MOTION TO APPROVE THE MINUTES OF THE DECEMBER 7TH PLANNING ZONING MEETING.

[NEW BUSINESS:]

THE PLANNING AND ZONING BOARDS IS AN ADVISORY BOARD COMPRISED OF UNPAID VOLUNTEERS.

STAFF. WILL PRESENT THE STAFF REPORT FOR EACH CASE.

BOARD MEMBERS WILL THEN BE ASKED IF THEY HAVE ANY QUESTIONS FOR STAFF.

THE APPLICANT OR THEIR REPRESENTATIVE WILL BE ASKED TO APPROACH THE PARTY AND PRESENT INFORMATION.

FLOOR WILL THEN BE OPEN FOR PUBLIC COMMENTS.

FIRST, THOSE WISHING TO SPEAK IN FAVOR OF THE APPLICATION AND THOSE IN OPPOSITION TO THE APPLICATION.

FOR ALL PROCEEDINGS.

ALL APPLICANTS AND SPEAKERS FROM THE AUDIENCE MUST SIGN A SPEAKER OATH CARD AT THE PODIUM AND AT THE BACK OF THE ROOM.

OUR FIRST CASE TONIGHT IS TX SEVEN DASH 2023.

A TEXTUAL AMENDMENT TO THE CODE OF ORDINANCES LAND DEVELOPMENT CODE, CHAPTER 169.

SECTION ONE 69.005 TO AMEND CITIZEN PARTICIPATION PLANS AND THE APPLICANT IS THE CITY OF PALM BAY SPECIFICALLY THROUGH THE GROWTH MANAGEMENT DEPARTMENT.

SO THE REQUEST BEFORE YOU, AS I MENTIONED, IS TO AMEND THE CITIZEN PARTICIPATION PLAN AND THE PROPOSED CHANGES THROUGHOUT THIS PLAN THAT WE ARE PUTTING FORWARD TODAY, THEY WILL ALLOW FOR THE TIME PERIOD IN WHICH THE APPLICATION IS TO SUBMIT THE CITIZEN PARTICIPATION PLAN TO BE EARLIER IN THE PROCESS.

IT ACTUALLY WILL BE SOMETHING THAT IS REQUIRED IN PART AND PARCEL OF A SUFFICIENCY REVIEW PRIOR TO IT GOING TO STAFF FOR AN ACTUAL REVIEW FOR ANALYSIS.

SO THAT WILL ACTUALLY MAKE SURE THAT WE DO HAVE THE CITIZEN PARTICIPATION PLAN PRIOR TO US GOING THROUGH THIS PROCESS AND GETTING TO ALL OF YOU EVERY SINGLE TIME INSTEAD OF US SOMETIMES NOT HAVING IT AHEAD OF TIME.

SO WE REALLY WANT TO MITIGATE THAT ISSUE TO MAKE SURE THAT WE HAVE ENOUGH TIME FOR CITIZENS TO PARTICIPATE IN THESE ACTIVE PLANNING PROCESSES.

AND THEN ON TOP OF THAT, WE'VE BROADENED AND STANDARDIZED THE ACTUAL CITIZEN PARTICIPATION PLAN REPORT.

SO FIRST OFF, THE REPORT ITSELF WILL BE SOMETHING THAT WILL HAVE A TEMPLATE TEMPLATE TO IT SO THAT THERE WILL BE STANDARDIZATION ACROSS THE BOARD FOR EACH ONE OF THE NEW CITIZEN PARTICIPATION PLANS.

THIS WILL MAKE IT STREAMLINED PROCESS FOR BOTH THE APPLICANTS AS WELL AS STAFF AND REVIEWING THE PROCESS.

AND THEN WE'VE ALSO ALLOWED FOR THE MORE ROBUST NATURE OF BROADENING CITIZEN PARTICIPATION PLANS BY ENABLING VIRTUAL MEETING LINKS TO ACCOMPANY MEETINGS.

THEY ARE NOT REQUIRED, BUT THEY ARE SOMETHING THAT CAN BE PROVIDED IN ADDITION TO THE PHYSICAL MEETING PLACE, JUST TO TRY TO ALLOW FOR MORE PARTICIPATION THROUGHOUT THE COMMUNITY, ESPECIALLY THOSE THAT MAY NOT BE ABLE TO MAKE THE MEETING OR ARE UNCOMFORTABLE BEING THERE IN PHYSICAL FORM.

THOSE ARE THE PROPOSED CHANGES IN A NUTSHELL, AND STAFF DOES RECOMMEND APPROVAL FOR CASE NUMBER TW SEVEN 2023 AND WE REQUEST THAT THE PLANNING COMMISSION DO THE SAME AND STAFF IS AVAILABLE FOR ANY QUESTIONS.

YES. A NON EXEMPT DEVELOPMENT PLAN WILL BE A DEVELOPMENT PLAN THAT DOES NOT HAVE TO GO FOR.

SORRY, LET ME REPHRASE THAT.

AN EXEMPT DEVELOPMENT PLAN.

I'M GOING TO START WITH THAT TO MAKE IT A LITTLE EASIER.

IF IT IS AN EXEMPT DEVELOPMENT PLAN, WHAT THAT MEANS IS IT WOULD BE SOMETHING THAT DOES NOT HAVE TO COME BEFORE THIS BOARD OR BEFORE CITY COUNCIL.

IT IS A SMALL ENOUGH SCALE AMENDMENT TO THEIR DEVELOPMENT PLAN THAT IT WOULD BE AT STAFF LEVEL.

SO NONEXEMPT.

WOULD BE SOMETHING THAT WOULD, OF COURSE, MAKE IT COME BACK TO YOU.

SO ANY NON EXEMPT WOULD BE SOMETHING THAT COMES BACK BEFORE YOU AND THEY'LL HAVE TO HAVE A CITIZEN PARTICIPATION PLAN TO DO THAT.

SO BASICALLY A GOOD EXAMPLE WOULD BE BAYSIDE LAKES.

IT'S BEEN AN ESTABLISHED PWD FOR A VERY LONG TIME, BUT A LOT OF THE PARCELS THERE ARE STILL VACANT AND BECAUSE OF THAT PEOPLE ARE HAVING IDEAS ON HOW TO DEVELOP THEM, BUT THEY'RE DIFFERENT FROM THE ORIGINAL POD STANDARDS THAT THEY HAD.

SO THEY HAVE TO MAKE AMENDMENTS TO THEM.

AND BECAUSE THAT IS STILL A NEW DEVELOPMENT, EVEN THOUGH IT HAS ITS ENTITLEMENTS, WE WOULD LIKE FOR PEOPLE TO BE ABLE TO SEE THAT AND PARTICIPATE IN THAT TYPE OF PLANNING ACTIVITY, BECAUSE LET'S SAY, FOR INSTANCE, BAYSIDE, SOME OF IT WAS IN 2003 THAT I WAS CREATED.

SO ABOUT 20 YEARS AGO THERE WEREN'T CITIZEN PARTICIPATION PLANS.

SO BECAUSE OF THAT, WE'RE NOW ENACTING IT AND ALLOWING THE CITIZENS TO PARTICIPATE.

AND THEN, OF COURSE, THE TRANSGRESSION OF 20 YEARS LATER, IT'S MOST LIKELY NOT GOING TO BE THE SAME PLAN AS IT ORIGINALLY WAS.

SO WE WANT TO BE ABLE TO HAVE, AGAIN, PARTICIPATION IN THE NEW PLAN.

AND THAT'S THE IDEA OF THE NONEXEMPT.

NOTIFICATIONS TO THE AFFECTED HOMEOWNERS WITHIN 500 FEET.

THAT'S STILL EVERYTHING.

STILL THE SAME IN THAT REGARD, CORRECT? CORRECT. YES. STILL A MAILED NOTICE TO THOSE INDIVIDUALS AFFECTED.

YES. SO FOR THAT, WHAT THEY DO IS THEY GO TO THE BREVARD PROPERTY APPRAISER AND THEY OBTAIN A 500 FOOT RADIUS PACKAGE FROM BREVARD THAT WILL PROVIDE THEM WITH THE BOTH THE HOME OWNER, AS WELL AS IF THERE IS A TENANT AT THE HOME.

SO THAT WAY WE GET EVERYONE THAT'S ACTUALLY IN THE VICINITY, NOT JUST INCLUDING THE HOMEOWNERS THAT MIGHT BE ABROAD, BUT ACTUALLY THE RESIDENTS IN THE CITY AS WELL, TO MAKE SURE IT'S A HOLISTIC PROCESS FOR THE PARTICIPATION.

IT'S A QUICK QUESTION. SO WHEN THIS REPORT, THIS FORM THAT YOU HAVE, THEN THAT COMES TO US IN, WE WILL GET A COPY OF IT AND SEE WHO'S IN ATTENDANCE AND THAT SORT OF THING.

SO WE WILL BE ABLE TO REVIEW THE ACTUAL COMMENTS FROM OR WHATEVER THE NOTATIONS THAT THEY MAKE.

YES, ABSOLUTELY. THAT WAS THE BIG PART OF THE TIMELINE FOR US IS NOW THAT WE WILL RECEIVE IT SOONER DURING THE SUFFICIENCY PERIOD, IT'S GOING TO BE PART OF THE APPLICATION PACKAGE AND WITH THAT WE'LL BE ABLE TO PROVIDE IT TO YOU ALONG WITH THE STAFF REPORT.

SO THAT WILL BE SOMETHING THAT YOU'LL ACTUALLY BE ABLE TO SEE AHEAD OF TIME AND SEE WHO HAS PARTICIPATED IN THE MEETING, WHAT THE GENERAL NOTES ARE ABOUT THE MEETING AND SO FORTH, RATHER THAN NOT KNOWING WHAT THE CITIZENS HAVE SAID ABOUT WHAT'S GOING ON ON THEM TO TELL US.

SO IT'S MORE OF AN EXTENSION THAT WE WANT TO SEE HAPPEN AND EVENTUALLY WE WILL TRY TO ADOPT THINGS TOWARDS IT ONCE WE PROGRESS THAT WAY.

BUT FOR NOW, IT'S TRYING TO ALLOW FOR CHANGES WITHOUT PROHIBITING TECHNOLOGY TO AN EXTENT.

RIGHT NOW, OUR CODE DOESN'T ALLOW FOR THE TECHNOLOGY, WE'RE JUST AT LEAST ALLOWING FOR IT.
