[AGENDA REVISIONS]
THANK YOU, MAYOR. I HAVE ONE.I WOULD LIKE TO REQUEST THAT COUNCIL.
CONSIDER ITEM NUMBER ONE UNDER NEW BUSINESS BE MOVED UP TO BE REVIEWED PRIOR TO PUBLIC HEARINGS.
GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
SO WE'RE MOVING THIS TO AFTER THE PUBLIC COMMENTS.
CORRECT. RIGHT BEFORE PUBLIC HEARINGS.
[PUBLIC COMMENTS/RESPONSES]
MR. DEREK NATHAN.THANK YOU FOR GIVING ME A CHANCE TO SPEAK.
I'M THE OWNER OF DSN HOME SERVICES, WHICH IS A SMALL HANDYMAN SERVICE HERE IN PALM BAY.
AND I WAS APPROACHED TODAY AT MY RESIDENCE ABOUT MY TRAILER BEING PARKED IN MY DRIVEWAY.
I TAKE CARE OF MY MY PROPERTIES IMMACULATE.
BY ME MOVING THE TRAILER TO MY BACK YARD, I'M GOING TO PUT DIVOTS WHEN IT RAINS.
I WAS WONDERING IF I COULD GO FOR A HARDSHIP OR SOMETHING BECAUSE I USE THIS TRAILER EVERY DAY FOR WORK, SO I WASN'T SURE IF THAT THEY DIDN'T CALL ON ME. IT WAS CALLED FOR SOMEBODY IN THE NEIGHBORHOOD.
BUT SEE, HE DROVE BY AND HE SAW MY TRAILER.
[00:05:01]
OKAY. SO, MADAM SHERMAN, DO YOU HAVE ANYONE, ANYONE ON STAFF THAT CAN HELP OUR CONSTITUENTS OUT? YES, SIR. SO, JESSE ANDERSON IN THE BACK IS OUR ACTING GROWTH MANAGEMENT DIRECTOR AND CODE COMPLIANCE AS PART OF HIS TEAM.OKAY. SO I'LL ASK HIM TO GET YOUR INFORMATION AND THEN WE'LL TALK THROUGH IT WITH YOU.
THANK YOU FOR LETTING ME SPEAK.
MY NAME IS SHERRY HANSELMAN AND I LIVE IN SOUTHEAST PALM BAY.
AND THIS FACILITY IS LARGE, PROBABLY SOMEWHERE BETWEEN 60,000FT² AND 80.
IT HAS NOW BEEN ALMOST A YEAR AND A HALF AND NO ACTIVITY HAS OCCURRED ON THIS HALF BUILT BUILDING.
AND. I WENT TO THE BUILDING DEPARTMENT TODAY AND THEY TOLD ME THAT THE PERMIT HAD EXPIRED AND THAT THE COMPANY THAT WAS BUILDING IT HAD NOT PAID THEIR EXCUSE ME, THEIR COMPLIANCE FEES.
SO THIS BUILDING SITS THERE WITH BARE BLOCK.
THE TABS AT THE TOP THAT ARE SUPPOSED TO SECURE THE TRUSSES.
THE TRUSSES ARE LAYING IN THE YARD AND THEY'VE BEEN LIKE THAT FOR A YEAR AND A HALF.
WE'D LIKE I WOULD LIKE TO KNOW WHAT'S GOING TO BE DONE ABOUT IT.
IS IT GOING BANKRUPT? ARE YOU GOING TO BE ABLE TO PENALIZE THEM FOR NOT MOVING FORWARD AND HOW THIS IMPACTS THE LOOKS OF OUR NEIGHBORHOOD.
WHAT'S TO BE DONE? DOES THAT CONCLUDE YOUR COMMENTS, MA'AM? YES, I'D LIKE TO KNOW I'D LIKE TO KNOW WHAT THE COUNCIL IS GOING TO DO IN REGARDS TO THIS COMPANY, ESPECIALLY IF IT'S GONE BANKRUPT.
DO WE JUST LIVE WITH A HALF BUILT 60 ZERO ZERO ZERO SQUARE FOOT BUILDING THAT WE ALL CAN SEE? WELL, THIS ISN'T A DIALOG.
FINISH YOUR COMMENTS AND THEN I'LL SEE HOW WE CAN HELP YOU.
THAT'S THAT'S MY QUESTION IS WHAT IS THE CITY COUNCIL GOING TO DO AND ARE WE JUST STUCK WITH LOOKING AT AN INCOMPLETE BUILDING? WELL, I'M NOT SURE, BUT WE'RE GOING TO DIRECT STAFF TO LOOK INTO THE REVIEW THE ISSUE.
MADAM CHAIRMAN. YEAH, I DON'T KNOW THE ANSWER TO THOSE QUESTIONS YET, BUT IS THIS THE ONE THAT'S OFF OF ELDERON? YES. THE ADDRESS IS 601 PILGRIM LANE.
SO LET ME GET YOUR CONTACT INFORMATION.
I'M ALSO GOING TO PICK ON JESSE ANDERSON BACK THERE.
I NEED HIM TO GET YOUR CONTACT INFORMATION.
JESSE. SEE THE GENTLEMAN IN THE BACK? YEAH. AND I'LL WORK WITH STAFF TO UNDERSTAND THE SITUATION AND WHAT WE CAN DO ABOUT IT, BECAUSE THAT IS A CONCERN.
BUT IF YOU DON'T MIND GIVING YOUR CONTACT TO HIM, THEN WE'LL FOLLOW UP WITH YOU.
OKAY. AND JUST ONE LAST FOLLOW UP QUESTION.
WILL YOU BE SENDING OUT A LETTER TO THE LOCAL RESIDENTS THAT WERE IMPACTED BY THIS DECISION TO BUILD IT AND TO LET THEM KNOW THAT NOTHING CAN BE DONE OR WHATEVER YOU'RE GOING TO BE DOING? WILL YOU BE SENDING THAT OUT TO THE RESIDENTS? WE CAN CERTAINLY LOOK INTO THAT COMMUNICATION, I THINK.
I'M SORRY, MAYOR. THAT'S A FAIR QUESTION.
BUT LET'S GET SOME DETAILS FIRST ABOUT WHERE THEY'RE AT.
NEXT SPEAKER, MR. DANIEL CORCORAN.
GOOD EVENING. DANIEL CORCORAN 2124 LYNBROOK DRIVE SOUTHEAST.
THANK YOU FOR THE OPPORTUNITY TO SPEAK TO YOU AGAIN.
SADLY, VERY LITTLE HAS CHANGED SINCE MY LAST REPORT.
A LIST OF TEN COMPLAINTS WAS SENT BY OUR TEAM TO THE PROPERTY OWNER ON JULY 15TH.
FOUR DAYS LATER, THE OWNER TOLD US THAT ALL THE ITEMS HAD BEEN ADDRESSED.
THIS IS THE SAME LIST THAT I READ TO YOU TWO WEEKS AGO TODAY.
WE DO NOT SEE ANY EVIDENCE OF THAT OCCURRING AND IF IT WAS DONE, IT CERTAINLY WAS NOT EFFECTIVE.
THE SITUATION DETERIORATES BY THE DAY.
THE LAST FULL MOWING BEHIND MY PROPERTY WAS JULY 14TH AND IT'S ALREADY HIGHER THAN 12IN.
[00:10:06]
WEEDS IN THE TRAPS CAN BE MEASURED IN FEET, NOT INCHES.MOWING FREQUENCY ONCE PER MONTH IS INADEQUATE TO SUSTAIN COMPLIANCE WITH THE CODE IN THE SUMMER.
BUT THE PROPERTY IS OVER 200 ACRES AND THERE'S ABOUT 300 AFFECTED HOMEOWNERS WELL BEYOND THE CAPABILITIES OF THEIR PROCESS AND THEIR SYSTEMS. MISS WEGLEIN FROM CODE COMPLIANCE TOLD US THIS WEEK THAT THE OWNER HAS WITHDRAWN PERMISSION FOR THEM TO ACCESS THE PROPERTY TO CONDUCT INSPECTIONS.
NONE OF WHAT WE ARE DOING NOW IS LEADING TO A SATISFACTORY OUTCOME.
IF WE CAN AGREE THAT THE PROPERTY'S CONDITION CONSTITUTES A PUBLIC NUISANCE AS DEFINED IN THE CODE.
CHAPTER 93 CONFIRM THAT ACCESS TO INSPECT HAS BEEN WITHDRAWN AND CONCUR THAT THE OWNER HAS GIVEN SUFFICIENT OPPORTUNITY TO ADDRESS THE VIOLATIONS, THEN THE CITY OUGHT TO PROMPTLY MOVE FORWARD TO PLACE THIS ON THE AGENDA FOR A SPECIAL MAGISTRATE HEARING AT THE AUGUST MEETING.
I RESPECTFULLY ASK FOR YOUR HELP IN MAKING THAT HAPPEN.
THANK YOU. THANK YOU, MISS MARIE CORCORAN.
HARRY CORCORAN, LYNBROOK DRIVE.
I'D LIKE TO ASK THE CITY COUNCIL TO HAVE TRAFFIC ENGINEERING TAKE A LOOK AT PLACING AN RFP, A RECTANGULAR, RAPID FLASHING BEACON AT THE CORNER OF EMERSON AND STIRLAND.
THERE'S ALREADY A PEDESTRIAN CROSSING THERE.
HOWEVER, CARS GO THROUGH ON EMERSON AT A VERY HIGH RATE OF SPEED.
A BOX TRUCK STOPPED BEHIND ME AND THEN A THIRD CAR BEHIND THEM JUST CAME FLYING AROUND PAST US.
THEY WERE BEHIND US, BUT THEY CAME AT A HIGH RATE OF SPEED AROUND US.
AND HAD THE COUPLE NOT STOPPED, THEY WOULD HAVE BEEN HIT.
UM, I KNOW THERE'S ALREADY CROSSWALK THERE, BUT IT IS LIKE THE SINGLE LANES GOING ACROSS THAT IS ACTUALLY A SIX LANE INTERSECTION.
YOU HAVE FOUR TRAVEL LANES AND TWO TURN LANES.
SO I'D LIKE TO KNOW IF IN ADDITION TO PLACING AN RFP THERE, IF YOU COULD ALSO HAVE ZEBRA STRIPES IN THE CROSSWALK INSTEAD OF THE TWO STRAIGHT LINES.
THANK YOU. SO YOU'RE TALKING ABOUT EMERSON, THE FOUR LANES THERE AT STARLING, THAT INTERSECTION, CORRECT? MADAM CHAIRMAN, CAN YOU DIRECT MR. WATANABE TO LOOK INTO THIS? ABSOLUTELY, SIR. THANK YOU.
THANK YOU. MA'AM, WOULD YOU GO MEET WITH THAT YOUNG MAN THERE? THANK YOU. MAYOR, IF I MAY, JUST WANTED TO ADD, AND I WOULD CERTAINLY SUPPORT THIS INTERSECTION.
THIS IS AN INTERSECTION I TRAVEL QUITE OFTEN.
AND AND IT COULD BE EITHER WAY, WHETHER YOU'RE TURNING NORTH OR SOUTH FROM STARLING.
THANK YOU. MR. EARL. EARL DEMINGS.
GOOD AFTERNOON. THE HONORABLE JUDGE.
EXCUSE ME, MAYOR AND COUNCIL PERSONS.
I HAVE A NEIGHBOR THAT CAME WITH ME.
SHE'S ON A CARD ALSO, AND I'D LIKE TO HAVE HER TO COME WITH ME IF POSSIBLE.
DID YOU WANT TO COMBINE THE TIME? YES, SIR. YES. OKAY. COME ON.
COME ON, SIR. IS IT JACKIE? YES, IT IS. JACKIE. OKAY.
SO SHE. SHE HAS THE PAPERWORK.
HI, MY NAME IS JACKIE THOMPSON.
THANK YOU SO MUCH FOR ALLOWING US SOME TIME TO SPEAK.
WE ARE HAVING SOME DIFFICULTY WITH OUR POWER AND WE ARE REQUESTING SOME CONSIDERATION AS TO AN INVESTIGATION AND POSSIBLY A RESOLUTION AS TO SOME POWER OUTAGES.
SO I PURCHASED MY HOME IN AUGUST AND I CAN SPEAK ONLY FOR MYSELF.
[00:15:01]
SINCE AUGUST 31ST OF 2022, WE HAVE HAD 14 POWER OUTAGES.14 POWER OUTAGES OR POWER OUTAGES OCCURRED.
THOSE POWER OUTAGES LASTED ANYWHERE FROM FIVE HOURS TO A DAY AND A HALF.
CLEARLY WE HAVE AN INFRASTRUCTURE PROBLEM.
SO WHEN YOU CALL AND REPORT THAT THERE'S A PROBLEM OR WHEN THEY ADVISE YOU THAT THERE'S A PROBLEM, THERE'S ALWAYS AN ANSWER OF IT COULD BE WEATHER OR IT COULD BE AN ANIMAL OR IT COULD BE SOMETHING, BUT THAT CAN'T POSSIBLY BE WHAT THE PROBLEM IS.
IT'S AN INFRASTRUCTURE PROBLEM.
SOMETIMES IT TAKES A LONG TIME FOR THEM TO GET SOMEBODY OUT THERE AND SOMETIMES IT DOESN'T.
IT'S ALWAYS THE SAME SECTION OF HOMES AND IT'S ALWAYS A CONSISTENT PROBLEM.
SO WE'RE REALLY REQUESTING AN INVESTIGATION AS TO THE STABILITY OF POWER IN OUR AREA AND IN A RESOLUTION FOR A CONSTANT FLOW OF ENERGY TO OUR HOMES.
SO I THINK WE COULD DEFINITELY HAVE A DIALOG AND A DISCUSSION WITH FPL.
AND SO IF WE COULD GET YOUR CONTACT INFORMATION AND START THAT DIALOG AND THAT DISCUSSION, HONING IN ON EXACTLY WHAT'S GOING ON IN THAT SECTION OF OUR CITY. OKAY.
CAN YOU TELL ME OFFHAND WHAT STREET ARE WE TALKING ABOUT? IT'S IT'S USUALLY THE SAME 107 HOUSES.
I LIVE ON RANGER ROAD IN SOUTHEAST, BUT IT'S USUALLY THE SAME 100.
SO ANYWHERE BETWEEN 107 AND 118 HOMES.
THANK YOU. AND MY ROAD RANGER ROAD ON MY SIDE OF THE STREET, THE POWER GOES OUT.
IF I COULD HAVE YOU, IF YOU DON'T MIND, I HAVE FRANK WATANABE, OUR CITY ENGINEER.
HE'S GOING TO GET MORE OF YOUR CONTACT INFO AND THEN WE'LL FOLLOW UP WITH FPL.
OKAY. WE ALSO HAVE A PETITION SIGNED BY MANY OF THE PEOPLE IN OUR NEIGHBORHOOD.
THANK YOU. THANK YOU, MA'AM. THANK YOU.
AND AS YOU SAID, SHE SHE BEEN IN THE NEIGHBORHOOD SINCE 19, WHAT, 2022, 2022? I, I PURCHASED MY HOME IN 2019.
AND SO SHE'S SINCE SHE'S BEEN THERE, SHE SAID 14.
AND JUST IMAGINE HOW MANY I HAD BEFORE SHE ARRIVED.
SO IF SOMETHING COULD BE LOOKED INTO AND MANY NEIGHBORS I WENT TO, SOME ONE LADY TOLD ME SHE WENT INTO LABOR ONE PARTICULAR NIGHT AND THE POWER WENT OUT AND THEY WERE SCRAMBLING TRYING TO GET THINGS ORGANIZED.
I DON'T KNOW IF THEY DON'T GET A BACKUP TO SERVE THAT, BUT IT'S VERY ERRATIC.
WHEN IT HAPPENED, I WAS IN THE HABIT OF GOING INTO MY HOUSE THROUGH MY GARAGE.
AND SO ONE DAY I CAME BACK AND THERE WAS NO POWER.
SO I WAS OUTSIDE OF MY HOUSE FOR A DAY BECAUSE I LEFT MY KEYS IN THE HOUSE.
SO Y'ALL CAN HAVE THAT LOOKED INTO.
ROBERT STILES, 1796 WENBERG DRIVE.
AEROJET ROCKETDYNE PURCHASED BY L3.
HARRIS YAHOO! RIGHT. I MEAN, GOT A LOT OF STUFF GOING ON WITH L3.
HARRIS. I HOPE THEY CAN DRIVE AROUND THE PROPERTY.
THAT'S WHAT I'M GOING TO HIT YOU WITH TODAY.
IT'S EXCITING TO SEE WHAT'S HAPPENING.
BUT RIGHT NOW WE'RE BUILDING GRIDLOCK NOW.
TALK TO FRANK WATANABE PREVIOUSLY, AND I KNOW THE PLAN IS OUT THERE, BUT LET ME PUT IT IN CONTEXT.
I HAD A NEIGHBOR WHO WORKS AT HARRIS IN MY HOA AND HE SAYS, MAN, YOU'VE BEEN TO PUBLIX LATELY.
IT'S LIKE THANKSGIVING THERE EVERY DAY.
OKAY. THE WAY THE CITY WAS SET UP, THE INFRASTRUCTURE, THE ROADS AND WHAT HAVE YOU ARE NOT CONDUCIVE TO GETTING FROM A TO B IN A TIMELY FASHION. IT'S NOT LIKE NEW YORK WHERE WHERE YOU'RE FROM THAT THERE WAS SIX DIFFERENT WAYS TO GET TO THE SAME PLACE WITH DIFFERENT ROUTES OR WHAT HAVE YOU.
MY WIFE WENT TO URGENT CARE EARLIER THIS WEEK.
[00:20:01]
SHE GETS THERE AT 8:00, AT 2.5 HOURS TO GET IN.OKAY. AND ONE OF THE THINGS THAT I'M YOU KNOW, I'M NOT SURE IF I'M EXPLAINING THIS CORRECTLY, BUT WHEN YOU WHEN YOU DROP 1500 HOMES HERE AND YOU HAVE AND YOU PUT ANOTHER 500 OR 600 HERE, OKAY, YOU JUST COMBINING THAT IN ROADS THAT AREN'T DESIGNED TO TAKE TO HANDLE THE INFRASTRUCTURE OR THE COMMUTING VEHICLES OR WHAT HAVE YOU, IT'S GRIDLOCK ANYWHERE YOU GO AND PEOPLE ARE GETTING UPSET.
SO I GUESS WHAT I'M ASKING YOU TO LOOK AT, CAN WE LOOK AT THINGS FROM FROM A 30 ZERO ZERO ZERO FOOT AREA? AND AS WE'RE PLANNING THESE HIGHWAYS, LOOK AT, OKAY, WHAT'S GOING TO DO? WHAT'S THAT GOING TO DO TO THE TO THE CURRENT INFRASTRUCTURE? WHAT'S THAT GOING TO DO TO COMMUTER TIME? BECAUSE YOU GET PEOPLE COMING FROM CALIFORNIA OUT HERE AND PEOPLE HAVE TO LIVE RIGHT THERE GOING TO WORK.
AND L3, HARRIS IS COMING HERE.
WE CAN GET OUT OF THE GRIDLOCK AND WHATNOT AND YOU'VE GOT ALL SORTS OF GRIDLOCK HERE.
SO CAN WE LOOK AT, YOU KNOW, HOW IS THESE DEVELOPMENTS DON'T HAVE TO BE IN SUCH CLOSE PROXIMITY.
OKAY. CAN WE LOOK AT THAT AND SEE WHAT WE'RE DOING? BECAUSE ALL THE STORES ARE PACKED.
I MEAN, DOWN IN HERITAGE, I DON'T KNOW WHO WOULD WANT TO LIVE THERE FROM WHAT I'M HEARING.
SO I WOULD ASK YOU TO PLEASE GIVE THAT DUE CONSIDERATION.
BY THE WAY, AS A SIDE NOTE, THE LAST TIME I WAS HERE WITH THE MAGISTRATE, HE TOLD BOTH HEATHER LLC AND THE ATTORNEY THAT YOU'RE PROBABLY GOING TO HAVE TO MOW EVERY TWO WEEKS WHAT'S GOING ON TO THAT POINT? SO THEY'VE BEEN TOLD BY THE MAGISTRATE, THANK YOU.
RIGHT. PHILLIP CORCORAN, 1878.
ONE BOOK DRIVE. I HAVE SOME MORE PICTURES FOR YOU THIS EVENING OF THE NEGLECTED PROPERTY AT 3003 75 BAYSIDE LAKES BOULEVARD. I KNOW YOU MUST BE TIRED OF SEEING THESE PICTURES, BUT I CAN ASSURE YOU THAT THE HOMEOWNERS THAT I THAT SEE THESE SITES FROM THEIR BACKYARDS ARE VERY TIRED OF SEEING THE EYESORES AND THE OVERGROWN WEEDS AND THE PEPPER TREES.
THIS NEGATIVELY NEGATIVELY AFFECTS OUR PROPERTY VALUES.
PALM BAY REALTORS ARE REPORTING INVENTORIES ARE UP.
SALES ARE DOWN DRAMATICALLY, ALONG WITH PRICES IN BAYSIDE LAKES AND PALM BAY AS A WHOLE.
I WOULD LIKE TO THANK THE CODE ENFORCEMENT TEAM FOR MANAGING A DIFFICULT SITUATION AT THE SITE.
WITH OVER 300 ADJOINING PROPERTIES AFFECTED BY THE LACK OF MAINTENANCE.
CONDITIONS. CONDITIONS DETERIORATE DAILY.
WE EXPECT THIS TO BE A LONG PROCESS, LASTING MANY MONTHS TO SEVERAL YEARS.
AND WE AND WE ARE PREPARED TO DO THE SAME THING AGAIN UPON REQUEST.
MANY OF THE SAME VIOLATIONS STILL EXIST TODAY.
THIS IS A MONUMENTAL ADMINISTRATIVE ADMINISTRATIVE TASK FOR CODE ENFORCEMENT.
LOGGING AND TRACKING COMPLAINTS WILL BE AN ADMINISTRATIVE NIGHTMARE.
FOR EXAMPLE, IS CODE ENFORCEMENT PREPARED TO MAINTAIN AN ACCURATE LIST OF AFFECTED HOMEOWNERS THAT HAVE COMPLAINTS AGAINST THE PROPERTY? WILL CODE ENFORCEMENT INSPECT ALL AREAS WHERE COMPLAINTS HAVE BEEN FILED? HOW WILL THE EFFECTIVE HOMEOWNERS GET CASE NUMBERS AND AND CHECK STATUS OF OPEN CASES? HOW WILL THE EFFECT OF HOME OWNERS FIND OUT WHEN INSPECTIONS WILL OCCUR AND AT WHAT LOCATIONS? THIS IS A HUGE JOBS.
IN MAY, WE BELIEVE THAT THE PROPERTY WAS IN VIOLATION OF CHAPTER 93 WHEN JUDGED.
HOWEVER, THE DOCUMENTS THAT THE MAGISTRATE HAD STATED THAT THE PROPERTY WAS UNIMPROVED PROPERTY.
WELL, THE FORMER GOLF COURSE BE ON THE AGENDA FOR THE AUGUST MAGISTRATE MEETING.
AND IT WILL WILL IT BE JUDGED AS IMPROVED PROPERTY? WE HAVE REASON TO BELIEVE THAT JOY LLC, ALONG WITH THE WITH HER ATTORNEY, SPIRA.
IS PREPARING TO CLAIM THAT THE PROPERTY IS UNIMPROVED.
IF THEY SUCCEED, IT WILL ALLOW THE ENTIRE PROPERTY TO BECOME OVERGROWN TO THE POINT WHERE BRUSH AND PEPPER TREES ARE EVERYWHERE SO THAT SHE DOESN'T HAVE TO MOW ANYTHING. THANK YOU.
THERE ARE NO MORE PUBLIC COMMENTS.
OKAY. THANK YOU. WE'RE NOW MOVING ON TO PUBLIC HEARINGS.
[00:25:01]
ITEM NUMBER ONE, MS..SMITH. MAYOR, I KNOW WHICH ONE.
[NEW BUSINESS ( Part 1 of 2 )]
OH, AS YOU WERE.WE'RE ON NEW BUSINESS, NUMBER ONE.
YES. RESOLUTION 2023, DASH 22, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, SUPPLEMENTING RESOLUTION 20 1863, AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $50 MILLION IN AGGREGATE PRINCIPAL AMOUNT OF THE CITY OF PALM BAY, FLORIDA GENERAL OBLIGATION BONDS SERIES 2020 THREE INCHES ORDER TO FINANCE ROADWAY IMPROVEMENTS, MAKING CERTAIN OTHER COVENANTS AND AGREEMENTS IN CONNECTION WITH THE ISSUANCE OF SUCH BONDS, PROVIDING CERTAIN TERMS AND DETAILS OF SUCH BONDS, AUTHORIZING THE CITY MANAGER OR THE FINANCE DIRECTOR OF THE CITY TO PUBLISH A SUMMARY NOTICE OF SALE AND TO RECEIVE BIDS PURSUANT TO A COMPETITIVE SALE OF SAID BONDS AND AWARD THE SALE OF SAID BONDS TO THE RESPONSIVE BIDDER OR BIDDERS.
OFFERING THE LOWEST TRUE INTEREST COST TO THE CITY, WHICH SHALL NOT EXCEED 6%.
AUTHORIZING THE EXECUTION AND DELIVERY OF SET BONDS, APPOINTING THE PAYING AGENT AND REGISTRAR WITH RESPECT TO SET BONDS, APPROVING THE PREPARATION AND USE OF A SUMMARY NOTICE OF SALE AND OFFICIAL NOTICE OF SALE.
MADAM SHERMAN, YOU WANT TO PRESENT THIS? THANK YOU, MAYOR. SO THIS IS THE THIRD DRAW FOR THE GO ROAD BOND PROGRAM.
SO I'LL ASK MOLLY IF SHE CAN COME UP.
GOOD EVENING. I'M MOLLY CLARK WITH PUBLIC RESOURCES ADVISORY GROUP.
WE'RE THE FINANCIAL ADVISOR TO THE CITY.
WELCOME, MISS MOLLY. YOU COULD BRING THE LECTERN DOWN IF YOU LIKE.
THERE'S A LITTLE BUTTON THERE TO ADJUST IT.
SO AS SUZANNE MENTIONED, THIS IS THE THIRD OF THREE SERIES OF GENERAL OBLIGATION BONDS THAT THE CITY APPROVED IN ITS REFERENDUM IN 2018. THE FIRST SERIES OF BONDS WAS ISSUED IN 2019.
THIS WILL THIS WILL FOLLOW THE SAME STRUCTURE THAT THE TWO PRIOR SERIES OF BONDS TOOK $50 MILLION IN TOTAL PRINCIPAL AMOUNT FINANCED OVER A PERIOD OF 20 YEARS.
AT THIS TIME, WE ESTIMATE A TOTAL INTEREST COST IN THE RESOLUTION.
THERE'S A NOT TO EXCEED TOTAL INTEREST COST OF 6% BASED ON CURRENT MARKET RATES AND A LITTLE BIT OF CUSHION, I WOULD ESTIMATE WE'RE CLOSER TO 4%, WHICH ALTHOUGH AS YOU'RE AWARE, MARKET RATES HAVE BEEN COMING UP OVER THE LAST YEAR TO 15, 18 MONTHS.
BUT GIVEN THE OPPORTUNITY TO FINANCE THESE IMPORTANT ROADWAY IMPROVEMENTS AT AN ALL IN COST IN THE NEIGHBORHOOD OF 4%, IT'S STILL, FROM A HISTORIC PERSPECTIVE, A VERY ATTRACTIVE RATE TO THE CITY AND A WAY TO GET THESE VERY MUCH NEEDED PROJECTS DONE.
SO WITH THAT, I'M HAPPY TO ANSWER QUESTIONS OR GO THROUGH ANYTHING THAT YOU MIGHT LIKE TO ASK.
I WANT TO GIVE HIM THE OPPORTUNITY TO COUNCILMAN FOSTER.
YES, SIR. DO YOU HAVE ANY QUESTIONS? NO, NOT AT THIS TIME.
THANK YOU, MAYOR. HOW WAS IT WE WERE ABLE TO LOCK IN SUCH A GOOD RATE? IS IT BECAUSE OF THE RATING OF THE CITY OR THE RATE IS NOT LOCKED IN YET? THAT'S JUST WE.
WE FOLLOW THE MARKET AND WE WATCH THE WAY OTHER BOND ISSUES IN FLORIDA OR SIMILAR GENERAL OBLIGATION BONDS PRICED BY OTHER ISSUERS NATIONWIDE. SO IT'S A MARKET ESTIMATE.
BUT YES, BASED ON THE CITY'S CREDIT STRENGTH AND YOUR RATINGS RIGHT NOW, YOU WERE RECENTLY UPGRADED BY STANDARD AND POOR'S FROM AN A+ TO A DOUBLE A MINUS.
BUT TO YOUR POINT, THAT INTEREST RATE IS VERY MUCH DRIVEN BY THE CITY'S CREDIT STRENGTH.
[00:30:03]
AND THESE TWO DOUBLE A CATEGORY RATINGS, IT'S A HUGE SUCCESS.IT'S SPEAKS VOLUMES ABOUT WHAT THE CITY HAS DONE OVER THE PAST FEW YEARS.
THE RECENT S&P UPGRADE IS IS A REAL CREDIT STRENGTH AND TO YOUR CREDIT.
THANK YOU, MA'AM. DEPUTY MAYOR, THANK YOU.
I'M SORRY. THANK YOU. THANK YOU, MA'AM.
I REALLY APPRECIATE YOUR PRESENTATION.
I WAS RIGHT ALONG COUNCILMAN JOHNSON BECAUSE WE WERE AWARE OF OUR OUR NEW DOUBLE A MINUS RATING.
WE'RE LOOKING TO GET THAT DOUBLE A PLUS.
RIGHT. BUT IT HAS BEEN THESE EFFORTS THAT THIS COUNCIL HAS DONE OVER THE LAST FEW YEARS.
THANK YOU FOR THE PRESENTATION, MA'AM.
YOU'RE WELCOME. HAPPY TO BE HERE.
DEPUTY MAYOR, MR. BILL BATTEN. BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST. I HAVE TWO QUESTIONS WITH THIS ONE, WILL THIS DRAWER APPEAR ON THIS YEAR'S TAX BILL? SINCE WE'RE JUST GETTING READY TO SUBMIT THE WHAT OUR NEW MILLAGE RATE IS GOING TO BE? AND NUMBER TWO, CAN YOU TELL ME WHAT THE ANNUAL AMOUNT FOR FOR ROAD BOND WILL BE ON MY TAX OR RESIDENCE TAXES WITH THIS FINAL DRAW? WHAT WE'RE WHAT WE CAN BE BUDGETING IN OUR ANNUAL BUDGETS TO BE FACING WHEN YOU MAKE THIS DRAW.
THANK YOU. THANK YOU, MADAM SHERMAN.
THANK YOU, MAYOR. SO THE FIRST QUESTION IS NO, IT WILL NOT BE ON THIS YEAR'S TAX BILL.
BASED ON THE TIMING OF THE DRAW.
IT WILL BE ON THE 2024 TAX BILL.
THERE'S A LOT THAT GOES INTO THAT.
BUT TO PUT OUT A NUMBER, I WOULDN'T BE ABLE TO DO THAT TONIGHT.

SECOND, I GOT A MOTION BY DEPUTY MAYOR FELIX, SECONDED BY COUNCILMAN JOHNSON.
ANY FURTHER DISCUSSION, GENTLEMEN? ALL IN FAVOR. SIGNIFY BY SAYING AYE.

[00:45:02]
MOTION TO CONTINUE.SO MOVED. SECOND GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ALL IN FAVOR. SIGNIFY BY SAYING AYE.
WE ARE NOW ON ITEM NUMBER NINE.
OR IS 20, 23, 69 AN ORDINANCE OF THE CITY OF PALM BAY? BREVARD COUNTY, FLORIDA AMENDING THE CODE OF ORDINANCES TITLE 17 LAND DEVELOPMENT CODE CHAPTER 183 COMPREHENSIVE PLAN REGULATIONS SECTION 183 .01 COMPREHENSIVE PLAN SUBSECTION D ADOPTION OF FUTURE LAND USE MAP BY AMENDING THE FUTURE LAND USE MAP PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES AND CONFLICT HEREWITH PROVIDING FOR AN EFFECTIVE DATE.
I'M GOING TO OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO PRESENT THEIR CASE.
THING. I JUST WANTED TO CHANGE THE FUTURE LAND USE SO THAT I CAN BUILD ON THE PROPERTY.
YEAH. BUILD A SINGLE FAMILY HOME.
IT'S RIGHT NOW IT'S UNDER UTILITY.
WE ARE PLANNING ON SPLITTING THE PROPERTY IN HALF TO DO TWO SEPARATE HOMES.
THANK YOU. ANY QUESTIONS? COUNCIL? ANY QUESTIONS? COUNCILMAN FOSTER.
THANK YOU. ANY COMMENTS, MADAM CHAIRMAN? NO, SIR. OKAY.
ANYONE IN THE AUDIENCE WISH TO SPEAK FOR OR AGAINST THIS ITEM, PLEASE STEP FORWARD.
BILL BATTEN, 586 OCEAN SPRAY STREET, SOUTHWEST.
I LIKE THE FACT THAT THIS IS ONE HOUSE PER HALF ACRE.
THAT'S NOT QUITE WHAT I SHOOT FOR OF ONE HOUSE PER ACRE, BUT IT IS STILL MUCH BETTER THAN FIVE HOUSES PER ACRE AND I HOPE THESE PEOPLE ENJOY THEIR NEW HOME.
THANK YOU VERY MUCH. I'M STILL GOING TO KEEP TRYING FOR THAT.
ANYONE ELSE WISH TO SPEAK FOR OR AGAINST THIS ITEM.
YOU GOT A BIG SUPPORTER THERE, MS..
TORRES. I'M GOING TO CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.
SO MOVED. SECOND, GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ALL IN FAVOR. SIGNIFY BY SAYING AYE.
THANK YOU. WE ARE NOW ON ITEM NUMBER TEN ORDINANCE 2023 DASH 70 AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA AMENDING THE CODE OF ORDINANCES TITLE 17.
LAND DEVELOPMENT CODE CHAPTER 185 ZONING CODE SUBCHAPTER SUPPLEMENTARY DISTRICT REGULATIONS BY MODIFYING PROVISIONS RELATED TO ACCESSORY STRUCTURES PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT.
THANK YOU, MA'AM. I'M GOING TO OPEN UP THE PUBLIC HEARING, MADAM SHERMAN.
GOOD EVENING. JESSE ANDERSON, ASSISTANT DIRECTOR FOR GROWTH MANAGEMENT.
WHAT WE HAVE BEFORE YOU TONIGHT IS AN UPGRADED MODEL OF OUR ACCESSORY STRUCTURES ORDINANCE.
IN THIS PLACE, WHAT WE ARE MAKING MORE USEFUL FOR RESIDENTS AND ANY DEVELOPERS IS A TABLE THAT ALLOWS FOR YOU TO UNDERSTAND THE REQUIREMENTS, SETBACKS AND SO FORTH THAT YOU HAVE FOR VARIOUS ACCESSORY STRUCTURES.
AND THEN ALSO WHAT THIS ENCOMPASSES IS SOMETHING THAT COUNCIL HAD REQUESTED MANY MONTHS AGO, WHICH WAS AN INCREASE TO ACCESSORY STRUCTURE ALLOTMENTS FOR RURAL RESIDENTIAL LANDS.
SO RURAL RESIDENTIAL LANDS WITH TWO ACRES OR MORE NOW DO HAVE AN EXCESS OF ACCESSORY STRUCTURES, THAT IS, THAT THEY CAN HAVE BEYOND THE PRINCIPAL STRUCTURE WHERE BEFORE IT WAS JUST MAINTAINED BY THAT PRINCIPAL STRUCTURE SIZING.
WE DIDN'T ADD TOO MANY DIFFERENT ACCESSORY STRUCTURES OR ANYTHING LIKE THAT YET.
BUT THIS WAS MORE TO MEET THE NEEDS OF THE RESIDENTS IN AN URGENT FASHION.
YOU KNOW, I GOT TO TELL YOU, YOU SIMPLIFIED IT AND I WANT TO COMMEND YOU ON THAT.
MY MY CONCERNS ARE UNINTENDED CONSEQUENCES.
[00:50:06]
EQUIPMENT IN THERE.AND MY CONCERN IS SOMETIMES THAT EQUIPMENT, THEY MAY USE IT FOR BUSINESS.
RIGHT? SO THAT THAT'S AN AREA OF CONCERN AND HOW WE MAY BE WE MAY POLICE THAT.
AND I, I WOULDN'T WANT TO HURT A MAN'S ABILITY TO PUT FOOD ON THE TABLE SO THAT THAT'S AN AREA OF, YOU KNOW, WHERE I'M AT WITH THE UNINTENDED CONSEQUENCES. SURE.
IF YOU WANT ME TO SPEAK ON THAT. YES, SIR.
YEAH, ABSOLUTELY. SO THAT HAS A TWO PART RESOLUTION TO ONE PART DOES STATE THAT INSIDE OF THIS ORDINANCE, ANY RESIDENTIAL STRUCTURE IS NOT MEANT TO BE FOR A BUSINESS OPERATION.
SO THAT DOESN'T PREVENT HOME BASED BUSINESSES.
IT JUST DOES RESTRICT CERTAIN TYPES OF BUSINESSES THAT CAN BE AT HOME.
IT JUST WAS HEARD LAST NIGHT AT PLANNING AND ZONING.
BUT THAT WILL DICTATE WHAT TYPES OF VEHICLES CAN BE PARKED IN RESIDENTIAL AREAS AND WHERE.
AND WE DO ALLOW FOR, FOR INSTANCE, F TWO 50S IN CERTAIN LEVEL TRUCKS THAT ARE WORK TRUCKS TO BE PARKED IN FRONT YARDS AND THEN OTHER TYPES OF COMMERCIAL TO BE PARKED IN OTHER LOCATIONS IF IT ISN'T AN ENCLOSED AREA.
THAT. THANK YOU. ANY QUESTIONS? COUNCIL MR. ANDERSON REAL QUICK, I KNOW IN THE PAST WE'VE WE'VE LOOKED LOOKED AT A COUPLE OF APPLICATIONS THAT CAME BEFORE US WHERE THE RESIDENT WANTED TO BUILD A STRUCTURE LARGER IN SQUARE FOOTAGE THAN THE EXISTING HOME.
WAS THAT WAS IS THAT ADDRESSED? YES, THAT WAS ON A RURAL RESIDENTIAL SPECIFICALLY PIECE OF PROPERTY.
AND THAT'S WHERE WE FALL INTO THAT ISSUE IS ON THE LARGER LOTS, BECAUSE ON LARGER LOTS, YOU'RE NOT REALLY HAVING AS MUCH AS MUCH LOT COVERAGE AS YOU WOULD ON A SMALLER LOT IF YOU'RE AT 7500 SQUARE FOOT LOT VERSUS A FIVE ACRE LOT.
AND THAT HOME REGARDLESS, IS 1600 SQUARE FEET, WHY WOULD WE LIMIT THEM DOWN WHEN IT'S MORE ABOUT LOT COVERAGE RATHER THAN THE SIZE OF THE ACCESSORY STRUCTURE? OKAY. ANY QUESTIONS? COUNCILMAN. FOSTER.
ANYONE ELSE WISH TO SPEAK FOR OR AGAINST THIS ITEM.
STEP FORWARD. BILL BATTEN 586 OCEAN SPRAY STREET SOUTHWEST. I LIKE THE NEW ORDINANCE.
WITH THE EXCEPTION OF THE METAL STRUCTURES, A HEIGHT OF ONLY 12FT WILL NOT ALLOW A MOTOR HOME OR AN RV THE CLEARANCE TO PARK INSIDE THE BUILDING.
ALL RIGHT. THIS WILL BECOME WILL BECOME VERY PERTINENT WITH THE NEW PROPOSED PLAN.
THAT'S COMING UP UNDER THE NEW REGULATIONS FOR THE PARKING THAT HE WAS JUST ADDRESSING.
I MEAN, THE CLEARANCE JUST ISN'T THERE.
I CAN'T ENTER THE BUILDING, SO I'LL HAVE AN EMPTY SHED.
THANK YOU VERY MUCH. I'M JUST TRYING TO ALLEVIATE A PROBLEM BEFORE IT ARISES.
THANK YOU. NO, THANK YOU, MASTER CHIEF, YOUR ACREAGE.
OKAY, SO IT DOESN'T AFFECT YOU DIRECTLY.
BUT I MADE SURE THAT WHEN WE ADDRESSED THIS LAST NIGHT.
I MADE SURE DURING THE PLANNING AND ZONING LAST NIGHT FOR THE AFFIDAVITS THAT COVERS THE RURAL, RESIDENTIAL AND THE AGRICULTURE, I MADE SURE THAT I HAD MY AFFIDAVITS AND EVERYTHING ELSE IN THERE. SO I'M GOING TO REMAIN AND MAIN TRY TO MAINTAIN MY LEGAL STATUS WITHIN THE CITY OF PALM BAY, BECAUSE I'D HATE TO HAVE YOU GUYS COMING AFTER ME.
SO FOR METAL STRUCTURES, WE ARE NOT CHANGING THE ACTUAL ALLOTMENTS.
CURRENTLY, IT IS ALLOWED TO ONLY BE AT 12FT HIGH WITH A 300 SQUARE FOOT BASE.
SO WE HAVE NOT CHANGED THAT PORTION OF THE CODE.
WE MAINTAINED IT AT THIS POINT IN TIME.
IF COUNCIL WERE TO WANT US TO RECONSIDER THAT, WE CAN.
[00:55:05]
SO IT'S A LOT ABOUT MAKING SURE THERE IS A CONDUCIVE NATURE BETWEEN THE STRUCTURES AND THE AREA.ALL RIGHT. THANK YOU. MAYBE WE SHOULD LOOK AT CONSIDERING THOSE METAL STRUCTURES.
MAYBE NOT NOW, BUT CERTAINLY WE CAN LOOK AT THAT IN THE FUTURE.
IS THAT GOOD? MADAM CHAIRMAN? YES. YES, SIR. AND I WOULD ADD, TOO, YOU CAN STILL BUILD A CARPORT OR A DETACHED GARAGE THAT GOES UP TO THE 25 FOOT HEIGHT.
SO THAT WILL ACCOMMODATE PEOPLE TYPICALLY WHO WANT TO BUILD.
ANYONE ELSE WISH TO SPEAK FOR OR AGAINST THIS ITEM? SEEING NONE, I'M CLOSING THE PUBLIC HEARING AND ASKING FOR A MOTION.
GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ANY ADDITIONAL DISCUSSION, GENTLEMEN? SEEING NONE. ALL IN FAVOR.
PASSES FOUR ZERO. WE ARE NOW ON ITEM NUMBER 11 ORDINANCE 20 2371 AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA AMENDING THE CODE OF ORDINANCES TITLE 17 LAND DEVELOPMENT CODE CHAPTER 185 ZONING CODE.
I'M GOING TO OPEN UP THE PUBLIC HEARING, MADAM SHERMAN.
THANK YOU, MAYOR. I'LL ALSO DEFER TO JESSIE ON THIS ONE.
FOR THE AMENDMENT THAT WE HAVE BEFORE YOU TODAY IS TO ALLOW FOR US TO HAVE MORE FLEXIBILITY AND LOOKING AT DEVELOPMENT SITES, SPECIFICALLY INFILL DEVELOPMENT AND REDEVELOPMENT SITES, MORE SO ON THE REDEVELOPMENT STANDPOINT OR EXTENSIONS OF BUSINESSES CURRENTLY IN OUR ZONING CODE, WE ONLY HAVE A CERTAIN LEVEL OF SITE PLAN, WHICH IS THE SITE PLAN, AND IT IS AN EXTENSIVE REVIEW PROCESS THAT REQUIRES A HOLISTIC LENS OF AN ENTIRE SITE.
IT WILL NOT BE PROJECT SPECIFIC OR LOCATION SPECIFIC AT THAT POINT.
SO FOR INSTANCE, A GREAT EXAMPLE IS THIS CAMPUS THAT WE'RE ON RIGHT NOW.
ANYTHING WE WERE TO DO TO THIS CAMPUS WOULD REQUIRE US TO SHOW THE ENTIRE CAMPUS EVERY SINGLE TIME.
WHAT THIS AMENDMENT BEFORE YOU ALLOWS FOR IS MINOR SITE PLANS AND SITE PLAN MODIFICATIONS.
AND THROUGH THOSE TWO PATHS, IF YOU HAVE A SMALLER SCALE DEVELOPMENT THAT IS NOT GOING TO BE AS INFLUENTIAL ACROSS THE BOARD ON THE PROPERTY, YOU CAN BE MORE PROJECT SPECIFIC IN THE TYPES OF DETAILS THAT YOU'RE PROVIDING AS LONG AS YOU'RE EXTRAPOLATING FROM THE ORIGINAL DETAILS THAT YOU HAD BEFOREHAND.
SO FOR INSTANCE, IF WE WERE TO BUILD ANOTHER BUILDING ON THIS CAMPUS, WE WOULD THEN TAKE THE DATA FROM THE OLD SITE PLAN, PUT IT ON THE NEW PLAN, BUT ONLY HAVE THEM CONCENTRATE ON WHERE THEY'RE DEVELOPING. FOR THE MOST PART, IT ALLOWS FOR THE DEVELOPERS TO HAVE LESS BURDEN IN TRYING TO HAVE THE WHOLE PROPERTY SURVEYED.
SO AGAIN, CONCENTRATING ON THE PROJECT SPECIFIC AREA, THEY CAN UPDATE THEIR PROJECTS TO CODE IN THOSE AREAS WITHOUT BEING OVEREXTENDED AND POTENTIALLY DISMISSING BUSINESSES THROUGHOUT THE AREA.
SO THIS IS REALLY FOR A REDEVELOPMENT AND EXTENDED DEVELOPMENT AREA.
THANK YOU, SIR. ANY QUESTIONS? COUNCIL I WANT TO COMMEND YOU ON THE HARD WORK THAT YOU'VE DONE ON THIS PROJECT.
THANK YOU, SIR. KNOW, IT ALSO ALLEVIATES, YOU KNOW, YOU COULD STREAMLINE IT.
YEAH, IT STREAMLINES IT BOTH FOR THE CITY AS WELL AS FOR THE DEVELOPERS.
THE CITY, FOR THE MOST PART, GETS TO IDENTIFY WHAT REVIEWERS ARE GOING TO BE AT WHAT LEVEL, RATHER THAN SPENDING ALL OF OUR REVIEWERS ON EVERY SINGLE PLAN, WHICH IS A HUGE BENEFIT FOR US.
ANY FURTHER QUESTIONS? COUNCIL? ANYONE WISH TO SPEAK FOR OR AGAINST THIS ITEM.
SEEING NONE. I'M CLOSING THE PUBLIC HEARING AND ASKING FOR A MOTION.
SO MOVED. SECOND, GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ALL IN FAVOR. SIGNIFY BY SAYING AYE.
MS.. SMITH. ORDNANCE 20 2372 AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA.
AMENDING THE CODE OF ORDINANCES TITLE 17 LAND DEVELOPMENT CODE CHAPTER 185 ZONING CODE SUBCHAPTER SUPPLEMENTARY DISTRICT REGULATIONS BY INCLUDING PROVISIONS FOR OUTDOOR DINING PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT.
OPENING UP THE PUBLIC HEARING AND ASKING MADAM SHERMAN GUESS TO CALL UP DR.
J. YOU SHOULD HAVE JUST SAID UP FRONT, SIR.
YOU GOT YOUR STEPS IN, THOUGH? THOUGHT ABOUT IT.
TOO LATE. I NEED MY STEPS TODAY.
[01:00:08]
IT ALSO DOES ALLOW FOR THE EXISTING OUTDOOR DINING AREAS TO BE CONSIDERED NONCONFORMING AS WELL.SO THEY WILL BE PERMITTED THROUGHOUT THE CITY.
IT MAKES IT A LOT EASIER FOR US TO ATTRACT MORE UNIQUE INTERDISCURSIVE DEVELOPMENT.
FOR INSTANCE, PEOPLE IN SHOPPING CENTERS ARE NOW GOING TO BE OUTSIDE.
YEAH, I LIKE THAT YOU CONSIDERED EVERYONE ELSE PRIOR IS GRANDFATHERED IN.
23. ANY QUESTIONS? COUNCIL? JUST WANTED TO MAKE A COMMENT ON THAT.
I THINK THAT THAT IS BRILLIANT.
THAT'S A GREAT FOR THOUGHT, IF I MAY SAY.
ESPECIALLY OUR EXPERIENCE WITH COVID, RIGHT? INDOOR ENCLOSED.
SO THAT'S THE DIRECTION AT, YOU KNOW, ON A NATIONAL LEVEL THAT EVERYBODY IS GOING TO.
AND I THINK IT'S IT'S TIMING IS GREAT.
I THINK IT'S A VERY SMART, SMART DECISION TO GO IN THAT DIRECTION.
SO IT'LL BE A LOT MORE SIMPLE PROCESS FOR THEM.
THANK YOU. ANYONE WISH TO SPEAK FOR OR AGAINST THIS ITEM? SEEING NONE. I'M CLOSING THE PUBLIC HEARING AND ASKING FOR A MOTION SO MOVED.
GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ALL IN FAVOR. SIGNIFY BY SAYING AYE.
FOUR ZERO. WE ARE NOW ON CONSENT.
[CONSENT AGENDA]
DEPUTY MAYOR. AND NO CONSENT WAS PULLED.DOES COUNCIL WISH TO PULL ANY CONSENT ITEMS? SEEING NONE.
MOTION TO APPROVE CONSENT AGENDA AS PRESENTED.
SECOND GOT A MOTION BY DEPUTY MAYOR FELIX.
SECONDED BY COUNCILMAN JOHNSON.
ANY DISCUSSION, GENTLEMEN? ALL IN FAVOR. SIGNIFY BY SAYING AYE.
[NEW BUSINESS ( Part 2 of 2 )]
ITEM NUMBER TWO.AN ORDINANCE OF THE CITY OF PALM BAY.
YES, MA'AM. BREVARD COUNTY, FLORIDA AMENDING THE CODE OF ORDINANCES TITLE 17 LAND DEVELOPMENT.
AN ORDINANCE OF THE CITY OF PALM BAY.
BREVARD COUNTY, FLORIDA AMENDING THE CODE OF ORDINANCES TITLE FIVE LEGISLATIVE CHAPTER 52 BOARDS SUBCHAPTER CITIZENS BUDGET ADVISORY BOARD BY REPEALING THE SUBCHAPTER IN ITS ENTIRETY, PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT.
I'M GOING TO DEFER TO COUNCILMAN FOSTER.
THANK YOU, MAYOR. UM, THIS IS AN ITEM I BROUGHT UP LAST YEAR.
AND SOME RESEARCH WAS DONE AND I MONITORED THE WARD.
WHEN THEY HAD MEETINGS, THEY DIDN'T HAVE REALLY TOO MUCH MEETINGS OVER THE LAST COUPLE OF MONTHS.
THEY HAD ONE LAST LAST MONTH AND I MONITOR THAT MEETING AND A STUDENT GET ANYTHING OUT OF THE BOARD THAT COULD HELP ME WITH MY BUDGET REVIEW OF THE CITY BUDGET.
I DIDN'T NEVER GOT ANY RECOMMENDATIONS SINCE I'VE BEEN ON COUNCIL.
TO. INCREASE THE BUDGET OR LOWER THE BUDGET.
PEOPLE MAKE PUBLIC COMMENTS, BUT THAT'S ABOUT IT.
I THINK OUR BUDGET PROCESS, THERE'S PLENTY OF OPPORTUNITY FOR THE CITIZENS OF PALM BAY CAN WEIGH IN ON AND WE'RE GOING THROUGH THAT THAT THAT.
MAXIM, MY COLLEAGUE, TO JOIN ME AND REDUCING A BOARD OFF THE CITY CHARTER OF THE.
[01:05:09]
UM. THE CITY AGENDA THAT WE HAVE PLANNING OF THE BOARDS.ALL RIGHT. THANK YOU. THANK YOU, COUNCILMAN.
ANY QUESTIONS? COUNCILMAN. OKAY.
ANY QUESTIONS? ANY QUESTIONS? FOR COUNCILMAN FOSTER? NO, SIR. THANK YOU.
FOSTER. ANY SPEAKER CARDS ON THIS? DEPUTY MAYOR. MR. BILL BATTEN. BILL BATTEN, 586 OCEAN SPRAY STREET SOUTHWEST.
NOVEMBER OF 2022, THE RESIDENTS VOTED NO PAY INCREASE FOR COUNCIL.
THEN ON DECEMBER 6TH OF 2022, YOU GAVE YOURSELVES A $500 A MONTH FOR THE MAYOR AND $400 A MONTH FOR COUNCIL MEMBERS TAX FREE EXPENSE ACCOUNTS.
THAT'S ON A MONTHLY BASIS NOW.
COUNCILMAN FOSTER WANTS TO DISBAND THE NON-PAID VOLUNTEERS THAT INVEST THEIR TIME AND ENERGY TO HELP THE CITY MAINTAIN THE BUDGET. COUNCILMAN FOSTER HAS NOT BEEN IN CHAMBERS SINCE THE END OF FEBRUARY.
YET WE AS CITY TAXPAYERS ARE PAYING FOR AN ELECTED OFFICIAL THAT CANNOT BE PRESENT AND ONLY ON THE PHONE PART OF THE TIME TO CONDUCT CITY BUSINESS. I THINK IT'S TIME FOR ME TO RUN FOR SEAT FOUR.
AND IF I WIN, JUST CALL IN FOR COUNCIL MEETINGS.
LET'S RESPECT AND APPRECIATE ALL THE VOLUNTEERS THAT TRY TO MAKE THIS CITY A SUCCESS.
THANK YOU. NEXT SPEAKER IS SUSAN CONNOLLY.
SUSAN CONLEY, 3901 DIXIE HIGHWAY NORTHEAST.
I'M ON THE BUDGET ADVISORY BOARD, CITIZENS BUDGET ADVISORY BOARD.
I'VE BEEN THERE OVER TWO YEARS AND I WAS AT THE MEETING WHERE COUNCILMAN FOSTER FIRST WAS INDICATING THAT HE WAS THINKING OF DISSOLVING THIS BOARD.
AND AFTER THAT THAT BECAME A TOPIC OF DISCUSSION AMONGST US ON THE BOARD AND WE LOOKED AT WHAT IS OUR PURPOSE FOR EXISTING AND WE AUTHORIZED RANDALL OLSZEWSKI, WHO WAS OUR OUR HEAD TO COME BEFORE COUNCIL FIRST TO WRITE COUNCIL A LETTER REQUESTING HOW CAN WE SERVE IN A MORE EFFICIENT WAY? AND THAT LETTER WAS NOT ANSWERED.
AND RANDALL OLSZEWSKI DID COME BEFORE AND ASKED PUBLICLY AND STILL THERE WAS NO RESPONSE THAT CAME BACK. SO I WANT TO OBJECT TO THE WAY THIS IS BEING DONE. THE DISSOLUTION, WITHOUT A THOROUGH DISCUSSION OF HOW CAN WE UTILIZE THIS BOARD FROM A CITIZENS PARTICIPATION VIEW? WE NEED TO KNOW MORE ABOUT THE BUDGET.
I THINK THE COUNCIL NEEDS TO KNOW THAT.
THE CITIZENS NEED TO UNDERSTAND THE BUDGET.
THERE NEEDS TO BE A BRIDGE AND A GAP, YOU KNOW, TO BRIDGE THIS GAP.
AND I THINK THIS COMMITTEE CAN THIS BOARD CAN DO THAT.
IN FACT, WE DO IT JUST NATURALLY AS WE LEARN.
WE HAVE IMPACT IN THE COMMUNITIES AND THE NEIGHBORHOODS THAT WE LIVE IN.
AND IT'S NOT EASY UNDERSTANDING THE BUDGET.
SO I WOULD LIKE TO SAY, JUST IN GENERAL, I BELIEVE THAT CITIZENS NEED TO TAKE A MORE ACTIVE ROLE AND THAT THIS IS ONE WAY.
AND BEFORE DISSOLVING THIS, I WOULD REQUEST THAT THERE BE A DISCUSSION ON HOW TO KEEP THIS BOARD AND UTILIZE IT.
MAYOR, IF I MAY ASK A QUESTION.
MISS CONNOLLY, HOW LONG HAVE YOU BEEN SERVING ON THAT BOARD?
[01:10:01]
OVER TWO AND A HALF YEARS.YOU MAY HAVE BEEN MY APPOINTMENT, RIGHT? YES, I BELIEVE SO.
CERTAINLY. I'VE YOU YOUR TIME ON THAT BOARD.
I'VE DO YOU THINK, BESIDES YOUR OWN PERSONAL KNOWLEDGE THAT YOU GAIN IN YOUR PROCESS AND OR BUDGET, HAVE YOU SEEN YOUR SERVICE ON THAT BOARD SERVE THE CITY AS A WHOLE? YES.
DO YOU THINK YOU WOULD DO WELL WITH THAT? YES. BECAUSE I AM.
I TALK ABOUT THE MATTERS OF THE CITY.
SO, YES, WHAT I LEARN AND KNOW.
AND IN FACT, THERE WAS A PROGRAM THAT THE ADVISORY BOARD DID LAST DECEMBER OF OUR OWN CREATION, WHERE WE IN DECEMBER HAD LOOKED AT THE CITIZENS COME AND LOOK AT THEIR PROPERTY TAX BILLS WHERE WE WENT LINE BY LINE.
IT WAS ONE OF THE BEST MEETINGS.
AND IT WAS, YOU KNOW, THERE'S MEANT A LOT OF DISCUSSION ABOUT THE 3% CAP AND HELPING PEOPLE UNDERSTAND THAT, BUT ALSO UNDERSTANDING THAT DECISIONS THAT YOU MAKE DO IMPACT THE PROPERTY TAXES.
SO THIS IS WHAT WE CAN DO AND TALK IN CITIZEN VOICES AND.
SO THANK YOU FOR THE QUESTION.
THANK YOU. THANK YOU FOR YOUR ANSWER.
THANK YOU, MA'AM. NEXT SPEAKER.
NATHAN WHITE, 1301 SEABURY STREET SOUTHWEST.
IT WAS NOVEMBER OF 2022 WHEN THIS MOTION WAS BROUGHT BEFORE THE COUNCIL LESS THAN A YEAR AGO.
I'M NOT SURE IF THAT'S PROPER PROCEDURE OR NOT, CONSIDERING IT WAS VOTED DOWN AT THE TIME.
THE SUGGESTION WAS MADE TO AMEND IT TO WHICH BOARDS IT WAS TALKING ABOUT.
FOSTER. COUNCILMAN. FOSTER DID NOT WANT TO DO THAT AND IT WAS VOTED DOWN.
IT WAS AT THAT MEETING THAT AFTER NINE MINUTES OF PUBLIC COMMENTS UNANIMOUSLY AGAINST DISSOLVING THIS FINANCE, THE FINANCE BOARD BUDGET ADVISORY BOARD, FOLLOWED BY SOME COMMENTS FROM COUNCIL, INCLUDING FROM MAYOR MEDINA AT THE TIME STATING HIS.
OPPOSITION TO DISSOLVING THE BOARD.
ALL SPECIFICALLY THE CITIZENS BUDGET ADVISORY BOARD.
SO I AM AWARE THAT COUNCILMAN FOSTER DOES NOT VALUE THIS BOARD.
BUT THE CITY VALUES THIS BOARD.
THE FULL ROSTER OF MEMBERS VALUES THIS BOARD.
SO IT'S AN EASY MISTAKE TO MAKE.
BUT IT EXISTS FOR THE CITIZENS.
IT IS A FANTASTIC ENVIRONMENT FOR LEARNING MORE ABOUT THE BUDGET, FOR HEALTHY DISCUSSION AND DEBATE, AND THEN IN THE END, IDEALLY FOR PROVIDING AN ADVISORY, SERVING IN AN ADVISORY CAPACITY TO THE COUNCIL.
IN ADDITION TO THE LETTER THAT WAS MENTIONED, WE WERE TOLD THAT AT THE LAST MEETING THAT IT HAD BEEN REQUESTED OF US TO TALK ABOUT THE MILLAGE RATE.
WE DISCUSSED IT AT LENGTH, HELD THREE VOTES BECAUSE WE VOTED TO.
I WE VOTED TO KEEP THE MILLAGE RATE THE SAME, AND THAT VOTE FAILED BY ONE VOTE.
AND THEN WE VOTED TO SET IT AT THE.
CAP RATE, AND THAT VOTE ALSO FAILED BY ONE.
AND AFTER EXTENDED DISCUSSION, WE VOTED, I BELIEVE IT WAS FORGIVE ME IF I'M INCORRECT.
AND WE ALSO MOTIONED SPECIFICALLY TO HAVE THE COUNSEL INFORMED OF ALL OF THOSE VOTES SO THAT YOU WOULD HAVE A CLEAR PICTURE OF WHERE THE BOARD STOOD, NOT JUST WITH THE ONE VOTE THAT PASSED, BUT UNDERSTANDING THAT WE DID CALL VOTES ON BOTH OF THE OTHERS AND THEY DID NOT PASS.
ONLY THE ONE IN THE MIDDLE DID TO PROVIDE THAT PICTURE.
[01:15:01]
THIS BOARD HAS VALUE.MAYOR, IT IS CONCLUDE PUBLIC COMMENT.
SO I'LL NEED A MOTION FOR DISCUSSION.
I'LL NEED A MOTION. COUNCILMAN FOSTER WILL MOVE THE MOTION FOR DISCUSSION.
DID YOU WANT TO ADD ANYTHING? YEAH, I'D LIKE TO ADD SOMETHING.
YOU KNOW, THEY'VE BEEN PERSONALLY ATTACKED BY MR. BILL BARTON BECAUSE I'M NOT AT A COUNCIL MEETING.
AND THE MONDAY THE COUNCIL MEETING BECAUSE OF MY HEALTH.
AS FOR THIS YEAR, I SPENT 5 OR 4 MONTHS IN THE HOSPITAL.
IN THREE DIFFERENT HOSPITALS LAST WEEK.
I WAS LAST WEEK, THE WEEK BEFORE LAST, I SPENT A WEEK IN A WEEK IN TWO DAYS IN PALM BAY HOSPITAL.
BECAUSE I HAD A DIABETIC SHOCK.
WHAT? NEARLY DIED IN MY HOME TWICE.
I HAVE SOME SERIOUS HEALTH ISSUES THAT I'M WORKING AND I'M GETTING BETTER.
AND WHEN I'M ABLE TO COME TO A COUNCIL MEETING.
DON'T PASS OUT AND STOP A COUNCIL MEETING BECAUSE I'M GOING TO A DIABETIC SHOT AND I WILL SHOW UP.
I'M ABLE TO WALK AND USE A WHEELCHAIR.
WELL, I'M DOING MY BEST I CAN AS MY POSITION.
I GOT ELECTED TO SERVE FOUR YEARS.
I'M GOING TO SERVE FOUR YEARS.
I DISCUSS THINGS WITH THE CITY MANAGER.
THE CITY MANAGER TO SUZANNE AND ITEMS COME UP.
SO I'VE BEEN ON. I'VE BEEN ON TOP OF MY GAME, DOING MY JOB AS A CITY COUNCILMAN.
LET'S SAY I'M NOT SHOWING UP BECAUSE I HAVE NO DESIRE TO SHOW UP.
IN TO SERVE OUT MY TERM, AND I SERVED MY DUTY AS A MILITARY PERSONNEL.
I SERVED MY DUTY AS A AS A US MARSHAL.
I SERVED MY DUTY AS A COUNCILMAN AND I'M GOING TO GIVE IT 100%.
SO THAT'S ALL I'M GOING TO SAY ABOUT THAT.
UM, NUMBER TWO, I APPRECIATE EVERYBODY WHO SERVED ON BOARD.
I SERVED ON DIFFERENT BOARDS IN THE CITY, SO I APPRECIATE THE TIME THEY TAKE AND THEY VOLUNTEER AND WE STILL GOT A LOT OF BOARDS, VACANCIES TO BE FILLED AND BY DISSOLVING THIS CITY BUDGET ADVISORY BOARD.
THE CITIZENS OF SUZANNE AND BURAK HAD AN OPPORTUNITY TO SERVE ON OTHER BOARDS IN THE CITY.
I HAVE FILLED MY VACANCY ON THAT BOARD.
I HAVE APPOINTED PEOPLE TO SERVE ON THAT BOARD.
NOT THAT I DON'T EVALUATE THE BOARD.
THE BOARD HASN'T GIVEN ME ANY VALUE TO MY KNOWLEDGE OF THE BUDGET.
WE HAVE A BUDGET THAT WE GO THROUGH EVERY YEAR.
THE CITIZENS COME ASKING QUESTION, EMAIL ME OR THE CITY MANAGER OR THE OR THE CITY OF THE MAYOR OR THE DEPUTY MAYOR OR OTHER COUNCILMAN ABOUT A BUDGET ITEM.
THE CITIZEN DID MAKE A DECISION ABOUT THE BUDGET.
THEY MAINTAIN THAT WE KEEP THE CAP.
WHICH HAS EVERYTHING TO DO WITH THE BUDGET.
SO. BUT THIS THIS ADVISORY BOARD IS IN MY OPINION, THIS IS MY OPINION
[01:20:02]
IS CAUSING CITY HOURS.IT'S CLOSING TIME OF CITY STAFF.
AND WE'RE NOT GETTING ANYTHING THAT WE REALLY COULD GET FROM STAFF.
THE BUDGET. THAT'S WHAT WE'RE HERE FOR.
THE CONTINUOUS OF GOVERNMENT OF THE CITY OF PALM BAY.
AND I'M GOING TO CONTINUE TO DO THAT.
ELIMINATE BUREAUCRACY AND RED TAPE AND FREE UP OUR CITY STAFF TO DO THEIR JOB.
UM, MY. I WASN'T LOOKING AT IT FROM THE STANDPOINT OF COUNCILMAN FOSTER.
MY. MY STANDPOINT WAS MORE SO.
DEPUTY MAYOR, THAT THE CBAP HELD, THERE WAS NO RESIDENTS, THERE WAS NO CITIZENS.
BUT MY MAIN ISSUE IS WITH MISINFORMING AND PUTTING OUT FALSE INFORMATION REGARDING, YOU KNOW, CALLING THE CITY, SAYING IT'S FACING FINANCIAL CATASTROPHE AND THAT WE'RE NOT ABLE TO ADOPT A BALANCED BUDGET.
UM, WE HAVE TO ADOPT A BALANCED BUDGET BY FLORIDA STATE STATUTE.
THAT'S WHY I ASKED THE I ALREADY KNEW THE QUESTION.
SO TO PUT OUT FALSE INFORMATION OR MISINFORMATION LIKE THAT.
USUALLY I STAY QUIET BECAUSE EVERYBODY HAS THE RIGHT TO SPEAK, YOU KNOW, SAY WHAT THEY HAVE TO SAY.
BUT WHEN STAFF IS WORKING THEIR HARDEST TO PUT OUT THE RIGHT INFORMATION TO THE RESIDENTS, BUT FOR OTHERS TO TAKE THAT INFORMATION AND MANIPULATE IT, I'M NOT GOING TO STAND YOU KNOW, I'M NOT GOING TO STAY SILENT ON THAT.
SO THAT'S WHY I'LL BE SUPPORTING MR. COUNCILMAN FOSTER'S MOTION.
OKAY. THANK YOU. COUNCILMAN JOHNSON.
THAT TO ME IS LIKE, WELL, LET ME JUST SHARE MY THOUGHTS, RIGHT? LET ME SHARE MY PERSPECTIVE, RIGHT? THE VERY FIRST THING I HAVE TO SHARE IS WE'RE ALL PART OF PUBLIC ENGAGEMENT.
WE WANT OUR PUBLIC TO BE ENGAGED.
WE WE NEED OUR PUBLIC TO BE ENGAGED.
AND AND MISS SUSAN CONNOLLY, SHE NAILED IT.
SHE SAID THERE WAS A LETTER THAT CAME TO US.
WE SHOULD GIVE THEM A DIRECTION.
WHAT WE SHOULD BE GIVING THEM IS SAYING STAY WITHIN THESE THESE BORDERS OR LOOK AT WAYS THAT WE CAN STAY WITHIN THE CAP, LOOK AT OTHER CITIES. HOW WOULD THEY STAY WITHIN THE 3% CAP? BUT WE NEED TO GIVE THEM THAT TYPE OF DIRECTION.
RIGHT NOW, THEY'RE NOT GETTING ANY DIRECTION FROM US.
AND I SHARED THIS BEFORE IN THE LAST TIME THIS CAME UP.
THIS IS PART OF OUR DEMOCRATIC REPUBLIC PROCESS.
WE'RE SAYING, OKAY, WE WANT YOU TO ENGAGE WITH US, BUT THEN.
SO WE'RE GOING TO WE'RE GOING TO DISBAND THIS BOARD FOR WHATEVER REASON.
IT'S LIKE THROWING THE BABY OUT WITH THE BATH WATER.
I DON'T SUPPORT DISBANDING THE BOARD BECAUSE I LOVE TO HAVE THE PUBLIC ENGAGE.
I UNDERSTAND WHERE YOU'RE COMING FROM.
I UNDERSTAND WHERE COUNCILMAN FOSTER IS COMING FROM.
BUT FROM MY PERSPECTIVE, I JUST LOVE TO SEE THE COMMUNITY ENGAGE, GIVING THEM FURTHER DIRECTION.
IF THEY CAN COMMUNICATE FURTHER WITH OUR WITH OUR PUBLIC, I THINK THAT'S A PLUS.
I THINK THAT WOULD WOULD BETTER HONE IN ON.
WHAT THAT BOARD REALLY REPRESENTS.
NOW, GRANTED, IF THIS COUNCIL SO CHOOSE TO SAY, HEY, WE SHOULD HAVE A CPA AS PART OF IT, THEN MAYBE WE COULD AMEND THAT BOARD. MAYBE WE COULD USE IT TO THAT.
MAYBE WE CAN, YOU KNOW, HONE IN THE BOARD TO INCREASE ITS DYNAMIC.
BUT I STILL BELIEVE IN IN OUR COMMUNITY ENGAGING WITH US AND PROVIDING VALUABLE EFFORT.
[01:25:04]
SO BECAUSE OF THOSE REASONS, I CAN'T SUPPORT DISBANDING THE BOARD.THIS IS ABOUT PUBLIC ENGAGEMENT.
WE WORK FOR THE PEOPLE AND I'D LOVE FOR THEM TO CONTINUE TO BE ENGAGED.
THANK YOU, MAYOR. I'M A BIT TORN ON ON THIS ITEM.
IF YOU RECALL THE LAST TIME THIS ITEM CAME BEFORE US.
SOMEWHAT DIDN'T SUPPORT THE ITEM, BUT LOOKING AT WHAT TRANSPIRED OVER THE LAST FEW MONTHS AND TO SOME DEGREE COUNCILMAN JOHNSON SAID IT.
WE KNOW ACTIVE MEMBERS OF THIS BOARD OUT THERE IN THE COMMUNITY SPREADING FALSE INFORMATION CONTRARY TO THE TRUTH. NOT ONLY ARE THE COMPANY THAT AUDIT OR CITY OR FINANCIAL FAIR SAY OUR RATING SAY CONTRARY THAN WHAT'S OUT THERE IN THE COMMUNITY GOT SOME SORT OF PETITION, SOME SORT OF MOVEMENT OUT THERE SPREADING FALSE INFORMATION, OBVIOUSLY. WE KNOW WHY.
BUT AGAIN, THIS IS THE SAME INDIVIDUALS OR INDIVIDUALS SITTING HERE AND ADVOCATING ON ON THAT BOARD. SO I'VE ISSUES WITH THAT.
SHERMAN, CAN I BRING THE LARRY? YES, LARRY WICHOWSKI, OUR FINANCE DIRECTOR.
SO AND THAT'S WHERE I HAVE A PROBLEM WITH AND I TRULY BELIEVE TAKE IT FROM A GUY THAT SERVED.
AND THAT'S WHERE THAT IS A QUESTION FOR YOU, SIR.
YES, SIR. WHAT IS OUR PROCESS? IF A CITIZEN WANTS TO BE INFORMED OR EDUCATE ABOUT OUR PROCESS OR OUR FINANCIAL, WHAT'S THE PROCESS CURRENTLY IN PLACE? SHOULD ANYONE.
WANTS TO GET INFORMATION ABOUT OUR BUDGET.
CURRENTLY, ANYBODY CAN CALL THE FINANCE DEPARTMENT AND WE ARE MORE THAN WILLING TO SIT DOWN AND HAVE A DISCUSSION FACE TO FACE AND DISCUSS ANYTHING ABOUT THE BUDGET FINANCE DEBT, ANYTHING ABOUT THE CITY.
SO OUR CITY FINANCE DEPARTMENT ARE TOTALLY HAVE AN OPEN DOOR POLICY FOR OUR CITIZENS.
WE HAVE OFFERED THAT SINCE THE DAY I'VE BEEN HERE.
HAVE YOU EVER HAVE, YOU KNOW, QUESTIONED ANYBODY COME TO YOU, ANY OF THE MEMBER OF THE BOARD COME TO YOU? AND ON ONE ON ONE GET BESIDES THE PUBLIC SETTING, HAVE ENGAGEMENT WITH YOU IN THAT SENSE? AT MEETINGS IT HAS BEEN PRESENTED ASKING THAT THEY CAN COME AND WE CAN MEET WITH THEM ONE ON ONE BECAUSE OF COURSE WE CAN'T MEET THEM.
AS A WHOLE, AND NOBODY HAS TAKEN US UP ON THAT.
THANK YOU, SIR. THAT CONCLUDES MY QUESTION.
THANK YOU, LARRY. SURE. I'M GOOD.
I JUST WANTED TO MAKE SURE LARRY ADDRESSED THAT.
WE HAVE A PROCESS WHERE ANY CITIZEN AT ANY GIVEN TIME CAN BE INFORMED.
BUT OFTEN WHAT WE SEE IN THIS BOARD I'VE WATCHED 2.5 HOURS.
IT'S REALLY IT'S A PLATFORM FOR I DON'T KNOW.
AND AND I BELIEVE I WANT TO BELIEVE I BELIEVE THERE'S VALUE IN CITIZENS SERVING.
BUT THIS PARTICULAR BOARD, THE PRIMARY PURPOSE OF A BOARD ADVISORY BOARD IS TO ADVISE.
DIRECTOR, DEPARTMENT, HEAD AND COUNCIL.
WE HAVEN'T GET MUCH WILLY OUT OF THAT BOARD, PARTICULARLY SINCE SINCE I KNOW THIS BOARD EXISTS.
AND AGAIN, THAT JUST MAY BE MY OPINION.
I DON'T KNOW IF WE HAVE GOT MUCH OUT OF THAT BOARD, BUT YET WE UTILIZE OUR RESOURCES.
UM, COUNTLESS HOURS OF STAFF PREPARING.
AND SO I SAID ALL THAT TO SAY THIS.
SOLD ON THE VALUE OF THIS BOARD AT THIS TIME AT THE CURRENT STRUCTURE.
I DON'T I DON'T SEE THE VALUE.
I TRULY BELIEVE IN SERVICE AND I'M ONE TO ADVOCATE FOR MANY, MANY YEARS AND I'VE LIVED IT.
[01:30:02]
WE'RE NOT TALKING ABOUT OTHER BOARDS, BUT THIS PARTICULAR BOARD.SUPPORT THE CONTINUATION OF THIS WAR AT THIS TIME.
AND WHAT I'M ALSO HEARING IS THAT YOU WOULD.
THE WAY THE CURRENT STATE, YOU DON'T WANT TO CONTINUE.
SO THE SUGGESTION THAT I MADE ABOUT GIVING DIRECTION TO THE BOARD AND ITEMIZING THOSE DIRECTIONS, YOU WOULD NOT CONSIDER YOU JUST WANT TO DISBAND THE BOARD.
TO STOP THE BOARD UNTIL WE CAN RESTRUCTURE THE TWO.
WHAT DO WE GET AS COUNCIL? BECAUSE STATE STATUTE PROVIDE THAT WE ONLY HAVE ONE BOARD.
PLANNING AND ZONING. THAT'S ALL.
THAT'S ALL. SO IN TERMS OF CITIZENS HAVE TONS OF OPPORTUNITY TO TO ENGAGE.
SO THE IDEA I DON'T QUITE BUY BUT THE IDEA OF OF, YOU KNOW, ENGAGEMENT AND SO ON OR LEARNING, YOU CAN LEARN, YOU CAN STILL LEARN ABOUT YOUR BUDGET, YOUR OUR BUDGET OR PROCESS.
YOU KNOW, THESE INDIVIDUAL, IF THEY CARE, I'M PRETTY SURE THEY DO CARE.
I WOULDN'T SAY IF I BELIEVE EVERY SINGLE ONE OF THEM CARE, BUT THERE'S A WAY.
IF YOU WANT TO CONTINUE LEARNING AND CONTINUE TO ENGAGE, YOU CAN DO THAT.
UM. I WOULD SUPPORT SOME SORT OF STRUCTURE.
CITY MANAGER LET'S LOOK AT EFFECTIVE WAY TO HAVE A BOARD.
BUT RIGHT NOW I DON'T THINK IT'S WORKING THE.
I LIKE YOUR IDEA. I LIKE WHAT YOU WERE SAYING.
AND I'LL START BY SAYING, I REALLY BELIEVE IN THE PUBLIC ENGAGEMENT, RIGHT? I'M NOT GOING TO SUPPORT THIS.
AND THEN I WANTED TO ADDRESS SOME COMMENTS THAT WERE MADE HERE.
I WANT TO I WANT TO PUT THAT ON THE RECORD.
AND I WANT TO GO ON THE RECORD AS SAYING I NEVER SUPPORTED THAT.
UM, NOT ONLY DID I NOT SUPPORT IT, I REFUSED TO GET THAT THAT STIPEND AS WELL.
I WANT TO MAKE THAT PERFECTLY CLEAR.
I ALWAYS SAID IT'S GOOD TO PASS IT ON TO ANOTHER TRUST TO DO SOMETHING LIKE THAT.
IN PARTICULAR AFTER THE THE PEOPLE VOTED AGAINST IT THAT, THAT.
SO I HAD TO SAY SAY THAT I'LL CONCLUDE WITH I THINK WE'RE GOING DOWN A WRONG PATH HERE AND I SAY THIS GENTLEMAN WITH WITH A VIGOR AND A PASSION BECAUSE WE WORK FOR THE PEOPLE AND WE HAVE ACTIVE BOARD MEMBERS.
OKAY. THERE MIGHT HAVE BEEN SOME COMMENTS THAT WERE MADE.
AT THE SAME TIME, THAT'S TO ME, THAT'S LIKE GETTING RID OF THE BABY WITH THE BATHWATER.
WITH THAT, I'M GOING TO CALL THE QUESTION.
I GOT A MOTION BY COUNCILMAN FOSTER SECONDED BY COUNCILMAN JOHNSON.
ALL IN FAVOR, SIGNIFY BY SAYING AYE.
SO I WANT A ROLL CALL, MISS TERRY.
DEPUTY MAYOR FELIX COUNCILMAN JOHNSON.
[COUNCIL REPORTS]
NO REPORT AT THIS TIME THERE.I WAS LOOKING FOR NANCY OR DR.
JESSE. THEY BOTH LEFT, BUT I SPOKE TO BOTH OF THEM AS WELL AS OUR CITY MANAGER.
[01:35:08]
CITY INITIATED REZONINGS.WHEN WE LOOK AT CERTAIN AREAS OF OUR CITY.
OUR MAYOR YOU'VE WRITTEN LETTERS TO ELON MUSK AND OTHER DEVELOPERS.
LIKE LIGHT. INDUSTRIAL OR HEAVY INDUSTRIAL OR FLEX USE.
THIS IS SOMETHING I THINK WE AS A COUNCIL AND GROWTH MANAGEMENT WITH ECONOMIC DEVELOPMENT TEAM WORKING COLLECTIVELY WITH OUR CITY MANAGER'S OFFICE, I THINK THAT CAN BE A GOOD STEP IN THE RIGHT DIRECTION FOR US.
UM, WITH US JUST NOW FINALIZING THE PLAN, I'M ON BOARD WITH THAT AND THAT'S THAT'S EXACTLY WHAT WE SHOULD BE DOING IS SEEING HOW THE FUTURE WE'RE BUILDING, THE FUTURE OF THIS CITY.
RIGHT. AND SO COMMERCIAL IS CRITICAL.
YES. AND THAT'S HOW YOU'RE GOING TO GET THESE BIG BUSINESSES TO LISTEN RIGHT NOW.
AND THAT'S GOING TO BE PART OF WHAT I WANTED TO BRING.
YEAH. WHAT WE NEED TO TO DO, BUT I'M COUNCILMAN JOHNSON HAS GOT MY FULL SUPPORT WITH THAT IDEOLOGY.
WE'RE GOOD. UH, TWO MORE THINGS, MAYOR.
UM, SECOND, I WOULD LIKE FOR US TO LOOK AT.
THE REASON WHY I SAY THAT WE SPOKE EARLIER ABOUT THE LIVE LOCAL.
SO I WANTED TO MAKE IT SPECIFICALLY FOR RESIDENTIALLY ZONED AREA AREAS ALREADY.
SO WHAT I'M HEARING IS YOU WANT TO TRY AND GIVE INCENTIVES.
YES. OR FOR IN REGARDS TO BUILDING BUILDING FEE REDUCTION.
SO I WAS JUST LOOKING AT IT FROM THE AFFORDABLE HOUSING STANDPOINT TO GIVE THEM.
THE REDUCTION, KIND OF LIKE WHAT WE DID WITH LOW IMPACT DEVELOPMENT.
UM, SO, LIKE, UH, NANCY'S NOT HERE, YOU KNOW? GO AHEAD. YEAH.
OKAY. I THINK WHAT WE'RE TALKING ABOUT IS WE ALREADY HAVE A PROGRAM FOR COMMERCIAL INVESTMENT IN THE CITY TO PROVIDE BASED ON DIFFERENT CRITERIA REDUCTION TO BUILDING FEE BUILDING PERMIT FEES TO INCENTIVIZE COMMERCIAL DEVELOPMENT IN THE CITY.
SO IT SOUNDS LIKE IT'D BE A COMPARABLE TYPE PROGRAM, BUT FOR AFFORDABLE HOUSING.
AND I'LL TELL YOU WHY. BECAUSE WHEN YOU WHEN YOU START THINKING ABOUT HAVING BUSINESSES INVEST, I DON'T WANT TO CREATE THESE DEVELOPMENTS THAT IS GOING TO SPECIFICALLY BE LOW INCOME HOUSING.
RIGHT. SO WHAT ARE WE DEVELOPING? ARE WE POTENTIALLY DEVELOPING LIKE IN THE BRONX, YOU HAVE A CERTAIN SECTION, RIGHT? THAT'S YOU KNOW, YOU DON'T WANT TO CREATE THAT TYPE OF ATMOSPHERE OR ENVIRONMENT IN A CERTAIN SECTION OF OUR CITY.
SO THAT'S I'M VERY CAUTIOUS ABOUT THAT.
AND I THINK THAT THOUGHT HAS TO BE GIVEN BEFORE WE GO DOWN THAT PATH.
OKAY. AND I'M AND I'M WITH YOU ON THAT.
IT WAS MORE SO OF A WAY JUST TO KIND OF REDUCE BECAUSE ONE THING THAT I'VE TALKED TO SEVERAL OF THESE DEVELOPERS, ESPECIALLY WITH THE INTEREST RATES, THEY'RE TRYING TO MAKE THE NUMBERS WORK IN REGARDS TO MAKING AFFORDABLE HOUSING UNITS.
SO I LOOKED AT IT NOT TO TRY TO TAKE AWAY FROM THE BUILDING DEPARTMENT, BUT IT IS PRETTY HEALTHY.
THE LAST THING, SPEAKING OF DISCUSSIONS OVER THE PAST TWO WEEKS, I'M SURE IT'S THE SAME FOR YOU ALL.
BUT THE MAIN THING MY EMAILS AND MY PHONES HAVE BEEN BLOWING UP IS ABOUT DRAINAGE WITHIN OUR CITY.
AND I SPOKE TO THE CITY MANAGER.
I'VE BEEN I'VE BEEN SHOOTING EMAILS TO THE TO VALENTINO AND TO THE TEAM AND EVERYTHING.
FRANK, IF YOU MR. FRANK, IF YOU WANT TO SPEAK. BUT I DON'T I WANT TO MAKE SURE KNOCK ON WOOD, WE DON'T HAVE ANY HURRICANES AT THIS TIME, BUT IF WE DO, I'M PRETTY SURE WE'LL BE SWIMMING.
SO I WANT TO MAKE SURE THAT IF WE NEED TO GIVE, YOU KNOW, CITY MANAGER DIRECTION TO UTILIZE A THIRD PARTY TO ASSIST WITH OUR PUBLIC WORKS TEAM OR WHATEVER AUTHORIZATION THERE'S NEEDED, I JUST WANT US TO BE PROACTIVE BECAUSE PART OF THE PROBLEM IS SOME OF THESE BUILDERS ARE CAUSING
[01:40:10]
ISSUES FOR OUR CURRENT RESIDENTS.AND THE OTHER PART OF THE PROBLEM IS JUST.
YOU KNOW, THE TRENCHING AND THE WORK ORDERS AND IT TAKES TIME, AND I UNDERSTAND THAT.
SO I JUST WANT TO MAKE SURE BEFORE WE REALLY GET INTO THE HEART OF THE HURRICANE SEASON AND WE ALREADY SEE THIS AS AN ISSUE, IF THERE IS SOMETHING PROACTIVE WE CAN DO, LET'S DO IT. IF THERE'S NOT, THEN, YOU KNOW, I JUST WANTED TO HAVE THAT DISCUSSION WITH COUNCIL.
WELL, NOW, YOU KNOW, YOU MENTIONED YOU MENTIONED A CRITICAL COMPONENT THERE.
THEY'RE THE ONES THAT ARE RESPONSIBLE.
BUT YOU'RE RIGHT. I THINK, MADAM SHERMAN, ARE YOU NEEDING AT THIS POINT IN TIME? THE TO FORM OUT ANY, ANY ANY SPECIFIC WORK REGARDING DRAINAGE.
I DON'T HAVE AN ANSWER FOR THAT RIGHT NOW.
COUNCILMAN. JOHNSON DID ASK ME ABOUT THAT BEFORE THE MEETING.
WE'LL TAKE ANOTHER LOOK AT IT BECAUSE I KNOW THE TEAM IS WORKING VERY HARD ALL THROUGHOUT THE CITY.
WE I KNOW JUST RECENTLY DID A NOTIFICATION BLAST OUT TO THE BUILDERS IN THE CITY TO REMIND THEM OF THEIR REQUIREMENTS TO KEEP THE SWALES CLEAR AND TO PUT UP THEIR SILT FENCES AND THINGS LIKE THAT.
AND IT'S HELPFUL WHEN THE RESIDENTS TELL US BECAUSE WE CAN'T BE AT ALL PLACES AT ALL TIMES.
HAPPY THAT AND COUNCILMAN JOHNSON.
I JUST WANT TO SHARE THIS WITH YOU.
WE WE DIDN'T HAVE A PUBLIC WORKS DIRECTOR FOR A LONG TIME.
RIGHT. AND WITH THAT, I'M JUST GOING TO PUT THAT OUT THERE.
I CAN TELL YOU THAT A LOT OF THE SERVICE THAT WE SHOULD HAVE TAKEN CARE OF MAY NOT HAVE BEEN ACCOMPLISHED BECAUSE WE'VE BEEN PLAYING CATCH UP FOR QUITE A NUMBER OF MONTHS.
AND I'M NOT SURE WE ACTUALLY ACCOMPLISHED THAT MISSION THROUGHOUT.
NOW THAT WE HAVE A DIRECTOR, I KNOW THAT HE'S CONTINUING ON A CYCLE.
HE'S BEHIND THE GUN AND EVERYTHING IS IS GOT TO BE DONE ON A TIMELY BASIS.
WE GOT TO SERVICE ALL THESE AREAS.
THAT WAY THE DRAINAGE IS FLOWING WELL, SO THAT MIGHT HAVE PLAYED A ROLE IN THAT.
BUT THAT'S BEEN PART OF THE ISSUE AS WELL.
SO I JUST WANTED TO SHARE THAT WITH YOU, BROTHER.
SO THE LAST THING AND I KNOW THIS WILL PROBABLY BRING ON A LOT OF INPUT, BUT THE SAME WAY WE PUT OUT INFORMATION TO THE BUILDERS, IF WE CAN PUT OUT LIKE HALF MRS MRS BORN OR HAVE THAT DEPARTMENT PUT OUT INFORMATION LIKE, HEY RESIDENTS, IF YOU SEE SOMETHING, SAY SOMETHING JUST TO LET US KNOW.
AND CARS AREN'T STALLING OUT BECAUSE OF FLOODING OR THINGS OF THAT NATURE.
SO, YEAH, I'M SURE THEY'RE GOING TO BE THE GUYS ARE GOING TO BE TALKING ABOUT ME TOMORROW AT WORK.
THANK YOU. THE SECOND THAT CONCLUDES IT.
YES, SIR. DEPUTY MAYOR, LET ME TELL YOU, I'M GLAD YOU KNOW, WE'RE NOT WE'RE NOT IN THE FLOOD ZONE.
VERY FEW SPOT IN THE CITY, BUT THE MAJORITY OF THE OF ALL.
90MI². IT'S NOT CONSIDERED FLOOD ZONE.
SO WHATEVER WE CAN DO TO HELP OUT, CERTAINLY I WANT MAYOR I WANT TO MAKE A COMMENT ABOUT COUNCILMAN JOHNSON HIS TRAIN OF THOUGHT AS FAR AS, YOU KNOW, THE AFFORDABLE HOUSING.
AFFORDABLE HOUSING NATIONWIDE.
IT'S SUCH A CRITICAL, CRITICAL THING.
AND AS A COMMUNITY, YES, WE ARE 60% BUILT OUT.
[01:45:02]
IT'S AN ISSUE HERE.I THINK ANYTHING AND EVERYTHING WE CAN DO TO TO TO EASE OR ATTRACT DEVELOPERS IN THAT SPACE, YOU KNOW, I KNOW THE STATE IS DOING THINGS AND WITH THE THE LAW THAT RECENTLY PASSED, I THINK WE STILL CAN DO MORE.
I HIGHLY DOUBT YOUR CONCERN WOULD BE AN ISSUE.
I DON'T SEE JUST THE THE WAY OUR CITY BUILT.
I DON'T THINK THAT WILL NEVER SEE THAT HERE IN PALM BAY.
IN TERMS OF YOU'RE REFERRING IT'S ALMOST YOU'RE REFERRING TO PROJECT.
BUT THAT'S NOT GOING TO HAPPEN HERE.
BUT I THINK WHAT THAT WOULD DO, IT WOULD ATTRACT MORE DEVELOPERS INTO THAT SPACE, INVEST INTO AFFORDABLE HOUSING FOR OUR PEOPLE BECAUSE WE WE YOU KNOW, ALL AVERAGE FOLKS ALMOST CANNOT AFFORD TO LIVE IN OUR CITY ANYMORE.
SO I WANTED TO COMMENT ON THAT.
SO AS FAR AS MY REPORT, YOU KNOW, I KNOW THE JUST WANTED TO COMMEND ALL POLICE DEPARTMENT.
I KNOW THEY HAD A TOUGH WEEK THIS THIS PAST FEW DAYS.
AND CHIEF, YOUR STAFF, THANK YOU FOR DOING WHAT YOU DO, KEEPING US SAFE.
THIS THIS ONE HIT CLOSER TO HOME.
I GOT FAMILY MEMBER THAT LIVES IN THAT VERY STREET, THAT VERY FIRST HOUSE IN THAT STREET.
SO IT WAS A LITTLE BIT OF A SHOCK TO ME WHEN I SAW IT ON THE NEWS AND GET THE FEEDBACK.
THE OTHER THING I WANT YOU TO TOUCH ON, I THINK IT'S RATHER KIND OF COLD FOR CITIZENS CALLING OUR ELECTED OFFICIAL OUT IN SUCH AND SUCH MANNER.
I DON'T THINK WE DESERVE THAT FOR ANYBODY TO STAND ON THE PODIUM GETTING PERSONAL AND SAYING WHAT WHAT WHAT WAS SAID, CONSIDERING THE CIRCUMSTANCES, I THINK IT'S RATHER COLD.
I'M GOING TO LEAVE THAT AS THAT.
UM, LAST THING, MAYOR, IS YOUR PROGRAM THE MAYOR, WHICH IS A GREAT, AWESOME.
THE MAYOR'S SPOTLIGHT BUSINESS SPOTLIGHT, WHICH IS AN EXCELLENT, EXCELLENT PROGRAM.
I THINK AS WE MOVE FORWARD AT THIS CONTINUED, IF YOU AND THE TEAM WOULD CONSIDER AS WE PICK UP, I DON'T KNOW WHAT ARE THE PARAMETERS, EXACTLY THE REQUIREMENTS AND SO ON.
HOW DO YOU GUYS GO THROUGH THE PROCESS SPECIFICALLY? IT WAS BROUGHT TO MY ATTENTION BY A COUPLE OF PEOPLE THAT SOME OF THE PAST BUSINESSES, GREAT BUSINESSES DOING GREAT THINGS IN OUR COMMUNITY. BUT MAYBE CONSIDER FOR INSTANCE, THEY NOT MEMBER OF THE OF OF OUR CHAMBER.
THEY'RE NOT CONTRIBUTING TO OUR CHAMBER.
THEY HAVE NO PART IN OUR CHAMBER.
AND WE WOULD AGREE THAT OUR CHAMBER SERVE OUR CITY WELL.
SO THAT MAY BE SOMETHING TO CONSIDER.
I MEAN, NOT SAYING THAT FORCING THEM, BUT MAYBE KIND OF AS WE HAVE A LIST OF REQUIREMENT, MAYBE THAT COULD BE A CONSIDERATION TO AS TO MAKE THEM BE CHAMBER MEMBERS.
IS THAT WHAT YOU'RE SAYING? YEAH, THAT'S A CONSIDERATION.
I THINK THEY SHOULD AND MAYBE LOOKED AT IT HOLISTICALLY.
ARE THEY GIVING BACK? WHAT ARE BESIDES JUST DOING BUSINESS IN OUR CITY? WHAT ELSE DO THEY DO? WE GOT BUSINESSES THAT ARE GREAT SOCIALLY.
THEY ARE SOCIALLY RESPONSIBLE IN TERMS OF GIVING BACK TO OUR COMMUNITY IN MANY WAYS, YOU KNOW, RATHER INITIATIVE SUCH AS, YOU KNOW, GIVE AWAY BACKPACKS AND SO ON AND SO FORTH.
THESE ARE I THINK THESE SHOULD BE SOME CONSIDERATION.
SO THOSE JUST TO LIST THESE TWO ITEMS. BUT I JUST WANTED TO PUT IT OUT THERE BECAUSE THEY WERE BROUGHT TO MY ATTENTION.
YEAH. FIRST OF ALL, THE MAYOR'S SPOTLIGHT DOES HAVE A CRITERIA, RIGHT? IF YOU TAKE THE TIME AND LOOK AT IT.
CERTAINLY GIVING TO THE COMMUNITY.
IF IT'S NOT ON THERE, MAYBE WE SHOULD LOOK AT THAT.
BUT TO MAKE THEM JOIN THE GREATER PALM BAY CHAMBER OF COMMERCE, I WOULD NOT AGREE WITH THAT.
WE HAVE CERTAIN WINNERS THAT ARE NOT MEMBERS, BUT THEY WERE BENEFITED BY THEM BEING PART OF WINNING.
THEY EARNED IT LIKE SKI BOATS.
SKI BOATS INCREASED THEIR SALES.
[01:50:03]
RIGHT. BUT THEY'RE NOT THEY'RE NOT CHAMBER MEMBERS INTENTION NOT TO FOR YOU TO DEFEND.I'M JUST THROWING IT OUT THERE BECAUSE IT WAS BROUGHT TO MY ATTENTION.
THESE ARE ITEMS THAT THINK THEY ARE IMPORTANT AS WE GIVING THEM THE GREATER SPOTLIGHT.
MAYBE THESE ARE THINGS THAT WE CAN SUGGEST, MAYBE JUST SUGGEST MAYBE BEING BETTER PARTNER IN THE COMMUNITY AS FAR AS BEING SOCIALLY RESPONSIBLE AND DO MORE FOR OUR COMMUNITY.
BUT I LEAVE THAT AS JUST JUST SUGGESTION.
YOU MAY TAKE THEM, DON'T TAKE THEM.
I STILL THINK IT'S A GREAT PROGRAM, BUT I'M JUST JUST WANTING TO PUT THEM OUT THERE.
I JUST WANTED TO BROUGHT TO MY ATTENTION.
YEAH, BUT DEFINITELY, MAYOR, I DON'T WANT YOU TO BE DEFENSIVE.
I'M JUST SAYING FOR ME TO REQUIRE A BUSINESS TO BE PART OF THE CHAMBER, THAT'S A THAT'S A FEE.
THAT WOULDN'T BE RIGHT TO EVERYONE ELSE.
I'LL CONSIDER WHAT I'M SAYING.
I'LL CONSIDER IT A SUGGESTION.
I'LL CONSIDER IT. YOU WANT TO WEIGH IN ON.
NO, I'M JUST. I'M GONNA COME IN THE MIDDLE ONE.
ONE THING THAT CAN BE DONE, LIKE, WHILE YOU'RE.
LIKE, THEY KNOW THAT THAT HAPPENS AUTOMATICALLY.
OKAY. BUT FOR ME TO REQUIRE THEM TO I DIDN'T SAY REQUIRE IT.
I'M JUST SAYING THAT HAPPENS AUTOMATICALLY AND I SELL THE CHAMBER.
OKAY. ALL RIGHT. OKAY. I WASN'T SURE, BUT THAT'S SOMETHING I SAW.
THANK YOU. THANK YOU. I LOVE THE BUSINESS SPOTLIGHT.
CONGRATULATIONS TO ALL THE WINNERS, ALL THE ALL THOSE THAT THAT WON AND THAT.
LISTEN, THERE ARE SO MANY BUSINESSES THAT HAVE BEEN BLESSED BY IT.
BUT TALK ABOUT BUSINESSES, TALK ABOUT BUSINESSES.
AND I THINK THE SAILOR'S STICE MENTIONED IT, YOU KNOW, AEROJET ROCKETDYNE OH, MY GOODNESS.
BUT IF YOU DON'T KNOW, YOU BETTER ASK SOMEONE BECAUSE PALM BAY IS GROWING AND WE'RE ABOUT WE'RE ABOUT TO GET SOME OUTSTANDING JOBS AND REALLY CREATE PROSPERITY.
AND THEN I WANT TO CONCLUDE WITH EXACTLY WHAT YOU SAID.
YOU KNOW, WE'VE GOT THE MEN AND WOMEN THAT PROTECT THIS CITY.
THEY'RE FACED WITH ADVERSITY ON A DAY TO DAY BASIS.
AND I WANT OUR LAW ENFORCEMENT OFFICIALS TO UNDERSTAND.
WE APPRECIATE YOU AND THANK YOU FOR PROTECTING LIFE.
YOU ARE NUMBER ONE IN PALM BAY.
ARE. THAT CONCLUDES MY REPORT, MADAM SHERMAN.
NO, SIR. DEPUTY MAYOR NEEDS SPEAKER CARDS.
[PUBLIC COMMENTS/RESPONSES]
MR. NATHAN WHITE.NATHAN WHITE, 1301 SEABURY STREET SOUTHWEST.
I APPRECIATE IT BEING ADDRESSED.
THE INAPPROPRIATE NATURE OF PERSONAL ATTACKS.
I FILED A PETITION WITH THE CITY.
WELL, I FILED TO COMMENCE A PETITION WITH THE CITY TO AMEND THE CHARTER TO PUT A LIMIT ON THE CITY'S TOTAL DEBT BY LIMITING THE AMOUNT THAT CAN BE TAKEN OUT BASED ON THE AMOUNT OF DEBT SERVICE IN THE ANNUAL BUDGET.
A LIMIT THAT WE ARE ONLY A BIT OVER AT THE MOMENT AND WORDED IN SUCH A WAY THAT IT WOULD NOT AFFECT ANY OF OUR CURRENT DEBTS, DEBT OR DEBT PAYMENTS, OUR DEBT OBLIGATIONS, OUR ABILITY TO PAY ON THOSE DEBTS, MEET THOSE BILLS.
AND I DON'T KNOW WHAT'S SO OFFENSIVE ABOUT THAT.
WE WANT THAT WOULD BE OUR RULE, EVEN IF THE STATE DIDN'T HAVE IT.
I THOUGHT THAT WAS A GOOD MESSAGE.
THE LIMITATION ON DEBT WAS AN HONEST AND SINCERE ATTEMPT.
AND TO ENSURE A SAFEGUARD THE FINANCIAL FISCAL WELL-BEING OF MY HOME TOWN, MY CITY.
YOU KNOW THAT. TO DISSOLVE THE ENTIRE BOARD BECAUSE YOU ARE DISPLEASED WITH WHAT I HAVE BEEN
[01:55:10]
SAYING PUBLICLY.WITH A PETITION THAT I HAVE EVERY RIGHT TO FILE FOR AND HAS GOTTEN A LOT OF SIGNATURES.
I AM NOT SHOCKED AT YOUR OPPOSITION TO MY STATEMENTS.
A LOT. I'M ON THE FINANCE BOARD.
CITIZEN BUDGETED? WELL, I WAS.
I DON'T KNOW IF PERHAPS YOU WEREN'T UPDATED ON ON THAT.
WAS THIS MOVED FORWARD WITH NO RESEARCH? BECAUSE I ASSURE YOU, I DID A GREAT DEAL OF RESEARCH BEFORE MOVING FORWARD WITH MY PETITION, WHICH NO MEMBER OF THIS COUNCIL HAS REACHED OUT TO ME ABOUT BEFORE DISSOLVING AN ENTIRE BOARD IN AN ATTEMPT TO SILENCE ME.
AND ADDRESS 1681 WICHITA BOULEVARD, SOUTHEAST PALM BAY.
AND THIS NEIGHBOR, THE ONE I HAVE TROUBLE WITH ALL THE TIME.
AND HE TOLD THEM HE DIDN'T WANT IT DONE BECAUSE OF THAT.
THE FLOODING HAS GOTTEN WITH THIS RAIN WE'VE BEEN HAVING HAS GOTTEN WORSE BECAUSE HE'S STOPPING THE FLOW TO LET THE WATER GET TO THAT LITTLE RAVINE THAT THEY HAVE.
I DON'T. SO RIGHT NOW, I WENT TO PUBLIC WORKS TO TELL THEM THE WATER IS BACKING UP AND THEY SAID THEY WOULD HAVE TO COME OUT THERE AND HOW CAN SOMEBODY STOP SOMETHING? BUT THE CITY HAS TO DO.
BUT HE ASKED WHO DECIDED TO HAVE THIS DONE? AND WHEN THEY TOLD HIM IT WAS ME, HE REFUSED TO LET THIS THING GO.
I'M HAVING A SERIOUS PROBLEM WITH THIS FELLA.
NOW I'M BRINGING THIS UP BECAUSE THANK GOD, SCHOOL IS OUT FOR THOSE KIDS.
BECAUSE, AGAIN, THE BUS STOPS THERE.
AND ALL I WANT TO SAY IS THAT SOMETHING GOT TO BE DONE.
AND THE FELLA SAID HE WOULD COME BY FROM PUBLIX WORK WHETHER HE CAME BY OR NOT, I DON'T KNOW.
I GO TO THE ONE IN MELBOURNE AND I GO TO THE ONE HERE.
BECAUSE THE TRUTH IS, IS THAT IF YOU WANT TO KNOW THE TRUTH, YOU COME WHERE THE SOURCE IS.
THEY DON'T EVEN COME TO THE COMMISSION MEETINGS.
NOW, I WORKED FOR MY COMPANY FOR 42 YEARS.
OKAY? I KNOW ABOUT THE ELECTRICAL SYSTEM.
SO MY SITUATION HERE IS WHAT DO WE DO? IF I'M NOT MISTAKEN, I WANT TO TRY TO GET THE MINUTES FOR THE HOMELESS.
I STILL GO TO DAILY BREAD AND EVERYTHING LIKE THAT BECAUSE I WANT TO GIVE.
SO WHAT? IF I'M NOT MISTAKEN, I COULDN'T GET THE MINUTES, BUT THE TINY HOMES FOR THESE PEOPLE, WHAT WOULD HAPPEN? OR WAS I JUST MISTAKEN THAT THEY'RE TRYING TO DO THESE TINY HOMES FOR THE HOMELESS? DO YOU WANT TO PICK THAT UP? OKAY. SO BACK IN 2019.
BACK IN 2019, SIR, UM, I SEE CONSENSUS FROM COUNCIL AND WE MOVED FORWARD WITH A TINY HOME ORDINANCE AND THIS ORDINANCE THAT ALLOWED TWO THINGS ALLOWED ADUS ACCESSORY DWELLING UNITS.
[02:00:02]
SO ESSENTIALLY MOTHER IN LAW SUITES ON SINGLE FAMILY LOTS.UM, BEFORE THE PANDEMIC HAPPENED, WE HAD A FEW DEVELOPERS THAT HAD SHOWN INTEREST IN DEVELOPING THESE, BUT AFTER THAT, YES, DEVELOPING THE TINY HOME COMMUNITIES FOR THAT PURPOSE OF CREATING AFFORDABLE HOUSING FOR WHOEVER IT IS, THE HOMELESS RETIREES, WHOEVER WANTS ACCESS TO IT FOR THAT.
UM, BUT SINCE SINCE THEN THE DISCUSSIONS HAVE REALLY BEEN.
YEAH, IT'S REALLY BEEN SILENT SINCE THEN.
SIR. LISTEN, THE GOOD NEWS IS WE HAVE AN ORDINANCE, OKAY? SO THEY'RE INVESTORS.
BUT TO GET TO YOUR OTHER POINT, SPEAK TO THE PUBLIC WORKS INDIVIDUAL OR.
SIR, YOU'RE DONE WITH THE THREE MINUTES.
DANIEL CORCORAN 2124 BROOK DRIVE.
THANK YOU FOR GIVING ME THE OPPORTUNITY TO SPEAK AGAIN.
FROM A PERSONAL PERSPECTIVE, I MADE MY LIVING AS A FINANCE MANAGER FOR AN AEROSPACE ORGANIZATION, AND PART OF MY ROLE WAS TO IMPART FINANCIAL WISDOM AND TO INCREASE THE FINANCIAL AWARENESS AND THE FINANCIAL CAPABILITY OF THOSE AROUND ME.
I'M VERY DISAPPOINTED TO HEAR THAT THIS CITIZENS ADVISORY BOARD CAME KNOCKING ON YOUR DOOR, ASKING FOR INPUT AS TO HOW THEY COULD INCREASE THE VALUE OF WHAT THEY PROVIDED, AND THEY WEREN'T GIVEN ANY INPUT ON THAT.
HERE WAS A GREAT OPPORTUNITY FOR THEM TO GO AND, AND, AND AND IMPART MORE IMPORTANT WISDOM THERE.
HERE WE'RE TAKING AND TAKING A STEP BACK.
I THOUGHT ANYTHING THAT INCREASES TRANSPARENCY AND INCREASES CITIZENS INPUT IS A GOOD THING.
AND WHAT YOU'VE DONE IS YOU'VE TAKEN THAT AWAY.
I FEEL PARTICULARLY BAD FOR THE FOR THE VOLUNTEERS THAT GAVE UP THEIR TIME.
I WANTED TO TALK TO MR. OLSZEWSKI ABOUT THIS.
UNFORTUNATELY, HE'S NOT HERE TONIGHT.
SO I CAN'T TELL YOU HOW DISAPPOINTED I AM IN THE OUTCOME OF THAT OF THAT ONE AGENDA ITEM.
THANK YOU FOR LISTENING TO ME.
PHILLIP CORCORAN, 1878 LYNBROOK DRIVE.
ONE OF THE PONDS DRAINS UNDER MY PROPERTY AND UNDER MY DRIVEWAY.
SOME OF BAYSIDE LAKES IS IN A FLOOD ZONE, IN FACT.
SO I SEE SOMETHING, I SAY SOMETHING.
I THINK THE CITY NEEDS TO HAVE A STANDARD FOR POND MAINTENANCE BEFORE WE HAVE A CATASTROPHE.
I DON'T KNOW HOW WELL THE PIPES ARE GOING TO WORK IF THEY GET CHOKED WITH THE LILY PADS.
ANY OTHER SPEAKER CARDS? NO. MAYOR. ANYONE ELSE WISH TO SPEAK? COME ON. FORWARD, MASTER CHIEF.
BILL BATTEN, 586 OCEAN SPRAY STREET, SOUTHWEST.
CITY COUNCIL HAD THE ABILITY FOR A TEMPORARY PLACEMENT.
WHEN COUNCILMAN FOSTER ENDED UP WITH HIS MEDICAL CONDITION.
I CANNOT ADDRESS AN INDIVIDUAL THAT'S NOT PRESENT.
I CANNOT CALL INTO THE COUNCIL FROM MY HOME AND CONDUCT BUSINESS.
SO HOW CAN AN INDIVIDUAL CONDUCT BUSINESS ON THE PHONE? THAT'S NUMBER ONE.
YOU FAILED TO TAKE THAT ACTION.
SHE WENT IN ON MARCH 1ST WITH A DIABETIC SITUATION IDENTICAL TO HIS.
[02:05:04]
SO I UNDERSTAND WHOLEHEARTEDLY WHAT YOU'RE TALKING ABOUT AND WHAT THE IMPACT IS, BUT I'M STILL TRYING TO BE ACTIVELY INVOLVED IN MY GOVERNMENT.AND FACE IT, I WANT ELECTED OFFICIALS THAT I CAN ADDRESS.
THANK YOU VERY MUCH ON THAT ONE.
I WANT TO THANK CITY OF PALM BAY.
AND THAT'S THE TYPE OF ACTION I'D LIKE TO SEE.
ALL IT TOOK WAS THEM REMINDING THE INDIVIDUAL, THIS IS YOUR RESPONSIBILITY, BUT A REAL QUICK STOP ORDER PLACED ON THESE BUILDINGS WOULD MAKE THESE PEOPLE BE RESPONSIBLE REAL QUICK HERE IT IS VIOLATION.
DON'T GIVE THIS THING. I'M GOING TO GIVE YOU SEVEN DAYS TO CORRECT YOUR THING.
YOU SEE IT. PUT A STOP, ORDER IN ON IT AND STOP.
ORDERS DON'T HAVE TO GO THROUGH THE SAME PROCESS.
IS THERE ANYTHING ELSE YOU SEE SOMETHING THAT CAN BE DETRIMENTAL? YOU PUT A STOP ORDER ON IT.
THESE PEOPLE WILL START JUMPING THROUGH HOOPS TO GET THEIR WORK DONE.
ON THE HOUSING SITUATION COUNCIL AT THE PLANNING AND ZONING LAST NIGHT, THE HOTEL ON PALM BAY ROAD.
THIS IS A PERFECT EXAMPLE WHERE SOMEBODY IS TRYING TO SOLVE THE HOUSING SITUATION.
THIS HOTEL HAS BEEN THE DEVELOPERS COMING IN.
THEY'RE GOING TO REVAMP THIS HOTEL THAT'S COMING UP.
I DON'T WANT TO SEE THAT TAXATION ABILITY DECREASED BECAUSE OF WHO'S GOING TO BE LIVING THERE.
I CALL THAT PREFERENTIAL TREATMENT.
AGAIN, STOP THE PREFERENTIAL TREATMENT.
IT'S A GOOD THING. HERE'S A DEVELOPER GOING TO DO IT.
THAT'S WHAT I WANT AND I WANT MY GOVERNMENT TO BE A GOOD GOVERNMENT OF THE CITY OF PALM BAY.
ANYONE ELSE? IS THERE ANOTHER SPEAKER CARD? OOH, A LOT GOING ON TONIGHT.
UM, I LOVE THE MAYOR'S SPOTLIGHT, AND I WANT TO COMMENT ON TWO COMMENTS.
ONE ABOUT THE CHAMBER OF COMMERCE BEING REQUIRED.
UM, I VOLUNTEER FOR THE GREATER PALM BAY CHAMBER OF COMMERCE, AND WE ARE FORTUNATE TO HAVE THEM.
I THINK THEY'RE A CUT ABOVE THE OTHER CHAMBERS IN TERMS OF BRINGING PEOPLE TOGETHER AND NETWORKING.
AND IT'S ALSO MY DIRECT KNOWLEDGE THAT THE CHAMBER HAS SOMETHING FOR EVERYBODY.
IT'S IT'S NOT YOU GOT TO THINK OUT OF THE BOX.
THEY REACH ALL TYPES OF BUSINESSES.
THE OTHER THING WAS YOU'RE MENTION IN USE OF THE WORD PROSPERITY.
THIS IS SOMETHING THAT THE CHAMBER IS DOING.
THE GREATER PALM BAY CHAMBER OF COMMERCE IS LEADING THE LOCAL PROSPERITY INITIATIVE, WHICH IS ACTUALLY STARTED FROM THE FLORIDA CHAMBER OF COMMERCE.
AND BASICALLY THE THRUST OF THIS PROGRAM IS THAT THEY HAVE COME TO REALIZE THAT FOR A COMMUNITY AND A TO BE PROSPEROUS, EVERYBODY HAS TO BE PROSPEROUS.
AND THE GOAL IS TO END CHILDHOOD POVERTY BY 2030, DECREASE IT BY 50%.
WE'RE ALREADY HAVE BEGUN THAT THROUGH THE LEAD OF THE LOCAL CHAMBER OF COMMERCE.
COUNCILMAN JOHNSON HAS VISITED THE ENDEAVOR SCHOOL, WHICH IS PART OF THIS PROGRAM AND PROJECT.
YOU ALL WILL BE HEARING MORE ABOUT THIS BECAUSE THIS IS AGAIN SOMETHING THAT THE CITIZENS ARE GETTING INVOLVED IN JUST BY HEARING ABOUT IT AND AND WANTING TO PARTICIPATE AND GROW OUR COMMUNITY AND ALSO INCLUDE ALL OUR POPULATIONS.
THANK YOU. ANYONE ELSE WISH TO SPEAK? BEFORE THIS MEETING'S ADJOURNED.
[02:10:01]
SEEING NONE. THIS MEETING IS ADJOURNED.
