONVERSION, GETTING THE COMMITMENT FROM EVERYBODY OVER THERE.

SO THAT'S SOMETHING I'VE TALKED TO.

YOU KNOW, WE'VE SPOKEN I'VE, I'VE GOTTEN YOUR INFORMATION TO STAFF, BUT IT'S ABOUT WHETHER OR NOT COUNCIL WANTS TO DO IT.

I KNOW WE'VE TALKED ABOUT SEPTIC TO SEWER CONVERSION, BASICALLY, OR WHATEVER, BUT I THINK.

[02:55:06]

WE NEED TO HAVE SOMETHING A LITTLE MORE CONCRETE, ESPECIALLY WHEN WE TALK ABOUT TURKEY CREEK, AND THAT THERE'S ALREADY GUARANTEED FUNDING FOR THE SEPTIC TO SEWER CONVERSION IN THAT AREA. SO SOMETHING LIKE POSSIBLY DOING IT BY SECTION OF THE CITY OR DOING IT SPECIFICALLY FOR THAT AREA IS SOMETHING I THINK WE CAN EXPLORE SPECIFICALLY BECAUSE THE FUNDING AND MONEY IS ALREADY THERE AND GUARANTEED.

WE JUST HAVE TO PUT SOMETHING FORWARD.

SO YEAH, AND I'D LIKE TO ADD BASICALLY THAT SINCE THE MONIES HAVE BEEN ACCEPTED.

IF THE PROGRAM GOES NOWHERE, THE MONEY THAT COULD BE USED TO IMPROVE THE EXISTING SEPTIC TANKS ARE ALSO IS AT A STANDSTILL.

SO PEOPLE THAT HAVE FAILING SYSTEMS. MINE'S 40 YEARS OLD.

NEEDS TO BE REPLACED.

I CAN'T. I'D HAVE TO COME OUT OF MY OWN POCKET, WHICH.

IT'S KIND OF SILLY WHEN THERE'S GRANT MONEY THERE TO DO IT, BUT.

WE'LL BE IN TOUCH. THANK YOU.

ANYONE ELSE WISH TO SPEAK OR.

MR. MAYOR, JUST REGARDING THAT COMMENT, MR. SHERMAN, IF YOU CAN PLEASE INCLUDE ME IN THOSE LINES OF COMMUNICATION.

THANK YOU. PHILLIP CORCORAN 1878 WHEN BROOK DRIVE.

I WOULD LIKE TO THANK THE COUNCIL AND THEIR SUPPORT OF A WORKSHOP TO STUDY WAYS TO RECOVER THE GOLF COURSE.

I THINK WE SHOULD KEEP IN MIND THAT MANY GOLF COURSES, MUNICIPAL GOLF COURSES DO MAKE MONEY.

CRANE CREEK DOES.

THERE ARE SOME VERY PRESTIGIOUS GOLF COURSES THAT ARE OWNED BY CITIES, AND BETHPAGE BLACK ON LONG ISLAND IS HAD THE US OPEN AND PGA CHAMPIONSHIPS PLAYED THERE.

SO THIS IS A PIECE OF PROPERTY, AS ROBERT, AS MR. BLAND SAID, WAS DESIGNED BY ARNOLD PALMER.

IT IS A BEAUTIFUL LAYOUT AND I THINK WE SHOULD TRY AND RECOVER IT.

I NOTICED THAT THE OWNER DID DO SOME MOWING THIS WEEK AROUND THE PARKING LOT AREA, BUT THE ENTIRE GOLF COURSE IS VERY HIGH AND ALL WEEDS. SO ALSO IF WE DO HAVE A WORKSHOP, I AM SUPPORTING THE.

CITY OWNING THE GOLF COURSE.

BUT FAILING THAT, WE HAVE FIVE INDIVIDUALS THAT ARE INTERESTED IN TRYING TO GET THE GOLF COURSE IF THEY CAN GET IT AT A REASONABLE PRICE.

SO IF THAT'S USEFUL AT THE WORKSHOP, MAYBE WE CAN SET SOMETHING UP FOR THAT AS WELL.

THANK YOU. THANK YOU.

ANY ANYONE ELSE WISH TO COME AND SPEAK? THE PUBLIC COMMENTS.

YOU JUST RAISE YOUR HAND, SIR.

OKAY. ANYONE ELSE.

MA'AM. MADAM CHAIRMAN, DO YOU WANT TO ADDRESS ANYTHING THAT WAS DISCUSSED? I MADE SOME NOTES OF THINGS.

I'LL FOLLOW UP WITH STAFF, BUT I DON'T HAVE ANYTHING SPECIFIC ELSE YOU'D LIKE ME TO ADDRESS? SOMETHING NEGATIVE, MA'AM.

THIS MEETING IS HEREBY ADJOURNED.
