UNFORTUNATELY THE FIRST NOTICE THAT WAS SENT THROUGH CITY OF PALM BAY,HE NEVER RECEIVED IT BY MAIL. WHAT HE RECEIVED WAS A NOTIFIED LETTER AND WHEN HE CALLED CITY OF PALM BAY AND I BELIEVE HE CAME IN TOO, THEY TOLD HIM THAT THERE WAS ALREADY FINES BEING PUT OF $50 I THINK A DAY PLUS THEY HAD ALREADY SCHEDULED SOMEBODY TO GO OUT THERE AND CLEAN THE PROPERTY. THEY SAID THEY COULDN'T STOP THE CLEANING, THAT THEY HAD TO WAIT TILL THE PROCESS WENT THROUGH AND THEN HE CAN COME BACK AND SEE HOW MUCH HE OWED. SO I GUESS AT THIS TIME ALL I'M SEEING IS IF THERE IS ANY WAY THEY CAN REDUCE THIS FINE BECAUSE HE NEVER RECEIVED THE FIRST LETTER. IT NEVER CAME TO OUR HOUSE. WHERE DOES HE RESIDE? 1261 CONNECT ROAD. AND WHAT'S THE CITY'S RESPONSE? THIS PROPERTY WAS POSTED. PROPERTY'S BEEN INSPECTED. THERE ARE CURRENTLY NO VIOLATIONS AND THE CITY IS SEEKING THE FINES ACCRUED. WHERE WERE THE NOTICES FORWARDED? THEY WEREN'T FORWARDED. AND WHEN WAS THE WORK PERFORMED ON THE PROPERTY? JANUARY 29TH 2019 BY SANTA CRUZ CONSTRUCTION. DO YOU HAVE ANY RESPONSE TO THE CITY'S POSITION OR THE INFORMATION THAT THEY JUST PROVIDED? I GUESS WHAT SHE'S PROVIDING IS ACCURATE BECAUSE I DON'T KNOW WHEN THEY CLEANED IT. IT HASN'T EVEN BEEN A YEAR SO IT'S LIKE YOU JUST BOUGHT IT WITH HIS SAVINGS FROM HIS LAST YEAR'S OF WORK AND ALL OF A SUDDEN HE'S PAYING ALMOST ONE THIRD OF WHAT HE PAID FOR HIS LAND. BUT THE ISSUE IS IS WHAT THE CITY IS SAYING IS THAT THEY SENT OUT THE NOTICE BY CERTIFIED MAIL WHICH IS WHAT THE STATUTE PROVIDES FOR THEM TO DO AND IT APPEARS THAT YOUR SON DID NOT GO PICK UP HIS CERTIFIED MAIL. BUT THE SECOND ONE WAS WHAT WE GOT WHEN WE CALLED, WHEN HE CALLED. NO I UNDERSTAND BUT. BUT WHEN CERTIFIED MAIL GOES OUT JUST SO YOU KNOW THIS, THAT POST OFFICE TRIES THREE TIMES BEFORE THEY SEND IT BACK IN THIS CASE TO THE CITY. SO I'M JUST SAYING IF THEY SENT THE CERTIFIED MAIL OUT  THE REASON YOUR SON DID NOT GET THE NOTICE WAS BECAUSE HE DIDN'T GO PICK IT UP AND THE POST OFFICE DOESN'T DO IT ONE TIME. BASED UPON THE INFORMATION PROVIDED AND THE NATURE OF THE VIOLATION, THE LENGTH OF TIME, THE FACT THAT THIS IS A VACANT LOT, THE FACT THAT THE CITY CURED IT AND THE EXPENSE OF THE $290.21 THAT'S IN THE ONE SHEET  THAT I HAVE, I'M GOING TO REDUCE THE TOTAL

I ACTUALLY PURCHASED THAT MORTGAGE THAT WAS IN FORECLOSURE AND THE FORECLOSURE FINISHED OUT THROUGH MY ATTORNEY. A LITTLE  BIT BECAUSE I WAS MANAGING IT FOR SO LONG THROUGH THE MANAGEMENT COMPANY. PRIOR TO THAT I WOULD HAVE TO LOOK AT THE DEED. WAS THIS CODE VIOLATION THAT  THIS IS THE SUBJECT MATTER OF WAS THAT A VIOLATION THAT OCCURRED WHILE YOU WERE MANAGING THE PROPERTY? NO THAT WAS  WHEN MR. CHRISTOPHER MARR WAS ACTUALLY LIVING THERE. THERE WAS A CODE VIOLATION LAST YEAR ABOUT A CAR BEING PARKED THERE AND I WORKED WITH CODE ENFORCEMENT IMMEDIATELY AND GOT THAT RESOLVED AND FOLLOWED UP TO MAKE SURE THAT IT WAS RESOLVED. MS. MARTINEZ WITH RESPECT TO THIS PROPERTY ARE YOU AWARE OF ANY OTHER VIOLATIONS ON THE PROPERTY OTHER THAN THE ONE THAT'S THE SUBJECT OF THIS ACTION AND THE ONE THAT MS. NO OTHER VIOLATIONS HAVE BEEN ON THE PROPERTY.

FOR 42 YEARS PROBABLY. 45 YEARS. 40 SOMETHING  LIKE THAT. OKAY. AND THE CITY INCURRED A COST TO ACTUALLY MOW THE PROPERTY OR CLEAR THE PROPERTY LINE? CORRECT. THE COST WAS 186.25. MS. GRANE I'M GOING TO REDUCE THE FINE BASED ON THE FACT THIS IS A VACANT LOT, THE NATURE OF THE VIOLATION, THE VALUE OF THE PROPERTY, YOUR PRIOR MAINTENANCE HISTORY THAT YOU DID TAKE CARE OF IT EVERY TIME IN THE PAST AND IT NEVER GOT TO THE POINT OF GOING TO THE BOARD. HOWEVER THE BOARD DOES INCUR COSTS OR THE CITY DOES INCUR COSTS FOR GOING TO THE BOARD AND IT ACTUALLY INCURRED HARD COST IN CLEARING THE LOT  ALONG THE PROPERTY LINE.
