I'M THE CITY MANAGER FOR THE CITY OF PALM BAY.

I WELCOME ALL OF YOU TO TONIGHT'S MEETING.

BEHIND ME IS JUST A SMALL SAMPLING OF A VERY INCREDIBLE TEAM THAT WE HAVE.

MANY OF THOSE BEHIND ME ARE DIRECTORS.

THEY'RE IN LEADERSHIP POSITIONS WITH THE CITY.

THEY'RE HERE BECAUSE AS PART OF THEIR JOB TO BE HERE TONIGHT.

AND THAT'S ONE OF THE MANY THINGS THAT THEY DO.

BUT AS YOU HEARD WHEN THE MAYOR READ THE PROCLAMATION THIS WEEK, WE'RE CELEBRATING WHAT'S CALLED FLORIDA CITY GOVERNMENT WEEK.

IT'S A WEEK THAT'S FOCUSED ON RAISING AWARENESS OF THE IMPORTANCE OF MUNICIPAL GOVERNMENT AND ITS DAILY IMPACT ON ALL OF OUR RESIDENTS, ON ALL OF YOU, ON ALL OF US WHO LIVE IN THE CITY. THE CITY OF PALM BAY HAS OVER 900 EMPLOYEES AND VOLUNTEERS, AND I WANT TO TAKE A MOMENT TONIGHT AND JUST RECOGNIZE EVERY ONE OF THEM AND EXPRESS MY APPRECIATION FOR THE EXCEPTIONAL DEDICATION AND HARD WORK THAT ALL OF OUR EMPLOYEES PROVIDE AS THEY SERVE OUR COMMUNITY 24 HOURS A DAY, SEVEN DAYS A WEEK, ALL THROUGHOUT THE YEAR. THEY'RE ALWAYS ON DUTY.

WE ARE A FULL SERVICE CITY.

WE HAVE 16 DEPARTMENTS WORKING HARD TO SERVE.

WHAT IS THE SECOND LARGEST CITY IN CENTRAL FLORIDA? WE HAVE OVER 135,000 RESIDENTS NOW.

WE'RE A LITTLE OVER 88MI².

SO WE'RE WE'RE A BIG CITY AND WE HAVE A LOT GOING FOR US AND A LOT OF GREAT PEOPLE WORKING TO SERVE OUR CITY EVERY DAY.

WORKING IN LOCAL GOVERNMENT IS TRULY AN HONOR AND A PRIVILEGE, AND IT'S NOT SOMETHING THAT WE TAKE LIGHTLY.

FOR MANY OF US, IT REALLY IS A CALLING TEAM.

I WOULD JUST WANT TO SAY TO YOU THAT YOUR COMMITMENT TO EXCELLENCE IS TRULY THE CORNERSTONE OF OUR CITY'S SUCCESS, AND IT'S TRULY SOMETHING THAT WE CAN BE, AS WE SAY, HASHTAG PALM BAY.

SO THIS IS DOMESTIC VIOLENCE AWARENESS AND PREVENTION MONTH.

IT IS HEREBY PROCLAIMED BY THE MAYOR OF THE CITY OF PALM BAY, THE GREATEST CITY ON THE FACE OF THE EARTH, BREVARD COUNTY.

FOR THAT, WHEREAS NEARLY 1 IN 3 WOMEN AND 1 IN 4 MEN IN OUR COUNTRY HAVE SUFFERED PHYSICAL VIOLENCE BY AN INTIMATE PARTNER.

WANT YOU TO LET THAT SINK IN.

AND DOMESTIC VIOLENCE IMPACTS PEOPLE OF EVERY AGE, ETHNICITY, NATIONALITY, ECONOMIC STATUS AND BELIEF. AND WHEREAS VICTIMS OF DOMESTIC VIOLENCE ARE DEPRIVED OF AUTONOMY AND SECURITY, THEY FACE, THEY FACE THREATS OF THEIR HEALTH AND SAFETY, AND IN MANY INSTANCES THEY FIND THEMSELVES LEFT WITH SIGNIFICANT FINANCIAL INSECURITY.

AND WHEREAS CRIMES LIKE DOMESTIC VIOLENCE INHIBIT OUR COMMUNITY FROM REACHING ITS FULLEST POTENTIAL.

AND ALTHOUGH GREAT PROGRESS IN BRINGING AWARENESS TO AND PROVIDING PROTECTIONS AGAINST DOMESTIC VIOLENCE HAS BEEN MADE, MUCH WORK REMAINS.

AND WHEREAS THE PALM BAY POLICE DEPARTMENT'S VICTIM SERVICE UNIT DIRECTS EFFORTS TO ADDRESS DISTURBING STATISTICS REGARDING DOMESTIC VIOLENCE, ADVOCATES FOR TOUGHER SENTENCES ON DOMESTIC VIOLENCE CASES, AND PARTNERS WITH THE STATE ATTORNEY'S OFFICE, LAW ENFORCEMENT, AND LOCAL DOMESTIC VIOLENCE SERVICE PROVIDERS SUCH AS SERENE HARBOR TO ENSURE THAT VICTIMS OF DOMESTIC VIOLENCE DO NOT EXPERIENCE FURTHER HARASSMENT.

AND WHEREAS THE PALM BAY POLICE DEPARTMENT'S VICTIM SERVICES UNIT CELEBRATED ITS 25TH ANNIVERSARY AND ITS SIGNIFICANT CONTRIBUTION TO THE CAUSE BY BEING THE FIRST ADVOCACY PROGRAM TO BE PART OF A FIRST RESPONSE TEAM IN BREVARD COUNTY.

WHEREAS THE CITY REAFFIRMS ITS DEDICATION TO PROVIDING A COMMUNITY WHERE NO ONE SUFFERS THE PAIN AND HARDSHIP CAUSED BY DOMESTIC VIOLENCE, AND RECOGNIZES THE ADVOCATES, VICTIM SERVICE PROVIDERS, AND ORGANIZATIONS WHO WORK TIRELESSLY TO PREVENT DOMESTIC VIOLENCE AND EXTEND HOPE AND HEALING TO SURVIVORS AND THE VICTIMS OF DOMESTIC VIOLENCE.

AND WHEREAS VICTIMS SHOULD HAVE HELPED TO FIND THE COMPASSION, TO FIND THE COMFORT AND THE HEALING THAT THEY NEED, AND DOMESTIC ABUSERS SHOULD BE PUNISHED TO THE FULL EXTENT OF THE LAW.

THE ANYWAY, BY NOW, THEREFORE, AND I GET EMOTIONAL ABOUT THIS BECAUSE WE WE TWO YEARS AGO, THERE WAS A YOUNG LADY THAT WAS WELL KNOWN IN OUR COMMUNITY, AND SHE WAS PART OF THE PALM BAY CHAMBER OF COMMERCE. NADINE WAS HER NAME AND SHE WAS A VICTIM OF DOMESTIC VIOLENCE.

WHAT'S INTERESTING TO KNOW, LADIES AND GENTLEMEN, IS YOU COULD NEVER TELL BECAUSE OF HER SMILE THAT WE ENCOUNTERED HER EACH AND EVERY DAY.

SO THE RAISING OF AWARENESS.

IT'S MY PRAYER THAT THESE VICTIMS GET BOLD ENOUGH TO SAY I NEED HELP NOW.

THEREFORE, I, ROBERT MEDINA, MAYOR OF THE CITY OF PALM BAY, BY VIRTUE OF THE AUTHORITY OF SAID OFFICE, DO HEREBY PROCLAIM OCTOBER 2023 AS DOMESTIC VIOLENCE AWARENESS AND PREVENTION MONTH AND URGE ALL THAT WE ALL REDEDICATE OURSELVES TO UPHOLD UPHOLDING THE BASIC HUMAN RIGHT TO BE FREE FROM VIOLENCE AND ABUSE AND WITNESS.

WE ARE SO FORTUNATE TO BE A PART OF PALM BAY, WHICH AS WE KNOW, IS THE GREATEST CITY ON THE FACE OF THE PLANET.

AND AND BEHIND ME ARE OUR VICTIM ADVOCATES.

WE HAVE TWO FULL TIME VICTIM ADVOCATES.

WE HAVE EIGHT VOLUNTEERS, AND SOME OF THEM ARE WITH US.

AND THESE LADIES ARE WITH SERENE HARBOR, OUR LOCAL DOMESTIC VIOLENCE SHELTER.

AS THE MAYOR SAID, THIS IS OUR 25TH ANNIVERSARY.

WE WERE THE FIRST CITY IN BREVARD COUNTY TO BRING VICTIM SERVICES IN-HOUSE.

ONCE OUR NEIGHBORING MUNICIPALITIES SAW THE SUCCESS WE WERE HAVING, THEY HAVE ALL BASICALLY MODELED THEIR PROGRAMS AFTER US AND HAVE INSTITUTED PROGRAMS OF THEIR OWN, WHICH IS EXACTLY WHAT THE CITIZENS EVERYWHERE NEED AND DESERVE.

I WANT TO JUST SAY THAT IT'S BEEN A PLEASURE.

I'VE BEEN ABLE TO BE HERE, A PART OF THIS PROGRAM, FOR THE ENTIRE 25 YEARS.

WE HAVE SOME VOLUNTEERS THAT HAVE BEEN WITH US SINCE THE INCEPTION OF OUR PROGRAM, AND OUR PROGRAM SERVES ABOUT 1200 CITIZENS A YEAR.

SO WE HAVE SERVED ABOUT 36,000 OF OUR CITIZENS TO DATE, WHICH I THINK IS ALTHOUGH IT'S NOT REALLY FORTUNATE CIRCUMSTANCES THAT WE COME TO MEET THEM, WE FIND IT AN HONOR AND A PRIVILEGE TO WALK BESIDE THEM AS THEY MOVE TO INDEPENDENCE AND SURVIVE UNFORTUNATE CIRCUMSTANCES.

SO WITH THAT, I JUST WANT TO THANK EVERYBODY IN THIS ROOM, CITY MANAGEMENT CHIEF, OUR COUNCIL, MAYOR, DEPUTY MAYOR.

I KNOW THAT THERE WAS A SUBMITTED APPRAISAL TO YOU ALL AT OVER $7 MILLION, WHICH WOULD EQUATE TO ABOUT $175,000 OF ANNUAL PROPERTY TAX.

SHE HAS SLIPPED DISC. SHE JUST HAD A ROTATOR CUFF SURGERY A COUPLE OF WEEKS AGO.

SO I EXPLAINED THAT, YOU KNOW, ALTHOUGH WE'RE IN FLORIDA NOW, WE CAN'T ENJOY, YOU KNOW, THE BEACHES AND STUFF LIKE THAT BECAUSE OF HER INJURIES.

SO AUTOMATICALLY YOU'RE GOING TO HAVE TO BE PICKING UP THAT MUCH BIGGER PROPORTION OF THE REPAIR INTO MALABAR ROAD, JUST LIKE HAPPENED ON BABCOCK.

HE'S GOT GREAT PROJECTS.

I UNDERSTAND WHAT THE OBJECTIVE IS.

I'M JUST STARTING TO QUESTION WHY OUR INCREASE SEEING OF WHAT WE HAVE TO OUTLAY IN EXPENDITURES ON ROADS THAT ARE COUNTY ROADS.

BUT BECAUSE WE'RE THE RESIDENTS LIVING ON THEM, WE'RE THE ONES HAVING TO PAY IT EVEN THOUGH WE'RE PAYING COUNTY TAXES.

I JUST I SEE WHAT'S HAPPENING.

IT'S NOT BAD THAT WE'RE ANNEXING IN.

YOU KNOW, CASE IN POINT IS THE THE PLAN TO DO THE DESIGN ENGINEERING FOR THE WIDENING OF MALABAR ROAD, WHICH IS PARTIALLY CITY, PARTIALLY BREVARD COUNTY.

THE DESIGN COSTS ALONE ARE ABOUT $10 MILLION.

AND THAT'S JUST BETWEEN MINTON AND THE PARKWAY.

OR IT'LL BE ON THE PARKWAY AS WE KNOW.

SO IT'S ALWAYS GOING TO BE A CHALLENGE.

THERE'S THERE'S A POINT AT WHICH EVEN THOUGH THERE'S JOINT OWNERSHIP, BECAUSE OF THE NEED TO THE RESIDENTS, WE HAD TO MAKE A DECISION TO MOVE FORWARD WITH THAT PROJECT.

AND WE DID. AND I THINK IT WAS A WORTHWHILE INVESTMENT TO START THAT AND GET THE DESIGN UNDERWAY SO WE CAN DO THE WIDENING.

AS TO THIS ANNEXATION FOR ITEM NUMBER FOUR THAT WE'RE ON, AND ALSO FOR ITEM NUMBER FIVE, THOSE TWO PARCELS ARE ARE ESSENTIALLY, YOU KNOW, ALL SURROUNDED BY OUR NEXT TO CITY PROPERTY AND OR WILL BE ONCE THEY'RE ANNEXED AND THEY'RE AT THE FARTHEST END AS YOU CAN GO WEST IN THE CITY, AS WE ALL KNOW.

I BELIEVE IT WENT FROM 224 TO 202.

SO THEN WITH THAT REDUCTION IN IN DENSITY, THE TRAFFIC STUDY WAS REVISED.

AND WHAT THE OUTCOME OF THAT WAS, THAT SOUTHBOUND TURN LANE AS THE ONLY IMPROVEMENT ON THE ROAD AS BEING NEEDED.

SO WITHOUT HAVING THIS ORDINANCE IN PLACE, THAT MEANS THAT SEPTIC TANKS AND INDIVIDUAL DRINKING WATER WELLS CONTINUE TO BE INSTALLED AND THERE IS NO OPPORTUNITY TO PROVIDE PEOPLE WITH THE THE SERVICES.

THE REASON THAT'S IMPORTANT IS WE HAVE AN INCREASING CONCERN ABOUT THE ENVIRONMENTAL IMPACT OF THE SEPTIC TANKS, THE MAINTENANCE OF THOSE SEPTIC TANKS, THE AGING SEPTIC TANKS IN THE CITY OF PALM BAY.

WE ALSO HAVE CONCERNS AND FREQUENT REQUESTS FROM OUR RESIDENTS FOR HELP IN ACCESSING CITY WATER IN PLACES WHERE THEY HAVE WELLS, WHEN THEIR WELLS ARE CONTAMINATED OR ARE NOT OF GOOD QUALITY OR HAVE RUN DRY, WHICH IS HAPPENING INCREASINGLY.

THE MORE WELLS WE HAVE, THE MORE THAT PROBLEM EXISTS.

SO ESSENTIALLY WHAT WE HAVE BROUGHT BEFORE YOU IS, IN ADDITION TO THE ORDINANCE, A PHASING APPROACH THAT WE'RE RECOMMENDING TO OVER A PERIOD OF ABOUT FOUR YEARS, BE ABLE TO CONNECT ALL OF THOSE PROPERTIES THAT HAVE WATER AVAILABLE BUT ARE NOT CONNECTED.

THE DEVELOPED PROPERTIES THAT ARE IN EXISTENCE TODAY.

AND RIGHT NOW, THAT COUNT IS A LITTLE OVER A THOUSAND PARCELS THAT HAVE WATER AVAILABLE BUT ARE NOT.

EXCUSE ME, I'M FLIPPING IT ABOUT 2300 PARCELS WHERE WATER IS AVAILABLE, BUT THEY HAVE NOT CONNECTED.

AND THEN LIKEWISE ON THE SEWER SIDE, WE HAVE ABOUT 1000 PARCELS THAT ARE DEVELOPED WHERE SEWER IS AVAILABLE AND THEY HAVE NOT CONNECTED.

SO THIS FOUR YEAR PROGRAM WOULD CONNECT ALL OF THOSE PARCELS.

AND ONE OF THE REASONS WE'RE EXCITED TO BRING THIS TO YOU TODAY IS STAFF HAS WORKED VERY HARD TO ADDRESS ONE OF THE CONCERNS WE KNOW, WHICH HAS BEEN THE COST FOR THE INDIVIDUAL HOMEOWNER, THE EXISTING HOMEOWNER, TO CONNECT AND SPECIFIC TO THE SEWER SIDE OF THINGS.

THAT CONNECTION COSTS CAN BE VERY EXPENSIVE BECAUSE NOT ONLY DO YOU HAVE TO DO THE ACTUAL CONNECTION, BUT YOU HAVE TO TAKE CARE OF ABANDONING YOUR EXISTING SEPTIC TANK.

SO WE'VE GOT SEVERAL THINGS THAT WE'VE PUT IN PLACE, AND THOSE THINGS INCLUDE $420,000 THAT COUNCIL PREVIOUSLY ALLOCATED OUT OF ARPA FUNDS. WE THIS PAST YEAR RECEIVED $2.1 MILLION FROM THE STATE IN APPROPRIATIONS TO SUPPORT SEPTIC TO SEWER CONVERSIONS, TO HELP PAY FOR THE CUSTOMER SIDE OF THAT.

WE ARE RECOMMENDING THAT IN THIS PART OF THE AGENDA AND THE MOTION THAT WE WAIVE, ALL OF THE UTILITY IMPACT FEE AND MAINLINE EXTENSION COSTS, WHICH IS A SIGNIFICANT CONTRIBUTION, BUT ALSO REDUCES SIGNIFICANTLY THE COST TO THE HOMEOWNER.

AND WE'RE WILLING TO DO THAT BECAUSE OF THE IMPORTANCE OF GETTING MANDATORY CONNECTION IN PLACE.

WE ALSO CURRENTLY HAVE AN APPROACH THAT YOU ALL APPROVED RECENTLY TO APPLY FOR ANOTHER $5 MILLION IN STATE APPROPRIATIONS FOR SEPTIC TO SEWER ASSISTANCE, WHICH WOULD HELP WITH THAT PROJECT.

BEYOND THAT, THERE ARE MULTIPLE OPPORTUNITIES TO RECEIVE ADDITIONAL FUNDING FROM THE STATE THROUGH DIFFERENT GRANT PROGRAMS. ONCE YOU HAVE MANDATORY CONNECTION IN PLACE FOR SEWER.

A SPECIFIC EXAMPLE I COULD GIVE YOU IS WE KNOW WE HEARD A COUPLE OF YEARS AGO, THE CITY OF FELLSMERE GOT AROUND $50 MILLION TO DO MAINLINE EXTENSIONS FROM THE STATE.

BUT YOU CAN'T GET THAT KIND OF MONEY IF YOU DON'T HAVE A MANDATORY CONNECTION ORDINANCE IN PLACE.

SO THAT'S A VERY BIG DEAL FOR US.

ALSO, THE THE COUNTY PROGRAM SWIRL THAT WE'RE ALL FAMILIAR WITH.

THAT PARTICULAR PROGRAM HAS ACTUALLY BEEN HELPFUL, VERY HELPFUL TO US LATELY BECAUSE THEY HAVE A QUICK CONNECT PROGRAM AND THEY'VE BEEN PAYING THOSE COSTS FOR THE RESIDENTS TO.

TOURS ARE INTERESTED, AND THEY'VE DONE OVER 250 HOMES IN THE CITY OF PALM BAY TO DATE, WHICH IS A BIG DEAL FOR US.

BUT BEYOND THAT, THEY HAVE ABOUT $10 MILLION IN SORREL MONEY THAT'S BEEN SET ASIDE FOR THE CITY OF PALM BAY FOR A NUMBER OF YEARS NOW, AND THAT $10 MILLION IS ALL SET ASIDE FOR THE PURPOSE OF EXPANDING SEWER LINES IN AREAS VERY CLOSE TO TURKEY CREEK THAT DO NOT YET HAVE SEWER ACCESS.

THEY'RE STILL ON SEPTIC TANKS.

WE COULD NOT MOVE FORWARD WITH THOSE PROJECTS.

AND THAT $10 MILLION THAT'S HELD BY SORREL, UNLESS WE HAVE A MANDATORY CONNECTION ORDINANCE.

AND IN FACT, THE THE FOLKS THAT RUN SORREL, THE COUNTY REACHED OUT TO US RECENTLY AND ASKED US FOR A STATUS UPDATE TO FIND OUT WHEN WE WERE GOING TO MOVE THAT PROJECT FORWARD.

SO THIS DECISION TONIGHT WILL HELP US DETERMINE HOW WE RESPOND TO THEM.

SO, IN SHORT, THE THE REQUEST WE HAVE OF YOU TONIGHT IS TO CONSIDER ADOPTION OF THIS MANDATORY CONNECTION ORDINANCE FOR WATER AND SEWER.
