THIS AGENDA ITEM IS FOR SHIP AFFORDABLE HOUSING INCENTIVE STRATEGIES REPORT PURSUANT TO HOUSE BILL 1339, ADOPTED DURING THE 2020 FLORIDA LEGISLATIVE SESSIONS.

PURSUANT TO HOUSE BILL 1339, ADOPTED DURING THE 2020 FLORIDA LEGISLATIVE SESSION, EACH AFFORDABLE HOUSING ADVISORY COMMITTEE MUST NOW ANNUALLY REVIEW THEIR LOCAL GOVERNMENTS, ESTABLISHED POLICIES AND PROCEDURES, ORDINANCES, LAND DEVELOPMENT REGULATIONS, AND COMPREHENSIVE PLAN, AND RECOMMEND SPECIFIC ACTIONS OR INITIATIVES TO ENCOURAGE OR FACILITATE AFFORDABLE HOUSING WHILE PROTECTING THE ABILITY OF POPPE OF PROPERTY TO APPRECIATE AND VALUE.

THE DRAFT AHAC REPORT WAS REVIEWED BY THE BOARD ON NOVEMBER 15TH, 2023, AND THE FOLLOWING SUMMARIZES THE BOARD'S DISCUSSIONS.

SO THERE WAS DISCUSSION BY THE BOARD IN REGARD TO WHETHER THE AFFORDABLE HOUSING PERMIT FEE WAIVER WOULD APPLY TO ADUS, AND STAFF CONFIRMED THAT YES, IT WOULD APPLY AS LONG AS THE ADU MET THE DEFINITION OF AFFORDABLE HOUSING.

SURE. WHAT IS THE DEFINITION? SO IS THERE A WHAT IS THE ARMY FOR AFFORDABLE.

UP TO.

IT WOULD DEPEND ON WHAT WHAT SHIP IS, BUT I GUESS.

SO BETWEEN IS THAT IN THE DEFINITION? THAT'S WHAT I'M ASKING.

FOR US. IF YOU'RE TALKING ABOUT SHIP THAT THE ARMY WOULD BE 80% OR LOWER.

BUT WE CAN DEFINITELY FIRM UP.

AM I UNDERSTANDING, MISS BEARD, THAT YOU ARE JUST ASKING WHETHER OR NOT THAT LANGUAGE IS IN THE, UM, OUTLINE FOR THE ADU, THAT IT IDENTIFIES IT AS, UM, WITHIN SHIP LIMITS.

I JUST WANTED TO GET THE DEFINITION OF AFFORDABLE.

YOU SAID IT WAS AS LONG AS IT WAS IN THE DEFINITION WITHIN THE DEFINITION OF AFFORDABLE, I JUST ASSUMED THAT WOULD THAT DEFINITION WOULD INCLUDE AN AMI FOR SHIP.

YES, THERE IS AFFORDABLE HOUSING FOR AMI, BUT IT DEPENDS.

THAT'S SET BY THE STATE AND IT'S NORMALLY 80% FOR SHIP OR BELOW.

BUT THIS WOULDN'T BE UNDER SHIP BECAUSE THEY WOULD JUST BE GETTING PERMITS.

WAIVED PERMITS. IT DEPENDS.

WHAT. WELL, YES, I SEE WHAT YOU'RE SAYING.

UM, SO WE WOULD HAVE TO SEE WE'D HAVE TO HAVE MORE DISCUSSION.

OKAY. BECAUSE THAT DEFINITION OF AFFORDABLE HOUSING, IT DEPENDS ON THE GRANT THAT YOU'RE WORKING WITH.

BUT THEY WOULDN'T BE WORKING WITH A GRANT.

THEY WOULD JUST BE SAYING I'M.

BUT YEAH, SO CAN WE CAN WE PUT THAT AS A NOTE TO NEXT MEETING.

HAVE A DEFINITION FOR PERMIT WAIVERS.

WHAT OUR DEFINITION OF AFFORDABLE IS GOING TO BE.

SURE. ABSOLUTELY. THANK YOU.

UM THE SECOND BLOCK OR BULLET IS THERE WAS DISCUSSION BY BOARD MEMBER BEARD AS TO REDUCING OR WAIVING IMPACT FEES FOR EXTREMELY LOW INCOME 30% OR BELOW.

UM, IT HAS BEEN DETERMINED THAT THE CITY WOULD BE WILLING TO OFFER A DEFERMENT OF FEES, BUT NOT SUPPORTIVE OF REDUCING OR WAIVING IMPACT FEES.

THE THIRD BULLET WAS THAT THERE WAS A DISCUSSION BY THE BOARD OF AMENDING ORDINANCE 20 2273, WHICH ALLOWS FOR THE ADMINISTRATIVE VARIANCE THAT INFORMS.

THAT INVOLVES MATTERS SUCH AS SETBACKS, FLOOR AREA RATIOS, FRONTAGE REQUIREMENTS, SUBDIVISION REGULATIONS, HEIGHT LIMITATIONS, LOT COVERAGE, SIZE RESTRICTIONS, YARD REQUIREMENTS, PARKING, AND OTHER VARIANCES WHICH HAVE NO RELATION TO CHANGE OF USE OF THE PROPERTY IN QUESTION.

AND THIS ORDINANCE WAS APPROVED ON JULY 21ST, 2020 AT THE 20% ADMINISTRATIVE VARIANCE AND ANY PERCENTAGE INCREASE ABOVE THAT WOULD BE A COUNCIL DECISION. AND THOSE WERE THE THREE BULLETS.

UM, THIS REPORT IS DUE TO FLORIDA HOUSING FINANCE CORPORATION FOR DECEMBER 31ST, 2023.

UM, AND WE ARE ASKING THE COMMITTEE IS REQUIRED TO VOTE ON THE STRATEGIES AND TO SOLICIT PUBLIC COMMENT ON THE REPORT AS IT'S BEING CONSIDERED FOR ADOPTION.

DO WE HAVE ANY DISCUSSION FROM THE BOARD ON THE REPORT? UH, JUST WANT TO NOTE THAT I STILL THINK THAT WE SHOULD BE DOING MORE TO BRING IN AFFORDABLE HOUSING.

UM, AS I NOTED IN THE LAST MEETING.

ANY OTHER COMMENTS OR ANYONE WANT TO ENTERTAIN A MOTION ON THAT ONE? I ACTUALLY AGREE, SO WHAT DO I GIVE A SECOND? YES, I AGREE WITH THAT STATEMENT.

OKAY. AND UM, I THINK THERE SHOULD BE MORE DISCUSSION AND MORE OPPORTUNITY TO EDUCATE BECAUSE I THINK A LOT OF THE ISSUE HAS TO DO WITH EDUCATION.

YOU KNOW, THERE ARE PEOPLE WHO DON'T WANT THESE TYPES OF, UM, LOW INCOME HOUSING, AND IT COMES WITH A WHOLE, UM, STIGMA.

AND I THINK THAT THAT STIGMA NEEDS TO BE ADDRESSED IN A POSITIVE WAY AND HOW OUR CITY IS UNIQUE ONTO ITSELF TO BEGIN WITH, AND THAT THIS PRESENTS A POSITIVE FOR THE CITY, ESPECIALLY IF WE'RE NOT LOWERING THE IMPACT FEES.

OKAY, TO DO THESE, UM, ADUS, BECAUSE THERE'S OBVIOUSLY SERVICES THAT NEED TO BE PROVIDED TO THE PEOPLE WHO ARE GOING TO OCCUPY THE UNITS.

BUT I DO THINK EDUCATION AND I AGREE WITH MY FELLOW BOARD MEMBER WHO THINKS THAT WE NEED TO DO MORE JUST AND JUST SO YOU KNOW, UM, I DID SOME RESEARCH AND I DON'T HAVE THE NUMBERS IN FRONT OF ME, BUT OBVIOUSLY, WE ALL KNOW PALM BAY'S POPULATION IS MUCH LARGER THAN, SAY, MELBOURNE'S POPULATION, 135,000 PER THE DEPUTY CHIEF.

AND THEIR SO THE NUMBER OF ASSISTED UNITS THAT THEY HAVE AFFORDABLE ASSISTED UNITS IS PROBABLY UH IT WAS LIKE TEN TIMES MORE THAN OURS.

SO WE HAVE A TON MORE RESIDENTS AND WE HAVE SO FEW ASSISTED UNITS THAT ARE AVAILABLE.

SO SOMEBODY ON A LOW INCOME CAN'T LIVE.

THEY JUST THE UNITS AREN'T IN PALM BAY.

SO I JUST FEEL LIKE AS A CITY THAT IS AS LARGE AS PALM BAY IS, IT HAS THE POPULATION AS HIGH AS WE DO.

WE REALLY NEED TO WORK TOWARDS BRINGING IN THOSE EARLY UNITS, THE, YOU KNOW, THE AFFORDABLE UNITS.

AND I JUST FEEL LIKE, I THINK TO DO MORE THINGS TO INCENTIVIZE.

I THINK IT'S NOT JUST EDUCATION, BUT I THINK IT'S ALSO PROVIDING FINANCING AND ACCESSIBILITY TO FINANCING, BECAUSE NOT EVERYBODY CAN COUGH UP 60 GRAND IN A SITTING, POSSIBLY.

OKAY. AND MOST OF THESE UNITS THAT I'VE SEEN HAVE BEEN RUNNING AT MINIMUM AT THAT AND MORE.

OKAY. SO I THINK THAT THERE'S A TWO FOLD ISSUE.

I THINK IT'S NOT JUST EDUCATION, BUT IT'S ALSO A FINANCIAL BARRIER IN, UM, GETTING INSTITUTIONS, WHETHER IT'S THE CREDIT UNIONS, OKAY, OR THE BANKS HERE LOCALLY THAT SUPPORT THIS AND PARTNER WITH THE CITY IN PROVIDING SOME OF THE EDUCATION.

THEY BENEFIT FROM THIS.

AND THAT'S WHY I BROUGHT UP SOME OF THE STRATEGIES ABOUT, YOU KNOW, SAY LIKE THE PARKING REDUCTION.

AND I KNOW THAT THE A DEVELOPER CAN COME BEFORE CITY, THE CITY COUNCIL.

BUT I'LL GIVE YOU AN EXAMPLE.

WE HAVE A PROJECT CALLED SPACE COAST COMMONS, WHICH PALM BAY HAS INVESTED THEIR THEIR FUNDS IN.

WE'RE BRINGING 31 UNITS TO PALM BAY.

THAT WILL BE WILL HAVE L UNITS AT THE HIGHEST AMI WILL HAVE IS 60%.

SO WE'RE BRINGING IN THOSE LOW INCOME UNITS.

UM, BUT I WAS JUST EXPLAINING TO TO CITY THE CITY.

I CAN'T TALK TONIGHT. SORRY.

WE WERE ABOUT TO SO WE WE NEEDED A PARKING REDUCTION JUST AS AN EXAMPLE.

WE DID GET THE 20% AND WE WERE ABLE TO MAKE IT WORK, BUT IF WE HAD NEEDED THAT 50% AND HAD TO COME BEFORE COUNCIL, WE WOULD HAVE MISSED THE BOARD MEETING THAT WE WERE, UM,

HAD TO GET APPROVED BY.

IF WE HAD MISSED THAT BOARD MEETING, IT WOULD HAVE COST US ALMOST $100,000 IN A PENALTY.

SO THAT'S WHY, YOU KNOW, I FEEL LIKE IT'S WE NEED TO MAKE IT EASIER FOR THESE PROJECTS TO COME IN HERE, BECAUSE THESE PROJECTS THAT ARE RUNNING AT THAT LOW AMI, THEY ARE DOING EVERY THEY CAN, EVERYTHING THEY CAN TO PUT THE MONEY TOGETHER AND THEN THE RENT AMOUNTS THAT THEY'RE ABLE TO CHARGE AN LG UNIT I THINK IS LIKE 388.

I DON'T HAVE THE NUMBERS IN FRONT OF ME, BUT THEY'RE VERY LOW RENTS.

AND SO IT JUST THE MORE WE CAN DO TO MAKE IT EASIER WHEN IT MAKES SENSE, NOT EVERY TIME.

IT'S NOT GOING TO MAKE SENSE EVERY TIME TO REDUCE PARKING BY 50%.

BUT WHEN IT MAKES SENSE TO TAKE OUT THE STEP OF HAVING TO GO IN FRONT OF THE CITY COUNCIL IS JUST WE DON'T ALWAYS KNOW WHAT THAT CAN AFFECT THE DEVELOPER. AND $100,000 IS A LOT OF MONEY TO AFFECT A NON PROFIT DEVELOPER.

SO THAT'S WHY I JUST KIND OF WANT TO GO ON THE RECORD SAYING THAT.

THAT'S WHY I BROUGHT UP A LOT OF THESE BECAUSE I FEEL LIKE WE REALLY NEED.

TO INCENTIVIZE SOME OF THESE LOWER COST UNITS, THE LOWER ELLIS AND THE AMIS.

SO BACK TO, UM, I THINK EDUCATION IS NECESSARY, AND I DON'T KNOW WHAT WE NEED TO DO AS A COMMITTEE TO FURTHER THE EDUCATION AND ACCESSIBILITY FOR THE RESIDENTS HERE TO BE ABLE TO DO WHAT THEY NEED TO SUPPORT THE NEEDS IN THEIR OWN HOMES AND SO FORTH ON THEIR PROPERTIES, ETC..

I MEAN, THERE'S GOT TO BE GUIDELINES, THERE'S GOT TO BE EXPECTATIONS.

AND I APPRECIATE WITH, UM, BOARD MEMBER UM, BEARD WAS SAYING ABOUT TIMING AND, YOU KNOW, I HAVE SEEN THE COUNCIL AND CORRECT ME IF I'M WRONG, DEPUTY MAYOR, THAT THEY HAVE HAD SPECIAL MEETINGS IF NEED BE, IN ORDER TO ISSUE APPROVALS, IF THERE ARE ISSUES LIKE THIS.

YES. YES.

IN SOME CASES, YES.

OKAY. SO I THINK THAT, UM, OBVIOUSLY ON A CASE BY CASE BASIS, THOSE KINDS OF THINGS ARE GOING TO BE DEALT WITH.

AND I SEE OUR CITY AS TRYING TO BE AS FLUID AND ACCESSIBLE AS POSSIBLE, OKAY.

WITHIN THE CONFINES OF DAY TO DAY BUSINESS.

NOW BACK TO EDUCATION AND ACCESSIBILITY, I THINK.

SO FLORIDA HOUSING COALITION OFFERS EDUCATION ON THEIR WEBSITE, BUT I BELIEVE THEY ALSO ARE ABLE TO COME TO A WORKSHOP, SAY FOR OUR ALL OF US, TO EDUCATE US MORE ON SOME OF THE STRATEGIES THAT ARE BEING USED ACROSS THE STATE BY OTHER CITIES.

I UNDERSTAND, LIKE PALM BAY OBVIOUSLY IS A VERY UNIQUE CITY.

UM, I KNOW I BRING UP MELBOURNE A LOT.

WE'RE VERY DIFFERENT THAN MELBOURNE, AND SO THE STRATEGIES THAT MELBOURNE IS USING ARE NOT ALWAYS GOING TO BE SOMETHING WE CAN USE HERE.

BUT UM, THEY DO OFFER EDUCATION.

I THINK WE, WE JUST NEED TO REACH OUT TO THEM AND SEE IF THEY WOULD COME AND DO A WORKSHOP FOR US.

BECAUSE REALLY, AT THE END OF THE DAY, I THINK THAT'S WHERE THE RUBBER IS GOING TO HIT THE ROAD.

SO BREVARD COUNTY DOES HAVE AN AFFORDABLE HOUSING COMMITTEE THAT MEETS REGULARLY, UM, MONTHLY.

I BELIEVE THEY'VE HAD DISCUSSIONS ABOUT THE WILLINGNESS TO COME BEFORE THIS BOARD AND PUT ON A WORKSHOP SPECIFICALLY TO AFFORDABLE HOUSING IN BREVARD COUNTY.

SURE. UM, OTHER NONPROFIT DEVELOPERS OTHER THAN VOA.

UM, I KNOW THAT THERE'S COMMUNITY OF HOPE.

UM, HOUSING FOR THE THEY JUST CHANGED THEIR NAME.

IT'S NOT HOUSING FOR HOMELESS ANYMORE, BUT IT'S THE BREVARD HOUSE.

YEAH. THIS COALITION, AS I UNDERSTAND, NO, THE, UM, ROB CRAMP'S ORGANIZATION THAT IS BUILDING AFFORDABLE UNITS IN COCOA.

THEY ARE ALSO DOING AFFORDABLE HOUSING DEVELOPMENT AS WELL.

SO THERE'S AND THERE'S DEFINITELY THE FLORIDA HOUSING COALITION WILLINGNESS TO COME AND MEET WITH US AND TRAIN US.

UM, AND THEN THERE'S ALSO THE FLORIDA HOUSING FINANCE CORPORATION, WHO WOULD PROBABLY BE WILLING TO COME DOWN OR PROVIDE SOME KIND OF TRAINING.

BUT THERE'S THE FLORIDA HOUSING COALITION HAS A TON OF RECORDED TRAININGS ALREADY ON THEIR WEBSITE.

AND THE REASON I KNOW, BECAUSE I'M I HAVE TO GO TO THEM.

I HAVE TO DO THEM WHEN THEY'RE ACTUALLY DOING THEM ALL THE TIME.

SO I DON'T KNOW IF IT'S SOMETHING WHERE YOU ASK MAYBE THE THAT AFFORDABLE HOUSING, BREVARD COUNTY'S AFFORDABLE HOUSING COMMITTEE TO MAYBE PUT TOGETHER A COUPLE OF THOSE THAT WOULD BE HELPFUL FOR US TO WATCH, OR IF THEY COME IN AND JUST PRESENT ON THEM IN PERSON.

BUT I THINK THERE'S A WILLINGNESS BY MULTIPLE AGENCIES TO COME IN AND AND EDUCATE US AND ANSWER QUESTIONS THAT YOU GUYS, ANY OF US MIGHT HAVE.

SO ARE YOU SAYING THAT THEY'RE GOING TO COME IN HERE TO EDUCATE US ON HOW THEY'RE GOING TO PROVIDE EDUCATION TO THE PUBLIC? BECAUSE I THOUGHT THAT'S WHAT WE WERE TALKING ABOUT.

I THOUGHT WE WERE TALKING ABOUT TRYING TO CREATE SOME SORT OF A VEHICLE THAT PROVIDES EDUCATION TO THE PUBLIC.

I THINK KIRA IS TALKING ABOUT TRAINING FOR BOARD MEMBERS SO THAT WITH THAT AND STRATEGIES, OTHER STRATEGIES THAT ARE BEING IMPLEMENTED, OTHER PLACES THAT ARE WORKING AND HOW THEY'RE WORKING AND THINGS LIKE THAT.

AND THAT'S SOMETHING THAT NEEDS TO BE ADDRESSED AT THE STAFF LEVEL.

AND IF THE CITY MANAGER, IF YOU KNOW WHAT, WHAT HER DIRECTION IS TO HER STAFF ON HOW HOW THEY'RE HANDLING THESE ADMINISTRATIVELY, YOU DON'T WANT TO BE OUT IN THE PUBLIC SAYING, PLEASE COME TO PALM BAY BECAUSE WE'RE GOING TO PUSH THESE PROJECTS THROUGH IF THAT'S NOT WHAT STAFF IS REALLY DOING.

UM, I THINK THERE'S SOME OTHER ELEMENTS HERE.

BEFORE YOU'RE TALKING ABOUT PUSHING IT OUT TO THE PUBLIC THAT PROBABLY NEED TO BE WORKED ON.

UH COUNCIL. WE WERE ABLE TO SET ASIDE A GOOD AMOUNT OF, UH, UPPER, UH, UP, YOU KNOW, UM, THE AMERICAN RESCUE FUND OR THE COVID FUNDING, WHERE WE'RE ABLE TO SET ASIDE A LOT OF FUNDING FOR TOWARD THAT GOES TOWARDS AFFORDABLE HOUSING, UM, SOCIAL SERVICES AND HOMELESSNESS.

SO AS THAT MONEY GOT DISTRIBUTED BASED ON THE APPLICATIONS WE RECEIVED, AND I REFLECT QUITE A BIT ON THAT.

UM, SO I SAID A LOT TO SAY THIS.

WE GOT TO FIND A WAY WHERE WE SEND MESSAGES, WHERE BRING SOLID PROJECTS, REAL AFFORDABLE HOUSING PROJECTS THAT THAT REALLY, UM, MAKE IT WORTHWHILE TO SPEND THOSE DOLLARS.
