[PUBLIC COMMENTS/RESPONSES (Part 1 of 2)]
MR. BLAND. TIM BLAND.GOOD EVENING EVERYBODY TIM BLAND.
1992 TWINBROOK DRIVE, SOUTHEAST PALM BAY, FLORIDA.
I'D LIKE TO SHOUT A BIG THANKS TO GETTING WALDEN DONE IN ADVANCE OF WHAT THE ESTIMATE WAS.
THAT WAS OVER THERE IN MY GOLF CART THE OTHER DAY, AND THE SITE MANAGER JUMPS OUT OF HIS TRUCK.
HE'S ON A CONFERENCE CALL AND HE'S GOING, MR. BLAND, MR. BLAND, I DIDN'T EVEN KNOW HE KNEW ME.
I WAS JUST CHECKING ON PROGRESS.
HE TOLD ME THAT IT WOULD BE, YOU KNOW, PROBABLY A WEEK BEFORE CHRISTMAS.
GETS ME TO THE HABITAT GOLF COURSE A LOT QUICKER THAN GOING DOWN WACO.
SO, UH, SO WE'VE GOT A NEW PLAN FOR FOR THE MAJOR'S GOLF COURSE.
AND, UH, IT WAS MISSING HOLES 13, 14 AND 15.
SO NOW TODAY WE'VE GOT, UH, PUBLIC INFORMATION, UH, A NEW PRE-PLANNING APPLICATION THAT I THINK WAS REJECTED FOR INCOMPLETE INFORMATION.
BUT AGAIN, THE SAME THING APPLIES.
WHAT'S HAPPENING TO HOLES 13, 14 AND 15? ARE THEY BEING ABANDONED TO THE CITY? DON'T KNOW. IT'S CRAZY, CRAZY STUFF, BUT I GUARANTEE YOU I'LL HAVE THE RED SHIRTS OUT FOR THE PLANNING AND ZONING AND CITY COUNCIL ON ALL THE MEETINGS COMING UP FOR THIS PROJECT.
BRAMBLE WOODS COMING UP IN THE 1ST OF JANUARY TO THE PNC.
ALL THOSE TOWNHOMES OVER THERE.
NOT A GOOD FIT. NOT A GOOD FIT IN BAYSIDE LAKES.
NOT A GOOD FIT FOR THAT AREA WITH ALL SINGLE FAMILY HOUSING.
UH, WE'RE GOING TO HAVE A PRETTY FULL, UH, TURNOUT FOR THAT AS WELL.
I'M ASKING YOU GUYS, YOU KNOW THERE'S INFRASTRUCTURE NEEDS IN THIS CITY.
I SEE THE THE ROADS, THE LIGHTS, THE TRAFFIC.
BUT IT'S SO GROWING AND GROWING AND GROWING AND GROWING AND GROWING AND GROWING.
YOU GOT TO SLOW DOWN THIS GROWTH, ESPECIALLY THIS BIG GROWTH.
YOU KNOW, A HOUSE HERE, A HOUSE THERE, A HOUSE THERE.
THESE BIG DEVELOPMENTS 200, 300, 400 UNITS, NOT SO GOOD.
INFRASTRUCTURE NEEDS TO CATCH UP.
[00:30:03]
AND THEN FOR THE INFRASTRUCTURE, HOW ARE YOU ALL GOING TO PAY FOR IT? HOW ARE YOU ALL GOING TO WIDEN ROADS THAT NEED TO BE WIDENED? BABCOCK NEEDS TO BE FOUR LANES, NOT TWO.UH, MALABAR IS CRAZY IN THE MORNING.
NEXT SPEAKER, MR. GARY OF ALFREDO.
YEAH. GOOD NIGHT. GOOD NIGHT TO THE MAYOR.
BRING IT UP. YEAH. GOOD NIGHT.
GOOD NIGHT. EVERYONE. STAFF AND EVERYONE.
UM, THIS ALPHA GUY FROM 1680 MAIN STREET, NORTHEAST PALM BAY.
UM, I GOT A SITUATION HERE WHERE I WANT TO.
WE HAVE A CHRISTMAS LIGHT PARADE.
UM, BASICALLY, IT'S CALLED HOLIDAY.
THIS PARADE, BASICALLY WHAT I'M TRYING TO PUT FORWARD IS I'M A LITTLE DISAPPOINTED IN THE IN THE JUDGES ON THIS, UM, ON OUR CHRISTMAS LIGHT PARADE BECAUSE IT'S CLEARLY STATED HERE THAT, UM, THE TEAM OF THE LIGHT PARADE IS LIGHT UP YOUR ENTRY IN TRADITIONAL HOLIDAY SPIRIT COLORS.
THIS IS WHAT I DID FOR QUITE A FEW YEARS, AND I WAS RECOGNIZED ALONG THE WAY AND AWARDED, UH, FOR MY EFFORT.
UM, IN THIS TIME AROUND, UH, THE FLOAT PARADES, STILL MOST OF THE FLOATS, NOT EVEN COLORFUL.
IT'S NOT LIKE IT'S NOT LIGHTED LIKE, UM, IT IS A LIGHT PARADE.
IT'S JUST A BASIC ENTRY, YOU KNOW? AND I THOUGHT THAT, UM, I WOULD BE RECOGNIZED BECAUSE, UH, YOU KNOW, IN MY OPINION AND MANY OTHERS, A LOT OF CITIZENS THAT COMPLIMENT ME AND MY PRESENTATION AND I THINK I DID WELL.
THIS IS NOT SOMETHING THAT WE NEED TO THINK ABOUT.
UM, THIS SLIDE PARADE IS OBVIOUS.
UM, IT'S JUST LIKE A DANCING CHANNEL ON THE TV.
UH, EVERYBODY PERFORM, AND YOU SEE WHO DO DO A BETTER DANCE.
SO, UM, ALL I'M JUST SAYING IS THAT WE NEED TO, YOU KNOW, YOU KNOW, RESPECT AND TREAT THE ENTRIES OF THIS PARADE IN A MANNER THAT PEOPLE CAN FEEL SATISFIED.
I HAVE A FEW VIDEO HERE JUST TO KIND OF HIGHLIGHT WHAT THE FLOAT PARADE WAS ALL ABOUT.
THIS IS WICKES'S ENTRY, AND I THINK IT MATCHES THE THEME OF THIS EVENT.
AND I WASN'T I WASN'T MEANING, UM, YOU KNOW, RECOGNIZED OR, OR REWARDED FOR MY ENTRY.
AND I JUST FEEL REALLY DISAPPOINTED.
AND, UH, A LOT OF CITIZENS HAD CALL ME AND COMPLAINING AND SAY, I CAN'T BELIEVE.
YOU KNOW, I TALKED TO THE CITY STAFF.
BUT I LOOK IN THE IN THE SCORE SHEET, AND I WASN'T THERE A COUPLE OF YEARS AGO.
UM, SO YOU GOT ONE MORE TO THANK YOU, MISTER GARY.
I APPRECIATE YOU BRINGING THIS TO US.
YES, SIR. BUT AGAIN, LIKE YOU SAID, THERE WERE JUDGES AND.
NOW, WE COULD GET INTO THE SEMANTICS OF THAT, BUT, UM.
I DON'T KNOW WHAT POSITION YOU CAME IN.
UH, BUT CERTAINLY YOU HAD AN OUTSTANDING FLOAT.
THE COMMUNITY SAW THE FLOAT, AND I CAN TELL YOU THAT WE ENJOYED THE FLOAT WHETHER YOU PLACED OR NOT.
SO I'M SORRY YOU DIDN'T PLACE.
HOWEVER, THE JUDGES DECISIONS ARE FINAL, SO IDEALLY YOU'LL YOU'LL BE ABLE TO PLACE NEXT YEAR.
LET ME ENCOURAGE YOU TO TO PARTICIPATE.
AGAIN. IT'S JUST SOMETHING TO ENCOURAGE, YOU KNOW, PARTICIPANTS.
NO, I DON'T WANT TO MAKE A DIALOG ON A CONTINUAL BASIS REGARDING THIS.
THE JUDGE'S DECISION WAS FINAL.
[00:35:08]
YEARS. NO.WELL, YOU'VE DONE AN OUTSTANDING JOB.
AND BASICALLY WHAT IT WAS IS I DON'T WANT TO, SIR.
WE GOT WE GOT TO GET EVERYBODY, SIR.
BUT I REALLY APPRECIATE YOUR ENTRY.
PAT DALPRA, 14 GEORGE'S AVENUE, NORTHEAST PALM BAY.
AND, UH, I APPRECIATE HIS, UH, POSITIVE, UH, ENCOURAGEMENT AND.
WORKING WITH THEM. SO THANK YOU GREG.
AND I TALKED TO HIM ABOUT THE WATER PROBLEM BEHIND MY LOT AND SEVERAL OTHER NEIGHBORS.
SO I'M HOPING THAT THE CITY CAN HELP US TO RECTIFY THAT.
I WOULD ALSO LIKE TO ASK IF WE CAN PUT FORTH SOME SORT OF ORDINANCE, THAT DRAINAGE NEEDS TO BE TAKEN CARE OF FIRST, SO THAT WE KNOW WHERE THE WATER IS FLOWING.
RIGHT NOW. THE WATER IN MY AREA IS JUST SITTING.
IT HAS NO PLACE TO GO, AND I SEE THAT IN MANY OTHER PLACES.
SO IF THE CITY CAN KIND OF WORK ON THAT, THAT WOULD BE GREAT.
I ALSO WANT TO WISH YOU ALL A MERRY CHRISTMAS, HAPPY HANUKKAH AND UH, A LITTLE CONCERNED TODAY, GOING AROUND TO THE DIFFERENT BUSINESSES THAT THERE ARE NO CARDS AND NOTHING FOR HANUKKAH.
SO THAT'S NOT THE CITY'S PROBLEM.
I DON'T KNOW WHAT THE ISSUE IS, BUT I JUST WANT TO PUT IT OUT THERE.
IT'S LIKE, WHERE ARE THE HANUKKAH CARDS? SO ANYWAY, WE ARE SUPPOSEDLY SUPPORTING ISRAEL AND AGAINST ANTI-SEMITISM.
SO IT'S LIKE, THAT'S JUST A CURIOSITY QUESTION.
YEAH. THANK YOU. AND ON ON YOUR NOTE OF ANTI-SEMITISM, I WILL SAY THAT THE BOARD OF COUNTY COMMISSIONERS DID ADOPT THE SAME RESOLUTION THAT WE DID REGARDING THE DEFINITION OF ANTI-SEMITISM, UH, WHICH WAS RECOMMENDED BY THE INTERNATIONAL HOLOCAUST REMEMBRANCE ALLIANCE.
STICE. GOOD EVENING. ROBERT STICE, 1796 LYNBROOK DRIVE, SOUTHEAST.
UM, AS A SIDE NOTE, UM, IF I CAN STOP THERE, IF YOU'RE HAVING, UH, CELEBRATING, UM, RESTAURANT AND PRIVATE BUSINESS OR WHAT HAVE YOU, IT'D BE NICE IF YOU PUT THEM ON A TV MONITOR SO PEOPLE CAN SEE THEM AND TAKE SOME NOTES IF THEY NEED TO.
ANYWAY, IN MY OPINION, IN MY OPINION, IN MY OPINION.
UM, I TALKED TO YOU ABOUT NUMBERS.
WE HAVE 5400 PEOPLE COMING IN PER YEAR IN PALM BAY.
ACCORDING TO THE STATS THAT PALM BAY IS THE NINTH FASTEST GROWING CITY.
THAT'S 27,000 A YEAR IN FIVE YEARS.
I'M SORRY. WE'RE GOING TO HAVE 27,000 NEW RESIDENTS IN FIVE YEARS.
IN TEN YEARS, THAT GOES TO 189,000.
YOU FOLKS HAVE SO MANY CHALLENGES IN FRONT OF YOU.
TIM WAS MENTIONED INFRASTRUCTURE.
BUT MY QUESTION TO YOU IS HOW MANY RESIDENTS, HOW MANY HOMES, HOW MANY NEW BUILDS DOES IT TAKE TO RUIN A NEIGHBORHOOD, IN THIS CASE BAYSIDE LAKES? YOU CAN REACH A POINT THAT IT BECOMES SATURATED, UM, PUBLIC'S HEALTH CARE SCHOOLS OR WHAT HAVE YOU.
I CAN'T BELIEVE I BLINKED, AND I AND I'VE BEEN HERE ABOUT SEVEN YEARS.
SO YOU LOOK AT ABOUT 180, 89,000 PEOPLE IN IN PALM BAY.
HOW ARE WE GOING TO HANDLE THAT? POLICE, FIREMEN, ROADS? I THINK ONE OF THE THINGS I WANT TO PUSH HERE IS PLEASE FOCUS ON THE EXISTING ZONING.
LET'S LOOK AND TAKE A HARD LOOK AT KEEPING IT.
IN THIS CASE WHERE THE FORMER MAJORS IS AT FIVE ACRE LOTS.
[00:40:01]
BECAUSE TRULY, I THINK YOU ALL CAN UNDERSTAND THE THE LOGIC OF IF YOU PUT ANOTHER 307 HOMES IN A NEW DATA TODAY WAS UM, UH, THAT WE GOT WAS TOWNHOMES, SINGLE FAMILY HOMES.AND OH, BY THE WAY, WE'LL HAVE 25 ACRES FOR COMMERCIAL PROPERTY.
UM, I FOUND THAT REAL INTERESTING.
AND I DON'T KNOW IF THAT WAS A, UH, WE USED TO CALL IT.
WELL, WE CALLED IT A TEASER IN ANOTHER LIFE.
UH, BUT. HOW MUCH INFRASTRUCTURE AND RESIDENTS COMING IN BEFORE IT STARTS BREAKING AT THE SEAMS AND IT WILL FIRE, FIRE TRUCKS, EMERGENCY VEHICLES, POLICE, ALL THE INFRASTRUCTURE THAT GOES IN.
IT'S NOT CHEAP. AND I THINK WHAT I'M SEEING NOW, WE CAN'T AFFORD IT NOW.
SO PLEASE TAKE A LOOK WHEN YOU WHEN YOU WANT TO CONSIDER GOING FROM, UH, ELIMINATING, UH, PRIVATE PROPERTY OR ELIMINATING RESIDENTIAL AND MOVING INTO COMMERCIAL.
THIS CONCLUDES PUBLIC COMMENT, SIR.
OKAY. THANK YOU. WE ARE NOW ON CONSENT.
[APPROVAL OF CONSENT AGENDA]
THE FOLLOWING ITEMS WERE PULLED.JUST THIS COUNCIL WISH TO PULL ANY OTHER ITEMS. I NEED A MOTION.
MOTION TO APPROVE A CONSENT AGENDA ITEM WITH THE EXCEPTION OF TWO, FOUR, NINE, 11, AND 12.

CHIEF. ANYONE ELSE? BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.FIRST, I'D LIKE TO SAY GOOD JOB ON EXTENDING THE TIME FRAME OF THIS, AND IT CAME QUICK.
FOR IT TO SUNSET, AND I'M GLAD YOU DID NOT LET IT SET.
AND I'M GLAD IT'S CONTINUING ON, BECAUSE THE INFRASTRUCTURE ADVISORY BOARD PROVIDES A LOT OF INFORMATION FOR THE CITIZENS, SO THEY DON'T KNOW WHAT'S GOING ON, TO GIVE THEM A LITTLE BIT OF A HEADS UP SO THEY CAN GAIN A LITTLE BIT OF KNOWLEDGE BEFORE THEY HAVE TO COME AND ADDRESS YOU.
ALL RIGHT. I JUST WISH WE HAD THAT SAME OPPORTUNITY WITH SOMETHING LIKE THE BUDGET ADVISORY BOARD.
THANK YOU. ANYONE ELSE WISH TO SPEAK FOR AGAINST THIS ITEM? I'M CLOSING THE PUBLIC HEARING AND ASKING FOR A MOTION.
SO MOVED. SECOND, GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.

SO MOVED. SECOND, GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ALL IN FAVOR SIGNIFY BY SAYING AYE.
ITEM NUMBER FOUR, MR. RODRIGUEZ. ORDINANCE 2020 3-106, AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE OF THE CITY OF PALM BAY BY CHANGING THE ZONING OF PROPERTY FROM RS.
TWO SINGLE FAMILY RESIDENTIAL DISTRICT AND SRI SUBURBAN RESIDENTIAL ESTATE CATEGORY TO RR RURAL RESIDENTIAL DISTRICT, WHICH PROPERTY IS LOCATED SOUTH OF AND ADJACENT TO ALCANTARA STREET IN THE VICINITY BETWEEN CALCUTTA AND CHAMBERLAIN AVENUES AND LEGALLY DESCRIBED HEREIN, PROVIDING FOR A CHANGE OF THE ZONING MAP.
PROVIDING FOR AN EFFECTIVE DATE.
I'M GOING TO OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO PRESENT THEIR CASE.
I REPRESENT MICHAEL AND REBECCA CRUZ.
UH, THIS IS OUR FAMILY BUSINESS FOR THE LAST 29 YEARS.
LOCATED AT 242 ALCANTARA STREET.
UH, WE PURCHASED THE FRONT PIECE OF PROPERTY THAT WAS COVERED IN AUSTRALIAN PINES.
AND THEN WE HAVE TO GET IT REZONED.
SO WE'RE REZONING THAT AND OUR ORIGINAL PIECE THAT WE HAD INTO RURAL RESIDENTIAL.
THANK YOU. ANY QUESTIONS? THANK YOU. ANY SPEAKER CARDS? YES, MR. GILBERT.
MAN. WHAT'S GOING ON? I'M GOOD. BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.
I HAVE TWO ITEMS WITH THIS ONE.
THAT WAS JUST A SIMPLE QUESTION.
I KIND OF DOUBT THAT BECAUSE I WENT AND LOOKED AT THE TAXES, BUT IT'S JUST THE FACT THAT THE PURPOSE OF THIS CHANGING WAS SO THEY COULD HAVE A BUSINESS LICENSE, AND THAT JUST CREATED A LITTLE BIT OF CONCERN WITH BILL BATTEN.
THE OTHER THING IS, YOU KNOW HOW I BLESS YOU.
YOU KNOW HOW I FEEL ABOUT RURAL RESIDENTIAL.
THIS IS THE BEST THING I THINK THE CITY COULD EVER DO.
AND THAT'S WHAT BENEFICIAL IS BENEFICIAL TO EVERYBODY BECAUSE OF STAYING RURAL RESIDENTIAL.
I'M GLAD THEY KEPT IT AND WENT TO RURAL RESIDENTIAL.
I'M IN AGREEMENT WITH YOU, UH, MADAM SHERMAN OR MISS JONES? UH, YEAH, I'D HAVE TO CHECK WITH STAFF TO SEE IF THE QUESTION CAN BE ANSWERED.
IT DOES NOTE THE CHANGE FOR THE ZONING OF THE 0.58 ACRES ALONG THE FRONTAGE OF ALCANTARA STREET.
[00:50:04]
UM, TECHNICALLY, IF THEY CAME FOR A RENEWAL WITH THE EXISTING PREEXISTING NON-CONFORMING PIECE, WE WOULD RENEW THAT BUSINESS TAX RECEIPT.IT'S BEEN AN EXISTING USE, UM, WITH THE CITY IN THE PAST.
UM, BUT BECAUSE THEY ARE BRINGING FORWARD AND ESSENTIALLY EXPANDING THEIR PROPERTY TO THAT 0.58 ACRES, IT IS ON HOLD UNDERSTANDING THAT THIS CAME BEFORE PLANNING AND ZONING AND NOW BEFORE CITY COUNCIL.
THANK YOU. ARE THERE ANY SPEAKER CARDS? YES, MR. OLSZEWSKI.
GOOD EVENING, MR. MAYOR. GOOD EVENING.
COUNCIL. MY NAME IS RANDALL OLSZEWSKI.
I LIVE AT 348 BROOK STREET NORTHEAST.
UH, AND MORE IMPORTANTLY FOR THIS, UH, CASE, MY DAUGHTER ATTENDS CHRISTA MCAULIFFE ELEMENTARY.
AND THEN I FOUND IT. AND I SAY GEM OF A PROPERTY BECAUSE I'M PALM BAY.
IT'S A NURSERY. IT'S VERY PRODUCTIVE.
I THINK THAT THIS EXPANSION IS MOST LIKELY TO CONTINUE THAT AND PASS IT TO THE NEXT GENERATION.
I COULDN'T SUPPORT THIS MOTION AND THIS CASE MORE.
I DO SPEAK ON THIS ITEM TO BRING ATTENTION TO THE FRONTAGE OF THIS PROPERTY.
WHAT'S OCCURRING OUTSIDE OF THIS GENTLEMAN AND HIS FAMILY'S GATES? UH, AND THAT IS A DRAINAGE NIGHTMARE ON BRAND NEW PAVED ROADS.
SO AS THE SCHOOL YEAR STARTED, ACTUALLY THE FIRST WEEK OF SCHOOL, THEY REPAVED, STARTED REPAVING ALL OF THE ROADS THAT MAKE UP THE CHRISTA MCAULIFFE PARENT LOOP, WHICH INCLUDE ALL OF THESE BLOCKS MENTIONED IN THIS ITEM.
THROUGH THAT PROJECT GOT DONE.
EVERYBODY DROVE THROUGH IT, WHAT HAVE YOU.
NOW WE HAVE WATER SITTING ON THESE TWO CORNERS THAT ARE MENTIONED ON THE FAR END OF HIS PROPERTY AND ON THE OTHER, AND WHAT WE HAVE IS THE CAR LOOP TRAFFIC DRIVING THROUGH THE HOLES AND BRINGING THAT WATER ACROSS.
WHAT THAT'S DOING IS QUESTIONING THE INTEGRITY OF THESE BRAND NEW CORNERS.
NOW, I AND ALL MY NEIGHBORS ARE SPENDING MILLIONS OF DOLLARS TO REPAVE THESE ROADS.
I RESIDE IN A ROAD THAT'S PHASE FIVE.
THOSE MILLIONS OF DOLLARS WILL NOT REACH MY ROAD.
THAT'S OKAY. BUT WE ALREADY MADE THIS ROAD AND I WOULD JUST HATE TO SEE IT GO TO WASTE.
SO I BROUGHT IT UP TO P AND Z.
I CAN'T SUMMARIZE HIS WORDS TOTALLY, BUT I DID BRING IT UP, UM, YOU KNOW, OFFLINE AS WELL.
I THINK THERE'S A LIFT STATION RIGHT AT THE FRONT OF THE PROPERTY.
SO MAYBE UTILITIES NEED TO GET INVOLVED AND WE NEED TO SOLVE THIS PROBLEM.
UM, BUT RIGHT NOW IT'S A PILE OF DIRT.
SO HE DOESN'T REALLY HAVE MUCH TO WORK WITH.
AND IT'S IT'S JUST ALL CLOGGED UP, AND IT'S RUINING OUR BRAND NEW ROADS, WHICH IS EXACERBATING THE CAR LOOP TRAFFIC PROBLEM, WHICH I THINK EVERY CAR LOOP IN OUR CITY IS A PROBLEM.
UM, MOST NOTABLY THE PINEAPPLE COVE AND LAMAR.
BUT AGAIN, I'LL FOCUS ON THIS ONE.
UM, IT'S EXACERBATED BY THE STANDING WATER, BY THE CORNERS.
UM, AND I JUST OVERALL THINK THAT IF WE CAN FIX THAT DRAINAGE SITUATION, THIS GENTLEMAN AND HIS FAMILY, AND WE'LL HAVE A MUCH MORE PRODUCTIVE COMMUNITY AND WE'LL KEEP THAT TRAFFIC FLOWING. SO I APPRECIATE YOU GUYS HEARING ME OUT, AND I HOPE WE CAN GET STAFF TO WORK COLLABORATIVELY AND GET THIS TAKEN CARE OF.
UH, RANDALL, REALLY APPRECIATE YOUR YOUR FEEDBACK ON THAT.
UH, MADAM CHAIRMAN, CAN WE LOOK AT AT THOSE OPTIONS? UM. YES, SIR. IT'S ACTUALLY ALREADY UNDERWAY.
THEY WALKED THE SITE, THEY TALKED ABOUT THE SOLUTIONS THAT ARE NECESSARY.
AND THAT, THAT IS, THAT IS UNDERWAY.
THANK YOU MA'AM. SO DOES THAT CONCLUDE THE SPEAKER CARDS, DEPUTY MAYOR? YES, MA'AM. OKAY.
ANY QUESTIONS OF STAFF? COUNCIL? OKAY.
I'M CLOSING THE PUBLIC HEARING AND ASKING FOR A MOTION.
SO MOVED. SECOND, GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DANNY OR DEPUTY MAYOR FELIX.
ANY FURTHER DISCUSSION, GENTLEMEN? ALL IN FAVOR SIGNIFY BY SAYING AYE.
ITEM NUMBER FIVE, MR. RODRIGUEZ. ORDINANCE 2023 107, AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE OF THE CITY OF PALM BAY BY CHANGING THE ZONING OF PROPERTY FROM RS. ONE SINGLE FAMILY RESIDENTIAL DISTRICT TO RS.
TWO SINGLE FAMILY RESIDENTIAL DISTRICT.
PROVIDING FOR AN EFFECTIVE DATE.
[00:55:13]
HIGH RETURN OF ARCANE ENGINEERING.WE WE'RE, WE'RE PROPOSING TO, TO TO REZONE FROM OUR CIS CIS ONE TO, I MEAN, FROM, UM, UH, CIS 1 TO 2, UH, BE HAPPY TO ADDRESS ANY, ANY, ANY QUESTIONS THAT THAT THE THAT THE COUNCIL HAS ON THIS.
WHY? WHY WOULD YOU WANT TO? IT'S CURRENTLY ZONED RS ONE.
WHY NOT BUILD? WHY COME BEFORE US? WHY JUST NOT BUILD TO THOSE CONFORMITIES RIGHT? THE THE BUILDER IS A LOCAL BUILDER AND THEY THEY LIKE TO BUILD US 60 FOOT WIDE HOMES.
UM, THEY, UH, THE SIZE OF FAIRLY SMALL SITE.
ANY SPEAKER CARDS? MISS GINA BARDI.
THANK YOU. UM, THANK YOU FOR HAVING US HERE TONIGHT.
I LIVE AT 2720 SCHOOL DRIVE NORTHEAST.
I'M ABOUT, UM, LESS THAN A QUARTER MILE FROM THE PROPERTY THAT HE'S DISCUSSING.
I WAS THRILLED WHEN I SAW THE, UM, THE CITY'S NEW COMPREHENSIVE PLAN.
IT CONSISTENT WITH THE COMPREHENSIVE PLAN.
THE ZONING HAS BEEN RS1, AND WE BELIEVE THAT IT SHOULD REMAIN SO AS NEIGHBORHOOD.
UH, THE REQUESTED CHANGE, UM, JUST MAKES IT MORE DENSE.
I THINK THE CHALLENGE WOULD BE FOR THE BUILDER TO ADAPT TO THIS NEW CODE THAT WAS ADOPTED, THE PALM BAY 2045 COMPREHENSIVE PLAN, FUTURE LAND USE ADOPTED ON MAY 1ST.
WHEN I READ IT, I WAS HAPPY BECAUSE A LOT OF IT IS PRESERVING NATURE.
IT IS DENSE VEGETATION, BEAUTIFUL VEGETATION.
IT'S ONE OF THE MOST BEAUTIFUL PARCELS WE HAVE IN THAT AREA.
THERE ARE GOPHER TORTOISES PEEKING OUT THROUGH THE TREES.
THE CITY SHALL EMPHASIZE THE USE OF NATIVE VEGETATION IN ALL DEVELOPMENT, SO CONSIDER ENLISTING KNOWLEDGEABLE GROUPS NATIVE PLANT SOCIETY, AUDUBON SIERRA CLUB TO IDENTIFY SPECIES OF SPECIAL CONCERNS AND MAKE THAT AVAILABLE TO THE PUBLIC.
SO WE MUST HAVE THAT AVAILABLE.
IT IS A GOPHER TORTOISE HABITAT.
IT IS AN OAK HABITAT, A BEAUTIFUL OAK HABITAT.
BY PROVIDING DATA AND STAFF ASSISTANCE, THE CITY SHALL USE CONSERVATION EASEMENTS, TRANSFER OF DEVELOPMENT RIGHTS TO PROTECT ENVIRONMENTALLY SENSITIVE LANDS, AND SEEK JOINT FUNDING FOR ACQUISITION OF NATURAL AREAS FOR CONSERVATION AND ENHANCED POPULATION OF ENDANGERED AND THREATENED SPECIES OF WILDLIFE IN THEIR CRITICAL HABITAT, SO THERE IS NO LOSS OF SUCH SPECIES IN PALM BAY.
THE ADMINISTRATIVE SITE PLAN MUST REVIEW THESE LAND USES AND CONSIDER THE EXACT, UM, PROVISIONS THAT THE CITY HAS PUT FORTH, AS WELL AS HONORING THE THE CURRENT, THE ZONING WHICH WAS IN THE COMPREHENSIVE PLAN, WHICH HAS BEEN CES1 ALL THIS TIME.
ANY OTHER SPEAKER CARDS? NO, SIR. OKAY.
WOULD YOU LIKE TO REBUT, SIR? CERTAINLY. UM, DUE TO THE SMALL SIZE OF THE PROJECT, WE'RE WE'RE NOT GOING.
WE'RE NOT GOING TO BE ABLE TO CREATE A A A SIZABLE A SIZABLE CONSERVATION AREA ON IT.
UH, THE STATE THE STATE DOES REQUIRE THAT WE THAT WE RELOCATE AND ANY ANY GOPHER TORTOISES THERE.
[01:00:04]
SO WE'LL SO THAT'S THAT'S WHAT WE'LL BE WHAT WE WILL BE DOING ON THAT THEN.ALL RIGHT. THANK YOU. ANY QUESTIONS? UH, QUESTIONS FOR STAFF OKAY.
THANK YOU. MAYOR. UM, ASSETS ZONE.
CURRENTLY, WHAT'S THE MAXIMUM AMOUNT OF UNITS THEY CAN PLACE IN THE PROPERTY? MALE. SO I'LL HAVE LISA FRAZIER, GROWTH MANAGEMENT DIRECTOR, COME ON UP.
OKAY. WHILE SHE'S COMING UP, THE NEXT QUESTION.
I'M LOOKING I'M LOOKING AT THE REPORT FROM, UH, BREVARD COUNTY SCHOOL BOARD.
MAYBE WE'LL PUT YOU ON IF YOU DON'T KNOW.
ACTUALLY, SIR, I'LL HAVE JONAS.
LISA, DO YOU WANT JOAN TO HELP A LITTLE BIT.
SHE HAS SOME OF THE DETAILS, I THINK.
GO AHEAD. JOAN, I WAS JUST GOING TO STATE THAT, UM, THIS PROPOSAL IS ASKING FOR 43 HOMES.
WITH THE ADDITION, IT'S ONLY ADDING THREE MORE HOMES.
UM, THE MOST THAT YOU CAN GET IN IN THE LOW DENSITY WILL BE 1 TO 3 UNITS PER ACRE.
BUT OF COURSE, WE NEED TO REMEMBER THAT WHEN WE ARE SAYING OVERALL IS 1 TO 3 UNITS PER ACRE, IT'S NOT A GIVEN, YOU'RE GOING TO GET THAT, BECAUSE WHEN YOU ADD STORMWATER, WHEN YOU ADD ROADS, WHEN YOU ADD SETBACKS, YADDA YADDA YADDA, YOU USUALLY END UP WITH ABOUT HALF OF THAT.
SO THAT'S THE MAXIMUM YOU COULD GET ON A PIECE OF PROPERTY WITH THIS ZONING, AM I CORRECT, JOAN? OKAY, GOOD. THANK YOU. ALL RIGHT. I DON'T HAVE IT IN FRONT OF ME.
ALL RIGHT. THANK YOU, MA'AM. AND THEN, UH, MISS SHERMAN, UH, I'M JUST READING AT THIS TIME.
PALM BAY ELEMENTARY SCHOOL, STONE MAGNET MIDDLE SCHOOL IN PALM BAY MAGNET SENIOR HIGH SCHOOL ARE PROJECTED TO HAVE ENOUGH CAPACITY FOR THE TOTAL OF THE PROJECTED AND POTENTIAL STUDENTS FROM THE GLENHAM ROAD DEVELOPMENT.
I'VE HAD A FEW PEOPLE ASK ME ABOUT THAT.
MAYOR. YEAH. MY MY CONCERN IS THE THE ROADWAY AND ADDING MORE TRAFFIC ONTO THAT ROADWAY THAT THAT'S MY CONCERN AS FAR AS INCREASING JUST ONE HOME FOR THAT DENSITY.
UM, ANY OTHER QUESTIONS? UH, DEPUTY MAYOR? NO, SIR. COUNCILMAN FOSTER, DO YOU HAVE ANY QUESTIONS OF STAFF? NO. NO QUESTIONS.
OKAY, SO I'M GOING TO CLOSE THE PUBLIC HEARING AT THIS TIME.
AND, UH, I'LL NEED A MOTION FOR DISCUSSION.
SO MOVED. SECOND FOR DISCUSSION.
I'VE GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
SO, JOHN, COUNCILMAN JOHNSON, DID YOU WANT TO SHARE? YEAH. JUST BRIEFLY. MAYOR.
UM, THIS WITH, UH, BREVARD PUBLIC SCHOOLS, IT MEETS THE CRITERIA.
SO IT'S OKAY ON THAT FRONT, I UNDERSTAND THE TRAFFIC, UH, ASPECT, BUT ALSO HEARING FROM OUR GROWTH MANAGEMENT DIRECTOR MADE ME FEEL MORE AT EASE BECAUSE THEY STILL DO HAVE TO PUT STORMWATER IN ON THE PROJECT AS WELL, SO THAT 43 CAN TURN INTO 33, OR IF NOT LESS.
SO, UM, WHICH BRINGS IT DOWN TO EVEN LESS THAN WHAT IT WOULD BE AS RS ONE.
SO I'M GOOD WITH THIS PROJECT, SIR.
YEAH. AND THEN GOING INTO THE, THE ENTRANCE OF, UM, WHERE WE HAVE CONNECT PARK.
UM, SO I THINK I THINK THAT'S PRELIMINARY, BUT STILL, I, I'M NOT COMFORTABLE WITH THIS PROJECT DENSITY, AND I WOULDN'T WANT TO PUT ANY ADDITIONAL HOMES ON THERE AND THEN THE SCHOOLS.
NOW, I DO HAVE TO ADMIT THAT IT'S A LOT BETTER THAN, UM, THE APARTMENT COMPLEX THAT, AS OUR CITIZEN ALLUDED TO BEFORE, IT WAS AN APARTMENT COMPLEX TO PUT AN APARTMENT COMPLEX THERE.
BUT, YOU KNOW, MY COMMENTS FROM BEFORE, WHY COME TO US? WHY SQUEEZE IN ANOTHER ADDITIONAL THREE HOMES? WHY JUST NOT GO WITH THAT? SO I FEEL COMFORTABLE NOW SUPPORTING THIS TODAY.
I REMEMBER HOW THE COMMUNITY FELT ABOUT IT, VERY OUTSPOKEN.
AND, UH, THEY DEFINITELY CLEARLY STATED THAT THEY DIDN'T WANT IT.
AND WHAT THEY ALSO STATED IS THAT THEY WOULD BE OKAY WITH SINGLE FAMILY.
UM, ON THAT NOTE, I WOULD BE OKAY TO SUPPORT THAT.
I DON'T SEE THREE HOMES CAN'T MAKE THAT MUCH OF A DIFFERENCE.
UM, I'LL BE OKAY TO SUPPORT IT.
[01:05:05]
CONSIDERED SOME OF THE LID PRACTICES.AND, UH, SURELY THAT CAN IMPROVE THE QUALITY OF THE PROJECT.
AND WILL THE IN TURN, IT WOULD BE GOOD, THE RIGHT THING TO DO.
SO TRULY, UH, FURTHER LOOKED INTO THAT, SEE HOW THAT CAN CAN BE IMPROVED.
COUNCILWOMAN FASSLER. DID YOU WANT TO WEIGH IN? NO, I HAVE NOTHING TO WEIGH IN.
I HAVE NOTHING, SIR. ALL RIGHT.
THANK YOU. ALL RIGHT, SO I GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ALL IN FAVOR SIGNIFY BY SAYING AYE.
WE ARE NOW ON ITEM NUMBER SIX.
I'M GOING TO OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO PRESENT THEIR CASE.
ANNA SAUNDERS WITH BSK CONSULTANTS, 312 SOUTH HARBOR CITY BOULEVARD, MELBOURNE, FLORIDA.
TONIGHT BEFORE YOU IS THE FIRST PHASE OF THE RIVERWOOD PROJECT.
THE FINAL PLAT. IT'S 124 UNITS, A MIXTURE OF 40S AND 50S.
THE SUBSEQUENT PHASES WILL BE COMING BEFORE YOU IN THE NEXT SEVERAL MONTHS.
THE PROJECT IS CURRENTLY UNDER CONSTRUCTION.
AND JUST TO SORT OF ORIENT YOU, THIS IS THE PIECE OF PROPERTY NORTH OF EMERSON, EAST OF THE PARKWAY.
IF YOU HAVE ANY QUESTIONS, I'D BE HAPPY TO ANSWER THEM.
DEPUTY MAYOR, MR. BARTON. BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST. I'M GOING TO SPEAK ON THIS ONE BECAUSE OF ITS LOCATION.
AND I WANT YOU TO REMEMBER THAT.
THIS IS ONLY PHASE ONE OUT OF PHASE THREE, BUT IT'S ONLY ONE DEVELOPER OUT OF MULTIPLE DEVELOPERS.
SO I WANT YOU TO REALIZE THAT THIS IS JUST A SMALL PERCENTAGE.
NOW WHY THAT COMES INTO PLAY IS IT'S REMEMBER IT'S IN AREA CODE 32907.
THEY'RE GOING TO GENERATE A LOT OF IMPACT FEES JUST FOR THIS DEVELOPMENT ALONE.
THIS ONE DEVELOPMENT IS GOING TO GENERATE $163,000.
REMEMBER THAT UNDER THE TRAFFIC IMPACT STUDY AT $4,353 PER RESIDENCE, THEY'RE GOING TO GENERATE $539,000 OVER A HALF $1 MILLION FOR THIS ONE PROJECT IN THREE, TWO, 907.
AND THE REASON WHY I'M POINTING THAT OUT IS BECAUSE YOU'RE TRYING TO DRAW FUNDS ON OTHER PROJECTS FROM 32908 TO PUT INTO INTO AREA CODE 32907, YET YOU'RE NOT PROVIDING SERVICES INTO 32908.
YOU'RE TAKING THE FUNDS FROM 32908 AND PUTTING THEM INTO 32907, WHICH IS ONE OF YOUR FASTEST GROWING FUND GENERATING NEIGHBORHOODS. 32907 THAT'S WHY I'M ADDRESSING THIS ONE.
THEY'RE DOING ALL THE PROPER PLANNING.
THEY'RE BUILDING SOMETHING FOR THE FUTURE.
I JUST DON'T LIKE THE FACT THAT AN UP AND COMING OTHER ITEMS THAT YOU'RE GOING TO BE ABLE TO TAKE FROM ONE AREA CODE AND PUT IT INTO ANOTHER AREA CODE THAT'S GENERATING MILLIONS OF DOLLARS UNDER PARK'S IMPACT FEE FUNDS AND TRAFFIC IMPACT FEE FUNDS.
THANK YOU. AND 32908 IS RIGHT ACROSS THE STREET.
JUST OKAY? YES, SIR. I'M JUST SAYING, SIR, IT'S JUST ACROSS THE STREET.
ANY OTHER SPEAKER CARDS? NO, SIR. OKAY, SO I'M GOING TO CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.
GOT MOST OF MY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX ANY.
NO. MAYOR. ALL IN FAVOR SIGNIFY BY SAYING I, I I YOU KNOW, I, I, UM, PASSES FOUR ZERO.
AND I LOVED WHAT HE SAID IN THE PREVIOUS ITEM.
MISS SAUNDERS, IS THE PERMEABLE CONCRETE, THE LOW IMPACT DENSITY.
I KNOW WE IT'S WAY BEYOND THAT POINT, BUT, UH, FOR, FOR FOLKS TO START CONSIDERING THAT.
SO WE'RE ON ITEM NUMBER SEVEN.
OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO PRESENT THEIR CASE.
[01:10:12]
THANK YOU, JAKE WISE, CIVIL ENGINEER, FOR THE PROJECT.UM, WE'RE ASKING FOR TONIGHT IS THE PRELIMINARY PLAT APPROVAL FOR GARDEN STONES PHASE.
UH, GARDENS OF WATERSTONE, PHASE THREE.
UH, COUNCIL PREVIOUSLY UNANIMOUSLY APPROVED THE FINAL DEVELOPMENT PLAN.
WE'RE FULLY COMPLIANT WITH THAT FINAL DEVELOPMENT PLAN.
WE HAVE OUR SCHOOL CONCURRENCY APPROVAL.
UH, AS I SAID, THIS IS THE THIRD PHASE.
PHASE ONE IS COMPLETELY CONSTRUCTED.
PHASE TWO IS JUST ABOUT DONE WITH CONSTRUCTION.
WE HAVE OUR CONSTRUCTION PLANS APPROVED.
BE ABLE TO MOVE FORWARD WITH THIS PROJECT.
UH, AS PART OF THE WATERSTONE AND CYPRESS BAY PRESERVE MASTER PLAN THAT YOU'VE SEEN ME OVER AND OVER AGAIN BEFORE THIS BOARD, AND IT'S FULLY COMPLIANT WITH THAT OVERALL MASTER PLAN THAT WAS PREVIOUSLY APPROVED AS WELL.
WE HAVE AMPLE OPEN SPACE AND RECREATION AS PART OF THE PROJECT, AND WE'LL EXTEND CITY UTILITIES.
THIS PROJECT WITH THE PREVIOUS PHASE IS ALSO CONSTRUCTING THE TRAFFIC SIGNAL AT MERALOMA AND BABCOCK STREET, UH, WHICH IF YOU'VE EVER TRAVELED THAT AREA, ESPECIALLY IN THE MORNING, YOU KNOW, IT'S BADLY NEEDED.
AND THEN ANOTHER PROJECT THAT'S ALSO FULLY COMPLIANT WITH THE MASTER PLAN IS EXTENDING AND LOOPING MERALOMA ALL THE WAY AROUND TO THE EXTENSION OF THE PARKWAY WEST OF BABCOCK STREET. SO WITH THIS PROJECT AND A COUPLE OF THE OTHER ONES THAT ARE ONGOING CONCURRENTLY, WE THINK THAT THE TRAFFIC FLOWS IN THOSE AREAS IS GOING TO IMPROVE DRAMATICALLY. UM, WITH THAT BEING SAID, STAFF RECOMMENDED APPROVAL AND WAS UNANIMOUSLY RECOMMENDED APPROVAL.
HAPPY TO ANSWER ANY QUESTIONS YOU HAVE AND THE DEVELOPERS HERE AS WELL.
IF I CAN ANSWER ANY QUESTIONS.
ANY QUESTIONS. COUNCIL COUNCIL.
ANY QUESTIONS? NO, MA'AM. NO QUESTIONS.
ALL RIGHT. THANK YOU, THANK YOU.
ANY SPEAKER CARDS? DEPUTY MAYOR? NO, SIR.
NOT FOR THIS ITEM. OKAY, I NEED A MOTION.
SO, SECOND, GOT A MOTION BY DEPUTY MAYOR FELIX, SECONDED BY COUNCILMAN JOHNSON.
NOTHING TO ADD, SIR. I JUST WANT TO THANK STAFF MISS SUZANNE FOR GETTING BACK TO MISS CAROL.
SHE HAD A LOT OF CONCERNS FROM THE HOA.
YEAH, IT WAS GOOD. YEAH, SHE HAD A LOT OF CONCERNS.
SO I APPRECIATE STAFF WORKING WITH HER TO GET THROUGH THOSE.
BUT I THINK THIS IS A GOOD PROJECT.
AND I WANTED, UH, MADAM SHERMAN TO JUST HIGHLIGHT THOSE THOSE CONCERNS.
FOR THE RECORD, UH, WHAT YOU RESPONDED TO.
FEELS CONFIDENT THAT THE LIMITS OF THE RESPONSIBILITY FOR THAT PARTICULAR HERON BAY SUBDIVISION, AND THEIR RESPONSIBILITY FOR THE MAINTENANCE OF FUTURE EXTENSIONS OF MERALOMA THAT IT IS, IT IS LIMITED BY WHAT THE RESOLUTION AND THE PLAT DOCUMENT SAID.
UM, THE THE HOA FOR HERON BAY IS HAVING SOME DISCUSSIONS WITH THE DEVELOPER.
UM, AND THAT'S WHERE WE'VE HAD A LITTLE BIT OF SORT OF DISCONNECT ON THE, ON THE ISSUE, BUT WE'LL CONTINUE TO WORK WITH THEM BECAUSE WE, WE ARE OF THE OPINION THAT THEY DON'T HAVE THAT ADDITIONAL, UM, RESPONSIBILITY.
IT CAME UP THIS AFTERNOON WITH AN EMAIL THAT WE DIDN'T REALIZE IT WAS STILL AN OUTSTANDING QUESTION.
AND THEN, UH, MR. WISE DID WAS DID MENTION THAT HE DIDN'T HAVE A PROBLEM WITH CHANGING THE NAME OF THE ROAD.
UH, AND I THINK A MEETING OR TWO AGO AS WELL.
RIGHT. JUST JUST FOR THE RECORD.
SO I GOT A MOTION BY DEPUTY MAYOR FELIX, SECONDED BY COUNCILMAN JOHNSON.
ALL IN FAVOR SIGNIFY BY SAYING I I HI PASSES FOUR ZERO.
WE'RE NOW ON ITEM NUMBER EIGHT.
I'M GOING TO OPEN UP THE PUBLIC HEARING.
AND ASK THE APPLICANT TO PRESENT THEIR CASE.
UH, THIS IS A SUBPHASE TO WHAT YOU JUST APPROVED.
AGAIN, FULLY COMPLIANT WITH THE FINAL DEVELOPMENT PLAN AND THE PRELIMINARY PLAT.
UH, WE RESOLVED WITH STAFF ALL THEIR COMMENTS.
UH, AGAIN, WE HAVE SCHOOL CONCURRENCY PLANNING AND ZONING AND STAFF RECOMMENDATION OF APPROVAL.
WITH THAT, I'D BE HAPPY TO ANSWER ANY QUESTIONS YOU HAVE.
ANY QUESTIONS? ANY QUESTIONS? OKAY, JUST FOR THE RECORD, THE PREVIOUS ONE, UM, YOU WERE GOOD WITH RENAMING THE THE THE STREET.
YES. WE'VE TALKED ABOUT THAT BEFORE.
YES, WE'RE HAPPY TO DO THAT IF THAT'S HELPFUL.
ALL RIGHT. THANK YOU. I APPRECIATE THAT, SIR.
THANK YOU. ANY SPEAKER CARDS? NO, SIR. I'M GOING TO CLOSE THE PUBLIC HERE AND ASK FOR A MOTION.
[01:15:03]
SO MOVED. SECOND, GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.ALL IN FAVOR SIGNIFY BY SAYING I I HI PASSES FOUR ZERO.
WE ARE NOW ON ITEM NUMBER NINE.
MR. RODRIGUEZ, ORDINANCE 2023 108, AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE 2045 COMPREHENSIVE PLAN TO CHANGE THE FUTURE LAND USE MAP DESIGNATION FROM RESIDENTIAL ONE UNIT PER ACRE BREVARD COUNTY TO COMMERCIAL USE, PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES AND CONFLICT. HEREWITH, PROVIDING FOR AN EFFECTIVE DATE, I'M GOING TO OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO PRESENT THEIR CASE.
YOU WANT TO SIT UP FRONT? YEAH. I FORGOT MY NOTES FOR THIS ONE.
UM, UH, THIS IS FOR A PIECE OF PROPERTY THAT WAS IN BREVARD COUNTY THAT HAS NOW BEEN, UH, UNANIMOUSLY APPROVED FOR ANNEXATION INTO THE CITY OF PALM BAY. UM, IT'S A COMMERCIAL PARCEL.
IS WHAT WE'RE ASKING FOR TONIGHT.
UM, AND, UH, THIS PROJECT, WE'VE BEEN WORKING WITH STAFF FOR WELL OVER A YEAR ON IT.
UM, SO WE HAVE BEEN WORKING WITH THEM TO DO AN EQUAL AMOUNT OF PROPERTY LAND SWAP SO THAT THE PARKWAY COULD BE EXTENDED, UH, THROUGH A PORTION OF THIS PROPERTY IN THE FUTURE.
SO WHAT WE'RE ASKING FOR TONIGHT IS 100% OF IT TO BE A COMMERCIAL FUTURE LAND USE.
AND, UH, WE'RE EVEN PROVIDING AN EASEMENT FOR THE CITY TO ALLOW STORMWATER CONVEYANCE TO GO FROM THE FUTURE EXTENSION OF THE PARKWAY THROUGH THE SOUTH END OF THIS PROPERTY ONTO WHAT WE ANTICIPATE AS BEING A FUTURE STORMWATER TREATMENT POND FOR THE PARKWAY, UM, FOR FUTURE LAND USE CHANGE, UH, CHANGE ITEMS. THERE'S TEN DIFFERENT ITEMS OF COMPLIANCE.
ANY QUESTIONS? COUNCIL FOR STAFF.
BUT JUST A QUESTION FOR STAFF.
DO WE HAVE A TIMELINE ON WHEN ROAD WIDENING WILL OCCUR AND THE TRAFFIC LIGHT? UM, IN COMPARISON TO A LOT OF THE GROWTH AND DEVELOPMENT THAT'S GOING TO OCCUR IN THIS AREA? YEAH. THE THE REASON WHY I'M ASKING IS WHEN WE LOOK AT WHAT HAPPENED A FEW COUNCIL MEETINGS AGO, UM, OVER ON MINTON AND ANOTHER ROAD IN REGARDS TO US HAVING TO WAIT TO SEE WHERE YOU UNDERSTAND WHERE I'M GOING.
SO. YEAH. SO THAT'S WHY I'M JUST ASKING, MAYOR, THAT'S ALL.
THAT'S A GREAT QUESTION, COUNCILMAN JOHNSON.
SO I WILL I WILL START WITH A FEW HIGHLIGHTS, AND THEN I MAY HAVE TO PULL FRANK UP FOR MORE DETAIL.
UM, AFTER THAT DISCUSSION, STAFF WAS, UH, KIND OF LIKE RE REVISITING THE PROJECT, AND NOW WE'VE MOVED THE TIMELINE BACK UP A BIT, SO IT LOOKS LIKE WE WILL BUNDLE WACO AND MINTON AND PUT THAT OUT, I BELIEVE IN JANUARY TIME FRAME.
SO WE'VE MOVED THAT UP A LITTLE BIT.
I KNOW IT'S NOT RELEVANT, BUT JUST WANTED TO SHARE.
UM, SO IN THIS PARTICULAR AREA, UM, ONE ACTIVE PROJECT AS YOU'RE AWARE, IS THE INTERSECTION AT MALABAR IN THE SAINT JOHNS HERITAGE PARKWAY AND THE NEED FOR A TRAFFIC SIGNAL. UM, WE ARE IN THE FINAL STAGES OF GETTING OUR RIGHT OF WAY PERMIT FROM BREVARD COUNTY.
THEY ASKED FOR SOME ADDITIONAL CHANGES TO A LIGHTING PLAN THAT HAS THAT WILL BE SUBMITTED TO THEM WITHIN THE NEXT 2 TO 3 WEEKS, I WOULD GUESS, UNLESS WE GOT IT LIKE THIS WEEK, WHICH FRANK CAN COME UP AND TELL ME.
YES. UH, FRANK WATANABE, THE CITY ENGINEER.
SOME GOOD NEWS. WE'VE GOT THE LIGHTING PLAN.
UH, YESTERDAY WE'VE ALREADY INCORPORATED INTO THE PLAN SET, AND I PLAN TO SUBMIT IT TOMORROW.
SO HOPEFULLY MAYBE BY MARCH OR APRIL WE'LL HAVE CONSTRUCTION STARTED.
YEAH. AND WE'RE LOOKING FORWARD TO THAT.
YOU KNOW, WE WANTED IT FOR THE SCHOOL YEAR, BUT I THINK, UH, COUNCILMAN JOHNSON'S TALKING ABOUT THE EXTENSION, THE BIG AND THEN THE MAST ARMS. RIGHT. I BELIEVE THE MAST ARM WOULD COME WAY BEFORE WE CORRECT.
THIS WAS ALL AN INTERIM PROJECT.
UH, IT'S KIND OF SAD, BUT WHEN WE STARTED THIS PROJECT, IT WAS TIED IN WITH THE BABCOCK PROJECT.
AND AN AGREEMENT WE HAD WITH THE COUNTY WAS WHEN WE WORKED ON THE BABCOCK PROJECT.
AND WE WERE GOING TO TAKE DOWN THE TEMPORARY SPAN SIGNAL THAT'S DOWN THERE.
WE WERE GOING TO RELOCATE IT TO HERE, MALABAR AT SAINT JOHNS.
[01:20:02]
UH, BECAUSE OF THE TIME FRAME AND THE DELAYS, WE'RE ACTUALLY GOING TO INSTALL A BRAND NEW SPAN WIRE.THE COUNTY IS ALL SUPPORTING IT.
UH, SO THAT PROJECT IS GOING TO MOVE FORWARD WITH THIS TEMPORARY ONE.
THE ULTIMATE WOULD BE A FULL INTERSECTION WITH POLES AND MAST ARMS. A LOT OF IT'S GOING TO BE PAID BY DEVELOPERS BECAUSE IT'S ALL DEVELOPER DRIVEN.
UH, IT'S GOING TO BE TIED IN WITH THE FOUR LANE WIDENING.
AND YOU HAVE IT ON ITEM TONIGHT.
WE'RE GETTING FEDERAL SORRY STATE ALLOCATION FUNDS TO WIDEN SAINT JOHNS HERITAGE PARKWAY.
AND WIDENING MALABAR IS A LOT MORE TOUGHER.
UH, SAINT JOHNS, WE ALREADY HAVE THE RIGHT OF WAY.
ALL WE HAVE TO DO IS BUILD THE ROAD, THE TWO LANES.
THEY'LL START USING ROADS LIKE EMERSON.
UNTIL SUCH TIME WE GET TO MALABAR AND PIECES, MORE LIKELY WE'RE GOING TO DO MALABAR IN SEGMENTS.
WE'RE NOT GOING TO DO THE ENTIRE ROADWAY, MAINLY BECAUSE OF THE COST, BUT WE'LL DO SEGMENTS OF IT.
HOPEFULLY. ANSWER YOUR QUESTION.
SO ANY SPEAKER CARDS? THE ZOLKIEWSKI.
GOOD EVENING, MR. MAYOR. GOOD EVENING.
COUNCIL. MY NAME IS RANDALL OLSZEWSKI.
I LIVE AT 348 BROOK STREET NORTHEAST.
THIS IS, UH, AN AMENDMENT TO OUR COMPREHENSIVE PLAN.
SO IF WE LOOK AT JUST THIS LITTLE ITTY BITTY PART OF OUR CITY COMPREHENSIVELY, WHEN TIMING WISE, SHOULD WE DEVELOP THIS PARTICULAR CORNER, SHOULD WE TAKE A STEP TOWARDS DEVELOPING IT AND TURNING IT TO COMMERCIAL AND DOING A LAND SWAP AND SO ON AND SO FORTH? I HAVE HESITATION TOWARDS DOING THAT BEFORE THE INTERSECTION IS SUFFICIENT.
NOW, IF YOU LOOK AT THIS PROJECT'S LAYOUT CONCEPTUALLY, THE MAIN ENTRANCE IS ON MALABAR.
THE SOUTHERN EXTENSION, SAINT JOHNS HERITAGE PARKWAY, THAT WILL ONE DAY EXIST ONE DAY.
THEY'RE NOT A DATE, BUT ONE DAY IS AN AUXILIARY ENTRANCE.
HE ANSWERED IN THE AFFIRMATIVE.
I DON'T LIKE IT AT ALL BECAUSE RIGHT NOW, SAINT JOHNS HERITAGE PARKWAY DEAD ENDS.
THAT'S BEYOND RED, THAT'S BEYOND BAD.
IT'S THE WORST CONDITION YOU CAN GET.
GO. 3:00, 315, 330 SOUTHBOUND ON THE SAINT JOHNS HERITAGE PARKWAY.
AND SEE IF YOU CAN GET TO EMERSON FROM THE MELBOURNE CITY LINE.
PEOPLE ARE GOING TO BUILD HOUSES TO THE WEST OF THAT.
AS THE DEVELOPERS EXPLAIN, THE HESITATION I HAVE HERE IS NO TRAFFIC IS FLOWING THROUGH THAT PLACE.
THE ONLY TRAFFIC THAT'S FLOWING THROUGH IS THOSE SCHOOL BUSSES LEAVING HERITAGE PARKWAY AND MAKING IT SO THE HERITAGE HIGH SCHOOL EXCUSE ME, SO THAT THE PARKWAY TRAFFIC CAN'T MOVE. THE INTERSECTION AS IT STANDS NOW, IS INAPPROPRIATE FOR EVERYTHING THAT EXISTS, EVERYTHING THAT'S ALREADY APPROVED, LET ALONE APPROVING SOMETHING ELSE.
NOW WE LOOK TOWARDS PRECEDENCE IN OUR SOCIETY TO FIGURE OUT HOW WE SHOULD DO THINGS.
SO IF WE LOOK AT MITTON AND HEALD ROAD AND WE SAID, NO, YOU CAN'T HAVE THIS CORNER BE COMMERCIAL BECAUSE THE APARTMENT COMPLEX PUT THE HOOD OVER OUR EYES AND SAID THEY WERE GOING TO IMPROVE THE TRAFFIC LIGHT NEVER DID BECAUSE THE TIMING IS INAPPROPRIATE.
THAT'S WHAT THIS COUNCIL STATED.
THAT'S WHAT THE PREMISE IT WAS.
WE'RE NOT GOING TO HAVE COMMERCIAL DEVELOPMENT IN THAT PART OF OUR CITY RIGHT NOW.
I'M VERY HESITANT, VERY HESITANT.
WE NEED THAT PHASE TWO BEFORE WE CAN REALLY GROW FURTHER.
THANK YOU VERY MUCH. THANK YOU.
ANY OTHER SPEAKER CARDS? ANYONE ELSE WISH TO SPEAK FOR OR AGAINST THIS ITEM? YOU WANT TO REBUT, SIR? YES.
THANK YOU. THIS WAS A DISCUSSION POINT AT THE PLANNING AND ZONING BOARD AS HE IDENTIFIED.
[01:25:03]
CORRIDOR WITH ALL OF OUR PROJECTS.UM, BUT THIS TYPE OF USE AND THE GAS STATION IS, UH, ANTICIPATED AS POTENTIAL USE, UM, IS A NEIGHBORHOOD COMMERCIAL TYPE OF USE, SO IT'S MOSTLY PASSERS BY, TRAFFIC.
IT'S NOT SOMETHING THAT'S GOING TO CREATE MORE TRAFFIC AND ADD TO THE PROBLEM.
IT'S JUST GOING TO BE A BENEFIT TO THE RESIDENTS THAT ARE ALREADY DRIVING THROUGH THE AREA.
UM, SO WE DON'T SEE IT AS SOMETHING THAT'S GOING TO GENERATE A LOT OF TRIPS.
AND AS MR. WATANABE EXPLAINED, THERE'S ALREADY A LOT OF INTERSECTION IMPROVEMENTS.
AND WE ALL KNOW THE AREA NEEDS TO BE IMPROVED.
BUT FOR THIS PARTICULAR FUTURE LAND USE, WE'RE ASKING FOR FOR THE COMMERCIAL, IT'S NOT A TEST INTENDED OR EXPECTED TO EVER BE SOME KIND OF DESTINATION USE, OR IT'S GOING TO CREATE A WHOLE LOT MORE TRAFFIC.
DO YOU THINK, UM, AS THIS COMMERCIAL PROPERTIES DEVELOPED RIGHT AT THAT INTERSECTION, WOULD THEY CONSIDER, UH, CREATING THAT EXTENSION, UH, AS PART OF THAT DEVELOPMENT TO ENTER ON THE SIDE OF THE SAINT JOHNS SOUTH OF MALABAR ROAD? WOULD THEY CONSIDER DOING SOMETHING LIKE THAT? WE DON'T HAVE AN END USER.
WE'RE JUST TODAY ASKING FOR LAND USE.
I GOT AN UNKNOWN END USER TO SOMETHING BECAUSE I COULD SEE A DEVELOPER WANTING TO DO THAT AND HAVE TWO DIFFERENT ENTRANCES, RIGHT? YEAH, TWO DIFFERENT.
BUT I THINK STAFF AND I HEAR EXACTLY WHAT YOU'RE SAYING.
UM, SO WE THINK THAT WILL HAPPEN WITH THE DEVELOPMENT IN THE AREA.
CERTAINLY. BUT I JUST CAN'T COMMIT A FUTURE.
COPY THAT. YOU DON'T KNOW WHO'S GOING TO BE THERE.
YES, SIR. BUT THAT'S SOMETHING WE COULD LOOK AT IN THE FUTURE.
ALL RIGHT, SIR, UH, ANYONE ELSE WISH TO SPEAK? DOES THAT CONCLUDE YOUR COMMENTS, MR. WEISS? SO I'M GOING TO CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.
GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
COUNCILMAN JOHNSON, I APPRECIATE MR. OLSZEWSKI'S COMMENTS SAYING I THINK WE'RE ALL ON THE SAME PAGE WITH THIS.
SO IT'LL BE CLOSELY MONITORED BY STAFF.
FRANK SHAKING HIS HEAD ALREADY BECAUSE SO I UNDERSTAND.
SO WE JUST WANT TO MAKE SURE THAT WE LEARN FROM OTHER AREAS OF THE CITY AND LEARN FROM THE PAST.
SO I THINK WE'RE IN A GOOD PLACE.
COPY THAT. SIR. THE COMMERCIAL ASPECT OF IT, TOO.
DEPUTY MAYOR, YOU SECONDED THE MOTION.
COUNCILMAN FOSTER, ANYTHING YOU WISH TO WEIGH IN ON? UH, NO, NOT AT THIS TIME.
I GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ALL IN FAVOR SIGNIFY BY SAYING AYE.
WE ARE NOW ON ITEM NUMBER TEN, MR. RODRIGUEZ, ORDINANCE 2023 109, AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE OF THE CITY OF PALM BAY BY CHANGING THE ZONING OF PROPERTY FROM A AGRICULTURAL RESIDENTIAL BREVARD COUNTY TO CC COMMUNITY COMMERCIAL DISTRICT.
WHICH PROPERTY IS LOCATED SOUTH OF AND ADJACENT TO MALABAR ROAD IN THE VICINITY WEST OF MELBOURNE.
PROVIDING FOR AN EFFECTIVE DATE.
I'M GOING TO OPEN UP THE APP, THE PUBLIC HEARING AND ASK THE APPLICANT TO PRESENT THEIR CASE.
THANK YOU. JAKE, CIVIL ENGINEER.
UH, WE'RE ASKING FOR A COMMUNITY COMMERCIAL ZONING FOR THE PROPERTY.
UH, AGAIN, AS IT WAS JUST TALKING ABOUT COMMUNITY COMMERCIAL IS ANTICIPATED USES TO HELP THAT LOCAL COMMUNITY NOT TO BRING IN TRIPS FROM OTHER PARTS OF THE CITY, NOT TO BE A BIG TRAFFIC GENERATION, BASICALLY GETTING LOCAL PASSERBY TRAFFIC ALREADY.
IT'S MORE OF A CONVENIENCE TO THE AREA.
UH, SO FOR THE REZONING, THERE'S SIX CRITERIA.
AS THE STAFF REPORT IDENTIFIES, WE, UH, ARE IN COMPLIANCE WITH ALL SIX CRITERIA.
UH, PLANNING AND ZONING BOARD RECOMMENDED APPROVAL, STAFF RECOMMENDS APPROVAL.
I'D BE HAPPY TO ANSWER ANY QUESTIONS.
THANK YOU. SIR. ANY QUESTIONS? COUNCILMAN. DEPUTY MAYOR.
NOT AT THIS TIME. NOT FOR THIS ITEM.
NOTHING. OKAY, OKAY, I NEED A MOTION.
SO MOVED. SECOND MOTION BY DEPUTY MAYOR FELIX, SECONDED BY COUNCILMAN JOHNSON.
GENTLEMEN. ALL IN FAVOR SIGNIFY BY SAYING AYE.
[01:30:08]
LAND USE MAP DESIGNATION FROM RESIDENTIAL ONE UNIT PER ACRE BREVARD COUNTY TO COMMERCIAL USE, PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES AND CONFLICT.THANK YOU. MAYOR. SO THIS ITEM AND THE ONE THAT IS FOLLOWING IT ARE FOR THE CITY OWNED PARCEL THAT IS ACTUALLY DIRECTLY NEXT TO THE PARCEL WE JUST FINISHED SPEAKING ABOUT. AND OUR REQUEST ON THIS PARTICULAR ITEM IS TO BECAUSE THE THE PARCEL WAS NEVER ANNEXED INTO THE CITY.
WE DID THAT RECENTLY, UH, THROUGH YOUR APPROVAL.
SO NOW WE'RE COMING IN FOR THE COMPREHENSIVE PLAN AND THE ZONING ASSIGNMENT FOR THE PARCEL.
MA'AM. UM, ANYONE IN THE AUDIENCE WISH TO SPEAK FOR OR AGAINST THIS ITEM? ANY QUESTIONS? COUNCIL. AWESOME.
OKAY, WELL, I'M GOING TO CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.
GOT A MOTION BY SECOND DEPUTY MAYOR FELIX, SECONDED BY COUNCILMAN JOHNSON.
ALL IN FAVOR SIGNIFY BY SAYING I.
MR. RODRIGUEZ, ORDINANCE 2020 3-1 11, AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE OF THE CITY OF PALM BAY BY CHANGING THE ZONING OF PROPERTY FROM A AGRICULTURAL RESIDENTIAL BREVARD COUNTY TO CC COMMUNITY COMMERCIAL DISTRICT.
WHICH PROPERTY IS LOCATED SOUTH OF AND ADJACENT TO MALABAR ROAD IN THE VICINITY, SOUTHWEST OF SAINT JOHNS HERITAGE PARKWAY AND WEST OF THE MELBOURNE TILLMAN DRAINAGE DISTRICT. CANAL SEVEN AND LEGALLY DESCRIBED HEREIN, PROVIDING FOR A CHANGE OF THE ZONING MAP PROVIDING FOR AN EFFECTIVE DATE.
AND THE REQUEST IS TO CREATE IT WITH A COMMUNITY COMMERCIAL ZONING DESIGNATION.
UH, DEPUTY MAYOR, ANY SPEAKER CARDS? NO, SIR. NEED A MOTION TO CLOSE THE PUBLIC HEARING.
SECOND, GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ANY ADDITIONAL COMMENTS, GENTLEMEN? YOU DON'T WANT TO SAY COMMUNITY COMMERCIAL? DON'T WANT TO SAY. ALL IN FAVOR SIGNIFY BY SAYING AYE.
WE ARE NOW ON ITEM NUMBER 13, ORDINANCE 2020 3-1 12, AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE 2045 COMPREHENSIVE PLAN TO CHANGE THE FUTURE LAND USE MAP DESIGNATION FROM PUBLIC SEMIPUBLIC USE AND RECREATION AND OPEN SPACE USE TO HIGH DENSITY RESIDENTIAL USE, PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES AND CONFLICT.
HEREWITH PROVIDING FOR AN EFFECTIVE DATE.
I'M GOING TO OPEN UP THE PUBLIC HEARING AND ASK THE APPLICANT TO PRESENT THEIR CASE.
THANK YOU. MY NAME IS STUART BUCHANAN.
BOX 1545, TITUSVILLE, FLORIDA 32781.
UH, QUICK BACKGROUND DIRECTLY ACROSS THE STREET, UH, TO THE WEST IS PHASE ONE EAST THE ONE THIS IS AN APARTMENT COMPLEX THAT WE ALREADY BUILT, UH, THAT WAS REZONED UNDER SIMILAR CIRCUMSTANCES SEVERAL YEARS AGO.
UH, IT WAS IT IS A HUGE SUCCESS.
WE HAD 100% OCCUPANCY WITHIN 30 DAYS OF KO.
ANY CITY COUNCIL OR STAFF ARE INVITED TO TOUR AT ANY TIME THEY LIKE.
UH, OUR TENANT MIXTURE, UH, BEING DIRECTLY ACROSS FROM THE COLLEGE, WE HAVE COLLEGE STUDENTS.
WE ALSO HAVE SIX POSTAL WORKERS, EIGHT SCHOOL TEACHERS, 11 NURSES.
AND ONE OF YOUR POLICE OFFICERS.
UH, WE COULDN'T BE MORE HAPPY WITH THE, UH, THE TENANTS.
ONE OF THE REASONS THAT YOUR FORMER, UH, TRAFFIC ENGINEER WORKED WITH US ON A IMPACT FEE REDUCTION FOR TRANSPORTATION IMPACT FEES IS THAT WE'RE DIRECTLY ACROSS THE STREET FROM THE COLLEGE.
THIS PROJECT IS ON THE SAME SIDE OF THE STREET AS THE COLLEGE.
UH, OUR PHASE TWO IS 140 DWELLING UNITS.
IT'S SURROUNDED ON THREE SIDES BY THE COLLEGE.
IT'S SURROUNDED TO THE WEST BY US.
SO, IN OTHER WORDS, WE'RE BUFFERING OUR OWN PROJECTS.
WE'RE TO THE WEST, THE COLLEGES ON ALL THREE SIDES.
[01:35:10]
ROADWAYS. ONE OF THE REASONS THAT STAFF SUPPORTED THE FIRST PHASE IS THIS ALLOWS COLLEGE STUDENTS NOT TO HAVE TO DRIVE ON YOUR LOCAL ROADS TO GET TO THE CAMPUS.UH, THE LAST THING I WOULD POINT OUT TO YOU IS WE DID APPROACH THE, UM, VICE PRESIDENT THAT'S IN CHARGE OF THE FIRE ACADEMY LOCATED ON THIS CAMPUS, WHICH IS RIGHT ACROSS FROM OUR PROPOSED PROJECT.
UH, AND WE OFFERED TO WORK WITH THEM SHOULD THEY NEED HOUSING FOR THEIR CADETS AT THE FIRE ACADEMY.
AS YOU KNOW, UH, STAFF RECOMMENDED THIS ITEM FOR APPROVAL.
SO THE ENTRANCE ON THIS, YOU'RE PROPOSING IT TO BE ON TREELAND.
SO. YES, MAYOR, WHAT WE DID WAS WE DO HAVE AN ENTRANCE OFF OF SAN FILIPPO, BUT WE RECOGNIZED THAT TREELAND IS GOING TO GET SIGNALIZED AT SOME POINT IN THE FUTURE. SO WE TOOK OUR EXISTING OUR ORIGINAL SITE PLAN.
WE SHIFTED THE DRIVEWAY ONTO TREELAND.
IN OTHER WORDS, BECAUSE OBVIOUSLY THEY'D WANT TO THE MOMENT IT GETS SIGNALIZED.
SO YES, WE DID TAKE THAT INTO ACCOUNT AND LOOKED AT WHAT WERE THE NEEDS WOULD BE IN THE FUTURE.
SO I'M LOOKING AT THIS AS 13 AND 14, RIGHT.
UH, ITEMS 13 AND 14 AND UH 14 IS GOING FROM MM TEN TO MM 20.
NOW WHAT HOW MANY MORE IN REGARDS TO DENSITY, HOW MANY MORE DEVELOPMENTS IS THAT? HOW MANY MORE APARTMENTS? OH, SORRY. I CAN HELP YOU WITH THAT.
UH, SO THE DIFFERENCE IS, UH, 70 UNITS, 70 ADDITIONAL UNITS.
AND THAT IS THE SAME REZONING THAT THE PRIOR CITY COUNCIL APPROVED ACROSS THE STREET.
YEAH, IT'S JUST WHEN THAT WAS WHEN THAT WAS APPROVED, SAN FILIPPO WAS IN AT ITS CAPACITY.
AND IT'S BEYOND THAT CAPACITY FROM WHAT I SEE.
HAVE YOU EVER WITNESSED GOING ON SAN FILIPPO, UH, TO MALABAR ROAD IN THE MORNING? YES. AND YOU'RE EXACTLY CORRECT, MAYOR, WHICH IS WHY WE NEED THESE UNITS.
SO THOSE COLLEGE STUDENTS DON'T HAVE TO DRIVE.
THEY CAN WALK TO THEIR CLASSES.
YOU'RE EXACTLY CORRECT, MAYOR.
THE POINT IS TO TRY AND GET LOCAL, UH, TRY AND GET TRIPS OFF YOUR LOCAL ROADS.
I'M NOT SURE COLLEGE STUDENTS ARE GOING TO FILL THAT.
WORKFORCE DEVELOPMENT IS WHAT YOU WERE SAYING.
SO NOW YOU'RE SAYING STUDENTS ARE GOING TO FILL THAT CAPACITY? THOSE APARTMENTS, WE ARE SPECIFICALLY BUILDING THESE TO TARGET THEM TOWARDS STUDENTS.
SO HOW MANY TOTAL UNITS ARE WE TALKING ABOUT? 140, 140 UNITS.
ALL RIGHT. THANK YOU. YES, SIR.
ANY OTHER QUESTIONS? WELL, UM, NOT NOT FOR MR. BUCHANAN, BUT, UH. RIGHT.
OH, I'LL WAIT IF DEPUTY MAYOR.
THANK YOU. MAYOR, JUST FOR SAKE OF CLARITY, UH, MR. BUCHANAN, SO YOU MENTIONED WORKFORCE HOUSING.
SO WORKFORCE FOR HOUSING OR MARKET RATE.
MARKET RATE. OKAY. SO NOT OKAY.
UH, POLICEMEN, FIREFIGHTERS, UH, COLLEGE STUDENTS, YOU KNOW, OBVIOUSLY MOSTLY THEY'RE SUPPORTED.
THEY GET RECEIVE HELP FROM THEIR PARENTS, NURSES, PUBLIC SCHOOL TEACHERS.
THE MIX THAT WE HAVE NOW IN PHASE ONE.
IT'S. I'M STILL I'M STILL NOT QUITE CLEAR WHAT I'M SAYING.
IS ALL THESE APARTMENT GOING TO ARE THEY GOING ABORTION OR SOME PERCENTAGE OF THEM.
ARE THEY GOING TOWARDS WORK FOR.
ARE THEY GOING TO PRICE AS WORKFORCE HOUSING OR MARKET MARKET BY MARKET PRICE? I JUST WANT TO BE CLEAR THE TERMS ARE INTERCHANGEABLE.
UH COUNCILMAN. THE THE DIFFERENT TERMS UH, YOU MIGHT BE THINKING OF IS AFFORDABLE HOUSING.
AND. NO, I KNOW EXACTLY WHAT I'M TALKING ABOUT.
I'M JUST TO YOUR WORD, I'M TRYING TO USE FOR THE RECORD, I WANT YOU TO STAY CLEARLY.
OKAY. SO NOT NOT WORKFORCE HOUSING.
THAT'S A DIFFERENT CONVERSATION.
HOUSING IS UP TO 120% OF THE MSA WHICH WE CONSIDER MARKET RATE.
I JUST WANT YOU TO BE CLEAR, UM, ON THAT, DOES THAT CONCLUDE YOUR QUESTION, COUNCILMAN FOSTER? ANY QUESTIONS? YES. UM, WAS ANY, UH, TRAFFIC STUDY DONE?
[01:40:02]
WE DO. DID YOU WANT? YES, COUNCILMAN WE DO.COUNCILMAN JOHNSON, YOU HAD QUESTIONS OF STAFF? YEAH. UH, YES, MAYOR.
UH, RIGHT ALONG THE SAME WAVELENGTH AS YOU AND COUNCILMAN FOSTER.
BECAUSE, UH, SAN FILIPPO IN THE MORNING IS.
IT'S CRAZY. SO I GUESS MY QUESTION IS, WITH THE ADDITIONAL 140, WHAT WOULD BE THE ROUTE LIKE? I UNDERSTAND SOME WILL BE STUDENTS, SOME WILL BE, YOU KNOW, EMPLOYEES FROM DIFFERENT PLACES.
UH, NANCY BUNCH TALKED ABOUT IT RIGHT.
AT THIS TIME, MOST PEOPLE ARE LEAVING PALM BAY TO GO TO WORK AND THEN COMING BACK.
I LOVE THE FIRST PHASE. THEY MAINTAINED IT.
IT LOOKS GREAT. IT'S ALWAYS CLEAN.
IT'S ALWAYS NEAT WHENEVER I LOOK BY, UM, BUT I JUST THAT'S WHERE MY CONCERNS ARE.
AND THE BABCOCK CORRIDOR, RIGHT.
UH, ON THAT SIDE. BUT EVEN MOREOVER, INTERESTINGLY ENOUGH, UH, THE COLLEGE IS RIGHT DOWN THE STREET.
RIGHT. AND THEN WE HAVE A CLEAN LAB NOT TOO FAR FROM THERE AS WELL.
I WOULD PREFER THAT TYPE OF LIGHT INDUSTRIAL COMMERCIAL IF I'M GOING TO DO SOMETHING LIKE THAT.
I THINK THAT'S A GREAT CORRIDOR FOR THAT.
UM, SO YOU'RE RIGHT, YOU'RE SPOT ON WITH THAT.
I THINK, UH, DEPUTY MAYOR, UH, IS LOOKING AT IT FROM A DIFFERENT PERSPECTIVE.
UM, AND HE HIGHLIGHTED, YOU KNOW, HE I KNOW HE IS A STRONG PROPONENT OF AFFORDABLE HOUSING.
UH, AT THE SAME TIME, HE'S BIG ON COMMERCIAL.
SO I THINK THIS IS A UNIQUE PIECE OF PROPERTY THAT'S THERE THAT COULD TACKLE THOSE THOSE ISSUES IN PARTICULAR, UH, WITH THE LIGHT INDUSTRIAL THAT WE'RE LOOKING TO GAIN IN OUR COMMUNITY, CREATE JOBS.
YOU'RE RIGHT. WE HAVE JOB PLACEMENT HERE.
UM, BUT ANYONE ELSE WISH TO SPEAK FOR AGAINST THIS ITEM? PLEASE STEP FORWARD, SIR.
AND MR. STICE, AFTER MASTER CHIEF.
BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.
I WAS NOT ORIGINALLY GOING TO SPEAK ON THIS ONE, BUT WHEN ESTHER BUCHANAN SAID THEY WERE LOOKING AT IMPACT FEE REDUCTIONS, WHICH I DIDN'T NOTICE IN THE PACKET WHEN I WAS GOING THROUGH THAT, THAT SPIKED.
WELL, I WANT THE FUNDS COMING INTO THE CITY OF PALM BAY.
I DON'T WANT ANYBODY GETTING ANY BREAKS.
I DON'T LIKE PREFERENTIAL TREATMENT, REGARDLESS OF WHAT THE CAUSE OR THE PURPOSE.
RIGHT. SO DEVELOPMENT HAPPENS OR DOESN'T HAPPEN.
I DON'T WANT TO SEE IMPACT FEE REDUCTION FOR FOR THIS DEVELOPMENT IF IT DOES HAPPEN.
THAT BEING SAID, THE CHOICE IS YOURS.
THANK YOU SIR. MR. STICE AND ANYONE ELSE WISH TO SPEAK AFTER MR. STICE? ROBERT SCHNEIDER 1796, WOODBRIDGE DRIVE, SOUTHEAST.
I'VE BEEN ON THAT ROAD 8:00 IN THE MORNING.
I STILL, I KEEP HEARING ABOUT THESE TRAFFIC STUDIES AND THEY THEY TRY TO MITIGATE WHAT'S HAPPENING AND RETIREES DON'T DO ANYTHING AND WHAT HAVE YOU THAT THAT PLACE IS INSANE. AND IT'S JUST NOT THE RIGHT TIME TO HANDLE THIS.
WHAT'S WHAT'S HAPPENING WITH THIS? UM. IT'S AMAZING. I GO AROUND TO, YOU KNOW, YOU GET A LOT OF PEOPLE WITH THESE NEW DEVELOPMENTS HAVING TO GO SHUT DOWN AND GO ON THAT SAME STREET WE'RE TALKING ABOUT TO GET ON 95.
AND IT JUST THE DENSITY IS THERE.
AND OF COURSE, YOU'VE GOT PEOPLE LATE FOR WORK OR THEY GOT A HEAVY FOOT OR WHATEVER.
UM, PLEASE TAKE A SERIOUS LOOK ON THIS.
THANK YOU. ANYONE ELSE WISH TO SPEAK FOR OR AGAINST THIS ITEM? OKAY. YOU'LL HAVE AN OPPORTUNITY TO REBUT AT THIS TIME, SIR.
IF THIS PROPERTY WAS TO BE DEVELOPED AS A LIGHT INDUSTRIAL.
[01:45:01]
THE TRIP GENERATION WOULD BE GREATER.THEN IT WOULD BE HIS MULTIFAMILY.
UM, IT WOULD BECOME WHAT'S CALLED A DESTINATION.
THE OTHER THING I'D SAY MAYOR AND CITY COUNCIL IS THE, UH, THE SURROUNDING AREA IS ALL MULTIFAMILY.
THEY MAY ASK US TO GO AHEAD AND DO THE SIGNALIZATION.
AND THEY'LL MAKE A LIST OF ALL THE IMPROVEMENTS WE'RE REQUIRED TO DO.
BY NOT APPROVING IT AND NOT MOVING FORWARD TO IT, YOU MAINTAIN THE STATUS QUO.
THESE ARE THE IMPROVEMENTS THAT YOU NEED TO DO, OR IT SIMPLY MAINTAINS THE STATUS QUO.
UH, ANYONE ELSE WISH TO SPEAK? YES, MA'AM. UH, MAYOR, I HAVEN'T CLOSED IT.
I DIDN'T CLOSE IT. I GIVE THEM AN OTHER OPPORTUNITY TO.
COME ON IN. PADDLE FOR TEN GEORGE'S AVENUE, NORTHEAST PALM BAY.
ALL I'M GOING TO SAY IS, I KNOW SAN FILIPPO IS A IS A MESS.
BUT IF YOU DON'T APPROVE THIS ONE, WHY DID YOU APPROVE THE ONE ON GLENHAM? THAT'S A MESS AS WELL.
JUST LIKE MANY OTHER DEVELOPMENTS, THE ROADS ARE JAMMED IN THE NORTHEAST SECTION OF PALM BAY.
BUT ANYWHERE WE GO IN PALM BAY, THE TRAFFIC IS HORRIBLE.
NOW. IF YOU PASS GLENHAM THEN PROBABLY THIS ONE SHOULD BE PASSED AS WELL.
WOULD YOU LIKE TO REBUT? SURE. IN THE, UH, THE RESIDENCE.
EXACTLY RIGHT. PALM BAY'S GOT, UH, TRANSPORTATION ISSUES.
WE ALL KNOW THAT YOU JUST HAD A SIMILAR ITEM ON THE AGENDA WHICH TALKED ABOUT, UH, THE DEVELOPER NEEDING TO DO IMPROVEMENTS AS PART OF THE DEVELOPMENT APPROVAL PROCESS, WHICH YOU APPROVED. IN A WAY, THIS IS SIMILAR.
WE HAVE TO MAKE THEM FOR YOU, UH, WHICH IMPROVES THE ROADWAY OR WE MAINTAIN THE STATUS QUO.
I WILL SAY THAT UNDER THE CURRENT ZONING OF MULTIFAMILY, IF WE WERE TO REZONE IT, UH, AND THEN COME BACK, AS YOU REQUESTED, WITH LIGHT INDUSTRIAL, COMMERCIAL, IT'S I'M SURE THAT IT'S GOING TO COME BACK WITH A HIGHER TRIP GENERATION AGAIN.
UH, BY APPROVING THE PROJECT, YOU RECEIVED A UNANIMOUS RECOMMENDATION FROM PNC STAFF RECOMMENDS IT.
I'M GOING TO CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION FOR DISCUSSION.
I'M SORRY. I WANTED TO ADD ONE THING IF I COULD REGARDING THE TRIP GENERATION COMMENT.
IF I COULD HAVE OUR CITY ENGINEER, FRANK WATANABE, COME UP AND SPEAK TO THAT BRIEFLY.
OKAY. UM, I WANT TO MAKE SURE COUNCIL GETS THE FACTS REGARDING THE TRAFFIC CONCERNS.
ALSO, JUST FOR THE RECORD, BECAUSE MR. BATTEN ASKED ABOUT IT, I KNOW HISTORICALLY THERE WERE, UM, HAVE BEEN TOLD THAT THERE WERE TRAFFIC IMPACT FEE REDUCTIONS THAT WERE GIVEN ON THE PRIOR PROJECT.
THANK YOU VERY MUCH. FRANK WATANABE, THE CITY ENGINEER.
UH, REGARDING THE QUESTION ON THE LAND USE AND THE DIFFERENCE BETWEEN THE LIGHT INDUSTRIAL OR, UH, OR ANY TYPE OF RESIDENTIAL USE, UH, DEPENDS ON THE TYPE OF LIGHT INDUSTRIAL. BUT THE CONCERN WE HAVE HERE IS THE LIGHT INDUSTRIAL AT THIS LOCATION WILL BE A REVERSE DIRECTION, AS YOU MENTIONED, MAYOR.
YEAH. RIGHT NOW IS THE BEDROOM COMMUNITY HEADING UP TOWARDS MALABAR ROAD, ONTO THE FREEWAY, INTO OUR OUR INTERCHANGE? UH, THIS WILL BE THE REVERSE.
SO ACTUALLY, IT WOULD HELP OUT THE SITUATION FOR THE LIGHT INDUSTRIAL, I BELIEVE THAT.
THAT'S ALL. WE NEED TO DISCUSS IT.
SO, NUMBER ONE, I DID ASK MR. BUCHANAN TO.
FOR CLARITY, AS FAR AS, UH, THE TERMS, UM, WORKFORCE HOUSING IN COMPARISON TO MARKET, UH, MARKET
[01:50:06]
RATE. UM.THAT. SO HE SOMEWHAT EXPLAINED AND I GET IT.
SO THE SECOND ASPECT, SO THE ONLY POSITIVE I'VE SEEN IN THAT PROJECT.
SO I'LL LET ME TALK ABOUT SOME OF THE POSITIVE.
THE POSITIVE IS THERE'S A NEED FOR UM STUDENT HOUSING.
THERE'S A NEED FOR UH, HOUSING OVERALL.
UM, IN THE CITY OF PALM BAY, THERE'S NO DOUBT ABOUT THAT.
UM, THIS AREA, STUDENT HOUSING TO ME, WE CANNOT DISCUSS, UH, A MARKET RATE.
AND AS WE, YOU KNOW, CATER, CATER AND TRYING TO CATER TO, UH, WORKFORCE OR POLICE OR TEACHERS OR STUDENTS, UM, THAT'S NUMBER ONE. NOT TO, YOU KNOW, NOT NUMBER NUMBER TWO IS, IS THE TRAFFIC.
I THINK WE COULDN'T SPEAK TO TO THAT ENOUGH.
UM, YOU GENTLEMEN STATED CLEARLY TRAFFIC IS IS HORRIBLE IN THAT, UH, CORRIDOR.
UM, I DO DAILY TRIP WHERE I HAVE A YOUNG LADY THAT GOES TO, YOU KNOW, I'M HER CHAUFFEUR.
UM, I HAVE TO TAKE HER TO MELBOURNE EVERY DAY FROM BAYSIDE TO MELBOURNE.
I AVOID SAN FILIPPO, I AVOID 95, DR.
BABCOCK, AND DOWN, YOU KNOW, NORTH.
AND IT'S NOT MUCH BETTER DEPEND ON THE DAY.
IT'S NOT MUCH BETTER TRYING TO GO OVER THAT 95 OVERPASS, TRYING TO MAKE IT TO.
UM, MY CONVERSATION WITH STAFF ABOUT.
I WOULD BE IN SUPPORTIVE OF A PROJECT LIKE THAT THAT I THINK IS NEEDED, BUT WITH THE CONDITION RIGHT NOW, AT THIS TIME, UH, I'M HAVING A HARD TIME SUPPORTING THAT BECAUSE OF THE CURRENT INFRASTRUCTURE.
THE WAY THINGS ARE RIGHT NOW, I THINK IT'LL MAKE IT, YOU KNOW, TEN TIMES WORSE.
UM, THAT THAT THOSE ARE MY COMMENTS.
THANK YOU. WELL, I SUPPORTED YOUR MOTION TO DENY DEPUTY MAYOR.
AND SOLELY BECAUSE I DO BELIEVE IF THIS WAS LIGHT INDUSTRIAL, JUST LIKE OUR TRAFFIC ENGINEER STATED, IT'S GOING TO CREATE JOBS, PEOPLE ARE GOING TO COME TO THAT LOCATION. SO IT'S KIND OF LIKE REVERSE.
AND THEN YOU'RE SPOT ON TO CREATE 140 MORE APARTMENTS TO OFFLOAD INTO WHETHER YOU'RE GOING TO TRY TO USE TREE LAND OR NOT, YOU'RE GOING TO PUT IT INTO THE SAN FILIPPO, THAT THAT WHOLE CORRIDOR, IF YOU GO EAST ON TREE LAND AND TRY TO GET INTO BABCOCK, IT'S GOING TO BE THE SAME, THE SAME STORY ALL OVER AGAIN.
UM, YOU'RE JUST CREATING A DIFFERENT BOTTLENECK SOMEWHERE ELSE.
SO FOR THOSE REASONS, I SUPPORTED THE DENIAL OF THIS REQUEST.
UH, SO I'VE GOT A MOTION TO DENY BY DEPUTY MAYOR FELIX, SECONDED BY MAYOR MEDINA.
ALL IN FAVOR, SIGNIFY BY SAYING AYE.
ALL OPPOSED. SIGNIFY BY SAYING NAY.
OR DO WE NEED TO DISCUSS 14? 14 IS OKAY.
SO WE ARE NOW ON ITEM NUMBER 15, MR. RODRIGUEZ.
AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE CODE OF ORDINANCES, TITLE SEVEN TRAFFIC AND VEHICLES BY CREATING A NEW CHAPTER 71 TO BE TITLED SCHOOL ZONE SPEED INFRACTIONS PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES AND CONFLICT, HEREWITH PROVIDING FOR INCLUSION IN THE CITY OF PALM BAY.
CODE OF ORDINANCES PROVIDING FOR SEVERABILITY CLAUSE.
PROVIDING FOR AN EFFECTIVE DATE.
THANK YOU. I'M GOING TO OPEN UP THE PUBLIC HEARING.
AND MISS SHERMAN, YOU PRESENT THIS REQUEST TO WAR.
SO, UM, OVER THE SUMMER, THE STATE LAW CHANGED, AND THERE IS NOW A STATUTE THAT ALLOWS MUNICIPALITIES TO CREATE A SCHOOL ZONE, SPEED LIMIT, ENFORCEMENT AREA.
AND WHAT WE'RE PROPOSING WITH THIS PARTICULAR ITEM IS THE OPPORTUNITY TO ESSENTIALLY INSTALL CAMERAS IN SCHOOL SPEED ZONES THAT WOULD, UM, AUTOMATICALLY ESSENTIALLY ISSUE CITATIONS TO DRIVERS WHO ARE VIOLATING THE SPEED ZONE WHEN THE WHEN THE, THE SPEED LIMIT, WHEN THE, THE SCHOOL ZONE IS ACTIVE.
[01:55:01]
SO, UM, THE LAW WAS VERY SPECIFIC IN HOW THOSE CITATIONS WOULD BE SET UP AND VERY SPECIFIC ABOUT THE PUBLIC NOTICE THAT'S INVOLVED IN ADVANCE OF CREATING A PROGRAM LIKE THIS.UM, ESSENTIALLY, THE STATUTE SAYS THAT EACH CITATION IS $100 IN TOTAL, AND IT HAS A VERY CLEAR BREAKDOWN ON WHERE THOSE FUNDS ARE TO BE USED AND WHAT THEY'RE TO BE USED FOR. UM, AND SO THIS IS ESSENTIALLY A HIGH LEVEL, WHAT WE'RE PROPOSING TO DO AND TO INSTALL THIS SYSTEM IN ALL OF OUR SCHOOL ZONES, IF YOU HAVE ANY QUESTIONS, AS I SAID, I'LL BRING UP THE CHIEF.
CHIEF, DID YOU WANT TO COME AND ENHANCE THAT PRESENTATION? JUST BRIEFLY.
KEVIN. WELL, HE SHE HE'S WELCOME TO COME.
I'M NOT GOING TO ASK ANYTHING.
I HAVEN'T ASKED ALREADY, CHIEF.
UM, IT'S LOCKED IN AT $100, CORRECT? CORRECT. OKAY. AND THEN I ALSO SAW IN THE STATE STATUTE THAT WE HAVE TO DO LIKE A 30 DAY EDUCATIONAL CAMPAIGN.
DO WE ALREADY KIND OF HAVE AN IDEA OF WHAT WE'RE LOOKING TO DO? ABSOLUTELY. SO IN FACT, AND GREAT QUESTIONS.
IN FACT, I HAVE A REPRESENTATIVE HERE FROM THAT ORGANIZATION FROM RED SPEED, MR..
GREG PARKS, UM, MET WITH HIM EARLIER TODAY WITH MY TEAM.
UM, THIS IS AN INITIATIVE THAT WE WERE, YOU KNOW, LOOKING TALKING ABOUT IT, LOOKING AT OTHER MUNICIPALITIES, NOT JUST IN THE STATE OF FLORIDA, BUT THROUGHOUT THE COUNTRY THAT HAVE BEEN UTILIZING THEM.
UM, AND IT'S SOMETHING THAT WE HAVE 16 SCHOOL ZONES IN THE CITY OF PALM BAY.
UM, SO THAT'S GOING TO BE CAMERAS.
IT'LL BE TWO CAMERAS AT EVERY SCHOOL ZONE, ONE FACING EACH DIRECTION OF THE ROAD.
THAT WILL INCREASE OUR SAFETY.
UM, I KNOW MRS. STICE MENTIONED IT MANY, SEVERAL MINUTES AGO ABOUT, UH, CITATIONS AND DETERRENT.
NEXT QUESTION. UH, I JUST SLIPPED MY MIND.
GIVE ME A SECOND. UM, WHAT WHAT WE WHAT WOULD WE USE? THE PORTION THAT WE RECEIVE THE CITY OF PALM BAY.
ARE WE LOOKING AT USING THOSE FUNDS TOWARDS SROS OR.
SO SO THE PORTION THAT COMES TO, UM, TO THE, TO THE MUNICIPALITY IS ACTUALLY GOES TO PUBLIC SAFETY.
UM, SO IT CAN BE UTILIZED FOR A VARIETY OF THINGS.
IT ALSO HAS A SECTION THAT GOES TOWARDS CROSSING GUARDS, UM, A CERTAIN AMOUNT OF, OF THE DOLLARS, UM, YOU KNOW, IT CAN BE PURCHASED FOR ANYTHING IN PUBLIC SAFETY VEHICLES, UM, ANY TYPE OF PUBLIC SAFETY EQUIPMENT, UM, THAT, THAT WE MAY DEEM THAT WE NEED AND WE DON'T HAVE THE FUNDING FOR.
IS THAT A POSSIBILITY? CAN WE TAP INTO THAT? IF IT CAUSES AN INVESTIGATION, WE CAN PULL IN THAT FOOTAGE FROM CAMERAS 100% THAT THAT'S WHERE I THINK WE CAN ALL ENHANCE IN A PUBLIC SAFETY ASPECT.
AND I THINK TAPPING INTO THAT RESOURCE IS CRITICAL AS OUR CITY CONTINUES TO GROW.
WE'RE AT 135,000 TODAY, AND IN THAT WE HAVE TO DO EVERYTHING WE CAN TO PROTECT OUR CITIZENS.
AND THIS IS A TOOL THAT YOU WOULD FEEL CONFIDENT IN, IN HELPING YOU SOLVE ANY CRIMES.
ABSOLUTELY. I'LL SAY, SIR, THAT THAT CONCLUDES MY COMMENTS AND QUESTION.
COUNCILMAN FOSTER? YES, MAYOR.
THANK YOU. UM, I THINK YOU ASKED THE QUESTION I WAS GOING TO ASK.
UM, COULD THIS CAMERA BE USED TO SOLVE CRIMES, HIT AND RUN? UM, KIDNAPINGS SUCH AS THAT IN THE SCHOOL ZONE AREA? AND THAT WOULD BE MY QUESTION TO THE CHIEF.
THAT'S ALL I HAVE. I IT'S SOMETHING I, I THINK IS A GREAT IDEA, A GOOD SUPPORT AND GOOD SUPPORT OF, UM, OUR SAFETY AND THAT'S WHAT'S ON MY MIND. THANK YOU, COUNCILMAN FOSTER.
THANK YOU CHIEF. APPRECIATE YOU COMING ON.
THANK YOU. SO AT THIS TIME, I WANT TO SEE WHO WANTS TO SPEAK FOR OR AGAINST THIS ITEM.
[02:00:01]
BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.I'VE GOT A COUPLE OF QUESTIONS WITH THIS ONE.
THE FIRST ONE, DOES THE TICKET GO TO THE VEHICLE OR DOES THE TICKET GO TO THE DRIVER? BECAUSE THAT'S SOMETIMES BECAUSE WHO'S WHO GETS THE POINTS FOR SPEEDING IN A SCHOOL ZONE.
SO THAT THAT JUST RAISED THAT QUESTION OF THE LEGAL SIDE OF IT.
I LIKE THE IDEOLOGY, BUT, YOU KNOW, IT'S JUST HOW DO WE SOLVE THAT? BECAUSE IF MY KIDS DRIVE IN THE CAR, I WANT HIM TO PAY THE TICKET, BUT IT COMES UP ON MY VEHICLE.
ITEM NUMBER TWO WAS THAT THE PREVIOUS MEETING? WE WERE TALKING ABOUT THE SPEED INDICATOR SIGNS THAT HAD THE CAPABILITY OF TAKING PICTURES AND CAMERAS, AND I ASKED THAT QUESTION, IF WE COULD HAVE THESE OUT THERE WHERE YOU'D BE ABLE TO GET A PICTURE AND THEN TICKET THE PEOPLE THAT WERE DOING IT.
WELL, THIS IS 100% WHAT WE'RE TALKING ABOUT.
IT'S JUST NOT IN THE SCHOOL ZONE.
AND THE BOTTOM THE OTHER LINE OF THAT ONE WAS THE TICKET REVENUE.
IF WE GENERATE FUNDS FOR THE SAFETY PROGRAM, I THINK THAT'S GREAT.
I'M HOPING THAT I HOPE THAT'S IN THERE, BUT I'M NOT SURE.
ABILITY EXPANDING, LIKE YOU'RE SAYING, WHERE WE COULD PUT IT SOMEPLACE ELSE OTHER THAN SCHOOL ZONES, BECAUSE WE HAVE OTHER AREAS THAT ARE JUST AS DANGEROUS IF WE'RE LOOKING AT SAFETY. THANK YOU, THANK YOU.
AND, UH, GO AHEAD, UH, MR. STICE. AND THEN I'LL HAVE, UH, PERHAPS THE CONTRACTOR COME UP, UH, OR THE THE CHIEF COME BACK UP.
GOOD EVENING. I THINK THIS IS A GREAT PROGRAM.
UM, A COUPLE OF QUESTIONS, BECAUSE WE DID THIS IN ANOTHER STATE, IN ANOTHER LIFE.
ARE THESE SIMPLY RED LIGHT CAMERAS, OR ARE THERE GOING TO BE FOR RED LIGHT VIOLATORS AND SPEEDING? UM, WHAT DO YOU DO WITH OUT OF STATE PLATES? HOW IS THAT HANDLED? AND FINALLY, IF LIKE ANYTHING, THIS HAS TO BE MONITORED.
IF YOU HAVE THIS, I DON'T KNOW, SIX, 16 LOCATIONS OR WHATEVER THEY ARE, DO WE HAVE THE STAFFING TO MONITOR THIS AND A SYSTEM IN PLACE TO GET THIS OUT IN A TIMELY FASHION? SO ALL ALL GREAT QUESTIONS AND I KNOW THE CHIEF WILL PROVIDE THOSE.
YEAH. WELL MARINES WOULD HAVE ASKED A BETTER QUESTION SIR.
UM, THIS IS COME NO FUNDING OR ANY COST IS GOING TO COME TO THE CITY.
UM SO IF I MAY, SOME OF THE QUESTIONS THAT WERE WERE APPROACHED AND POSED BY MR. BRATTON AND MR. STICE, IF I CAN HAVE MR..
GREG PARKS, WHO'S, UH, SITTING RIGHT BEHIND ME.
YES, SIR. PUT THEM AT EASE IN TERMS OF THEIR CONCERNS.
MR. PARKS, THANKS FOR JOINING US TODAY.
YOU'RE WELCOME. THANK YOU FOR HAVING ME.
UH, BOY. THERE'S YOU. GET CLOSER TO THE MIC, SIR.
EXCUSE ME. IS THAT BETTER? YES, SIR. OKAY. THANK YOU.
CHIEF, I'M GREG PARKS WITH RED SPEED, 1300.
UH, LAUREL HILL DRIVE, TALLAHASSEE.
UM, I'LL TRY TO REMEMBER THE QUESTIONS IN ORDER.
UH, THE BY STATUTE, THIS IS A NEW LAW.
AND AS YOUR MANAGER STATED, I PARTICIPATED IN THE PROCESS IN TALLAHASSEE, AND IT IS A GREAT LAW.
UH, WE CLONED IT VERY CLOSELY OFF OF SIMILAR LAW IN GEORGIA.
THAT'S BEEN IN PLACE FOR FIVE YEARS.
AND AT MOST CUSTOMERS, SPEEDING IS DOWN OVER 90%, WITH ONLY A 7% RECIDIVISM RATE AND NO COST TO TAXPAYERS, MEANING 93% DON'T GET ANOTHER TICKET AFTER THEY RECEIVE ONE.
SO THE SAFETY, I BELIEVE, IS THERE.
THERE IS NO OUT OF POCKET COST TO THE CITY.
WE OPERATE ON A REVENUE SHARE.
ALL CITATIONS ARE APPROVED BY YOUR LAW ENFORCEMENT, BY YOUR POLICE DEPARTMENT, NOT US.
UM, I BELIEVE ONE OF YOUR CITIZENS.
UH, THERE ARE NO POINTS OR INSURANCE.
AND I BELIEVE THE RESULTS IN GEORGIA PROVED IT'S WORKS.
UH, THE FINE UNDER THE THEME OF EDUCATION IS MUCH LOWER.
BUT AS A UTC DOUBLED IN THE SCHOOL ZONE, PROBABLY BE 3 TO $400, OR CERTAINLY WAY HIGHER THAN 100.
SO IT'S DESIGNED TO IMPROVE BEHAVIOR.
AND AGAIN, I BELIEVE IT'S PROVEN TO HAVE DONE THAT.
UM, AND THE STATE DOESN'T TAKE A LOT, WHICH IS A MIRACLE.
AND I HAVE NO PROBLEM WITH ANYBODY INFERRING THAT WOULD NORMALLY BE THE CASE.
[02:05:03]
PROGRAM, $12 TO THE BREVARD COUNTY SCHOOLS THAT MUST BE USED FOR PUBLIC SAFETY, SCHOOL HARDENING, ACTIVE SHOOTER DETECTION, SIDEWALKS, ETC.AND THEN $20 IN THE STATE, IT'S ONLY 20 OF 100, WHICH IS A BARGAIN IN THIS CASE, WE BELIEVE.
WHAT WERE THE OTHER QUESTIONS? MAYOR, I THINK THAT YOU COVERED IT ALL.
SO THE VEHICLE IS GOING TO BE CITED.
UH, IT'S EFFECTIVELY A CIVIL VIOLATION.
YEAH. I THINK YOU NAILED ALL THE QUESTIONS, SIR.
OKAY. THANK YOU. NO, THANK YOU, MR. PARKS, FOR JOINING US, CHIEF.
ANYTHING ELSE TO ADD, SIR? NOPE. APPRECIATE IT.
ALL RIGHT. THANK YOU. ANYONE ELSE WISH TO SPEAK? YES, SIR. STEP RIGHT UP.
GOOD EVENING, MR. MAYOR. GOOD EVENING.
COUNCIL. MY NAME IS RANDALL OLSZEWSKI.
I LIVE AT 348 BROOK EDGE STREET, NORTHEAST.
MY PRIMARY ROLE IN THIS WORLD IS FATHER PROTECTING MY CHILD.
A CHILD IS GOING TO TURN EIGHT YEARS OLD IN A LITTLE WHILE.
SHE GOES TO SCHOOL. SCHOOL ZONES ARE VERY IMPORTANT TO ME.
WE HAVE, UH, NOT ENOUGH, BUT WE HAVE AS MUCH AS WE CAN.
SOME QUALITY OFFICERS PROTECTING OUR STREETS.
THAT DRIVES THE VETERAN MARKED POLICE UNIT.
2021 YOU GOT TO GO 20 TO GET IT TO TURN ON.
TO QUOTE GRADY JUDD, YOU'RE AN EVIL DOER.
OKAY, SO YES, WE SHOULD CATCH, WE SHOULD NAB, WE SHOULD INFORM AND EDUCATE THOSE FOLKS.
I SAY IF YOU DO IT INTENTIONALLY, SOME FOLKS ARE NOT PAYING ANY ATTENTION.
THEY STILL NEED EDUCATION, ARE NOT DOING IT INTENTIONALLY.
AND I DO FEEL AS THOUGH SOME OF OUR SCHOOL ZONES ARE NOT MARKED THE BEST, THE MOST EFFECTIVELY.
SO I HOPE THAT THROUGH THIS INFORMATIONAL CAMPAIGN, WE CAN LOOK WITHIN AND ASK OURSELVES THE TOUGH QUESTIONS OF WHAT DO WE HAVE TO DO TO BETTER INFORM THE CITIZENRY OF SCHOOL ZONES? DOES EVERY SINGLE SCHOOL ZONE HAVE A BLINKING LIGHT OR AND OR DOES EVERYONE HAVE AN EYE CHART THAT YOU HAVE TO DECIPHER WHAT THE DAYS ARE? IS IT MONDAY? IS IT FRIDAY? IS IT THURSDAY? WHAT'S THE TIME? IF THE LIGHTS ON, I GO SLOW, RIGHT? BUT IF THERE'S NOT A LIGHT, I GO SLOW AND THEN I GET TAILGATER I NEED, I NEED SOME HELP, I NEED SOME HELP.
AND I THINK WE ALL DO. SO I THINK THAT THROUGH THIS, UH, PUBLIC INFORMATION CAMPAIGN THAT WE'RE GOING TO SET OURSELVES ON BEFORE WE TALK COSTS AND FIGURES AND HOW WE'RE REALLY GOING TO MAKE THIS WHOLE THING WORK.
WE REALLY NEED TO LOOK WITHIN IT.
HOW ARE WE INFORMING EVERYBODY THAT THE SCHOOL ZONES ARE THERE? OKAY. AND AGAIN, IF YOU DO THAT INTENTIONALLY, YOU'RE EVIL.
YOU'RE YOU'RE PUTTING THE LIVES OF CHILDREN AT RISK.
UM, ADDITIONALLY, JUST ONE LAST POINT.
AS WE CONTINUE TO COMPREHENSIVELY BUILD OUT OUR CITY WHEN WE STACK SCHOOL ZONES SO CLOSE TO EACH OTHER THAT THEY COULD POTENTIALLY BE ONE BIG ONE, MAYBE WE SHOULD MAKE IT ONE BIG ONE. SO LAMAR ELEMENTARY, LAMAR, PINEAPPLE COVE, THERE'S TWO, TWO SCHOOL ZONES TWO BLOCKS APART.
EVERYTHING TO DO WITH THE LOCK BAR.
THAT'S A STORY FOR A DIFFERENT DAY.
UM, I REMEMBER RED LIGHT CAMERAS ON SAN FILIPPO AND MALABAR.
IRONICALLY, UM, THAT INTERSECTION WAS HORRIBLE.
TEN, 15 YEARS AGO, WHEN THOSE CAMERAS WERE ON THERE, I SAW A LOT OF BLINKING, STROBING LIGHTS.
ALSO SAW A LOT OF PEOPLE, YOU KNOW, NOT REALLY HAVE TO PAY THE CONSEQUENCES OF THAT.
UM, BECAUSE, YOU KNOW, ULTIMATELY IT WAS DEEMED UNCONSTITUTIONAL BY OUR FLORIDA SUPREME COURT.
SO HOW DEEP ARE WE GOING TO GET INTO THIS POTENTIALLY FISCALLY, UH, AND THEN HAVE TO PULL OUT? HOPEFULLY. NOT AT ALL. HOPEFULLY WE WON'T HAVE TO BECAUSE THIS IS RIGHT FOR OUR SOCIETY, IN MY OPINION.
UM, BUT I'M JUST LOOKING AT PRECEDENT BECAUSE THAT'S HOW WE LOOK AT THINGS IN OUR SOCIETY.
SO FIRST OF ALL, I HAVE A QUESTION FOR YOU.
THANK YOU FOR THAT DESCRIPTION.
THIS GENTLEMAN HE'S HE'S BEEN HE KNOWS WHAT HE'S DOING.
HE KNOWS WHAT HE'S DOING. AND HE'S GETTING EVILDOERS ONE AT A TIME.
SO WE DO NEED HELP. BUT IT HAS TO BE IN THE RIGHT WAY.
ALL RIGHT. THANK YOU. THANK YOU, SIR, THANK YOU.
AND THE COST OF THIS? UM, CHIEF, YOU WANT TO COME BACK UP, OR SHOULD MR. PARKES COME BACK UP? UH, BECAUSE HE TAPPED INTO CONSTITUTIONALITY AND.
[02:10:04]
YEAH. YEAH. YES.VERY ACTIVE CITIZENRY, I RESPECT THAT.
UH, I'LL FIRST ADDRESS THE CONSTITUTIONALITY.
UH, RED LIGHT CAMERAS, AND THESE ARE WEIGHED.
FIRST, I'LL ADDRESS THE DIFFERENCES IN.
BECAUSE I WAS AN ELECTED OFFICIAL, THAT WOULD BE AN IMPORTANT.
I UNDERSTAND YOU HAD THOSE IN THE PAST, SO, UH, AS MANY DID.
UH, THE RED LIGHT CAMERAS COULD BE ANYWHERE IN THE CITY.
A NANOSECOND INTO THE RED WOULD TRIGGER A VIOLATION FOR POLICE REVIEW.
UH, SCHOOL'S IN SESSION DURING INSTRUCTIONAL CLASSES.
SO THERE ARE SIGNIFICANT DIFFERENCES.
AND THERE'S STILL MANY IN USE IN THE STATE.
HUNDREDS. SO THEY ARE CONSTITUTIONAL AND PHOTO ENFORCEMENT FOR.
AND YOU CAN HAVE A VERY SPIRITED, RESPECTFUL DEBATE ON THE MERITS OF IT.
UH, THE FORCE MULTIPLIER, ALLOWING POLICE TO DO OTHER THINGS, RESPOND TO CALLS QUICKER.
NO ONE HAS ENOUGH POLICE TO BE IN 16 SCHOOL ZONES DURING THE SCHOOL DAY.
SO IF IF THE PROGRAM IS OPERATED ETHICALLY AND CORRECTLY BY THE CITY AND THE VENDOR.
UM, THERE ARE NO PROBLEMS. WE HAVE NOT EXPERIENCED.
AND THEN MISTER PARTY HIGHLIGHTED, UH, THE INVESTMENT ASPECT OF IT.
THERE'S NO COST OUT OF POCKET COST TO THE CITY AT ALL.
I'M GOING TO CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.
I GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY MAYOR MEDINA.
ANY FURTHER DISCUSSION? COUNCILMAN? YES, SIR.
MAYOR, I'D JUST LIKE TO ADD, I THINK, UH, MISS OLSZEWSKI MADE A GOOD POINT AS FAR AS TAKE A GOOD LOOK ON WHAT WE HAVE IN PLACE RIGHT NOW AS FAR AS, UH, EQUIPMENT, YOU KNOW, INFRASTRUCTURE, WHAT HAVE YOU TO MAKE SURE THAT BEFORE WE ENFORCE, START ENFORCING THIS, EVERYTHING IS WORKING PROPERLY, AND WE HAVE SUFFICIENT STUFF BECAUSE, I MEAN, THIS IS A DAILY THING FOR ME WHERE I HAVE TO TRAVEL FROM BAYSIDE TO MELBOURNE.
SO I'VE, I GO THROUGH THREE, UH, AT A MINIMUM.
SO THERE'S TIME THAT I HAVE TO REMEMBER WHAT TIME OF THE DAY.
SO IT'S, UM, YOU KNOW, MY ROUTE TYPICALLY IS WACO BABCOCK.
SO THERE'S SOMETIMES IT'S NOT.
YEAH. WE MAY HAVE AN OPPORTUNITY THERE TO IMPROVE FOR IMPROVEMENT.
SO THAT'S MAYBE A DIRECTION FOR STAFF TO TO LOOK A LITTLE CLOSER OUT OF ALL OF 16 LOCATIONS.
ARE THEY ALL ON THE UP AND UP? UM, JUST WANTED TO, UH, POINT, YOU KNOW, MAKE A POINT ON THAT.
WELL, YOU KNOW, I REALLY ENJOYED THE THE BRIEF 7% RECIDIVISM, RIGHT? THAT SPEAKS LOUDLY.
SO I REALLY APPRECIATED THAT, THAT ASPECT TO IT.
AND THEN MOREOVER, THE OPPORTUNITY TO AS A TOOL TO HAVE THIS AS A CRIME SOLVING ISSUE, TO GIVE LAW ENFORCEMENT THAT, THAT OPPORTUNITY, I'M ALL ON BOARD WITH THIS.
NOT ONLY IT'S IT'S EASY TO GO INTO THE PUBLIC SAFETY ASPECT OF OUR CHILDREN.
AND, AND, YOU KNOW, I'VE SEEN FOLKS PASSING A BUS, A SCHOOL BUS.
AND IT'S TO ME THAT THAT'S LIKE, UM, WE SHOULDN'T EVEN BE THINKING ABOUT THAT.
SO I'M FULLY ON BOARD WITH THIS.
I SECOND THIS, AND I'M I'M REALLY ON BOARD WITH IT.
SO I GOT A MOTION BY COUNCILMAN JOHNSON, SECOND BY THE MAYOR.
ALL IN FAVOR SIGNIFY BY SAYING I, I I AYE, PASSES FOUR ZERO.
WE'RE NOW ON ITEM NUMBER 16, MR. RODRIGUEZ. ORDINANCE 2023 115.
AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE CODE OF ORDINANCES, TITLE 17, LAND DEVELOPMENT CODE, CHAPTER 185 ZONING CODE, SUBCHAPTER PLANNED UNIT DEVELOPMENT PUD BY MODIFYING THE TIMELINES RELATED TO PRELIMINARY DEVELOPMENT PLAN SUBMITTALS, PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES
[02:15:09]
AND CONFLICT. HEREWITH PROVIDING FOR INCLUSION IN THE CITY OF PALM BAY.CODE OF ORDINANCES PROVIDING FOR SEVERABILITY CLAUSE.
PROVIDING FOR AN EFFECTIVE DATE.
THANK YOU. I'M GOING TO OPEN UP THE PUBLIC HEARING AND MISS SHERMAN.
UH, THANK YOU MAYOR. SO THIS ITEM AND THE SUBSEQUENT ITEM ARE ALL RELATED TO CHANGING TIMELINES THAT ARE IN OUR ORDINANCES CURRENTLY, UH, THAT PERTAIN TO A LAND DEVELOPMENT TYPE CHANGES.
UM, STAFF CAN CERTAINLY ELABORATE ON THIS AS, AS YOU HAVE QUESTIONS.
BUT THE THE HIGH LEVEL REASON FOR THIS HAS A COUPLE COMPONENTS.
UM, ONE, FIRST OF ALL, IS THAT IN OUR CURRENT PROCESS TODAY, BASED ON OUR TIMELINES AND OUR ORDINANCE RIGHT NOW, STAFF ENDS UP WITH APPROXIMATELY TWO WEEKS OF TIME TO REVIEW LARGE, MASSIVE PROJECTS THAT ARE THESE PUDS WE'VE WE HAVE FOUND AND CURRENT STAFF AND PRIOR STAFF ALL HAVE HAD A VERY CHALLENGING TIME KEEPING UP WITH NOT JUST THE VOLUME OF THOSE PROJECTS THAT HAVE COME IN, BUT THE ABILITY TO, IN THAT TWO WEEK TIME FRAME, UM, ADEQUATELY AND EFFECTIVELY REVIEW THESE PROJECTS IN A WAY THAT BRINGS A PRODUCT TO YOU ALL AND TO THE PLANNING AND ZONING BOARD THAT WE FEEL IS A GOOD REPRESENTATION OF WHAT IT'S BEST FOR THE CITY.
SO THE SHORT VERSION OF THAT IS WE'RE TRYING TO ADD SOME ADDITIONAL TIME FRAME THAT'S ALREADY WITHIN STATE STATUTE THAT OTHER CITIES, INCLUDING, I BELIEVE, MELBOURNE, UM, HAVE HAD IN PLACE FOR SOME TIME.
WE BELIEVE IN 2016 2017 TIME FRAME TO TO CREATE THESE MORE RESTRICTIVE TIMELINES.
UM, I WILL SAY, AS WE'VE SHARED IN OUR BRIEFINGS WITH YOU ALL THAT THIS IS NOT INTENDED TO, UM, SLOW DOWN DEVELOPMENT IN THE CITY, BUT RATHER TO MAKE SURE THAT WE ARE PROVIDING YOU WITH OUR VERY BEST RECOMMENDATIONS AND A QUALITY PRODUCT THAT HAS BEEN FULLY VETTED AND DOESN'T HAVE, YOU KNOW, EIGHT CONDITIONS ATTACHED TO IT, BECAUSE WE'VE ALREADY BEEN ABLE TO WORK THROUGH ALL THAT WITH THE DEVELOPER AND THE APPLICANT.
UM, SO I'M EXCITED ABOUT THIS CHANGE.
I THINK IT'S GOOD FOR THE CITY.
SEEING NONE. IS THERE ANYONE IN THE AUDIENCE THAT WISH TO SPEAK, MASTER CHIEF? ARE YOU GOING TO SPEAK? YES.
YES, SIR. BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.
I HAVE TWO ITEMS WITH THIS ONE.
WAS THERE GOING TO BE AN UNLIMITED TIMELINE WHERE YOU'RE WAITING TO SEE FOR AN INSPECTION? I COULDN'T FIND OUT WHAT THAT TIMELINE WOULD BE.
WE'LL JUST. WE HAVEN'T GOTTEN TO YOU YET.
THE OTHER ANOTHER ITEM IS THAT LAST COUNCIL MEETING.
WE JUST VOTED TO HIRE OUTSIDE AGENCIES TO INSPECT THE BIG PACKETS.
WE'RE WILLING TO SPEND THAT MONEY.
YET WE'RE NOW WE'RE HEARING IN THIS MEETING, WHILE OUR STAFF HAS RUSHED FOR TWO WEEKS TO DO IT.
OKAY? AND THE THIRD ITEM IS I'VE WATCHED PLANNED UNIT DEVELOPMENTS.
I DON'T SEE AS MANY PUDS IN THE CITY AS WE USED TO HAVE.
WE SEE OTHER NAMES AND TITLES FOR THEM, BUT UNDER A PUD, I'VE SEEN PUD SUBMIT THEIR PAPERWORK.
AND THEN 2 OR 3 YEARS LATER, AFTER PEOPLE FORGOT ABOUT THE PUD PROJECT, IT SHOWS UP AGAIN ON.
I DON'T KNOW HOW YOU GO ABOUT IT, BUT SOME KIND OF GUIDELINES THAT MAKES A PROJECT THAT SITS STAGNANT FOR YEARS ON END BECAUSE, WELL, OUR FUNDING SOURCE FELL THROUGH, BUT NOW WE WANT TO GO BACK AND MAKE LOOK AT ALL THE AGREEMENTS THAT WAS MADE WITH THE CITY FROM 15 YEARS AGO, THOSE IT JUST RUBS ME THE WRONG WAY.
THANK YOU. MADAM CHAIRMAN, THERE'S THREE QUESTIONS.
THANK YOU. MAYOR JONES, DO YOU WANT TO TAKE A STAB AT THAT? SURE. I'LL TAKE A STAB.
AND THEN IF I'M INCORRECT, I WOULD DEFER TO LISA TO CORRECT ME.
UM, OKAY, SO A COUPLE OF QUESTIONS.
NO, IT WOULD NOT PROVIDE AN UNLIMITED PERIOD OF TIME FOR REVIEWS.
[02:20:01]
COMPLETENESS WITHIN 30 DAYS.I BELIEVE THERE'S ALSO AN UP TO 180 DAYS TO BRING THAT APPLICATION THROUGH REVIEW, THROUGH PNC, AND TO COUNCIL FOR EITHER APPROVAL OR DENIAL. AND THEN THERE'S ADDITIONAL TIMELINES FOR WHICH A DEVELOPER OR AN ENGINEER CAN, UM, SUBMIT AND RESPOND TO REVIEW COMMENTS AFTER A CERTAIN PERIOD OF TIME.
I BELIEVE IT'S THE THIRD REVIEW.
THERE IS A REQUIRED PRE-APPLICATION MEETING BEFORE YOU CAN EVEN REVIEW THAT THIRD ROUND.
REGARDING OUTSIDE AGENCIES, YES, WE WE DID COME TO COUNCIL FOR FUNDING TO HAVE AN OUTSIDE PLANNING CONSULTANT HELP REVIEW, UM, THE APPLICATIONS THAT COME IN KEEPING IN MIND THAT AND I BELIEVE I SENT SOME STATS AND DATA TO YOU ALL EARLIER THIS EVENING BEFORE COUNCIL.
WE DON'T ONLY GET PUD APPLICATIONS, WE GET ADMINISTRATIVE VARIANCES, CONDITIONAL USE APPLICATIONS, SITE PLANS THAT ARE ADMINISTRATIVELY REVIEWED, UH, CONSTRUCTION DRAWINGS, UM, THE GAMUT.
IN ADDITION, ANOTHER UM, PROJECT THAT STAFF IS TRYING TO TACKLE WITH THE LIMITED CAPACITY THAT WE CURRENTLY HAVE IS THE LAND DEVELOPMENT CODE UPDATE THAT IS STILL PENDING FOR US TO BE IN COMPLIANCE WITH OUR COMP PLAN, UM, OUR RECENTLY APPROVED COMP PLAN UPDATE.
SO THAT'S JUST A COUPLE OF THE, I GUESS, SALIENT POINTS, UM, TO KIND OF TOUCH ON THE PUD AND THE PROJECTS THAT GO STALE, YOU KNOW, A COUPLE YEARS LATER, THEN THEY COME BACK.
THERE'S REALLY NO EXPIRATION DATE ON THOSE, BECAUSE THE PUD AND THE PRELIMINARY DEVELOPMENT PLAN AND FINAL DEVELOPMENT PLAN ESSENTIALLY CREATE A TENTATIVE ZONING AND A FINAL ZONING.
AND THOSE DON'T HAVE AN EXPIRATION BECAUSE IT IS A LAND ENTITLEMENT.
OKAY, SO WE'RE GETTING TWO THUMBS UP FROM LISA.
ANYONE ELSE WISH TO SPEAK? I'M GOING TO CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.
SO MOVE. GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ANY ADDITIONAL DISCUSSION, GENTLEMEN? ALL IN FAVOR SIGNIFY BY SAYING I.
COUNCILWOMAN. ARE YOU STILL ONLINE? YES I AM.
IS IT AN EYE FOR YOU? ON ITEM 16.
ORDINANCE 2020 3-1 16, AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE CODE OF ORDINANCES, TITLE 17, LAND DEVELOPMENT CODE, CHAPTER 184 SUBDIVISIONS. BY MODIFYING THE PROCESS FOR SUBMISSION OF A PRELIMINARY AND FINAL PLAT APPLICATIONS.
PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES AND CONFLICT.
HEREWITH PROVIDING FOR INCLUSION IN THE CITY OF PALM BAY.
CODE OF ORDINANCES PROVIDING FOR SEVERABILITY CLAUSE.
PROVIDING FOR AN EFFECTIVE DATE.
THANK YOU. I'M GOING TO OPEN UP THE PUBLIC HEARING, MADAM CHAIRMAN.
UH, THANK YOU MAYOR. THIS IS ESSENTIALLY IDENTICAL IN TERMS OF THE LANGUAGE CHANGE THAT'S PROPOSED, THE SAME AS WE JUST DISCUSSED FOR THE TIMELINES AND ADOPTING THE FLORIDA STATUTES. SAME LANGUAGE IS INCLUDED IN THIS PARTICULAR ORDINANCE CHANGE.
SO HAPPY TO ANSWER ANY QUESTIONS YOU MIGHT HAVE.
SEEING NONE. I'M CLOSING THE PUBLIC HEARING, ASKING FOR A MOTION.
SO MOVED. SECOND, GOT A MOTION BY DEPUTY MAYOR FELIX, SECONDED BY COUNCILMAN JOHNSON.
ANY ADDITIONAL DISCUSSION, GENTLEMEN? SEEING NONE. I'M CALLING.
ALL IN FAVOR, SIGNIFY BY SAYING I, I ANY ANY OPPOSED.
DID YOU VOTE ISE? YES, SIR. ALL RIGHT.
WE ARE NOW GOING BACK TO CONSENT.
[CONSIDERATION OF ITEMS REMOVED FROM CONSENT AGENDA]
WE'LL START WITH ITEM NUMBER TWO.DEPUTY MAYOR, MR. BILL BATTEN. BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.
YOU'RE GOING TO HEAR THIS QUITE A BIT COMING UP IN TONIGHT'S PRESENTATIONS ABOUT DRAWING FROM FUNDS FROM OTHER AREAS, FROM OTHER AREA CODES OR ZIP CODES, NOT AREA CODE.
ZIP CODES PRIMARILY USING FUNDS FROM 32908 TO PUT THEM INTO OTHER FUND AREAS.
[02:25:04]
RIGHT. SO UNDER ITEM CONSENT AGENDA ITEM NUMBER TWO, I NOTICE THAT IT'S 32907 AND 32908.YET ALL OF THE BUILD EVERY BIT 100% OF THE BUILDING OF THIS IS HAPPENING IN 32907.
YET THE LARGEST PROPORTION OF THE FUNDS COMING OUT OF IT IS COMING OUT OF 32908.
AND I'M NOT TALKING LITTLE FUNDS, I'M TALKING 1.7 MILLION VERSUS $3 MILLION THAT COULD BE USED IN 32908, BECAUSE YOU'RE NOT DOING ANYTHING OUT THERE FOR THE RESIDENTS IN THE PARKS FORUM RIGHT NOW.
THAT BEING SAID, WELL, I MIGHT EVEN CONSIDER A 50/50 SPLIT IF YOU'RE TRYING TO MAKE IT.
EVERY SINGLE 3290 832907 32909.
ALL OF THEM ALL JOIN AT THAT CORNER RIGHT THERE.
SO THEY ALL HAVE JOINING BORDERS FOR THE SYSTEM.
SO INSTEAD OF A 5050 SPLIT I WANT TO SEE 25% COME OUT OF EACH ONE OF THE UNITS FOR THIS PARK.
THANK YOU. ANY OTHER SPEAKER CARDS? NO, SIR. OKAY, I NEED A MOTION.
SO MOVED. SECOND, GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX ANY.
ALL IN FAVOR SIGNIFY BY SAYING I.
WE ARE NOW ON ITEM NUMBER FOUR.
I NEED TO READ THE RESOLUTION.
RESOLUTION 20 2348, A RESOLUTION OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AUTHORIZING THE MAYOR AND OR CITY MANAGER TO EXECUTE A STATE FUNDED GRANT AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE SAINT JOHNS HERITAGE PARKWAY WIDENING PROJECT, PROVIDING FOR AN EFFECTIVE DATE.
THANK YOU. MR. BELL. BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.
ONE MORE TIME 32907 AND 32908.
SO SAME STATEMENTS AS PREVIOUSLY, EXCEPT FOR THE FACT THAT IN THIS CASE, STARTING FROM THE CONSTRUCTION SIDE OF IT, IT'S ALL NORTH OF MALABAR ROAD.
SO AT WHAT POINT DOES 32908 COME INTO PLAY? IT DOESN'T. THANK YOU VERY MUCH.
A MOTION BY COUNCILMAN OR DEPUTY MAYOR FELIX, SECONDED BY COUNCILMAN JOHNSON.
ALL IN FAVOR SIGNIFY BY SAYING I.
WE ARE NOW ON ITEM NUMBER NINE.
IT'S ABOUT. BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.
THIS ITEM, I THINK, COULD RELATE TO CONSENT AGENDA NUMBER FIVE.
IT'S STILL SHORELINE RESTORATION, RIGHT.
AND THAT WHEN YOU'RE ASKING FOR $76,000 FOR A GRANT.
SO IN THIS CASE, IF WE WOULD JUST JOIN IN WITH THAT GRANT, SEE IF WE COULD COMBINE THE FUNDS, BECAUSE THERE'S ALL THIS SHORE RESTORATION BECAUSE OF A WASHOUT, THAT IT WOULD SAVE THE GENERAL FUND $20,000.
AND FOR ME, BEING THE PERSON THAT I AM, $20,000 IS HALF OF A NEW POLICE CAR.
THANK YOU. THANK YOU, MADAM CHAIRMAN.
I THANK YOU, MAYOR. SO ITEM NUMBER, I'LL GET TO ITEM NUMBER FIVE.
THIS PARTICULAR ITEM, THESE ARE THE COSTS THAT WE INCURRED DURING THE EMERGENCY STORM EVENT THAT WE ACTUALLY WHERE WE HAD TO MOVE QUICKLY TO SAVE THE PARK THAT WAS GOING TO BE WASHED INTO THE, INTO THE RIVER.
WE HAD TO BRING IN SAND, SOD, ROCKS TO STABILIZE THE LOCATION.
AND THAT'S WHAT THIS ITEM IS ABOUT.
[02:30:09]
TO PERMANENTLY REPAIR, UM, THREE AREAS IN THE CITY, INCLUDING CASTAWAY POINT PARK, WHICH IS IMPORTANT BECAUSE WHAT WE'VE DONE IS, IS, AGAIN, A TEMPORARY SOLUTION, AND WE WANT TO FIND A PERMANENT SOLUTION TO AVOID THAT.SECOND, GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ALL IN FAVOR SIGNIFY BY SAYING I, I I I PASSES FOUR ZERO.
WE ARE NOW ON ITEM NUMBER 11, DEPUTY MAYOR.
BATTEN BILL. BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.
THIS ITEM RELATES TO CONSENT AGENDA ITEM NUMBER TWO.
ALSO BECAUSE IN THAT PACKET IN CONSENT AGENDA ITEM NUMBER TWO, ON PAGE 23, IT HAS THE BREAKDOWN FOR THE COST OF CONDUIT AND FRED POPPY PARK FOR EXPANDING OF THE ELECTRICAL FOR THE ELECTRICAL OUTLETS IN FRED POPPY PARK.
SO ONE MORE TIME YOU'RE USING THE FUNDS $3 MILLION FROM 32908.
RIGHT. AND PUTTING IT INTO 32907.
SO FIRST UP ON THIS ONE, I'M SEEING TWO DIFFERENT GRANT REQUESTS OR APPLICATION REQUESTS FOR THE SAME ITEM, BECAUSE BOTH OF THEM HAD CONDUIT FOR EXPANSION OF THE ELECTRICAL IN THE FRED POPPY PARK.
WELL, THAT'S RIGHT, WE DON'T HAVE ONE ANYMORE.
THANK YOU. ANY OTHER SPEAKER CARDS? YES, MAYOR. MR. OLSZEWSKI. GOOD EVENING, MR. MAYOR. GOOD EVENING. COUNCIL.
I LIVE AT 348 BROOK STREET NORTHEAST.
AND THAT'S IN PALM BAY. THAT'S 32907.
I'M WITH MR. BATON HERE ON THE EXPENDITURE OF IMPACT FEES.
SO NORTHWEST THINKS OF THEMSELVES AS OH SEVEN.
SOUTHEAST THINKS OF ZERO NINE.
SO IN MY AREA, IN MY NEIGHBORHOOD, THE ONLY THING THAT I COULD ADVOCATE AND WORK TOWARDS, AND MAYBE JOIN SOME COMMUNITY BOARDS AND TRY TO INFLUENCE, IS TO BRING IN WITH THESE TYPES OF IMPACT FEES, NEW PARKS.
BUT MY NEIGHBORHOOD, THERE'S NO LAND FOR ANY NEW PARKS.
ALL I CAN DO IS JUST, YOU KNOW, HOPE THAT WE CONTINUE TO INVEST IN FRED LEE.
SO GRATEFUL FOR THE TENNIS COURTS BEING REFURBISHED.
AND WE'RE GOING TO PUT SOME PICKLEBALL LINES.
THAT'S GREAT. BUT WE CAN'T BUILD A NEW PARK A FEW BLOCKS FROM ME.
I CAN'T, YOU KNOW, TAKE MY KID ON HER BIKE OVER TO A PARK.
THEY HAVE BEAUTIFUL ESTATES NOW IN THE MIDDLE OF MY NEIGHBORHOOD.
I'M JEALOUS IF YOU CAN'T TELL.
THERE'S NO THERE'S NO ME GETTING A PARK.
SO I HAVE TO THINK ABOUT THE OVERALL COMMUNITY.
SO SHOULD WE MAKE AN INVESTMENT IN FRED POPPY REGIONAL PARK? MOST LIKELY.
BUT I DO HAVE QUESTIONS OF THE MOTIVE OF THIS PARTICULAR INVESTMENT.
NOW WE'RE GOING TO LOOK AT THE SPACE COAST LIGHT FESTIVAL.
IT WAS BIG NEWS. THE SPACE COAST LIGHT FEST DIDN'T COME TO FRED POPPY REGIONAL PARK THIS YEAR.
AND THEN AT THE SAME TIME, THE CITY OF MELBOURNE WAS IN JEOPARDY OF NOT HAVING A PARADE.
THOSE TWO EVENTS HELD BY FOLKS WITH GREAT INTENTIONS IN THE COMMUNITY THAT ARE FOR PROFIT.
OKAY, BUT YOU KNOW WHAT WE DID HAVE MISTER GARY BROUGHT UP.
I LOVE YOUR FLOAT, MISTER GARY.
IF WE'RE GOING TO HAVE A LIGHT FESTIVAL.
LET'S GET VOLUNTEERS TOGETHER.
LET'S SET UP OUR OWN CHRISTMAS LIGHT DISPLAYS.
LOOK AT THE DISPLAYS THAT ARE GREAT.
I THINK IT'S OUR PLANNING STAFF IS DOING OUR GIS MAP.
WE HAVE THIS GREAT INTERACTIVE MAP OF ALL THE COOL CHRISTMAS HOUSES ALL OVER PALM BAY.
LOOK AT THE MAP. TAKE YOUR KIDS.
AND I WOULD BE UNCOMFORTABLE IF THIS INVESTMENT WAS FOR THAT ENTITY AS OPPOSED FOR US.
[02:35:03]
THANK YOU, THANK YOU.ANY OTHER SPEAKER CARDS? NO, SIR. OKAY.
SECOND. GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
YES, SIR. WOULD YOU ALSO LIKE ME TO SPEAK TO THE IMPACT FEE QUESTION? THAT'S COME UP A COUPLE TIMES.
YES, PLEASE. THANK YOU. SO I'LL DO THAT FIRST, IF YOU DON'T MIND.
UM, SO WHEN WE LOOK AT THE USE OF IMPACT FEES.
PARKS, POLICE, FIRE, WE LOOK AT, UM, SOMETHING THAT'S CALLED A RATIONAL NEXUS.
IT HAS TO BE LEGALLY DEFENSIBLE.
SO OUR CITY ATTORNEY'S OFFICE HAS TO REVIEW ANY USE OF IMPACT FEES.
UM, BUT YOU ARE ALLOWED TO USE FUNDS FROM MULTIPLE IMPACT FEE DISTRICTS IF THERE'S, UM, BASICALLY A DEFENSIBLE ARGUMENT FOR THE SERVICE THAT IS PROVIDED AFFECTING MULTIPLE DISTRICTS.
UM, SO THAT IS HOW WE ARE ABLE TO USE THOSE FUNDS FROM MULTIPLE.
3907 32908 THE SAME, UM, PROCESS IS WHAT WE FOLLOW FOR FUNDING FOR THE MALABAR ROAD DESIGN PROJECT, WHERE WE TOOK FUNDING OF TRAFFIC IMPACT FEES OUT OF TWO DIFFERENT ZIP CODES, BECAUSE THE RESIDENTS IN BOTH AREAS USE THAT ROAD.
SO THAT, AGAIN, IS SOMETHING THAT'S LEGALLY REVIEWED BEFORE WE BRING IT TO COUNCIL.
AND PART OF THOSE AGREEMENTS INCLUDE REVENUE SHARING.
SO THE CITY ACTUALLY MAKES MONEY ON THOSE EVENTS.
BUT TO BE CLEAR, OTHER THAN THE CO-SPONSORSHIPS THAT WE BRING YOU THAT ARE ONLY ONLY NONPROFITS ARE ELIGIBLE FOR CO-SPONSORSHIP APPLICATIONS A FOR PROFIT ENTITY THAT WANTS TO USE OUR PARK FOR ANY KIND OF EVENT THEY WILL PAY.
THANK YOU, THANK YOU MA'AM. GOT.
GOT A MOTION BY COUNCILMAN JOHNSON, SECONDED BY DEPUTY MAYOR FELIX.
ALL IN FAVOR SIGNIFY BY SAYING AYE.
MR. BARTON. BILL BATTEN 586 OCEAN SPRAY STREET, SOUTHWEST.
AND I NOTICE THERE ARE GOING TO BE SENDING THREE PEOPLE TO GET THE TRAINING ON THIS.
AND BUT WITH THAT, I'VE SEEN THIS HAPPEN BEFORE.
PEOPLE GET TRAINING TO ADVANCE THEIR CAREER, THEIR KNOWLEDGE BASE AND STUFF LIKE THAT, AND THEN THEY WELL, YOU KNOW, I COULD WORK FOR THIS COMPANY OVER HERE BECAUSE I'VE BEEN TRAINED IN ALL OF THIS AND WE SO WE WE GIVE THEM WE GIVE THE EMPLOYEES THE TRAINING AS AN INCENTIVE TO KEEP THEM, WHICH WE NEED TO DO, AND THEN WE PAY THEM WHAT WE THINK IS APPROPRIATE.
SO THIS IS JUST A SIMPLE REQUEST.
I KNOW SOME PEOPLE ARE GOING TO HATE ME FOR THIS, BUT LOOK AT THE POSSIBILITY OF WHEN YOU GET YOUR TRAINING THAT THE CITY OFFERS, THAT YOU'RE DEDICATING A CERTAIN LENGTH OF TIME IN EXCHANGE FOR THAT TRAINING.
IT'S NOT GOING TO SAY WE'RE OR YOU HAVE TO PAY IT BACK, SOMETHING LIKE THAT, BECAUSE I'VE SEEN THIS HAPPEN IN SEVERAL LOCATIONS NOW WHERE THE THE TRAINED PERSONNEL LEAVE AND THE PERSON THAT PAID THEIR BILL IS GOING.
JUST A SIMPLE REQUEST AND DOESN'T HURT ANYBODY.
AND YOU STILL GET THE TRAINING TO COINCIDE WITH IT.
THANK YOU. SIMILAR TO WHEN YOU GET ALL YOUR TRAINING AND DON'T RE-ENLIST.
HUH? MASTER CHIEF. SAY THAT AGAIN.
SIMILAR TO WHEN YOU GET ALL YOUR TRAINING AND THEN YOU DON'T RE-ENLIST.
EXCEPT I ALWAYS I ALWAYS READ.
NOT EVERYONE KEEPS GOING 20 YEARS.
BUT, MADAM CHAIRMAN, UH, THE THOUGHT OF GETTING A COMMITMENT, UH, BASED ON CERTIFICATIONS.
SO THIS IS A VERY SMALL, VERY MINOR TYPE OF TRAINING.
UM, BASICALLY WHAT WE'RE SENDING FOR PEOPLE TO DO.
AND THERE'S TWO PEOPLE IN TWO DIFFERENT DEPARTMENTS, SO TWO DIFFERENT DEPARTMENTS ARE REPRESENTED.
THEY'RE GOING TO GET TRAINED ON HOW TO MAKE SOME MINOR REPAIRS TO OUR ACCESS CONTROL SYSTEM.
SO WE DON'T HAVE TO CALL THE VENDOR AND AND BASICALLY INCUR ADDITIONAL EXPENSE.
[02:40:02]
SO IT WILL SAVE US MONEY IN THE LONG RUN.I DON'T BELIEVE THIS IS THE TYPE OF TRAINING THAT WILL MAKE THEM MORE MARKETABLE TO OTHERS.
AND SO I WOULDN'T RECOMMEND A AN AGREEMENT RELATED TO THAT.
AND THE OTHER PART OF THIS IS A MODEL THAT IS A TRAIN THE TRAINER MODEL.
SO I THINK WE'RE IN A GOOD POSITION ON THAT.
SO SECOND, GOT A MOTION BY DEPUTY MAYOR FELIX, SECONDED BY COUNCILMAN JOHNSON.
ALL IN FAVOR SIGNIFY BY SAYING I I HI PASSES FOUR ZERO.
[NEW BUSINESS]
ITEM NUMBER ONE, MRS..UM, I REQUEST THAT COUNCIL MEMBERS ANNOUNCE TONIGHT IF YOU DESIRE TO ATTEND.
YES, MA'AM. I GAVE A THUMBS UP BEFORE, UM.
AND I BELIEVE DEPUTY MAYOR DID AS WELL.
UM, DID YOU NEED THAT IN A MOTION? NO, SIR. OKAY.
OR DEPUTY JOHNSON, UH, COUNCILMAN JOHNSON STATED HE WOULD NOT BE ATTENDING.
UH, BUT DEPUTY MAYOR AND MYSELF ARE ATTENDING.
THANK YOU. AND SO NOW WE'RE ON TO REPORTS, AND I'LL START WITH COUNCILMAN FOSTER.
[COMMITTEE AND COUNCIL REPORTS]
YES, MAYOR.UM, I JUST WANT TO WISH EVERYBODY IN PALM BAY A MERRY CHRISTMAS.
AND I WANT TO, UH, LET THE CITY OF PALM BAY CITY WORKERS, EMPLOYEES KNOW I APPRECIATE THEM.
AND I PRAY AND HOPE THAT THEY CONTINUE THAT IN 2024.
THAT'S ALL I HAVE HERE. THANK YOU.
COUNCILMAN FOSTER. COUNCILMAN JOHNSON, JUST BRIEFLY MAYOR.
HAPPY HANUKKAH, HAPPY KWANZAA.
IF WE CAN GIVE MORE, WE WOULD.
OTHERWISE. IF WE DID BUILD, THAT WOULD BE ON OUR ON OUR NECK.
SO. SO, UM, ENJOY THE 26TH WITH YOUR FAMILY.
YEAH. UH, DEPUTY MAYOR FELIX THANK YOU MAYOR.
SAME HERE. MERRY CHRISTMAS TO EVERYBODY.
JUST REMEMBER THE REASON FOR THE SEASON.
UH, KEEP JESUS INTO THE SEASON FOR SURE.
UM, AGAIN, YOU KNOW, CITY STAFF, THANKS FOR ALL YOU.
YOU GUYS DO DAY IN AND DAY OUT.
YOU REALLY KEEP THE ENGINE GOING.
UM, YOU KNOW, WE JUST UP HERE AND AND KIND OF LOOK GOOD SOMETIME AND, BUT BUT CERTAINLY, UM, YOU GUYS ARE THE ONE REALLY, TRULY I MEAN, UM, CERTAINLY APPRECIATE APPRECIATIVE OF ALL YOU DO.
UM, SO ENJOY THE SEASON WITH YOUR FAMILY.
WE'RE GIVING YOU JUST THE SHORT EXTRA DAY.
BUT THE BOTTOM LINE IS WHAT YOU DO ON BEHALF OF OUR CITIZENS AND HOW YOU INVEST INTO OUR COMMUNITY.
UM, BUT I WANTED TO TAKE A SLIGHT TURN ON THE MY REPORTS.
GENTLEMEN, I WANT TO TALK A LITTLE BIT ABOUT.
WE LOST TWO OUTSTANDING LEADERS IN OUR COMMUNITY.
WE TWO PILLARS IN OUR COMMUNITY.
HE INVESTED SO MUCH IN OUR COMMUNITY, IN OUR AND WE LOST HIM.
SO, UH, MY PRAYERS, UH, FOR PEACE AND COMFORT ARE TOWARDS THE MALDONADO FAMILY.
ALSO, JOHN PASCO, THE FOUNDER OF FAMILY.
OF THE SHIELD. ANOTHER GIANT IN OUR COMMUNITY.
I TELL YOU, I AM ON THE SHOULDERS OF GIANTS.
AND THEY BOTH PALM BEARERS, UH, AND THE BORDERS DIDN'T CONTROL THEM AS AS SOME OF US MAY THINK, THESE GUYS WERE LEADERS AND WHAT THEY DID FOR OTHER FAMILIES OF LIFTING FAMILIES UP, WHETHER THROUGH BOXING OR WHETHER THROUGH ASSISTING FAMILIES THAT WERE IN LAW ENFORCEMENT, UH, THAT THAT WAS WHAT WE LOST THIS PAST WEEK.
UM, AND THEN I WANT TO GO INTO, UH, IT WAS HIGHLIGHTED EARLY WITH OUR INVOCATION.
UH, WE WEREN'T ABLE TO TO DO THAT, BUT, UH, 300 VOLUNTEERS WERE READY TO SERVE THIS COMMUNITY.
HOWEVER, I JUST WANT TO HIGHLIGHT THAT THEY PIVOTED.
[02:45:02]
THEY HAD TWO 75 INCH LG SLIM TVS, SMART TVS, AND WHAT THEY DID ON BEHALF OF THE CITY AND THE CITIZENS.AND THEY DISTRIBUTED, UH, TOTE BAGS FULL WITH GAMES AND, AND LITTLE TRINKETS.
AND I'M SURE THAT YOU'VE PROBABLY SEEN THOSE PICTURES.
WHAT'S SO IMPRESSIVE IS THAT IT DIDN'T TAKE DOWN THAT JOY.
THE JOY OF THE SEASON WAS STILL DEMONSTRATED BY GIVING AWAY ALL THESE, UH, BICYCLES.
UM, AND THEN I JUST WANTED TO TO TO SHARE WHAT A HUGE VICTORY OUR CITY JUST RECENTLY HAD.
THE SACRIFICE PART THAT WE ALL ENVISION TO REALLY HONOR THE SACRIFICE OF OUR FIRST RESPONDERS.
AND I AM I AM SO JOYFUL THAT THAT NOW I'M LOOKING FORWARD TO THE DAY WE TURN DIRT OVER THERE.
AS YOU KNOW, WE GOT $150,000 GRANT FROM THE STATE.
WE ALSO GOT $250,000 FROM THE TOURIST DEVELOPMENT COUNCIL, AND WE RAISED $100,000.
UH, AT THE BOARD OF COUNTY COMMISSIONERS, WE HAD JULIETTE MOSCONI THAT GAVE THE PRESENTATION.
WE HAD JOANIE GIANCARLO BROWN THAT WAS WRAPPING ALL THESE THINGS TOGETHER.
CHRISTINA BOURNE, EVERYONE PUT THEIR HAND TO THE PLOW, AND WE'RE ABLE TO BRING IN A HALF $1 MILLION PROJECT TO ACTUALLY, UH, HONOR THE SACRIFICE AND MY VISION OF HAVING THE FAMILIES OF THOSE THAT SERVE THEIR GRANDCHILDREN TO ACTUALLY STOP AND TAKE A PAUSE AND SAY, YOU KNOW WHAT? THE PEOPLE OF PALM BAY, THIS COMMUNITY TRULY DOES APPRECIATE THE SACRIFICES THAT MY FAMILY LAID ON ON THIS ALTAR.
SO, UM, WITH THAT, I ALSO WANT TO END WITH MERRY CHRISTMAS.
HO HO HO, AND A HAPPY NEW YEAR.
AND THAT CONCLUDES MY REPORT, MADAM CHAIRMAN.
IT'S A LITTLE HARD TO FOLLOW THAT MIRROR.
UM, I JUST HAVE ONE QUICK UPDATE.
AND THE RECREATION AND POLICE.
SO WE HAVE ON WHERE PALM BAY ROAD AND MAIN STREET IS ON MAIN STREET, WE HAVE A COAST GUARD AUXILIARY BUILDING, AS YOU KNOW, AND IT'S UM, IT'S USUALLY AVAILABLE IN THE EVENINGS. SO WE HAVE KIND OF PUT THINGS TOGETHER.
THEY, THEY DO SEEM TO LIKE THAT LOCATION.
SO SO I'D LIKE TO JUST ADD TO THAT, UM, LAST YEAR, UH, WE HAD EMERGENCY FUNDS THAT WE PROVIDED HCI.
IF THAT DOESN'T WORK OUT OR IF IT'S INADEQUATE, I'D LIKE FOR COUNCIL TO CONSIDER, UH, YOU EXPLORING HAVING THOSE FINANCES AVAILABLE TO PROVIDE HCI? NOT FOR US TO MANAGE.
RIGHT, BUT TO PROVIDE HCI WITH THE SAME CAPACITY THAT THEY DID LAST YEAR.
IS IS THEY PUT THEM UP IN CERTAIN HOTELS, UH, FOR SHORT PERIOD OF TIME.
BUT I'M JUST GIVING ANOTHER OPTION THAT WAY.
YOU KNOW, YOU DON'T YOU'RE NOT PIGEONHOLED INTO THAT THAT.
SO, UH, COUNCILMAN OR DEPUTY MAYOR, WHAT ARE YOUR THOUGHTS, MARIO? YOU'RE SAYING IN ADDITION TO.
I'M SAYING IF ONE ISN'T PANNING OUT OR GIVE HER THAT FLEXIBILITY, IT COULD BE.
IN ADDITION, IT COULD BE, UH, IN SUBSTITUTION OF, UH, WHATEVER.
TO GIVE HER A DIFFERENT OPTION IS ALL I'M THINKING.
YEAH, I WOULD BE IN SUPPORT OF THAT.
EXCEPT I THINK THE LAST THE FUNDING WE PROVIDED WERE WAS IT CDBG? WHAT WAS THE SOURCE OF THAT? IT WAS OUR DISASTER RELIEF COMMITTEE, WASN'T IT? OR WAS IT ARPA ARPA FUNDING? JOE KNOWS. I'LL LET HER ANSWER THAT.
IT WASN'T DISASTER RELIEF, BUT I HAD THE SAME THOUGHT AS YOU.
WHETHER THAT WOULD BE AN OPPORTUNITY.
DO WE HAVE, UM, THE AVAILABILITY OF THOSE FUNDS RIGHT NOW THAT YOU'RE AWARE OF? BECAUSE WE'D HAVE TO CHECK ON THAT, TOO.
NO, CERTAINLY I SOURCES WOULD BE WOULD BE WHAT WE NEED TO LOOK AT.
[02:50:02]
YEAH I WOULD CERTAINLY SUPPORT IF WE STILL HAVE FUNDING UM, AVAILABLE.DID YOU HEAR THE CONVERSATION? I DIDN'T, MAYOR, SO WE WERE THINKING.
SO SHE GAVE US A BRIEF REPORT ON, UH, WITH WHERE? THE LOCATION. YEAH. AND I JUST DON'T FEEL COMFORTABLE PIGEONHOLING HER.
IF THAT DOESN'T PAN OUT TO HCI.
LAST YEAR, PUT FOLKS UP WITH A PROGRAM THAT THEY DEVELOPED BASED ON SOME FUNDING PROVIDED TO PROVIDE HOTEL ROOMS. AND SO I IN, IN IN AN EFFORT OF NOT PUTTING HER IN A, IN A POSITION I WANTED TO MAKE THAT AVAILABLE TO, UH, GIVE IT TO HER AS AN OPTION OR IN ADDITION OF.
BUT ARE WE LOOKING AT GIVING A WAIVER.
SO SO I UNDERSTAND THAT BUT BUT UM, FUNDING FROM WHERE? BECAUSE MY, MY UNDERSTANDING WAS THAT ALL THE ARPA WAS UM, WE'LL HAVE TO WE'RE GOING TO CHECK ON THAT.
I DON'T HAVE THE ANSWER READILY TONIGHT BECAUSE I ALSO KNOW EACH YEAR, YOU KNOW, I DON'T BELIEVE HCI APPLIED THIS PAST YEAR, BUT UM, FOR THE CDBG FUNDING, THAT'S OUR OPPORTUNITY THAT THEY GET THE I BELIEVE NANCY EMAILS ALL THE NONPROFITS AND THEY GET ACCESS.
I JUST WANT TO MAKE SURE WE'RE CAREFUL ON PREFERENTIAL I LOVE HCI, UM, I'VE TRUTH BILL IS MY HOME, BUT I WANT TO MAKE SURE THAT WE'RE VERY CAREFUL WITH WHAT WE'RE DOING HERE.
SO THAT'S WHERE I WAS COMING FROM.
I DON'T WANT IF IT FALLS BETWEEN OR IF WE CAN'T DO THAT.
I WANT THEM TO HAVE THE OPPORTUNITY TO HAVE ANOTHER OPTION, AND THAT'S WHERE I'M COMING FROM.
SO THERE'S NO ONE ELSE THAT'S TALKING ABOUT PROVIDING A COLD NIGHT SHELTER.
WELL, WE HAD WE HAD THE SOURCE.
BUT COUNCIL, YOU KNOW, DISAGREED ON THAT APPROACH.
AND EACH YEAR PEOPLE HAVE THE SAME OPPORTUNITY.
BUT I DO UNDERSTAND THEY'RE THE ONLY ONES RIGHT NOW.
BUT WE DID HAVE, UM, OTHERS IN THE PAST, BUT THEY WEREN'T AS WELL RECEIVED.
SO, MA'AM, LET ME ASK YOU THIS.
IF THIS FALLS THROUGH, WHAT'S THE PLAN B IS THERE? OR I MEAN, I KNOW THAT YOU'RE LOOKING AT SEE IF THERE'S ANY TYPE OF FUNDING THAT WE COULD, YOU KNOW, EASILY PIVOT TO.
I GET THAT, BUT WHAT'S THE PLAN B IF THIS DOESN'T WORK OUT AND WHAT WHAT ARE WE WHAT'S THE OPTION.
DO WE IS THERE ANOTHER OPTION THAT WE COULD SEND THEM SOMEWHERE OR WHAT.
WELL I WAS ACTUALLY I DIDN'T EVEN THINK ABOUT ARPA, SO I'M GLAD THAT CAME UP.
I WAS THINKING ABOUT THE DISASTER RELIEF COMMITTEE AND THE POTENTIAL TO SEE IF THERE WAS FUNDING THERE THAT COULD BE ALLOCATED, BECAUSE THAT WOULD BE PROBABLY A LITTLE BIT MORE OF AN APPROPRIATE USE FOR SOMETHING LIKE THIS.
IF WE WERE GOING TO DO IF YOU WERE INTERESTED IN DOING THE HOTEL NIGHT PLAN AGAIN, LIKE HAPPENED LAST YEAR, UM, BEYOND I WOULD I WOULD SAY WE ARE GOING TO BE CAREFUL BECAUSE WE DON'T WANT TO.
WE HAVE TO HAVE A PROCESS FOR THINGS LIKE THAT.
SO WE WILL BE CAREFUL ON THAT.
UM, BUT I FEEL BASED ON WHAT STAFF HAS SHARED WITH ME, THAT THIS IS LIKELY TO WORK OUT.
SO I APPRECIATE THE OPPORTUNITY FOR FLEXIBILITY.
I HAVE TO COME BACK TO YOU ANYWAY SO I CAN'T, YOU KNOW, MAKE THAT DECISION TONIGHT.
BUT I APPRECIATE KNOWING WHERE YOU ALL STAND ON THAT.
OKAY. ALL RIGHT. THANK YOU MA'AM.
SO DOES THAT CONCLUDE YOUR REPORTS, MA'AM? YES. OKAY, SO, MR. RODRIGUEZ, I HAVE NO REPORTS.
WELL, THANK YOU, SIR, AND THANKS FOR JOINING US TODAY.
AWESOME. SO NOW WE'RE AT PUBLIC COMMENTS.
UH, YOU HAVE A CARD THERE, DEPUTY MAYOR? YES, SIR. UH, MR. WARREN.
[PUBLIC COMMENTS/RESPONSES (Part 2 of 2)]
BUTCH.EXCUSE ME. BUTCHER RAN 219 TRENTON AVENUE.
UM, I GUESS IT'S TRUE. THE SQUEAKY WHEEL GETS THE GREASE.
UH, I'D LIKE TO REPORT THAT THE PUBLIC WORKS GUYS WAS AT MY HOUSE THIS AFTERNOON.
I'M GOING TO CALL IT A SUB DITCH.
I DON'T KNOW WHAT WHAT YOU ACTUALLY CALL IT.
AND THE POND THAT I HAD IS NOW DOWN TO A CREEK.
[02:55:01]
SO. AND THOSE TWO INDIVIDUALS WAS A FRANK AND A JAMES THAT COME TO THE HOUSE AND I'LL GET WITH, UH, JOHN BACK THERE.UM, BUT I WAS REALLY SURPRISED THAT IT WAS SO QUICK.
THE ONLY THING THAT STILL BOTHERS ME IS WE STILL HAVE THE DRAINAGE PROBLEM THROUGHOUT THE UNIT.
CORRECT OR NOT? OH, I THINK IT'D BE.
WELL, I DON'T KNOW, BUT I CAN TELL YOU THAT I'VE HAD SEVERAL EMAILS, UH, THAT COME OUT AND PUBLIC WORKS HAS BEEN VERY RESPONSIVE. YES, THEY ARE.
SO YOU KNOW, IT'S IT'S DAMMING UP UPSTREAM.
SO I'LL JUST TALK TO HIM AND LET HIM COME OVER AND EXPLAIN HIS SITUATION.
BUT I DO WANT TO SAY THANKS TO THE PUBLIC WORKS GUYS.
UH, NUMBER ONE DRAFT PICKS, BOTH OF THEM.
SO, AND I'LL GIVE MR. JOHN A DESCRIPTION ON IT.
THANK YOU SO MUCH. OH, AND, UH, GOOD LUCK TO THE SEMINOLES DOWN IN, UH, ORANGE BOWL IF THEY DECIDE TO GO NOW, I HEAR PLAYERS ARE SAYING THEY'RE NOT GOING TO PLAY, SO I DON'T KNOW WHAT'S UP WITH THAT, KENNY.
SORRY. SO Y'ALL HAVE A GREAT HOLIDAY.
MERRY CHRISTMAS. UH MRS. THIS. GOOD EVENING, ROBERT.
I WANTED TO COME UP HERE AHEAD OF MR. GRINCHY. OVER HERE. WHO'S GOING TO END? BUT, UM, I JUST I'M GOING TO BE A LITTLE SENTIMENTAL HERE.
WORSHIP PERSON LIVES, UH, WORSHIP DIRECTOR LIVES IN PALM BAY.
AND IT TOOK ME BACK TO MY CHILDHOOD, WE HAD, UM, UH, MAILBOXES AND BASICALLY THEY SPECIFICALLY WENT TO CHILDREN WHOSE PARENTS WERE INCARCERATED. AND SO WE PICKED UP A COUPLE OF SLIPS THAT WE HAD TO BUY.
I WORKED ON THE OTHER, BUT IT TOOK ME.
IT TOOK ME BACK BECAUSE, UM, I GREW UP IN THE 60S AND 70S, AND I REMEMBER ASKING FOR A BASKETBALL FOR CHRISTMAS THAT YOU GOT ONE THING NEXT YEAR AFTER THAT WAS A WAS A BASEBALL GLOVE AND WENT AND PLAYED BASEBALL WHATNOT.
BUT IT JUST BETWEEN THAT AND MEALS ON WHEELS AND WE DID A LOT OF COLORADO.
BUT WE'RE DOING THERE'S MORE OPPORTUNITY HERE.
ALSO, UH, SUZANNE, YOU AND YOUR STAFF.
UM, I DON'T KNOW IF THEY SAID THE MARINE CORPS IN THE NAVY, WE SAID FOUR ZERO.
YOU GUYS DID IT OUT OF THE PARK.
MERRY CHRISTMAS, MERRY CHRISTMAS.
UH. MASTER CHIEF AND THEN MR. GARY. WITH CIGAR.
YOU WANT TO SIT UP FRONT SO YOU CAN COME RIGHT UP.
BILL BATTEN, 586 OCEAN SPRAY STREET, SOUTHWEST.
I'VE GOT THREE ITEMS TO QUICKLY ADDRESS ON THIS ONE.
THE NEW LAW THAT WAS JUST PUT OUT THAT THE FINANCIAL DISCLOSURES OF ALL ELECTED OFFICIALS.
I'M NOT DOUBTING HOW YOU GUYS MAKE YOUR MONEY.
I'VE SEEN I'VE SEEN WHAT I GIVE YOU.
I WANT TO SEE THE REPORT SO I KNOW WHICH STOCK TO START INVESTING IN.
RIGHT UNDER THE HISTORY OF PALM BAY.
AND IT SEEMED LIKE I WAS CONSTANTLY TOLD, NO, YOU CAN'T DO THAT.
WELL, THAT'S THE SAME THING WE'VE BEEN REQUESTING BEFORE.
SO I'M NOT DOUBTING THAT THE LEGAL FOUND A WAY TO DO IT, OTHERWISE THEY WOULDN'T DO IT.
[03:00:05]
BUT THE FACT WAS, WHEN WE NEEDED CERTAIN THINGS IN CERTAIN AREAS, IT WAS DENIED BECAUSE IT WAS THE WRONG AREA CODE, EVEN THOUGH FUNDING WAS AVAILABLE IN ANOTHER AREA THAT WAS RIGHT NEXT DOOR TO IT.SO THAT'S WHY I HAVE THE HATE AND DISCONTENT WITH IT.
COULD BE VERY BENEFICIAL IN THE FUNDING SOURCE TO THE SOUTH, DIRECTLY ACROSS MALABAR ROAD FOR THE UP AND COMING COMPOUND PROJECTS THAT WE'RE TRYING TO GET PUSHED. AND I'M HOPING THAT YOU'RE GOING TO SAY, OKAY, THAT'S REAL GOOD.
NOW WE'RE GOING TO TAKE THREE TWO, NINE ZERO FROM THE OTHER OTHER AREA AREA CODES.
AND. PUT THAT DOWN SOUTH NOW BECAUSE WE PUT OURS UP NORTH.
THAT'S WHAT I'M REQUESTING BECAUSE WE FOUND OUT THAT IT WILL BE A JOINT USE.
AND THE FINAL ITEM IS MERRY CHRISTMAS TO ONE AND ALL.
EVEN THOUGH I AM A PAIN IN YOUR REARS.
ANYONE ELSE? OH, MR. ALFIE. YES, SIR.
GOOD NIGHT AGAIN, MR. MAYOR. AND COUNCIL MEMBERS AND STAFF.
UM, ALTHEA, GUARD FROM 1680 MAIN STREET, NORTHEAST PALM BAY.
UM, BEFORE I FORGET, YOU HAD MENTIONED SOMETHING THAT I HAD IN MIND FOR A WHILE.
UH, ABOUT THESE TWO FALLEN OFFICERS.
UM, ANYTIME THAT PROJECT STARTED, I WOULD LIKE TO BE INVOLVED.
UM, YOU KNOW, I'M A LOCAL VENDOR IN OUR CITY, AND I'M IN THE CONSTRUCTION BUSINESS, SO IF YOU EVER NEED SOME FILL DIRT OR SOME SAND OR SOMETHING ON THAT PROJECT, I'LL. I'LL CONTRIBUTE IT BECAUSE I WAS HERE.
I THINK THAT INCIDENT PROBABLY HAPPENED IN 1987 OR SOMEWHERE.
APRIL 23RD, 1987 OR SOMETHING.
UM, THE OTHER THING I WANT TO SAY IS I WAS KIND OF SURPRISED.
A FEW MONTHS AGO, I CAME TO RENEW THE TAX RECEIPT FOR MY BUSINESS GAS STATION, AND I USED TO PAY LIKE $325 A YEAR, AND IT WENT UP TO 1500 AND ABOUT $55.
AND I WAS SURPRISED BECAUSE I WAS LIKE 300%, 400%, MAYBE.
SO THAT'S ONE THING I WAS WANTED TO MENTION.
